The following members answered roll call: Nohl, Smith, Alcott, Irish, Sohnson, Monson, Buckley, Art Hanson, Unseth, Arnold, Desparois, Mineau, Pristash, Sigurd Swanson,. Kerr, Schultz, C. 0. Moved by Nohl and seconded by Alcott to dispense with the reading of the min- utes of the County Board Meeting held November 9, 10.and 11, 1937, and that they be approved of as published. Motion carried. The Board proceeded with the election of Chairman for the ensuing year. The Chair appointed Hougas and Alcott as tellers. The result of the first ballot was as follows: Squires 27 Rivers 6 fl2ineau 1 C. 0. Nelson 1 vitliams 1 Not voting 1 Total 37 Iti2oved by Arnold and seconded by Rude that the informal ballot be declared formal and that Squires be duly elected as Chairman of the County Board for the ensuing year. The Clerk put the motion.'to a vote and it carried. The Clerk, therefore, de- clared Mr. Squires duly elected. The result of the first ballot for Vice-chairman was as follows: Nohl 21 Rivers 4 Mineau 3 Knight 2 Unseth 1 Rude 1 Fiege 1 Alcott 1 Not voting 3 Total 37 The Chair declared Mr. Nohl duly elected as Vice-chairman for the ensuing year. Moved by Arnold and seconded by Unseth that the rate per folio be set at - forty -five cents for the publication of the official Gounty Board Proceedings for the coming year, with the.same arrangement for supplements -as now in force. 1,10tion carried.. Dr. Shumate, Superintendent of Pureair Sanatorium, spoke to the County Board with regard to a proposed addition to the Sanatorium, particularly for an operating room. TiVisconssin Statutes, -you are hereby notified in absence of County Board meeting that Randall ff. Smith has furnished a surety bond from the National Surety Corporation for $1000 covering the Office of County Surveyor. The following petition was read: TO THE COUNTY BOARD OF BAYFIELD COUNTY, 7,TISCONSIN: Gentlemen: Yours very truly, Ludwig Tranma1 Bayfield County Clerk U. S. Dept. of Agriculture. Milwaukee, Wisconsin July 8, 1937 The undersigned is now and has been for some twenty years last past, employed as a title attorney for the United States Department of Agriculture in the Office of the Solicitor of said Department; that during the course of said period of time I have ex- amined and passed upon titles to lands being acquired by the Forest Service, United States Department" of Agriculture, in various States, including the State of ?Wisconsin; that I have at all times meticulously endeavored to ascertain and have settled by our vendors, before concluding any specific case, all unpaid taxes and other liens which may exist against any lands being so acquired; that in or about the year 1935, the Kopplin Company of Iron River, Wisconsin, optioned the S-z SE of Section 20, Township 48 North, Range 7 West, to be acquired by the United States for National Forest purposes; that I did examine the title to said description and duly certified same as free and clear of the assessment of' all taxes and the United States thereupon paid to the optionor company, the purchase monies therefor; that through an oversight on my part, I apparently overlooked the assess- ment of omitted taxes in the amount of approximately $16.32, which omitted taxes: for the year 1927, 1928 and 1929 on said description were so assessed as omitted taxes on the records of the Township Treasurer; that at the time I consummated this case and certified - the title clear, the said omitted taxes were not on the tax rolls of or in the hands of the County Treasurer for collection and.I apparently overlooked checking these omitted taxes with the Township Treasurer. Under the circumstances, and since I have certified this case for payment and since the purchase monies have been paid to the'Company and since the Company is now defunct or non-existent and since my request to the Company; made immediately after this error was discovered, to pay said amount to the County Treasurer has remained uncoraplied with, it becomes necessary that I pay the said amount of �`,16.3Z from my own personal funds The amount of taxes due Bayfield County which I have required to be paid.during the time I have been handling title work in W.1sconsin is enormous and if I am required to pay this amount of 5?16.32, it will work a hardship on me and L, therefore, respectfully request.your County Board to'kindly cancel said omitted taxes and thereby relieve me of the necessity of clearing a matter which I inadvertently overlooked at the time of con- summating this particular case. The following resolution was read: BE IT HEREBY RESOLVED that the District Attorney be instructed to press claim for all damage done by dogs from owner when owner is known. IT. G. Nohl Moved by Alcott and seconded by Hougas to adopt the foregoing resolution. Motion carried. The following resolution was read: WHEREAS, a number of record books in the Register of Deeds Office are very much in need of repairs, requiring services of a book binder, THEREFORE BE IT HEREBY RESOLVED that the Register of Deeds be .authorized and directed to have the books properly repaired and to accompany said books to the book binder, as required by the Wisconsin Statutes governing same. The following resolution was read: TO THE, COUNTY BOARD OF BAYFIELD COUNTY: WHEREAS, no appropriation was made by the County Board of Supervisors of Bay - field County at their meeting in November, 1937, to cover any part of the administration of the CAB Office and 7WHEREAS, the CAB,Director finds that the administrative expenses of the office runs. on an average of 520.00 a month over the State allotment for the office and VHEREAS, the CAB Office serves all the municipalities in the county and functionE as a county office in assisting the county in placing, its. unemployed persons on ;VPA projects, NOW, THEREFORE, be it resolved that we the members of the Relief and CAB Committee recommend to the County Finance Committee: _and to the County Board of Bayfield County that an appropriation of two hundred dollars ($200.00) be made to assist the CAB Director in covering'the administrative expenses of the GAB Office. The following resolution was read: �a ANNZTAL ORGANIZATION MEETING OF THE.' BAYFIELD COUNTY BOARD MAY 3. 1938 TO THE COUNTY BOARD OF BAYFIELD COUNTY: WHEREAS, the County Board of Supervisors are the: sponsors of the Bayfield Count Wide sewing project which is supervised by the CAB agency, and WHEREAS, the WPA Office has discontinued paying the expenses of repair of sew- ing machines used on the projects, and WHEREAS, the sewing projects employ twenty-four women on the projects, and. WHEREAS, the project benefits and serves the entire county, and. WHEREAS, the estimated costs of repair of the above mentioned machines will not. exceed $40.00 for the balance of this year, THEREFORE, be it resolved, that the County Board of Supervisors make an approp- riation of $40.00 to cover the .expense of repair of the machines. The following resolution was read: TO THE COUNTY BOARD OF BAYFIELD COUNTY: WHEREAS, the County Board of Supervisors of Bayfield bounty at their November meeting in 1937 adopted a resolution making $500.00 available to the CAB Office to be used in purchasing materials,for.the County sewing projects, and trucking of surplus commodit- ies, and WHEREAS, approximately $2.77.96 of said appropriation remains on hand, and WHEREAS, hills have been incurred by the CAB Office for administrative purposes in connection with the function of the office and WHEREAS, such bills incurred amount to $14.9.12, and are unpaid, NOW THEREFORE, be it resolved, that we the members of the CAB Committee rec to the County Finance Committee and to the County Board that the CAB Director be author- ized to pay the bills incurred for administrative purposes for the months of November, and. December of 1937, January, February, March, and April of 1938., out of said appropriation made by the County Board at its November meeting in 1937. Albert E. Swanson S. E. Squires Henry J. S. Nelson that the County Board refuse to appropriate funds for the operation of the Central Application Bureau in the future, and that said Central Application Bureau stay within its budget as. allotted by the State. Motion carried. 5 ANNUAL ORGANIZATION iIMETING OF THE_BAYFIELD_COU1�1'IY_BOARD ___ 0 The following petition was read: Bayfield County Board of Supervisors Gentlemen: I redeemed my property from the County about two weeks ago, described as Lots 30, 31 and. 32, Block 28, Townsite of 1ashburn, for the sum of $268.54. The shed used as a garage f or the above mentioned premises is on Lot 1, Block 28, Townsite of '4`ashburn, known as the old Red Front property. I wish to purchase the shed and make an offer of $11.00 for same. It would not be practical for me to redeem it as the accrued taxes against the said lot are $782.00. The shed is constructed of hemlock,;and very little lumber could be realized if it were sold for wrecking purposes. Neither is it practical to move it as a garage for the reason that the sills are rotted and the floor is all dry -rot. If my petition is granted, I agree to tear the shed down and clean tip the premises at any time that the County may desire, or in case the County should have an opportunity to sell the Lot. carried. Whereas the Town of Clover in its road improvement program is in need of the grant of the road right of way as follows: 33 feet on each side of the center line of the Lenawee Road going through the following I county owned land to wit: NW NE and SE SW, Sec. 4, Township 49, R. 7 and - NE Ned and SE MY and NE SW and SE SW in Sec. 9, Township 49, R. 7. THEREFORE BE IT RESOLVED by the County Board that the Town of Clover be granted the above described road right of way. Daniel J".. Buckley, Chairman Moved by Kerr and seconded by A. C'. Hanson to adopt the foregoing resolution. Motion carried. The following petition was read: April 29, 1938 NIr. Ludwig Tranmal, Co. Clerk I would like to buy the matured green timber on the SE of the SW quarter, Sed. 17-50-5. The timber on this place is mostly large popple which I prefer most, but there may be some down stuff such as cedar I want to inquire about too. It would be to an ad- vantage to the Town of Bayfield to have this stuff cleaned out as it is alongside a new piece of road they cut through a swamp and it would help to dry the grade up. 1:Zr. Aleott knows this piece of timber and can verify what I write about it. Please take this up at your coming Board meeting and let me know about it as soon as possible. Yours truly, Wm. G . The following decisions of the Wisconsin Highway Commission were ordered re- ceived and placed on file: Change in the State Trunk Highway System i in Bayfield County, State Trunk Highway No: 112 TO THE COUNTY BOARD OF BAYFIELD COUNTY: f i The State Highway Commission of Wisconsin at its meeting held Saturday, April 30, 1938, pursuant to public hearing held in the City of Ashland on April 27, 1938, after due notice to the localities concerned and in accordance with the Statutes in such cases made and.provided, decided to make a change in the State Trunk Highway System in Bayfield County by abandoning as a portion of the ,State Trunk Highway System a certain road and by substituting another road in lieu thereof as hereinafter described. The road so to be abandoned as a portion of the State Trunk Highway System is i described as follows: Beginning at a point at the intersection of U. S. Highway No. 2 and State Trunk Highway No. 112, at or near the center of the southeast one -quarter of Section 10, Town- ship 47 North, Range 5 Hest; thence northerly along the present marked and traveled State Trunk Highway Na. 112 to the east one -quarter corner of Section 34, Township 48 North, Range 5 West; thence easterly to its intersection with the present marked and traveled State Trunk Highway No. 13. The road to be added to the State Trunk Highway System in lieu thereof is des- cribed as follows: Beginning at a. point on the present marked and traveled U. S. Highway No. 2 on the south line of and approximately 500 feet east of the southwest corner of Section 9, Township'47 North, Range 5 ,hest, thence northeasterly along the most direct feasible route through Ashland Junction to an intersection with the present marked and traveled State Trunk Highway No. 13 in the southeast one -quarter of the southeast one -quarter of Section 35, Township 48 North, Range 5 West. Since the foregoing changes more than one mile of the State Trunk Highway System, the order making the change must be referred to and approved by the County Board of Bayfield County before the same can become effective. Your honorable body is, therefore, requested to act in the natter at the first convenient opportunity, and to cause a report of your action to be made to the State Highway Commission of eVisconsin as soon as practicable thereafter. S, Highway No. 2 and State Trunk highway No. 112. The following resolution was read: A RESOLUTION authorizing and directing Bayfield County to issue a tax receipt for the taxes for the year 1936 on certain property in the City of "dashburn and to charge the amount of said delinquent taxes against the excess delinquent tax account of said City. RESOLVED by the County Board of Bayfield County at a meeting thereof held this 3rd day of May, 1938, pursuant to the provisions of Section 59.04 (b) of Wisconsin Statutes, that the County Treasurer and the County Clerk make, execute and deliver a redemption receipt for the taxes for the year 1936 on the following described real estate, to -wit: That part of the Southeast Quarter of the Northwest quarter (SE4 of 1VtiV) of Section six (Sec. 6), Township forty-eight, north (T48N) of Range four, west (R 4YT) lying northwest of the Northern Pacific Railway Company's right-of-way and containing twenty acres more or less, owned by Elma Rose Skaug, and to charge the amount of said taxes against the excess delinquent tax account of said City of Washburn in pursuance of an agreement between said City of Washburn and the owner of said property by which said - owner gave said City right-of-way for a public highway on said premises. Motion carried. r� The following resolution was read: ANNUAL ORGANIZATION MEETING OF THE BA17FIELD COUNTY BOARD ----- - ---- T\UIY 3 1938 -------- 9 e WHEREAS, Bayfield County, in pursuance to a resolution of November 6, 1933 of the Town Board of the Town of Bell, quit claimed the Southwest quarter. (SjP.T) of the Southwest quarter (S z1) , and the Northwest quarter (Nffl) of the Southwest quarter (S7,PF ) of Section four (4), Township fifty (50), Range six (6). to said Town of Bell on June 10, 1934, the consideration for said deed being the exchange of said Town's delinquent real estate tax .credit existing on said lands, and, WHEREAS, said deed stated therein that.it was issued in accordance with a resolution adopted by the.Board of Supervisors of said County at a meeting held May, 29, 1924, which resolution was recorded on page 57, volume VI, Journal, and, 'TWHERE_AS, doubt has been cast on the legality of said deed because of the fact that the statute authorizing Towns to exchange tax credit for county owned lands did not become effective until June 22, 1933, NOW, THEREFORE', in view of the foregoing facts, be it hereby resolved that the County Clerk be authorized, and hereby directed, to now issue a quit claim deed of said above described lands by and in behalf of said County to said Town of Bell. The following resolution was read: A RESOLUTION, Authorizing and directing the County Clerk of Bayfield County, to convey to the City of Washburn, certain lots in said city held by said county by tax deed. RESOLVED,.By the County Board of Bayfield County, assembled at the regular May, 1938 meeting thereof, this 3rd day of I:2ay, 1938, that the County of Bayfield con- vey to the City of TiVashburn, lots numbered fifteen (15) and siXteen (16) of block numbered forty-nine (49) of the plat of the original townsite of the City of Washburn, according to said plat as recorded and on file in the office of the Register of Deeds in and for Bayfield County, and charge the same to the excess delinquent tax account of said city on the books of said"county; and that said County Clerk of said county be and he is hereby instructed and directed -to make;" execute and deliver to said City of 'Washburn, a deed of said lots and to charge the same on the books -of said county against the excess delinquent tax account of said city. carried. The first three named parties and the deceased are the record title holders to lands in Bayfield County described�as the Southwest Quarter of Section Nineteen, Township forty-six North, of Range Nine West. GENTLEMEN: The Wisconsin Statutes provide (Sec. 70.3�:) that itreal property shall be valued by the Assessor from actual view or from best information that the Assessor can pract- ically obtain, at the full value which could ordinarily be obtained therefore at private sale. LL This is a truly equitable approach to the matter of tax valuation. It appears, however, that this provision of the law has not been followed in'the matter of the valua- tion of lots 13 and 14 in Block 52, Original Townsite in the City of Washburn (known as the Dr. Frey house). Actual figures are given herewith to substantiate this statement. In 1919 this property represented 16% of the valuation for the south side of this block 52. In 1937 the tax valuation in relation to this block was 22.%. These figures are more impressive when it is considered that the valuation for the entire south side of the block in 1919 was $18,500.00 and in 1937 was $10,850.00. A situation exists therein where the valuation of the block dropped 40%, and the valuation of lots 13 and 14 therein in- creased 6% during the same period of time. . ANNUAL ORGANIZATION TJiEETING OF T MAY 4. 19 In fairness and for the purpose of giving the Committee• and the Board a full picture of this situation, it should be set out here that one building, known as the Delziel House, has been torn down in the meantime. In 1919 three lots 20, 21 and Z`2 were included in the Delziel property and the valuation thereof was $3400.00. Placing a valuation of $2800.00 on the building itself, we have'a variance of more than 30% over the period from 1919 to 1937 in the valuation of the south side of this block. This, of course, is wholly inequitable and contrary to legal concepts of taxation. If the property on lots 13 and 14 had been improved and kept in good repair dur- ing the past years some justification might exist. On the contrary, however, the building has rapidly deteriorated without any upkeep whatsoever. There is a small basement or cellar under the kitchen part, balance of the house is on a concrete foundation. There is one hardwood floor in the kitchen, balance of the floors are of pine, and the plaster is; cracked in most of the rooms, the roof is not very good and will soon have to be replaced and the house leveled up. If I was to offer;,this property for sale I doubt if. I could get much over $1000.00 for it. If the amount nozlr due in delinquent taxes were to be reduced to a figure commensurate with the value of the propertyj' this would provide an incentive to improve the building. I am willing to pay on a valuation of 6,,11700.00 (this figure is determined on a basis of 7'0% of the present valuation and would be in accordance with the decrease in valuation.of the other property on the south side of the block. Keeping in mind that the entire block has experienced a decrease'of 30% from 193,9 to 1937 and my property has not. The present delinquency. -has been caused almost wholly by lack of income. During the past fifteen years, the income from this property has been devoted to payment of street assessments, taxes,.repairs and other necessary expenses. I submit the following facts to show that it is over assessed: 1 - Investment Value This is purely an income producing property as distinguished from residential property. Its rental income amounts to $180.00 per year. Taxes assessed for 1937 amounted to �122.00. Excessive repairs on account of the age of the buildings, insurance, collections, etc. with taxes, amount to more than its income.. It does not pay interest on any amount of capital invested and therefore has no.investment value. 2 - Comparison Lot 13 of Block 72, an adjacent lot, is assessed (lot and building) for �2,200.00. This is also rental property. The amount of income is not known to me but I.do know that the house is of a more substantial type than the one which I own, being from forty -to fifty years newer and would need considerably less repair. I'do not think that Lot 13 is under assessed but I am using this comparison to show that my property is over assessed. 3 - Sale Value This property has been offered for sale for more than ten years without receiving even a modest offer for it. I am advised that at forced aale, my property would bring little more than the amount of outstanding taxes. 4 - Loan Value I have made diligent effort to borrow sufficient monies on this property to pay delinquent taxes. Loan agencies establish their value on an earning basis. Applications have been rejected because of the fact that the earnings are not sufficient to repay a loan. This rule does not apply to residential property. 5 - Replacement Value Replacement value could hardly be considered in a situation of this kirid. In case of destruction of the property, with its present.earningsa.rebu.ild- ing would be, impossible. STATUTE INVOLVED SECTION - 70.32 (1) - Real property shall be valued by the assessor from actual view or from.the best information that the assessor can practically obtain at the full value which could ordinarily be ob- tained therefor at private sale -- k _* * * * * * * Tt2Y C ON T ENT I ON The assessments as placed by the assessor represent valuations that are approximately three times the market value as defined by the statute. The assessments represent arbitrary values arrived at by rule of thumb methods ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD TJAY 4. 1938 in plain disregard of the statutory requirements and not at the full value which could ordinarily be obtained at private sale. The assessor failed to take into consideration the collapse of valuers of invest- ment properties due to the closing of the saw mills and to the depression in determining market value within the meaning of the statute. My buildings are located on Lots 14, 15 and 16 and not wholly on Lot 15 as indicated. This, no doubt, has caused in part an illegal assessment. That the loss in value in the city of Bayfield property is not a temporary condition. This loss of income has continued through good times and bad for more than fifteen years. I am familiar with the rule that requires taxpayer.s'to present their protests to a Board of Review. I. have not done so in this case because no income was available for the cost of travel from Milwaukee to Bayfield. I realize the difficulty assessors have encountered in properly assessing these properties. It seems to me, however, that if values were placed on these investment properties so that they could at least pay their way_,it would have a tendency to encourage investors in the purchase of property and thereby increase values. OFFER IN SETTLEMENT I am in a position to pay �?,286.00 for all delinquent taxes on the above des- cribed property, and ask that the same be accepted. This offer is intended to pay the tax in full on Lots 14, 16 and 17.and reduces the assessment on Lot 15 to $700.00 for lot and that part of the house located thereon. The following petition was read: To the Board of Supervisors of Bayfield County: GENTLEMEN: The Board is hereby petitioned to authorize the sale of tax certificates to they ANNUAL 0GANIZATION MEETU OF THE BAYFIELD COU�_Y_B�RD MAY 4, 1938 w petitioner herein on Lots 11 and 12 of Block 52 of the city of Washburn on a basis of 70% Of the present value thereof. The amount now in delinquency is $796.89; I am ready and willing to pay $550.00. This petition is based on the fact that the valuation of the south side of the Block wherein these lots lie has been reduced from $l&,500 in 1919 to $10,850 in 1937 while the valuation of Lots 11 and 12 has increased from 17% of the valuation of the Block to 20% of the valuation. In the meantime, as a matter of fact, the dwelling house there- on has depreciated in value at least $1500.00. In order to make the House livable throughout the, year, it will be necessary to install a furnace at the estimated cost of $400.00; the furnace formerly there having fallen into complete disuse. Other necessary repairs will require an additional outlay of approximately $600..00. It is your petition - errs willingness to have the property assessed at the value which could ordinarily be obtained -at a private sale after these improvements are added; but until that time it' would appear only fair and equitable and in accordance with the theory of real estate taxation in the State of Wisconsin that the assessed valuation be reduced to an amount commensurate with the present value thereof which is not more than $p1600.00. Yor the information of the Board it may be stated in substantiation of this statement that the petitioner carries insurance on the dwelling in the amount of $1500.00; the insurance company having set that value as fair. I am also sending you pourer of Attorney of three, of the petitioners, to show you that I have power to act in.this matter; I have power of Attorney of twelve other improved property owners on Iron Lake, which I have filed with.the Public Service Commiss- ion, with petitions to it for a public hearing, which must be had before anything can be done. But first of all we must have a.survey of the Lake, and have the Surveyor who made the survey for a witness before the Commission at the hearf;--�therwise I am afraid we won't get a hearing. Since the Board has gone on record at the last meeting, and appropriated $300.00 for the purpose of improving Iron Lake by raising the water and establishing water levels, I would like to ask as a representative of the, property owners on the shores of the said lake, that the County Board direct that a -survey be made of Iron Lake just as soon as possible s:o that a date can be set for a hearing, providing the commission decide t'o grant a hearing. Will you please return to me your letter, also Mr. Newhouse's letter and the power of Attorney of the three petitioners. Will you also bring this to the attention of the Board? Respectfully, E. F.
