Rondeau, Vice Chairman at 9:30 A.M. The following members answered roll call: No. 1 Howard Sibbald, Thomas E. Rondeau, Raymond J. Mammoser,,William Stuart, Art Hanson, Ernest Heglund, George Moniza, Louis J. Brost, G. William Frankie, Axel Lehto, George Sampson, Philip-E. Tetzner, Bertyl R. Nelson, William Celinsky, Walter Barningham, Art Meierotto, Edwin M. Erickson, Walter Wasmuth, Alva A. Lattimer, Arthur A. Anderson, Bennie Rude - Total .21. Moved by Moniza and seconded by Sampson to dispense with the reading of the last County Board minutes. Motion Carried. The following Notice of Resignation was read: No. 2 I, the undersigned, G. William Frankie, a member of the Bayfield County Board of Supervisors representing the 9th District, consisting of the Towns of Hughes, Orienta and Tripp, Bayfield County, Wisconsin, hereby tender my resignation as such Supervisor and Chairman of the Bayfield County Board of Supervisors, effective immediately. Dated this 15th day of November, 1966. G. William Frankie NOTE: Section 17.01 (7) of the Wisconsin Statutes provides that resignations by a County Supervisor shall be made to the Sheriff who shall immediately trans- mit a notice thereof to the Chairman of the County Board and thereafter the Sheriff shall file such resignation with the County Clerk. Moved by Moniza and seconded by Lehto to accept the resignation of Mr. Frankie. Motion Carried. No. 2a s A motion was made by Mammoser and seconded by Sibbald to seat Sanfred Anderson of the Town of Orienta, as a member of the County Board representing District #9 to replace the vacancy of G. William Frankie. Motion Carried. 3b November 15, 1966 No. 2b The Board proceeded with nominations to elect a County Board Chairman and Vice Chairman. A motion was made and seconded to nominate Thomas E. Rondeau as Chairman of the County Board. Moved by Sampson.and seconded by Lattimer to close nominations. Motion Carried. Moved by Sampson and seconded by Mereitto instructing the Clerk to cast.a unanimous ballot for Thomas E. Rondeau as Chairman of the County Board. Motion Carried. The Clerk cast the ballot as directed and the Chair declared Mr. Rondeau elected as Chairman of the Bayfield County Board. Nominations were in order for a Vice Chairman of the Bayfield County Board. Moved by Erickson 'and seconded by Mammoser to nominate Walter Barningham as Vice Chairman of the Board. Moved by Moniza and seconded by Stuart to nominate Bennie Rude as Vice Chairman of the County Board. Moved by Mammoser and seconded by Celinsky to close nominations. Motion Carried. The Chair appointed Mr. Lattimer and Mr. Meierotto as tellers. The result of the ballot was as follows: Barningham 10 Rude Total The Chair declared Mr. Rude elected as Vice Chairman of the Bayfield County The Chairman announced the position of Highway Commissioner would be vacant the first of year. The Clerk explained that the Highway Commissioner's position is held for one year to begin with and after one year he would be appointed for a term of two years. Work consisted of rural road construction, ditching, dam building, land clearing, and golf course construction. From September 1961 until February 1962 worked with the State Highway Commission at Superior. Work consisted of surveying, asphalt and concrete inspection, subgrade construction inspection and testing, drafting and computation of field notes. The Board proceeded with the election of a Highway Committee. No. 3b Mr. Wasmuth explained to the Board the study that had been. made by the Committee on boundary changes of the districts. The plan for redistricting the Highway Districts to be as follows: District #1 - Towns of Russell, Bayfield, Bell, Clover, Port Wing, Washburn, Bayview & the City of Bayfield District #2 - Towns of Barksdale, Pilsen, Keystone, Eileen, Kelly, Lincoln & the City of Washburn District #3 - Towns of Orienta, Oulu, Tripp, Hughes,. Iron River, Delta, Barnes, Drummond, Mason, Pratt, Namakagon, Cable, the Villages of Cable and Mason Moved by Stuart and seconded by Celinsky to accept the recommendation of the study made by the Committee changing the boundaries for the Highway Districts. Motion Carried. November 15, 1966 The following nomination was made for a member of the Highway Committee from District #1. A motion was made and seconded to nominate Walter Wasmuth as a member of the Highway Committee from District No. 1. Moved by Nelson and seconded by Sampson to close nominations. Motion Carried. Moved by Sibbald and seconded by Celinsky instructing the Clerk to cast a unani- mous ballot for Mr. Wasmuth as a member of the Highway Committee from District #1. Motion Carried. The Clerk cast the ballot as directed and the Chair declared Mr. Wasmuth elected 'As a member of the Highway Committee from District #1. A motion was made and seconded to nominate Ernest Heglund as a member of the Highway Committee from District No. 2. Moved by Lattimer and seconded by Rude to close nominations. Motion Carried. Moved by Stuart and seconded by Moniza to instruct the Clerk to cast a unani- mous ballot for Mr. Heglund as a member of the Highway Committee from District #2. Motion Carried. The Clerk cast the ballot as directed and the Chair declared Mr. Heglund elected as a member of the Highway Committee from District #2. A motion was made and seconded to nominate Howard Sibbald as a member of the Highway Committee from District #3. Moved by Mammoser and seconded by Art Anderson to close nominations. Motion Carried. Moved by Mammoser and seconded by Lattimer to instruct the Clerk to cast a unanimous ballot for Mr. Sibbald as a member of the -Highway Committee from District #3. Motion Carried. The Clerk cast the ballot as directed and the Chair declared Mr. Sibbald elected as a member of the Highway Committee from District #3. Mr. Martin Olsen, Division Engineer, State Highway Commission, Superior, Wiscon- sin,' reported on highway construction, aids, surveys, etc., in Bayfield County. He stated that maintenance of highways will be similar to past years. The following Resolution was read: No. 4 PROVIDING FOR THE ADVANCE OR TRANSFER OF CONSTRUCTION FUNDS IN BAYFIELD COUNTY WHEREAS Section 84.03(5), Wisconsin Statutes, provides that the State Highway Commission and County Board, or a County Highway Committee when authorized by the County Board, may agree upon the advance of one or more future years' allotments for such county under Section 84.03(3), to be expended on selected improvements on state trunk highways or connecting streets within such county to the extent so agreed, and WHEREAS occasions frequently arise when it is necessary or desirable to provide for the advance, allocation, or transfer of construction funds to or between previously 36�a November 15, 1966 authorized or additional needed construction improvements on state trunk highways or connecting streets in this county. THEREFORE, in order to provide for promptly making available the funds necessary for such improvements and to avoid the delay and expense incident to calling a special meeting of this board for such purpose, BE IT RESOLVED that the State Highway Commission be and is hereby petitioned to advance pursuant to Section 84.03(5), Wisconsin Statutes, upon the filing of a request therefor by the County Highway Committee of this county, which said Committee is here- by authorized to file, such sums as may be required and are not otherwise available for any such previously authorized or additional needed construction improvements in this county, with the understanding that the amounts thus advanced will be deducted from future state allotments for state trunk highway construction in this county under Section 84.03(3) of the Statutes, and BE IT FURTHER RESOLVED that the State Highway Commission be and is hereby peti- tioned, upon the filing of a request therefor by the County Highway Committee of this county, which said Committee is hereby authorized to file, to transfer to or between any such previously authorized or additional needed construction improvements in this county, any funds allotted by the State under the provisions of Section 84.03(3), Wisconsin Statutes, and previously allocated to any other improvement- or remaining unallocated in reserve. The following Resolution was read: No. 5 COUNTY AID CONSTRUCTION & MAINTENANCE DURING THE CALENDAR YEAR 1967 Notice: Section IX on page 4 of this resolution authorizes the County Highway Commissioner, subject to supervision and control by the County Highway Committee, to employ, discharge, suspend, or reinstate county highway personnel. This change in form was made in 1945 in view of Attorney General's opinions dated March 6 and March 24, 1945. If this form conflicts with any existing general rules or civil service plan, or if the County Board wishes to limit the authority which would be conferred by this provision, the attached form should be appropriately altered in consultation with the District Attorney. Attention is directed to the fact that any action taken by the County Highway Committee in exercising its powers must, to be effective., be recorded in the minutes of the County Highway Committee's meeting. - November 15, 1966 COUNTY AID CONSTRUCTION AND MAINTENANCE DURING THE CALENDAR YEAR 1967 SECTION I. The County Board of Supervisors of BAYFIELD County, Wisconsin, reg- ularly assembled, does hereby ordain that such funds as may be made available to the county for highway work in the year 1967 under the provisions of Section 20.420 and Chapter 83 of the Statutes, and the additional sums herein appropriated, shall be expended as hereinafter set forth; SECTION II. COUNTY TRUNK HIGHWAY ALLOTMENT. WHEREAS the State Highway Commission has notified the County Clerk that a sum of money estimated to be Two Hundred Fifty- eight Thousand, Five Hundred Dollars ($258,500.00) will become available at the end of the fiscal year under the provisions of Sections 83.10 and 20.420(3)(xg) and (3) (xm) of the Statutes, for the county trunk highway system in the county, but the actual amount will not be known until the close of the fiscal year ending June 30, 1967.. BE IT RESOLVED that the County Highway Committee is authorized and directed to expend the said sum to the extent required to match and supplement Federal aid for construction, right of way, and other costs on any Federal projects located on the county trunk highway system of said county, which are not recovered from Federal funds, and to expend any balance for constructing, repairing, and maintaining such county trunk highway system and the bridges thereon, including snow and ice removal and con- trol, as directed in Section 83.10(1) of the Statutes, and to reimburse the general fund for any expenditures that may be made therefrom pursuant to Section 83.01(6) of the Statutes. The distribution to such purposes is estimated, but not specifically directed, to be as follows: For construction -maintenance, snow and ice removal and control on"the County Trunk Highway System. The County Clerk is directed to levy the special benefit assessments made herein - as special charges against the respective municipalities as provided by law. SECTION VII. WHEREAS the various highway activities for which provision is made in this resolution are continuous from year to year; and the exact cost of any work cannot be known at the time of making the appropriation therefor, BE IT RESOLVED that this Board does hereby direct that any balance remaining in any appropriation for a specific highway improvement after the same shall have been completed may be used by the County Highway Committee to make up any deficit that may occur in any other improvement which is part of the same item in the county budget, for whichprovision is herein made, and any balances.remaining at the end of the year in any highway fund shall remain and be available for the same purpose in the ensuing year. SECTION VIII. WHEREAS the exact amount of the funds that will become available from the state for highway purposes in the county under Section 20.420 of the Statutes will not be known until on or after June 30, 1967. BE IT RESOLVED that -the County Treasurer is hereby authorized and directed to make payments for the purposes for which such funds are to be used, as hereinbefore authorized, from any funds in the county treasury that are not required for the purpos- es for which appropriated prior to August 1, 1967, and to reimburse such funds in the county treasury from the sums received under Section 20.420 of the Statutes. SECTION IX. WHEREAS the County Highway Committee and the County Highway Commissio er are charged with the duty and responsibility of carrying out the construction and � maintenance of highways for which provision is made, and other related supervisory November 15, 1966 and administrative duties. BE IT RESOLVED that the County Highway Commissioner shall have authority to employ, discharge, suspend, or reinstate such personnel as he'deems necessary for such purposes, provided however that the County Highway Committee may by action recorded in its minutes determine the number of persons to be hired and may also at any time by action so recorded order the County Highway Commissioner to employ, discharge, suspend, or reinstate any such person. The term "personnel" or "person" shall include all patrolmen, laborers, foremen, clerks, stenographers, or other employees necessary to carry on such activities. The following Resolution was read: No. 6 PURCHASE OF HIGHWAY EQUIPMENT BAYFIELD COUNTY WHEREAS for the construction and maintenance of highways, including the removal and control of snow and ice, it becomes necessary from 'time to time to purchase equip - went, the nature of and necessity for which cannot be accurately anticipated. THEREFORE BE IT RESOLVED that the County Highway Committee is hereby authorized, pursuant to Section 83.015(2) of the Statutes, to purchase without further authority, and to the extent that revolving funds accumulated for such purpose or appropriations made for such purpose are available, such highway equipment as they deem necessary to properly carry on the work, and to trade or sell such old equipment as may be consider- ed to be for the best interests of the county; Resolution presented Nov. 15, 1966 Walter Wasmuth The foregoing resolution was adopted on ,Nov. 15, 1966. The following Petitions were read: No. 7 County Aid Bridge Section 81.38 TO THE COUNTY BOARD OF SUPERVISORS., BAYFIELD COUNTY, WISCONSIN GENTLEMEN: This petition of the Town of Kelly, Bayfield County, Wisconsin, respectfully represents and shows to your honorable body that: The bridge known as the White River Bridge on the road known as the Maple Ridge Road in the Northwest Quarter of the Northwest Quarter Section 29, Township 46 North, Range 5 West, on a public highway maintainable by the Town of Kelly, requires a re- placement in"aceordance with the provisions of Section 81.38 of the Wisconsin Statutes., The'Town of Kelly has provided for such portion of the cost of replacement as is required by Statute. The total cost of such replacement is $1150.00. Wherefore, Petitioner prays and makes this petition to your honorable body for County Aid for one-half of the cost to said Town, in the amount.of $575.00, all in accordance with the provisions of Section 81.38 of the Wisconsin Statutes. Motion Carried. 3771 November 15, .1966 The following Communication and report was read: No. 21 October 6, 1966 TO ALL COUNTY BOARD CHAIRMEN AND COUNTY CLERKS RELATING TO SUGGESTED ITEMS TO BE PLACED IN THE COUNTY BUDGET Gentlemen: You will recall that at the recent Wisconsin County Boards Association conven- tion in my address to the convention I suggested that counties seriously consider placing in their budget amounts to cover dues to the National Association of Counties and to cover a proposed labor management service for Wisconsin Counties. NACO DUES Enclosed with this letter is a schedule of dues for all of the counties as set forth by the National Association. About 12 counties now already belong to the National Association. In view of thv any federal aid programs now available to counties, it appears that.it would be good judgment on the parts of all counties to join the National Association so that they could readily be informed fully on the opportunities under federal aid programs, including guides describing eligibility, types of projects for which aid is given, and full details on how to participate. The NACO staff in Washington will aid and assist subscribing counties and their officials in matters before the Congress and in the executive departments. It would appear that the time has arrived when every county should have available to them a source of information in Washington, D. C. for national problems, as well as the Wisconsin County Boards Association at Madison as a source on state problems. We earnestly advise that you give consideration to placing fees in your county budget for membership in the National Association of Counties this fall. COUNTY CO-ORDINATOR OF FEDERAL AIDS In connection with the above membership in the National Association of Counties, we would suggest that you appoint some person as a county co-ordinator of federal aids and notify the Washington office who the person is to receive the material and data that will be available to your county. This person could also analyze all of this data and make it readily available to the Standing Committees of your county boards for their consideration. PROPOSED LABOR MANAGEMENT SERVICE In the September issue of WISCONSIN COUNTIES on page 21 is an article giving in detail the proposed labor management service that I spoke about at the convention as being a joint venture with the League of Wisconsin Municipalities and the County Boards to supply information and services and to act as a clearing house for informa- tion relating to municipal labor relations. Included in the article was a proposed dues schedule which was based on the number of full-time employees in the county which are presently organized by the unions, or which will very probably be organized, such as your county highway departments and institutions. We suggest that you carefully read -the article in the September issue -- also contact your county highway commissioner and committee and probably your trustees of institutions and your superintendent to see what they think of such a plan. If the response is favorable, we would suggest that you place an, item in your county budget to cover the proposed annual charge for such service. This would guarantee that when the Service -Agency is organized and ready to begin that dues could be collected to cover its operations. CONCLUSION We believe that the items that we have raised in this letter are of great im- portance to county government, and hope that they will be given favorable considera- tion by your Finance and Budget Committees and also on your county board when it comes up for action in your fall session. A. The Resolution referred to requests the cooperation of the Conservation Committee in obtaining funds from governmental agencies to establish a public park and boat landing on the White River in the Village of Mason. It is the recommendation of the Conservation Committee that the Village of Mason submit a written application for the proposed project to the Conservation Committee of the County Board. The Committee will study all the proposals submitted'and applications will be made for any available funds to assist in financing any project that is approved by the committee. The Committee further recommends that all applications for Conservation pro- jects proposed by any municipality be submitted at an early date so that application for funds can be made gs soon as possible. The Committee is of the opinion that this would result in a saving to the County as a higher trade-in price will be realized when the cars are traded in early in the Fall. After a lengthy discussion the following Ordinance was presented to the Board. No. 46 SANITARY ORDINANCE for Bayfield County, Wisconsin The County Board of Supervisors of Bayfield County does ordain as follows: SECTION 1.0 - General Provisions 1.1 The jurisdiction of this ordinance shall apply to all the lands within Bay - field County except within the corporate limits of cities and villages which have adopted codes or ordinances expressly covering the same subject matter. 1.2 No sanitary facilities or part thereof shall be installed, altered or their use changed without compliance with the provisions of this ordinance and other applic- able local and state regulations. 1.3 Sanitary facilities for purposes of this ordinance shall include: (1) Plumbing as defined in. Sections 145.01 (1), (a) (c) (d) and (e) of the Wisconsin Statutes. (2) The Construction, connection to or alteration of any drain, soil or waste pipe to carry domestic sewage, storm water or industrial waste from a point three feet outside.of the foundation walls of any building to the sewer lateral at the curb or other disposal terminal including the private sewage disposal or treatment plant. This definition does not include minor repairs to faucets and the removal of stoppages in soil or waste pipes. (3) Private well and pump installation as provided in Chapter H 55 Wis- consin Administrative Code. Section 2.0 - Adoption -of 'State Requirements by Reference. This ordinance is adopted in addition to the applicable rules, regulations and laws as set by the Wis- consin Statutes and the Wisconsin Administrative Code. Chapter 145, Wisconsin Statutes and Chapters H 55, H 61, H 62, H 63, H 65, and H 66 which are hereby made a part of this ordinance by reference and shall apply until amended and then shall apply as amended. November 16, 1966 IWI SECTION 3.0 - Sanitary Permit Requir.6d for Sanitary Facilities. Cases Where Permit is Required: 3.1 Work on a structure or use requiring a private sewerage or water system shall not begin until a sanitary permit has been issued.. 3.2 No private sewerage or water.system shall be constructed until,a sanitary permit has been issued. 3.3 A sanitary permit shall not be issued for any structure or use open to the public which requires a private sewerage or water system until the plans for such sys- tems have been approved by the State Board of Health or other state agency authorized by law to make such an approval. 3.4 No new plumbing or alterations to present plumbing shall be made until a sanitary permit has been issued. Cases Where Permit is not Required: 3.5 No sanitary permit will be required for making minor repairs to faucets, valves, pipes, appliances and removal. -of stoppages. Stoppages and repairs are defined to consist of fixing leaks and removing of obstructions in the plumbing drainage pip- ing and to restore defective valves, faucets and similar appliances to an efficient operating condition. 3.6 No sanitary permit will be required for the replacement of existing plumbing fixtures. SECTION 4.0 - Private Sewage Disposal Systems 4.1 General: The following rules shall apply except where special conditions exist which because of practical difficulty and unnecessary hardship would justify the granting of a variance as provided in Section 11.0 of this ordinance. Provided further that on lots of 10 acres or more in area, the sanitary inspector may grant a permit if the method of sewerage disposal is conducted in compliance with provisions of 5.2 of this ordinance. (1) No site for a private sewerage system shall be approved where there is less than 4 feet of undisturbed soil between the bottom of the tile field or seepage pit and ground water or bedrock. (2) No site shall be approved for a private sewage disposal system where the percolation rate is less than 1 inch in 60 minutes. Seepage pits shall not, be installed where the percolation rate is less than 1 inch in 30 minutes. (3) A private sewage system may be installed only where no public sewerage system is available or likely to become available within a reasonable time as determined by the County Zoning Committee. (4) When a public, sewerage system becomes available, the private system shall be discontinued and connections with public sewer shall be made within 60 days. (5) No storm water, roof drains, footing drains, clear water drains, shall r' discharge into a private sewage disposal system. (6) Laundro-mats and other commercial -laundries shall not be connected to a private sewerage system but must be connected to a public sewerage system. 4.2 Septic or treatment tanks. (1) Only septic or treatment tanks as approved by the State Board of Health shall be installed or constructed. (2) Sizes Septic tank size shall be based upon the number of persons using the building to be served or upon the nature of use and type of waste. The minimum septic tank capacity before the outlet shall be 750 gallons. Additional November 16.; 1966 capacity shall be required..as provided in .Section H 6.2.20 (1) Wisconsin Admin- istrative Code. (3) Location: No septic tank or treatment tank shall be located within 5 feet of a building used for human occupancy, 10 feet of a lotline, 10 feet of any cistern or basement, 50 feet of a well or water source, and 25 feet from the ordinary highwater mark of a watercourse, stream, or lake. Where practical greater distances shall be provided, all such distances. shall be measured horizontally. (4) All domestic wastes shall enter the septic or.treatment tank unless a permit for a sewage holding tank has been granted by the Zoning Committee. (5) The slope of the sewer 10 feet preceding the septic or treatment tank shall not exceed one quarter inch per foot. (6) The inlet and outlet pipes between the septic or treatment tank to stable ground shall be cast iron with lead and oakum joints, or other pipes and joints approved for this purpose by the State Board of Health or other state agency designat- ed by law to make such an approval. (7) Maintenance: Septic tanks shall be cleaned whenever the sludge and scum occupies one-third of the volume of the tank. 4.3 Seepage or drainage system. (1) Percolation Tests - Percolation tests and soil boring tests shall be done in accordance with Section H 65.06 (3)9 (4)9 (5), of the Wisconsin Administra- tive Code, and shall consist of 3 test holes uniformly over the proposed absorption field. (2) Effluent Disposal. a;. Seepage Trenches shall not exceed 100 feet in length and should be from 2-3 feet in width, and laid at a grade of 2-4" per 100 feet. Lines of tile in trenches shall be at least 10 feet apart, The depth of the trenches shall have at least 12" of coarse gravel or crushed rock beneath the tile, and at least 2" above the tile. Fresh air inlets shall be provided at the end of all the tile lines. The absorption area required for a tile field shall be determined as provided in Section.H 62.20 of the Wisconsin Administrative Code. b. Seepage Pits. 1. Seepage pits shall be used only when deeper soil formations are more porous than the upper soil and shall not be installed where the percolation rate is less than 1 inch in 30 minutes. 2. Seepage pits shall not be installed in areas where shallow wells are used for potable water supplies. 3. Seepage pits shall be constructed of concrete block or brick lay- ed, without mortar. The bottom shall be left open. The pit shall be at least 5 feet in diameter and have a liquid depth below the inlet of 6 feet. The cover shall be provided with at least a 20-inch manhole and extend to within 12" of the ground surface, It shall be provided with a fresh air inlet of at least 2 inches with a return bend at least 12 inches above the ground surface. The absorption area required for a seepage pit shall be determined as provided in Section H 52.20 of the Wisconsin Administrative Code. (3) Location of effluent drainage systems. a. Subsurface absorption systems shall be kept 100 feet from any water supply well, 50 feet from the ordinary high watermark of any stream, lake or watercourse, 25.feet from any dwelling or cistern, 10 feet from any lot line and November 16,,1966 25 feet from any bank. at the edge of a lake, stream or water courser All such distances shall be measured horizontally. 4.4 Soils. Certain soils in Bayfield County have severe or very severe limitations for successful operation of soil absorption sewage disposal systems because of slow per- meability, shallow impermeable bedrock, high ground water or steep slopes. Locations and descriptions of these and other soils are given in the Soil Survey of Bayfield County Wisconsin U. S. D. A. Soil Conservation Service Series 1939, No. 30 issued April 1961. (1) The following soils shall not be used for sewage disposal systems which operate by soil absorption because of the very severe limitations which they embody. On -site investigation of the morphology and classification of soils is required before sewage disposal systems which operate by soil absorption may be installed. Installations shall be prohibited on very poorly, poorly and somewhat poorly drained soils included herein. An applicant desiring to install soil absorption sewage disposal facilities in sites where soils in groups (1) or (2) above are mapped shall have an opportunity to present evidence contesting the soil classification of the site at a public hearing as provided in Section 11.0 of this ordinance if he so desires. Thereafter the County Zoning Committee may affirm, modify or change the classification. The applicant shall have additional on -site investigations made including percolation tests; obtain the certification of a soil specialist that specific areas lying within these soils are suitable for the proposed facility; and meet the State Board of Health and other state regulations. Upon con- sideration of the factors listed above the Zoning Committee may attach such conditions in addition to those otherwise listed that it deems necessary to fulfill the purpose and intent of this ordinance. Violation of any of these conditions shall be deemed a violation of this ordinance. 4.5 Minimum Lot Area. The area of any lot shall be sufficient to permit the use of a sewage absorption system. The minimum area, width, length and elevation of a lot shall be determined as provided in Sections H 65.03, H 65.04, H 65.05 and H. 65.06 of the Wisconsin Administrative Code, unless more restrictive requirements are contained elsewhere in this ordinance or other applicable county, town, city or village ordinances. Servicing SECTION 5.0-7Sewerage Systems 5.1 General Septic tanks, seepage pits, grease traps, privies and other sewage disposal systems shall be serviced in accordance with Chapter H 66 of the Wisconsin Adminis- trative Code. 5.2 Sludge Disposal Sludge, scum, and effluent from septic tanks and any other material removed from sewage disposal units, all hereafter referred to as sludge, shall be disposed of in°such manner as not to create a nuisance or menace to public health. Unless otherwise authorized by the Sanitary Inspector the sludge shall be disposed of as follows: Discharge Into a Public Sewerage System when practical. The point and method of discharge into thee -system shall be subject to the re- quirements of the municipality. Discharge at a Disposal Site designated by a city, village, or town for such purpose, or In the Absence of a public sewerage system or designated disposal site by burial under eighteen (18) inches of earth on the premises on which produced at a distance of at least one hundred (100) feet from a well or if on other premises at a distance of at least 500 feet from a place of habitation provided that there is also at least 18 inches of soil between the buried sludge and the ground water level or limestone rock or by spreading on land, not used for pasturing livestock or for November 16, 1966 growing vegetables, at.a distance of 1000 feet from a place of habitation. The Sludge Shall Not Be Disposed of by discharge into a lake, watercourse, ditch, or dry run nor be deposited within 100 feet of such watercourses or body of water nor within 100 feet of those soil types enumerated in Section 4.4 (1) of this Ordinance. SECTION 6.0 - Private Water Systems 6:1 Well construction and materials shall be as specified in Section H 55.059 .069 .07, .09, .11 and .15 of the Wisconsin Administrative Code. 6.2 Location - Well shall be located as specified in Section H 55.04 of the Wis- consin Administrative Code except they shall not be located closer than 50 feet from any septic tank, 100 feet from any seepage pit or drainage.field. 6.3 Well water samples shall be submitted to the state laboratory of hygiene and construction reports shall be submitted to the State Board of Health and the well own- er as specified in Section H 55.08. SECTION 7.0 Sanitary Permits 7.1 An application for a sanitary permit shall be made by the home owner if in- stalling plumbing in his home or by the Master Plumber in charge of supervising the installation, to the County Zoning Administrator who shall issue a permit upon com- pliance with the provisions of this ordinance. Such a permit shall be posted in a prominent place on the premises prior to and during the period of construction and alteration. 7.2 Application shall contain the following information: (1) Name and address of property owner. (2) Name of person in charge of installation. (3) Legal description of property. (4) Type of proposed installation. (5) Type of occupancy, number of occupants or patrons and estimated water consumption. (6) Sketch indicating dimensions of lot and location of buildings. (7) Size and location of Sewage disposal system. (8) Location of wells, cisterns, streams, lakes, buildings, privies, septic tanks, seepage systems or other sources of pollution within 50 feet of the lot bound- aries. (9) The location of all percolation test holes and reports of each test and soil boring as run by a qualified person. Percolation tests in fill must be supple- mented by the information required in Section 4.4 (3) of this ordinance. (10) Depth. to ground water or bedrock if less than 8 feet. (11) Slope in feet per 100 or contour lines. 7.3 A permit shall expire when installation has not begun within one year from the date such permit is issued. 7.4 Permit fees shall be paid at -the time a permit is issued.The fees shall be the following: a. Minimum fee permit for minor alteration of existing facilities 6 1.00 b. New residential construction 3.00 c. Each additional inspection required to inspect correction 2.00 d. New commercial construction 10.00 e. Fee for Zoning Administrator to run percolation test 2.00 per hr. November 16, 1966 SECTION 8.0 - Inspection of Installation 8.1 It shall be the duty of the plumber in charge to notify the Zoning Adminis- trator whenever any work is ready for inspection (l.e., soil, vent, underground drain, septic tank disposal system final inspection). All plumbing work shall be left exposed until such time as the Zoning Administrator has completed his examination and inspection. When in the opinion of the Zoning Administrator a test is necessary, he may require a water or air test on any part of or the entire installation. 8.2 No person shall use or permit to be used any sanitary facility until it has been inspected and approved by the Zoning Administrator. SECTION 9.0 - Inspection and Abatement of Nuisances 9.1 The Zoning Administrator shall have the authority to inspect for improper sewerage systems and make tests necessary to determine the adequacy of such systems. 9.2 If a nuisance caused by an improper sewerage system is found on private pro- perty, the Zoning Administrator shall notify the owner and occupant of -such property by registered mail. The Zoning Administrator shall order that the nuisance be abated within 30 days of receipt of such notice. He shall also notify the County Board of the nuisance. 9.3 The County Board shall have authority to abate the nuisance or may contract to have the work performed if said nuisance is not abated within 30.days of receipt of notice by registered mail. The Board may delegate this responsibility to the Dis- trict Attorney. The cost of abatement.may be -recovered from the person permitting such violation or may be paid by the County Treasurer who shall enter the amount chargeable -to the property in the next tax roll as a special tax on the lands upon which the nuisance was abated which tax shall be collected as are other taxes. SECTION 10.0 - Administration 10.1 Zoning Administrator The provisions of this ordinance shall be' enforced under the direction of the County Board of Supervisors through the Zoning Committee and the County Zoning Admin- istrator. 10.2 Duties It shall be the duty of the Zoning Administrator to enforce the provisions of this ordinance and to: 1. Record all permits issued, inspections made, work approved, and other official actions; 2. Test all new private water supply -and sewage disposal systems upon com- pletion of the work in accordance with standard testing methods; 3. Investigate all complaints made relative to private water supply and sewage disposal systems. 10.3 Powers The Zoning Administrator shall have all the powers necessary to enforce the pro- visions of this Ordinance including the following: 1. Access to any structure or premise between 8:00 A.M. and 6:00 P.M., for the purpose of performing his duties; 2. Prohibit the use of any private water supply or private .sewage disposal system until he has inspected, tested and approved such system. . 3. Order any person, firm, or corporation owning, using, operating or in- stallinga private water supply or private sewage disposal system to modify it, repair it or place it in a safe or sanitary condition if he finds such system to .November,,16, 1966 be in a defective, unsafe or unsanitary condition. 4. Recommend to the County Zoning Committee any additional sanitary measures asshall seem -to him,.necessary. 5. Condemn and prohibit the use of any'private water supply or sewage dis- posal systems which he findsis so constructed, operated or maintained as to be a menace to the health of the users, neighbors or community as provided in Section 9.2 of this ordinance. 6. Appoint Deputy Zoning. Administrator for assistance in processing applica- tions for sanitary permits, upon the consent of the County Zoning Committee. Compen- sation for Deputy Zoning Administrators shall be determined by the County Board. 7. Enforce any or all of rules or orders and amendments thereto of the State_Agencies applicable to private water supply or sewage disposal systems. SECTION 11.0 - Right of Appeal and Hearing Any person whose application for a permit under this ordinance has been denied by the Zoning Administrator may request in writing and shall be granted a public hearing on the matter before the Bayfield County Zoning Committee within 30 days of receipt of such request. The Committee may grant upon appeal in.speci.fic cases and subject to appropriate.conditions and safeguards, a variance from the terms of this ordinance, where owing to special conditions, a literal enforcement will result in practical difficulty and unnecessary hardship. In evaluating a request for variance the committee may ask the. Supervisors of the Bayfield County Soil and Water Conser- vation District for expert assistance from those State and Federal agencies which are cooperating with said district under a memorandum of understanding. In granting a variance the Committee may attach conditions, without limitation because of specific enumeration, such as requirements for larger minimum lot size; installation of ridge and furrow disposal systems, provisions of sewage holding tanks and methods of sewage collection; adequate off -site disposal of wastes in a designated manner; and other requirements it deems necessary to fulfill the purpose and intent of this ordinance. Violation of any of these conditions shall be deemed a violation of this ordinance. Such variance shall be in conformity with state law; the public health, safety and general welfare; and the spirit of this ordinance. SECTION 12.0 - Penalties Any person, firm or -corporation found guilty of violating any of the provisions of this ordinance shall be fined not less than $10.00 nor more than $100.00, together with the full costs of such prosecution and each days failure to comply shall con- stitute a separate violation. Compliance with the terms of this ordinance may be enforced by injunctional order at the suit of the County or the owners of real estate within the area affected. SECTION 13.0 - Conflict of Ordinance, Effect on Partial Validity 13.1 In any case where a provision of this ordinance if found to be in conflict with a provision of any County zoning, building, fire, safety or health ordinance existing on the effective date of this ordinance, the provisions .that establish the higher standard for the protection of public health,..safety and general welfare shall prevail.. 13.2, _In any case where a provision of. this ordinance is found to be in conflict with a provision of .any other County ordinance, existing on the effective date of this ordinance which establishes a lower standard for the protection of the public health, safety and general welfare, the provisions of this ordinance shall be deemed to November 16, 1966 U7 N prevail, and such other ordinances are hereby declared to be repealed to the extent that they may be found in conflict with this ordinance. SECTION 14.0 - Definitions for the Purpose of this Ordinance are: 14.1 Drainage or seepage field - A shallow subsurface soil absorption system consisting of open jointed or perforated pipe for the disposal of effluent. 14.2 Percolation Test - A test used to determine absorption qualities of soils and shall be conducted in accordance with H 65.06 (3), (4)9 (5) of the Wisconsin Ad- ministrative Code. 14.3 Private Sewerage System - All structures, conduits, and pipe lines by which sewage is collected and disposed of outside the buildings being served, other than systems owned.and operated by a municipality or sanitary district. 14.4 Seepage Pit - An underground receptacle with a manhole and cover brought to within 12 inches of the ground surface for observation and cleaning purposes, so constructed .as to insure the disposal of effluent or clear wastes, by soil absorp- tion through its walls and bottom. 14.5 Septic Tank - A reservoir or tank which receives crude sewage, and by bac- terial action and sedimentation effects a process of clarification and decomposition of solids. 14.6 Sewage - The water -carried wastes created in and to be conducted away from residences, industrial establishments, and public buildings as defined in Section 101.1 Wisconsin Statutes. SECTION 15.0 - Severability Clause If any section, subsection, clause or phrase of this ordinance is, for any reason, -held to be invalid, such decision shall not affect the validity of the remaining portion of this ordinance. SECTION 16.0 - Amendment This ordinance may from time to time be amended, modified or altered by the County Board of Supervisors in the manner prescribed by law. LEDIN District Attorney Bayfield County Washburn, Wisconsin 54891 November 16, 1966 At the September, 1966 meeting you referred a question to my office concerning a request by Larry Woiak of the City of Washburn correcting a deed issued by Bayfield County to Henry Frechette on March 17, 1941. It was requested that the deed be chang- ed by the County to delete the name of Henry Frechette and replace it with the name of Larry Woiak, as grantee, on the assumption that an error was made when the original deed was issued as to the grantees. This deed has not been recorded. Larry Woiak has paid taxes on this property for about twenty years and it appears that he probably was the intended owner or at least had an interest in the property. I can not recommend that the deed be changed by the County Board. However, I do recommend that this Board go on record directing the County Clerk to issue an entirely new corrective quit claim deed to Larry Woiak covering Lot 17, Block 3, Neil & Pratt's Addition to the City of Washburn, reciting in the deed that Bayfield County claims no interest in said property and gives this deed only for what purpose it may serve in correcting the title. Moved by Meierotto and seconded by Rude to adopt the foregoing Resolution., Motion Carried. 41� November 16, 1966 A Report by the Bayfield County Welfare Director was presented to the Board and reads as follows: No. 54 To The Bayfield County Board of Supervisors: The year 1966 saw the enactment of a great piece of social legislation, both on the federal_ and state level. This was the enactment of the 1965 amendments to the Social Security Act. On the federal level, it was termed Title XIX, or Medicare, and Title XVIII, Medical Assistance or Medicaid. On the state level, this legislation was presented in the form of Senate Bill 621S which provides for the continuation of money grants to the aged, blind, disabled, and to dependent children, and does remove the maximum money grants for which a recipient is eligible, so that effective July 1, 1966 all recipients receive money grants according to their basic needs. This same legislation not only expanded the present welfare._programs, but increased the programs to include Old Age Assistance to people in mental hospitals, Aid to Dependent Children for children in institutions, and Aid to Dependent Children of un- employed parents. On the state level, the further enactment of Title XVIII, which is termed Wisconsin Medical Assistance, will provide medical assistance to persons sixty-five years of age and older, and for children under the age of twenty-one living in families determined to be medically indigent because of income limitations of the parents. Eligibility in both programs is based on the amount of assets and the amount of income. This medical assistance, in effect, replaces the previous medical assist- ance to the recipients who received their medical care authorized and paid for by the County Welfare Department and also replaces the Kerr -Mills Medical Assistance Payments Program. Because of the above mentioned changes in legislation which affect this depart- ment, I will be unable to give you any significant graphs or charts to show you the agency's operating expenses for the year 1966 as I have done in the past because there has also been a change in the formula whereby the counties are reimbursed for expendi- tures made in behalf of welfare recipients. At this time, I can only state that Senate Bill 621S provides that no county shall be responsible for any more than they were for the fiscal base year 1964-1965. I can advise you that the cost of Bayfield County's expenditures for'the base year was $99,432.05. The caseloads too, at this time, will not give a representative picture of agency function. I can report that for the first six months of the year our Old Age Assist- ance recipients averaged about two hundred fifty-five cases, our Blind Aid cases numbered five, our Disabled Aid cases numbered fifty-five, our Aid to Dependent Child- ren averaged from thirty-five to forty cases, and our Aid to Dependent Childredn in Foster Homes has varied between five and eight cases. These figures are listed on our monthly case counts. The new legislation has changed our case counts, as for instance, people receiv- ing Old Age Assistance, living in skilled nursing homes and having sufficient personal income such as retirement or social security, were discontinued from our money payment caseload as of July 1, 1966. These people are, therefore, only certified as recipients of Medical Assistance. Also, because of the new S-72 Social Security Benefits, we will again be removing other persons over the age of seventy-two from our money pay- -ment caseloads, and we are presently not aware of the number of cases that we may have to put on because of those people living in mental institutions, dependent children living in mental institutions, and the number of families that will be applying for November 16, 1966 - Aid to Dependent Children because of unemployment of the parents. I have indicated that we have removed certain people from our Old Age Assistance payroll. However, these people have been certified for medical assistance. At the end of June, our clients certified for the Health Assistance Payments Program numbered 119, and we now have 300 cases certified for Medical Assistance. Because of the change in status of the caseloads, in some areas we may show a reduction of caseloads. However, at this time, we do not know what the state and federal requirements will be for providing social service to those prople certified for the Medical Assistance program. Beginning in February, this department began providing homemaker services to clients in their own homes. Our one homemaker is providing a much needed service to ten persons or families each month. This service, provides the clients an opportunity to gain exper-ienc.e in budgeting, food preparation and meal planning, child care, and other duties essential to maintaining a satisfactory home life for the clients. Although there are no county funds involved in the administration of Indian Relief, I make this report because the agency is involved in the determination and issuance of relief to needy Indians. During the first eight months of 1966, the total expenditures for Indian Relief were $3,518.57, or approximately $440.00 a month. At this rate, the department should spend approximately $5,300.00 for the year 1966 on the Indian Relief payroll, compared to the total expenditure of $8,698.48 for the year 1965. The Surplus Commodity Program continues to provide surplus foods to needy people of Bayfield County and this program has had a reduction in the total amount of re- cipients. For example, for the month of September, there were only 811 recipients and about 865 people certified as eligible to receive commodities. This figure has changed considerably from the report of 1965 as during this same period in 1965, there were 1,140 recipients. The cost -to distribute the commodities for the first eight months of 1966 totaled $4,740.80, roughly $593.00 per month, as compared to $766.00 per month for the same period during 1965. I would, therefore, conclude that providing there is no major change in the economy, Bayfield County could continue distribution of surplus foods at a cost of $8,000.00 a year. The year 1966 also saw a revised merit system plan for the State of Wisconsin which affects all the employees of the Welfare Department. This however is a delayed revision as, according to the state plan, this revision should have been due in 1965. According to the revised merit system plan, your Bayfield County Welfare Board has adopted Schedule B for the employees of the department® As mentioned above, the agency does not know what requirements the state and federal government will make in the provision of service to clients. I, therefore, would like to again call your attention to the lack of adequate interview facilities within the department. This matter has been discussed by the current Welfare Board, and I respectfully request that consideration by the.Board of Supervisors be given to provide the agency with adequate office facilities necessary for the duties and func- tions of the personnel within the department. As the Department has no means to gain experience in arriving at an appropriate budget request so that I could provide the entire Board with graphs and charts, I am only submitting one chart showing the estimated total expenditures for the year 1967, the reimbursements and the county costs, and this should also be the budget request for 1967. I, therefore, give this brief explanation that the money grant November 16, 1966 requests for.Old Age Assistance, Blind Aid, -'Disabled Aid, Aid to Dependent Children, and Aid to Dependent Children in Foster Homes is based on the money grant expenditures for the month of August. As there is no means of estimating the amount the county will have to spend for Old Age Assistance to people in mental institutions, for Aid to Dependent Children in institutions, and for the new Aid to Dependent Children of Unemployed Parents, I am only making an estimate as to what this might cost the county and am not making a request for each separate program. Regarding the county's cost for the Medical Assistance Program, I can report that the total expenditure for medical assistance for all cases in a twelve month period has been $328,357.00. For the Health Assistance Payments Program, which will now become a part of the Medical Assistance Program, the total cost for the fiscal year 1964-65 was $29,000.00. Therefore, the total medical expenses that the county may be responsible for would be in the neighborhood of $357,357.00, and because we still do not know the amount by which Medicare might reduce these medical assistance payments, I am therefore recommending what appears to be a sum sufficient for Medical Assistance as Senate Bill 621S provides that the county will be responsible for its pro rates share of all medical expenses. REPORT OF CONSERVATION COMMITTEE FOR 1966 OUT DOOR SHOWS The following out door sport shows attended were, DesMoines, Iowa, Chicago, Ill. Milwaukee, Wis., and Minneapolis, Minn. The attendance of these shows have increased from year to year with vacation minded people. We purchased 75,000 folders, 15,000, bags and 50,000 cards. We run short on bags and folders as we had requests from sporting goods stores and Chamber of Commerce Information Booths. We think this is good advertising. The Committee plans on attending only two shows in 1967, Chicago and Milwaukee, so there will be less Map Folders purchased. COUNTY PARKS Twin Bear Park and Delta Park were overcrowded as usual due to the fact that there was no man power available. No improvements were done to either of the parks. The Committee agrees that something must be done to improve the accomodations or there will be a slum area in our parks. WATER SHED & STREAM IMPROVEMENT This year we had projects on stream improvements as follows: Town of Pratt, 18 Mile Creek; Town of Clover, Cranberry River, Town of Port Wing, Flag River, 18 Mile and Cranberry have been completed. We believe that this work should continue on other streams in the County with probable funds from other sources. DAMS & SURVEYS Surveys have been made on the proposed dam.and locks between the Upper and Middle Eau Claire Lakes. A. permit for construction of the structure has been granted by the Public Service Commission. Estimates will have to be made as to total cost and the Town of Barnes' approval to share some of the cost will be necessary before construc- tion can begin. The Totogatic Lake Survey was made, as of this date the Committee has made no request for a permit from the Public Service Commission to construct a dam there. The following Budget for 1967 was presented to the Board: No. 70 PROPOSED BUDGET FOR THE YEAR 1967 TO THE HONORABLE BAYFIELD COUNTY BOARD OF SUPERVISORS Gentlemen: We, the undersigned Committee on Finance and Budget, hereby submit our report and recommendations for 1967. November 16, 1966 VALUATION The Supervisor of Assessments recommends a true value of $47,805,865.00. -The legal levy limit exclusive of debt items for County general purposes is 1%. The proposed Budget is $50,000.00 below the legal limit. The Contingency Fund is $40,186.94. A larger than normal contingency fund is being provided due to the changes.made in the Welfare medical programs. No definite information is available at the present time regarding the county's share of medical payments to be made under Title 19, the new state medical assistance program. FINANCE The committee has kept all Budgets intact as recommended by the various committees. This committee strongly urges the adoption of the State Bureau of Per- sonnel's recommendations as to salaries. Finances for salary increases have been provided for in the Budget. The committee will again introduce a resolution author- izing short term loans if it becomes necessary. There is also an item for $30,222.00 to cover county share of past service retirement costs. Paying the total amount of the past service cost this year would save the county upwards of some $30,000.00. HIGHWAYS AND BRIDGES Highway expenditures are financed entirely from gasoline and automobile revenues, with the exception of County Bridge Aid to Districts. The Bridge Aids for 1967 amounts to $1,218.64. AUDIT The 1965 report is on file in the County Clerk's office and is available for inspection. The audit was completed on schedule on October 15th, and greatly aided the committee in their budget work. We would also wish to commend the county Clerk's office for the up to date bookkeeping records and information which resulted in the completion of the Budget work in two days as compared to four days average in the past. The Clerk recommends some changes in account classification so as to assist and make it more convenient to complete the state reports. The committee supports these recommendations. The committee also feels that with the chairman of all the other committees serving as the Budget Committee is of great value in the prepara- tion of the Budget. We recommend the acceptance of the audit proposal for 1966 records. HEALTH & WELFARE There is a great change in the Welfare items in the Budget as the figures in- dicate. The effect of the Medicare Program reflects these changes. The Rest Home is operating at full capacity. The Pureair Sanatorium operation is of some concern because of the low patient load. The Board of Trustees together with the Chairman of the Finance Committees of the three counties are to further study and recommend solutions to the problem.
