ANNUAL MEETING OF THE BAYFIELD COUNTY' BOARD

Meeting called to order at 10 A. dal. by Chairman, Clarence L. Olsen.
The following members answered roil call: Raymond Mammoser, W. C'. Barningham,
Stance Burlager, 3'. Wo Buck, C'. C.'Laudenschlager, Anthony Janock, Edward Reimer;
Bernard E. Johnson, Joseph Pustingger, J. R. Desparois, Frank Hoefling, William Stuart,

Moved by Janock and seconded by Shykes to dispense with the reading of the
minutes of the last annual meeting held in November 1953. Carried.
Moved by Buck and duly seconded to nominate Clarence to Olsen for Chairman of
the Board. Motion carried.
Motion was duly made and seconded that nominations be ,closed. Motion carried:
Motion was duly made and seconded that the County Clerk be instructed to cast a
unanimous ballot for Clarence L. Olsen as Chairman for the ensuing year. Carried.
The Clerk cast a unanimous ballot for Mr.. Olsen as Board Chairman and he was declared
duly elected.
Moved by Janock and seconded by Pristash that Edward Pajala be named as Vice
Chairman,of the County Board. Motion carried.
Moved by Janock and seconded by C.-O. Nelson that nominations be closed, and
that the County Clerk cast a unanimous ballot for Pajala as Vice Chairman. Motion
carried. The County Clerk cast a unanimous ballot for Edward Pajala as Vice Chair-
man and he was declared duly elected.
Moved by Tribovich and seconded by Stuart that the rates for publication of
the County Board proceedings for the ensuing year be set as follows:
85¢ per folio for official proceedings
25¢ per folio for printed supplements,
15.00 for other than official paper for distributing supplements of each County
Board meeting. Carried.
Moved by Desparois. and seconded by Reimer that the Iron River Prioneer Press be
designated as the official paper for the ensuing year. Carried.

Moved by H. C. Anderson and seconded by Reimer that RobertASpearsbe nominated as
Trustee of Pureair Sanatorium representing Bayfield County for the balance of the
unexpired term which commenced January 1, 1954. Carried.
Moved by Stuart and seconded by .Tribovich that nominations be closed. Carried.
Moved by Janock and seconded by Pustinger that the County Clerk cast a unanimous
ballot for Mr. Spears. Carried. The County Clerk cast a unanimous ballot for 10r.
Spears and he was declared duly elected.
The following resolution was read:
RESOLUTION
WHEREAS' the terms of Clarence L.- Olsen, Town: of Barksdale, and Thomas Rondeau,

WHEREAS, the Committee on Education of the County Board is to nominate candidates
for these offices according to Section 40.02 (a) of the Wisconsin Statutes, therefore

My dear Ludwig:
Thank you for your letter of November 23, with which you enclosed a copy of a
resolution adopted by the Bayfield County Board of Supervisors, regarding the effect
on the Soil Conservation program under the Agriculture Reorganization Plan. I recent-
ly received a resolution adopted by the Bayfield County SCS Governing Body; and I
wrote them as follows:
rrI want you to know I agree wholeheartedly with the statements in the resolution.
I ha#e always supported t-he Soil Conservation program which I think is one of the
best we.have. As a matter of fact, I think it should be expanded and certainly
not hampered in any way.
teTVhen the announcement of the change came out I immediately got busy by personal,
telephone and written contact with the Secretary - pleading for full and careful
evaluation of the proposal. I was advised that November lst was the deadline for
receipt of comments and sug.gestions,. and you may be sure I continued my contacts
right up to the last minute. According to the Secretary of Agriculture, the
Plan was not to go into effect until all protests and suggestions were considered.
However, as you know, the Secretary announced on November 2nd that the Plan was

being put into immediate effect. Because of my belief in the program and hopLe for
its continuation of its highly efficient level, I was terribly disheartened that
such action was taken. I am sure that -when Congress reconvenes in Tanuary, this
high-handed action on the part of Secretary Benson will be repudiated.
"You may rest assured that I am going to be watching the new setup closely for
any indication of inadequate service to the people.
"As long as I have been a Member of Congress I have always supported legislation
and programs that are beneficial to the farmers and you may be sure I will continue
to watch out for the best interests of the farmer as long as I am here."

reorganization of the Soil Conservation Service.

Re: Protest Against Reorganization
Of Soil Conservation Service'
I want to thank you for conveying your views to me with regard to the very
questionable reorganization plan'proposed for the Soil Conservation Service.
I have received a vast number of telegrams and letters rightly protesting against
this plan. Immediately on receipt, of the very, first, wire. and- letter, 1' got, in touch
with Secretary Benson's-Off ice" urging- postponement of placing of the plan into effect
and -reconsideration of the whole plan.
Secretary Benson -had previously indicated that he definitely would wait until
reactions had come in.
From all over Wisconsin, Conservation groups, farmers and farm -organizations have
almost UNANIMOUSLY indicated their deep protest against the plan. It would mean, as
you know, the closing of the seven vital regional offices including the one in F�jilwaukee.

It could mean the possible loss of a great many invaluable technicians who can hardly
be replaced. This must not happen.
Sound soil conservation, we all know, is an.ind-ispensable-program for the future of
our State and of all America. . IT' IVIUST"-NOT'' BE"'ENDANGERED"'IN"ANY MANNER, 'SHAPE OR FORM:
I shall be in the closest of contact with Secretary Benson's office, as will other.
Senators and Representatives"who have already expressed to the Secretary of Agriculture

Dear Lud:
I am. sending you herewith the information requested in your -letter -of March 6th,
which has been somewhat delayed due to my absence on vacation. I trust this is the
information you will need for the County Board meeting, which is scheduled for April
20th:
I do not know the reaction of the other Counties. Last Fall in as far as my
knowledge goes the matter was not transmitted to them, and I am quite sure that no
action was taken by either Ashland or Iron Counties.
The original estimate made- by Kr. Shefchik in- October of 1952 was f or enlarging
the kitchen and also enlarging the bedroom at the same time. The estimate for this
project with new kitchen cabinets and counters was $7,700. The present kitchen space
is 11, x 81611, and the proposed change was to knock out the 8161.1 wall and project
the building for a distance of 619". On October 29, 1953 I again inquired from
Mr. Shefchik regarding this matter following our County Board meeting, and I.quote
as follows. !'We have checked over our estimate that we prepared a year ago for the
addition to the Kitchen and bedroom and find that omitting the bedroom extension
would save in the neighborhood of $1,000. In ether words, the foundation forthe
addition and the kitchen itself, including the roof would cost about 5�5,000. If the
wall is not removed but only an arch placed therein the saving effected would be in
the neighborhood of $400. We hope that you do not use this deduction. The kitchen
would be much better if the wall is removed entirely. lm?eiv kitchen cabinets and
counter tops would be priced just about the same as we had in our letter of October
2, 1952, or namely, :$1,200. additional.fi
This all adds up to a net cost for the proposed addition of 46.,200 as of Mr.
Shefchik's estimate last October. I am sending you the blue prints, itLich 1,As. Shef-
chik drew up in October of 1952. We do not have an additional copy, so I would
appreciate your returning them later. you will note that these include the enlarge-
ment of the bedroom also, but in as much as this has been eliminated from the

April first, 1954, makes this correction necessary.

Gentlemen:
On July 6, 1939 a conveyance of land for highway purposes was entered into between
Jack Pavich and Manda Pavich, his wife, and Bayfield County granting to Bayfield
April.203, 1954
County a certain -easement for highway purposes in connection with -the laying out of
U. S. Highway 2. As a part of the consideration -for said conveyance, Bayfield
County agreed to install a cattle pass and fence the Highway up to said ca.,etle
pass for the tree use of that area constituting the passageway for their cattle in
passing from lands owned on one side of the road by 'Jack Pavich and IVIanda "Pavich, his
wife, to those owned by them on the other side -of the road.
A cattle pass and.renced=in-lane which adjoined and abutted lands owned by one
Andrew Brilla were used by the above grantors up to about April 1, 1953 when the
fence was removed by Andrew Brilla. The County Judge has; in an opinion handed down
on January 10, 1954.relative to the criminal action of the State of Wisconsin vs:
Andrew Brilla, held that Jack Pavich has no right, title or -,interest in the -cattle
pass and the lane and is, therefore, unable to use this cattle pa-ss-,
On behalf of Jack Pavich and Manda Pavich, the grantors in this deed of convey-
ance dated July 6. 1939 to Bayfield County, I am making demand that Bayfield County
construct and provide a cattle pass and fenced -in lane on the highway right of way
which can be used by Jack Pavich and Manda Pavich for their cattle. If construction
is not made forthwith it will be necessary for us to ask for specific performance
of this part of the agreement.

follows: That the present incorrect definition of "'Non -conforming." shall be deleted
and the correct definition be inserted as follows "Non -conforming Use - a building

at 2:00 P.M, in the afternoon on the proposed amendment to theZoningOrdinance of
Bayfield County as it affects (a) the definition of "Non -conforming use" in the
zoning, regulations of said ordinance,, all pursuant to Section 59.97 (3)) Wisconsin

WHEREA3, Bayfield County has constructed and maintains a data, Known as ivkrray Dam,
located in the Town of Delta in said County, said dam having been re -constructed in 1950,
with a sill elevation of 93.93 feet and said dam being maintained for the purpose of
controlling the water level of a chain of - lakes in the Towns of Delta and Iron River,
known as the Pike Lake Chain, and
WHEREAS, the normal water level of said chain of lakes was found by the Public
.,service Commission to be 94.04 feet, between The years 1941.and 1950, and 94.33 feet on
the 10th day of September,, 1953, and
lnlERFAS, numerous piers, docks, cabins and other structures have been built on said
chain of lakes representing substantial investments of private property owners,, said
construe -Lion having been undertaken in regard to and in considdratiOn Of the normal
water level of said chain of lakes as hereinabove set forth, and
IVHEREAS3, The Public Service Commission of the State of Wisconsin ordered that the
sill of said Murray Dam, be lowered approximately one foot to 93.0 feet) on or before
July 1st 1954, said order being dated the 25th day of Sanuary,, 1954t,-an-d
WHEREAS, such a lowering of the will and water level of said chain of lakes could
result in great loss of property and damage to structures on said lakes, now, therefore
BE IT RESOUVED9 that in the alteration of said Murray Dam to comply with the order
of said Public 3etvice Commission to lower the sill of said dam to elevation 93.0 feet,

that such steps as necessary be taken to insure the maintenance of the maximum
level of said Pike Lake Chain at 94.3-- feet as nearly as practicable as allowed by

level that the dam be so altered as to provide a system of stop logs or other --system

will formulate policy for traffic control and will have authority to supervise and

REGARDING..THE,.STATE,CONSTRUCTION
PROGRAM',IN BAYFIELD.COUNTY
WHEREAS, The State and County.- jointly, heretofore made available the sum Of $3590095.56
for the improvement of S.T.H. 110. 27 from the south county line northerly, by advancing
the 1955 and 1956 construction allotments matched with federal aid secondary funds;
and it now appears that the above sum may be insufficient to complete all of the 8.3
miles originally planned; and
MiMREAS9 It is also conside.red--advisa-ble and necessary to program and finance the
improvements of S.T.H. No. 13 between Washburn and Bayfield;
NOW THEREFORE BE IT RESOLVED, That the State Highway Commission be and is hereby re-
quested to improve S.T.H. No. 2.7 from the South County Line northerly as far as funds
will permit,, giving consideration to the minimum construction standards acceptable
by the Federal Bureau of Roads for that class of road.
BE IT FURTHER RESOLVED, That the State Highway Commission be petitioned and requested
10 program and finance the improvement of S.T.H. 13 between Washburn and Bayfield
and that construction allotments subsequent to 1956 be advanced for that purpose to
the extent necessary.

The request by the State Highway Department for an easement through county
owned land for the relocation of State Highway No. 27 was discussed by the Forestry
Committee at their meeting Of April 19, 1954. This right-of-way would run through
Sections 4, 9,-17p 16, 32, and 33 all in Township 43 North, Range 9 West.
Your Forestry Committee recommends that this easement be granted.
We further recommend that all merchantable trees be cut in such a manner
that the County ]Forestry Department can sell them to a timber buyer.

CLAIM LAKE ROAD
This road is located b�tween-Namekagon`Lake and'Clam Lake. The t°otal length is 11..3
10.15 miles
miles, -""in the Town of Namekagon, Bayfield County; and 1.15 miles in the Town of
Gordon, Ashland County.
The road is used Mostly by tourist traffic in season. A traffic count indicates 165
vehicles at the Junction with '!Dn.
The present condition of the road is narrow; hilly and crooked. The traveled surface
is an oiled skin mat 16 feet wide in poor condition.
The estimated cost to improve,to present county trunk standards is approximately,
$300,-000. Necessary immediate reoiling would cost approximately- 35;000. The -reso-
lution from the town does not provide any money. The county highway department has
no money available.
The Torn of Namekagon has an equalized valuation of e1,283,350. no town indebtedness;
and a local tax rate of .0384. The -town has not appropriated any money for roads -for
the past several years. The town road mileage is 48.86 miles; the'townfs 1953 gas tax -
income was- ,898.65. ' he-ave'rage- miles .af county highways per town in the e,ounty is
6 miles. The present mileage -of C.T.H. "Dn in -the Town of Namekagon is 10 miles. If
this request is granted the mileage of'County Highways in the Town of Namekagon would
then be 20 miles- or-approximat�ely 1-4 miles. -.more than the average.
This petition -is only one of se-vera ., ei-ther,previously filed or pending, before this
board and they -should all receive fair consideration when and if the county can secure
money for these roads. At present the only source of money is a direct property tax
under the two -mill levy.
Increasing the -county roads -decreases the--gas-tax money. That is why the County
Highway Committee -has repeatedly recommended that there be, no increase in county roads
anywhere in the county at this�particular'time: Section 20,.49 (11) b (1) requires a
gas tax distribution Formula based on total rural mileage in the county not on county
trunk Mileage: Adding more county -roads -under this formula, if carried out in full,
could mean -the -loss of the supplemental money -or -about 118,000 each year. Bayfield
County cannot afford such a loss in road revenue at present.

ing such an instrument, in duplicate, which we ask that you kindly summit to the

stand will be held -on April 20th. As,we informed you by phone the other day, we

seven 40 acre plots and have `built a cabin and intend to use the land for recreation-
al purposes only.

There is quite an increase in deer hunters since I came to your state in 1909, but d,

we shall again bring up a resolution for the 3rd time for a closed season on deer.
Lets save afet'dder for part of our. tourist attraction. And give our resolution the
consideration we are at least entitled to; as we represent every town in the County.

At the County Board meeting in NovemDer,l was requested to do some research on
the matter of the effect of county tax deeds on mineral rights in lands covered by
such deeds, and to make report to the Board at the Spring meeting.
I have studied the question with a good deal of interest because I think the
subject may come up one of these days now that mineral rights apparently are becoming
more important in some of the areas embraced within Bayfield County.
At one time I was somewhat concerned about whether of not tax deeds would include
mineral rights which had been reserved back in the chain of title, but after looking
over the statutes and the cases'on tax deeds, I am thoroughly convinced that the taking
of a tax deed gives the County the absolute ownership of the land involved including
not only surface rights, but all mineral rights as well, assuming of course that the
tax deed has been regularly taken and is a.valid tax deed.
.Section 75.14(1) of the statutes provides, among other things, that a tax deed
"shall vest in the grantee an absolute estate in fee simple in such land." It is
interesting to note that this was one of the first laws passed after the admission of
Wisconsin as a state and after the organization of the state legislature, this language
having been incorporated in the statute book by Section 109 of Chapter 15, Session
Laws of 1849, and the wording has remained the same to this day. This language has
been interpreted in a number of cases which have come into the State Supreme Court,
in one of which it was said that a tax deed conveys as good a title as any other
conveyance. In another case, it was said that a tax deed vests a fee simple title

like any other- abs&1-dte' conveyance.
From these opinions, I am as I have said, thoroughly convinced that the ownei-
ship-of the county by tax deed is absolute and includes mineral rights as -well as
surface rights. The Attorney General has, by inference, stated this to be the
opinion of his office also, by advising in 1949 that the county,_board has general
power to include reservations of ores, minerals, oil and gas in conveyances of county,
lands acquired by tax deed. The. opinion relates to the matter of reservations of such
mineral .rights in conveyances by the county, and it was held that the county had that
right. It is obvious that there would be no point in advising that the county had
the right to reserve the minerals if it had not acquired them by a tax deed in the
first instance. The opinion is contained in Volume 30, Opinions of the Attorney Gen-
eral, page e39
Accordingly, it seems that our county has been entirely within'its-rights in
assuming that the ovinership of mineral rights came into the county upon acquisition
of lands by tax deed and 'Within its rights in m-aKing the reservation of mineral rights
that we have been making in recent years when selling and conveying such tax deed
lands.

in.the State Board of Health, and
WHEREAS, it appears there will be available for the construction of nursing homes,

20th day of April 1954 that if the Bayfield County Public Welfare Committee finds that
forty or forty-five per cent of the cost of construction of the Bayfield County -nursing
home will be made available to Bayfield County on application, the proper officials
of Bayfield County are authorized to make application to the State Board of Health for
such a grant, providing that such application does not make it mandatory upon the
County to build such a nursing home, and
BE IT FURTHER RESOLVED that in the event that such money is available -and such
application for funds binds Bayfield County to construct a nursing home, and if such
money would be available to the County before July 1, 19549 the Bayfield County Welfare
Committee is authorized to ask the Bayfield County Clerk to issue a round robin calling
a special meeting of the Bayfield County Board for the purpose of determining whether
or not Bayfield County should make application for such funds.

An adjustment in the fees paid to doctors for services rendered at'the Bayfield
County Immunization centers must be made. The fee for many years has been-97.50 per
hoer. The number of hours is estimated from the time the doctor leaves his office
until he returns:
In asking information from other communities it was- discovered that- doct-ors
fees is other- areas is- $25-600, per9 hour and some-- of, them- also charge mileage. -
.A request for $15.00 per .hour for doctors* fees, is hereby made.
The cos-V of this- department, has -averaged- $600.00 per- year, for -doctors-9 fees;
The entire cost of this program has been charged pack to each individual town, village
and city.
A .rough estimate of the increase necessary in future programs for doctors-? fees
is $750:00 instead of the t600.00 now allowed in the budget. This• cost, of course,
is the estimate --figuring a continuation of the.8 centers now held instead of the 14
centers held in previous years-,
I stated in my. 1953--annual report that in planning for future immunization
clinics, fewer centers Mould beheld. These -centers -to -be, -held in key places in the
county. It seas_ felt that so few' came- -to-some. of the centers held, it was a waste
of ruaterial, doctors and nurse:s time, as well as costly. People From --these areas
were asked to attend one -of the•centers•scheduled. It was tried out this year, and,
I believe, with a few -minor -changes, it will work out well. The county will still
be well protected.

Gentlemen:
The death of - Peter J. Savage- crested a vacancy in the off ice" of judge of the
second municipal court of Bayf eld-C`ounty'. The -act creating the court provides that
such vacancy shall be filled b'y� appointment by the Governor and that the person
appointed shall continue in office for the residue of the term for which his prede-
cessor was elected or appointed.
The Governort s" office' is- reluctant to appoint a non -lawyer.. to judicial office
and has asked the -Judicial Council to recommend what action should be taken. The
council has directed me to inquire among the Bayfield bar and other sources as to
and
the -need for such a court/as to the existence of justices of'the peace in the
vicinity of Iron River, so that an intelligent recommendation can be made to the
Governors office.
The idd cial-statistics which we collect show that there were only 2 statutory,
autombil'e violations disposed of during 19'520, During 1953 there were a 'total of
58 cases disposed of. 40 of _these were statutory autombile violations, 2 were
minor assaults, l was carrying a deadly weapon, i was a liquor law violation, i
was a disorderly charge and 12 were various other crimes. All of these were pleas
of guilty or nolo contenders as were the .two 1952 violations. Ih'1953 there was
one preliminary examination -in -an -aggravated as•sauit case.
From these figures, it appears that the:7 primary busines-s of the court is the -
handling of traffic and' overweight cases- .(although there may be some civil cases -
since we d'o not col eet statistics --as to -those- matt ers° from thi& court).
I contacted the..Enforcement�Division. of the -.-Motor Vehicle Department to deter-
mine how much their" operat fona'would ce -himd'ered by the absence of the Second
Municipal Court. I was informed that there would be no inconvenience if there veere
justices of the peace in the vicinity. They do need some one to accept bail since
state traffic officers are not authorized to do so and many of the traffic offenders
on highway 2 are out-of-state residents.
The records of the Secretary of State indicate that Otto Makela and James P.
Tutor'are justices in the Town of Tripp and that their post office addresses are
both Iron River. Arnold L. Carlson is a.justice in the Town. of Drummond and Joe
Susienka is a justice in the Town -of Keystone.
Vdhile Section 4 of the act creating the Second municipal Court says "No justice
of the peace within Bayfield county.shall exercise any jurisdiction: in any criminal
cases, but all such jurisdiction is vested in. the judge of the. said second municiP_al
court and the judge of the municipal court of Bayfield County".a later act which
gives the County Court of r3ayfield County extra jurisdiction states in section 3.(3)
"All criminal warrants issued by justices of the peace of said county of Bayfield
may be made returnable before the county court ." Thus the legislative intent
appears to be that a justice can still issue warrants in Bayfield county despite
the language of the Second Municipal Court act.
If the Governor wishes to name a lawyer as judge, I gather from checking the
legal directories and conferring with Phil Habermann that thie Bayfield County
lawyers consist of Judge B1anchard, Mr. Norlin, Mr. Spears and Miss Fawkes. Since
Mr. Norlin is District Attorney and also a partner of fir. Spears, I take it that
neither would be a possible nominee upless they changed their status in view of
Wis. Stats, sections 256.19 and 256.21.

Possibly none of- the, members of the Bayfield , bar- are - interes -ed" in the office'.
In this case the alternatives seem to be to app'oinl' a non -,lawyer or to let the
office remain -vacant.
I would certainly appreciate your commentt�as�to whether•my - assumptions are
correct concerning the. -local situation and any suggestions any of you may care to
offer to enable the council'.to mane an intelligent recommendation.
