Pajala, County Board Chairman. The following members answered roll call: Sampson, Hall, Barningham, Howell, Pristash, Kliszcz, Beeksma, Meyer, Bernard E. Johnson, Heglund, Chambers, Hoefling, Stuart,.Moniza, Berweger, William Peterson, J. 0. Anderson,.Sanfred Anderson, Elonen, Lupa, Evald Johnson, Sibbald, Frankie, Rondeau, Jr., Ernest Nelson, Ed. Dear Mr. Tranmal: Due to the illness of Mr. Paul Tribovich, Arthur Meierotto has been appointed to represent him at the meeting of the County Board. Yours, Art Meierotto, Town Clerk Moved by Sampson and seconded by H. J. S. Hanson to seat Meierotto as a member of the County Board representing the Town of Russell. Motion Carried. Moved by Justice and seconded by Moniza to dispense with the reading of the minutes of the last meeting. Motion Carried. The Board proceeded with the election of a Highway Committee. The Chair appointed Richard Holman and Onne Beeksma as tellers. Nominations for a member of District #1 were as follows: Walter Wasmuth K. C. Howell Moved by Barningham and seconded by Pristash to close nominations. Motion Carried. The result of the ballot was as follows: Walter Wasmuth - 19 K. C. Howell - 17 Total - 36 The Chair declared Wasmuth duly elected. 566 November 1:2, 1963 Nomination for District #2 was as fo-llows: Joseph Berweger Moved by Justice and seconded by William Peterson to close nominations. Motion Carried. Moved by Justice and seconded by Lupa that the County Clerk be instructed to cast i a unanimous ballot for Joseph Berweger. The Clerk cast the ballot as directed and the Chair declared Berweger duly elected! Nomination for the 3rd District was as follows: Frank Hoefling Moved by Evald Johnson and seconded by Pristash to close the nominations. Motion Carried. Moved by Beeksma and seconded by Stuart that the County Clerk be instructed to cast a unanimous ballot for Hoefling. The Clerk cast the ballot as directed and the chair declared Hoefling duly elected The following communications were read: NORTHERN PACIFIC RAILWAY COMPANY September 11, 1963 County Clerk Bayfield County Washburn, Wisconsin Dear Sir: Recently, our agent at Iron River, Wisconsin advised that a party had leveled a portion of our right-of-way, West of.Lea Street on the North side of the Railway Com- pany's track, preparatory to placing a house trailer.on it. Lea Street is about one block West of our depot at Iron River. This party claims to have purchased the property from Bayfield County. As near as we can tell, the encroachment is on the outer portion of our 200' right-of-way in Block "A", Lots 7 and 8. Our Industrial Department in St. Paul advises their records show Northern Pacific ownership and we have, therefore, instructed Agent E: J. DeNagle to restrain Mr. Aaron Kivisto from doing any further work on our right-of-way. Our Industrial Department in St..Paul advises that, regardless of subsequent deeds, the Northern Pacific claims its ownership over and across Section 7, Township 47, Range 89 Bayfield County, by virtue of the Act of Congress of July 2, 18649 which granted a 400 ft. wide right-of-way strip. In the subject case, the area indicated on the right-of-way plat by reference was not occupied adversely in 1907 and is therefore claimed under the Act of 1864. The outer 150 feet to the east of "L" across the SE/ of Section 7, was occupied ad- versely in 1907, but technically we only lost the outer 100 feet and should be show- ing a'100 foot width north of the track, rather than 50 feet. In our Title Memo #78 of June 59 1908, for some reason it was deemed inadvisable to assert our title to the additional 50 foot width as the lesser width seemed sufficient for Railway purposes at the time. County records do not show charter right-of-way ownership in the Northern Pacific November 12 , 1963 It since -such ownership was not placed on record in the many counties across which our line was located. The only recording of the Northern Pacific charter right-of-way is with the General Land Office in Washington, D.C. As the line was constructed, maps of definite location were filed in said office, To cause more difficulty, however, the U. S., in granting patents to lands thru which the right-of-way extended, did not except the charter right- of -way in such patents. Under the circumstances, the Northern Pacific Railway Company is claiming title to the right-of-way under the Act of 1864, which Bayfield County is now proposing to sell to Mr. Kivisto. Division of Field Services band Office Sep. 27, 1963 Mr. Ludwig Tranmal, County Clerk Bayfield County Wisconsin Dear Mr. Tranmal: This has further reference to your letter of September 20, 1963, and enclosure relative to the lands in sec. 7, T.47 N., R. 8 W., fourth meridian, Wisconsin. The land-grant of the Northern Pacific Railroad Company,.now Railway Company, in the State of Wisconsin was made by the act of July 2, 1864 (13 Stat. 365)', as amended by the joint resolution of May 31, 1870 (16 Stat. 378). The right of way of the. Northern Pacific Railroad Company, which comprises a strip of land 200 feet in width on each side of the railroad where it passes over the public land, was granted by Section 2 of the act of July 2, 1864 (supra). Our tract book records show all of section 7 patented as homestead land'in 1891, 1892 and 1893. This office has no further jurisdiction over the land after it has been patented for the reason that title thereto has passed out of the United States. The history of the section shows it was forfieted by the Wisconsin Central Railroad successor in interest of the'Portage, Winnebago and Superior Railroad; and restored to homestead entry February 28, 1891, by the act of September 29, 1890 (26 Stat.496). Information concerning the selection in lieu of this land is contained in Bismark List No. 30, North Dakota -Northern Pacific Railroad Company. For your further information, the map of the constructed road of the Northern Pacific Railroad Company from Ashland. -Wisconsin, to a point in Sec. 13, T. 47 N., R. 10 W., through the vicinity of the above tract of land, was approved by the President of the United States on February 6, 1885, and duly filed in this office. True copies of the above map may be obtained at a nominal cost by writing to the General Services Administration, National Archives and Records Service, Cartographic Records Division, Washington 25, D. C., taking care to properly identify it as Map No. 18, in tube 42. i Copies of the maps of definite.location,of the Wisconsin Central Railroad, formerly Portage, Winnebago and Superior Railroad Company under the act of May 5, 1864 (13 Stat., 66), as amended identified as Map 1 A, B, C, in tube 65, may also be obtained from the above office. Motion Carried. 570 -November 1 2, 1963 The following communication was reads CHEQUAMEGON BAY CIVIL AIR PATROL ASHLAND BAYFIELD COUNTY AIRPORT ASHLAND, WISCONSIN. Mr. George Moniza Bayfield County Board Budget Committee Washburn, Wisconsin Dear Sir, The Chequamegon Bay Civil Air Patrol is, this year, making a request to the Bayfield County Board for an appropriation of $1000.00 to help defray the operating cost for 1964. A copy of the proposed budget for 1964 has been delivered to the County Clerk. Many board members may not be familiar with the function of the C. A. P. I would like'to give a run-down on our activities and organizational structure. The Civil Air Patrol is a federally chartered, national organization of volunteer members, uniformed, regimented and trained to offer a unique service to the community. Members do not re- ceive pay for their services. We are on call all hours of the day or night: In addi- tion.to the equipment owned by the local unit members use their personal air craft, mobile radio vehicles, radios rescue equipment and others., risking loss and damage to this expensive equipment in addition to the great risk members take on their own lives, for low level search work over our wooded area can be extremely haz- ardous. We are not purchasing and storing equipment for a situation which may never develop. Our communications equipment is in daily use passing on the C.A.P. national network, (the world's largest non-military network) intra department communications and training - both senior and cadet. Our aircraft is used by members for training purposes, for which the pilot pays the gas and oil. Rusty and green pilots are of little value as searches have a way of happening during inclement weather. Examples of the versa- tility of the C.A.P. is shown by it's record. In addition to search for missing air- craft our missions have included searches for lost hunters,. missing children, aged persons, escaped convicts, drowning recovery, uniformed guards, road block, blood ferry, courier service, balloon tracking, natural.disaster such as the Colfax tornado and Odanah floods and others. There are many well qualified persons in the Chequamegon Bay area who would be an asset to the Civil Air Patrol. Few will join because of the time and risk involved. In addition to training meetings, members must devote such time to necessary reports, forms O.C.S. courses for promotion, maintenance on aircraft, vehicles, radios, work details and the Cadet program, when our membership numbered fifty to seventy five persons we were able to stage fund raising activities to cover the entire cost of operation. Attrition, by. moving, death, public disinterest, and a reluctance to devote their spare time to the program has brought our active membership.down to less than fifteen members. our members close their business, pay others to work for them, cancel their plans and given up their sleep, when called on a mission. We have never refused a mission and are on the job within minutes, when called on in an emergency and our success record has been outstanding. I am sure Sheriff Peterson will attest to our worth to his Department and our C. D. capabilities are known to your C. D. Director through our C. D. exercises. Whether you appropriate this amount or not, we will continue to provide our services where needed for as long as we are able. We have done more search work in Bayfield County than we have in Ashland County. The Committee, further respectfully requests you consider a future annual appropriation of $500.00 for future years. The following report.was read: October 31, 1963 Amended Report correcting report submitted on Oct. 14, 1963 Personnel Committee County Board of Supervisors Bayfield County Washburn, Wisconsin Gentlemen: This request is submitted for an appropriation of $500.00to the County Veterans' Service Commission fund for the year of 1964. On hand in the fund as of October 14; 1963 is,the balance of $652.86 and by add- ing the appropriation of $500.00 to this fund for the year of 1964, the fund would have an operating balance of $1152.86. The total expenditures from January 1, 1963 thru October 14, 1963 is S525.77. A letter is attached.as to the breakdown of these expenditures. The requests for aid from this fund are at times quite a number and then again, you may have no requests for quite sometime. It is hard to give an exact amount that will be requested from this committee for the next 12 months, however, the committee handling the funds are very careful in granting aid so the amount requested above should be sufficient unless something unforseen comes up. The following communication was read: Honorable Members of the County Board Dear Sirs: At the present time a total of 60 hours is spent to maintain the Court House. After snowfall and cold weather, an additional 15.hours is spent due to care of the furnace and snow removal. I have to take care of the furnace on Saturdays, Sundays and Holidays -and often am called, at any hour of the night due to the furnace going out, etc., For this I receive $250.00 per month. I have inquired in this area of other custodians who receive from $300.00 to $350.00 per month. With the new proposed addition, considering the bare minimum of maintenance, I know that additional hours will be necessary. Therefore, I.am hereby requesting an increase of $50.00 per month for the additio ai duties now for furnace care and later for additional space cleaning on the new annex. The following communication was read: VILAS COUNTY BOARD Vilas County Eagle River, Wisconsin November 4, 1963 Bayfield County Board Washburn, Wisconsin Gentlemen: Enclosed is a copy of a Vilas County Resolution adopted September 17, 1963. This test case, State vs. Mutter, is a direct result of Vilas County's withdrawal from the Forest Crop Law, and is now on appeal to the Supreme Court. The real issue of :the case is whether or not an,V count.V has the right to enforce contract rights with the State, made when county lands were first entered under Forest Crop Law and which provided that a county could withdraw. The State refuses to recognize the County right of Withdrawal and by changing the terms of the contract through legislation without the written consent of the individual counties the State, in effect, is saying that it is not bound by a contract with the counties but that the counties are bound by same. The issue goes deeper than Forest Crop Law. If a County's contract rights with the state are not recognized under the Forest Crop Law, are any county contract rights made with the state valid? November 12-,•1963 At a general meeting of Forest crop counties held at Phillips, Wisconsin in 1961, the necessity of clarifying the counties contract rights in regard to Forest Crop Laws was discussed. It was agreed that Vilas County would make the test case by withdrawing from the Forest Crop Law. It was further agreed by members of Forest Crop Counties present that they would present resolutions to their respective county boards for an appropriation of $250.00 to assist Vilas County with expenditures involved in.the test case. The expenditure through the Wisconsin Supreme Court on this case has now been limited at $3750.00. If all 27 Forest Crop Counties involved will accept equal shares the cost will be $139.00 per county. If'your county is willing to cooperate with Vilas County, we would appreciate the remittance of a check in the amount of $139.00 payable to Vilas County Treasurer, Courthouse, Eagle River, Wisconsin. S/ Everett Zimpelmann RESOLUTION NO.. 63-21 WHEREAS, the Forestry.and Land Committee having thoroughly studied the Forest Crop problem and deeming it in the best interests of Vilas County to clarify this problem in -a Court of Law, NOW THEREFORE BE IT RESOLVED, by the County Board of Supervisors duly assembled this 17th day of September, 19639 that there be appropriated from the Forestry Fund the sum of $3750.00 which sum is to cover cost of litigation to date, as. incurred by County Forester Anthony Mutter, and estimated additional cost of appeal of case.of State of Wisconsin Vs. The County Board of 'Supervisors of Bayfield County Wisconsin, regular- ly assembled, does hereby ordain that such funds as may be made available t'o.the .county for highway work in the year 1964 under the provisions of'Section 20.420 and Chapter 83 appropriated, shall be expended as. herein - of the Statutes, and the additional sums hereinafter set forth: SECTION II. COUNTY TRUNK HIGHWAY ALLOTMENT. WHEREAS the State Highway Commission has notified the County Clerk that a sum of money estimated to be Two Hundred Twenty- four Thousand, Six Hundred & 00/100 Dollars (8224,600.00) will become available at the end of the fiscal year -under .the provisions of Sections 83.10 and 20.420 (83) and (84) of the Statutes, for the county trunk highway system in the county., but the actual amount will not be known until the close of the fiscal year ending June 30, 1964. BE IT RESOLVED that the County Highway Committee is authorized and directed to expend the said sum to the extent required to match and supplement Federal aid for construction, right of way, and'other costs on any Federal projects located on the county trunk highway system of said county, which are not recovered from Federal funds, and to expend any balance for constructing, repairing, and maintaining such county trunk highway system and the bridges thereon, including snow and ice removal and con- trol, as directed in Section 83.10 (1) of the Statutes, and to reimburse the general fund for any expenditures that may be made therefrom pursuant to Section 83.01 (6) of the Statutes. The distribution to such purposes is estimated, but not specifically dii ected, to be as follows: For Construction, Maintenance, Snow Removal, and Ice Prevention on the County Trunk Highway System. SECTION III. WHEREAS the various highway activities for which provision is made in this resolution are continuous from year to year, and the exact cost of any work cannot be known at the time of making the appropriation therefor, BE IT RESOLVED that this Board does hereby direct that any balance remaining in any appropriation for a specific highway improvement after the same shall have been completed may be used by the County Highway Committee to make up any deficit that may occur in any other improvement, which is part of the same item in the county budget, for which provision is herein made, and any balances remaining at the end of the year in any highway fund shall remain and be available for the same purpose in the ensuing year.. SECTION IV. WHEREAS the exact amount of the funds that will become available from the state for highway purposes in the county under Section 20.420 of the Statutes will not be known until on or after June 30, 1964, BE IT RESOLVED that the County Treasurer is hereby authorized and directed to make payments for the purposes for which such funds are to be used, as hereinbefore authoriz ed, from any funds in the county treasury that are not required for the purposes for which appropriated prior to August 1, 1964-, and to reimburse such funds in the county treasury from the sums received under Section 20.420 of the Statutes. The following report was read: REPORT OF COUNTY HIGHWAY COP'MITTEE County Trunk Highway "B" TO THE HONORABLE COUNTY BOARD OF SUPERVISORS Bayfield County, Wisconsin Gentlemen: The County Board at its April meeting.referred to this Committee a resolution changing the location of County Trunk Highway "B" in the towns of Oulu and Tripp. s The advantages of these changes are: It would shorten the system one mile. It would eliminate two 90° curves and dangerous intersections with County Trunk Highway "A" known as Briggs Corner and one that is known as the Washington Corner. It would improve the alignment and vision. The disadvantages to Bayfield County are: The present road is in good condition and can be used without the expense of construction for the next few years. The proposed road would require reconstruction at an estimated cost of $75,000.00 for which there are no funds available at the present time. Your Highway Committee recommends the adoption of this resolution with the understanding that construction funds will not be available until 1966 or 1967. We invite members of the County Board to inspect the report. I submit my application to audit the Bayfield County records and books of account for the year ending December 3191963 at a per diem rate of $50.00, $40.00 and $30.00 for senior, semi -senior and junior accountants respectively. It is estimated that the cost of the general county will total Two Thousand Six Hundred Dollars ($29600.00). Included in this amount is an estimate of $100.00 for the annual state report. For the 1964 county fair audit, we submit, as in the prior year, an estimate of $175.00 which is in addition to the general county audit. Declaration of Policy Because of the existing possibility of an attack upon the United States of unpre- cedented size and destructiveness, including the inevitable hazards of radioactive con- tamination, and in order, in the event of such an attack, to assure the continuation of effective, legally constituted government of the County of Bayfield, it becomes prudent to provide for the relocation of the county government in order to insure its survival, emergency operation and continuity in the event of such an attack. Such provision should be enacted in the interest of public welfare and protection of property and in pursuance.of the authority conferred by Act 22.01, dated 1959 of the State of Wisconsin Statutes. BE IT ORDAINED BY THE Board of Supervisors of the County of Bayfield: Section 1. Short Title. This Ordinance shall be known and may be cited as the "Emergency Temporary Relocation Ordinance of the County of Bayfield". Section 2. Definitions. As used in this Ordinance, unless the context otherwise clearly indicates: (a) "Disaster" means an extraordinary misfortune caused by an enemy attack on the United States resulting in widespread destruction of life and property. (b) "Enemy attack" means any attack or series of -attacks by a power hostile to the United States which causes or may cause death, injury, or substantial damage to the people and property in the United States by Sabotage or by the use of bombs, missiles, shells, or any other weapons of conventional, atomic, radiological, chemical, bacteriolo gical, biological, or any other nature, process or means. Section 3. Temporary Location for County Government. Whenever, because of a disast- er in this State, due to an enemy attack on the United States it becomes imprudent, inexpedient, or impossible to conduct the affairs of the County of Bayfield, the county government may meet at any other place within or without the County of Bayfield, or within or without the State of Wisconsin, on the call of the Chairman of the Board of Supervisors or his emergency interim successor as provided by Law. Section 4. Conduct of Business at Emergency Location. During the period when business is being conducted at the emergency temporary location the Board of Supervi- sors and other officers of the County of Bayfield shall exercise, at such locations all of the administrative and legislative powers and functions conferred upon them by the laws of the State of Wisconsin and the ordinances of the County of Bayfield. Section 5. Separability® If sections of this ordinance are changed or disregarded, this does not effect the entire ordinance. Section 6. Effective Date. This ordinance will be put into effect immediately upon the notice of a disaster of any kind as listed in Section 2 of this Ordinance. This ordinance shall take effect immediately upon passage. The following Petition was read: A PETITION FOR COUNTY BRIDGE AID To The Bayfield County Highway Committee Bayfield County Courthouse Washburn, Wisconsin Gentlemen: Last spring as the ground thawed out and water ran down the hill it undermined the west abutment of the Iron Bridge on Rice Ave. that spans the ravine between Second and Third streets in the City of Bayfield, The mayor called Mr. Olsen and Mr. Germond and they inspected the bridge and they agreed -that the bridge should be closed to vehicular travel as there would be no other way of keeping heavy traffic from using the bridge. The bridge was closed to vehicular travel, but a few weeks later it was noted that the abutment was slipping and unless something was done very soon, it would collapse and take at least the first span of the bridge with it. Harry Jardine was called and asked to submit a bid to stabilize the abutment before it collapsed. The work was done and the City of Bayfield hereby petitions the County Highway Committee for aid as authorized by Statute 81.39 (3) which states as follows: - Whenever the construction or repair of such culvert or bridge must be made with- out delay, the Town Board may file its petition with the County Clerk and County Highway Committee setting forth the facts respecting the.necessity for immediate construction or repair.' It shall be the duty of the Town or the Highway Committee to make such construction or repairs with the least possible.delay. The Town Board is authorized to borrow the entire cost of the work, and to include the town's share of such cost in the next tax levy. But if the town's share of such cost exceeds the 598 November 13, 1963 amount produced by a tax of 2 mills on the dollar the action of a town meeting shall be required. The repair or construction of a culvert or bridge performed and accepted pursuant to this subsection,shall entitle the town to the same County Aid that the town would have been entitled to had it filed its petition with the County Board as provided in 81.39 subsection(1). Total Bed Capacity' 32 (all nursing care) Present Census 32 Rates All patients are charged equally for the kind of care which is available in the home. The rate per month is 275.00. Introduction Edith W. Nolander stated that it is extremely difficult to recruit professional nurses in this part of the state. She would feel more secure and would like to have a nurse on night duty. Almost all of the patients require maximum care and the home has been full since shortly after it opened. Medical and Nursing Care Dr. H. Guzzo is the medical director who visits the institution twice weekly and is on call at'any time. Occasionally Mrs. Nolander finds it necessary to stay in the Home over night due to the critical condition of a patient. Dental service is made available as it may be needed and other services are obtained either in Washburn or in Ashland. Dr. Guzzo has the opportunity to pass on all applications for admission. His order for medicines and treatment are written and he also writes very informative progress notes. The annual physical ,examinations are done to date. Ile is responsible for the procurement of the medical supplies and is actively interested in the rehabilitation program:® He has been helpful along with the physical therapist in the training of the November 14, 1963 aides in simple techniques for the exercising and retraining of some of the patients. Nursing care includes intensive care to 11 patients. One patient has an in- dwelling catheter, 6 are incontinent and 3 others partly so, 7 must be fed. All but one must be closely supervised to prevent illness or injury. One patient pre- sented a problem on control of a bed sore. The aides make rounds and patients' positions are changed every hour and in some instances every two hours. A complete bath is given once weekly, in the tub -if possible. It is necessary to give some patients a complete bath daily the nurse said. Others are given partial baths on all the other days. Skin care is given several times a day. Medicines are given by the RN on duty and by responsible aides on the other shifts. Narcotics are given very seldom and only on prescription.. An emergency supply of oxygen only is available. An LPN is on night duty part of the time. Nursing personnel for this service is as follows: 7 a.m. - 3 p.m. Shift RN 1 LPN 1 (on 2 days) Aides 4 (plus 1 on split shift) 3 p.m. - 11 p.m. Shift 0 L 3 11 p-m.-- 7 a.m. Shift_ X 1 (on 2 nigh.ts)j 2 Food Service Two cooks and.a helper are responsible.for the preparation and serving of all meals and nourishment. The menus are planned in advance by Mrs. Nolander who also does the purchasing. The menu plan for.the week of April 1 - April 7 was rated satisfactory. Special diets include diabetic, blended, low residue, bland, low fat, low fat low salt, low salt low calorie. All patients are served trays at 7:20 a.m.; 11:30 a.m. and 4:45 p.m. Pasteurized grade A milk is served directly from the carton to the glass. Meat and milk supplies are obtained from approved sources. The food service area and equipment was clean and appeared to be in good condition. Other Services The patients appear to be happy and comfortable. Day rooms at each end of the building are furnished with books, games, TV and radio. Chapel services are conducted in the West day room. A protestant service is held every Sunday and once during the week. individual basis. A catholic service is conducted on an An organized recreational program is guided by an activity aide under Mrs. Nolander's supervision. The volunteer group ceased visiting the home because they felt they should be paid for their services. The following communication was read: STATE DEPARTMENT OF PUBLIC WELFARE Division of Corrections July 19, 1963 Mr. Edward A. Pajala, Chairman Bayfield County Board of Supervisors Route #1 Washburn, Wisconsin Dear Sir: In accordance with the provisions of Section 46.17, sub -section 3 of the Wisconsin Statutes, the annual official inspection of the Bayfield County.Jail was conducted' on July 9, 1963. In general, the appearance of all jail,sections was found to be satisfactory. The recent painting of the floor in the first floor cell block greatly improves the appearance of that section. Examination of the jail register revealed that it is being kept current, complete and giving the necessary required information. It was noted at this time that some of the windows have been provided with glass block and ventilators, and it is my understanding that the remaining windows will be so enclosed in the near future. I do have some reservations with the type of screen being provided, since it is my opinion that these will be damaged from time to time, necessitating replacement. It is suggested that future ventilators be provided with a heavier woven mesh screen which will not be.easily damaged or torn. The matter of female adult detention in the Bayfield County Jail was discussed with Sheriff Peterson and Mr. Tranmal, County Clerk, and I have informed them that if county officials wish to have the Bayfield County Jail approved for the detention of female adults, the following improvements and operational procedures must be complied with: 1. Female adults would be confined in the first floor cell block. 2. A shower be provided in the first floor cell block. The shower could be located in the guard.corridor, 61,2 November 14, 1963 since it appears that this would be the most economical place to install it. Also, the shower could then be controlled by the jail staff and prisoners would not have access to it at all times. 3. Whenfemales are confined in the first floor cell block, male prisoners must be locked in the second floor dormitory or in the individual cells located on the second floor. All feeding would then have to be conducted on the second floor and the present procedure of feeding all prisoners in the first floor day'room would be discontinued. It is also recommended that the present bath tub, located off the first floor day room be replaced with a shower, which would be much more sanitary. Please convey my sincere thanks and appreciation to Sheriff Peterson, Deputy Cizek, Undersheriff Embertson and Mr. Tranmal for the cooperation extended me at the time of my visit. November 14, 1.963 The following Resolution was read: WHEREAS, From time to time units of Government.within the County, public utilities, corporations and private persons, apply to the County Board of Supervisors for rights - of -way across County lands for highway purposes, the construction and maintenance of utility lines and for other purposes, and WHEREAS, In many instances said rights -of -way cross forest crop lands and other valuable lands owned by Bayfield County., which rights-of-way:and the activity in connec- tion with the constructions of highways and utility lines, at times, results in damages to adjoining County lands, obliteration of corners, land marks and bearing trees, to- gether with other damages which affect the value of said County lands and the rights of the public, NOW THEREFORE BE IT RESOLVED, That all future rights -of -way over County lands granted by the Board of Supervisors shall include the provisions set.forth in Schedule "A" attached hereto and made a part of this Resolution and Order, and BE IT FURTHER RESOLVED, That all easements of rights -of -way or easements of any nature whatsoever granted by Bayfield County shall be approved, in writing, by the Forest Administrator of Bayfield County as to content and form, in accordance with this Resolution, such approval to be evidenced in writing on each of said easements prior to delivery to the municipality, corporation or person applying for such easement. The rights of the grantee of such easement shall apply only to the particular parcel of land granted in the easement and such grantee shall have no right of any nature whatsoever to enter upon adjoining County lands or lands outside of the right- of-way for any purpose whatsoever. 2. All timber cut by said easement grantees for purposes of opening up said rights - of -way shall be cut in accordance.with practices normally required and by Bayfield County, and all merchantable forest,produ.cts cut shall remain the property of the County at the County's option. 3. The easement grantee shall refrain from spraying rights -of -way for the des- truction of trees, shrubs and other plants without thereafter cutting and properly dis- posing of the dead trees and shrubs on said rights -of -way resulting from said spraying for the purpose of avoiding unsightly conditions, detracting from scenic beauty and possibilities of fire hazards. 4. Said easement grantee shall have the right to cut and trim branches of trees overhanging the right-of-way, but shall have no right to go outside of the right-of-way to cut trees, pile brush and debris or to bulldoze and construct access roads, except upon written consent of the Forest Administrator. 5. The easement grantee shall take all necessary precautions to prevent the obliteration of landmarks relating to corners and monuments 'including all corners, bearing trees, bench marks and other Government and private survey references. 6. That such easement grantee shall, in the clearing of rights -of -way and con- struction thereof, comply with all of the laws of the State and County concerning the cutting of forest products and disposition of slash and shall be more specifically prohibited from windrowing slash in, along or upon said rights -of -way and adjoining lands. 61 November 14, 1963 7. The easement grantee shall pay a monetary consideration to Bayfield County for said easement or right-of-way at a scheduled rate per year, calculated on an acreage basis in the amount of 8, per acre annually. The following Budget Report was read: PROPOSED BUDGET FOR THE YEAR 1964 TO THE HONORABLE BAYFIELD COUNTY BOARD OF SUPERVISORS Gentlemen:. We, the undersigned Committee on Finance, Budget and Equalization, hereby sub- mit our report and recommendations for 1964. VALUATION The Supervisor of Assessments recommends a true value of $39,603,175.00. The legal limit of taxation for County general purposes is 1% exclusive of debt items. The budget is under the legal limit by 520,000.00 although it includes an item of $18,232.59 for a contingency fund. SANATORIUM The recommended changes at the Nurses Home have been completed. The Joint Committees and Trustees.:are not recommending dual use, pending further study. The findings may result in a definite program by the spring meet- ing of the County Boards. WELFARE This continues to be one of the larger items in the budget. State and Federal aid is reflected according to costs in the revenue section of the budget. REST HOME There have been some structural defects which will require correction. It is operating at full capacity. MOBILE LIBRARY SERVICE Our share of costs is in the budget for 1964. HIGHWAYS AND BRIDGES Highway expenditures are financed entirely from gasoline -and automobile revenueE with the exception of County Bridge Aid to Districts. The Bridge Aid from 1964 amounts to $11,308.67 a reduction of $3,225.00. PLAT BOOKS The plat books have been printed and received. We call your attention to a new feature. FINANCE In view of the building program we feel that the contingency fund should be kept as intact,as possible for the present., We'ar"e introducting a resolution authorizing short term loans in case it is found necessary. The budget is based on the recommendation of the Personnel Committee as to wages and salaries. It also is based on a mileage cost of eight cents for use of personal cars. This is an increase of one cent per mile.
