BOARD
Meeting called to order at 10:00 A.M. by Edward A. Pajala, Chairman.
The following members answered roll call. -

the special meeting of the Bayfield County Board on June 20, 1963.
Mr. Hoefling has designated Tom Costello of Iron River to serve in his place
at this meeting.
I hereby certify that Mr. Tom Costello is duly authorized to serve in place of_
Frank Hoefling on the Bayfield Co. Board of Supervisors at their special meeting

ing :
1. Adoption of a resolution appropriating $159,200.00 to match Federal Aid for
Court House addition and alterations of present structure plus $5,000.00 for estimat-
ed cost of furnishings and movable equipment, and to take such other and further
action as may be necessary to authorize the proper committees of said Board of Super-
visors and the proper officers of said Bayfield County to do such acts as may be nec-
essary to complete negotiations for the Federal grant applied for and to grant said
committees and said officers such authority as maybe necessary to proceed with the
construction of said Court House addition and alterations of the present structure.
2. To consider amending or additions to County Zoning Ordinance.
3. To take such action as the Board may deem appropriate in reference to pro-
posed legislative changes in the forest crop law as may be considered necessary for
the best interests'of Bayfield County.
4. To consider and act on any other business that may legally come before said
meeting.

flown over our Nation's Capitol.
I want you to present this historic flag to the County Officials with my best
wishes.. It is a privilege for me to make this flag available to you, Tom, and if I
can be of any further help to you, please let me know.
The delay in obtaining this flag was due to the fact that.there are so many re-
quests for flags which have been flown over the Capitol that it takes some time to
fill them.

Clerk send a letter to Assemblymen Paul Alfonsi, Robert., � F. Barabe and to State Senator
Frank W. Christofferson at Madison, Wisconsin asking that they support Bill #558A
which provides for a co-ordinator for water resource.. program in Wisconsin.

Moved by Sampson and seconded by Meyer that the County Clerk write a letter to
the Conservation Commission advising of their disappointment of the continued closing
of the Big Rock on the Sioux River during the regular fishing season, the park being
created primarily because of the fishing hole. Motion Carried.

THE HONORABLE BOARD OF SUPERVISORS
BAYFIELD COUNTY, WISCONSIN
Gentlemen:
We the undersigned newspapers of Bayfield County respectfully request that the
County Board consider granting us an increase,in the rates for publishing proceedings
of the County Board and the printing.of supplements.
It has been quite a number of.years since the present rates wereestablished and
as you all are aware, costs of practically everything have risen considerably® Our
labor costs, paper costs, ink costs, etc. are no exception to the trend.
The present rates for publishing proceedings are as follows:
$1.15 per folio (100 words) for proceedings.
.35 per folio for printing supplements.
$25.00 for distributing supplements (This figure is what the other two papers,
receive for folding, inserting and mailing the supplements.)
We respectfully request that.the County Board grant us an increase of 20% which
would make the new rate as follows:
01.30 per folio for proceedings
.50 per folio for printing supplements
$30.00 for distributing supplements.
At the regular organization meeting held in April, the Board failed to designate
the official paper for this year. Under the rotation system, the Iron River Pioneer
should be designated as the official paper for the current year.
We hereby respectfully ask that if the raise be granted that it be made retroactive
so as to cover the printing of the supplements for the spring organization meeting.

BE IT HEREBY RESOLVED, That the rates for the publication of official county board
minutes and publication of legal notices be set as follows for the ensuing year:
$1.15 per folio for the first publication
.35 per folio for printing supplements of County Board Proceedings, and
25.00 for the distribution of the supplements by other than the official paper.
RESOLVED, That the official paper send a copy of the County Board minutes to.each
County Board Member and to the Clerk of each town, city and village.

The following Resolution was read:
WHEREAS, Bayfield County has acquired tax title to Lots 1 to 3 Inclusive, Block
79 City of.Bayfield, and
WHEREAS said property is.occupied and the occupants are not paying any rent, and
further that the buildings are dilapidated and very unsightly and a fire hazard,
THEREFORE BE IT HEREBY RESOLVED, that.the District Attorney be directed to
vacate the afore said premises and that, the Sales Committee dispose of the build-
ings in a co-operative action with the City Council of 8ayfield.

The following Resolution was read:
WHEREAS Bayfield County has acquired by tax deed the Northeast quarter (NEy4) of
the Southeast quarter (SE'/), & Southeast quarter of Northeast quarter (SE34 NEqu), of
Section 7, Township 47 North,'Range 9 West (Town of Hughes), and
WHEREAS it borders on a small lake which does not have any game fish and it is
too small to be suitable for a public landing, therefore
BE IT HEREBY.RESOLVED.that the Sales Committee be authorized to sell this parcel
without a reservation for a public landing,.

Resoluti'dii providing for increase in planned total expenditure for capital
improvement projects.
Whereas, under the terms of Public Law 87-658, approved September 14, 1962, the
United States of America has authorized the making of grants to aid in financing
construction of specific public works projects, provided the proposed or planned
total expenditure of the public body for its capital improvement projects is increas-
ed by an amount approximately equal to the non -Federal funds required to complete
such public works projects:
Now, Therefore, Be It Resolved By The Board of Supervisors of Bayfield County
1. That as of the date of filing of an application by Bayfield County (here-
after called Applicant) with the Housing and Home Finance Agency, United States
Government, for a grant to aid in financing the construction of (brief project
description)
The applicant had a capital improvements (plan) program or capital (improvement)
expenditures budget for the fiscal year or years during which construction of the,
proposed project is expected to occur; and that the total expenditures for capital
i
improvements in said plan or budget was:

for the fiscal year ending Dec. 1963
for the fiscal year ending Dec. 1964
That, in the event that said Federal grant is approved by the United States of
America,, said capital improvements.plan or capital budget will be (is hereby) increas-
$164,200.00 for the fiscal year ending Dec. 1963 and

for a total increase of $164,200.00 in the proposed or
planned total expenditure for capital improvement projects (exclusive of Federal funds).

WHEREAS, It'is required, under the aforesaid application and proposed Court House
construction project, to provide matching funds;by said Bayfield County to equal funds
expected to be.provided under the aforesaid.Federal program and to provide certain
additional funds to be used in the construction of said building, which will not be
matched under said Federal program, and
WHEREAS, It is deemed advisable by the aforesaid Board of Supervisors to provide
the aforesaid matching funds in the total amount.of $1599200.00 and to provide an -
additional $59000,00 of non -matching funds representing the estimated cost of furnishing
and moveable equipment.
AND WHEREAS, There are now sufficient funds on hand in the Treasury of Bayfield
County to provide the aforesaid matching funds without jeopardizing the financial op-
eration of Bayfield County,
NOW, THEREFORE, BE IT RESOLVED, By the Board of Supervisors of Bayfield County,
Wisconsin,, -duly meeting in special session this 204 day of June, 1963, that in the
event the aforesaid Federal grant is approved by the United States of America, there
is established a capital improvement budget in the amount of $164,200.00 for the
capital improvements, as aforesaid, and said entire amount to represent said added
capital improvement -budget for the fiscal year ending December 31, 1963, and said funds.
to represent the planned total expenditure for capital improvement projects during said
period, exclusive'of Federal funds, it being understood that said proposed additional
budget and expenditure for capital improvement, as aforesaid, is approximately equal
to the non -Federal funds required to complete the public works project for which the
aforesaid application was submitted.
BE IT FURTHER RESOLVED, That -the Finance and Building Committee of this Board of
Supervisors and the proper officers of said Bayfield County`be and they are hereby
authorized to take such action and do such acts as may be necessary to carry out the
intent of this Resolution and all such prior Resolutions as may have been passed by
this Board relating to the aforesaid project and to comply with the requirements of the
Federal regulations in reference to said project, as set forth in Federal publication
CPA-1102 (1-63)9 and that the aforesaid power to act hereby granted to said Building
and Finance committee. and the proper officers of said Bayfield County be binding herein
as though done by.direction and Resolution of this Board of Supervisors.
BE IT FURTHER RESOLVED, That the County Treasurer of Bayfield County, Wisconsin,
be and he is hereby.authorized and directed to segregate County funds.in the amount of
$164,200.00 and to deposit said funds in said amount in an authorized depository, as
"Construction Account, Bayfield, APW-Wis-64 G".
This Resolution is adopted pursuant to the authority provided by Chapter 59 of the
Wisconsin Statutes and the aforesaid budget is amended pursuant to the provisions of
Chapter 65 of the Wisconsin Statutes.

having held public hearings thereon pursuant to Section 59.97 (3), Wisconsin Statutes,
notice thereof having been given as provided by law, and being duly informed of the
facts pertinent to the changes proposed and duly advised of the wishes of the -'people

having been met, the amendatory ordinance to the zoning ordinance, passed by the County
Board on.the 17q' day of April, 1963, a copy of which is attached hereto, went into full
force and effect on the 5Lh day of June, 1963.

ORDINANCE
WHEREAS, a petition was duly filed with the Clerk of Bayfield County, Wisconsin,
for amendment of the Bayfield County Zoning Ordinance, pursuant'to_the provisions of
Section 59.97 of the Wisconsin Statutes, and
WHEREAS, all the provisions of the last said Statute have been complied with as
appears by'the records of the County Clerk of said Bayfield County,
NOW, THEREFORE,`the County Board of Supervisors of the County of Bayfield do
ordain as follows:
That the Zoning Ordinance of Bayfield County, Wisconsin, adopted on the 10 day
of November, 19.349 as modified thereafter, be and the same is hereby amended so that,
as amended, the South One-half of Southwest Quartet .(Sh of SWya), of Section Thirty-
five (35), Township Forty-five (45) North, Range'Six '(6) West be changed from the
forestry and recreation classification to the unrestricted district.
The foregoing amendment shall,be effective upon passage and publication and
such further proceeding as may be required by Section 59.97 of the Wisconsin Statutes.

PLEASE TAKE NOTICE that .the requirements of Sec. 59.97(3)9 Wisconsin Statutes,
having been met, the amendatory ordinance to the zoning ordinance, passed.by the
County Board on the 19t day of April, 19609 a copy of which is attached hereto, went
into full force and effect on the.274 day of October, 1960.

AMENDMENT OF ZONING ORDINANCE'
SECTION I
Districts and District Maps
For the purpose of promoting public health, safety, and general welfare and
regulating, restricting, and determining the areas within which agriculture, forestry,
and recreation may be conducted and .regulating ,and restricting areas along or in,
natural water courses, channels, streams,_and-ereeks, and establishing districts
which are deemed best suited to carry out such purposes, outside of the limits of

incorporated villages.and cities, and in accordance with the provisions of Section
59.97 of the Wisconsin Statutes, the territory included in the boundaries of the follow-
ing towns, to -wit:
Barksdale, Barnes, Bayfield, Bayview, Bell, Cable, Clover, Delta, Drummond,
Eileen, Hughes, Iron River, Kelly, Mason, Keystone, Lincoln, Namakagon, Orienta, Oulu,
Pilsen, Port Wing, Pratt, Russell, Tripp and Washburn are hereby divided into four
classes of use districts as follows, to -wit:
1. Forestry District
2. Recreation District
3. Unrestricted District
4. Flood Plain District
The boundaries of the aforesaid four 4 use districts are shown upon the official
map of Bayfield County, attached hereto, being designated the "Zoning Map showing Use
Districts," Bayfield County, Wisconsin, dated November 14,'.19349 and made a part of
this ordinance, as amended. The Flood Plain District is identified by land levels
based on the high water mark of Lake Superior (CheVamegon Baru). All notations, refer-
ences, and other things shown upon said zoning map showing use districts shall be as
much a part of this ordinance as if the matter and .things set forth by said map were
all fully described herein.
2. Following Section III of the ordinance add a new section as follows. -
SECTION III-B
District Number 4 - Flood Plain District
In the Flood Plain District no building or structure used for human habitation
shall be erected and no existing building shall be relocated in or moved onto unless
the land upon which said building or structure is to be erected or located and ten
feet beyond the limits of said building or structure shall prior to the time of con-
struction be raised to such a level that the main floor of said building or structure
shall not be less than seven feet above the high water level of Chequamegon Bay -or Lake
Superior. No basement or other floor shall be constructed below or at a lower elevation
than the main floor.
_Provided further, that septic tanks, dry wells, and disposal fields shall be con-
structed in such a way that the outlet of the septic tank shall be at a minimum eleva-
IItion of 610 feet. Explanatory (Note the average elevation of the Ch:equamegon Bay is
1603 feet above sea level).
For property which fronts on Cheguamegon Bay or Lake Superior and is not directly
subject to the high water conditions of an individual river or stream the main floor
of such building shall not be less than four (4) feet above the high water level of
Cheguame$on Bay or Lake Superior.
Minimum lot areas in the flood plain shall conform with Section H 65.03 (1) and
(2) H 65.05 and H.65.06 (4) of Chapter H 65, Wisconsin Administrative Code.
3. Said zoning ordinance should be amended to change the boundaries of use districts
as follows:

4. That the'following definition of a flood plain be -added to Section XII Defini-
tions of the Ordinance:
Flood Plain - An area of land bordering the present or -former course of a river
or stream and built•of silt and other materials deposited at times of flood.
Habitation - A place of abode, a settled swelling, residence or house for people.

Moved by Meyer and -seconded by Stuart to receive and place on file the foregoing
notice of and amendment to the County Zoning Ordinance. . Motion Carried.
Moved by Stuart and seconded by Sampson that the County Board recommend that the
Welfare Department hire a case worker, that in hiring another case worker the said
employee be from Bayfield County if possible. Motion Carried.
The Board -proceeded with the election of a trustee from Bayfield County for Pure
Air Sanatorium for a three-year term commencing January 1, 1963.
Moved by Howell -and duly seconded that Robert-M.-Spears be nominated.
Moved by Stuart and seconded by Meyer that nominations be closed. Motion Carried.
Moved by.Justice and seconded by Heglund that the County Clerk cast a unanimous
ballot•for Spears as Trustee. Motion Carried.
The County Clerk cast the ballot as directed and the chair declared Robert M.
Spears duly elected as a Trustee from Bayfield County for Pure Air Sanatorium for a
three year term commencing'January 1, 19'63.

TO ALL COUNTY BOARD CHAIRMEN
RELATING TO LOCAL FACT FINDING ORDINANCE
Gentlemen:
Will you please.WIRE reply to us whether or not your county board has adopted
the uniform fact finding ordinance that was developed by our association last fall and
published in the October 1962 issue of Wisconsin Counties.
Wisconsin Employment Relations Board has issued an order stating that the uni-
form fact finding ordinance is in non-compliance with the law.
Shawano county expects to make its decision on a question of an appeal based
on the fact that the Wisconsin Employment Relations Board has exceeded its authority
and that only the courts can render such a decision.
We would like you to do. 3 things:
(1) Wire us immediately as to whether or not your county has adopted this uni-
form fact finding ordinance.
(2) If your county has adopted this ordinance, please mail us a copy of your
ordinance as soon as possible.
(3) If your county has adopted an ordinance would your county join in intervening
in.the Shawano county case in the event that they appeal. (Intervening would mean
that you would make available your District Attorney or Corporation Counsel to appear
before the Dane County Circuit Court when the case comes up).
IT IS NECESSARY THAT WE KNOW BEFORE NEXT MONDAY IF YOUR COUNTY WILL JOIN SHAWANO
COUNTY IN THIS CASE.
Shawano County will make its decision to appeal at a meeting of their executive
committee next Monday.
