Johnson and seconded by Herman Hanson that the chair appoint a committee to draw up a memorial resolution for Charles Willoughby, deceased. The chair appointed John Shykes, Frank Hoefling and J. R. Desparois in accar dance with the foregoing motion, Moved by H. C. Anderson and seconded by Desparois to dispense with the reading of the minutes of the previous meeting. Carried. Mr. G. I. Germond, State Highway Division Engineer from the Superior Office, appeared before the County Board and explained orally the proposed 1954 highway program. The Board proceeded with the election of the Highway Committee: Nominations from District # 1 were : Paul Tribovich Edward Pajala The Chair appointed Mr. Stuart and Mr. Richard Nelson as tellers. the first ballot was as follows: Paul Tribovich 23 Edward Pajala 12 Total 35 The Chair declared Tribovich duly elected. The result of The following resolution was read: SALARY OF THE COUNTY HIGI—RVAY COMMISSIONER BE IT RESOLVED: By the Bayfield County Board of Supervisors assembled in annual session, this loth day of November 1953 that the salary of the County Highway Commissioner be and is hereby set at $4,320.00.annually for the ensuing term. BE IT FURTHER RESOLVED: The foregoing salary be paid from State Motor Vehicle funds received under the provisions of Section 63.10 (1) and in accordance with Sections 83:01 (6) and 59:15 (2) of the statutes. Respectfully submitted, Harry B. Curry Moved by Herman Hanson and seconded by, Pristash that H. B. Curry be elected as Highway Commissioner for the two year term commencing January 1, 1954. Carried. Moved by Herman Hanson and seconded by J. 0. Anderson to accept and place on file the annual report of the -County Highway Committee. Motion carried. Moved by Moore and seconded by B. E. Johnson to accept and place on file the annual report of the County Highway Commissioner. Motion carried. The following resolution -was read: STATE AND COUNTY AID CONSTRUCTION AND I4L4INTENANCE SECTION I. The County Board of Supervisors of Bayfield County, Wisconsin, regularly assembled, does hereby ordain that such funds as may be made available to the county for highway work in the year 1954 under the provisions of Section 20449 and Chapters 83 and 84 of the Statutes and the additional sums herein appropriated shall be expended as hereinafter set forth: SECTION II. COUNTY TRUNK HIGHVAY ALLOTMENT. VMREAS: The State Highway Commission has notified the County Clerk that a sum of money estimated to be One Hundred Fifteen Thousand and no/100 Dollars ($115,000.00) will become available at the end of the fiscal year ending June 30, 1954, under the provisions of Sections 83.10(1) and 20.49(11)(b) of the Statutes, for the county trunk highway system in the county, but the actual amount will not be known until the close of the fiscal year, June 30, 1954, BE IT RESOLVED: That the County Highway Committee is authorized and directed to expend the said sum.to the extent required, to match and supplement Federal Aid for construction, right of way, and other costs on any Federal projects located on the County Trunk Highway System of said county, which are not recovered from Federal funds, and to expend any balance for constructing, repairing, and maintaining such county trunk highway system and the bridges thereon, including snow and ice removal and control, as directed in Section 83.10(1) of the Statutes, and to reimburse the general fund for any expenditures that may be made therefrom, pursuant to Section 83.01(6) of the Statutes. The distribution to such purposes is estimated; but not specifically directed to be as follows: For construction, maintenance, snow removal and ice prevention on the County Trunk Hi hw y System. SECTION III STATE TRUNK HIGHTj7AY ALLOTIVISNT (A) WHEREAS: The State Highway Commission has estimated that the sum of One Hundred Nineteen Thousand and no/100 Dollars ($119,000.00)_ will become available from the appropriation of the fiscal year ending June 30, 1954, under Sections 20.49(4), .to be allotted and -expended by the State -Highway Commission in accordance with the provisions of Section 84006 for the construction, reconstruction and improvement of the state trunk highway system and connecting streets upon projects which have been approved by this county, but subject to the provisions of Section 84.03(4) relative to the retirement of bonds, and WHEREAS, there has been received from the State Highway Commission its determina= tion as to the proposed projects and the proposed allocation of such sum; BE IT RESOLVED: That such projects and the allocation of such sum be approved as hereinaf ter set forth: 1. The sum of One hundred eighteen thousand and no/100 Dollars ($,118,000.00.) previously advanced pursuant to Section 84.03(5) Statutes, for the improvement of S.T.'Highway No. 13 between U. S. Highway No. 2 and Bayfield. 2; The following sums for the improvement of the State Trunk Highway System on the projects described: (a) The sum of One Thousand and no/100 Dollars ($,1,000:00) for the improvement of S. T. Highway No. 13 , the U. S. Highway No. 2 Bayyfield Road, approximately 19,32 miles; SECTION IV. WHEREAS: The various highway activities, for which_ provision is made in this resolution are continuous from year to year, and the exact cost of any work cannot be known at the time of making the appropiation therefor: BE IT RESOLVED: That this Board does hereby direct that any balance remaining in any appropriation for a specific highway improvement after the same shall have been coiipleted, may be used by the County Highway Committee to make up any deficit that may occur in any other improvement, which is part or the same item in the county budget, for which provision is herein made, and any balances remaining at the end of the year in any highway fund shall remain and be available for the same purpose in the ensuing year. SECTION V. WHEREAS: The exact amount of the funds that will become available from the state for highway purposes in the county under Section 20.49 of the Statutes will not be known until on or after June 30, 1954; BE IT RESOLVED: That the County Treasurer is hereby authorized and directed to make payments for the purposes for which such funds are to be used, as hereinbefore authorized, from any funds in the county treasury that are not required for the purposes for which appropriated prior to August 1, 1954; and to reimburse such funds in the county treasury from the sums received under Section 20.49 of the Statutes. SECTION VI WHEREAS: The County Highway Committee and County Highway Commissioner are charged with the duty and responsibility of carrying out the construction and maintenance of highways for which prevision is made and other related supervisory and administrative duties, BE IT RESOLVED: That the County Highway Commissioner shall have authority to employ, discharge, suspend, or reinstate such personnel as he deems necessary for such purposes, provided, however, that the County Highway Committee may by action recorded in its minutes determine the number of persons to be hired. . 1 - - -- - - - - November 1:0, 1953- The term "personnel" or 1►person" shall include all patrolMeU, laborers, foremen, clerks, stenographers, or other employees necessary to carry on such activities. S. Highway 2 and Bayfield it becomes desirable to agrese upon the advance of additional future years? allotments to become available to the credit of this county for state trunk highway improvement, BE IT RESOLVED that the State Highway Commission is hereby petitioned to advance and commit the additional sum of $60,000.00 , or as much thereof as rea_uired for such improvement, the amount so advanced to be deducted from future ailotments'as they accrue to the credit of this county under Section 84:03(3)2 Wisconsin Statutes, beginning witj the allotment accruing in the fiscal year ending June 30, 1955; and BE IT FURTHER RESOLVED that this resolution, when approved by the State Highway Commission, shall constitute an agreement pursuant to Section 84.03(5)* Wisconsin f Statutes. The following resolution was read: PROVIDING FOR THE ADVANCE OR'TRANSFER OF CONSTRUCTION FUNDS IN BAYFIELD.COUNTY ITHEREAS Section 84.03(5), Wisconsin Stuates, provides that the State Highway Commission and a county board, or a county highway committee -when authorized by the county board, may agree upon the advance of one or more future yearst allotments for such county under Section 84003(3), to be expended on selected improvements on state trunk highways or connecting streets within such county t.o the extent so agreed, and WHEREAS occasions frequently arise when it is necessary or desirable to provide for the advance, allocation or transfer of consruction funds to or between previously authorized or additional needed construction improvements on state trunk highways or connecting streets in this county; THEREFORE, in order to provide for promptly making available the funds necessary for such improvements and to avoid the delay and expense incident to calling a special meeting of this board for such purpose, BE IT RESOLVED that the State Highway Commission be and is hereby petitioned to advance pursuant to Section 84.03(5), Wisconsin Statutes, upon the filing of a request therefor by the County Highway Committee of this county, which said Committee is hereby authorized to file, such sums as may be required and are not otherwise available, for any such previously authorized or additional needed construction improvements in this county, with the understanding that the amounts thus advanced will be deducted from future state allotments for state trunkk highway construction in this county under Section 84.03(3) of the Statutes, and BE IT FURTHER RESOLVED that the State Highway Commission be and is hereby petitioned, upon the filing of -a request therefor by the County Highway Committee of this County, which said Committee is hereby authorized to file, to transfer to or between any such previously authorized or additional needed construction improvements in this county, any funds allotted.by the state under the provisions of Section 84,03(3), Wisconsin Statutes, and previously allocated to any other improvement or remaining unallocated in reserve. - Resolution presented by: -- - - November 10, - 1953 - Ernest Moore J. The following resolution was read, PURCHASE OF HIGEWAY EQUIPMENT BAYFIELD COUNTY 11HEREAS, for the constructionand maintenance of highways including the removal and control of snow and ice, it becomes necessary from time to time to purchase equipment, the' nature of and necessity for which -cannot be accurately anticipated. THEREFORE, BE IT RESOLVED$ that the County Highway Committee is hereby authorized pursuant to Section 830*015(2) of the Statutes, to purchase without further authority and to the extent that revolving funds accumulated for such purpose or approriations made for such purpose are available, such highway equipment as they deem necessary to properly carry on the work, and to trade or sell such old equipment as may be considered to be for the best interests of the county® Resolution presented by Ernest Moore J+ R. The following resolution was read: BE IT RESOLVED, by the Bayfield County Board of Supervisors assembled in annual session this loth day of November, 1953, that the County Board Chairman, County Highway Committee and County Highway Commissioner are hereby authorized to attend State Road Schools or meetings and that their per diem and expense be paid from the County Highway Administration fund, Recommended by .Ernest Moore .J. The following resolution was read: BE IT RESOLVED By the Bayfield County Board of Supervisors assembled in regular session this loth day of November, 1953, that the -County Highway Committee is hereby authorized to pay the sum of $1380-29 from the County Highway Machinery fund to the Wisconsin County Boards Association to cover Highway Research and analysis opera- tions for the year 1954: Respectfully submitted, Ernest Moore J. Warning: It,is directed that provision for this levy shall be made in the county budget, but that this levy shall not be duplicated. Resolution offered by County Highway Committee Ernest Moore J. R. Note: The petitions by the town board asking for county aid on the bridges listed in the foregoing motion are filed in the County Clerkts Officee The following report was read: I 123 November 101,1953 REPORT- OF COPMTTEE ON THE HERBSTER TO INO ROAD The distance from Herbster to Ino is about 28 miles. The first 8 miles of this proposed road, southerly-from'Herbster, is a fair town road serving about 27 farms or homes, The remaining 20 miles through the Chequamegon National Forest Area to Ino consists of unimproved- Federal Fire Lanese The cost of improving this 28 miles of'road to about the -same standards as the present county Highways would be about $400,000. Even with -the use of Federal Secondary Aid funds if the project were accepted by the Federal Bureau of Roads; of which there is considerable doubt, the cost to the taxpayers in this county would be over $200,000. There is no money available in the county highway depart - went for this purpose. Under the present Statutes in the State of Wisconsin there is no chance to gain any additional state highway funds in the county by changing any road from town to county at this time. The land adjoining the existing fire lanes for 20 miles from Ino northerly is owned by the Federal Government and is tax exempt. The entire Federal area is unimproved, uninhabited, and.vacant as far as residents of any kind is concerned: If the proposed road were built, local travel from Herbster would not normally use it, because it would increase their distance travelled. For instance, from Herbster to Iron River by 16 miles, and from Herbster to Washburn by 19 miles; over and above the present roads. There appears to be no need for such a road from the county point of view at this time, therefore, your committee recommends that the petition requesting such road, recorded in Vol. 10, page 90 of the -county board minutes, be rejected. It further appears that this fence was removed by the owner and not by the 4: z county. Therefore: Your undersigned committee recommends that the claim of Paul Vlasaty for fence damage in the amount of 8150,00, recorded in Vol. 10, page 83 of the County Board minutes, be disallowed. i Respectfully, submitted-, Ernest Moore J. Therefore, your undersigned committee recommends that the claim of Frank Dolato i for fence damage in the amount of $300,00, recorded in Volume 10, page 84 of the County Board minutes, be disallowed. This money was well spent, for he has been receiving monthly benefits of $63.00 since July 1, 1953, the date we reopened his ease. County institutions. County infirmary, home, hospital (for mental diseases, tuberculosis or otherwise) or asylum. b. State institutions. Mendota state hospital, 11innebago state hospital, Wisconsin general,.hospital, �-Tiscon-sin orthopedic hospital for children, southern colony and training school, northern colony and training school, central state hospital, Wisconsin school for girls and industrial school for boys. (1) The provisions of par® 1 shall not be construed to authorize the coun-ty department of public welfare to make investigations regarding admission to or release from the Wisconsin state prison, the Wisconsin state reformatory, the Wis- consin home for women, county houses -of correction, jails, detention homes or reforestation camps. (2) Make investigations which are provided for under Section 322.02(1) if the court having jurisdiction so directs. (3) Perform the duties and functions of a juvenile probation department as defined in Section 48.03 when requested -to do so by the juvenile judge of the county. (4) To furnish services to families or persons other than the granting of financial or meterial aid where such services may prevent such families or persons from becoming public charges or restore them to a condition of self-support, (5) To make certification or referral of eiigibiles for state or federal worms or other assistance programs, eligibility for which is based on need, when desig- nated to perform such certification or referral services, and to certify eligibility for and distribute surplus commodities and foodstuffs. (6) To administer child welfare services including services to children who are mentally defective, dependent, neglected, delinquent, or illegitimate, and to other children who are in need of such services. In administering child welfare services the county agency shall be governed by the following: (a) The county agency may avail itself of the cooperation of any individual or private agency or organization interested in the socaii welf are of children in such county. (b) The county agency shall administer and expend such amounts as may be necessary out of any moneys which may be appropriated for child welfare purposes by the county board or donated by individuals or private organizations. (c) Upon the request of the state.department of public welfare and under its direction, the county agency shall assume the oversight of any juvenile under parole from or otherwise subject to the supervision of any state institution' (d) Upon the request of the Budge of the juvenile court, the county agency shall investigate the home environment and other factors in the life of any child brought to the attention of the court for alleged dependency, neglect, or delinquency; and to assume guidance and supervision of any child placed on probation by such court. '(e) The county agency shall, without being licensed pursuant to Section 48.37(2), have and exercise any additional powers and duties that are authorized for child wel- fare agencies under ss. 48.35 to 48.38 except that the county department of public welfare shall not have authority to accept permanent care, custody and control of any child, to place children for adoption, or to -place children in foster homes in another state. (f ) The authority given to the county department of public welfare under par. (6) to function as an authorized child welfare agency shall not be interpreted as excluding agencies licensed pursuant to Section 48.37 from also exercising such functions. The' -following resolution was read: WBEREAS the State does not grant any direct aid.toward the payment -of the salary of the County Judge as it does -for the agricultural agent, county nurse, welfare director, highway commissioner, -etc., but the state legislature has passed certain laws whereby the county revenue or income has -been -substantially -increased to assist the counties to partly defray the cost of law enforcement and court functions. Some of this legislation is: (1). In 1951 court costs were increased from $2.00 to $3.00 in all criminal and civil cases. (2) In 1953 fees for certified copies were raised about 50%. (3) In 1953 most state traffic fines were substantially increased. (4) Starting Ian. 1, 1954 coUtt-costs will be collected in -all probate cases. This is entirely new revenue. tgM1REAS all of the above monies have been and will be collected and turned over to the county, The county keeps all of it except 50% of the -traffic fines and 65% of the probate court costs. The county judge gets no fees of any kind. WHEREAS part of this increased revenue or income should be used,'as intended by the legislature, to enable the county judge to receive a salary comparable with other positions requiring professional training and education. I hav ,,e no way -oft -knowing what the records show with respect to the restrictions on this allotment,, but 1presume that-Mr..Riley has that information and that it is correct,, and that the land in que'stion was not taxable. .7hat, being the case, it is very likely that the County did not acquire an interest by its tax deeds, and unless the County has actually taken possession of the -land or asserted some dominion over the. same by -reason of its tax deedsi 1'would say that it would be in order for the County Board to order the cancellation of such deeds. I realize that a good deal of time has elapsed since the taking and recording of .the deeds, but unless rights in possession or rights of third parties have intervene.d, the situation would not be any different now than at the time the deeds were taken -and they are probably void and should therefore be cancelled. It has been calculated that- a circuit judgd today, to stand upon the same footing as a circuit judge in the 30°s, taking into-cons2.deration only the difference in purchasing value of the dollar; would have to have a salary of $'15,624. When there is further added to the :computation the increase in the income tax the increase in 'salary, to be at a level with the 30•s would have to be even -greater. Since taking my -position as circuit judge I.have instituted in each of the counties a system to pretrial conferences. I feel' that -by so doing I have - saved -each county, and will continue to save each year; far more than any possible contribution that could be made, The, -reporting -of a jury panel for the trial of one case-, fort -just one day, costs the county, between $300. and $400. Thus by holding a-pre=trail conference and exerting every effort to getting the parties to settle their cases without a trial this expense is avoided. While I think it unnecessary to set forth'in-detail the number of cases -which have been so settled, 1-might refer the members of the committee to the Clerk of Court for information on tI1at point. I perk-s can cite one case whichwas ,at November issue.in Price County. It was estimated that the minimum time for trial would be between a week and,ten days. Suah.;_trial would have cost the county in the neighborhood of $1300. Through a pre-trial conference Which lasted throughout one whole day, all of the parties finally got together and settled without resort to a jury trial. This result was accomplished first of all because such conference was set and all parties were' required to be in attendance, and secondly, I feel, through efforts which I used in promoting the settlement itself. T'o advise you that the work of this circuit is as ia..avy as that, of adjoining circuits, I am enclosing. herewith. a tabulation taken from the Judicial council report showing matters handled by each circuit in the northern half of the state during the year 1952.: It is, of course, to be understood that my best efforts will be continued in the future to conduct the affairs of this circuit with the least expense to each of the. counties involved, no matter what, may be the result of this application. As chairman of this committee am writing you to -call your attention to thisconditionwhich exists in Ashland and Bayfield Count ie s. After every substantial rain the waters of Chequamegon Day become red from the clay being washed into the bay. The City of Ashland has been forced to instal* a sewage disposal plant at a terrific expense to'the taxpayers and water users of the city in order to a -void contaminating the water of Chaxquamegon Bay, but these waters are being. constantly contaminated by the red clay being carried down from the streams and rivers. This condition not, only contaminates the bay, but constitutes a loss of valuable top soil from the forests and farm lands along these rivers".
