SPECIAL MEETING OF THE BAYFIELD COUNTY BOARD OF
SUPERVISORS
The meeting was called to order at 9:30 A. Mr. by Walter C. Barningham, County
Board Chairman.
The following members answered -Roll Call: No. 1

Due to the fact that I will remove from the Town of Barksdale within a few
days and my office as Bayfield County Supervisor for District No. Eleven will become
vacant by law, I hereby tender my resignation as such County Supervisor to the
Sheriff of Bayfield County, pursuant to the provisions of Section 17.01 (7) of the
Wisconsin Statutes, said resignation to be effective upon delivery of this resign-
ation by the Sheriff to the Bayfield County Clerk.

County Board of Supervisors for the balance of the term. Your appointment will be
effective August 12, 1969. I am also appointing you to serve as a member of the
Conservation, Forestry, and Fencing Committee of the County Board.
The appointment will be presented to the County Board at their next meeting for
approval.

Gentlemen:
We want to express our approval of the appointment on August 12th of Mr. Clar-
ence Olsen as Supervisor of the llth District,Bayfield County for the unexpired term
of Mr. George Sampson.
Mr. Olsen is well qualified for this office. He was Town Chairman of the Town
of Barksdale for many years. The voters re-elected him to this office every time he
was a candidate. He held this office until he resigned several years ago to become
Highway Commissioner of Bayfield County. This position he held until he retired.
Because we believe Mr. Olsen is well qualified for this office, we recommend
his confirmation.

A motion was made by Stuart and seconded by Mammoser that Mr. Olsen be seated.
A motion was made by Bertyl Nelson and seconded by Erickson that a ballot vote
be taken on the foregoing. Motion carried.

Mr. Howell was allowed the floor and questioned as to whether Mr. Olsen had
the right to vote. District Attorney Robert N. Ledin responded that Mr. Olsen is
construed as being a member of the board as per his appointment by Chairman of the
Board, and therefore, he has the right to vote.
The ballot vote taken was as follows::

Nayes - 8
Total - 20 The Chair declared Mr. Olson seated as Supervisor.
Mr. Richard Olson, Vice Chairman of the Hospital Board, was allowed the floor
and gave a brief report on the progress of the Bayfield County Memorial Hospital
construction.
The fallowing Resolution was read: No. 5
WHEREAS, Bayfield County is now in the process of constructing a County Hospital
to be operated by the Bayfield County Memorial Hospital, Inc., lessee of said Bayfield
County, and
WHEREAS, The Board of Supervisors of said Bayfield County has heretofore provided
for a bond issue in the amount of $650,000.00 to finance said hospital construction,
and
WHEREAS, The total amount of said funds will be paid over to Bayfield County
upon execution and delivery of said bonds, and
WHEREAS, A substantial period of time will elapse before all of said funds are
used and paid out for said construction purposes, and
WHEREAS, It is deemed desirable that Bayfield County invest such of these funds
in certificates of deposit and Federal Government securities as may return to said
Bayfield County the greatest amount of interest income pending the use of said funds
for said hospital construction,
NOW THEREFORE BE IT RESOLVED, That the County Treasurer be and he is hereby
authorized and directed to invest such monies as he may have on hand as a result of
said bond issue as aforesaid which are not immediately required for said hospital
construction, in certificates of deposits in any bank in Bayfield County and in Fed-
eral Government securities or agencies thereof as set forth on Schedule "A" attached
hereto, and
BE IT FURTHER RESOLVED, That such investments be made as to draw the greatest
amount of interest income considering the necessity to have sufficient funds avail-
able to meet necessary construction contract payments, and
BE IT FURTHER RESOLVED, That said County Treasurer, with the assistance of the
Executive Committee, work out a schedule of investments of the aforesaid funds to
accomplish the aforesaid purpose of bringing the highest reasonable return to said
Bayfield County in interest income under such conditions as may assure availability
of said funds when needed for construction purposes.

It was moved by Erickson and seconded by Hanson that the foregoing Resolution
be adopted. Motion carried.
A motion was made by Moniza and was seconded by Rude to recess for ten minutes.
Motion carried.
Mr. George Moniza gave a report on the Jail matter. He stated that the State
and Federal Governments are ordering curtailment of all but emergency building pro-
grams due to the inflation in the building construction industry. Members of the
Executive Committee attending the County Board's Convention in Madison recently heard
the Governor make the direct request to the County Boards to co-operate with the State
and Federal Governments in the matter of building. Mr. Moniza stated that the Execu-
tive Committee had further studied the matter and they were recommending that the
Board continue working and planning for the jail construction, but that actual con-
struction be delayed for the present time.
Several questionswere raised at this time'by members of the Board and other
county residents. A number of Petitions regarding the Jail matter were presented.
Mr. George Sampson, former Supervisor, was allowed the floor and spoke in re-
gard to the jail.
Several members of the Board spoke in behalf of their districts to the effect
that they are in favor of curtailing any additional expenses at this time because of
the tax situation.

A motion was made by Stuart that the Petitions and the Town Resolutions regard-
ing the Jail be received and placed on file. The motion was seconded by Moniza.

RESOLUTION
WHEREAS, The Wisconsin Division of Correction has decreed that the Bayfield
County Jail at Washburn does not conform to State Statutory Standard, and
WHEREAS, Condemnation proceedings will be instituted unless remedial steps are
taken to bring the .existing jail up to acceptable for standards for its continued
operation, and
WHEREAS, The Bayfield County Board of Supervisors is presently considering adopt-
ion of one of two proposals submitted for bringing the existing jail up to said ac-
ceptable standards, and
WHEREAS, These two proposals were submitted to the taxpayers in attendance at
a Public Hearing at the Iron River School on September 3rd, 1969, and identified as
Proposal #1 and Proposal #2, and
WHEREAS, It was the overwhelming opinion of those in attendance at that Public
Hearing that the County Board of Supervisors should adopt, accept and activate
Proposal #1,
THEREFORE BE IT RESOLVED THAT, This Town Board of the Town of Barnes does strong-
ly urge the County Board of Supervisors to accept this mandate of their constituents
and adopt Proposal #1 as submitted to them by the Architect and Engineers employed
for that specific Purpose.

RESOLUTION

WHEREAS, The Town Board of the Town of Drummond, Bayfield County, Wisconsin,
recognized the need for modernization of the county detention facilities so as to
conform to the State of Wisconsin's penal code, and
WHEREAS, It is deemed both impractical and a violation of fiscal responsibility
to attempt remodeling of the existing detention facility.
NOW THEREFORE BE IT RESOLVED, That the Town Board of the Town of Drummond, Bay -
field County, Wisconsin., in session this 9th day of September, 1969, enjoins the Bay -
field County Board of Supervisors to adopt proposal number 2, as set forth by Archi-
tect Robert Novak, for construction of a modernlydetention facility that will meet re-
quirements of the State penal code and fulfill the needs of Bayfield County in the
foreseeable future.

RESOLUTION
WHEREAS, The Bayfield County Board of Supervisors is contemplating the adoption
of Proposal #1 or Proposal #2, as submitted to the people at a Public Hearing at the
Iron River School on September 3, 1969, pertaining to the remodeling or the building
of a new Bayfield County Jail,
WHEREAS, Proposal #2 would cause a burden on our taxpayers,
NOW THEREFORE BE IT RESOLVED, That we, the Town Board of the Town of Namakagon,
petition the County Board members to adopt Proposal #1.

PETITION
WE, the undersigned voters and taxpayers in Bayfield County,of the State of
Wisconsin, strongly urge the Bayfield County Board of Supervisors to adopt Proposal
#1, as submitted at the Public Hearing at the Iron River School on September 3, 1969,
in connection with correcting conditions at the Bayfield County Jail at Washburn
that do not meet State Statutory Regulations:

A motion was made by Stuart that we curtail repair or construction of the Jail
in view of the directives of the Federal and State Governments. The motion was second-
ed by Erickson. Motion carried.
The following Resolution was read: No. 8
WHEREAS, the enforcement of the Bayfield County sanitary ordinance is under the
direction of the County Board of Supervisors through the Zoning Committee as provided
by Section 10.0 of said ordinance, and
WHEREAS, in pursuant to Section 10.0 the Zoning Committee has approved the
appointment of a Deputy Zoning Administrator to enforce the provisions of the sanitary
ordinance, and
WHEREAS, Section 10.36 provides for the pay rate of Deputy Zoning Administrators
to be determined by the County Board,
NOW THEREFORE BE IT RESOLVED that the pay rate for the Deputy Zoning Adminis-
trator be $3.50 per hour.

The following Resolution was read: No. 9
WHEREAS, Sec. 145.15 Wisconsin Statutes require a State permit and a fee of
$10.00 to construct, alter or extend a private sewage disposal system, and
WHEREAS, the imposition of such permits and fees duplicate those at the County
and Township level, and
WHEREAS, such duplication is discouraging and detrimental to the development
and administration of local sanitary programs, and
NOW THEREFORE BE IT RESOLVED, that Sec. 145.15 of the Wisconsin Statutes be
repealed.

Subject: Retroactive Pay
Dear Mr. Moniza:
In compliance with Resolution #8 passed by the Bayfield County Board of Super-
visors on July 31, 1969, the Bayfield County Highway Committee submits the following
request.
As part of the final settlement of a two years agreement between the Highway
Department and the Teamster's Union Local 288, the Negotiating Committee for the
County agreed to recommend retroactive pay for the month of August, 1969.
The total amount of the retroactive pay is $ 2,041.81.
A complete list of the employees and the amount each is to receive is attached
to this request.

The following Resolution was read: No. 11
WHEREAS, by Resolution of the Bayfield County Board adopted on July 31, 1969,
payment of retroactive pay for County employees is restricted except by specific
recommendation of the Executive Committee and approval of the Bayfield County Board,
and
WHEREAS, the negotiation committee of the Highway Department has now reached an
agreement with the Highway employees, and
WHEREAS, said agreement provides for retroactive pay for August, 1969, and
WHEREAS, the Executive Committee has considered the payment of such retroactive
pay reasonable and just,
NOW THEREFORE BE IT RESOLVED, that rb.troactive pay for the month of August, 1969,
as set forth on the attached schedule be allowed.

held Sept. 10, 1969.

Moved by Moniza that the rules be suspended and that retroactive pay covered by
the foregoing Resolution be paid as soon as practicable and a transfer of funds to
cover said payment be made from the Contingency Fund to the proper account. This
motion was seconded by Wasmuth. Motion carried.
The following Resolution was read: No. 12, together with Memorandum of
Understanding
WHEREAS, The Wisconsin Conservation Commission is desirous of cooperating with
Bayfield County in the development and improvement of lands now entered under the
Forest Crop Law for recreation, wild life management and other conservation practices,
and
WHEREAS, It is necessary that a Memorandum of Understanding be entered into be-
tween Bayfield County and said Wisconsin Conservation Commission in the form attached
hereto and marked Schedule "A", and
WHEREAS, It is deemed in the interest of Bayfield County to enter into said
Memorandum of Understanding with said Wisconsin Conservation Commission,
NOW THEREFORE BE IT RESOLVED, That the Chairman of the Bayfield County Board of
Supervisors and the Bayfield County Clerk be and they are hereby authorized to enter
into a Memorandum of Understanding in the form set forth in Schedule "A" attached
hereto and to bind the County therein accordingly.

MEMORANDUM OF UNDERSTANDING
Memorandum of Understanding, made in duplicate this 29th day of September, 1969,
by and between the Wisconsin Conservation Commission, hereinafter called the Depart -
went and Bayfield County.
WHEREAS, many of the areas available to the public for recreational purposes
within the State of Wisconsin are located in the county forests, and
WHEREAS, it is recognized that the counties have accomplished considerable wild-
life management within the county forests, and
WHEREAS, Bayfield County is interested in having the county forests developed to
their fullest extent, and
WHEREAS, it is to the benefit of all concerned to have these lands developed, and
Z,IHEREAS, the Conservation Commission is interested in assisting in further de-
velopment of the wildlife on county forests,and
WHEREAS, the Commission cannot expend Pittman -Robertson or Dingell -Johnson funds
unless covered by a memorandum of understanding,

NOW THEREFORE, in consideration of the mutual advantages resulting from such
cooperation, the County Board of Bayfield County authorizes the Forestry Committee
of the County Board (which has been designated to administer the county forest lands
entered under the Forest Crop Law) to cooperate with the Conservation Department in
the use of said lands in such manner that the committee deems advisable when requested
by the Department.
That nothing herein contained shall be construed,as limiting or affecting in
any way the authority of the counties in connection with the proper administration
and protection of the county forests in accordance with the purpose for which the
lands contained therein were acquired and reserved.
That nothing in this agreement shall be construed as obligating the county to
expend any funds or as involving the county in any contracts or other obligations.
That in the event the wildlife management plans conflict with acceptable forest
management practices, and necessitate the withdrawal of forest crop lands, separate
and individual memoranda will be entered into covering the management of each area
by said committee and a designated state officer. The withdrawal of land from under
the Forest Crop Law shall be according to established procedures.
That all work contemplated in the county forest receive prior approval from the
committee herein designated before the work is initiated.
That whenever any other land or other facilities owned or controlled by the
county are to be used by the Department, such facilities shall be covered by a sep-
arate agreement between the Department and the committee in charge of direct adminis-
tration of said land or facilities.
That this agreement shall become effective as soon as signed by the parties
hereto and shall continue in force until terminated by either party upon thirty days'
notice in writing to the other of his intention to terminate upon a date indicated.
The committee of the county board responsible for the administration of the
county forests is the Forestry Committee.
IN WITNESS THEREOF, the parties hereto have executed this memorandum of under-
standing the day and year first above written.

Ray Anderson, County Fcmstry Administrator was called upon and introduced Don
Bublitz, Area Game Manager, who spoke in regard to the Pittmen-Robertson program.
Motion carried to adopt the foregoing Resolution.
The following Resolution was read: No. ;13

WHEREAS, The Bayfield County Board of Supervisors has heretofore by resolution
requested the withdrawal of the following described property from the Forest Crop Law,
to -wit the North One-half of the Southwest Quarter (N7/z of the SW/4) , Section Nine
(9), Township Forty-seven (47) North, Range Eight (8) West, said resolution being
dated February 11, 1969, and
WHEREAS, The Bayfield County Forestry Committee has reconsidered said proposal
and now recommends that said request for withdrawal be withdrawn and the aforesaid
resolution of February 11, 1969 be rescinded.
NOW THEREFORE BE IT RESOLVED, That the resolution dated February 11, 1969, pet-
itioning for the withdrawal of the above described property from the Forest Crop Law
be and the same is hereby rescinded and said petition for withdrawal is hereby with-
drawn.

WHEREAS, The Bayfield County Board of Supervisors has heretofore by resolution
requested the withdrawal of the following described property from the Forest Crop Law,
to -wit: the South One-half of the Northeast Quarter (S/� of the NEI/4), Section Nine (9),

SCHEDULE "A"
1. The rights of the grantee of such easement shall apply only to the particular
parcel of land granted in the easement and such grantee shall have'no right of any
nature whatsoever to enter upon adjoining County lands or lands outside.of the.right-
of-way for any purpose whatsoever-.
2. The easement grantee shall pay for all trees.and timber standing on said
right-of-way at the time the easement is granted at the regular going rates for stump-
age charged by Bayfield County, said stumpage to be estimated by the Bayfield County
Forestry Department.
3. The easement grantee shall refrain from spraying rights -of -way for the des-
truction of trees, shrubs and other plants without thereafter cutting and properly
disposing of the dead trees and shrubs on said rights -of -way resulting from said
spraying for the puupose of avoiding unsightly conditions', detracting from scenic
beauty and possibilities of fire hazards.
4. Said easement grantee shall have the right to cut and trim branches of trees
overhanging the right-of-way, but shall have no right to go outside of the right-of-
way to cut trees, pile brush and debris or to bulldoze and construct access roads,
except upon written consent of the Forest Administrator.
5. The easement grantee shall take all necessary precautions to prevent the
obliteration of landmarks relating to corners and monuments including all corners,
bearing trees, bench marks and other Government and private survey references. The
easement grantee shall be notified of the penalties for unlawful obliteration of
corners and landmarks as set forth in Section 59.635 of the Wisconsin Statutes.
6. That such easement grantee shall, in the clearing of rights -of -way and con-
struction thereof, comply with all of the laws of the State and County concerning
the cutting of forest products and disposition of slash and sh,62,1be more specifically
prohibited from windrowing slash in, along or upon said rights -of -way and adjoining
lands.

Northwestern Wisconsin Peace Officers Association
June 25, 1969
To: County Board, Bayfield County

The Northwestern Wisconsin Law Enforcement Officers Association consists of
Officers from various levels of government located in 22 Counties in Northwestern
Wisconsin.
The organization notes with some concern that the Counties are lagging behind
other units of government, as well as private industry, in the pay of County Officers.
This has caused some Counties to have difficulty in recruiting and keeping the high
2± type of individuals necessary to cope with the rising crime and ever increasing
accident rates on our highways.

It has also been noted that some Counties did not even give raises sufficient to
keep pace with the rise in the cost of living in the past year. This cost of living
is expected to increase by approximately five per cent in 1969.
This organization feels that if we are to keep law enforcement on a local basis,
capable men must be recruited and trained to protect the public, and enforce the
various laws. The present salaries now paid in most of our Counties are not conduce
ive to this end.
We respectfully suggest that the various County Boards give serious consideration
to granting substantial raises to their Officers. We see no reason why County Off-
icers should not be paid as well as Officers in the larger cities in any given County,
or as well as State Officers doing comparable work.
Our organization is dedicated to the betterment of law enforcement', and we feel
the time has come to speak out in support of our brother law enforcement officers
employed by the counties.
Thank you for your consideration of the above suggestions.

We are enclosing an original and one copy of a right-of-way easement with Map
attached, that the Chequamegon Telephone Cooperative, Inc. will need from the Bayfield
County for the purpose of laying underground telephone cable south of Port Wing and
along the east side of County Trunk A.
Bayfield County Highway Commissioner, Mr. Brevak, informed me that Bayfield
County has very definite plans for rebuilding and improving County Trunk A south of
Port Wing and that they would need to go out much farther than they ordinarily do.
He suggested that we stay back at least fifty feet east of the present right-of-way
line. We will flag the proposed route so that this can be looked over by anyone and
estimate if there would be any timber damage, and if there is,this cooperative will
pay for any crop or timber damage. We had not originally planned to stay outside of
the highway right-of-way limits until we were informed of the plans for the reconstruc-
tion of County Trunk A. We plan to cut over the Port Wing exchange on July 15, 1969
and this cable will have to be installed sometime on or before the first of July.

SCHEDULE "A"
1. The rights of,the grantee of such easement shall apply only to the parti-
cular parcel of land granted in the easement and such grantee shall have no right
of any nature whatsoever to enter upon adjoining County lands outside of the right-
of-way for any purpose whatsoever.
2. kll timber originally cut by said easement grantees for purposes of opening
up said rights -of -way shall be cut in accordance with practices normally required by
Bayfield County, and all merchantable forest products cut shall remain the property
of the County at the County's option®
3. The easement grantee shall refrain from spraying rights -of -way for the des-
truction of trees, shrubs and other plants without thereafter cutting and properly
disposing of the dead trees and shrubs on said rights -of -way resulting from said
spraying for the purpose of avoiding unsightly conditions, detracting from scenic
beauty and possibilities of fire hazards.
4. Said easement. -grantee shall have the right to cut and trim branches of trees
overhanging the right-of-way,-�but shall have no right to go outside of the right-of-
way to cut trees, pile .brush and debris or to bulldoze and construct access roads,
except upon written consent of the Forest Administrator.
5. The easement grantee shall take all necessary precautions to prevent the
obliteration of landmarks relating to corner and monuments including all corners,
bearing trees, bench marks and other Government and private survey references.
6. That such easement grantee shall, in the clearing of rights -of -way and con-
struction thereon, comply with all of the laws of the State and County concerning the
cutting of forest products and disposition of slash and shall be more specifically
prohibited from windrowing slash in, along or upon said rights -of -way and adjoining
lands.
It was moved. by Stuart and seconded by Brost to accept the recommendation of
the Forestry Committee to grant the foregoing Easement. Motion carried.

Mr. William Lake and Leon Gesecki, personnel from the Bureau of Property Taxation
were present and presented the recommended Equalized Property Valuations to the Board
It was moved by Rude and seconded by Olsen to recess for 5 minutes.
Motion Carried.
Following the recess, Wm. Lake continued his'report and several questionswere
asked regarding the Equalized Valuation figures.

for County Trunk Highways, Sec. 20.395(4) (xg) (xm)
Wisconsin Statutes -
The enclosed State Treasurer's check in the amount indicated in the right-hand
column below represents the prepayment of the 1969 supplemental highway aid for
County Trunk Highways in your county pursuant to Section 20.395(4) (xg) (xm), Wiscon-
sin Statutes. It is computed as 50 per cent of the supplemental aid paid to your
county in August, 1968. The exact amount of the 1969 supplemental aid paid to your
County Trunk Highways pursuant to Section 20.395(4) (xg)(xm) will be determined after
the close of the current fiscal year on June 30, 1969. The balance of your 1969 supp-
lemental highway aid, after deducting the amount of this payment, will be remitted
during the month of July.
The funds represented by this payment are supplemental to and are to be used for
the same purposes as the County Trunk Allotment under Section 83.10(1), which will be
paid in July.
