ANNUAL MEETING OF THE COUNTY BOARD November 12, 1958 Meeting called to order at 10:00 A. M. by Chairman Clarence L. Olsen. The following members answered.roll call: Boroo, Barningham, Burlager, Buck, Kliszcz, Beeksma, Bernard E. Johnson, Heg- lund, Rostollan, Hoefling, Stuart, Erickson, Berweger, Herman Hanson, J.-O. Spears, Trustee of Pure Air Sanatorium from -Bayfield.County-''gave a detailed and informative report on the Sanatorium program as it affects health sit- uation in the County and also a detailed report on the operation of the Sanatorium as a whole. The following Resolution was read: WHEREAS, the itemized expense budgeTfor the 1958 Fair premiums was $4,800.00 and the premiums to be paid in 1958 amount to O,882.30; and WHEREAS, The budget was set up for a three day, rather than a four day affair; and WHEREAS, The 'total' expenses will exceed the budgeT by an estimated $2,070.72; now there -fore, BE IT RESOLVED, That the County Clerk and County Treasurer be authorized to issue checks in payment of the premiums and.unpaid bills for the operation of the 1958 Bayfield County Fair. The following Resolution was read: WHEREAS, the material for the repair of the City dock at Bayfield has been purchased and is on hand, and WHEREAS, the repair to the dock will not be completed until after Jan. 1, 1959 Now Be It RESOLVED, that. the remainder of the $3000.00 appropriated by Bayfield County be carried over into 1959 when said repairs will be completed. The following Report was read: To The Bayfield County Board of Supervisors: Your Committee on Public Welfare has acted in two capacities this past year. First, as the Welfare Board, and second, as members of the special building committee for the nursing home. As the Welfare Committee, we have endeavored to keep in close touch with the operation of the Welfare Department. The operation of the Welfare Department is very complicated and the Committee, has been able to keep up with the changes in the laws, both state and federal, and with department rulings that affect the policies and pro- cedures of the department. Your Committee feels that the Director has kept it Informed of the changes in the laws, rules, and other matters affe'eting the department and that we have had opportunity to formulate policies and procedures for the department. Your Committee has gone over the expenditures for the department for 1958 and the Director's request for funds for 19599 and we have approved the estimate of expenditures as submitted. The nursing home rates presently used in the county were set at a meeting of the Committee and the various nursing home operators. The Committee has met several times with Clarence L. Olsen and George Malinoski and is the committee on the building of the nursing home, and some of these a November 12,_ 1958 meetings have included the architect, Hilman Esten son. We feel that we have helped in many decisions regarding the construction of the nursing home. The Committee appreciates the responsibility it has as the Welfare -Board and assures the Board of Supervisors that. they .will continue to keep in close touch with matters affecting the operation of the Bayfield County Department of Public Welfare. The following Resolution was read: WHEREAS, Bayfield County is constructing a building to, be used as a nursing home, WHEREAS, no official title has been given to this building, therefore, BE IT RESOLVED by the Bayfield County Board of Supervisors in.annual session this 12th day of November, 1958, that the official name of this home be the Bayfield County Rest Home. Motion Carried. and The following Resolution was read: WHEREAS, Bayfield County is constructing a building to be used as a nursing home, WHEREAS, it is necessary that the Board designate under which statute the home be constructed, therefore, BE IT RESOLVED by the Bayfield County Board of Supervisors in annual session this 12th day of November, 1958, that the Bayfield County Rest Home be constructed under Section 49.14 of the Wisconsin Statutes. The following communication was read: To the Finance Committee Bayfield County Board Washburn, Wisconsin Gentlemen: I herewith submit my application to audit the Bayfield County records and books of account for the year ending December 31, 1958, for the same base price of Two Thousand Two Hundred Dollars (2,200.00). In addition thereto, a sum of Seventy Five Dollars ($75.00) is asked for separate services in preparing the annual state report. This will include, as in prior years, an audit of the records of the general county, register of deeds, clerk of circuit court, county court, municipal court, and the highway department. Also included in the base amount is One Hundred Thirty Five Dollars 0135.00) for an audit of the 1958 County Fair records, the same as previous years. Respectfully submitted, W. E. The following communication and petition was read: Mr. Tranmal: Enclosed is the letter I was going to write the County Board. It is in the form which we arranged except that I realized after I left your office that I could not say that Mattie Trockstad was the only known nearest living relative who might have an interest in this property inasmuch as there are a number of grandchildren of H. P. Trockstad still living - so'me in Canada, some in Florida, one in Minneapolis, one in Jamestown, No. Dak., my sister in Ashland and myself. A year ago we talked this over and at that time something was said that possibly it would be necessary for an attorney to draw up a paper to be sent to each one of the grandchildren getting their consent that the property go to me. I might state that.at the time of Axel's death not one of the grandchildren offered to pay. anything toward his funeral expenses, which were paid by me. Lot 2 W. of R.R.R.O.W. as described in Vol. 64 P. 220 - Sec. 21-49-4 This property was occupied by Axel P. Trockstad, deceased, who was'my Uncle. The title to the property is in the name of H. P. Trockstad, the father of Axel. Axel's brother William paid the taxes on this property for many years and after his death his wife, Mattie Trockstad, continued to pay the taxes.until Axel's death. Mattie Trock- stad resides in Burbank, California. I have a letter from her dated Dec. 11, 19519 prior to Axel's death, stating that she was willing to sign her interest, if any, to me. The property does not have enough value to warrant going through Probate Court in order to get a certificate of descent. I hope the County Board will give my application favorable consideration. The following communication was read: UNITED STATES DEPARTMENT OF THE INTERIOR Bureau of Indian Affairs Great Lakes Agency Ashland, Wisconsin County Clerk November 4, 1958 Bayfield County Washburn, Wisconsin Dear Sir: A recent check of the county records indicates the NW/ NWj4 sec. 25, T. 51 N., R. 4 W., was taxed in 1923 and 1924. This is a part of the restricted Indian allotment of John Bete Gauslin (Goslin) or A ma da ga mi, and to date no instrument has been issued or approved by the Bureau of IndianAffairs which would terminate the restrictions covering this-40-acre tract. Swartz, Senior Accountant 2� November 1291958 Mr. Ludwig Tranmal September 4, 1958 Bayfield County Clerk Washburn, Wisconsin SUBJECT: Federal -Aid Secondary Highway Funds Federal -Aid Highway Act of 1958 Dear Sir: Under the Federal -Aid Highway Act of 1958 federal -aid secondary highway funds will be available to Wisconsin in the respective amounts of approximately $ 6,572,800 and $ 6,755,400 for the fiscal years 1959-60 and 1960-61. On May 29 1958, the State Highway Commission met with the officers and advisory board members of the County Highway Commissioners and Committee Members Associations. At that meeting a recommendation was made, in which the State Highway Commission has concurred, adopting a plan for the distribution and administration of the federal -aid secondary funds becoming available to Wisconsin under the Federal -Aid Highway Act of 1958 which is substantially the same as the plan which was adopted two years ago for the distribution and administration of the federal -aid secondary funds available under the Federal -Aid Highway Act of 19569 except that the total for the two years to be ten- tatively apportioned among the counties is increased from $12,000,000 to $12,500,000. The plan is outlined in the accompanying statement. The 1958 Act federal -aid secondary funds apportioned for your county for the two fiscal years 1959-60 and 1960-61 are as follows: County Total 2-,year Apportionment Bayfield $1869000 These funds may be matched by your county and used on qualifying improvements requested by your county on county trunks or local roads or streets located on the Federal -Aid Secondary Highway System. On December 319 1960, any,portion of this 2-year apportionment which has not been matched by your county and used on projects which have been advanced to the contract stage, or have not been transferred to a state trunk highway or state park road im- provement -with the approval of the State Highway Commission, will revert, to be used at the descretion of the Commission in any.part.of the state, as provided in the attached plan. In planning the utilization of the federal -aid secondary funds on County trunks or local roads and streets, due consideration should be given'to qualifying improve- ments on the Federal -Aid Secondary System in cities and villages under 5,000 popula- tion and to qualifying and desirable extensions of rural improvements into such mun- icipalities. It need -not be construed that -the 2-year apportionment of.Federal-aid secondary funds must. be spread over a 2-year period. Within certain limits, which can be deter- mined only after the total program of all counties is known, up to a total of a county's 2-year apportionment may be used in one year. Requests for the programming of projects using 1958 Act funds, hereby apportion- ed, may be filed at once. 23 November 12, 1958 Several.counties presently have balances remaining of the federal -aid secondary funds apportioned to them from the 1956 Act. Under the plan adopted two years ago, and as stated in the Commission's letter to County Clerks (with copies to County Highway Commissioners) dated October 5, 1956, the 1956 Act funds apportioned are available to a county to be placed under contract by December 31, 1958. Any such 1956 Act funds may be combined and used on a project with part of the 1958 Act funds, provided the projects are placed under contract by December 31, 1958. The Commission's District Engineer and the District Engineer of Secondary Roads will discuss with your County Highway Committee your potential federal -aid secondary program, and your county, through your County Highway Committee, is requested to work with them in developing a proposed program of improvements on the Federal -Aid Secondary System to utilize the funds apportioned to your county. For projects on County trunks or local roads or streets, the program requests by. your County Highway Committee should be submitted through the District Engineer's office. Such program requests will be subject to review by the Commission. In case it is desired that part or all of the federal -aid secondary funds be used on certain improvements on the State Trunk Highway System or on state park road S� n your county, where matching funds appear to be available, such request by your 1(County Highway Committee should be filed with the District Engineer, who will forward such requests, with his recommendation, for theconsideration of the Commission. As set forth in the statement accompanying our letter of October 5, 1956, from the unused balances to be reverted from counties' apportionments of 1956 Act funds on December 31, 1958, the Commission will accept requests for tentative allotments, to be matched with county funds, for additional qualifying and meritorious improvements. on county trunks or local roads or streets, by counties which have evidenced their capacity to plan for and to match and use -more than their normal apportionments of federal -aid secondary funds. The method of apportionment among the counties of the $12,500,000 for the two,years will be: 60% on the basis of total highway mileage as of January 1, 1958, exclusive of the Federal -Aid Primary System and exclusive of other mileage in "urban areas" establish- ed pursuant to the federal -aid highway acts (places of over 5,000 population); and 40% on the basis of the total number of motor vehicles registered in the fiscal year ending June 30, 1958. The FAS funds thus apportioned to'a county may, within the time limitation herein- after provided, be matched by the county and used on qualifying improvements requested by the county on county trunks and local roads and streets on the Federal -Aid Secondary System, in accordance with the requirements of the federal -aid highway acts and amend- ments thereof and regulations pursuant thereto and of the established requirements and procedures of the State Highway Commission.' Upon the request of a county highway committee submitted for the consideration of the State Highway Commission, and if matching funds are available, and if approved by the Commission, a portion or all of the FAS funds thus apportioned for such county may be transferred to and ,used for the improvement of a portion of the State Trunk Highway System or a state park or forest road located on the Federal -Aid Secondary System within such county. Where more than 50 percent of the total area of a county consists of "urban.areas", leaving limited potential for the effective use of federal -aid secondary funds, upon request by such county and approval by the Commission, and subject to the requirements of Section 102 (c) of the Federal -Aid Highway Act of 1956, all or part of the'apportion- ment of federal -aid secondary funds for such county may be transferred for use on November 1'29 1958. federal -aid urban extensions or the Federal -Aid Primary Highway.System. On December 31, 1960, any FAS funds under the 1958 Act apportioned to a county but which have not been matched by the county and used.on projects which have been advanced to the contract stage, or have not been transferred to a state trunk highway or state part or forest road improvement with the approval of the Commission, shall revert from such county, to be used or allotted, by and at the di,scretio tsf the State Highway Commission, for other improvements in any part ofthestate. From the funds thus reverted, the State Highway Commission will accept requests for tentative allotments, to be matched with county funds, for additional qualifying and meritorious improvements on county trunks or local roads or streets, by counties which have evidenced their capacity to plan for and to match and use more than their normal apportionments of FAS funds. On June 30, 1961, any such additional 1958 Act FAS funds so allotted to a county, but which have not been matched by the county and used on a project which has been ad- vanced to the contract stage, shall revert from such county to. be used by the State Highway Commission for state trunk highway improvements in any part of the State. FAS funds will be deemed to have been "used on a project which has been advanced to the contract stage" when binds have been received and the county matching funds have been deposited with the state; or in case the work is to be performed by day labor, when an acceptable day labor contract has been signed by the county and delivered ,to the state; or for a project involving only preliminary engineering and/or the ac- quisition of rights of way when all acts required of the county prior to placing the project under agreement with the U. S. Bureau of Public Roads have been performed. When more than one contract is involved in a single FAS project, the determination shall be based on the last.eontract. In the spring of 1960, at the discretion of the Commission and to the extent the total Wisconsin balance of FAS funds permits, a project requested by a county and using more than the county's apportionment of FAS funds under the 1958 Act may be programmed and advanced to the contract stage by anticipating and using not more than an estimated one-year apportionment to such county (based on the 1958 Act apportionment) under a proposed 1960 Federal -Aid Act pending in Congress..Should such anticipated funds not become available, the Commission will make such adjustment in unencumbered unapportion- ed or apportioned FAS funds as necessary to finance the encumbered FAS funds. WHEREAS, there has been evidenced the existence of an unmistakable interest in such a regional planning commission, some of the instances of such interest being as follows: The Governor's Minerals Resource Conference at Ashland on February 12, 1958.
