Annual Session, November 12th, 1912.
The County Board of Supervisors of Bayfield County met in annual session
at the office of the County Clerk, November 12th, 1912.
Board called to order by Chairman Martin Rogan, at 10:30 A. M.
At roll call the following members were found present.
Herman Sense, Pat Galligan, George S. Barnes, Walter Flieth, Peter Soronen
F. H. Bartlett, Geo. A. Curry, M. B. Morris, Algert G. Johnson, Ben Holm,
C. H. Werden, Fred Antonson, John Pyykola, Hans Peterson, Erick Johnson, W.H.
Nettleton, W. E. Tripp, A. P. Stone, Ike Berman, T. H. Robinson, Geo. Mertz,
Ole Aune, Ole Dahl, Ole Ramstad and Martin Rogan. -25.

The following petition and resolution was presented; petition accept-
ed and resolution was upon motion adopted:
To the County Board of Supervisors of the County of Bayfield, State of Wiseonsa
Your petitioner, Red Cliff Lumber. Company, a Wisconsin corporation, respel
fully represents and -shows to your honorable body that it is the owner in fee
simple of the following described lands lying and being in Bayfield County,
Wisconsin, to -wit: the Northwest quarter of the Southeast quarter (NW-4 of
SE4) of Section Twenty-eight (28) in Township Fifty-one (51) North of Range
Five-(5) West, by purchase and conveyance thereof from Johan Olof Nordin, who
was the patentee thE)reof fhom the United States. That said lands were duly
entered at the United States Land Office by the said patentee August 7th, 1901
and were thereafter duly patented unto him.July 22nd, 1902, and whichtsaid-
pdtant was duly recorded in the office of the Register of Deeds of said county
in Book 47 of Deeds on page 39 thereof.
That a tax was levied, taxed and assessed against said lands in the year
1894, and long prior to the entry thereof aforesaid, and the issuance of a
final receiver's recel-pnt upon said entry; and that thereafter such proceed-
ings were had because of the nonpayment of said taxes the same were sold at
the tax sale -on May 21st 1895 to Bayfield County at and for the sum of $1. 94;
and that thereafter a tax deed of said lands issued by said county and state b
to one Paul Buol bearing date June 5th 1899, which was recorded in the office
of the Register of Deeds of said county on June 6th 1899 in Book 2 of Tax
Deeds on page 401 thereof.
That a tax was levied, taxed and assessed against said lands in the year
1895, and long prior to the entry thereof aforesaid, and the issuance of a
final receiver's receipt upon said entry; and that thereafter such proceedings
were had because of the non-payment of said taxes the same were sold at the
tax sale on May 19t13 1896 to Bayfield County at and for the sum of $2.32; and
that thereafter a tax deed of said lands issued by said county and state to oe
one Paul Buol bearing date September 25th 1899, which was recorded in the of�,
fice of the Register of Deeds of said county on September 25th 1899 in Book 2
of Tax Deeds on page 463 thereof.
That the said taxes so levied, taxed and assessed against said lands
for said years, and each thereof, was and is wholly illegal, for the reason
that said lands were not them subject to taxation, being at said times the
property of the United States; and that the said tax sales of said lands, and
the said two tax deeds issued thereupon as aforesaid were, and ever since have
been, illegal and void for the same reasons.
That said tax deeds constitute clouds upon the title of your petitioner
to said lands; and that by reason of their illegality as aforesaid the same
should be cancelled and annulled by your honorable body.
WHEREFORE your petitioner respectfully prays that you will by order
direct -the cancellation of the said tax deeds and each of them, whereupon the
county clerk of said county may issue a certificate in writing under his hand
and official seal stating the fact of such cancellation, and otherwise, pur-
suant to the provisions of Section 1184A of the Wisconsin Statutes of 1898,

ORDER.
On reading and filing the foregoing petition, and it having been duly
determined by the County Board of Supervisors of Bayfield County that the facts
in said petition set forth are true, and that the relief there asked should be
granted,
IS
NOW THEREFORE, IT• HF.REBYN ORDERED by the County Board of Supervisors
of Bayfield County Wisconsin that the said tax deeds, and each thereof, in the
foregoing petition mentioned and described be and the same hereby are, and each
of them is, and that -the same shall forever stand as, cancelled for the reasons
of the illegality thereof expressly set forth and stated in the said foregoing
and annexed petition to -wit: for the reasons that the said lands were at the
time of the assessment and taxation thereof in each of said years 1894 and 1895,
and at the time of the tax sales thereof aforesaid, and at the times of the i
issuance and delivery of said tax deeds and each thereof, and the recording of
the same, the lands and property of the United States, and thereby were not sub-
ject to assessment and taxation, whereby t'.).e said taxes and the said tax sales,
and the said tax deeds, and each thereof were and are and ever since have been
illegal and void; and that the County Clerk of said County Board shall furnish
to the said petitioner a certificate in writing under his hand and seal stating
the fact of such cancellation, the date thereof, the description of the lands
as to which such deeds are cancelled, the dates of such deeds, and the,respec-
tive dates of sale upon which such deeds are based and the said reasons for such
cancellation, pursuant to the provisions of the statute in such case made and
provided, and particularly, Section 1184A of the Wisconsin Statutes of 1898, be-
ing Chapter 44 of the Laws of Wisconsin for the year 1901.

The following resolution was -presented and was pppn motion adopted.
Whereas, it -appears by the county records in the offices of the county
clerk, register of deeds and the treasurer for Bayfield County, that a certain

porting to convey the Southeast quarter of the Southwest quarter of section Thirty-
three, township fifty north, range Four west, and said deed being based upon a tax
certificate upon said land, sold illegally and without authority of law, at the tax
sale of May 16, 1893; the grantee of said deed being the Superior Trust Company, a
cprporation; said deed being executed on the 26th day of October, 1896, and being
recorded in the office of the register of deeds in and for said county at Volume
two of tax deeds on page 118, and,
Whereas, said certificate of sale and said tax deed based thereon were is-
sued and executed illegally and without authority of law for the reason that there
is and was at the times herein stated no land legally described as sueh, the land
intended to be conveyed by said certificate and deed being a part of lot three of
said section 33-50-4 West; and
Whereas it appears by an entry dated May 15, 1898, at page 182 of the co
county treasurer's journal, tha.t said certificate and deed were cancelled and the
amount received by Bayfield County upon the sale of said certificate was returned
to Superior Trust Company by county order No. 663, whereupon said Superior Trust
Companyrreleased,its interest in and to said landsby executing and delivering to
Bayfield County a quit claim deed, which said deed was recorded in the office of
the register of deeds, aforesaid, at Vol. 35 of deeds, on page 378; and,
Whereas it appears, as the fact is, that said Bayfield County acquired no
right,, title or interest in or to said land under or by virtue of said tax certifi-
cate'or by said deed of 'conveyance, or either of them, and said Bayfield County
makes no claim of any kind to said land.and it further appears that the title to
said land is now, in George H. Whiting;
Now, Therefore,
BE IT RESOLVED? by the County Board of Bayfield County, duly assembled this
12 day of Nov. 1912, that Nels M. Oscar, county clerk in and for said county be and
he is hereby authorized and directed to execute for and on behalf of said Bayfield
County a quit claim deed to George H. Whiting, conveying and quitclaiming any and al
all right, title and interest of said county to said Southeast quarter of the South-
west quarter, or to lot three, of said section Number thrty-three, township fifty
north, range four west.

The following petition was presented and was upon motion referred to the
Committee on Illegal Taxes and Tax Certificates.
TO THE HONORABLE., THE COUNTY BOARD OF BAYF'IELD COUNTY:
Gentlemen:
Bayfield County Land Company makespetition and shows to your honorable B
Board, as follows:
That the South half of the Southeast quarter (52-SE1) of section twenty-
four (24), the Northwest quarter of the Southwest quarter (NWT-SW-4), the Southeast
quarter of the Southwest quarter (SEL - SW1) and the Southwest quarter of the South-
east .quarter(ST-;--- SEa) of section twenty-eight, in township forty-nine (49) north
of range seven (,7) west, was returned delinquent for taxes; that your petitioner
obtained tax certificates on said land in section twenty-four (24) for nine years
last .past and on -said land in section twenty --eight (28) for seven years last past,
and that your petitioner has three tax deeds on said lands; that said tax deeds are
for the certificates on said lands for the years 1906, 1907 and 1908; that hereto
annexed, marked"Exhibits A -and B, " is a true and correct statement of the tax cer-
tificates outstanding against said premises, and of tax deeds issued thereon; that
it appears therefrom that the County of Bayfield obtained tax deeds on said lands
upon the certificates of 1902 and 1903; that your petitioner brought suit in the
circuit court of Bayfield County against William Coach and Mrs. William Coach}} his
wife, Clara Whitman Gibbs, Charles A. Sweet and Mrs. Charles A. Sweet, his wife, who
were the original owners of said premises", and also againstBayfield County; that
the object of said action is to quiet title to said premises; that the said Bayfield
County has appeared in said action by E. C. Alvord, the district attorney, and set p
up the claim to .said premises under said tax deeds so issued to Bayfield County as
aforesaid; that .if the court should hold that the three tax deeds issued to your
petit -loner, Bayfield County Land Company, are void, the County of Bayfield Will be
obliged to remit to your petitioner the face malts of all the certificates obtained
by it and interest; that said premises are north a little more than the amount of
said taxes;
THEREFORE, your petitioner offers to the County of Bayfield the sum of T
Twentyd-fi,ve($25.00) Dollars for a quit claim deed of said premises so as to clear
the titl6 to said lands as to the said County of Bayfield.

The following report of the Committee on Roads and Bridges was presented and
was upon motion adopted:
To The Honorable County Board of Bayfield County:
Gentlemen:
Your committe-emade a trip of inspection of the County system of highways
starting from Iron River May 24, 1912, going out over the road through the town
pf Oulu. We found the road in fair condition with the exception of some old wood
en culverts, which needeto be replaced. On.May.25 we left Iron River for Port
Wing and found this road in rather. poor condition except about six miles on the
Port Wing end of the road, which was in fairly good condition. The entire road
needed regrading and new culverts. The Committee was unable to go over toe Count'
road from Port Wing to Herbster for the reason that.about four miles of the'road
was only cleared out and stumped. This part of the road is still in the same conq
dit ion.
The Committee leftt Herbster on County Road leading to Cornucopia -and found 1:
this road in very poor condition, needing drainage and raising of road beds over
flats, and the old bridge over Bark Creek in poor condition. This bridge has
since been specified to be rebuilt under state aid in 1913. From Cornucopia to
Bayfield we found the first three or four miles in good condition, But from there
on until we came to Wachsmuth's Camp we found the road in bad shape, especially
the bridge across Sand River. From Waehsmuth's Camp to Bayfield we found the roa
very narrow, but in good condition. From Bayfield to Washburn we found the road
in fair shape except Sioux River flats, which need to be surfaced with clay, as
it is a sandy piece of road.
From Washburn to A'sti;land Junction we found the road in need of a general re-
building. A number of old bridges were found to be unsafe, some of which have
since been replaced with concrete arches. The long bridge or "Bridge 'of Sighs"
at that time was supposed to be abandoned, and your Committee paid no attention
to it.
From Ashland Junction east to the Bayfield County line we found the road in
rattier poor condition, in need of a general regarding, and the bridge over the
south fork of Fish Creek was in bad.shape. The Contract has since been let for
the replacing of this bridge with a sixty -foot steel bridge, under state aid.
From Ashland Junction to Benoit we found the road in need of drainage and
regrading. From Benoit to Bibon the road was in fair condition with the excep-
tion of two or three bridges, which need replacing. From Bibon to Grand View the
road was in bad shape, especially a piece about three wiles in length across the
Bibon swamp, which needed raising and surfacing, which has since been done. All
the dirt was hauled on wagons.
The road from Grand View to Drummond we found in a poor condition, needing
general overhauling, such as reducing the grades of the hills and the installing
of a large amount of culverts to give the road drainage.
From Drummond to Cable the road was im a fair condition, but very narrow.
From Cable to the Sawyer County line we found the road in need of but very little
repair, there being a few hills &n this road that should have the grades reduced.
From Drummond to Barnes we found the rand in a bad condition. Considerable
work would have to be done to put it in.a passable condition.- The whole of this
road is very narrow.
From Barnes to Iron River the road was in fairly good condition, excepting
a new piece of about two miles, which was under construction•. The Committee
found that whole system, with a few exceptions, was greatly in need of culverts
for drainage.
When your Committee got bast to Iron River on May 28 we expected to proceed
to test out traction engines, for road work, with a view to buying, as we
idotructed to do by the County Board if found satisfactory. As one of the engine'6
had not arrived, it was necessaty for us to wait for its arrival. When it came we
proceeded to test them out. The first piece of road was dry, sandy road, and.bot
engines did satisfactory work. -We ndxt selected a piece 'of clay road, which was
in a wet condition, and on this piece of road the traction engines proved a failure.
At a meeting of your Committee, held at Iroh River, it was decided not to
make the purchase, but to hire teams. We soon fpund.we could not get teams, and
letter was sent by the Committee to all the members of the County Board for the
purpose of getting their views on the proposition of, the County buying teams for
County road work. The majority of the answers tp these letters were in favor of
buying teams. It was then decided by your Committee that the Highway Commission-
er and one member of the Committee go to St. Paul for the purpose of buying team
We looked over horses in different sale stables and found we were unable to get
suitable horses to do County road work. We then reconsidered the engine proposi
tion and took the matter up with the J. I. Case Company and finally decided to
buy a traction engine, also wheel scrapers and other road tools.
Your Committee together with the Highway Commissioner called for bids for th
supplying of galvanized culverts. We purchased of Bark River Bridge & Culvert Cc.
culverts of different sizes, the cost of which agiounted to $4,640.18.
Since the time of the purchase of machinery and culverts your Committee has
not been over the.County system of highways for the reason that we could not see
no advantage to be gained by so doing, as we uhderstand that the new state aid la _
under which we are working, places all the responsibility,hfdr the construction and
maintaining of county highways upon the County Commissioner of Highways; and you
Committee wish to refer you to the Commissioner as to the present condition of
the County highway system.
In referenee,to that part of the road being built between Washburn and Nash
and®r btate aid. Estimated cost of this piece of worn made by the state was $
$3300.00, all complete according to survey and specifications. Up to Nov. 1st,
1912,..-ac-tual expense on file for this pieces of road is $3,149.30. Besides, they
are -autstanding bills against this work, to the best of our information, to the
amo!un� of $700.00. This work is not yet completed, and it is the opinion of 'this
Committee that it will take about $850.00 to complete the work according to plan
end specifications. From the above figures it appears that the cost of this work
overruns -estimate placed by the state engineers in the sum of $1400.00.
Your Committee has at all times endeavored to aid the Commissioner in his
work, as ate realized from experiemse of past committees that chances of success
were greater by trying to work in harmony with the commissioner than to oppose
him. The County Board, at the meeting of Aug. 1.6, 1012, expressed the decided
opinion.that the money to be expended in repairs of the county system should in

all cases be specified as to amount anal location, and not to be overdrawn. There
was at that time available for repairs. of the entire county system about $2000.00.
Your Committee has tried to carry out.the expressed wishes of the County Board, and
with this end in view, we immediately adopted -the following resolution for the gui-
dance of the Commissioner:
Resolved, that the repairs to be made upon the County system of highways in ac-
cordanse with resolution adopted by the Bayfield County Board on Aug. 16, 1912, be
and the same is hereby apportioned between the different towns as follows:
Town of Clover repairs not to exceed $300.00
Trown of Pratt repairs not to exceed 300.00
Town of Lincoln repairs and culvert not to exceed 200.00
Town of Drummond repairs on Cable road 200.00
Town of Eileen repairs not to exceed 50.00
Town of Barksdale repairs not to exceed 100.00
Town of Washburn repairs not to exceed 200.00
Town of Port Wing repairs and culverts not to exceed 250.00
Town of Orienta repairs not to exceed 100.00
Town of Tripp repairs not to exceed 50.00
Town of Oulu repairs not to exceed 50.;00
-"And be it further resolved that the Highway Commissionerbe, and he is hereby instruct
ed to arrange for storing and housing road machinery and tools at Washburn, and that
said tools be collected and properly stored at the close of season's work.
Your Committee find that the amounts specified as above have been generally over
drawn. As to the amountsof these overdrafts, and the reasons for the same, we refer
you to tho County Highway Commissioner, as he is, or should be, familiar witty the
same. As to the housing and storing of the machinery and tools, there have been no
arraggements made so far as we 4now.

ing and conducting the management of the highway business of Bayfield County, as
handled by the Commissioner of Highways, tends towards extravagance on account of
carelessness, -thoughtlessness and lack of attention on the part of the Highway
Commissioner., In the opinion bf your Committee, better results could be obtained
if the County system of highways was maintained by the towns in connection with
county and state aid, if this could be legally done.

The following petition was presented and was upon motion referred to the.
Committee on Roads and Bridges; '
To the Honorable the County Board of the County of Bayfield, in the state of Wis-
consin:
The petition of the town board of the town of Barksdale•.respectfully repre-
sents to your honorable body and alleges:
That said town has voted to construct a bridge over Fish Creek, at the head
of Chequamegon Bay, in section 36;-township forty-eight north,, range 5 west, wholl
within said town, on th.e,main travelled highway leading from the town of Barksdale
aforesaid to the city of Ashland; that the cost thereof will exceed twelve hun-
dred dollars and will amount t-o ten thousand dollars.
That the total valuation of said town, according to the last assessment, as
equalized.by t#e county board of said county, is more than $60.0,000.00.
That said town has provided for the payment of such proportion of the cost
of the construction of said bridge as is required by section 1319 of the Statutes
of 1898, as amended by Chapter 39y of the laws of 1909; and Chapter 435 of the.
laws of'1911, namely, for V2e sum of five thousand dollars, and has raised said
sum for said' purpose by the sale of its bonds.
Your petitioners therefore pray that your honorable body appropriate such
suns as required by the aforementioned statutes, to -wit, the sum of five thousand
dollars, and cause said sum to be levied upon the taxable property of saidcounty
and designate two of your members -to act as your commissioners and cooperate with
the town board of said town in the premises, in accordance with the statutes in
such case made and provided.
And your petitioners will ever pray.

WHEREAS the Legislature of the State of Wisconsin did create a Third Muni-
cipal Court for Bayfield County, said act being Ohapter 3.80 of the Laws of 1911,
wherein and whereby the salary to be paid to the Municipal Judge of saifi court
for his services in conducting criminal trials and examinations was fixed for tle
first term by the terms of said act, and
WHEREAS it was further provided by said act that the salary of said Muni-
cipal Judge thereafter should be fixed by the County Board of Bayfield County,
NOW, THEREFORE, be it resolved that the ,salary of the Municipal Judge for
the Third Municipal Court for Bayfield County for the term beginning May 1, 1917,
shall -be and is hereby fixed by said County Board of Bayfield County at Six Hun-
dred Dollars per annum, the said salary to be and remain at the said sum of Six
Hundred Dollars per annum until otherwise determined by this county board, or by
law.

November, A. D. b912,.that the salary of the county judge of said county bd and
the same is hereby fixed at the sum of Fifteen humdred dollars per annum, pay:"l.
able in regular monthly installments at the same time and in the same manner as
the salaries of other county officers are paid.
Be it further resolved that the resolution passed and adopted on the 23rd
day of January 1911, providing for Clerk hire for the County Judge be and the
same --is hereby repealed and recinded.

Annual Session, November 12th, 1912.
The following resolution was presented and was upon motion adopted:
Whereas it appears by the County Records in the office of the County Clerk of
-Bayfield County, Wisconsin, that a certain tax deed has been issued without author
ity of law, as"to the North-west quarter of the north east quarter, and lots two
(2) and three (3), of section eight (8), Township Forty4four (44), North, of Range
Nine (9) West, by reason. of the fact that said tax deed was based on the tax cer-
tif-i.cates for the Sale of 19071, taxes of 1906, and duly dated May 26th, 1910, and
was issued to Frederick Ayer, assignee of Geo. F. Morgan, which tax deed is illega
as said lands were during all of said year 1906, Government land and could therefc
not be lega-lly ,assessed. Further, that said tax deed is recorded in the office of
the Register of Deeds in and for Bayfield County, Wisconsin, in Volume four (4) -of
Tax Deeds on page 448. Further, that the Patent granting said lands is dated
October 4th,.1909, and is recorded in Volume 37 of Pateats on page 570. Further,
that it appears from the Abstract's of Entries in the office of the County Clerk
of Bayfield County, Wisconsin, that said lands were entered at the U. S. Land Off!
on lot day of February, A. D. 1909.
Therefore be it resolved by the. County Board of Bayfield County duly assemble
in annual session, this 12th day of Novi 1912, that the said Tax Deed hereinbefore
described so far as the•same relates to the above described lands, be, and the sau
is hereby. cancelled. And be it further,
Resolved, that the money paid for the said certificates and -all subsequent
charges thereon be refunded, with interest at the rate of 7 per cent per annum, ac
provided by Section 1184 Statutes 1898. And be it further, Resolved, that the Cot
Clerk be directed to furnish a certificate to the owner of said land, stating the
fact of such cancellation, as provided by Section 1184, being Chapter 44, Laws of
1901.

t24), the Northwest quarter of the Southwest quarter (NWi - SW-4), the Southeast
quarter of the Southwest quarter(SE4 �- SW4) and the Southwest quarter of the South
east quarter (SW - SE,L) of section twenty-eight (28) in township forty-nine (49),
north of range seven (7) west, for the payment to the County of.'Bayfield of the st
of Twenty-five ($25.00) Dollars.

portance of the petition to Bayfield County, also to the town of Barksdale we ask'

The following resolution was presented and was upon motion adopted:
Whereas, the Wisconsin Legislature of 1911, passed a law commonly referred
to as the "State Aid Highway Law", and known as Chapter 337, Law of 1911, and
Whereas, we, the County Board of Bayfield County, Wisconsih,deem said law
impracticable, unnecessary and productive of less good for the same expenditure,
than came from former laws pertaining to the building og highways. Now, Therefore
be it • '
Resolved, by the County Board of Bayfield County, Wisconsin, that we declare
said law to be an imposition, in as much as it is called the "State AID Law",whwn
in fact the law does not provide for any funds not raised by direct taxation upom
the property in the several towns, cities and villages, in which the highway fund
is expended: and that said law is too expensive in its execution for th®amount of
good that can come by or through its enforcement, And be it further
Resolved, that this Resolution be spread upon the Records of County Board
Proceedings, of Bayfield County, and that the County Clark be and he is hereby in4
strutted to send a copy of same to each member of the Wisconsin Legislature prior
to the session thereof to be held in 1913. Be it further
- Resolved, that said law should be repealed, and that the members of the Bayf:
County Board use all honorable means to that and.
