The following members answered roll call: Nohl, Smith, Alcott, Irish, Tohnson, Monson, Buckley, Art Hanson, Unseth, Arnold, Desparois, Mineau, Pristash, Sigurd Swanson, Kerr, Schultz, C. 0. Nelson, Maryland, Mihalak, Anderson, Wallin, Rowley, Hougas , Nyberg, Williams, Hogstrom, Fiege, Knight, H.J.S. Hanson, R. S. Nelson, Kasmarek, Rivers, Thoreson, Olsen, A.E. Swanson, Rude, Squires. Total 37. The following communication was read and ordered placed on file: July 29, 1938 Mr. Ludwig Tranmal County Clerk Washburn, Wisconsin Dear Mr. Tranmal: I+1lr. Earl Anderson, who was elected a supervisor at the last spring election, was appointed as Chairman to fill the vacancy caused by Carl Bystrom's resignation. Mr. Hilmar Hansen was appointed supervisor in Mr. Anderson's place. Motion carried. The reading of the petition for a special meeting of the County Board was, upon motion by Williams and seconded by Arnold, duly dispensed with and ordered placed on file. The call was as f ollows: July 25, 1938 Mr. Ludwig Tranmal County Clerk Washburn, Wisconsin Dear Mr. Tranmal: We, the undersigned members of the Board of Supervisors of Bayfield County, Wisconsin, hereby request that a special meeting of the said Board of Supervisors be held at the Court House in the City of Washburn, Wisconsin, at 10 o'clock A. M. on Tuesday, August 2, 1938, for the purpose of considering and acting upon the following questions: (1). To continue on the county system of poor relief, hire a relief director and provide funds for same; (2). To go off the county system of poor relief; (3). To borrow money, (4). To authorize, sale oT lands to the Northern Pacific Railway Company; (5). For consideration of claims against the County; SPECIAL MEETING OF THE BAYFIELD COUNTY BOARD (6). To authorize appeal from decision or decisions of the Wisconsin Industrial Commission in relief cases; (7). To forbid use of damsite grounds in Section 19, Township 44 North, of Range 9 West, for park or .camping purposes; (8). To authorize exchange of County -owned lands with N. E. Ledin in Section 34, Township 47 North, of Range 8 West; (9). To authorize options of County -owned lands to the United States Forest Service; (10). For the transaction of any other business that may legally come before the County Board at said special meeting. In answer to the call, the County Clerk sent out the following notice: Dear County Board Member: The undersigned having been duly petitioned in accordance with the Wisconsin Statutes to call a special meeting of the County Board of Supervisors of Bayfield County, Wisconsin, you will, therefore, please take notice that the Bayfield County Board of Supervisors will meet at the Courthouse in the City of Washburn on Tuesday forenoon, August 2, 1938, at 10 o'clock for the purpose of transacting such business as may legally come before the Board. Yours very truly, Ludwig Tranmal, Bayfield County Clerk The following resolution was read: BE IT RESOLVED that the Resolution regarding relief adopted by the Bayfield , County Board of Supervisors on November 17, 1933, and recorded in Volume 7 on page 181, Journal of County Board Proceedings,,and. said Resolution as amended by County Board in special session on February 12, 1934, and recorded in Volume 7, on page 192 of Journal of County Board Proceedings, BE HEREBY REPEALED in accordance with Section 49.16 of the Wisconsin Statutes and that the system of relief be the entire responsibility of the various towns, cities and villages within Bayfield County. Moved by Williams and seconded by Nohl that the Relief Committee be in - strutted to continue their activity in trying to secure' Federal warehouse for sur plus commodities. Motion carried. The following resolution was read: BE IT RESOLVED, by the County Board of Bayfield County in special session assembled this 2nd day of August, 1938, that the County of Bayfield borrow a sum of money under and by virtue of authority invested in it by Section 67.12 of the Statutes for 1937, at. a rate of interest not to exceed 4 percent per annum, the amount of said loan to be determined by the County Clerk, County Treasurer and Chairman of the County Board at such times and in such amounts as the need arises, not to exceed, however, the sum of Seventy Thousand Dollars, such sum to be repaid in any event not later than the 30th day of August, following the next tax levy; said money to be borrowed and used for the purpose of paying current expenses of the County, such as, salaries, care of county charges, and prisoners, expenses of maintaining the courts, and other necessary and current expenses, and BE IT FURTHER RESOLVED that the County Clerk and Chairman of the County Board hereby are authorized to execute and deliver the promissory note of said County to evidence said loan. There is hereby levied on all taxable property of Bayfield County the sum of $70,000.00, together with such additional sum as shall be required to pay the interest on said sum at the agreed rate to -the time of repayment of said loan, said sum to be placed on the next tax roll and collected as other taxes are collected. The following resolution was read: WHEREAS, the Conservation Committee of the Bayfield County Board of Super- visors has received a quit claim deed from Michael Hughes to the following described land: Starting from -the - S. W. 1/8 corner of Section 18 and the N. W.'1/8 corner Section 19, T 44 R 9 W, a course was run S 8 degrees -00' W a distance of 120 feet to the point of beginning', thence N 90 degrees -00' E a distance 350 feet, thence S 6 degrees - 30, E a distance of 200 feet, thence S 90 degrees -00' W a distance of 350 feet, thence N.6 degrees - 301 a distance of 200 feet to the point of beginning, enclosing an area of approximately 1.63 acres, for the purpose of building a combination dam, town bridge and boatway on and over the thoroughfare between the Upper and Middle Eau Claire Lake, and WHEREAS, this quit claim deed was received.by Bayfield County for a nominal consideration for the sum of One ($1,00) Dollar, and WHEREAS, the Conservation Committee agreed that part of the consideration was on condition that the above land would not be used for a public campsite, %.I NOW THEREFORE, in view of the foregoing facts, we hereby resolve that the SPECIAL MEETING OF _THE_BAYFIELD__COUNTY—B9ARD- _ _ AUGUST 2, 1938 public be barred from use of any of the above land for public parking or campsite purposes, and I ' BE IT FURTHER RESOLVED, that Mr. Michael Hughes be furnished with a certified copy of this resolution for his record. The following resolution was read: WHEREAS, the Town of Delta desires to construct a town highway on the township line between township 46 north of range 6 west and township 46 north of range 7 west, and WHEREAS, Bayfield. County owns the west half of the northwest quarter of Section 18, Township 46 north, of Range 7 West and the northeast quarter of the northeast quarter of Section 24, Township 46 north, of Range 7 west, THEREFORE, BE IT HEREBY RESOLVED that the County Clerk be authorized and directed to issue a right of way release to a strip of land 33 feet along the west side and extending from the north line to the south line along the west side of the west half of the northwest of Section 18, Township 46 north, of Range 6 west, and a strip of land 33 feet wide extending from the north line to the south line on the east side of the northeast quarter of the northeast quarter of Section 24, Town- ship 46 north, of Range 7 west, for the consideration of One ($1.00) Dollar. The foregoing resolution was read: WHEREAS, Bayfield County is the owner of the northeast quarter of the southeast quarter of Section 6, Township 45 north, of Range 5 west, situated in the town of Lincoln, and WHEREAS, it is a part of Bibon swamp practically inundated at the present time and in dry seasons practically one-half is under water, and WHEREAS, there is little or no forest coverage and it is covered by brush, therefore, in view of the foregoing facts, WE HEREBY RESOLVE that the County Clerk be authorized and instructed to issue a quit claim deed to Frank Dahl who now owns the forty of land adjoining it on the north side and that the consideration for the northeast quarter of the southeast quarter of Section 6, Township 45 north, of Range 5 west, be the sum of Thirty-seven and 60/100 ($37.60) Dollars, which is the amount of tax plus interest accumulated to date. Sigurd Swanson 52 SPECIAL MEETING OF THE BAYFIELD COUNTY BOARD Moved by A. C. Hanson and seconded by Pristash to adopt the foregoing resolution. Motion carried. The following resolution was read: WHEREAS, the County Board Committee in Charge of Sale of Tax Deed Property sold the building on the North Half of Lots 17 and 18 of Block 49 of the Townsite of Washburn to Allen Morris, high bidder, on May 24, 1938, for the sum of Sixty ($60.00) Dollars, and WHEREAS, in wrecking the same, he found that the building had been gutted by fire and the salvage thereupon did not exceed fifteen hundred boardfeet of lumber, with only part salvage of the sills, and WHEREAS, he is desirous of purchasing a lot upon which to build;'namely, Lot 2, Block 63, Townsite of Washburn, and WHEREAS, the Committee in Charge of Sale of Tax Deed Property set a sales price of $50 on said lot, therefore, in view of the foregoing facts, WE HEREBY RESOLVE that the County Clerk be authorized and directed to issue a quit claim deed to Lot 2, Block 63, Townsite of Washburn, to Allen Morris, for the sum of Twenty-five ($25.00) Dollars. J. A. Rivers Moved by Rivers and seconded by A. E. Swanson to adopt the foregoing resolution. Motion carried. The following resolution was read: WHEREAS, a Resolution was adopted by the County Board;of Bayfield County on May 3, 1938 and recorded in Volume 8, page 9, Journal of County Board Proceedings, authorizing the exchange of Lots 15 and 16 of Block 49 of the original Townsite of ?Washburn to the City of Washburn for the excess delinquent tax account of said City of Washburn, and WHEREAS, through an oversight, the consideration was omitted from the resolution, THEREFORE, BE IT RESOLVED that the consideration be the amount of tax plus fees and penalties accumulated against said property up until May 3, 1938, and that the County Clerk be and he is hereby authorized and directed to make, execute and deliver to said city of Washburn a deed to said lots and to charge the same on the books of said county against the excess delinquent account of said city of Washburn. S. Highway No. 2 Ashland and Bayfield Counties The above change involving the rerouting of U. S. Highway No. 2 in Ashland and Bayfield Counties in accordance with a decision of the State Highway Commission of April 30, 1938 has been approved by the County Board of Bayfield County, but was disapproved by the County Board of Ashland County. It having been deemed necessary for the proper improvement of a state trunk highway to relocate or widen a portion thereof, a plat showing the old and the new locations and a copy of the order of the State Highway Commission are hereby filed with each of you, as required by law. A resolution was presented to the Commission by the Secretary as follows: E --_-SPEC.IAL-MEET_IhT_G OF THE-BAY-S_IELD.-C-O_UN-T-Y—BOARD ---- --- Due to the proposed construction of the above named project which extends along a state trunk highway known as U. S. Highway No. 2, and along State Trunk Highway No. 112, as located in the state trunk highway layout of 1923, or subsequently located in accordance with the Statutes, from a point approximately 750 feet west of the center of Section. 17, Township 47 North, Range 5 West, thence northeasterly to a point 1320 feet east and 296.6 feet south of the center of Section 35, Township 48 North, Range 5 West, it becomes necessary for the proper construction and improvement of said U. S. Highway No. 2 and State Trunk Highway No. 112 to make certain relocations and to secure certain additional right of way. A plat of the said relocations and the right of way to be acquired, marked, "Plat of Right of Way Required, Division Job.No. 8647, Iron River - Ashland Road, U.S.H. No. 2 & S.T.H. No. 112, Bayfield County,'' was presented, the same being sheets Nos. 4 and 5 of the plans for said Division Job No. 6647. No. 112, Bayfield County," be approved; that the state trunk high- way be and hereby is changed and relocated in accordance with said plat by authority granted the Commission under Section 83.08 of the Statutes; that the relocations shown thereon be ordered; that the state trunk highway as laid out by the Legislative Committee and the Highway Commission in 1923, or as subsequently located, between the limits shown on said plat, be and hereby is discontinued; that said state trunk highway be officially located as shown on the attached plat; that it is necessary to take for highway purposes, in order to carry out said improvement, the land within the limits of said highway as relocated and shown on said plat; that the State Highway Engineer be directed to order the construction of said Division Job No. 8647 along the alignment shown on the said plat and secure the right of way necessary for such construction in the manner provided by law for the acquirement of right of way in such cases. BAYFIELD COUNTY: DECISION ON AGREED STATEMENT OF FACTS The issue submitted to this court in this case on an agreed statement of facts is therefore one of Law, - as to whether or not a resolution passed by the County Board of Bayfield County at its annual meeting in November, 1933, and amended at a special meeting of the Board held on February 12, 1934, is effective to place the county on a county system of poor relief. The November resolution is as follows: "Resolved by the County Board of Bayfield County assembled at the annual meeting thereof this 17th day of November, 1933, that the County go on the County system of unemployment relief for the purpose of better co-operation with the state and county authorities in charge of such relief, without in any way affecting the present town system of poor relief which is understood to be a distinct and separate function from the unemployment relief as now administered." The amendment passed at the special meeting the following February is, as I see it, an effort to explain and define some of the terms used in the November resolution, - for the purpose of clarifying its meaning, so that all poor relief was intended to be covered by the November resolution, except hospitalization relief. I interpret the agreed statement of facts to assume that all poor relief was included in the November resolution except hospitalization, when it is stated "Relief, as the term is herein used, means all public aid furnished in said county other than hospitalization ." A change from the unit (town, city, etc.) system to a county system, or vice versa, could only be effected at an annual meeting of the Board, or a special meeting called for that purpose, under Sec. 49.15 and 16, Statute of 1935, and those provisions have not been changed since. According to the minutes of the County Clerk (submitted with the record) the February meeting was not an adjourned annual meeting, but a special meeting, of the Board, but its action with reference to the matter here involved was an attempt merely to define the terms used in the November resolution and to declare the intent of the Board's action at the annual meeting. The February resolution was probably induced by the letter of January 18, 1934 from the Industrial Commission to the County Clerk. The County Board undoubtedly, in passing that resolution of November 1933 and the amendment in 1934, had two purposes in mind, one to simplify the distribution of relief funds as suggested by the Industrial Commission, and one to receive funds from the state, aided by Federal Funds for relief purposes for such funds more convenient distribution through the relief organization. The board at that time assumed probably that sufficient funds would be supplied by the state to take care of the relief work of the nature here under consideration without the county being obliged to furnish any such relief. However, it turned out that the state funds became insufficient to take care of the relief load, and the county through its board drew from year to year upon the county general fund to supplement the state relief fund. 5 -----SPEC I-AL_MEET_ING-0_F THE_B 4-YFIELD—C-OU1TT-Y—BO_ARD AT UST 2. 1938 The relief organization at Washburn would issue orders to relief applicants, which the merchants, principally in Washburn, would honor and fill, and checks would be issued to the merchants in payment for these supplies drawn upon the relief fund by the relief director, such funds being supplemented by the county, as above stated, up to and including May and June 1937. For those months, the state failed and still has failed to furnish any funds to meet these orders, and the county considers itself not obligated to pay those orders. There is in the record submitted to me a document called an indenture, wherein most of the chairmen of the different town boards agreed with the relief adminis- tration in Madison .to take care of the poor relief in their town or city, but of course that has no binding effect, no change from the county system to the unit system could be made without complying with the statute, 49.16. The. question submitted to me is the one, stated at the end of the statement of facts and designated I, namely. "Iffas the res.olution adopted by the County Board in November. 1933 and amended in February 1934, effective to place the County on the legal county system of relief? It is agreed that if the court's answer to this question is in the affirmative, that judgment should be rendered in favor. -of the plaintiff." After a"careful consideration of the situation as presented to me, I conclude that the answer to that question is Yes, the resolution was effective to change from the unit system to the county system, considering all the facts stated in the statement of facts and the statement of facts I have inserted, herein, supplementary thereto, gathered from the resolutions submitted with the statement of facts. The result is therefore that the plaintiff is entitled to judgment against the defendant county for the amount of his claim, which is, according to the statement of facts, $84.01.
