The following members answered roll call: Buss, Pease, Alcott, Irish, Holton, Frels, Buckley, Meyer, Unseth, Grubisic, Desparois, MacRae, Pristash, Berweger, Hanson, Pearson, Kallinen, Mihalak, Bagstad, Wallin, Bloom, Shykes, Ness, Moore, Tedlund, Knight, ?ifachsmuth, Nelson, Anderson, Robinson, Brink, Swanson, IMoe, Squires. Total 34. The Board proceeded with the election of officers. The Chair appointed Meyer and Desparois as tellers. The result of the first ballot for Chairman was as follows: Squires 27 Knight 2 Wallin 2 Liebman 1 Alcott 1 MacRae 1 Total 34 Mr. Squires was declared duly elected.. The result of the first ballot for Vice-chairman was as follows: Alcott 21 Wallin 4 Knight 3 Hanson 1 MacRae 1 Meyer 1 Irish 1 Blank 1 Total 33 Mr. Alcott was declared duly elected as Vice-chairman. Moved by Wallin and seconded by Pristash to set the rate of 45V per folio for printing of the official proceedings of the County Board, 13.6¢ per folio for printing the supplements 'and $12.50 to each newspaper for distribution thereof. Motion carried. Moved by Wallin and seconded by Desparois that the Bayfield County Press be the official newspaper for the ensuing year. Motion carried. The following resolution was read: WHEREAS, in the past various problems have arisen in Bayfield County,'as well as in other counties, regarding the assessment of Indian lands, AND WHEREAS, it has been impossible to secure definite information as to which Indian lands are taxable and which are non-taxable. NOW THEiREFORE BE IT RESOLVED, by the Bayfield County of Board of Supervisors, that the legislative committee in the seventy-one counties of the state, be contacted, and be asked to write their Congressmen and Assemblymen, requesting that definite legislation be enacted, regarding these Indian lands, in order that the municipalities be reimbursed for their loss of revenue. I. L. Alcott Moved by Alcott and seconded by Bloom to adopt the foregoing resolution. Motion carried. Mr. Liebman arrived at this time. 54 ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD -- -- ----- - -- — May 2, 1944 J------- ---------------- The following resolution was -`read: Whereas, it has become necessary for the maintenance of service for the Wisconsin Telephone Company to rebuild certain sections of its telephone line between Trego and Ashland; and Whereas, it is considered necessary for said telephone company to locate the telephone line approximately two to ten rods west of the quarter line of Section thirty (30), Township forty-four (44) North, Range seven (7) West, BE IT RESOLVED, that in consideration of the sum of Twenty and no1100 Dollars ($20.00), the Chairman of the Board of Supervisors of Bayfield County, Wisconsin, and the County Clerk be and they are hereby authorized and directed to execute a grant unto the Wisconsin Telephone Company, their successors and assigns, covering the follow- ing described rights: To erect and to maintain its poles, wires, cables, anchors, storm fixtures, guys and other appliances, including the future right to place subway construction, all necessary and usual in the conduct of its business and including the customary growth and replacement thereof, said equipment to be located on, over and beneath land owned by the grantor and describes as follows: Those parts of Government Lots numbered three (3) and four (4) lying east of a line extending the west line of Government Lot numbered two (2) South to the South section line, all of section thirty (30), Town- ship forty-four (44) North, Range Seven (7) West, in the Town of Drummond, Bayfield County, Wisconsin, The pole line to be located along the centerline of a strip of land four (4) rods in width, said centerline to be located approximately seventy (70) rods east of the west line of Government Lot numbered four and from seventy-eight (78) to seventy (70) rods east of the west line of Government Lot numbered three (3), Together with the right to trim at any time all trees l-Ocated on land of the grantor to clear the wires of the grantee at least twenty-eight (28) feet, and to cut down any trees that are within thirty-three (33) feet of said pole line; also the right to cut down any other trees that are, in the judgment of the grantee, a hazard to said equipment. The following resolution was read: APPLICATION BY TOWN BOARD FOR AMENDMENT TO COUNTY ZONING ORDINANCE Resolution by the Town Board of -Drummond, Bayfield County, Wisconsin. `JTIEREAS, We, the Town Board of Drummond, Bayfield County, Wisconsin, having duly considered the zoning of certain lands within the Town of Drummond as provided in the Zoning Ordinance pursuant to Section 59.97, Wisconsin Statutes, WHEREAS, It is necessary that approval of the town board of the town in which. may be situated any lands affected in the amendment of said Ordinance be secured, now therefor BE IT RESOLVED, That, we .the Town Board of Drummond, Bayfield County, Wisconsin, do hereby approve amending the said Zoning Ordinance as enacted by the County Board of Supervisors on November 14, 1934, and that the areas in the Town of Drummond shown on the accompanying map in red and described as the E2 of the NE4 of Section 28, Township 44, ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD ,)43 Range 8, Tffest, be changed from a forestry classification, District No. 1, to an unrestricted use district No. 3,-and be made a part of the official, zoning map known as the "Zoning Map for Bayfield County, showing use districts." The following communication was read: Cable, Wisconsin Jan. 29, 1944 County Clerk Dear Sir: Well we got the wolf bounty all o.k. Good thing. I thought vie might get the county to pay bounty on those D. foxes as they are cleaning up our game birds. I wrote the state game management not to protect those foxes. I have talked to some of the County Board members down here. They are in favor of the county paying bounty on fox. You see in the fall you can catch them when the fur is not much good. Our game birds are worth more than those D. foxes so if you can, you can talk to the County.Board members up there. I am going to Hayward today and see them down there and have Sawyer County pay bounty too, so as to clean up on those foxes. It will take some time. You see when the state had those game refugees a trapper could not trap them on the National forest so it gave the wolves and foxes a good chance to breed up, so there are a lot of them all over the northern counties. Do what you can. You can't make any headway trapping them on snow. I am 78 years old, but will do what I can. The following communication was,read: November 18, 1943 County Board Bayfield County Mashburn, Wisconsin Gentlemeh: According to the Ashland Daily Press and the 'Washburn Times, the sum of $200 was contributed by you to the Martha Washington Home here in Milwaukee. We do a work similar to that done by the above named institution. Just as this time of the year we ask all our kind friends to help us meet our obligations. Will you, too, contribute? Two Hundred dollars means a great deal to us, and we should appreciate this help. INe never fail to remember in our prayers all those who do us good. The following communications were read: I hereby give notice that the Cordts building located between 5th and 6th Avenues on Bayfield Street in the City of Washburn be boarded up to prevent children from entering said building, or it will be ;necessary that I condemn it as a fire hazard. 'William J. Doucette Fire Chief April 27, 1944 Mr. J. 0. Bodin County Treasurer City Dear Sir: The chief of the fire department of the City of -.Mashburn requests me to write to you and say that the old Cordts Meat Market building is a public nuisance, because of the fact that the same is a fire hazard and is in danger of falling down and injuring pedestrians on the street. It is my understanding that this property is owned by Bayfield County under a tax deed. Unless some action'is taken promptly by the county to tear down this build- ing or to put it in such condition as to take it out of the class of extreme fire hazards, it is probable that the City of Washburn will institute an action to condemn the same and have it torn down as a public nuisance. Under the old Vital Statistics law the Town Clerks and Village Clerks made out the original certificates of birth, deaths and marriages and made a copy of such certificates for the Register of Deeds and thereafter mailed the original certificates to the State Board of Health. Under the 1943 Vital Statistics law all such original certificates from the Towns and Villages must be mailed to the Register of Deeds and the Register must make copies of the certificates for his office and thereafter mail the original certifi- cates to the State Board of Health and no fees are paid for making such copies by the Register of Deeds. Motion carried. The following letters were read: February 2, 1944 Mr. Ludwig Tranmal Bayfield County Clerk ;Mashburn, Wisconsin Dear 1�1r. Tranmal: With further reference to the salary of the Bayfield County Agricultural Agent, concerning which we have had several converstations, and.also with reference to the salary of the County Home Agent, please be advised that I have studied the matter and am of the opinion that you are authorized to make payment from county funds in the amount of $1300.00 for the former and $300.00 for the latter. It appears that the Agricultural Committee set up a proposed budget which included the following item: "Salaries (2) - $1600.00 ($1300 & $300)" The total budget request submitted to the County Board including the above item amounted to $5155.00. This figure was included in the budget approved by the County Board, hence we believe it follows that the County Board did fix the salaries to the extent that they are reflected in this total budget item of $5165.00. The Attorney General has ruled that the adoption of a county budget which includes a certain sum for salaries is a fixing of salaries within the meaning of the statutes. (21 OAG 245). It is therefore my opinion that the contract which the committee has entered into with Mr. Holvenstot should be honored and that payment of the increased salary, which I understand will be taken care of by the $1300 may begin at once. With reference to the Home Agent, I am obliged to say that the increase promised by the committee,will not have any binding effect until ratified by the County Board, 5 4 G ANNUAL ORGANIZATIONMEETING OF THE BA_Y_FIELD _COUNTY BOARD Mav 2. 1944 since the item of $300.00 included in the budget.and passed on by the County Board represented the same amount that the County had previously paid as salary for that office. Norlin Mr. Ludwig Tranmal Bayfield County Clerk Washburn, Wisconsin Dear Mr. Tranmal: January 25, 1944 You have requested my opinion on the legal construction of the resolution adopted by the County Board concerning the Sheriff's salary. The pertinent provision of the resolution reads, "that the salary of the sheriff be set at one hundred and seventy-five dollars ($175.00) per month and the salary of the undersheriff be set at one hundred and fifty dollars ($150.00) per month, both exclusive of civil'fees.ft Your question relates to the meaning or effect of the last clause and you ask if the sheriff will be entitled to fees in addition to his salary. Section 59.15 (1) gives the County Board the power to fix the salary of each county officer. In that subsection the following language is used "the salary so fixed - shall be in lieu of all fees, per diem and compensation for services rendered From the foregoing quotation is appears clear that if the except "./ phrase "both exclusive of civil fees" had been omitted fromthe resolution in question than the portion of the statute above quoted would have the effect of fixing the salary in lieu of fees. In other words, if this clause,had not been added to the resolution then the officer would not be entitled to fees. From a legal standpoint we think it follows that since the board included a clause relating to fees they intended to give that clause some meaning and the only meaning which can be attributed to it is that the sheriff should have fees in addition to the salary fixed. The following resolution was read: TO THE HONORABLE BAYFIELD COUNTY BOARD: BE IT HEREBY RESOLVED by the County Board of Supervisors of Bayfield County, at a meeting held this 2nd day of May, 1944, pursuant to the provisions of Section 59-04 (b) I of the Wisconsin Statutes, that all Bayfield County banks are designated as county depositories of county funds, all of which banks are designated as working banks in conformity with Section 59-74 of the Wisconsin Statutes. The following resolution was read: BE IT HEREBY RESOLVED By the Bayfield County Board of Supervisors in its May session assembled this 2nd day of May, 1944, that the County Clerk and the County Treasurer be, and they are hereby authorized and instructed to proceed with the work of 547 ANNUAL ORGANIZATION MEETING OF THE BAYFIELD _COUNTY _ BOARD Mav 2. 1944 taking tax deeds for Bayfield County on all county owned tax certificates that are now, and will be subject to tax deed during the next year, I. L. Alcott Moved by Pease and seconded by Liebman to adopt the foregoing resolution. Motion carried. The following resolution was read: WHEREAS, it is deemed advisable and for the best interests of Bayfield County to hold all tax certificates on property within the County, including property on which the Bayfield County Public lillelfare Department has liens, NOW THEREFORE, BE IT RESOLVED by the Bayfield County Board of Supervisors that the County Treasurer be and is hereby authorized and directed to be the sole bidder and be- come the purchaser for Bayfield County of the tax sale certificates on any and all such lands as are sold for general taxes. It being the intent of this resolution to make Bayfield County the sole and exclusive purchaser of all tax certificates of tax sales hereafter issued by Bayfield County. It being the intent of this resolution to exercise the authority vested in the County Board in Section 74.44 of the Wisconsin Statutes, and BE IT FURTHER RESOLVED BY THE Bayfield County Board of Supervisors, that the County Treasurer be and is hereby authorized and directed to be the sole bidder and be- come the purchaser for Bayfield County of the tax sale certificates on any 'and all such lands as are sold for general taxes, which such lands are subject to a lien of the Bay - field County Public Velfare Department and only for the amount of such general taxes, interest and charges as remain unpaid, and BE IT FURTHER RESOLVED that the County Treasurer is hereby prohibited from assign- ing or otherwise disposing of any tax certificates held by him for the county, and BE IT FURTHER RESOLVED that this resolution expressly rescinds the resolution of the Bayfield County Board of Supervisors passed on November 10, 1943, covering this matter. Motion carried, The following resolution was read: BE IT HEREBY RESOLVED, that the County Treasurer be authorized and instructed to purchase excess delinquent real estate tax accounts from the taxing districts of Bayfield County covering the tax of 1943, amounting to approximately $35,600.00, as of March 1, 1944. The following resolution was read: RESOLVED BY THE COUNTY BOARD OF SUPERVISORS of BAYFIELD COUNTY, assembled at their ANNUAL ORGANIZATION MEETING OF THE _BAyFIELD_COUNTY _BOARD Mav 2. 1944 regular meeting this 2nd day of May, 1944, that the District Attorney of said County be, and he is hereby directed and instructed to institute and prosecute such actions as may be necessary to quiet the title and obtain possession for Bayfield County to the follow- ing described real estate situated in said County, upon which said Bayfield County now holds tax deed, to -wit: Castle Garden Resort - Lot 2 and 1W SW in Section 18-43-6 and Part of Lot 7 as recorded in Vol. 100 of Deeds, Page 548 in Section 13-43-6. Iron River Packing Co. - Lot 5 partly lying E. of D.S.S. & A. Ry. Company's Right-of-way except Block 1 and the N2 of Block 8 of Lumberman's Add. Lot 4 except that part of Block 8 of Lumberman's Add. not vacated by County Board, Section 8-47-8. Arthur A. Smith property - Neill & Wings Addition to Washburn, Lot 22, Block 11. and that said District Attorney be, and he is hereby directed and instructed to proceed with such action as soon as reasonably may be done so that the titles of the same may be placed in condition for sale. The following resolution was read: WHEREAS, the Finance Committee on January 7, 1944, passed the following resolution, to -wit: "Moved by Liebman and seconded by Pease that the scale of wage for clerical help in the court house be based as follows:: Minimum base of $70.00 per month with a $10.00 raise per month after the third month and a $10.00 per month raise each six month period thereafter providing the officer in charge approves of same until the maximum amount of $125.00 per month is reached and provided in case of help with previous experience it"be taken Into con- sideration in lieu of experience gained by working for the County commencing January 1, 1944. Motion carried." NOV, THEREFORE, BE IT RESOLVED that the resolution of the Finance Committee be approved and ratified in every respect. S. E. The following resolution was read: March 29, 1944 WHEREAS, It has been necessary for the Agricultural Committee to employ a new home agent at a salary increase of $200.00 per year, and TPTHEREA.S, the salary of the County Agent's clerk was increased $300;00 per year, in accordance with the Finance Committee's action, and WHEREAS, These increas es were not included in the budget passed by the County Board in November, 1943, THEREFORE BE IT RESOLVED, That the County Board hereby appropriates an additional $500.00 to the County Extension Office, for the purpose of paying the salary increases mentioned above. The following communication was read; April 22, 1944 Office of the Area Director Mr. Ludwig Tranmal, County Clerk Courthouse, Vlashburn, ;Visconsin Dear Mr. Tranmal: ',de wish to take this opportunity to inform you of your right to be covered by our Employment Stabilization Program, a copy of which is attached. The War Manpower Commis- sion appreciates the fact that governmental services are vital to the welfare of the nation and should not be impaired through wasteful turnover of personnel. According to our national regulations, State, county or municipal governments have the right to ask for coverage under the Employment Stabilization Program, which affords them- protection in the recruitment and retention of employees. Without this coverage your employees, although considered essential workers, are free to leave their present employment and accept other work without the necessity of securing a statement of availability. If you desire to be included under our program, a formal request should be sent to this office indicating that you wish to conform with the provisions of the program. A form notice to this effect is attached for your convenience. 550 ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD Mlav 2. 1944 We realize the possibility that some of the provisions of the Stabilization Program may conflict with the laws under which you operate. If this is the case, you can still elect to be covered if you can conform to the major provisions of the program. Your re- quest should then be accompanied by a legal opinion concerning the provisions with which you will be unable to conform. The following report was read: PROGRESS REPORT OF THE AIRPORT COMMITTEE ON THE PROPOSED JOINT BAYFIELD-ASHLAND COUNTY AIRPORT Your Committee together with the Ashland Airport Committee has given considerable study to the site selected by the State Planning Board. This proposed site consists of three sections of land adjoining the south city limits of Ashland; two sections lying in the town of Gingles in Ashland County and one section lying in the Town of Eileen, Bayfield County. A half section of this site is all that is necessary to be acquired in the beginning of the development of an airport. 554 ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD - --- < Mav 2. 1944 - _-- - -- - --------- The Joint Committee has contacted the firm of Foth, Boyd and Porath, Consulting Engineers, of Green Bay, Wisconsin, These engineers agree to prepare topographic maps of the three sections of land under consideration for airport sites together with the necessary information pertinent to the drainage of said sites and all other information such as obstructions, utilities, road access, etc., shall be delivered by the State Planning Board as necessary for the evaluation, comparison and recommendation of the most ! favorable site for development. Tentative runway layouts and grade profiles shall be pre- pared to assist in such comparison and at the completion of the field work, a conference shall be held at Ashland by the Joint Committee, the Engineers and a representative of the State Planning Board. Blue prints of the topographic maps, runway layouts and pro- files shall be furnished the Joint Committee and the State Planning Board together with a narrative report which shall embody.the information secured by the engineers and the conclusions drawn therefrom. In general, the engineers agree to furnish all field work, maps and factual information requested by the State Planning Board as necessary for the proper site, the evaluation and comparison. The charge for this engineering service is $1200. The cost of a Master Plan for the erection of an airp.Ort is set by the State Planning Board at $5,000. One-half of the amount will be paid from state funds. If the same engineers are employed to prepare the Master Plan as those who made the topographical sur- vey, they will allow a credit of $600.00, mcing the net cost of the Master Plan to the Counties $1900.00; the combined cost of the surveys and the Master Plan being $3100.00. One thousand dollars each were appropriated by the Ashland and Bayfield County Boards at the last November meetings for the use of the Joint Committee in this preliminary work. If the Bayfield County Board desires to continue with the Joint Airport project, your committee recommends that the above mentioned surveys be madd and a Master Plan completed. Separate resolutions will be submitted authorizing the committee to contract for these sefvices and appropriating the additional sum of $550.00. Interesting developments in,the field of aviation are occuring in Wisconsin and in our neighboring states of Minnesota and Michigan. Governor Goodland has recently appointed a disconsin Advisory Aeronautics Board for the specific purpose of planning and promoting commercial aviation in Wisconsin. At the first meeting of this new board, the guest speaker, Mr. Thomas ?'dalsh, Director,of the Michigan Aeronautics Board, stated that Michigan is energetically promoting aviation as a guarantee of future prosperity in its immense tourist business, and he recommended the integration of northern ,Viscon- sin aviation planning and airport building with the Michigan program. He further said Michigan is promoting its future tourist business by planning airports, landing strips and amphibious ramps in the resort areas following a scheme that will put air travel facilities within 122 miles of every tourist resort center. The whole article "State Air Board is Established" found in the April issue of Wis- consin Counties is well worth the attention of every Bayfield County Board member. Consideration will be given commercial aviation projects in order of their priority. It now seems that a franchise for a joint Ashland-Bayfield County airport can be obtained at an early date. The next legislature will no doubt provide for state f participation in airport building with a referendum ratifying and legalizing such projects. Michigan and Minnesota already have aviation gasoline taxes that produce revenue for aviation programs. It will be necessary to determine on what basis we will unite with Ashland County in building an airport. Also t.o learn how it will be.maintained if developed. The following resolution was read: 55` ANNUAL ORGANIZATION MEETING OF THE BAYFIELD COUNTY BOARD ------------ May 2, 1944- -- ---- - ------ WHEREAS, at the adjourned regular meeting held on the 5th day of December, 1935, the Board of Supervisors of Bayfield County authorized the transfer of county owned lands in the amount not to exceed eight thousand five hundred (8,500) acres at an average price of $2.50 an acre to the United States Government for the purpose set out in the Resolution aforesaid, and, WHEREAS, by the aforesaid Resolution, dated December 5, 1935, the Board of Supervisors of Bayfield County authorized the County Clerk to execute and sign options to the United States Government on such lands as Bayfield County now owns in the Town of Russell and more particularly described by legal sub -divisions in said Resolution of December 5, 1935, and, WHEREAS, the County Clerk of Bayfield County did on December 18, 1935, execute and to sign an option to sell/the United States Government the lands described in the resolution aforesaid, which option was accepted and approved by the Secretary of the Department of the Interior on the 12th day of March, 1936, and, WHEREAS, titles to the following described lands have been found, upon examination, to be defective and not acceptable to the Secretary of the Interior: NT4 NE4i Section 17, Twp. 51 N., Rge. 3V.
