Bayfield County Board for the purpose of organization and the transaction of any other
business which may legally come before the Board at such meeting.

Lloved by Anderson and seconded by Rivers to dispense with the reading of the
minutes of the annual meeting held in November, 1933 and of the special meeting held
in February, 1934. Motion carried.
The Chairman appointed C. 0. Nelson and Nels Ness as tellers. The Board- pro-
ceeded with election of a County Board Chairman for the ensuing year.

Attached copy of letter of your District Attorney dated August 27, 1930 and
copy of my reply dated August 28, 1930 regarding a 'tax deed covering pea vinery and
pickling station on this Company's property in the village of Mason are self-explan-
atory. By a letter dated the 13th of last December recently received from your county
clerk it appears that this matter has not yet been definitely disposed of.
Will you kindly have appropriate resolution passed at the next meeting of
your Board cancelling this invalid tax deed and have the county clerk then advise us
that the records have been straightened out, obliging?

RESOLVED, that the Bayfield County Fair Association be hereby given permission

With full appreciation of the depleted conditions of the State Treasury, we
yet feel the urgent need of a modern Police Radio Intelligence System to coordinate our
present Law Enforcement Officers. We respectfully urge you, in the interest of Latin
Enfforceme-dt and real economy, to find the means for establishing such a system without
delay.
This must not be construed as recoimnendinj-, any State Police or additional per-
sonnel other than required in the effective management of a. Radio Call System.
That a copy of the Resolution. be sent to Honorable Governor A. G. Schmedemann,
the State Senator, Philip E. Nelson and Assemblyman, Robt. A. Nixon.

The following resolution was read;
R E S O L U T I O N
UEREAS, Counties within forest protection districts are required, under sub-
section 4 of section 26.14 Wisconsin statutes, to repay to the state one-half of the
costs of fighting fire and there is need to reduce such costs to Bayfield County, be it
RESOLVED by the County Board of Bayfield County that the Conservation commit-
tee is hereby authorized to employ two active, able bodied men at $4.00 per day and the
cost of gasoline and oil, to act as fire prevention patrolmen, during periods of high
hazard a.s determined by the committee and the District forest Ranger, and be it further
RESOLVED that the county clerk shall monthly certify to the State Conservation
Commission the cost of such patrol, with the understanding that half of such sums will
be credited to Bayfield county on the amount due the state for fire fighting -costs.

Range 5, consisting of about 23 acres, recorded in Volume 120 of Deeds on page 78. Have
about 5 acres cleared, and have 1 acre in strawberries, which I want to reserve the right
to pick for two years, also want to remove the small -house that is on it, as there are
no buildings on the place I want to exchange for, which is the NE NW, Section 15, Town-
ship 51, Range 5.
Mr. Alcott knows all about this deal, and land. Hoping to.hear from you as
soon as the Board meets.

not suffer any loss through this exchange, rather they would profit by it, as our home

to draw up a resolution to enter additional lands in the U. S. Forest Area. Motion car -

The chairman declared a fifteen minute recess.

the agreement made with the State and Federal departments by the County Agent regarding
grass -hopper control. Motion carried.

cost of grass -hopper control. Motion carried.
Moved by Sibbald and seconded by Meyer that Andrew Nessett submit a written

Moved by Anderson and seconded by C. 0. Nelson that the forestry committee be
authorized to hire a trespass officer in co-operation with the County Agent and Conser-
vation department, the County paying 50`�o and the other 50j� to be paid out of the County

session this 24ttz day of April,-19-11, that the County Clerk and County Treasurer be
hereby authorized and directed to issue a Quit Claim .Deed to the City of Washburn on the
SIV SE, Section 49-4, and that the consideration be 400.00 and that said consideration
be written off the excess account of the City of ,yrashburn on delinquent Real Estate
taxes.

The following report was read;
April 24, 1934
TO THE HONORABLE OF THE BAYFIEL'D COUNTY BOARD;
This year the County Superintendents throughout the state were asked to put
unemployed teachers to work. Three different projects were initiated; Adult Education
under MIRE, Helping Teachers, and Library Assistants under C?.VA. Although the second pro—
ject "fell through" and the third only lasted for two weeks, the first was maintained
in Bayfield County from December 28 until April 21. As many as forty-three (43) teachers
and one stenographer, all Bayfield County residents, >>vere given employment, receiving
a total of 7455.45 from Federal or State funds.
As no provisions were ^.ade for financing the necessary expenses, including
stationery, postage and telephone, I had to draw upon my office allowance for these ex-
penditures. Because of this, we shall no doubt exceed our budget by approximately
75, 00, and therefore we request the honorable members of the County Board to extend the
original budget for the office of County Superintendent of Schools by such amount.

The following letter was read;

Gentlemen
On Noverfber lb, 1933,, the Committee on Illegal Tax and Tax certificates recom-
mended the allowance of cla.itns for illegal descriptions of real estate. The amount was
;64.98, and was charged back to the Town of Namekagon.
The lands involved in this alleged illegality are Lot 1 and a parcel of lc�.nd
in Lot 1, Section 18-43-5. These lands were to-x delinquent for the years 1930, 1931 and

The owners of these lands, or their representative, Claire that the descriptions
given in the Deed -as recorded in Vol. 107, page 2�11, or another deed recorded on gage 107
of Deeds, page 234, "is so ambiguous and uncertain as to be useless"; and, "that by reason
of gross inaccuracy in the original survey and description, it is impossible to define the
lands described in the tax certificates issued against said lots", and, therefore, said
certificates are void.
Their claim also is, that the description in the deed, recorded October 31, 1933
in Vol. 122, page 307 is correct. There is no evidence that either or both deeds a.re
Tight or wrong in describing these lands.
The Town Board of the Toi. n of Narnekagon feels that the County in charging these
taxes back, has cast an additional burden of taxes on other taxpayers, and that the charge
was not justified, for the following reasons;
That the Deed recorded. in Vol. 1-22, page 307, October 31, 1933, was only sixteen
days before the committee recommended the allowance.

That there was no mistake or irregularity in the tax proceedings that affected

That the description of the parcel of land was put upon the assessment and tax

the Town Clerk, dated July 9th, 1930, he says;
"In order that a complete record ma.y be had of the pages in the Deeds of Regis-
try in Bayfield County, Wisconsin, as to the various documents .filed in connec-
tion with the property belonging to .fEtta Becker ythite in the To�1.m of Natnekagon,
I give you the following information;

assessment of 1934, from which list you may ascertain what I claim to be an unjust asses-
ment. I had this property built in. 1916, and in 1923 I added a wooden garage at a. total
cost of .130.00. I have raised no protest until this year of 1931, when they raised me to
$1600.00, after which they put it back to 11500.00.
In this year of 1934 atiwhich time the city of Bayfield was reassessed by a
group from Madison, my property valuation wakaised from 11500.00 to 12500.00, without
am inspection of the Dremises being made as I was out of the city for several months
during the time of their reassessment. I have been given to understand that it is neces-
sary for the assessors to make an affidavit of their proper findings, and setting forth
these reasons for realustment. As my residence was locked up and all curtains dope it
would be utterly impossible for any one to make a true finding or result to a careful
answer as to my present valuation. Therefore, I respectfully request that I be,granted
an opportunity to present these facts for your kind consideration.
I shall defer payment of these taxes until I have conferred with your body or
at such time that they may be adjusted.

Board on November 16, 1933, it caused to be prepared a tentative report recommending
boundaries for areas within the county in which agriculture, forestry and recreation
may be conducted, and the location of buildings designed for specific uses, together
with appropriate regulations and restrictions to 'be imposed thereon, outside of incor-
porated cities and villages, as required by the provisions of section 59.97-of the `fdis-
consin Statutes.
That, thereafter, it counseled with officers and citizens of twenty-five (25)
towns, to -wit: Barksdale, Barnes, Bayfield, Bayvie'w, Bell, Cable, Clover, Delta, Drum-
mond, Eileen, Hughes, Iron River, Kelly, Keystone, Lincoln, Mason, Nameka.gonn, Orienta.,
Oulu, Pilsen, Port Wing, Pratt, Russell, Tripp, and Iffashburn, discussing; with said of-
ficers and citizens essential features of the tentative zoning ordinance and the relat-
ions of the totwns thereto.
That it caused to be held, in the city of Washburn, on April 18, 1934, public
hearing on the tentative zoning ordinance, due notice of which was published in the of-
ficial nel,^aspaper of the county prior to the date of the hearing, a brief of the minutes
of vahich hearing are on file in the office of the county clerk.

An ordinance regulating, restricting and determining the areas within the county
in which agriculture, forestry and recreation may be conducted, the location of roads,
schools, trades and industries, and the location of buildings, designed for specified uses
and the establishment of districts for such purposes and the establishment of set -back
buildings lines outside of the limits of incorporated villages and cities, pursuant to
section 9,97 of the Wisconsin statutes.
The county board of' supervisors of Bayfield county does ordain as folloi. s:
SECTION I.
Districts and District Iriaps.
For the purpose of promoting public health, safety and general ,7jelfare and regu-
lating, restricting and determining the areas within which agriculture, forestry and rec-
reation may be conducted, and establishing districts which are deemed best suited to carry
out; such purposes, outside of the limits of incorporated villages and cities, and in accor-
dance with the provisions of section 59.97 of the Wisconsin Statutes, the territory inclu-
ded in the boundaries of the following towns, to -wit; Barksdale, Barnes, Hayfield, Bay -
view, Bell, Cable, Clover, Delta, Drummond, Eileen, Hughes, Iron River, Kelly, Keystone,
Lincoln, 14ason, Namel:agon, Orient a, Oulu, Pilsen, Port �,Ijing, Pratt, Russell, Tri-op and

SECTION II.
Forestry District.
In the forestry district no building, land or premises shall be used except
for one or more of the following specified uses;
1. Production of forest products
2. Forest industries
3. Public and private parks, playgrounds, camp Grounds and golf grounds
4. Recreational camps and resorts
5. Private summer cottages and service buildings
b. Bunting and fishing cabins
7. Trapper's cabins
b. Boat liveries
g. Mines, quarries and gravel'pits
10. Hydro -electric dams, power plants, flowage areas, transmission lines and
sub -stations.
11. Harvesting of any wild crop such as marsh hay, ferns, moss and berries, tree
fruits and tree seeds.
(Explanation -- Any of the above uses are permitted in the Forestry District,
and all other uses, including family dwellings, shall be prohibited.)
SECTION III.
District No. 2 - Recreation District
In the Recreation District all buildings, lands or premises may be used for any
of the purposes permitted in District No. 1, the Forestry District, and in addition,
family dwellings are permitted.
(Explanation Any of the above uses are permitted in the Recreation District,
and all other uses, including farms, shall be prohibited because of the fire hazard invol-
ved in clearing, operations and spoilation of forested conditions adjacent to highly devel-
oped recreation property. Such properties demand the maintenance of a maximum of natural
conditions to retain their fullest economic value.
Family dwellings are permitted in order to allow owners to protect their invest-
ment during the entire year.)
SECTION IV.
Unrestricted District.
In the unrestricted district, any land_ may be used for any purpose whatsoever,
not in conflict with law.
SECTION V.
Non -conforming Uses.

The lawful use of any building, land or premises existing at the time of the
passage of this ordinance, although such use does not conform to the provisions hereof,
may be continued, but if -such nor.lonforming use is discontinued, any future use of said
building, land or premises shall be inconformity with the provisions of this ordinance.
The lawful use of a building, land or premises existing at the time of the pas-
sage of this ordinance may be continued although such use does not conform with the pro-
visions hereof, and such use may be extended throughout such building; land or premises.
Whenever a. use district shall be hereafter changed, any then existing non -con-
forming use in such changed district may be continued or changed to a use permitted in
the new use district, provided all other regulations governing the new use are complied
with.
Whenever a ton -conforming use of a. building, land or premises has been changed
for

such

shall not
thereafter be changed

unless

Immediately following Publication of this ordinance by the county board, the
County Zoning, Committee shall prepare a list of all instances of established non -conform-
ing uses of land and publish the*sa.me to permit appeal on errors and omissions. Thirty
days after publication of this list a final and official copy shall_ be filed in the office
of the register of deeds.
Nothing in this ordinance shall be construed as prohibiting forestry and recrea-
tion in any of the use districts nor a change from any other use to forestry or to recrea-

SECTION VI.
Land Exchange.
Lands acquired by Bayfield County through tax deed in the unrestricted district
may be subject to exchange for privately owned lands within the forestry district or the
recreation district when such exchange will promote the regulation and restriction of agr
cultural and forestry lands.
SECTION VII.
BOUNDARIES of DISTRICTS
District boundary lines shall follow along the lines, including Oeighth" lines
or lines extended, indicated on the United States General Land Office survey maps, or alo
meandered streams.
SECTION VIIT..
Interpretation and Application.
The provisions of this act shall not apply to buildings, land or premises bel
ing to and occupied by the United States, the'State of Wisconsin, any torn, or any school.
district.
(Explanation --Restrictions as to the use of land or buildings in districts 1 and
2, the forestry district and the recreation district, respectively, shall not apply on
lands owned by Indians, when such lands were obtained by Indians upon proof of competency.)
SECTION IX.
Changes and Amendments.
The board of supervisors of Bayfield County may from time to time amend, supple-

ment or change by ordinance the boundaries of districts or regulations herein established,.

ated any lands affected by such amendment, supplemment or change. Any proposed changes
shall first be submitted to the County Zoning Committee for its recommendation and report.
Any and all ordinances which may amend this ordinance, T�hich have been adopted
as herein provided, shall be submitted to the to.nrn boards governing the territory affected
thereby and their approval obtained before the same shall be adopted by the county board.
SECTION X.
Enforcement and penalties.
The provisions of this ordinance will be enforced by and under the direction of
the county board. of supervisors. Any person, firm, company or corporation who violates,
disobeys, omits, neglects, or refuses to comply with or .Rlrio resists the enforcement of
any of the provisions of this ordinance shall be subject to a fine of not less than ten
($10.00) dollars nor more than tiro hundred (1200. 00) dollars, together with costs of
action, and in default of payment thereof to imprison.nent in the county jail for a,
period of no' Less than one (1) day nor :core t'r�a.n six (5) months, or until such fine
and costs be maid. Colpliance therewith may be enforced by in junctional order at the
suit of the county or the -owner or owners of land within the district affected. by the
regulations of this ordinance. ,
SECTION XI.
Validity.
Should any section, clause or provision of this ordinance b.e declared by the
courts to be invalid, the same shall not affect; the validity of the ordinance as a
whole or any lDart thereof, other than the part so declared to be invalid.
SECTION XII.
Definitions.
Certain terms and words used in this ordinance are defined as follows;
Words used in the present tense include the future; words in. the singular
number include the plural number, and words 'in the plural number include singular,
number; the word "building" includes the word ll structurell and. the i ord_ 'I s"la.11" is

to roofs, ,,vi.ndows and a coat of paint z-vhich, if done, will help preserve said County -
owned buildings and also bring a better selling price to the County,
THEREFORE BE IT RESOLVED that the County Boaxd%nereby appropriate the sum of
0200.00 to be used to make such minor repairs to such buildings -rdhich deem most profit -able
to Bayfield County, work to be supervised by building; and grounds committee.

The following resolution was read;
R E S O L U T I O N
wEERPAS the Bayfield County Board did create a Child Welfare Board and
WHEREAS such Welfare Board has been active in Bayfield County and
WHEREAS the County 'Board_ for the year 1933 did appropriate the sum of $130.00
for the expense of said committee and
WHEREAS the Board was financially unable to ma?e any appropriation for 1934 and
THEREAS the Welfare Board being aware of such condition did by personal sacri-
fice and economy have left in its budget December, 1933, the sure of 126.73 and
WHEREAS the County Clerk could not legally allow the 7elfare Board to draw againE
said balance after January 1, 193''r
BE IT HEREBY RESOLVED by the Bayfield County Board in special session this 24th
clay of April, 1934, that the County Clerk and County Treasurer are instructed to honor
vouchers and draw checks payable to the needs of the Welfare Board up to the amount of
$26. 73.

salaried officials with mileage allowance,, and
WHEREAS it is to the interest and welfare of the County that he do so and
WHEREAS the State makes no arrangement for compensation for these services,
BE IT HEREBY RESOLVED by the Bayfield County Board of SuDervisors in special
assemblage this 24th day of April, 1934 that the Chairman of the County Board be and is
hereby allowed per diem and mileage for such meetings attended since November 24, 1933
