Upon motion the Chairman of the Committee on Roads and, Bridges was directed to audit the claims of the members of actual expense incurred in making the tour of the County roads, and that the Clerk be directed to issue orders in payment of same. Upon .motion the Chairman of the Board was directed to. appoint a committee to draw a set of resolutions of commendation of the splendid treatment accorded the members of the County Board by all people , especially the good people of the Towns of Port Wing and Cable. Good Alois Habelt' "' The following report of the Bayfield County F&ir Association was presented: Receipts and`Disbuisements of the Bayfield County Fair Association for 1916. From Bayfield County Insurance Company for tornado insurance Consessions Gate receipts, $1500.00 400.00 50.00 692.50 2642.50 Disbursements.', Cost of new barn building complete, `size 150 X 35 ft including concrete wall and floor in alley in barn $1575.06 New fence built and repays on old fence 237.00 Paid on old account of 1915 100.00 All other costs and expenses of 1916 fair includ- ing repairs -on old buildings and work on track 1296.45 $3208.51 which leaves a deficit of about 0566.00. A contract was let by your committee to'T. F. Mackmiller to put a concrete floor in the large exhibit hall, and in alley of Aew barn, also a concrete foundation under new barn, all for the sum of 01100.00, of this sum o$400.00 has been paid, which leaves a balance due Mr. Mackmiller of $700.00. It will also take about 0360.00 to pay our 200 of the premiums. Deficit $566.01 20% of premiums 360.00 De Mackmiller 700.00 01626.01 Bayfield County Fair Association. It was moved and seconded that the report of the Association be accepted and filed, and that-the•deficit report be paid and that a county order be issued to the said Association for the amount of 01626.01. _ Upon a call of the roll all members present voted in the affirmative. The following report of the County.Clerk was presented: To the Honorable County Board, Bayfield County: I beg leave to submit -the following: On April 20th of this year, Miss Margaret McDonald, Supervising teacher, was severely injured, by being thrown from a.wagon in a runaway, at Cable. Her spine was injured and she also sustained severe internal injuries. For several days it was not thought possible that she would survive. Under date of May 15th, a report of the accident was made to the Wisconsin Sp.. ial u:ess. -o,n,, f'b>cember 18 h; .1.916 Industrial Commission, accompanied by a letter from Miss Jessie N. Smith, County Superintendent, containing a full explanation of the accident, and seeking full information. I also wrote the Commission attempting to set forth the claim that Miss McDonald being paid by the State was really a state employee, and entitled to compensation under the workmen's compensation act. The State Superintendent was *asked to get a full and complete opinion from the Attorney General. The Attorney General in a very lengthy opinion, a copy of which is attached hereto, held that -Miss McDonald was a county employee and as she was injured in the performance of her duties was entitled to damages and in addition was entitled to compensation for the time she was actually incapacitated. The Industrial Commission says:" She is entitled to receive from the county the necessary medical, surgical and hospital treatment, medicines, supplies, etc., reasonably re- quired at the time of the accident.and thereafter for ninety days, to cure and relieve her from the effects of the injury. Wile disabled, she is entitled weekly to 650 of her average weekly earnings, and for the purpose of computing compensation the average weekly earnings cannot exceed $14.42. If an employee of the county she is entitled to the above benefit and they should be paid promptly by the county. In case these benefits are.not paid the injured person may make her application to the commission to have her claim adjusted,, - The Attorney General having held that Miss McDonald was a county employee, and that the State was not liable, the.commission having ordered the benefits paid if she was a county employee, I could see no other way than to make the payments. I did not object to the payments to Miss McDonald, I wanted to give her the benefit of the doubt, even though there was some question of liability. If the county was liable, it should be paid promptly. I had before me the opinion of the attorney general, the order of tote Industrial Commission, and the letter of the State Super- intendent. I then submitted the whole case to the District Attorney. In a letter to me, attached,to this report, he advised that payments be made in accordance with the order of the Industrial Commission. Accordingly the following bills were paid for medical, surgical and hospital treatment: July 24th, Margaret McDonald, for expense Massage treatment Voucher herewith, 8.00 if St. Joseph Hospital, 159.00 "` Dr. Kate Clerk, Cable 10.00 " Dr. J. M. Dodd, 100.00 " Margaret McDonald for hospital services and massage treatment 44.00 In addition to the above I have paid her 65�o percent of the monthly salary or at a rate of not to exceed $14.42 per week, this has amounted'to $41.50 per month for the months of May, June, July, August, September and. October, total 249.00 Total to date ----------------------------------- y �--- 0— Miss McDonald has not recoveded and it is possible she will not for some time, in the 0eantime monthly payments will be made from the general fund. Upon motion District Attorney, A. IV. Warden, was excused from attendance at'the meeting of the County Board, at his request, and C._ F. Morris was appointed Assistant District Attorney for the day. The following report was presented and was upon motion adopted. To the County Board of Bayfield County:- Gentlemen: - Your board has no Committee on Education, and no' Committee. -to whom the bills incurred by the County Superintendent's office may be.properly referred. The bills for expense of the Supervising teacher have been paid by me when presented," and a regular order issued therefor. It is quite necessary that the expense bills be paid promptly, first for the reason that the Supervising teacher must pay her bills, as she goes along, and second that the county only advances the money for the state. The co-dnty has been reimbursed by.the state for all expenditures made up to Julyylst, amounting to 0657.35, this does not include medical, surgical and hospital treatment for Miss McDonald. Smith, County Superintendent from April 27th, 1916 to Nov. 23rd, amounting to 239.39 Peavey Publishing Company, printing 185.95 All of which is respectfully submitted, Nels M. Oscar, County Clerk. The following resolution was presented:. Be it resolved by the County Board of Bayfield County, in adjourned annual session assembled that a Committee of Five members of this Board be appointed to make a careful investigation of proposition of securing a site and building suitable buildings for a County Poor Farm and County Tuberculosis Sanitarium, the entire cost of same to be thoroughly investigated and the report of the said Committee to be presented to this Board at its next meeting. Bates and Joseph Stevens are Civil War Veterans, and are members on the Indigent Soldiers Relief Commission, and that their duties require them to go and visit the indigent soldiers in Bayfield County, which involves considerable expense to them each year, BE IT RESOLVED, By the County Board of Bayfield County this 28th day of November, 1916, that L. Bates and Joseph Stevens be each allowed $50 per annum, for said purpose, to be paid out of. Indugent Soldiers Relief Fund. Geo. Mertz. .The following resolution was presented and was upon motion adopted: Whereas, in an action brought in the circuit court of Bayfield County in the name of the town of Mason against the White River Lumber Company to recover an -income {Special session, December 18th, 1916. tax levied upon income of, and assessed against, said company f'or the year 1914 and' duly extended upon.the tax r&ll of said town for the year 1915;,and whereas judgment was rendered in said action against said company on the 3rd day_of April, 1916, for $4912.88 damages, and $119.45 costs, making in all $4942.33; and whereas no part of said judgment has been paid and there is now due thereon said sum of $4942.33, with interest from said 3rd day of April, 1916; and whereas said White Rivekr Lumber Compan has no property in this state and has not been engaged in business in this state within a period of one year; and whereas there does not appear to be any prospect tha said company, or the stockholders thereof, will pay said judgment unless.compelled so to do by juducial proceedings; and whereas said town of Mason and the State of. Wis- consin, as well as said county, have each a beheficial interest in said judgment and have signified their willingness to cooperate with said county and with the county treasurer and the district attorney thereof in the institution and prosecution of such /action or actions or such proceedings as may be deemed necessary or advisable to en- force payment of such judgment; - BE IT RESOLVED, that.such proceedings or such action or actions as the district attorney of said county shall deem necessary, proper or advisable, be connmenced and prosecuted by said county either alone or in conjunction with said town and said state for the collection of said judgment. RESOLVED further that it is the sense of this board that the district attorney of said county confer with the attorney general of the state and with the attorney for the town of Mason, with a view of obtaining such assistance as they may be able a willing to render in such actions or proceedings, provided that no compensation shall be paid by said county for any such assistance or service; it being understood that the town of Mason shall make provision for its own attorney and that whatever service may be performed by the attorney general in the premises will be so performed in his official capacity. 0.
