BAYFIELD COUNTY BOARD OF SUPERVISORS
November 10, 1959
Meeting called to order at 10:00 A.M. by Clarence L. Olsen, Chairman.
The following members answered roll call: Mammoser; Barningham, Howell,
Pristash, Cliszcz, Beeksma, Smart, Bernard E. Johnson, Heglund, Chambers,.Hoefling,

The Board proceeded with the election of a Highway Committee. Moved by
Barningham and duly seconded to nominate Paul Tribovich as a member of the
Highway Committee of District #1. Motion was made and duly seconded to close the
nomination. Motion was made and seconded that the Clerk cast a unanimous ballot
for Mr. Tribovich. Motion Carried.
The Clerk cast the ballot as directed and the chair declared Mr. Tribovich
duly elected.
The results of election for a member from Highway District #2 was as follows:
Moved by Mammoser and duly seconded to nominate Ernest Moore. Moved by Stuart
and seconded'by Pristash to close -the nomination. Motion Carried. Motion was
made and duly seconded that -the County Clerk cast a unanimous ballot for Ernest
Moore. Motion Carried. The Clerk cast the.ballot as directed and the chair de-
clared him duly elected.
The results of election for a member to Highway Committee for District #3
was as follows: Motion was made and duly seconded to nominate Frank Hoefling.
Motion was made and duly seconded to nominate Evald Johnson.
The Board proceeded with election by ballot.
The chair appointed Glenn 0. Holman and Edward Smart as ballot clerks.
The result of the first ballot was as follows:

The following is a consolidated report of'this Commission for the year from
October 15, 1958 to October 15, 1959.. The books of the Commission are open to any
one who may wish to examine any of the accounts listed therein.
On October 157 1958 the books of this Commission shows a balance of $700.41.
The appropriation of the County Board made January 11 1959 added $800.00 to this
balance, making a total of $1500.41.
From October 15, 1958 to October 159 1959, a total of 11 applications were receiv-
ed from indigent war veterans or their immediate families. A total cost to the
county for the 11 cases which were allowed, was $478.429 including the total expens-
es of the Committee.

A request is herewith submitted for an appropriation of $500.00 to the County
Veterans' Service Commission fund for the -year 1960.
On hand October.159 1958 was a balance of $700.41. An appropriation of the County
Board, made January 11 1959, added $800.00 to this balance, making a total of $1,500.410
Disbursement and administrative,expenditures amounted to $478.42, reducing the balance

on hand, as of date, to $1,021.99.
The demand on this fund, the past year has been -normal and not being able to fore—
see the veterans' need for relief for this coming year I feel that we the balance at
approximately $1,500.00 as we have in the past.

The proposed amendment was read as follows:
PETITION FOR AMENDMENT OF ZONING ORDINANCE
To the County Board of Bayfield County:
The undersigned hereby petition the County Board to amend the zoning ordin-
ance of Bayfield County 'as follows:
(Strike out any part which does not apply and number paragraphs consecutively.)
1. Section I of said zoning ordinance should be amended to read as follows:
By inserting the following underlined words at the places indicated.
SECTION I
Districts and District Maps
For the purpose of promoting public health, safety and general welfare and
regulating, restricting and determining the areas within which agriculture, forestry
and recreation may be conducted and regulating and restricting areas along or in
natural water courses, channels, streams and creeks, and establishing districts
which are deemed best suited to carry out such purposes, outside of the limits of
incorporated villages and cities, and in accordancd with the provisions of Section
59.97 of the Wisconsin Statutes, the territory included in the boundaries of the
following towns, to -wit: Barksdale, Barnes, Bayfield, Bayview, Bell, Cable,Clover,
Delta, Drummond, Eileen, Hughes, Iron River, Kelly, Keystone, Lincoln, Mason,
Namekagon, Orienta, Oulu, Pilsen, Port Wing, Pratt, Russell, Tripp and Washburn are
hereby divided into four classes of use districts as follows to -wit:
1. Forestry District
2. Recreation District
3. Flood Plain District
4. Unrestricted District
2. Following Section III of the ordinance add a new section as follows:
SECTION III - B
District Number 3 - Flood Plain District
In the Flood Plain District no building or structure used for human habitation
shall be erected and no existing building shrill be moved unless the land upon which
said building or structure is to be erected and ten feet beyond the limits of said
building or structure shall prior to the time of construction be raised to such a
level that the main floor of said building or structure shall not be less than seven
feet above the high water level of Chequamegon Bay. No basement or other floor shall
be constructed below or at a lower elevation than the main floor.
Provided further, that septic tanks, dry wells and disposal fields shall be
constructed in such a way that the outlet of the septic tank shall be at a minimum
elevation of 61.0 feet. Explanatory (note the average elevation of the Chequamegon
Bay is 603 feet above sea level).
Minimum lot areas in the flood plain shall conform with Section H 65.03 (1)
and (2) H65.05 and H65.06 (4) of Chapter H 659 Wisconsin Administrative Code.
(Explanatory Note) (Copies of drawing 8 M 1031 may be seen in the offices of
County Clerk, Register of Deeds and Town Board -of the Town of Barksdale).
Such elevations as are provided for above shall be determined on the basis of
benchmarks which are established in accordance with drawing 8 M 1031 of the Wisconsin
Conservation Department.

3. Said zoning ordinance should be amended to change the boundaries of use
districts as follows:
That the boundaries of District No. 3, the Flood Plain District in the Town of
Barksdale be in accordance with drawing 8 M 1031 by the Wisconsin Conservation
Department a copy of which is on file in the Offices of the County Clerk and County
Register of Deeds.
4. That the following definition of a flood plain be added. to Section XII
Definitions of the Ordinances:
Flood Plain - An area of land bordering the present or former course of a'river
or a stream and built of silt another materials deposited at times of flood.

Gentlemen:
My husband Clarence Oscar Henkel was the owner. of the SW/ of NEI,4, Section 13
Township 47 North, Range 9 West. At the time he died on January 3, 1950 the propertyr.—
was in his name only. There are no mortgages against the property and I paid the
taxes from the date of his death up to and including the tax of 1954.
This property is not of enough value to w arrant -a cost of probate proceedings
for the purpose of getting title by Certificate of Descent.
I, THEREFORE, Petition your Honorable body for the right to purchase tax certi-
ficates as follows for the amount of tax plus interest;

July 30, 1959
I would like to petition the County Board for the right to buy the 1953 tax
on my late mothers property., NE NE & NW NE, Sec. 8-48-8. The other heirs are not
interested. She had planned to sell it to me but before the deal was made she had
a stroke and passed away.
I paid the taxes on it several years prior to my mothers death. I also re-
deemed the 1952 tax which amounted to over $100.

Attorneys Miss Elizabeth Hawkes and Mr. Walter T. Norlin appeared before the
County -Board representing Lewis J. Charles, Circuit Judge, and the North Wisconsin
Bar Association. They explained new legislation enacted a week ago and signed by -the
Governor. This Act discontinued the office of Divorce Counsel and created the office
of a Family County Court Commissioner. The Board's attention was called to the
fact that they should make due provision for compensation for such officer in the
present Budget for the year 1960.
Moved by Mammoser and seconded by Holman to refer the matter of compensation of
November,10, 1959
a Family Court Commissioner to the Personnel Committee for a study and report.
said report be made to the County Board in time for action when the Budget comes up
for final consideration.
Mr. Vic C. Wallin of Grandview appeared before the County Board and gave a talk
on water shed control, erosion and stream improvements. He made a plea for funds and
asked that if the Board granted an appropriation for this purpose that the County
representatives enlist the aid of all present agencies concerned as well as legislative

for stream improvements, water shed and erosion control.
Moved by Mammoser and seconded by Smart that the foregoing motion for funds be
amended to read: that the expenditure in control of said appropriation be under the
jurisdiction of the Conservation Committee. Amendment Carried.

WHEREAS the Washburn City School District is desirous of establishing a School
Forest, and
WHEREAS the Southeast quarter of the Southeast quarter of Section 30, Township
49 North, Range 4 West, located in the Town of Bayview is adaptable for such purpose,
WHEREAS said land is County -owned, Now, Therefore, Be It
RESOLVED by the Bayfield County Board of Supervisors assembled in annual session
this loth day of November, 1959, that said land be deeded to the Washburn City School
District, with the understanding that said land will be used by the School District foz
the establishment of a School.Forest.

Gentlemen:
The Lake Superior District Power Company has in operation a 33,000 volt trans—
mission line extending from the City of Washburn to the City of Bayfield. We are
finding it increasingly difficult 'to maintain service along the route of this line
without interruption because of the proximity of trees adjacent to it, which fall into
the , line and cause interruptions to service from time to time.
We propose to widen this right of way to a full width of 100 feet, i.e., 50 feet
each side of the centerline of the present transmission line. In order to do this it
will be necessary for us to obtain new easements to provide for this greater width of
right of way than is granted by easements we now hold along the route of this line.
For that reason we are at this time respectfully making application to Bayfield County
for an easement covering those portions of pur transmission line located upon Bayfield
County land. Two copies of a Resolution and a proposed form of easement are enclosed
herewith, together with a map on which is shown in yellow the lands owned by Bayfield
County upon which this transmission line is now located.
We are desirous of beginning this work as -soon as possible, and will appreciate
anything you may be able to do to facilitate the approval o,f this application.

R E S O L U T I O N
WHEREAS, Lake Superior District Power Company, a Wisconsin corporation, has
built and does maintain a 33,000 volt transmission line extending from the City of
Washburn to the City of Bayfield, and
WHEREAS, in order to more properly maintain the line and decrease the hazard of
trees falling into it, causing.interruptions of service'to the City of Bayfield and
points beyond, the Lake Superior District Power Company finds it necessary to acquire
additional easements along the route of the present transmission line to provide for a

greater width of right of way and a.greater margin of safety than that now provided
by easement-s held by the Lake Superior District Power Company, and
WHEREAS, Bayfield County has heretofore granted certain easements to.Lake Superior
District Power Company covering electric lines built and maintained through County
lands located elsewhere in Bayfield County and it is desirable that there be uniformity
in the terms and provisions of the easements granted to Lake Superior District Power
Company for the purpose of crossing County lands, and
WHEREAS, Lake Superior District Power Company has proposed that it will pay to Bayfield
County the sum of g$310.00 for an easement in substantially the language and effect as
the copy of the proposed Easement which is hereto annexed, across lands of Bayfield
County which are crossed by electric lines owned by Lake Superior District Power Com-
pany, and said Lake Superior District Power Company has. agreed that in addition to
paying said sum of $310.00 it will also pay to Bayfield County the stumpage value of
forest products which said Power Company may remove or cut along the route of said
lines in the course of its first brushing or clearing of lands to the width specified
in said proposed Easement, such additional payment to be computed in accordance with
the Bayfield County stumpage price schedules which are effective and applicable to the
sale of forest products on Bayfield County lands at the time of such cutting or re-
moval of forest products, and
WHEREAS, it appears proper that the County Board of Bayfield County, in the name,
of the County, grant an easement to Lake Superior District Power Company in substan-
tially the form of the proposed Easement of which a copy is attached to this Resolution
and made a part hereof,
NOW, THEREFORE, IT IS RESOLVED: That the County Clerk of Bayfield County be and he
is hereby authorized, on behalf of said Bayfield County, upon receipt by him for Bay__
field County of the sum of$310.00, to be paid by Lake Superior District Power Com-
pany, to execute and deliver to Lake Superior District Power Company an Easement
across the lands described in the attached copy of the proposed Easement, said
Easement to be in substantially.the same language and to the same effect as the copy
of the proposed Easement which is hereto annexed.
EASEMENT
IN CONSIDERATION of the sum of $310.00 and, in addition thereto, the Grantee
.will pay for any merchantable stumpage that is cut on the proposed right of way, the
value of which will be determined according to the Bayfield County Forestry Depart-
ment's price schedule, the undersigned, hereinafter referred to as.the Grantor, has
and does hereby grant and conveyr to the Lake Superior District Power Company, a Wis-

consin/Service Corporation duly autnui•lzed Tu Transac6 business in tine bTaTus of
Micnigan and Wisconsin, hereinafter referred to as the Grantee, the perpetual right
and easement to construct, maintain, inspect remove from, rebuild, replace, and op-
erate across the premises hereinafter described, a line or lines of wires for the
transmission and/or distribution of electric energy and for the private telephone
service of the Grantee, including all supports, poles and/or structures, wires, guys,
anchors, fixtures, appliances and other equipment which the Grantee shall deem nec-
essary, over, across, and upon said premises and'to carry electric energy thereon.
There is also granted to the Grantee the perpetual right from time to time and
by such means as The Grantee may determine to cut, trim, destroy and/or remove from
the portion of said lands lying within fifty feet (50') of the centerline of said
line or
lines any brush, trees, logs, stumps, branches, weeds or grass lying, standing or being
thereon, and to cut, trim, de-etroy and/or remove from adjacent lands of the undersign-
ed any trees or branches which by reason of their proximity may endanger or interfere

with the said line or lines or the above -described use,and operation thereof, and
to enter upon and/or cross over said premises from time to. time by men and machines
and to maintain a travelable way for the passage thereon of men and machines, in-
sofar as the Grantee shall deem necessary in the exercise and enjoyment of said rights.
The undersigned may make such use of the affected premises as shall not inter-
fere with the exercise of and enjoyment by the Grantee of the rights hereby granted
and conveyed to it provided, however, that the undersigned shall not place or permit
to be placed any structure, other than customary fencing, within the limits of the
strip of land described in the second paragraph of this instrument.
Wherever any pole or other structure of said line or lines may be so located as
to require relocation at any future time because of the widening or changing of the
route of any public highway, the Grantee shall have the right to relocate the same
on the land of the Grantor, provided that, as so relocated, any such pole or structure
shall be within ten (10) feet of the near boundary of such widened or changed highway.
The premises affected hereby are strips of land of the above -mentioned width,
the centerlines thereof in each instance being, the centerlines of the electric lines

RECOMMENDATION
TO THE BAYFIELD COUNTY BOARD OF SUPERVISORS:
Reference to the attached resolution and'letter from the Lake Superior District
Power Company concerning a right-of-way easement through County owned lands.
The Lake Superior District Power Company now has a power line running through the'
descriptions described in attached easement but they are desirous of widening their righ,
of -way to 100 feet.
Your Forestry Committee has considered their request and recommends that said.
easement be granted. In addition to the $310.00 which the Lake Superior District
Power Company agrees to pay that they also pay for all merchantable stumpage accord-
ing to the Bayfield County Forestry price schedule.

is the present boundary, proceeding west for one mile to the Northwest corner of Sectic

R E S O L U T I O N
WHEREAS, by action of the County Board the amount allowed for the burial of re-
cipients of Social Security Aids was set by the County Board at $150 plus actual
cemetery expense when the state law authorized reimbursement on such amount, and
WHEREAS, the state law has now been changed and the state will reimburse on
funerals for those recipients of Social Security Aids up to.$200 for the burial and
actual cemetery expenses up to $35, therefore,
BE IT RESOLVED by the Bayfield County Board of Supervisors in annual session this
llth day of November, 1959, that the Director of the Public Welfare Department is
authorized to approve the payment of $200 plus actual cemetery expenses up to $35 for
the burial of recipients of Social Security Aids when there is no other party to de-
fray the cost of such burial, this to be effective in all burials after November 1,1959,

I herewith submit my application to audit the Bayfield County records and
books of account for the year ending December 31, 1959 for the price of Two Thous-
and Four Hundred Dollars($2,400.00). This is the same base price as the previous
year with $200.00 additional for the County Nursing Home which will be in its first
year of operation.
In addition thereto, a sum of Seventy Five Dollars (875.00) is asked for separate
services in preparing the annual state report which is the same as last year.
This will include, as in prior years, an audit of the records of the general
county, Register of Deeds, Clerk of Circuit Court, County Court, Municipal Court,
Highway Department, and also the County Nursing Home. Included in the base amount
is One Hundred Thirty,Five Dollars ($135.00) for an audit of the 1959 county fair
records, the same as previous years.

WHEREAS, predatory animals have become very numerous since the State of Wisconsin
discontinued the bounty payments and as a result our game bird population and rabbits
have been greatly reduced in numbers and,
WHEREAS, the increase.in coyote population is getting to be quite a problem
among the sheep raisers in -the county,
THEREFORE BE IT HEREBY RESOLVED, by the Bayfield County Board of Supervisors in
annual session, go on record in favor of re-enactment of the bounty provision by the
state as they formerly existed.,
BE IT FURTHER RESOLVED, that a,copy of this letter be sent to Gaylord A. Nelson,
Governor, to Senator Carl E. Lauri, to Robert F. Barabe and to A. J. Thelen, Secretary
of the County Boards Assn.

WHEREAS before there was any federal reimbursement for medical payments made in
behalf of recipients of Social Security Aids the State law read, "The County shall
be reimbursed 35 percent of the direct medical cost of the program, plus any federal
money available, and
WHEREAS as soon as federal money was made available for reimbursing Counties.
for direct medical payments made to recipients of the Social Security Aids the State
Legislature changed the law to read, "The County shall be reimbursed 35 percent, of
the cost of medical care after the federal money has been allocated." and

WHEREAS this change in the law caused Bayfield County to lose reimbursement for
the medical program in the amount of 1631.58 in the month of July 1959 alone and will
cost Bayfield County approximately.19578.96 for the year 1959
THEREFORE BE IT RESOLVED by the Bayfield County Board of Supervisors in annual
session this llth day of November 1959 that the State Legislature be requested to
change the law regarding the reimbursement to Counties for direct medical payments
to recipients of the Social Security Aids so that the Counties will receive 35
percent reimbursement on.such payments from.the State plus any federal monies made
available for such purpose and be it further'

Exploration of lands owned by Bayfield County,Wisconsin
Because of the excessive overburden encountered in certain areas in Bayfield
County, a refraction seismic survey was undertaken in hopes of defining areas of shall-
ow overburden within general areas where we plan to drill. Some seismic work was done
in Bayfield.. The survey was quite successful and will allow for more efficient re-
connaissance drilling.
An electric logger has been leased to aid in correlating the rocks from drill
hole to drill hole. Because of the similarity of the rocks encountered thus far, it
is impossible to correlate by geology alone.

We have received requests from several county clerks asking that we advise them
of the amount -that should be placed in the budget to cover Association dues for the
year 1960.
Listed below is the detail of the dues for the year 1960 so that you will have the
proper amount to place in your budget.
You will notice that in accordance with a resolution adopted at the convention at
Rhinelander on September 22nd that the magazine dues have been increased at the rate of
$1.00 per year per subscription.
The Association authorizes -the increase of magazine dues for the year 1960 in
order to cover the increased cost of publication of the magazine. This is the first
increase of magazine dues in the past 3 years.

Dear Mr. Tranmal:
Since 1955 I have been trying to get a road or trail to my property on Raspberry
Bay described as Lots 1 and 2. Section 1-51-4 and Lot 2, 36-52-4 and I have written you
about this matter and sent sketches showing proposed trail to service the property.
I have worked for almost forty years trying to develope Bayfield County by in-
teresting tourists and land buyers in the county but the County must also do some-
thing to encourage Ipeople to come there. It seems to me that I have received very
little benefit to my lands from the taxes I have paid in the last thirty-five to forty
years. When I asked for a trail to my land even that request was denied with the
excuse that the Town did not have the money to take care of it. The cost could be
placed on the tax roll.
I could develope the Raspberry Bay lands if I could get to.it. Enclosed find a
copy of a sketch I made in 1955, showing two plans for a trail running from the gravel
pit in the S'/z of SEy4, 1-51-4 in a northwesterly direction from th ire lane for a
distance of about three-quarters of a mile to my land. There is no heavy timber to

cut through, only small birch and poppel, without much value now and which won't have
much value in our lifetime. I am not a.sking for a road on the section line. I cannot
lay myself liable by trespassing on adjoining property and running a bulldozer through
it to make a trail to my land, and stand the chance of the owners claiming damages..
I would buy enough of the land to get a road in and make my property accessable.
According to an old map I have it shows Bayfield County as the owner of the West /2
of Section 1-51-4 and the N/2 of the Southeast / Section 2-52-4.
I am sending a copy of this letter to the County Treasurer and to Mr. Paul
Tribovich, Chairman of the Town of Russell, hoping the three of you can get together
and help me work out some kind of a plan to give me.access to my property. It would
benefit the whole location if I could develope the land on Raspberry Bay, but I can't
do anything unless I can get to it. My letters to Mr. Tribovich in 1955, 1956 and
1957 describe how I believe this can be worked out. This is the time of the year to
do this work. Let me hear from you as soon as possible.

policy and have all county offices closed on the legal holidays enumerated in Sec.
256.17 of the Statutes

Election Day in Bayfield County and that all county offices be closed on such days.

both counties to provide a direct connection for thru traffic between the towns of
Oulu in Bayfield County and Brule in Douglas County,
NOW THEREFORE, BE IT RESOLVED, that the following described public highway be and
is hereby added to and made a part of the County trunk highway system of Bayfield and
Douglas Counties, effective January 1, 1960, subject to the approval of the State
Highway Commission as provided by Section 83.025 (1) of the Wisconsin Statutes:
Beginning on County Trunk Highway "B" in Bayfield County at or near the section
corner common to Sections 17, 18, 19 and 20 of Township 48 North of Range 9 West;
thence westerly approximately two (2) miles to County.Trunk Highway "F" in Douglas

Bayfield County Trunk Highway System as a joint County Line Highway with Douglas
