The undersigned members of the County Board hereby requests you to call a meeting of the County Board, for the purpose of organizing, and for the transaction of such other buisiness as may legally come before such meeting. At roll call the following members were found present: Holston, Galligan, Thorsen, Juel, Foss, Soronen, Bartlett, Kekhofer, Miller, Johnson, Iverson, Yderstad, Axxness, Good, Hopkins, Vester, Duffy, Habelt, Johnson, Smith, Ellerman, Stone, Kransfelder, Lidreas, Robillard, Bell, I3eavey, Handberg, Robinson, Johnson and Barnes. Absent, Clausen. Board upon motion proceeded with the election of Chairman for the ensuing year. Supervisors, Erick Johnson and Pat Galligan were appointed tellers. Informal ballot resulted as follows: YThole number ballots cast 329 of which James ,'1. Good, received 9, George Mertz 12 Peter Soronen, Jr. 4, George Barnes 2 and A. P. Stone 5. Formal ballot resulted as follows: Whole number votes cast 329 of which James W. Good, received 7, A. P. Stone 4, George IdIertz 21. - George Irlertz having received a majority of all votes cast, was declared alected Chairman for the ensuing term. The application of Alfred Idarsh for re -appointment to the position of Janitor of the Court House, was presented. Upon motion 1dr. Larsh was elected at the same salary as in the past. Upon motion the price for publishing the proceedings, notices ordinances etc. of the County board, in the official paper was fixed at thirty cents per folio. Election of official paper: Informal ballot resulted as follows: 'si�.riole number votes -cast 32, of Which the Bayfield County Press -received 11, The Washburn flews 3 and the 1fashburn Times 18. It was moved seconded and carried that the informal ballot be declared formal hnd-ithat )'Uhec ,'dashbu:bn_-f2i.ines be declared elected the official paper for the ensuing year. The following resolution was presented and was upon motion adopted: I'Vhereas, judgment has been rendered in favor of the town of Idason and against the unite Diver Lumber Company, a Wisconsin Corporation, for the tax assessed to said Company upon its income earned. in the year 1914, the amount of said judgment is 'j�4942.33, the same having been entered in the office of the Clerk of the Circuit Court of Bayfield County, on the 3rd day of April, 1916; and whereas, no part of said judgment has been collected, and said company has np property in this state so far as can be ascertained; and whereas said company had assets far in excess of said income,,which it distributed among its stockholders in the year 1914; now Special session, Inlay 2nd, 1916 therefore BE IT RESOZ�;D, that the District Attorney of this countybe and he hereby is directed,to take such steps as he deems proper or suitable for the -collection of said judgment, and he is•hereby authorized and directed, it in his opinion it shall be necessary, to commence an action against the stockholders of said company to enforce satisfaction of said judgment. Be it further resolved, that Wm-. F. Shea, an attorney at law of Ashland, Wisconsin,) be and he hereby is retained to assist said District Attorney in the prosecution of said litigation. 0. I1. Axness. The petition of the hloquah Guernsey Cattle Fair by T. Hall, President was presented to the Board. The following resolution was presented: RESOLVED, by the County Board of Supervisors of the County of Bayfield, in special session duly assembled;, That there be and hereby. is appropriated to It2oquah Guernsey Cattle :Fair the sum of one hundred. dollars (ja1OO.00) for t)xe purpose of paying premiums for the best Guernsey Cattle at the I;Zoquah Guernsey Cattle Show. Said money to be paid to the Treasurer of said Moquah Guernsey Cattle Fair, when proof is made to the County Clerk that.said bloquah Guernsey Cattle Fair is duly organized under the statutes of the a State of b-Visconain. The following resolution was presented:and was upon motion adopted; ` Whereas no Provision was made for Mother"s pension fund under chapter 637, laws of 1915, by this :Board in making up the levy of November 1915, and Whereas obligation have been incurred under this law, therefore be it resolved that the county Treasurer be and he is hereby authorized: to pay all orders issued on account of Mother'.s pension out of fund designated on the November 1915 levy as "Care of Blind".. Dated this 2nd day of Flay 1916. F. H. Bartlett. The following resolution was presented: Whereas a large number of counties in the state have appropriated money for the employment of a County Agricultural Representative, and the plan has been a great success, and Whereas the plan has been -agitated in this county to some extent, now therefore be it Resolved that the sum of W00.00 be set aside from the general fund of Special Session, tiiay 2nd, 1916 7 9,3 the county for salary for the year beginning April 30th, 1916, and that �1g000.00 be included in the salary fund in levy of November 1916, for salary for the year beginning April 30th, 1917, Which together with a like amount to be con- tributed by the State of Wisconsin, shall be used for the employment of an Agricultural Representative in this county. Resolved further that a committee of 'three be appointed by the Chaorman of this Board, who shall select such County Agricultural Representative from a list submitted by the State College of Agriculture, and to fix the salary of such representative and the amount to be used for expenses, etc. :.Dated this 2nd da;r of 1,day 1916. H. H. Peavey. The foregoing resolution was presented, and upon motion adopted, on the call of the roll. All members present voting in the affirmative, except F. V. Holston who did not vote. Upon motion Board adjourned until 1:30 P. Board met pursuant to adjournment, with 1 all members of the morning session present. The following resolution presented: Resolved that the members of the County Board duly assembled this 2nd day of iiay 1916, be requested and hereby do appropriate the sum of Fifteen Hundred Dollars (4')1500.00) as per resolution adopted on the 12th day of 1ilay 1915, to be. used in the continuance of the annual fair exhibit held in September, 1916, at the Bayfield County Fair Grounds at Iron _River, '01isconsin. 1,1. The foregoing resolution was adopted on the call of the roll, all members present, viz. 271 voting in the affirmative. The following resolution'was presented: Whereas few of the members of the County Board have been over the entire system of county -roads, they are therefore not conversant with conditions, and cannot act Or vote intelligently on matters connected with the administration of road affairs. And whereas many of the members have expressed a desire to make a tour of the county roads, therefore be it resolved, that this board proceed to mmke an inspection of the county roads, and that the committee on County Roads and Bridges be and it is. hereby directed to secure sufficient automobiles to transport all members of the board who desire to go, it is further Resolved that all members of the board making the inspection be paid the legal per diem of i�3.00 per day, but no railage, be it further Resolved that the sum of 1P50.00 be and the same is hereby set adide from the genergl fund of the county for the purpose of defraying the expense of the said tour of inspection, and that the county clerk and Chairman of the board be directed as to draw orders for perdiem -of members and `for onto hire, upon the filing of verified bills, duly approved by the Chairman of the Committee on County toads and Bridges. Dated this 2nd day of May 1916. Special Session May 2nd, 1916.. Frank Robillard, The foregoing resolution was amended by stiging out all reference to the payment of per diem of members of the Board while"on the tour of inspection, and substituting the words,"That all members amking the trip over the county roads be paid their actual expenses only." Resolution with amendment adopted. On the call oLR the roll all members voted in the affirmative. The following resolution was presented and was upon motion adbipted: Resolved that the Chairman appoint a committee who shall prepare plan for the remodeling of the Court Room and submit the same and the approximate cost thereof to next meeting of the board. Said Committee shall consult with the Circuit Judge, with reference to such remodeling. Said committee is authorized to emplok a competent architect to make the plans. Donald C. Bell - Verbal report of the Committee on County Roads and Bridges as to the Mackmiller bridge. Matters explained by County Highway Commissioner John Sundell, State Bridge Engineer, 1:1. W. Torkelson and Frank Robillard. The following recommendation of the Committee on Roads and Bridges was presented: To the Honorable County Board of Bay -field County. Gentlemen: - The undersigned recommends that an agreement be entered into with the Iron River Water Light and Telephone Company, to build and maintain a roadway across the Iron River valley, under the provisions of Section 1319m of the Statutes, the consideration to be paid the said Iron River V1. L. & T. Co. be Three thousand five hundred dollars. May 2nd, 1916. Frank Robillard, bl. B . Morris, Geo. 1Jertz Chris Iverson. The following resolution was adopted: Resolved by the County'Board of Bayfield County, this 2nd day of LIay 1916, that the County Highway Committee be instructed to enter into a contract with Iron River Water Light and Telephone Co. to construct a bridge and road across Iron River near the power house at Iron River, for '$3500.00 and said Iron River Dater light and Te-:ephone.]--.C:ay shall forever maintain the same in passable condition for travelers. Dated May 2nd, 1916. George I1�Iertz. The following resolution was presented: Resolved that two mills be and the same is hereby levied for the road fund, to be expended for raod improvements for the year 1916, and that the said sum be spread on the tax rolls of the several towns and cities and collected as other sate and county taxes are collected. The following resolution was presented and was upon motion addipted: 1111hereas the Town of Iron River Mas returhed as delinquent the tax 'assessed upon the, -income earned by the Iron River Lumber Company, a Wisconsin corporation't in the year 1914, the amount of which is 4113.98, plus penalty and interest; and whereas said corporation hasnoproperty in this state, so far as can be ascertained; and whereas it had assets far in excess of said income tax which it distributed among its stockholders' in T the year 1914; now therefore: BE IT RESOLVED that the district attorney of said county be and he is hereby directed to take such steps as he shall deem proper or suitable for the collection of said tax, and he is hereby authorized and directed if in his opinion it shall be necessary, to commence an action against said corporation for the recovery of said tax with penalty and interest, and that in'case judgment shall be recovered against said ,corporation and no property -shall be found in this state out of which said judgment can be satisfieaf,then the said district attorney is hereby authorized and directed, if he shall deem it necessary, to coDmience an action against the stockholders of said corporation to enforce satisfaction thereof. BE IT FURTHEIR RESOLVED that the expense of collecting said tax shall be borne by the County and the Town of Iron River as follows, to wit: Seventy per cent. (70%) thereof by said Town and Thirty per cent. (30%) thereof by Bayfield County. BE IT FURTHEM 112,SOLUD that an attorney at law,, of be retained to assist said district attorney in the prosecution of said litigation. .4. G. Johnson The following resolution was adopted: Resolved by the County Board of Bayfield County this 2nd day of May, 1916, that the committee on Public Grounds and Buildings be authorized and directed to buy a typewriter for the office of County Treasurer. Ole Handberg. The following resolution was presented and was upon motion referred to the District Attorney. Whereas, the legislature of the state Of Iffisconsin by Chapter 540 of the laws of 1911, sub-divisioh 3 of Section 1212, sub -section 7 of 51-02t Wisconsin Statutes of 1913, and sub -section 7'Of Section 51-02, Wisconsin Statutes of 1915 provide that real estate not adjoining the tracksoffa railroad company, together with stations and ' terminals, grain elevators used in the transferring of grain between cars and vessels, coal docks, ore docks, merchandise docks, and real estate not necessarily used in -the operating of the railroad should be subject ject to assess- ment and taxation like the property of individuals, and - Whereas, in pursuance of said act of the legislature, certain property Owned by the C. St- P. I1. & 0. Ry. *Co. at the City of 'Washburn, in Bayfield County, Wisconsin, to -wit: All -that part of Lot *1 in Sec. 5-48-4, described as follows: commencing at a point 469 ft. west of the southeast corner of the northeast quarter of the north- east quarter of said Sec. 5, running thence southeast 431 ft u thence northeast thence southeast 51 9 30 ft., thence southwest 158 ft., *thence northwest 196 Spe-cial Session May 2nd, 1916. ■ 530 ft., thence southwest 548 ft., thence southeast 239 ft., thence southwest 106 ft.., thence northwest 329 ft., thence northeast 50 ft., thence northwest 435 ft., to the shore line of Chequamegon Bay, thence along said shore line to where the same intersects a line dravm due south from the center of said northeast quarter of said Sec. 5, thence due north to the center of said quarter section, thence east along the south line of said northeast quarter of the northeast quarter of said Sec. 5, together with the Commercial Dock, Coal Dock and Elevator dock extending into -the waters of Chequamegon Bay there from; excepting from said description all of the right of way and trackage of the C. .St. P. M. &0 0. Ry. Co., as now located thereon, was assessed for taxation in said city in the year 1914, and was also in said year placed upon the tax roll of -said city as made for the year 1914, and.that said property was valued for the year 1914 at the sum of $10&,000, and the tax was carried out and extended upon the tax roll of said city against said property for the year 1.1 1914 in the sum of 43500, and Whereas said.C. St. P. 11. &0 0. Ry. Co. failed, refused and neglected to pay said taxes, or any part thereof, the same were returned delinquent to the county treasurer of Bayfield County,.and appear now upon the books of said county treasurer as a charge against said property and said railway company, and, Whereas, the statute above referred to, providing for local taxation of railway terminals and property as that h.ereinbefore described was adjudged to be unconstitutional and void in the case of Il. St. P.&.."S. -Ste. !d. Ry. Co. vs Douglas Co., reported 159 Wis. 408, and said tax so appearing upon:. -.the books of said county treasurer against said property and said railway company is in .fact illegal and void, now therefore BE IT PERSOLVID by the County Board of Bayfield County here assembled this 2nd day of Riay, 1916, that the county treasurer be and he is hereby directed and instructed to charge said tax back to the City of Washburn, and to make such entries upon his books and records as will show that said tax was charged back as illegal, and that said tax is in fact illegal'and void. Co. coal dock is now located, beingthat said section 5 situated in the SE TTL of said section, and inclupipar, including theLot fillednand cribbed portions of said lands and premises extending therefrom into Chequamegon Bay, and excepting therefrom the right of way of the Omaha Rz . and roadway to what is known as the Commercial Dock and also the said dock and warehouseeading thereon; containing about 2 acres, was assessed for taxation in said city in the year 1915, and was also in said year Placed upon the tax roll of said city as made for the year 1915, and that said Special Session 1,ay 2nd, 1916. property was valued for the year 1915 at the sum of 5�48,000, and the tax was carried o-at and extended upon the tax roll of said city against said property for the year 1915 in the sum of 01680, and Maereas the above described property was also placed upon the tax roll for the year 1915, as omitted for the year 1914, and valued at the sum of ',1�48,000, and said tax was carried out and extended. upon the tax roll of said city against said property for the year 1814 in the sum of1680, in all, the total tax for the two years extended upon said tax roll amounting to $3360,' and V,'hereas, the said C. St. P. & 0. :.V-. Co. failed, refused and neglected to pay said taxes, or any part thereof, the same were returned delinquent to the county treasurer of Bayfield County, and appear now upon the records and 'books of said co-.nty treasurer as a charge against said property and said railway company, and 17hereas, the statute above referred to, providing for local taxation of railway terminals and property as that hereinbefore described was adjudged to be unconstitutional and void in the case of Id. St. P. & S. Ste. 2.1. Ry. Co. vs. Dougl as Co., reported 159 Wis. 408, and said tax so appearing upon the books oaf said county treasurer against said property and said railway company is in fact illegal and void, Now Therefore BE IT �i SOBVED by the County board of Bayfield. County here -assembled this 2nd day of may, 1916, that the county treasurer be and he is hereby directed and instructed to charge said tax back to the City of 'Washburn, and to make such entries upon his books and records as will show that said tax was charged back as illegal, and 'that said tax is in fact illegal and void. The follow✓ing resolution was presented: To the Honorable County Board of Bayfield County. Gentlei,�len : - Be it resolved, by the County Board of Bayfield County assembled in session this 2nd day of Islay 1916, that Bayfield County herewith discontinue the present system of county highways, as now maintained; and, further, Be it resolved, that from and after the Ist day of :January, 1917, said county relinquish all claim for services or financial aid in the construction of highways, as now permitted udder the present state highways laaws, and that the towns in said county from and After the date above specified, maintain and build the necessary highways within their respective bounderies as the proper authorities or freeholders therein may so desire, according to the statutes of the State of in reference thereto, be it further Rebolved that this resolution be subject to the approval of the State Highway commission. The following petition was presented: To the County Board. of Bayfield County: We, the undersigned residents and freeholders of said County of Bayfield, residing in towns therein,` as stated hereinafter opposite our respective names, not less than fifteen of whom reside within the town of Bayfield, where the portion of the county highway hereinafter described is situated, de hereby petition you to alter the county highway within the town of Bayfield, in said county, and described as follows: That part of the county highway within the town of Bayfield 'in said county, extending from Salirio to the City of Bayfield and known as Piket•' Bay road, anff that portion of the County highway leading from the City of Bayfield northeasterly, and known as the Dalrymple Boulevard, as the same extends through the south half of Section 12, in township 50 Forth, Range 4 West, by reducing the width thereof from 100 feet to 60 feet, being 30 feet on each side of center line of said highway, a6,heretofore laid out, located and constructed. V The following petition was presented and was upon motion granted; To The County Board of Supervisors of Bayfield County, Wis., The undersigned, the town board of Supervisors of ,the town of Namekagon, respectively petition and represent; That at the regular annual town meeting of said town of Namekagon held on the 4th day of April, 19169 it was among other things voted to add one additional steel span on each end of Castle Garden Bridge in Section 14-43-6. That the total cost of the construction of said additional spans exclusive of all fills and approaches is the sum of Two Thousand dollars (02000.00), and that said town did at said town meeting provide in accordance with law for the collection and payment of its share or proportion -of such cost namely the sums of One Thousand dollars ($l000.00). That said bridge is to be constructed viholly within said town of Namekagon, and that said town has a total valuation of less than four hundred thousand dollars according to the last assessment as equalized by the County Board of said county Special Session 1`,lay 2nd, 1916. i�. I,LAMAM of Bayfield. That this petition is made in accordance with the provisions of Section 1519 of 1,11-isconsin. Statutes. Wherefore your petitioners pray that an amount equal to one half of the cost of the construction of said spans, exclusive of the cost of the constructing the approaches thereto, be appropriated, and levied upon all the taxable property of said County to be used with that provided f6r,by said town of Namekagon in defraying the expense of the construction of said bridge. 0 Jas . The following petition was presented aria was upon motion granted: To the County Board of Bayfield County: The petition of the undersigned Town Board of the Town of Pratt, County of Bayfield, Respectfully, of said Town, electors thereof, voted to construct a bridge lying wholly within said Town as described in the resolution hereinafter mentioned, that at -the same time due provision was made for the payment by the said Town of Pratt of the proportion of the cost of constructing such bridge. required by law to be'paid by the said Town as appears from them, which is a true copy of said resolution. Resolved by the qualified electors of the Town of Pratt, County of Bayfield, duly assembled in annual special Town meeting this 4th day of April, 1916, that the Town Board of said Town be and it is hereby authorized to construct a bridge lying wholly within said town over the 11,1arengo River on the quarter line of Section 4-4,1-5, at a total cost not exceeding '$*0.00, to be defrayed in part by the said Town of Pratt and in part by the County of Bayfield as provided by law. COUNTY BOARD OF BAYFIELD COUNTY: The Town Board of the Town of Eileen respectfully petition and.show to this board as follows: That said Town of Eileen has voted to construct a bridge within said town across the -South Fork of Fish Creek on the Section line between Sections Twenty (20) and Twenty-one (21),-in Township Forty-seven (47) North, of Range Five (5) Vest, a little north of the quarter post on said section line, and that said Town of Eileen has provided for the payment of one-half of the cost_._of._such _construction Special Session I=ay 2nd, 1916. 4 and that the estimated cost of such construction is Sixteen Hundred Dollars (°1?00.00) and that the cost of such 'bridge exceeds one -eighth of one per centum of all the taxable property in said town, according to its last equalized valuation; that the equalized assessed valuation of said town of Eileen exceeds Four Hundred Thousand Dollars ($400.,000); and that said Town of Eileen has raised for the purpose of baying fot its half of the construction of said bridge -the sum of Eight Hundred Dollars (086,0.00). The undersigned the Town Board'.of'the Town of Orienta respectfully petition and represent: That at a reg-filar annual town meeting of the said town held on the 4th day of April, 19169, it was among other things voted to construct a certain road on the north side of township Forty eight and Range eight west, a distance of six miles. That the total cost of the construction of the said road is T'1200.00, and that the said town did at the said meeting provide in accordance with the law for the collection and payment of its share or proportmon of such cost, namely the sum of Three hundred Dollars (300.00). That the saidroad is partly in the town of Orienta and partly in the town of Tripp, that is the road is on the line between the town of Orienta and the town of Tripp. That the said town has a valuation of less than four hundred thousand dollars according to the last assessment as equalized by the County Board. That this petition id made in accordance with the provisions of sections 1319 of Wisconsin Statutes. Therefore your petitioners prays that an amount equal to one half of the cost of the construction of said road be appropriated by the County, and levied upon the taxable property of said county to be used with that provided for by the said town of Orienta in defraying the expense of the construction of the said road.
