M. by Chairman. Squires. The following members answered roll call: Buss, Pease, Alcott; Thoreson, B. Johnson, Frels, Buckley, Meyer, Unseth, Grubisic, Desparois, KlacRae, Pristash, P. Johnson, Herman Hanson, Liebman, C. 0. Nelson, Taipale, Sande, Klovstad, Wallin, Rowley, Shykes, Nyberg, Williams, Tedlund, Fiege, Knight-, H. J. S. Hanson, Reiten, Kasmarek, Rivers, Ambly, Brink, Squires. Total 35. Koved by H. J. S. Hanson and seconded by Nelson to dispense with reading of the minutes of the County Board meeting held November 12, 13 and 14, 1940, and to approve of same as published. Motion carried. The Chair appointed Grubisic and Klovstad as tellers. The Board proceeded with the election of a chairman. The result of the first ballot was as follows: Squires 17 Alcott 10 Rowley 3 MacRae 1 Williams 2 Defective 1 Total 34 No majority. The result of the second ballot was as follows: Squires 21 Alcott 11 Bus s 2 Rowley 1 Total 35 Squires was declared duly elected as chairman for the ensuing year. The Board proceeded with the election of a vice chairman. The result of the first ballot was as follows: Alcott 21 Meyers 4 Fiege 2 Rowley 2 Williams 1 Pristash 1 H. J. S. The following communication was read: STATE OF WISCONSIN CONSERVATION DEPARTMENT Madison February 20, 1941 File Reference: Co-operation Geographic Bd. Mr. Ludwig Tranmal County Clerk Washburn, Wisconsin Dear Mr. Tranmal: In accordance with the provisions of Sec. 23.25, I am submitting for approval by the Bayfield county board the following recommendation of the state geographic board: 'Mr. A. E. Kaiser of Park Falls has requested that the name of Spring lake in Secs. 19 & 202 T46N, R71Y be changed to Namagosh, meaning brook or small trout in the Chippewa Indian language. I.understand that the name of the company operating on the lake is Namagosh Company. The state geographic board at its meeting on February 14 approved the sug- gestion, as the change helps to eliminate duplication within the state, the name is euphonious, easy to pronounce and remember, and appropriate. Any assistance you can render in expediting approval by the County board will surely be appreciated. Very truly yours, H. W. Motion carried. 31 ANNUAL ORGANIZATION MEETING. -OF THE BAYFIELD COUNTY BOARD 'May 6, 1941 The following resolutions were read: RESOLUTION No, 33 BE IT HEREBY RESOLVED that the Shawano County'Boara of Supervisors recom- mends that the State law be changed so that the mileage allowance -for the sheriff departments is out from ten cents to six cents per mile. BE IT FURTHER RESOLVED that a copy of this resolution be sent to Senator Mike Mack, and Assemblyman -Elect Charles J. Ebert, and each County Clerk Harold C. Volland Supervisor RESOLUTION No. 43 WHEREAS, the statutes of the State -of Wisconsin provide -that supervisors shall be allowed mileage to and from the place of meeting, and; WHEREAS, the Attorney General of the State of Wisconsin has ruled -that this means that the supervisors shall be entitled for only one round trip for a session and not for each day of the session, and, WHEREAS, the Attorney General has pointed that the "Horse and Buggy" origin of this statute wherein the supervisors traveled to the county seat and re- mained there during --the entire course of -the -session, but- that , under present day conditions -the custom is to travel back and-f orth,every-day, and-, AREAS, the Attorney General has -further pointed out that it is the function of the legislature to bring this statute to date, i .NOW, THEREFORE`, LET"IT HEREBY" -BE RESOLVED BY'THE"SHAWANO COUNTY BOARD I OF SUPERVISORS that" -the - legislature of the. State of Wisconsin is hereby memorialized to correct, and amend -this statute--- to - the end that members of the 'various county boards of supervisors may be entitled to mileage for each day of the county board session.. BE IT FURTHER RESOLVED that a copy of this resolution be sent to Senator Mike Mack and Assemblyman -elect Charles J. Ebert and to all' County Clerks with in- structions that they recommend the same to the State Legislature. The following resolution was read: TO THE HONORABLE BAYFIELD COUNTY BOARD: BE IT HEREBY RESOLVED by the Bayfiel d County Board of Supervisors in its May session assembled this 6th day of May, 1941, that the County Clerk and the County Treasurer be, and they are hereby authorized and instructed to proceed with the work of taking tax deeds for Bayf ield County on all county -owned tax certificates that are now, and will be subject to tax deed during the next year. April 182 1941 To All County Clerks: Will you kindly bring the following resolution totheattention of your county board and present a request from our board,that it -,be given consideration and if favored by a majority of your board, a like resolution be passed and for- warded to your state senator, assemblyman and governor. Yours truly, Carl Wallin, County Clerk, Burnett Co, RESOLUTION WHEREAS, Extraordinary Medical and hospital bills are frequently incurred by recipient's of social security aids during their last illness, and whereas these bills are frequently left for the town of legal settlement to pay and often no funds are available to meet the obligations, THEREFORE, BE IT RESOLVED, that the County Board of Bayfield County res- pectfully petitions the Wisconsin legislature to so amend the statutes that county pension administrators will be able to liquidate current medical and hospital bills remaining unpaid at the time of death of a beneficiary of the social security aids, in the same manner as now..provided for funeral expenses. Motion carried, The following communication was read: VACATIONLA.ND ATHLETIC CLUB Iron River,Wisconsin May 2, 1941 Ludwig Tranmal, County Clerk County of Bayfield Washburn, Wisconsin Dear Mr. Tranmal: We of the Athletic Club wish to take this opportunity of complimenting the committee which has charge of the compiling and publishing of the brochure, "Bayfield County - At the Top of Wisconsin lures you Northward." The brochure is an excellent piece of advertising, and from reports in our local information booth it is doing the work. The supply we have here, Mr. Daniels of the Indian Head Booth reports is entirely inadequate. I called Mr. Desparois to inquire if there were any left from the Minneapolis Show, but he reports that their supply likewise was inadequate. Unless there exists a supply somewhere, we would like to suggest that the County Board consider a second publication at this time, it would be worthwhile. April 29, 1941 I would like to have you represent this letter to the County Board when they meet in regarding to a certain forty acres of,land,which I bought from the County last August, 1940. 'The description is SW SW, Sec. 31-46a-5. I understood that when I bought this land after July lst there wouldn't be any 1940 taxes charged against this land being that the County owned it. But it hadn't been changed in the Town of Kelly books. So I did not pay the taxes which are somewhere in the neighbor- hood of $10.00. So I 'am asking the County Board to fix this matter so that Town of Kelly get the 1940 taxes on this land from the County for as I paid $100 for this forty thinking that I did not have to pay any 1940 taxes. The following communications were read: Office of County Clerk Manitowoc County, Wisconsin May 2, 1941 To all County Clerks: Since we will not have the names of the new Chairmen of the various County Boards throughout the State until the organization of County Boards on May 6, I am directing this letter to you and asking if you will kindly see to it that the enclosed invitation gets into the proper hands. We want you Clerks to know, too, that you are also invited to attend this convention and hope you will find time to come. Our close association with County Boards almost makes it imperative that we attend. You can't afford to miss a single part of the program being planned. Our banquet program will undoubtedly set the convention on fire. The following petition was read: TO THE BAYFIELD COUNTY BOARD OF SUPERVISORS: Gentlemen: I hereby offer the sum of $250.00 for Lots One (1), Two (2) and Three (3), Block Fifteen (15) of Egan's Subdivision of Vaughns Division to the city of Washburn. I can pay $25.00 per month commencing with May,.1941, which would complete the contract in ten monthly payments. The property was originally owned by my grandmother, Balbina Kovalski. She is living in the house with me and is receiving Old Age Assistance. Her general physical condition is poor. The following petition was read: TO THE BAYFIELD COUNTY BOARD Gentlemen: Moquah, Wis., May 6, 1941 Writing to you regarding the forty acres of land of which the description is NW SW, Sec. 9-47-6, Town of Pilsen. As I understand you are selling it for two dollars an acre. But I don't want to pay that much on account of it being too rocky and then there's a small ravine running through it. The ground just sand which is only for pasture. And that is until the brush is cleared out. The brush is small and thick, hardly any wood. The most I can offer is $50.00 for this forty. The following petition was read: COUNTY BOARD OF BAYFIELD COUNTY Dear Sirs: We would like to trade our land, the NW -NE, Sec. 7-49-9 and the SW of SE, Sec. 6-49-9, located in Orienta on highway No. 13 for the NON of the NE and the NE of Nil and the NW of the NW, Sec. 23-49-9 known as the Currier farm. Our reason for trading is to get more acreage for hay. We have more cows than we can find hay for on this farm and we would like very much to keep our cows. We have more improvements here but not enough broke land of our own. We did have the use of the LaChapplle place .but it.has been sold. The following resolution was read: BE IT RESOLVED by the County'Board of Bayfield County, at a meeting thereof held this 6th day of May, 1941, pursuant to the provisions of'section 59.04 (b) of the -Wisconsin Statutes, that all Bayfield County banks are designated as county depositories of county -funds, all of which banks are designated as work- ing banks in conformity with Section 59.74 of the Wisconsin Statutes. The following resolution was read: To Cancel the 1940 Tax on the South One-half of the Northwest one -quarter of Section 14, Township 44, Range 9W. Charging the Same Back to the.Excess Delin- quent Tax of the Town of Barnes. BE IT RESOLVED by the County Board of Bayfield County, at a meeting thereof, held this 6th day of May,. 1941, pursuant to the provisions of Section 59.04 (b) of the. Wisconsin Statutes, that the 1940 tax on the following described real estate, to -wit, the South One-half of the Northwest One -quarter of Section 14, Township 44 north, Range 9 Test, now owned by John Valeski, is hereby waived as against Mr. Valeski and thereby cancelled, the amount thereof to be charged back to the Town of Barnes, wherein said land is situated, against the excess delinquent tax account of the said town of Barnes. The following resolution was read: WHEREAS, the Peace Officers of twenty-four (24) counties have formed an association known as the Northwestern Wisconsin Peace Officers' Association for the purpose of obtaining better cooperation between law enforcement agents of several counties and it being deemed for the best interests of Bayfield County that. member- ship in said association be retained: Now, Therefore, Be It'Resolved that..Bayfield County appropriate the sum of Twelve and 50/100 ($12.50) Dollars to- pay -for- one-half year-''s membership in the Northwestern --Wisconsin Peace-- Officers' Association -and that 'the'sum of !'Twenty-five ($25.00) Dollars be paid annually on November 1 of each year and that the same be sent by the clerk to the secretary and treasurer of the Association and that this money be taken from the Sheriff's fund. Motion carried. 323 ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD May 6, 1941 The,following resolution was read: WHEREAS, the North 2 of the Southeast 4 of Section 34, Township 51, North, Range 4 sliest is County owned land and restricted under the County Zoning Ordinance for forestry purposes, and AREAS, this land is suitable for agricultural purposes, and lies adjacent to an existing farm whose -owner wishes to purchase the above description as an addi- tion to his farm, and WHEREAS, amending the Zoning Ordinance s-o as to change the classification of the above description from forestry to the unrestricted classification will be bene- ficial to both the Town of Russell and the prospective purchaser of this land-, therefore, BE IT RESOLVED, that the County Board in session this 6th day of May, 1941, amend the County Zoning Ordinance so as to change the North 2 of the Southeast 4 of Section 34-51-4 from forestry classification to the unrestricted classification and that the County Clerk is hereby instructed to furnish the Register of Deeds with a copy of this Zoning Amendment. The following resolution was read: BE IT RESOLVED, By the County Board of Bayfield County, Wisconsin, that County Trunk Highway E from Ino to what is known as Butlers corners, a distance of three miles, be abandoned; and relocated from said Butlers corners on and over the Delta Town High- way running from said Butlers corners to Delta, and from Delta to Iron River over the Pike Lake Scenic Highway. The following communication was read: CITY OF WASHBURN Washburn., Wisconsin Members of the County Board Bayfield County, Washburn, Wisconsin Gentlemen: May 6, 1941 The City Council of the City of Washburn.wish to call to your attention the use of. the Pioneer School Building for City, County,State and Federal purposes. The expense of maintaining this building for this purpose is greater than the City can afford alone and we request that the County Board assist the City financially in caring for the expense of maintaining the building for this purpose. It is costing the City an average of $143.66 per month for Light, Water, Telephone, Heat, Care and incidental.expenses. This is too heavy expense for the benefit that the City arrives from the use of this building and we feel that the County Board should shoulder a part of the expense. No aid is received from the State or Federal Government in any way by the City. We have called to their attention this lack of aid and have been notified that they :make no provisions for any such purpose. As .this is also a County affair we think that the County should help with the expense of maintenance. The following resolution was read: WHEREAS, it appears that it will be necessary to borrow money to meet current expenses of -the County; NOW, THEREFORE, BE IT RESOLVED, by the County Board of Bayfield County in regular session assembled this.6th day of May, 1941, that the County of Bayfield borrow an additional sum of money under and by virtue of authority in it vested by section 67.12 of the Statutes of 19372 at a rate of interest not to exceed 4% per annum. -The amount of said loan or loans to be determined by the County Clerk, County Treasurer and Chairman of the County Board at such times and in such amounts as the need arises, not to exceed, however, the sum of $90,000.00, including temporary loans now outstanding; such sum or sums to be repaid in any event not later than the 1st day of January following the next tax levy; said money to be borrowed and used for the purpose of paying current expenses of the County, such as, salaries, care of County charges and prisoners, expenses of maintaining the Courts and other necessary and current expenses, and BE IT FURTHER RESOLVED, that the County Clerk and Chairman of the County Board are hereby authorized to execute and deliver the promissory note or notes of said County to evidence said loan or loans. P. A..Project was set up in Bayfield County to correct Property Descriptions. This project has cost quite a sum of money, but, no doubt -has been worth considerable more than -it cost, as it -will give you a list of corrected descriptions. We sent you at your homes, a Story on Winnebago Counties use of Addressograph Tax Equipment, this is only one of many Wisconsin Counties some of which have been using our equipment for over ten years, to insure the accuracy of Property Descriptions, for without equipment for writing the many forms in connection with Tax work your Project will soon be of little value to you. We suggest that a committee be appointed -to look at our equipment in some of the Counties now using, so they can report back to you at a later date. The following resolution was read: TO THE HONORABLE SUPERVISORS OF THE BAYFIELD COUNTY BOARD: WHEREAS, under the statutes it is mandatory that the Public Welfare Depart- ment make collection from the estates of deceased Old Age Assistance beneficiaries for amounts which they received during their life time, and WHEREAS, a recent ruling of the Attorney General, as interpreted by the County Court, makes it impossible to make such collection through probate proceedings, and MREAS, the only other method of collection is by foreclosure of lien against the real estate of the deceased beneficiary, THEREFORE BE IT RESOLVED by the Bayfield County Board of Supervisors in annual session this 7th day of May, 1941, that the District Attorney of Bayfield County is hereby authorized to institute foreclosure proceedings in conformity with Section 49.26 of the statutes against the property of deceased persons, who have been reci- pients of Old Age Assistance, upon proper information furnished the'District Attorney by the Public Welfare Department. The following resolution was read: Resolution establishing salary schedules, attendance and leave regulation, and travel allowances in the Bayfield County Public Welfare Department. 331 ANNUAL ORGANIZATION MEETING OF THE BAY -FIELD COUNTY BOARD -- ----- - - --- -- - ------ - -- --- ----- May 7, 1941 -- `J BE IT RESOLVED that the Bayfield County Board of Supervisors in annual session this-7th day of May, 1941, adopt the following compensation plan for posi- tions in the Bayf field County Public Welfare Department. Class of position - Director, salary schedule range from 125 a month to $175 as set by action of the County Board. For Case Worker, $75.00 a month for beginners, -an -increase of $5.00 every six months, upon recommendation of the Public Welfare Committee, until the maximum of $100.00 a month is reached, the present incumbents to receive a salary of $100.00 per month effective May 1, 1941. Clerk Stenographer's salary of $60.00 a month for beginners and an increase of $5.00 at the end of three months and a further increase of $5.00 every six months, upon recommendation of the public Welfare Com- mittee, until a maximum of $90.00 is reached. This compensation plan shall constitute an official schedule of salaries for all classes of positions in the agency. No salary shall be authorized unless it conforms to this compensation plan.. The Public Welfare Committee shall have authority to fix salaries within the schedule set for the various classes of positions as adopted by the County Board of Supervisors. �1 BE IT FURTHER RESOLVED that each permanent employee of the agency shall be entitled to annual vacation leave with full pay at the rate of one day for each full month of employment since January 1, 1941. Probationary employees shall not be al- lowed vacation leave during the first six months of employment, but after the first six months they shall receive vacation leave in the same amount as permanent employees, in the amount of one full day for each full month of employment. Vacation leave shall be granted by the Director at such time or times as it shall least interfere with the efficient operation of the agency. A permanent employee who has been employed in ex- cess of the probationary period of six months and who is dismissed or laid off shall be entitled to and shall receive a vacation allowance of one full day for each full month of employment after the expiration of the six month probationary period, except that an employee who has been dismissed as provided in Section 2 of Article 12 of Rule I of the State Department of_Public Welfare may within the discretion of the Director be denied all or any part of accrued leave. BE IT FURTHER RESOLVED that vacation shall not be allowed.during the six months probationary period, but days accumulated during the probationary'period may be taken after the six months have expired. An employe-e..may anticipate his. vacation to the end of the year. Should the employee terminate his employment before.the end of a calendar /year, deduction will be made from the last salary check for the time employee has not earned. Sundays and legal holidays shall not --be counted in computing time -off. Whenever Saturday forenoon is -taken as vacation, it shall be counted as a full day. All vacation leave shall expire at the end of each calendar year, and employees shall forfeit any unused vacation leave not taken by the end of the calendar year, unless special provision has been made by the Director before the year has expired. At the expiration of such leave the employee shall be reinstated in the service without loss of any of his rights unless`the position is no longer available due to a budgetary reduction in staff. Failure on the part of an employee to.report promptly at, the expiration of the leave of ­absence, except for satisfactory reasons submitted in advance, shall be a cause for dismissal. Leave of absence without pay, however, will not be granted until after all of the employee's annual leave has been exhausted. BE IT FURTHER RESOLVED that a travel. allowance is hereby established for each employee authorized to use his personal automobile of six cents a mile for -each business mile travelled up to 600 miles in any month, and an allowance of $30.00 for the use of his car plus the actual and necessary disbursements of gasoline, lubricating oil and grease if more than 600 miles are travelled in any one month. OF THE BAYFIELD COUNTY BOARD -- Mav .7. 1941 - The following resolution was, read: WHEREAS, the Bayfield County Board of Supervisors gave -the Bodin-Finstad Post #86, American Legion, a life time lease on that building located on Bayfield Street in the City of Washburn known as -the Amos Hanson building, and WHEREAS; this building is ideally located and there are many inquiries from persons desiring to purchase it, and WHEREAS, if this building could be sold, it very likely will be during the present emergency, and WHEREAS, it is very likely -that this'sale would have to be consummated within the shortest possible time, and WHEREAS, release of the present lease by the Bodin-F;instad Post would be necessary before such a sale could be made, and WHEREAS, it appears advisable that Bayfield County should have title to this building so that a quick disposal of the building could be made, and WHEREAS, it is to the best of interest of both the City of Washburn and Bayfield County to sell this building to private interests so as to place it on the tax roll, THEREFORE BE IT RESOLVED by the Bayfield County Board of Supervisors in annual session this 7th day of May, 1941, that the Building and Grounds Committee of the County Board is authorized to work with the Trustees of the Bodin-Finstad Post to draw plans for a building suitable to both groups on which the Bodin-Finstad Post will have a life lease, and BE IT FURTHER RESOLVED that the County Board Chairman and County -Clerk are authorized to enter into a W.P.A. project for the construction of such building after approval of the plans by the Building and Grounds Committee and the Bodin-Finstad Post trustees, the sponsor's share not to exceed four thousand dollars, the money received from the sale of the present building to be applied toward this sponsor's share, and BE IT FURTHER RESOLVED that the County Board Chairman and the County Clerk and the County Treasurer are authorized to write checks for the amount of sponsor's contribution necessary for the project up to the specified limit of four thousand dollars, provided no new structure be constructed until the present building is sold for four thousand dollars or more. Ludwig Tranmal Mashburn, Wisconsin Dear Mr. Tranmal: Several weeks ago Miss Hawkes and I.were in.your office conferring with you in regard to matter of disposition of two outstanding tax certificates upon the Compton land in the town of Bayfield on which we'obtained a judgment quieting title against Bayfield County, and costs were taxet in favor of Mr. Compton on the 4th of February last in the sum of $114.90. Sometime last July I offered to pay the amount of taxes represented by these two tax certificates which at that time was- $118.82', but the offer was refused, after which the quiet title action was commenced, and the Judge decided in -favor of Mr. Compton. In the action the plaintiff contended that if he was entitled -to quiet title because the county tax deeds had become void under the three -years' statute, then the tax certificates were also void, on the ground that the county was in the position of a private individual who had purchased the tax certificates and could not enforce them where the deed was void because of failure to commence action to obtain posses- sion within three years after obtaining the deed. In regard to that portion of the controversy the Judge held that he did not find any authority for an order cancelling the tax certificates, and he made the following statement in regard to the two certificates: "They. -are void no doubt and I cannot see that they can be of any value to the county but I do not quite see how tax certificates as such constitute any cloud upon the title and I hesitate to issue an order cancelling the certificates for that reason." It is apparent, therefore, that in the Judge's opinion these certificates are not enforceable although they do stand on record. However, as I stated in my letter to Miss Hawkes and to you at our meeting several weeks ago, I have been authorized to suggest that if the County Board will order these certificates can- celled we will satisfy our cost judgment running against the County in the amount stated above, and thus close this matter as to both parties. I am writing this letter so that it will be brought to your attention before the Board meeting next week, and can be presented to the County Board at that time. I presume Miss Hawkes will be attending the meeting and she can make whatever recommendation she thinks best to the Board.
