Anderson In response to said petition the County dleric sent out the -following notice: BAYFIELD" COUNTY; WISCONSIN' Office of - County Clerk Mashburn, Wisconsin June 1, 1953 County Board Members: The Bechtel Corporation, which is building the -oil line--from-Superior-to Sarnia, Canada, has requested -a special meeting of the County Board in order that they can get easements across county owned lands. We are enclosing a call for special meeting together with a stamped return addressed envelope.. The pipe line company has offered to pay the expense -of this meeting plus the regular price of $44.00 per acre covering the area it will cross. The easement will cover an area 60 feet wide and on an acreage basis this figures out at $1.00 per lineal rod or $80.00 per forty. Yours very truly, Ludwig Tranmal Bayfield County Clerk Moved by H. Anderson and seconded by Shykes to rescind the action of the County Board of last Sprang regarding this matter and that the $53.20, plus $478.80 making a total of ,1532'.00 be accepted in payment for the lands, and a deed be issued to George W. Engstrom and` wife. Moved by Pajaia and seconded by°Stuart-that:the-foregoing motion be amended to read that part°of the consideration be that the- lands be subject to assessment as of May 1, 1953. June 10, 1953 The following resolution was read: RESOLUTION AUTHORIZING RIGHT'..Or'- WAY AND EASEmENT GRANTS TO LAEYHEAD- PIPE LINE COMPANY, INC. OVER COUNTY OWNED LANDS �NHEREAS' the Lakehead Pipe Line Company, Inc., a Delaware corporation having its principal office at Superior National Bank Building, Superior, Wisconsin, has - made application to the County Board of Bayfield County; Wisconsin, for a right of way and easement grant or grants.in the form hereto annexed for the laying down, construction, operation, maintenance, inspection, patrol (including aerial patrol), al. teration;,removal, replacement, reconstructlon-and/or repair of..one or more -pipe lines, together with all the works of the Company necessary for its undertaking, including but without limiting the generglity of the foregoing, all such drips, valves, fittings, meters,.scraper trap installations and other fixtures, equipment and appurten- ances as may be necessary or convenient in connection therewith for the carriage, con- veyance, transportation, storage and/or handling of crude petroleum, its products and derivatives, over, through, upon, under and across all lands owned by Bayfield County, Wisconsin, and which are located on or in the proximity of the route of the proposed pipe line extension beginning at a point on the westerly line of Bayfield County, Wisconsin, approximately 2100 feet north of the Southwest corner of Section 19 in Township 46 North Of Range 9 "Jest of the fourth P.M.; thence southeasterly approximately 29 miles to a point on the easterly line of Bayfield County, Wisconsin, approximately 800 Peet south of the northeast corner of Section 13 in Township 47 North of Range 5 Vest of the -Fourth p.m.; and WHEREAS, the County Board deems it for the best interests of this County and its inhabitants that said application be'granted; NOW, TIHTREFORE, BE IT RESOLVED that said application be granted to the extent that this County Board be empowered to grant the same for and in the consideration of One Dollar ($1.00) per rod. The said strip of land comprising the right of way and easement shall.be selected by grantee and shall be ascertained as follows; That portion of the above described property lying between lines parallel to and - situate forty (40) feet to the left and twenty (20) feet to the right, (going from Superior, Wisconsin through Michigan to the St. Clair River), measured at right angles, from the center line ( or tangent thereto if a_, -curve) of the initial pipe as actually laid by Grantee in connection with its undertaking, across the said lands of Grantor or across lands adjacent to the said lands of Grantor, if the initial pipe is not.act- ually laid on grantorts land, such parallel lines being extended to the boundary lines of Grantors said property'so as to enclose the right of way and easement. Grantor covenants with Grantee.that he is the lawful owner of the aforesaid lands, that he has the right and authority to make this grant, and that he will forever warrant and defend the title thereto. TO HAVE AND TO HOLD the said right of way and easement unto said T-A HEAD PIPE LINE COMPANY, INC., its successors and assigns. The Grantee, by the acceptance hereof, agrees that as soon as weather and soil condiitions permit and insofar as it is practicable so to do, it will bury said pipe lines so as not to interfere with the ordinary use of the surface of the land, and also to pay any damage to crops, fences.and timber which may arise from laying, maintaining, operating, or removing said lines. Said damage, if not mutually agreed upon, shall he and determined ascertained by three.(3) disinterested persons, one (1) to be appointed by Grantor, one (1) by Grantee, its successors and assigns, and the third by the two persons aforesaid; and the award of such three (3) arbitrators or any two (2) of them ,in -.writing, shall 'be final and conclusive. The most of such arbitration shall be borne equally by Grantor and Grantee. .June 1i6., 1953- The Grantor --shall not excavate, drill, install, erect or permit -to be -excavated, drilled, installed or erected on or -under the said right- - of` way, and easement any- pit, well, foundation, pavement or other structure or installation, -but otherwise the Grantor - shall have the right fully to use and enjoy- said -premises except- as the, sdme may be necessary, bonvenient or incidental'to the purposes herein granted to -the Grantee. The Grantor- eonvenant's­that lie, will, if so requested by the Grantee, execute such further and other documents'of ,title in respedt of the said right of�way and easement as may be requisite. This agreement shall be assignable by the Grantee and shall inure to the benefit of and be binding upon the heirs executors, admnstrators, successors, and assigns of the parties hereto; and wherever the singular or masculine is used, it: -shall be con- sidered as' if the plural or the feminine or the neuter, as the case may be, had been used, where the context,or the party or parties hereto so require and the rest of the sentence shall'be construed as if -.-the grammatical and terminological'ehanges thereby rendered necessary have 'been -made. Olsen The following instrument is the one referred to in the foregoing resolution; PIPE LINE PERMIT IMREAS, Lakehead Pipe Line Company, Inc., a Delaware corporation having its principal office at Superior National Bank Building, Superior, Wisconsin, has applied for permission to lay down, construct, operate, maintain, inspect, patrol, alter, re- move, replace, reconstruct and/or repair one or more pipe lines over, through, under, across and along county highways in the County of Bayfield, Wisconsin, for the carriage, conveyance, transportation, storage and/or handling of crude petroleum, its products and derivatives, and TRU REAS, the County Board of Supervisors of Bayfield County did, by resolution duly adopted on the day of , 19530 authorize the issuance, execution Line and delivery of a permit to said Lakehead Pipe/Company, Inc., its successors and assigns. for said purposes; Now, THEREFORE, the County Board of Supervisors of Bayfield County, Wisconsin, hereby grants permission to the said Lakehead Pipe Line Company, Inc., its successors and assigns, to lay down, construct, operate, maintain, inspect, patrol, alter, remove, replace, reconstruct and/or repair one or more pipe lines over, through, under, across and along all county highways in the County of Bayfield, Wisconsin, for the carriage,, - conveyance, transportation, storage and/or handling of crude petroleum, its products and derivatives. This permit is subject to the condition that the work shall be constructed sub- ject to such rules and regulations as may be prescribed by the County Board of super- visors and be performed and completed to its satisfaction, and in the case of tem- orary alterations that any county highways shall be restored to their former. condition, and that the permittee, its successors and assigns; shall be liable to the County for all damages which may occur during the progress of said work or as a result thereof. The following -report was read: Washburn, Wisconsin June 16, 1953 Bayfield County Board of Supervisors Gentlemen: At the May 27 meeting of the Forestry Committee the Lakehead Pipe Line Corpora- tion, Inc. request for a pipe line easement through county lands was discussed. Your Forestry Committee recommends that the Bayfield County Board grant an easement for a pipeline across County Forestry Crop Lands in Section 26 and 27, Township 48 North, Range 8 West. The Lakehead Pipe Line Corporation, Inc. paid`for damages to mature timber and reproduction in this right of way. It is also the Committeeas understanding that if the County Board grants this easement, the Lakehead Pipe Line Corporation, Inc. agrees to pay Bayfield County $44.00 per acre for the use of the land through which this line runs. The following report was read: Washburn, Wisconsin June 16, 1953 Bayfield County Board of Supervisors Gentlemen: At the I�pril 22 meeting of the Bayfield County -Board, the petition of Howard Ihrig, Drummond, Wisconsin, to trade his lands, the NE NW and.SE NW of Section 13-45N- -919 for the Gounty-owned land; the NT-SE" and SW" SE- of Section 26-45N-9W, was passed on to the Forestry Committee for their recommendation. At the Forestry Committee meeting of May 271 1953, this matter was discussed by the Committee. We, the undersigned 'Forestry 'Commi.ttee ' rec ommend that the request of Howard Ihrig to trade these lands with Bayfield County be•denied. The following report was read: Washburn, Wisconsin June 16, 1953 Hayfield County Board of Supervisors Gentlemen: At_the April 22 meeting of the Bayfield County Board, the petition from Manly Sharp, Superior, Wisconsin, to trade the lands he now owns - the NE NW, SE SW and SY SE all in Section 15, Township 43 North, Range 9 West; and the SE SW of Section 13-43N-Range 9 test - for the County tax title lands - the SW NE, NW SE, SW SE, SE NE and NE SE all in Section il, Township 43 North, Range 8 West, was referred to the Forestry Committee for their recommendation. At their meeting on April 25, 1953, your Forestry Committee discussed this pet- ition and recommends that Bayfield County first sell the mature hardwood stumpage from the descriptions the county owns as listed above, and then trade these lands with Manly Sharp forty for forty. -The lands that Bayfield County owns exceed in stumpage value, the lands owned by Manly Sharp.
