The following members answered roll call: Henry L. B.oroo, Walter C. Barningham, Stance Burlager; Silas W. Buck, Walter Kliszcz, Onne Beeksma, Albert Podolan, Bernard E. Johnson, Ernest Heglund, J. R. Desparois, Frank Hoefling, W. A. Stuart, Everett J. Erickson, Joseph Berweger, Herman Hanson, John 0. Anderson, C. O. Nelson, Toivo Elonen, Joe Lupa, Evald Johnson, Clarence T. The Board proceeded with then'election of a Chairman and Vice -Chairman for the ensuing year. Moved by Buck•and seconded by Desparois to nominate Clarence L. Olsen for the Chairmanship. Motion carried. Moved by Anderson and seconded by Stuart to close nominations. Motion carried. Moved by,,Buck and seconded by Stuart that the Clerk cast a unanimous ballot for Clarence L. Olsen as Chairman.. Motion carried. The Clerk cast the ballot as directed and Clarence L. Olsen was declared duly elected. Moved by Desparois and seconded by..Lupa that Pajala be nominated as Vice - Chairman. Motion carried. Moved by Buck and seconded by Barningham to close the nominations. Motion carried. Moved by Herman Hanson and seconded by John 0. Anderson that the Clerk cast the unanimous ballot for Pajala as Vice -Chairman. Motion carried. The Clerk cast the ballot as directed and the Chair declared Edward Pajala duly elected. Moved by Pajala and seconded by H.J.S. Hanson to dispense with the reading of the last minutes of the County Board. Motion carried. The following Resolution was read: R E S O L U 71 O N WHEREAS, Edvard Skille is now serving on the Election Board for his fiftieth consecutive year in the Town of Drummond, and WHEREAS, he has been present at every Election during that t ime ; THEREFORE, BE IT HEREBY RESOLVED, That the County Board of Bayfield County go on record to extend to him its appreciation and best wishes; BE IT FURTHER RESOLVED, That a copy of this resolution be sent to Mr. Skille at Drummond, Wisconsin. Motion carried. - --- --- - --Apr_il _16 1957-- ' --- The following -Resolution was read: RESOLUTION' ` RESOLVED, that Bayfield County seek to acquire the lands described as, < The Southwest quarter of Section 18, and the,North half of the Northwest quarter of Section 19, in,Township�49, North, Range 5 West; - and The East half of the Southeast quarter of Section 13; and The Northeast quarter of the Northeast quarter of Section 24, in Township.49 North, Range 6-West from.the United States of America, the same being a part of the 1 federal forest, by exchange for County -owned lands of similar extent and/or value or by other means if an exchange cannot be arranged. - Prdsented by: George Malinoski Henry J. It was ruled that the motion by Pa,-jala was properly before the house and there- fore'the Motion by Herman Hanson was out of order. A vote by ballot was requested and the results were as follows: For 31 Against 6 Total 37 The Chair declared.the motion to adopt the Fa=mxbresolution carried. The following Resolution was read: RESOLUTION RESOLVED, that the resolution heretofore adopted by the County Board under date of April 21, 1954, and recorded in Volume 10 on page 191 of the County Board Journal°be, and the same is hereby entirely repealed and rescinded. FURTHER RESOLVED, that the ordinance of the County Board relat- ing to the granting of preference in the right. to purchase tax -deeded lands to the former owner, -which Ordinance was adopted November 12, 1947, shall be considered to°give the County Sales Committee the authority to give preference to the former owners who apply for the April 16, 1957 52'7 purchase of lands lost through delinquent tax proceedings, but that in no case shall the Committee permit the former owner gny preference in the re -purchase after the land has been in the name of the County for a period of five years. RESOLVED FURTHER That where the land has been in the County under appropriate tax title proceedings for less than five years, the Committee shall have the authority to exercise discretion and to allow the re -purchase by the former owner in such cases where..they deem it desirable to do so, but that in cases where they deem the public interest to so require, they shall have the discretion to deny the application of any former owner for the re -purchase of such lands except by bidding and competing with other prospective purchasers. RESOLVED FURTHER that in all cases where the former owner is permitted to redeem or repurchase, mineral rights shall be reserved by the County, pursuant to the terms of the general resolution of this Board relating to reservation of mineral rights in all convey- ances by the County. The following Report was read: -Washburn, Wisconsin April 16, 1957 Bayfield County Board of Supervisors Washburn, Wisconsin Gentlemen: Your Forestry Committee has considered the request of the Lake Superior District Power Company for an easement through the SW SW of Section 12-49-9. We recommend that this easement be granted with the pro- visions covering timber stumpage according to the resolution adopted by the Bayfield County Board November 14, 1952, as recorded in Volume 10, page 38 of Bayfield County Board pro- ceedings. Motion carried. 52�z April 16, 1957 The following Resolution was read: RESOLUTION --- ---- - WHEREAS, The NE NE of Section 18-45-6 is now under the County Park System; and WHEREAS, The above description has a considerable amount of matured aspen stumpage on it that should be harvested; and WHEREAS, The cutting of this timber would in no way affect the stream or cause erosion as no timber will be cut within 200 feet of this stream which runs through a tag alder swamp; now THEREFORE, BE IT RESOLVED, That the aspen stumpage be harvested from said description. The following Resolution was read: R E S O L U T I O N WHEREAS, certain lands located along the laid -out route of S.T.H. 133 in the Town of Bell, Bayfield County, Wisconsin, within the limits of Project S 0269(7), Port Wing -Red Cliff Road, have been acquired by Bayfield County by Tax Deed, and WHEREAS, it is necessary that certa.n portions of such county -owned lands be established as highway rightef-way, NOW THEREFORE, BE IT RESOLVED, that the County Board of Supervisors of Bayfield County, Wisconsin, in regular.session assembled this 16 day of April , 1957, do hereby dedicate the following described lands for highway purposes: All of T. 51 N., R. 6 W., Sec. 32, the SE' -SE! thereof, lying south of the following described line: Beginning on'the east line of Sec. 32, T. 51 N., R. 6 W., (the east boundary of`described parcel) 69.41, north'of the southeast corner of such section; thence S. 84 46, W. The.following Report was read: Washburn, Wisconsin April 16, 1957 Bayfield County Board of Supervisors Washburn, Wisconsin Gentlemen: Your Forestry Committee has considered the r equast of Ronald Flones, Washburn, Wisconsin, to purchase the NW SE of Section 29, Township 50 North, Range 6 West, now under County Forest Crop Land. This land is isolated and zoned for forestry and'with- drawing this forty would break up a solid blocking of Forest Crop ownership, we therefore recommend that this request of Ronald Flones be denied. Motion carried. 534J - - - ---April 16,- 1957 The following Resolution was read: RESOLUTION WHEREAS, The Bayfield County Forestry Committee now issues permits for 'sand, gravel and dirt to be taken from County Forest Crop lands; and WHEREAS, It is the responsibility of the Forestry Depart- ment to check and collect for any and all sand, gravel and dirt removed from County lands; now THEREFORE, BE IT RESOLVED, That the Bayfield County Forestry Committee will be authorized to issue permits to sell dirt, sand and gravel from all County owned lands. The County Board ...resolved itself into a Committee of the whole for the purpose of conducting a hearing on the'vacating of part of the plat of the Iron River and Brule Estate,'Sub-division. December 22, 1956 Bayfield County Board of Supervisors Bayfield County Washburn,'Wisconsin --April _17,_ 1957 __-- Gentlemen: :At a recent Town Board meeting the members discussed the Forest Croplaws, the ten cents per acre initial tax being paid on the large blocks,of private forest crop in our town and in our area. It seems to this board that the tax could be raised to twenty cents per acre, at least; more and more land is placed in the Private Forest Crop category each year. Very truly yours, Blanche J. The following communication was read: CONSERVATION DEPARTMENT Madison April 1, 1957 Mr. Ludwig Tranmal Bayfield-County Clerk Washburn, Wisconsin Dear Mr.Tranmal: - Enclosed is a state draft in the amount of $16,262.49 as 1957 payment of state aid for county forests pursuant to subsection (1) of'Section 28.14 of the Statutes. This payment is made on 162,624.95 acres.of county forest lands as shown on our records. As similar pay- ments have been previously received by your county, you will understand that these funds may be used only for the purpose of development and improvement of the county forest. The following Resolution was read: RESOLUTION A proposal having been received from the Bear Creek Mining Company for the leasing_of mineral rights owned by Bayfield County in lands described as the Southwest quarter of t25nshirNtWeaiesthe aS�o�u�t�h�w �a �quarter of Section,Towp44 North, Range Northwest Quarter of the Northwest Quarter,Sec.36-44-5 W, Bayfield County, Wisconsin, and a proposed form of lease having been submitted to the Board for its consideration; BE IT RESOLVED that the,Industrial Development Committee be and it is hereby authorized to negotiate a lease with said company according to the terms and in substantially the form of the copy of lease presented to this meeting; and be it FURTHER RESOLVED that the Chairman of, the Board and the County Clerk are hereby authorized and directed to.execute on behalf of the County an original -and as many counterparts of such lease as may be deemed necessary. The County Clerk asked the County Board what policy the Sales ,Committee should follow in reference to sale of county lands located in known mineral areas of the county.- Motion was made by H.J. S. Hanson and seconded by Buck that the Sales Committee withhold from sale, lands where there are apparent mineral deposits. Motion carried. The following Resolution was read: , RESOLUTION WHEREAS, bids have been received for the sale of the Bayfield County Garage Building at 409 West Bayfield Street and Lots 11 to 20 inclusive of Block 27, all in the Original Townsite, City of Washburn, as follows: 1. Washburn Foundry Company, Inc. - Woo.00 NOW THEREFORE, BE IT RESOLVED by this Bayfield County Board of Supervisors, assembled in regular session this 16th day of April, 1957, that the bid of Washburn Foundry Company, Inc. in the amount of $5600.00 be accepted. BE IT FURTHER RESOLVED that the County -Clerk of Bayfield County be and he is hereby directed to issue the County's quit '.claim deed to,the above property.upon payment in full within thirty (30) days from the date hereof, and BE IT FURTHER RESOLVED that the sum received be credited to the Land and Building accounts of the County Highway Machinery Fund. April 1.5 , 1957 In accordance with Section 46.17 (3) of the Wisconsin Statutes, the Bayfield County Jail was inspected on April 11, 1957, and the following conditions were found. The jail was excellent in appearance, cleanliness, and sanitation. Bunks are made-up with mattress, blanket, pillow, and pillow case. In the first floor cell block, which contains four cells, the toilet and lavatory are located in the center area dayroom; and when more than one prisoner is confined, cell doors must be left open so prisoner can use the plumbing facilities. It was noticed in the storage room on the second floor that Pillows, blankets, and white linens are laid out on a table. This manner of storing linens and bedding does not appear adequate. It is therefore recommended that a closed cabinet provided with shelves for the storage of these items be provided. I wish..to convey my thanks to you, Sheriff Utpadel, and tothose people with -whom I came in contact for the courtesy and consideration at the time of this inspection. The following Ordinance was read: AN ORDINANCE PROVIDING FOR A CIVIL DEFENSE ORGANIZATION AND FOR PROTECTION AND PROMOTION OF PUBLIC SAFETY, HEALTH, AND WELFARE IN THE COUNTY OF BAYFIE LD DURING CIVIL DEFENSE EMERGENCIES The County Board of Supervisors of the County of Bayfield Do Ordain As Follows: SECTION 1. POLICY AND PURPOSE. (a) "Civil Defense" shall mean the preparation for and the carrying out of all emergency functions, other than functions for which the military forces are primarily responsible, to minimize and repair injury and damage resulting from disaster caused by enemy attack, sabotage, or other hostile action, or by fire,flood or other natural causes. (b) By reason of the increasing possibility of disasters of unprecedented si: and destructiveness, and to insure that preparations will be adequate to cope with such disasters; and to provide for the common defense, to protect the public peace, health, safety, and general welfare, and to preserve the lives and property of the people, it is hereby declared necessary: (1) To establish a local civil defense organization, (2) To provide for the exercise of necessary powers during civil defense emergencies; and (3) To provide for the rendering of cooperation and mutual aid between this county and other political subdivisions. (c) It is further declared to be the purpose of this ordinance and the polio of the county that all civil defense functions of this county be -coordinated to the maximum extent practicable with existing -services and facilities of this county and with comparable functions of the federal_, state and county government and other political subdivisions, and of various private agencies to the end that the most effective preparation and use may be made of manpower, resources, and facilities for dealing with any disaster that may occur. SECTION 2. CIVIL DEFENSE COY]MISSION. (a) How Constituted. There is hereby created a civil defense commission composed of the Chai man, County Board of Supervisors and as many additional members as may be determined by the County Board of Supervisors by resolution who shall be appointed by the Chairman of the County Board of Supervisors, subject to the confirmation of the County Board of Supervisors, and who shall serve without compensation. The Chairman of the County Board of Supervisors shall serve,as chairman of the commission and the civil defense director shall serve as secretary of the commission. (b) Duties of Defense Commission. The civil defense commission shall be an advisory and planning group and shall advise the Chairman of the County Board of Supervisors,coordinator and the County Board of Supervisors on all matters pertaining to civil defense. The civil defense commission shall meet upon the call of the chairman. SECTION 3. CIVIL DEFENSE COORDINATOR. (a) Appointment. The office of coordinator of civil defense is hereby created. The coor nator shall be appointed by the Chairman of the County Board of Supervisors subject to confirmation by the County Board of Supervisors and shall receive such salary as may be authorized by the County Board of Supervisors. He shall take and file an official oath. Deputy and assistance coordinators may be appointed by the coordinator subject to the approval of the civil defense commission, as may be deemed necessary, and such appointees shall receive such compensation as may be determined by the County Board of Supervisors. (b) Duties and Authority of Coordinator.- (1) The coordinator shall be the executive head of the civil defense organization and shall have direct responsibility for the organization, administration and operation of the civil defense organization subject to the direction and control of the Chairman of the County Board of Supervisors and County Board of -Supervisors. He shall coordinate all activities for civil defense within the county, and shall main- tain liaison and cooperate with civil defense agencies amid organizations of other . political subdivisions and of the state and federal government, and shall participate in county and state civil defense activities upon request, and shall have such addi tional authority, duties and responsibilities as are authorized by this ordinance,and as may from time to time be required by the County Board of Supervisors. (2) The coordinator shall prepare a comprehensive general plan for,the civil defense of the county and shall present such plan to/, the County Board of'Super- visors for its approval. When the County Board of Supervisors has approved the plan by resolution, it shall be the duty.of all municipal agencies and all civil defense forces of the county to perform the duties and functions assigned by the plan as approved. The plan may be modified in like manner. ;e -- --- -- April 17,___ 1957 - ---- -- -- - -- — --- SECTION 4.;.- UTILIZAT`ION OF -EXISTING SERVICES AND FACILITIES. In preparing and executing the civil defense plan, the coordinator shall utilize the services, equipment, supplies and facilities of.the eexisting departments and agencies of the county to the maximum extent practicable; and the officers and personnel of all such departments and agencies are directed'to cooperate with and ex- tend such services and facilities to the .coordinator,. SECTION 5. EMERGENCY REGULATIONS.. Whenever necessary to meet a civil defense emergency for which adequate regulations have not been adopted by.the County Board of Supervisors., the Chairman of the County Board of Supervisors and in his absence, the coordinator of civil defense, may.by proclamation promulgate and,e nforce such orders, rules and regulations re- lating to the conduct of -persons and the use of property as shall be necessary -to protect the public peace, health and safety, and.preserve lives and property and to insure the cooperation necessary in civil defense activities. Such proclamations shall be posted in three public places and may be rescinded by the .County Board of Supervisors by resolution at any time. SECTION 6. MUTUAL AID AGREEMENTS. The coordinator of civil defense may, subject to the approval of the County Board of Supervisors, enter into mutual aid agreements with other political subdivision! Copies.of such agreements shall be filed with the state director of civil defense. SECTION 7. DECLARATION OF EMERGENCIES. Upon the declaration by the governor, by the Chairman of the County Board of Supervisors or the civil defense coordinator in -the absence of the Chairman of the County Board of Supervisors, or by the County Board of Supervisors of"a state of emergency,.the coordinator of civil defense shall„ issue all necessary proclamations as to the existence of such state of emergency and shall issue such disaster warnings or alerts as shall'be required in the civil defense plan. The civil defense organization.shall take action in accordance with the civil defense plan only after the declaration of an emergency and the issuance of official disaster warnings; Such state of emergency shall continue until terminated by the issuing authority, provided that any such declaration not issued by°'the governor may be terminated at the discretion of the County Board of Supervisors. SECTION 8. PENALTIES. It shall be unlawful for any person wilfully.to obstruct, hinder or -delay member of the civil defense organization in the enforcement of any order, rule, regulation, or plan issued pursuant to this ordinance, or to do any act forbidden by any order, rule, regulatian or plan issued pursuant to the authority contained in this ordinance. For a violation of any of the provisions of this ordinance he shall forfeit not less than $100 nor more than $500. and in default of payment thereof, shall be imprisoned in the county.jail for a period not exceeding 90 days. SECTION 9. This ordinance shall take effect and be in force from and after its passage and(publication) (posting). Joe Lupa W. A.
