ANNUAL MEETING OF THE BAYFIELD COUNTY BOARD
OF SUPERVISORS
.The meeting was called to order at 9:30 a.m. by Wad- er C. Barningham, County
Board Chairman.
The following members answered roll call: No. 1
Ray Kyle, Thomas E. Rondeau, Raymond J. Mammoser, William A. Stuart, Ernest
Nelson, Ernest Heglund, George Moniza, Louis J. Brost, Sanfred Anderson, Axel Lehto,
Clarence L. Olsen, Kenneth C. Howell, Bertyl Nelson, William Celinsky, Arthur Meierotto,
Edwin Erickson, Walter Wasmuth, Alvin E. Bratley, Peter Hanson, Bennie R. Rude, Walter

A motion was made by Moniza and seconded by Stuart to dispense with the reading
of the minutes of the July 31st and September 29th meetings. Motion carried.
The following Resolution was read: No 2
RESOLUTION DESIGNATING PUBLIC DEPOSITORY AND AUTHORIZING WITHDRAWAL
OF COUNTY, CITY, VILLAGE, TOWN OR SCHOOL DISTRICT MONEYS
Resolved, that the following banking institutions: All banks in Bayfield County,
Wisconsin, qualified as public depositories under Chapter 34 of the Wisconsin Statutes,
shall be and are hereby designated, until further action, as public depositories for
all public moneys coming into the hands of the treasurer of the County of Bayfield,
State of Wisconsin.
Resolved Further, that withdrawal or disbursement from any one of the above
named depositories shall be only by order check, as provided in Section 66.042 of
the Wisconsin Statutes; that in accordance therewith all order checks shall be -signed
by the following persons: Edward A. Pajala, Clerk; Nick Pristash, Treasurer; and
countersigned by Walter C. Barningham, County Board Chairman, or their successors in
office, and shall be so honored.
Resolved Further, that in lieu of their_personal signature(s), the following

Chequamegon Bay Squadron

Dear Sir:
October 17, 1969
The volunteer members of the Chequamegon Air Patrol respectfully ask your
consideration of our request for an appropriation of $500.00 for 1970, to enable
us to provide effective search work in the Bayfield County area.
The Chequamegon Bay unit has a very effective search aircraft in good condition
and a workable communications system for search and rescue. There is much need for
improvement in this, since our radios must be replaced by single side band systems
by 1970. This means all our long range fixed and mobile --radios cannot be used
after this -year and must be replaced. Since this equipment is obsolete there will
be very little trade in value.
We are required by regulation and by membership insistance to provide insurance
coverage for liability and $500.00 deductable collision on our search aircraft.
This insurance will cost approximately $700.00 per year to provide the above coverage.
This insurance must be put in effect immediately.
Our unit has always participated when requested to search in Bayfield County.
As a matter of fact, we have volunteered when a situation has been called to our
attention, before a request was made. Our future, based on the above mentioned
expenses,'depends on the contribution by Bayfield County. Ashland County has also
been requested, to appropriate $500.00 and this has been approved by the Budget
Committee.

Gentlemen:
I submit my application to audit the Bayfield County records and books of
account for the year ending December 31, 1969, at a per diem rate of $120.00,
$70.00 and $40.00 for senior, semi -senior and junior accountants respectively.
It is estimated that the cost of the general county audit will not exceed $3,600:,00.
In addition to the foregoing, an estimate of $250.00 is made for the 1969 annual
State report and an estimate of $200.00 for the 1970 Bayfield County Fair report.
The audit will include the records of the general county, Register of Deeds,
Clerk of Circuit Court, County Court, Highway Department and County Rest Home, as
in previous examinations of Bayfield County, and will be completed by October 15,
1970.

The following communication was read: No. 5
Washburn, Wisconsin
September 30, 1969
Dear Sirs:
The board of directors for the Ashland-Bayfield County Day Care Center for
the Retarded should like to give our sincere thanks for including our center in the
1969 budget. By including us in the budget, you have made it possible to inc-Tease
the number of days we have sessions. We hope, in the next month, to increase our
daily hours also, thereby making it possible to serve retarded children and adults
from outlying districts.
We feel our cause is a worthwhile one and we should like to be included in the
1970 budget for the same amount we were allowed last year.

The following Communication was read: No. 6
Union Airport
Cable, Wisconsin 54821

Gentlemen:
On April 29, 1969, three of the four commissioners of the Union Airport at Cable -
each representing the owning municipalities, namely: Towns of Cable, Drummond, Nama-
kagon, and Village of Cable --appeared before the Executive Committee of Bayfield
County and explained the need for aid from the County to meet our growing expenses
as our area grows.
Unlike the Hayward Airport, which derives all of its funds from Sawyer County to
operate, our airport has been operating on $2000.00 per year. We have been paying
our dedicated operator only $1400.00 per year. The electricity to operate our
beacon and runway lights averages $400.00 per year. Our latest snowplowing bill was
$1,026.48, of which one-half was paid by Tony Wise, who owns Mt. Telemark. Insurance
on airport and beacon is $170.00. The municipalities voted last spring to pay the
commissioners mileage plus $10.00 per meeting --we had served without pay previously.
We have had about $75.00 repair expenses on our beacon in the past year. Our asphalt
runway must be seal -coated this next summer.
Our airport operator suffered a back injury recently, was confined' to a hospital
for about 3 weeks and has doctor's orders to do no work until this injury heals.
Therefore, she must hire assistance and at a salary of $1400.00 per year, we will
have to assume these additional expenses.
As stated previously, this southern part of Bayfield County is growing into a
vast year -around tourist and retirement haven. Mt. Telemark has developed one village
on which several homes have been built, and two other villages of over 200 lots are
in the process of being laid out. A- 9-hole golf course is nearing completion. On
Lake Namakagor_, the 44-lot Missionary Point Subdivision is getting final approval
from the State --altogether making more land available for construction of new resid-
ences.
County Clerk Pajala has in his possession a colored photograph which we submitted
showing the airplane activity on a typical week -end afternoon during skiing season.
Since we are an integral part of Bayfield C'ounty's future growth, progress, and

development, we shall be submitting a resolution at the November 18 meeting of the
Board of Supervisors, requesting $5000.00 to meet our expenditures for the coming
year. This request was not made in time to be considered in the County budget; hence,
I am submitting this letter so that your group will be informed.

The following resolution was read; No. 7
RESOLVED:
WHEREAS: The four sponsoring Municipalities of the Union Airport at Cable,
Wisconsin, namely, the Towns of Cable, Namakagon and Drummond and the Village of
Cable, are constantly striving to keep this airport competitive with neighboring
Hayward Airport which is supported entirely by Sawyer County.
WHEREAS: Operating expenses to -maintain 24 hour per day, 365 days a:year
service to remove the snow from the runway in winter and mow the grass along these
areas in the summer, the electricity to light the runway and rotating beacon, the
repair and patching of -the runway surface, etc:. --are borne directly and only by these
four municipalities.
WHEREAS: The real estate developments around this airport and the, whole south-
ern part of Bayfield County, makes a favorable impact on increased revenues to Bay -
field County from an assessment standpoint.
THEREFORE: We, the undersigned, petition the County Board of Supervisors of
Bayfield County, in session this 12th day of November, for the consideration of a
$5,000 grant, to alleviate these four municipalities from carrying the entire ex-
penses to keep and maintain the only recognized airport in Bayfield County.

Moved by Rondeau and seconded by Kyle to adopt the foregoing resolution.
The Chair called for discussion and Mr. Thomas Rondeau called on Mr. Harold
Schulte who gave a brief resume on the history of the Cable Union Airport.
A question was raised by Moniza concerning fees of said airport and ownership
of the airport. Several questions were raised as to submission of the airport
request -in the budget. It was stated by Mammoser that the towns of Drummond and
Barnes were in favor of the contribution to the airport.
Howell moved to turn down the request; the Chair declared that a motion was
before the house to adopt the resolution.
Moniza commented on the request, stating that the proposed contingency fund is
$10,000.00 for 1970. He suggested that the Board either increase the budget by
$5000.00 or decrease the contingency fund by $5000.00.
Motion by Stuart and seconded by Rondeau that the vote on Resolution No. 7 be
by ballot. Motion carried.

The Chair declared the motion to adopt the resolution lost. Further questions
were raised as to the airport request followed by discussion.
Moved by Moniza that a 5 minute recess be called - there was no second to the
motion.

Mr. Mammoser a9ked the County Clerk for clarification of the procedure to re-
consider a question. The Clerk advised the Board that a question could be recon-
sidered on a req�iea-t made by a member voting on the prevailing side either on the
same day or the next succeeding day.
Mr. Vernon Christman, Chairman, Town of Cable was allowed the floor and he
again spoke on the matter, followed by Mr. Rudy Schindler, Clerk, Town of Bayview.
Motion by Moniza, seconded by Rondeau to recess for 5 minutes. Motion carried.
Mr. Hanson was allowed the floor and he stated that he had voted against the
airport resolution and he moved that the airport matter be reconsidered during the
afternoon session. The motion was seconded by B. Nelson. Motion carried.
The following Communication was read: No. 8
State of Wisconsin Department of Health and Social Services

Dear Sir:
This letter is in reply to a letter from Edward A. Pajala, County Clerk,
which in part stated that the Executive Committee rec-ommended to the County Board
to withhold construction or remodeling at this time. We realize that there have
been references made to the withholding of new constructions and that the state has
complied in part with their programs. We must also realize that in discussing your
jail, which is sub -standard, we are dealing with a statutory item.
An institution of such sub -standard qualities will result normally in sub -nor-
mal operations which frequently does not comply with statutory codes. The ultimate
result will necessitate an operation under certain limitations.
Therefore, the following limitations are set forth including Statutes and
Departmental codes that control such limitations.
(1) Only Huber Law Prisoner's should be held in the dormitory. !V-C'
Department Requirement under 50.01 states "Dormitories may be used only
for Huber Law Prisoners. Such dormitories must include sufficient wash
bowls, toilets and shower baths. There should be at least one shower
bath, one toilet and one lavatory to every six persons".
(2) The Bayfield County Jail is not adapted: so as -to hold mentally ill or
alleged mentally ill persons, because proper segregation is not feasible,
Statutory-53.36.
(3) The jail section on the first floor (with the cells) should be used as
a section and prisoners should not be permitted into the guard corridor.

(4) Care should also be exercised in types of persons held therein 53.36.
All jails shall be provided with suitable areas for separation of
criminals from non -criminals, etc.
(5) The Bayfield County Jail is not approved for juveniles, Chapter 48.
The Wisconsin Statutes provide that a child may be detained in:
1. A detention home or,
2. A licensed foster home, subject to the supervision of
the Court or,
3. A=suitable place of detention maintained by a licensed child
welfare agency, subject to supervis on:'of ...the -Court-^or,
4. If a child's habits or conduct are such as to constitute
a menace to himself or others, he may be detained in a
jail or other facility for the detention of adults 48.30(1).
"A.child cannot be detained in a jail unless he (or she)
is placed in a room, or ward, which is entirely separate,
from that for adult prisoners. The section for juveniles
must not only be separated physically from the adult sec-
tion, but there must be no communication between juveniles,
in detention and adult prisoners. Before a jail facility
can be used for the detention of juveniles, it must be app-
roved by the State Department of Health and Social Services,
48.30(l)(d). It is one of the duties of the Division of
Corrections of that department to inspect and approve juven-
ile sections in jails. The approval must be in writing and
filed with the Clerk of the Juvenile Court."
(6) The cells in the security section on first floor cannot be
individually locked for purposes of isolation or otherwise
for security reasons as they do not comply with requirements.
Department Requirement RI-C 50.01 "Each cell must contain a
rigidly constructed perforated steel bottomed metal bed se-
cured to the floor, prison -type washbowl, and prison type
toilet."
(7) The Huber Law Dorm to be locked at all times to that those
housed therein do not have freedom to prisoners detained in
_,other areas. Under sanitation, food storage in prisoner's
quarters should be kept free of all unnecessary articles which
might collect 'vermin.
(8) Huber Law prisoners should not have any contact with prisoners
detained as non -Huber Law prisoners.
(9) The two cells at the top of the stairs are limited to receiving
cells and for isolation when necessary.
(10)The detention of adult females is not permitted as the jail
facility is not adequate for proper segregation. There are
identified instances where very temporary detention would be
permitted.
(11)Central feeding should not be practiced when prisoners are
detained with different types of offenses, such as criminal,

those awaiting sentencing, and awaiting trial for the more serious
offenses.
These limitations are set forth for the purposerof aiding constructive super-
vision, administration, and abidance with Statutory. Requirements, Departmental
Requirements and a good safe jail operation.
Theses limitations are necessary to permit the operation of a sub -standard
f acility.

June 30, 19.70 .
The above estimates are tentative. The total allotments will not be known
until after the close of the fiscal year J'zrie 3, 1970.
You were notified by our letter of July 7, 1969, of the estimated 1970 Sta-.eE�
Trunk Highway allotment under Section 84.03(3) the allocation of which has been
completed.

The following resolution was read: No. 11
WHEREAS, the Bayfield County Highway Department, has reached a two year labor
agreement extending from January 1, 1969 to December 31, 1970 with the General
Drivers Local No. 288 of Superior, Wisconsin and -
WHEREAS, a copy,of this agreement, together with the fringe benefits and labor
rates,' is in the hands of the County Clerk and
WHEREAS, it is necessary that this agreement be signed by representatives of
the Bayfield County Board.
THEREFORE, BE IT RESOLVED, that the Chairman of the County Board, the Highway
Commissioner and the Chairman of the Highway Committee are hereby authorized to
sign the labor agreement on behalf of the Bayfield County Board.

to be used by the Highway Department concerning weather conditions.

Highway Commissioner be received and placed on file. Motion carried.

The Illegal Tax Statements for the various Towns, Villages, and Cities were
read. The Clerk suggested that the Board members check the statements before any
action is taken.
The following res-olution was read: No. 15
WHEREAS, The County Board in November 1968 authorized the hiring of an addit-
ional employee in the County Clerk's office as a trainee for the position of
tax deed clerk and addressograph operator, and
WHEREAS, a girl was hired in March, 1969, and
WHEREAS, no provision was made in the 1969 budget for purchase of a desk and
chair for said girl, and
WHEREAS, the Executive Committee of the County Board at a meeting held on
May 26, 1969 directed the County Clerk to purchase a new desk and chair,
now therefore be it
RESOLVED, that $400.00 be transferred from the contingency fund to the -
county clerk's outlay budget to cover the cost of said desk.

WHEREAS, Lots 1 to 11, Block 25, DuPont Park Addition to the City of Washburn
have been set aside as a gravel pit and withheld from sale by county board action and,
WHEREAS, it now appears that said lots are not suitable for use as a gravel pit
and are desirable lots for residential purposes and,
WHEREAS, an offer has been made to purchase said lots, now therefore be it
RESOLVED, that any restrictions previously made on the sale of said lots be
rescinded and that they be advertised for sale through the usual procedure.

The fallowing resolution was read: No- 17
InHEREAS, the Iron River Lion's Club will sponsor a Snowmobile Derby during the
month of February, and
WHEREAS, the Iron River Lions Club has asked for permission to use the Bayfield
County Fairgrounds for this event, and
NOW THEREFORE BE IT RESOLVED, that the Iron River Lions Club be given permission
to use the fairgrounds for the Snowmobile Derby if they will provide for adequate
liability insurance, and will agree to clean up the grounds after the event has been
held, and
BE IT FURTHER RESOLVED, that the insurance coverage furnished for this event be
studied and approved by the Bayfield County District Attorney before permission is
granted for the use of the fairgrounds.

A question was raised as to insurance which was answered by Robert N. Ledin, D. A.
A motion was made and duly seconded to amend the foregoing resolution so that
control of the use of the fairgrounds for snowmobiling be delegated over to the Fair
Committee so that the restrictions would be carried out.
Moved by Olsen and seconded by Brost that the foregoing resolution, as amended,
be adopted. Motion carried.

Gentlemen:.
Acme Northern Industries, Inc. is interested in the establishment of a trailer
park for the permanent parking of mobile homes in the Town of Iron River.
Acme Northern was organized and incorporated in 1955• It serves as a develop-
ment corporation to promote industry and the economy in order to help improve living
conditions in this area. The Corporation is composed of 148 stockholders, the
majority of whom are local residents. .At each annual meeting seven shareholders are
elected to serve on the Board of Directors.

This Corporation would like to acquire a parcel of land in the First Addition
to Iron River described as hots 10 thru 13 in Block 1 and all of Blocks 10 to 23
inclusive -known as the Iron River School Forest. The property was purchased by
the Iron River School District from Bayfield County in 1929 and became one of the
assets transferred to the Maple School at the time of consolidation of the two
districts.
Upon investigating the possibility of buying this land, members of the Acme
Board were informed the Bayfield County Board had placed a restriction upon the
property at the time of the sale to the Iron River School District. This restrict-
ion being that once the land ceased to be used for school purposes, it would revert
to the County.
Since County and school lands are both tax-exempt, there has been no tax re-
venue from this property for at least the past forty years. If it could be returned
to private ownership, it would then be valued for tax purposes as well as the
added valuation of any homes located on the property.
The extent that Acme Northern will participate in this development will be
the building of roads, making utilities available and the laying out and selling
of the lots. The price of the lots will be held to a minimum since it is not the
desire of the Acme Board to make a profit on these sales but -.rather to fulfill a
need for the establishment of mobile home sites in the Town of Iron River.
Members of the Maple School Board have agreed to convey this land to Acme
Northern Industries providing the County Board of Supervisors will release the
restriction placed on the property. Enclosed is a certified copy of a motion made
at the last regular meeting of the Maple School Board.
This letter is being written to request the County Board of Supervisors to
release the restriction placed on this parcel of land.

Claim Deed to Acme Northern Industries for the land known as the Iron River School
Forest on the condition that Acme Northern Industries and its officers are able to
secure a release from the reversion clause to Bayfield County. It is further under-
stood that a condition of this agreement will be that the Acme Northern Industries
will pay the Joint School District No. 1, Maple, Wisconsin, Five Hundred Dollars
($500.00) to cover all expenses involved in the transaction.

COUNTY AID CONSTRUCTION & MAINTENANCE DURING THE CALENDAR YEAR 1970
Notice:
Section IX on page 4 of this resolution authorizes the County Highway Commiss-
ioner, subject to supervision and control by the Cbunty Highway Committee, to
employ, discharge, suspend, or reinstate c-oun y-highway personnel. This change in
form was made in 1945.in view of Attorney General's opinions dated March 6 and
March.24, 1945. If this form conflicts with any existing general rules or aiv'il
service plan, or if the Cbunty Board wishes to limit the authority which would be
conferred by this provision, the attached form should be appropriately altered in
consultation with the District Attorney.
Attention is directed to the fact that any action taken by the County Highway
Committee in exercising its powers must, to be effective, be recorded in the minutes
of the County Highway Committee's meeting.
SECTION I. The County Board of Supervisors of Bayfield County, Wisconsin,
regularly assembled, does hereby ordain that such funds as may be made available to
the county for highway work in the year 1970 under the provisions of Section 20.395
and Chapter 83 of the Statutes, and the additional sums herein appropriated, shall
be expended as hereinafter set forth:
SECTION II. COUNTY TRUNK HIGHWAY ALLOTMENT. WHEREAS the Division of Highways
has notified the County Clerk that a sum of money estimated to be two hundred eighty-
eight thousand, three hundred Dollars ($288,300.00) will become available at the

end of the fiscal year under the provisions of ,Sections 83.10 and 20.A5(2)�(yd) of
the Statutes`, for the county trunk highway system in the county, but the actual
amount will not be known until the close of the fiscal year ending next June 90.
BE IT RESOLVED that the Cbunty Highway Committee is authorized and directed to
expend the said sum to the extent required to match and supplement Federal aid for
construction, right of way, .and other costs on any Federal projects located on the
county trunk highway system of said county, which are not recovered from Federal
funds, and to expend any balance for constructing, repairing, and maintaining such
county trunk highway system and the bridges thereon, including snow and ice removal
and control, as directed in Section 83.10(l) of the Statutes, and to reimburse the
general fund for any expenditures that may be made therefrom pursuant to Section
83.01(6) of the Statutes. The distribution to such purposes is estimated,but not
specifically directed, to be as follows:
For construction, maintenance, snow removal, ice prevention and removal on the
County Trunk Highway System.
SECTION IV. WHEREAS it appears that certain additional highway improvements
in the county are necessary and warranted.
BE IT RESOLVED that the County Board does hereby appropriate the following
sums for the purpose hereinafter set forth:
(1) The sum of Sixty-two thousand one hundred Dollars (b62,100.00) for the
improvement by Reconstruction of County Trunk -Highway A beghhing at Port Wing and
extending to Iron River as far as the said sum will construct.

(2) For Namakagon Bridge Construction C.T.H. "D", the necessity for which is
determined by the County Highway Committee and for which other funds are not avail-

pense of the County Highway Committee, the County Highway Commissioner, his clerks
and assistants not paid from construction or maintenance funds, the sum of Thirty-
five thousand Dollars ($35,000.00).
Total authorized in this Section $152,100.00.
SECTION V. WHEREAS appropriations are made herein, in addition to the amounts
to be received from the state and available for work in the county under Section
20.395 of the Statutes,
BE IT RESOLVED that the County Board does hereby levy a tax on all of the
property in the county to meet such appropriations as follows:
For County Aid under Section 83.14, as provided by Section III hereof, the sum
of NONE Dollars($ ).
(1) For the various purposes as set forth in Section IV hereof the sum of
One hundred fifty two thousand one hundred Dollars ($152,100.00).
WARNING: It is directed that provision for this levy shall be made in the county
budget, but that this levy shall not be duplicated.
SECTION VII. WHEREAS the various highway activities for which provision is made
in this resolution are continuous from year to year, and the exact cost of any work
cannot be known at the time of making the appropriation therefor,
BE IT RESOLVED that this Board does hereby direct that any balance remaining in
any appropriation for a specific highway improvement after the same shall have been
completed may be used by the County Highway Committee to make up any deficit that
may occur in any other improvement, which is part of the same.item in the county
budget, for which provision is herein made, and any balances remaining at the end of
the year in any highway fund shall remain and be available for the same purpose in
the ensuing year.
SECTION VIII. 14HEREAS the exact amount of the funds that will become available
from the state for highway purposes in the county under Section 20.395 of the Stat-
utes will not be known until on or after n$xt June 30.
BE IT RESOLVED that the County Treasurer is hereby authorized and directed to
make payments for the purposes for which such funds are to be used, as hereinbefore
authorized, from any funds in -;the county treasury that are not required for the
purposes for which appropriated prior to next August 1, and to reimburse such funds
in the county treasury from the sums received under Section 20.395 of'the Statutes.
SECTION IX. WHEREAS the County Highway Committee and the County Highway Comm-
issioner are charged with the duty and responsibility of carrying out the construct-
ion and maintenance of highways for which provision is made, and other related superv-
isory and administrative duties.

for the advance, allocation, or transfer of construction funds to or between pre-
viously authorized or additional needed construction improvements on state trunk
highways or connecting streets in this county.
THEREFORE, in order to provide for promptly making available the funds necessary
for such improvements and to avoid the delay and expense incident to calling a
special meeting of this board for such purpose,

The Bridge known as the Dam Bridge crossing the Namakagon River in the South-
east Quarter of the Northwest Quarter (SE 1/4 NW 1/4) of Section Eight (8), Township
Forty-three (43) North, Range Six (6) West on a public highway maintainable by the
Town of Namakagon required an emergency replacement. The County share of cost of
said replacement was authorized in Resolution No. 3 adopted by the County Board of
Supervisors at the meeting on April 15, 1969.
The Town of Namakagon has provided for such portion of the cost of replacement
as is required by Statute.
The total cost of such replacement is:. $ 5737.80

County Board have made recommendations to increase Bayfield County.'s contribution
to each of the above named employees salaries of $25.00 per month, and
WHEREAS, -this is in.line with the salary increases allowed to other C'ounty
employees, ands
NOW THEREFORE BE IT RESOLVED, that the County.contribution to, the salaries of
both Lyle Hakes and Harry Lowe be increased $25.00 per month.

west Quarter of Northeast Quarter (SIFT/4 of NE/4) of Section Twenty-six (26) , and
WHEREAS, Said Bayfield County is the'.owner of certain hands in Township Forty-
three (43) North, Range Nine (9) West, to -wit: the Southwest Quarter of Northeast
Quarter (SIFT/4 of N.EI/4) , Section Four (4) ; Southeast Quarter of Northwest Quarter
(SEI/4 of NW/4),Section Eighteen (18); Northwest Quarter of Southwest Quarter, Section

such officer during the years 1968 and 1969; that during the year 1969, no collect-
ions were made by said office as and for fines, forfeitures and other matters
relating to criminal or -county matters and that all such payments were made direct
to the County Court of said Bayfield County, Wisconsin; that there was collected
from the period September 1, 1968 through August 31, 1969,*on-old age assistance
liens the sum of'$2,405.00,.representing Bayfield County's share,of said collections,
all as more fully set forth in the records `of the Department of Public Welfare in
and for said Bayfield-County, Wisconsin.
That this report'is made to the County Board of Supervisors at their November

has examined a report of the Bayfield County Treasurer setting forth that certain
tax certificates now owned by Bayfield County are illegal and void in that said
certificates were issued on a "tax on exempt property, on property on which there was
a double or incorrect description and for other reasons set forth in said Treasurer's
report, and
WHEREAS, From said examination it has been determined that said report is correct
and that said certificates described in said report are illegal and void and that
the taxes upon which said certificates are based are not justly reassessable,
NOW THEREFORE BE IT RESOLVED, That the amounts of said illegal and.void tax
certificates be charged back to the respective towns, cities or villages wherein
such lands are situated.

Mr: Ludwig Tranmal, Trustee of the Rest Home, was present and spoke to the
Board.
Mr. Ed Dashner was also present and spoke.
Several question were asked at this time.

Mr. Robert Spears appeared before; -the" -Board concerning the possible use of the
facilities at the Pureair Sanatorium for mental health care. Mr. Spears also ex-
plained a proposal for a joint sewage disposal system holding pond to be used by the
Sanatorium and Port Industries, Inc.

The following Resolution was read:
WHEREAS, The Pureair Sanatorium owned by Ashland, Bayfield and Iron Counties is
required to update and improve its sewage disposal facility, and -
WHEREAS, Port Industries, Inc. is the owner of certain lands adjacent to and.
immediately to the west of the lands of said Pureair Sanatorium, and
WHEREAS, It is deemed in the interest of said two parties to construct a common
holding pond for use as a part of the sewage,disposal facility of both of said par-
ties, and
WHEREAS, It has been agreed by and between the parties, subject to the approval
of the County Boards of said Counties and -the Trustees of said Pureair Sanatorium,
that a lease shall be entered into between said parties providing generally as
follows:
1. That said holding pond shall be located on the westerly Three Hundred (300)
feet of Government Lot Four (4), south of the railroad in Section Twenty-two (22),
Township Fifty (50) North, Range Four (4) blest, the same being a part of the real
property of said Pureair Sanatorium,
2. That the total cost of the construction of said holding pond and the main-
tenance thereof shall be assumed by Port Industries, Inc.
3. That in further consideration of the lease of said premises by said
Counties to said Port Industries, Inc., said second party agrees at its own cost to
construct for Pureair Sanatorium the discharge pipeline from the Sanatorium sewage
plant to the holding pond, said pipeline'to be maintained by said Counties following
construction.
4. The agreement between said parties shall be in the form of a lease, a copy
of said proposed lease being attached hereto and marked Exhibit "Al".

5. That said lease and agreement shall run for a period of Twenty-five (25)
years with the option for renewal for a like,period on the part of said Port In-
dustries, Inc.
NOW THEREFORE BE IT RESOLVED, That the aforesaid agreement is deemed to be in
the interest of-Bayfield County and the proper officers of Bayfield County and, the
Trustees of said Sanatorium are hereby authorized and directed to enter into an
agreement with the said Port Industries, Inc. in accordance with this resolution
and said Exhibit "All, and
BE IT FURTHER RESOLVED, That said County officers and said Trustees are hereby
authorized to make, such changes in said agreement and lease prior to execution
thereof as may be in keeping with good business practices and which may be in the
interest and to the,benefit of Bayfield County.and to said Pureair Sanatorium
facility.

LEASE
THIS LEASE, entered into this day of November, 1969, by and between Ash-
land County, Bayfield County, Iron County and the Trustees of Pureair Sanatorium,
collectively, as Lessor, and Port Industries, Inc., a Minnesota corporation, as
Lessee.
WHEREAS, Lessor is the owner of the premises described in Exhibit A attached
hereto; and
WHEREAS, Lessor is willing to lease said premises to Lessee in consideration
for Lessee's construction of a treated sewage "holding pond" on the premises and
construction of a pipeline from Lessor's sewage treatment plant to said holding pond;
NOW, THEREFORE:, the'parties hereto agree as follows:
1. Les.sor, in consideration of the covenants to be performed by Lessee, here-
by demises and leases to Lessee the premises described in Exhibit A for development
of a treated sewage "holding pond", and for other recreational development supple-
mental to development of adjoining property owned by Lessee.
2. The term of this lease shall commence on December 1, 1969 and shall ter-
minate on December 1, 1994.
3. Lessee shall have the right to renew this lease for an additional 25 years
until December 1, 2019 on the same terms and conditions as contained herein.
4. In consideration for leasing the premises described in Exhibit A,attached
hereto, Lessee hereby covenants to perform the following:
(a) Construct a treated sewage holding pond of sufficient capacity to
contain all treated sewage discharged from the sewage treatment plant of
Lessor, and from the sewage treatment plant of Lessee's.adjo.ining devel-
opments. Lessee shall enlarge the holding pond if it becomes necessary
in order to provide disposal of treated sewage from the Sanatorium during
the entire period of this lease and any renewal thereof.

(b) Pay for and connect a discharge pipeline from.the Sanatorium sewage
plant to the holding pond. "This pipeline shall be of such size and in such
location as requested by the Sanatorium's engineer.
(c) Maintain the holding pond during the entire term of this lease and any
renewal thereof, The Sanatorium shall maintain its pipeline after it is com-
pleted by Lessee.
(d) Lessee shall pay any real estate or personal property taxes assessed
against any improvements placed on the premises described in Exhibit A.
5. The use and occupancy of the Leased Premises by Lessee shall be in com-
pliance with all applicable laws, ordinances and governmental regulations.
6. Lessee agrees to pay for all utility services such as heat, water, gas,
steam, electricity,.and any other utility used or consumed in or on the Leased Pre-
mises.
7. Lessee shall not commit or suffer to be committed any waste or public
nuisance upon the Leased Premises.
8. Lessee shall pay for and maintain any capital improvements it makes on the
Leased Premises.
9. Lessee further covenants and agrees that it will peacefully and quietly
vacate and surrender the Leased Premises to the Lessor at the expiration of this
Lease, or at any earlier termination as may be provided elsewhere herein, and that
the Lessor shall not, in any way or to any extent, be liable for any loss or damage
to the Lessee or to any property of the Lessee in or upon the Leased Premises.
10. Lessee agrees to indemnify and hold harmless Lessor from all liability
and damages that might occur on the Leased Premises as a result of Lessee's use or
occupancy of the Leased Premises.
11. No waiver of any default of Lessee hereunder shall be implied from any
ommission by Lessor to take any action on account of such default if such default
persists or is repeated. One or more waivers by Lessor shall not be construed as a
waiver of a subsequent breach of the same covenant, term or condition. The consent
to or approval by Lessor of any act by Lessee requiring Lessor's consent or approval
shall not waive or render unnecessary Lessor's consent to or approval of any sub-
sequent similar act by Lessee.
12. If default shall occur in the performance by Lessee of any of the terms or
covenants hereof, and such default is not cured within 30 days,, or if the Lessee
shall vacate or abandon the Leased Premises., Lessor may, at its option, and without
notice, terminate all future rights of Lessee under this Lease.
13. The terms and covenants of this Lease shall not be altered, deleted, added
to, or otherwise modified except by written instrument signed by the parties hereto.
This Lease constitutes all the covenants, promises, and agreements between Lessee
and Lessor concerning the Leased Premises and there are no covenants, promises and
agreements, either oral or written, between them other than as set forth herein.
14. The terms, covenants and conditions hereof shall be binding upon and inure
to the successors in interest and assigns of the parties hereto.

WHEREAS, Section 46.22 (3) of the Wisconsin Statutes provides in part that
"the County Director shall recommend to the County Board of Public Welfare the
appointment of employees necessary to administer the function of the Department,"
and
WHEREAS, The State Department of Health and Social Services interprets this
to mean that the County Welfare Board.approves reclassification of positions and
promotions, and
WHEREAS, Public Law 154, enacted effective September 1, 1969, which amended
Section 46.22 (3), would seem to.indicate that the County Board of Supervisors
would have to approve any increase in salaries, and

classification for the position of Homemaker I to Homemaker II and.has received
approval of the reclassification effective November 1, 1969, and as under the est-

1966 adopted a resolution granting the authority to adopt salary schedules and
determine salary adjustments for employees -of the Department of Social Services to

WHEREAS, Public Law 154 states in part that the County Director shall make a
recommendation to the County Board of Supervisors who shall fix the salary of such
employees, which supersedes any previous law regarding salaries, and
WHEREAS,'The aforesaid resolution is in compliance with the State Merit System
and Compensation Plan which continues to be in effect regardless of Public Law 154
directions, and
WHEREAS, It continues to be in the best interest of sound administration for

WHEREAS, The expenditures from said fund for said Forestry building have been
completed, the balance of said funds remaining for the purpose of the aforesaid
building or repairing of the jail facility, and
WHEREAS, It is deemed in the interest of Bayfield County to add funds to this
fund from year to year -for the aforesaid purpose,
NOW THEREFORE BE IT RESOLVED, That said fund be increased for the.year 1970

WHEREAS, the administration of the Bayfield County Sanitary Ordinance is under
the direction of the County Board, and
WHEREAS, the Bayfield County Zoning C-ommittee on September 9, 1969 employed a
master plumber to enforce the Sanitary Ordinance in order to =mply with Section
145.15 (6) of the Wisconsin Statutes, and
WHEREAS, such action was taken under the authority vested in the Zoning Com-
mittee by the County Board, and
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Zoning Committee acted
in compliance with the spirit and intent of the Sanitary Ordinance, and is hereby
declared to be in compliance with Section 145.15 (6) Wisconsin Statutes and is en-

WHEREAS, The Superintendent of the Bayfield County Rest Home rec-eived a letter
from the State Department of Health and Social Services -dated October 30, 1969 ad-
vising that the new rates for reimbursement would be $13.25 per day minimum, $14.05
per day moderate, and $14.85 per day for maximum care patients, the rates to become
effective November 1, 1969, and
WHEREAS, The actual cost based on an average of 99 per cent occupancy as applied
to the 1970 budget averages $17.26 per day, and in applying the approved state aid
figures covering all the classes of patients, we arrive at an approximate difference*
on an average of about $3.00 per patient day or $96.00 per day.. By applying al.reas-
onable credit for private pay and Medicare patients, it appears that according to
the new established rates that the state will not participate in aid on an amount
of approximately $32,000.00, now therefore
BE.IT RESOLVED that.the Executive Committee of the County Board,.Director of
the Department of Social Services, and Board of Trustees continue negotiation with
the State Department to arrive at a reimbursement based on our actual cost.

BE IT FURTHER RESOLVED that in the event of an unsatisfactory agreement the

The following )Proposed Budget for the Year 1970 was read: No. 71
TO THE HONORABLE COUNTY BOARD OF SUPERVISORS
Gentlemen:
We, the undersigned members of the Executive Committee, hereby submit our
report and recommendations for 1970.
VALUATION
The Supervisor of Assessments recommends a true value of $71,623,600.00, which
has been accepted by the County Board. The legal levy limit exclusive of debt items
for County General purposes is 1%. The proposed levy is $88,074.78 below the legal
limit but is an increase of $87,310.22 over last year's levy. The Contingency fund
is $10,000.00 which is the lowest for some time but the committee feels it is ad-
equate and a control to any further spending. Percentage -wise, the levy this year
increased 13.89% compared to 33.47% last year.
FINANCE
There is an item in the budget for the Bayf field County Memorial Hospital; how-
ever, the expenditure is balanced off on the receipt side as this total expenditure
will be funded by the Hospital. Salary increases as proposed'by the Personnel
Committee are reflected in the budget. Our cash surplus seems to be declining each
year as we find where we have over -budgeted on some items and are making the adjust-
ments. However, this year's cash surplus amounts t6100,000.00 as compared to
$901000'000 last year. This year $80,000.00 was applied against the tax levy and
we propose that $20,000.00 be set aside in'the Building Fund, this brings the total
of the Building Fund to about $72,000.00. Since this fund has not been funded by
special levy for this purpose, those funds could be used for other purposes in an
emergency. We would like to commend the Treasurer for investing all available funds
as another source of revenue.

HIGHWAYS AND BRIDGES
This is the second year that the Highway Budget is being supported with
County funds. Aside from the Bridge Aids of $5,318.90, there is $55,000.00'for
a bridge on Co. Highway "D", $62,100.00 for construction on Co. Highway "A" and
$35,000-00'f.or Highway Administration. The subheading of Transportation has been
added to the budget.
HEALTH AND SOCIAL SERVICES`
The Health and Social Services Budget continues to be a major f actor in the
amount of the budget. However, Medical Assistance programs were cut $94,000.00 as
it was discovered that this item was budgeted in with other welfare items. This
certainly will effect our cash surplus in the future.
The Rest Home continues.to operate at full capacity. The question of opera-
tional costs has risen and needs some study, the committee feels.
Pureair is still under study by the trustees insofar as dual purpose is Gon-
cerned. No specific recommendations are being offered at this time. Interim
financing still continues to be a problem for a dual purpose operation.
North Central Guidance Clinic Budget is up over last year by about $2,000.00.
A=new system of allocating cost of the clinic is now based on membership, valuation,
and population.
AUDIT
The 1968 Audit Report has been completed at budget time which assisted the
committee in preparing .the budgets. We recommend the acceptance of the Audit
proposed for the 1969 records.
Most of the Department Budgets are. about the same as last year only reflecting
increases- in salaries. There were cuts made in the department requests, in the
Transportation Budget, Welfare Budget and the Forestry Buudget. The Sheriff's Com-
mittee recommended a� Supplementary Budget which considered.the addition of full
time employes in that department. The committee appreciates the need in this
department, but in trying.to,,balance the budget found it necessary to exclude this
recommendation at this time..
The committee wishes to thank the County Clerk'soffice and the Auditor for
their assistance.

BE IT HEREBY RESOLVED,, by the Board of Supervisors of Bayfield County, Wis-
consin, assembled in annual session this 13th day of November, 1969, that there
be and is hereby levied against all the taxable property in Bayfield County,
