Axness, Chairman of the County Board. The Clerk,read the call for the Special Meeting as follows: To Jacob Yderstad, County Clerk of Bayfield County, Wis.: We, the undersigned, members of the County Board of Supervisors of Bayfield County, Wisconsin, hereby request that a Special Meeting of said Board be held at the Court House, in the City of Washburn, in Bayfield County, Wisconsin, on Tuesday, Oct. ll, 1921, at 10 o'clock in the forenoon of said day. Upon roll call the following members were present: Bourse, Regelein, Pease, Kjarwick, Juel, Karow, Ewing, Soronen, Curry, Bradfield, A. G. Johnson, Iverson, Malm, P. Johnson, Froney, Taipale, Yarlihalak, Okerstrom, Habelt, LaMont, Lavin, Tetzner, Wachemuth, Bell, Peavey, Warden, Arntson, Handberg, Posey, Potwin, Axneso. Supervisor Donald C. Bell, m:-.de a motion that the Board, at this meeting, take such action as may be found necessary to take proceedings restraining the Northern Pacific Railway Company from tearing up the track of the railroad now located between Washburn and Iron River, known as the "Battle Axe" road, and that the District AttorngT be instructed to draw up a proper resolution to be acted upon by this Board at this meeting. Motion carried. Arguments in the matter were made by G. Id. Okerstrom, W. E. Tripp, P. J. Savage, M. Sprague, and C. F. Morris. The County Clerk -reported that the funds of the County were rather low, and the Finance Committee was instructed to provide for a temporary loan. The resignation of Alf -red Froseth, County Treasurer, was read as follows: Washburn, Wisconsin. To Mr. Andy Murray, Sheriff of Bayfield County. Sir: 1, the undersigned Alfred Froseth, County Treasurer of Bayfield County, Wisconsin, hereby tender my resignation as and resign my office of County Treasurer of Bayfield County, my res _gnation to take effect Dated this 5th day of October, 1921. The above is made out in compliance with advice reepived from the district attorney, my original resignation having been filed on August 19, 1921, being addressed to the County Board. To , 0 . 1vI. Dear 'Sir: 171ease take notice that the resignation of Alfred Froseth_, County Treasurer, County of Bayfield, has been received by me and same has been duly filed with the County Clerk of Bayfield County, this 6th day of October, 1921. Andy Murray. Sheriff, Bayfield County, ibis. It was moved and seconded that the said resignation 'be accepted, same to take gffeet on November 1, 1921. The following resolution relating to the Treasurer's bond was adopted after several amendments had been made to it, and the original resolution after amended was adopted as follows: Resolution. Be it resolved by the County Board of Bayfield County assembled in special session this llth day of October, that beginning on the first day of January, 19229 that the County Treasurer be obliged to furnish a surety bond in the amount of 20�% of the total tag levy, but not less.than `4`160,000.00, instead of the amount formerly required by statute, to wit: directed by the County Board. a bond equal to the amount of the tax Signed: 0. I:I. Axness. The foregoing resolution was adopted October 11, 1::21, 'by the following vote: Ayes 32 No none. J. Yderstad, county Clerk. It was moved and seconded that the Board now proceed to elect a County' Treasurer to succeed Alfred Froseth, the term of office to begin November 1, 1921, and to continue for the balance of the term or until the first Monday in January, 1923. Gentlemen: Learning from the Washburn Times that the Office of County Treasurer is vacant, through the resignation of Mr. Froseth, I hereby respectfully ap.>ly for the position. Gentlemen: Being informed that there is a vacancy in the office of County Treasurer, owing to the resignation of -Mr. Alfred. Froseth, I hereby respectfully apply. for the appointment to fill said vacancy. I am familiar with duties of said office, having held the office of Deputy County Treasurer under ivir. Wilkenson during 1�)04 and 1905. I was elected to, and held the office of County Treasurer two terms, i.e. 1906,to 1909 inclusive. If I am appointed to fill such vacancy I shall endeavor to perform the duties of the office in a proper manner. During the eleven years past, I have been in the employ of the J.S. Stearns Lumber Company of Odanah, Wisconsin. Respectfully, John Froseth. Washburn, Wis. Oct. 11, 1921 Members of the County Board, Bayfield,, County, Wis. Gentlemen: I hereby make application for the appointment as County Treasurer to fill the term of Alfred Froseth, the vacancy of which is made by his resignation. Respectfully yours, Randall W. Smith. It was moved and seconded that an•informal ballot for County Treasurer be taken. Motion carried. Result of the informal ballot was as follows: John Froseth received 16 votes; R. IN. Smith received 16 votes. There being no choice, another :"formal 'ballot was ordered. Result of the first formal ballot was as follows: R. W. Smith received 17 votes; John Froseth received 15 votes. R. W: Smith was thereupon duly declared County Treasurer for Bayfield County for the balance of the term. On motion, recess was taken until 1:30 P.11. a At 1:30 P.M. the Board was called to order, roll] -call shocking all members present. The following resolution to borrow money was presented as follows: Be it resolved, By the County Hoard of Bayfield County, assembled in special session this llth day of October, 1921, that the Finance Committee of said Board, be, and it is hereby authorized to borrow the sum of =�8,000.00 (E ight Thousand Dollars) at such rate, of interest not to exceed 77oo, party or parties as in its judgment be advisable. Resolution as to the County depository, was thereupon read as follows: Be it Resolved, By the County Board of Bayfield County, assembled in special session this llth day of October, 1921, that the Northern State -Bank, at Washburn, Wisconsin, the Port ding State Bank, at fort Wing, the Cable State Bank, at Cable, Wisconsinh, the Iron River Bank, at Iron River, Wisconsin, the Farmers & Merchants State Bank, at Bayfield, Wisconsin, same are hereby declared a county depository, under the provisions of law guaranteeing proper bond, etc. it Geo. Karow.. It was moved and seconded that same be adopted. Motion carried. a _ Resolution as to the Washburn, Bayfield; and Iron River Railway Company was thereupon presented and read as follows: 1rdHEREAS application has been made by Northern Pacific Railway Company to the Interstate Commerce Commission of the United States for permission to discontinue operation of the- Iron River-Washburri branch of the Northern Pacific Railway, and to take up the track, notice of which appplication has been sent out and published by said Interstate Commerce Commission; AND WHEREAS said branch of railroad was constructed 1cargely by the railway aid bonds issued and delivered to Washburn,, -Bayfield and Iron River R ailway Com_:any, by BayfieTd County, to the amount of Two Hundred and Fifteen Thousand Dollars (215,000.00), and said branch is of great importance to the residents of northern Wisconsin, and particularly'to Bayfield County, and serves an ever increasing territory and population, and its discontinuance would be a very great inconvenience to a great number of people in a large territory, and would practically ruin and destroy the value of much valuable property; NOW THEREFORE, BE IT RESOLVED By the county board of Bayfield County, assembled, at a special meet:_ng thereof this llth day of October, 1921, that C. F. -Morris, District Attorney of said county, be, and he is hereby directed and instructed to, immediately take such steps and proceedings as hes.mayr�de_em necessary to oppose the discontinuance of the operation of said branch of railroad, and that he have authority to engage and employ such persons and witnesses as may be necessary to gather the information, proof and evidence for presentation to the. Interstate Commerce Commission upon the hearing of the application aforesaid. BE IT FURTIivR RESOLVED That the district attorney be authorized and empowered to request the attorney general of Wisconsin to render such legal services and M i aid as said attorney general may deem proper in behalf of Bayfield County and tl�e State of Wisconsin to oppose the discontinuance of said "branch of railroad, at the expense of the state; and BE IT FURTHER RESOLVED The district attorney be and he is hereby authorized and empowered to employ and engage on behalf and at the expense of Bayfield County .such other legal counsel as he may deem necessary to protect the interests of said county and the state of Wisconsin in opposition to the discontinuance of the operatio n, of said branch of railroad. BE IT FURTHER RESOLVED That the chairman of the county board appoint a committee of three members of said board to co-operate with the district attorney and the other legal counsel representing the state and Bayfield County and the public in opposition to the discontinuanne of said branch of road, and to assist in the execution of such plans and arrangements. as may be decided upon between said counsel a and said committee of three; and BE IT FURTHER RESOLVED That there be, and there is hereby appropriated by said county the sum of Twenty Five Hundred Dollars (62,500.00) for the purpose of defray- ing the expenses of preparing and conducting the case in opposition to the discon- tinuance of said branch of -railroad, such expenses to be paid therefrom by the proper county officers upon the. certificate of the committee aforesaid. Yderstad County Clerk The Chairman appointed as a committee to assist the District Attorney in making a survey and in other ways preparing the case: Peter Soronen, L. J. -Lavin, and Otto Regelein. A resolution as to bounty on woodchucks was presented, and by agreement withdrawn until next Annual l;ieeting. A correspondence from I;. Ivy. Rockman, Barron, Wisconsin, relating to the Bibon Swamp, was read and on motion placed on file. It was moved and seconded that the County Clerk be instructed to correspond with Senator yenroot and Congressman Nelson, stating to them that it was the.:s.ense of this meeting that they be invited to render all possible assistance in helping Bayfield County to retain and prevent the Northern ?acific from tearing up the so-called "Battle Axe" road. Motion carried.
