The Special Meeting' of the Bayfield County Board of `supervisors was called
to order, by Chairman Bell,at 10 o'clock A. H., July 31st. Roll call showed the
following present:
Nourse, Regelein, Kjarwick, Baker, Karow, Ewing, Soronen, Bartlett, Curry,
Morris, Helmer, Squires, Melstrand, Kobelt, Axnesa, Lawrenz, Froney,,Taipale,
Mihalak, Okerstrom, Habelt, Lamont, Lavin, Tetzner, Vlachsmuth, Warden, Arntson,
Handberg, Posey, Potvin, Bell.
The reading of the minutes of meeting held on May 15th, 1923; was duly
dispensed with.
The Clerk thereupon read the following request for a special meeting:

Dear Sir:
lJe, the undersigned members of the, County Board of Bayfield County, Wisconsin,
hereby request that a special meeting of said County Board be held at the Court
House in the City of Iffashburn, Wisconsin, on Tuesday the 31st day of July 1923 A. D.,
at ten o'clock in the forenoon, for the purpose of making provision for paying the
cost of emergency construction of fill and bridge and necessary grading for
relocation of Highway No. 10 over Iron River in the Town of Iron River, and to
transact such other business that may legally come before said Board at such meeting,

County Board of Supervisors will be held at the Court House in the City of Washburn,
'ffisconsin, on Tuesday the 31st day of July, 1923 A. D., at ten O'clock in the
forenoon.

Motion made to have the County Board go over to Iron River, and look over the
proposed site for reconstruction of Highway No. Ten; and also to do away with the
special mileage for the Board members. Roll call showed the following vote:
Nays: Nourse, Baker, Bartlett, Curry, Helmer, Axness, Lawrenz, Franey,
Okerstrom, Habelt, Lamont, Bell.
Ayes: Regelein, Kjarwick, Karow, Ewing, Squires, Nelstrand, Kobelt, Taipale,
Mihalak, Lavin, Tetzner, 71achsmuth, ffar•den, Arntson, Handberg, Posey, Potvin.
Motion made and carried to have the County Clerk give the Board the
financial conditions of the Cou7.ty. The County Clerk informed the Board that it
would be necessary to borrow the full amount that can legally be borrowed in order
to meet the general expense of the Government until such time as they receive tax
money in 1924.
The following was duly presented:
To the Bayfield County Board:
.7e, the undersigned members of the Building and Ground Committee, wish
to inform you that the appropriation for the Court House was Two Thousand and Nine
Hundred Dollars, and the 1st of July there was Seven Dollars and Eight Cents left
to run the last six months, of the year. This was due largely for insurance,
which was due the month of January, and comes due every three years. Evidently
this was not taken into -consideration when the appropriation was made. We
thErefore request that you allow us Fifteen Hundred Dollars to cover balance lof the
year.

The following resolution was read:
`Mashburn, Wis., July 31st, 1923
BE IT RESOLVED, that we the members of the County Board of Bayfield County in
special session ass-embled this 31st day of July, do hereby endorse the application and
recommend the appointment of T. :fit. Robinson of ~Mashburn, Iffisconsin, as Deputy Conservation
`nlarden, subject to the usual rules of the State Conservation Commission.
Be it further resolved that a copy of these resolutions be forwarded to the
State Commission. ;

Dear Sir:
In regard to those lots 7, 8, 9 and ten, Block One, Pittingill's First addition
to Iron River, I could not think of paying what taxes there is against the property,
as the Lots are not worth over Twenty-five Dollars, and I am willing to pay Twenty-
five Dollars for them, providing I can get a Clear Deed of them. Kindly take this
matter up before the County Board at their next meeting, and let'me know what they
will do about it, and oblige

and Tax Deeds. Motion carried.
Motion made and seconded to have,the District Attorney prepare a form for
settlement for the Town of Iron River.' Motion carried.
Motion made to have the audit report printed in the County Newspaper if it does
not exceed the cost of Fift Dollars.
Roll call showed the following vote:
Nays: Nourse, Regelein,•Kjarwick, Baker, Karow, Ewing, Bartlett, Curry, Morris,
Squires, Melstrand, Kobelt, Lawrenz, Habelt, Lamont, Arnts.on, Posey, Potvin, Bell,
total nineteen.
Ayes: cSoronen, Helmer, Axness, Froney, Taipale, Mihalak,'Okerstrom, Lavin, Tetzner,
<7achsmuth, 17arden, Handberg, total twelve.
Motion made and seconded that a Supervising teacher be appointed by County
Superintendent., the salary to be Fourteen Hundred per year., the appointment to be made
in time to begin fiscal school year. Iiotion carried.
The bill for the Town of Iron River for Two dollars for transportation of poor
to Duluth was read.
Motion made and seconded to reject the above bill. Motion carried.
The bill for City of Bayfield, for Fifty-two Dollars and Eighty-five Cents, for
burial of poor person, namely, Andrew Bergmark, was, upon motion, referred to the
Committee of Finance.
The bill for County of Douglas amount& to" 6ixty-five Dollars and Seventy-five
Cents, for the case of State of Wisconsin V. S. George Ba.cich was duly allowed by the
Board, and the County Clerk was instructed -to issue County Order in favor of Douglas
County.
The following report was then read:
May 15, 1923.
We, the members of the County Fair Committee, at a meeting this 15th day of May,
are unanimously agreed that the County Fair Buildings should not be used for any other
purpose than County Fair purposes. --
They are not opposed to the track being used for running horses, but the buildings
must not be occupied by anyone.

Gentlemen:
Petition is hereby made that the road running due lest from the Center of'
Section Twenty-eight (28) feet, Township Forty-five (45) north, Range'Nine,(9) West, -
and connecting with the.Douglas"County Trunk Line "A" at the ffest quarter (`)'post
of Section Thirty (30) be made a part of the Secondary System of Bayfield County,

j' 'ITE, THE UNDERSIGNED C01,11=TEE, to whom was referred the foregoing and
j atta-ched petition for placing two and one-half (22) miles of Highway, in the Town of
Barnes, on the County system of Highways, respectfully report to the Bayfield County
Board as follows:
This Committee, in company with County Highway Commissioner, John Friberg,
and L. D. Peas-e., Chairman of the Town of Barnes, did on the 23d day of June, 1923,
go over and inspect this piece of road and found it to lead from County Trunk "All
at Barnes, in a Westerly direction two and one-half (2 0 miles to County Line between
Baygield and Douglas Counties, and connects at that point, with County Trunk Road
"H" of Douglas County. This piece of road had just been graded when we were there,
and was in very good condition --the road bed is about twenty (20) feet wide, soil
sandy loam, no bridges, no culverts,- and none seem needed, and the draining apparently
goes straight down. As this piece of road will form a connection between the County
system of Highways of Douglas and Bayfield Counties, and as it is now in good
condition, and will only call for a moderate outlay in the way of maintenance,

Z11TE RECOMMEND the same to be adopted and made a. part of the County System
of Highways of Bayfield County, Wisconsin.

Motion waa then made to accept the report of the Committee, and that the above
mentioned .road be placed on the Prospective State Trunk Highway System of Bayfield
County, January 1, 1924, and that the Clerk be instructed to send a copy of the
report and resolution to the Wisconsin Highway Commission at Madison. Motion carried.
Motion was made for the Bayfield County Board of Super.vis:ors to go on record as
strictly opposed to taking State Trunk Highways Nos. 24, 112, and 125, or any part
thereof, off the State Trunk System in Bayfield County, and that a copy of this
resolution be sent to the Wisconsin Highway Commission, and that a copy also be
placed with the State Highway Legislative Committee. Motion carried.
The Board instructed the District Attorney to look up the power of the Board to
finance the reconstruction of the Highway washed out by the Iron River Dam.
Motion was made to adjourn until 1:30 P.. M. Motion carried.

The following report of the Road and Bridge Committee and Highway Commissioner
was then read:
July 31, 1923
To the Honorable County Board:
The County State Road and Bridge Committee reports in reference to the emergency
j construction work required on Highway No. Ten, at Iron River, that since the last
meeting of this Board, your Committee has decided upon the re -location of said Highway
No. Ten.
ALSO that at the time of the previous meeting, this Committee had authority in
such cases to proceed to let contracts and borrow money if necessary to carry on the
work, but since that time, the law has been changed so; that your Committee is now
without power to borrow money for such purposes, but must call a meeting of the County
Board, and for that reason this meeting of the County Board has been called. j
FURTHER, your Committee reports that it -is essentially necessary that the emergency
construction work be done during the present season and hence, the matter could not
well be referred to the Annual Meeting.
Your Committee in conjunction with the Division Engineer has: obtained an accurate
survey of the work to be done, and estimate the cost of the work of building upon
the re -location at Ten Thousand Dollars.
WE THEREFORE RECOAUVE�D to- the County Board that authority be given to the
Committee to proceed with this work, and let necessary contracts; and in conjunction
with the Finance Committee to borrow the necessary funds to carry on said work.

the proposed site. Motion carried.
Motion was made and seconded that no County Nurse be hired at present to fill

The Board was then informed that F. H. Bartlett, Chairman of the County Nurse

the County Nurse Committee.

To the Honorable Bayfield County Board:
VVIIIEREAS, Eleanor Yderstad, Deputy County Clerk, has resigned, having a.cc°epted
a position with Pearce Tompkins as an employe of the Wisconsin Tax Commission, be it
hereby resolved that the Bayfield County Board.make a voteof appreciation for the
services. rendered by said Eleanor-Yderstad to Bayfield County.
Motion was made that the above,resolution be passed. Motion carried
unanimously.
The following letter from the Railroad Commission, addressed to District
Attorney, Fisher, was then read by A. M. Warden:
July 24, 1923
Mr. John J. Fisher,
Attorney at Law, Bayfield,
Wisconsin. I
Dear Sir:
In reference to the Iron River Dam:
Wehave your letter dated July 19th requesting that the Highway authorities be
given permission to erect three fifteen foot bents.across the stream below the Iron
River Dam, it being understood that not lessthan a thirty foot space be left for the
river bed. We have not had sufficient time to thoroughly investigate this matter, and
will write you later regarding'it.
You undoubtedly know that Mr. Mackmiller strenuously objects to any obstruction
which may interfere with the. level of the water below the dam either in the nature of
piling or embankments which may wash into the river bed. The commission, as you know,
is interested in the most economical operation of the public utilities in the state
and certainly no additional or unnecessary burden should be imposed upon the Iron River
j Company.
It appears that the entire controversy could not only be satisfa-at.orily adjusted
but also a substantial saving in money could be effected by the County in the construct=
ion of the Highway and by the utility in the construction of the dam if these, two
I projects- are built together. It would appear further that the County will save money
in the annual cost of maintenance in case the road is built in connection with the dam.
The road both insofar as alignment and grade are concerned will be superior to the
proposed road below the dam. Becauseof the many advantages and saving in costs we
feel that every effort should be made to construct the road and dam together especially
in view of the fact that the public is directly concerned in the construction of the
road and aleo vitally interested, although indirectly, in the construction of the dam.

RAILROAD COMMISSION OF WISCONSIN.
The following proposition was then made by T. F. Mackmiller to the County Board:
July 31, 1923
To the County Board of Bayfield County:
The undersigned, T. F. I&ckmiller, hereby proposes to rebuild the State
Highway No. Ten, across Iron River, in the Town of Iron River, with necessary filling
and approaches, according to the plans for such rebuilding as prepared by the Division
Engineer's department at Superior, for the sum of Ten Thousand Dollars. In case of
alteration of plans requiring additional concrete work, such additional work shall be
paid for at the rate of Twenty-five Dollars per cubic yard. The work is to be done.
within ninety days after this offer becomes effective as an agreement. Work is to be
paid for on or before April 1st, 1924, with interest at the rate of six per cent. from
the time said work shall be completed. All work shall at all reasonable times be
subject to inspection by the State Highway Department. All piling used is to be driven
as far as can -be done with a twenty-five hundred pound hammer.
This offer, shall not be binding on the undersigned unless. the Attorney
General of Wisconsin shall render an opinion that Bayfield County has authority to -make
such an agreement.

SPECIAL MEETING OF-BAYFIELD COUNTY BOARD-
JULY 31, 1923
I The Board voted the above proposition to'be laid on the table.
Motion was then made that an offer of Six Thousand Five Hundred Dollars be offered
Mr. Mackmiller for the reconstruction of the Highway over the old site, and if rejected,
to use the present detour until such time that the County can build a bridge over the i
Iron River. .Roll call showed.the following vote:
Aye: Baker, Karow, Bartlett, Axness, Froney, Lamont, Posey, Bell. Total, eight.
Nay: Regelein, Kjarwick, Ewing, Soronen, Helmer, Squires, Melstrand, Kobelt,
Taipale, Mihalak, Okerstrom, Lavin, Tetzner, lVachsmuth, Warden, Arntson, Handberg,
Potvin. Total, eighteen.
Motion was made and passed that District Attorney, Fisher, and Mackmiller draw
! up a new proposition which would not waiver the County's right to go to court action
for damages against the Iron River lVater, Light & Power Company and a few other
changes of the proposition already presented. Roll call showed the following vote:

Recess of twenty minutes was allowed for the drawing up of the new proposition.

The following proposition was then read to the Board:
July 31, 1923.

To the County Board -of Bayfield County:
The undersigned, T. F. Mackmiller, hereby
proposes to rebuild state Highway No. Ten, across Iron River, in the Town of Iron
River, with necessary filling, structures and approaches, all according to the plans
and specifications for such rebuilding heretofore prepared by the Highway Division
Engineer's Department at Superior, for the sum of Ten Thousand Dollars. In case of
alteration of plans requiring additional concrete work, such additional concrete work
shall be paid for at the rate of Twenty-five Dollars per cubic yard. The work is to
be done within ninety days after this offer becomes effective as an agreement. Mork
is to be paid for on or before April 1st, 1924, with interest at the rate of six
per cent. from the time said work shall be completed and accepted. -All Mork shall at
all reasonable times be subject to inspection by the State Highway Department.
This offer shall not be binding on the undersigned unless the Attorney General of
Wisconsin shall render an opinion that Bayfield County has power and authority to make
such an agreement.
It is understood that Bayfield County does not by accepting this proposal waive j
i any rights it may now have to recover damages for loss caused to Bayfield County by
reason of the destruction of the old highway over said river during the month of
December, 1922.
f The undersigned, individually and as president and manager of the Iron River
Water, Light & Telephone Company, hereby agrees that upon the completion and acceptance
of said work Bayfield County and the State of `,Visconsin shall hereafter have full
control and jurisdiction over said highway as it crosses the property of the
undersigned and of said Iron River Water, Light & Power Company at said place, as to
the future maintenance and use thereof, not exceeding a width of 28 feet at the top,
or roadway.

Motion was made that an amendment to the above offer beadded with the consent
of Mr. Mackmiller who was representing the Iron River Light & Power Company.

Mackmiller consented to furnish bonds to the approval of the Highway Committee,
and the motion was made that the following amendment be added to Alackmiller's
j proposition:
That Mackmiller furnish a bond of sufficient amount subject to approval of
Highway Committee for the proper reconstruction of the Highway as per specifications
of the State Highway Commission.
Roll call showed the following vote:
