MINUTES OF THE BAYFIELD COUNTY
BOARD OF SUPERVISORS
The meeting was called to order,at 9:45 A.M. by Walter C. Barningham, County
Board Chairman.
The following members answered roll call: No. 1

Mr. Richard Olson appeared before the Board and made a progress report on the
Bayfield County Memorial Hospital. He explained in detail the various change orders
that have been made in the construction contracts. He informed the Board that con-
struction appeared to be about one to ane and one-half months ahead of -thm schedules.
tgmxxx This is due to an early start in the construction and exceptionally favorable
weather during the construction period. Mr. Olson also spoke regarding the present
financial condition of the hospital construction fund. A number of questions were
raised that were answered by Mr. Olson.
The following Communication was read: No. 2
To All County Forest Administrators:
You are aware that the recently enacted ORAP-200 legislation provided a major
program for the development of wildlife habitat on county forests. Basically, it
provides for a direct payment to the county in the amount of five cents per acre of
county forest to improve wildlife habitat according to a prescribed and approved plan.
Because this law is brand new, we have not developed the detailed procedures and
forms as yet. This will be done in the very -near future and details will be sent to
each of you. However, the law does provide that any county wishing to be included
in this program must, by resolution of the county board, indicate this desire to the
Department. Knowing that a number of the county boards will be meeting in the near
future we are enclosing a sample resolution which can be used by your county forestry
committee and the county board to express this desire. Also included is a copy of the
law pertaining to the program which outlines the essential procedural requirements.
You will note that provision is made for the approval of projects and inclusion of
these projects in the annual work plan.
In addition to the resolution, I suggest that your committee may wish to antici-
pate projects for the remainder of this fiscal year. The area game manager and
forester have worked up certain plans for wildlife habitat improvement on county
forests. It would be well for you to contact these individuals and at least hold

exploratory discussions on those plans which may be applicable.
You are aware that the top priority in the current game habitat program on all
public lands is the maintenance of deer habitat. This is a large program and timely
in that the deer populations are at a point where such work is feasible. I mention
this only as a guideline you may use in establishing priorities for your county progr
You can expect to receive additional information on this program in the very
near future.

COUNTY FOREST HABITAT PROJECT
TO THE HONORABLE BOARD OF SUPERVISORS OF BAYFIELD COUNTY, WISCONSIN
Members:
WHEREAS, the Legislature of the State of Wisconsin enacted legislation providing
for allocation of funds on an acreage basis to the several counties for the improve-
ment of natural environment for game and nongame species on county forest lands enter-
ed under S.28.11, Wis. Stats., and
WHEREAS, Bayfield County desires to participate in this program pursuant to pro-
visions of S.23.09 (17m), Wis. Stats.;
THEREFORE BE -IT RESOLVED, That the Bayfield County board of Supervisors does here
by make application to the State of Wisconsin, Department of Natural Resources for
funds appropriated for such purposes by S.20.370 (1) (vm), such account to be known
as the "County Game Management Fund";
BE IT FURTHER RESOLVED, That the Conservation Committee of the Bayfield County
Board of Supervisors be and hereby -is authorized to expend the funds to be received
from the State of Wisconsin, for projects which have been approved.

Dear Sirs:
MOTION CARRIED.
The reason for this letter is highway safety and the use of salt on our state
and county roads. This all started years ago when the county used sand with a little
salt which was good. Now salt alone is used just to melt snow. Uounty Trunk D is
now a winter time slosh trail.;
I have listed below some of the disadvantages and unsafe driving conditions when
salt alone is used on the roads.
1. Wet sloshy roads with below freezing temperatures. It has been proven by
university safe driving teams that it takes very little water on the road surface to
hydroplane a car. This is at temperatures above freezing, not in winter driving.
2. Windshield, headlights and rearview.mirrors get extremely dirty with salt
spray, visibility hazard.
3. Maintenance failure due to corrosive action on brake lines, gas lines and
other parts of the car or truck.
4. Road maintenance is extreme due to salt water freezing in the cracks of the
road surface.
5. Deer come to the edge of the road to drink saltwater in the Spring, some of
them are -hit by cars.
6. Water pollution in our lakes and streams due to the many tons of salt used
on the roads in the winter.
7. Concrete floors in private garages are destroyed by saltwater.
8. Cars no longer last the time it takes to pay for them.
9. When salt is spread down the center of a road, drivers are tempted to stay
too close to the center or yellow line and there is a chance of a head-on collision.
10 Slosh builds up in front wheel wells and prevents turning of the front wheels
on real cold days.
Other disadvantages and.unsafe driving conditions on county and state roads are:
1. goad oil on County Trunk D is still coming up on cars a year and one-half
after it was put down.
2. Plow trucks running too fast in light snow with cross winds over the roads
can't see trucks or the road.

3. Grader not being used to take snow and slosh off roads.
4. Grass on County Trunk D was not cut until late Aug. of this year.
5. Road maintenance on County Trunk D is terrible, chuck holes all through the
summer and late in the fall.
6. Blown down trees lay on County Trunk D for days.
As assessor of the Town of Grand View, the above questions are asked whenI
meet the tax payer.
Any information on the above conditions would be of great help.

WHEREAS, the premises described as: All that part of Government Lot Four (4)
of Section Twenty-three (23), Township Fifty (50) North, Range Four (4) West, lying
south and east of the Chicago Northwestern Railroad Right-of-way is owned by Bayfield,
Ashland and Iron Counties and is exempt from real estate tax, and,
WHEREAS, the said premises was inadvertently included in a conveyance to one
Albin Larson when he purchased the portion of said Lot Four lying north of the Rail-

road Right-of-way recently with the result that Lot Four was assessed as a whole

I wish to make an appeal for correction of an illegal 1969 tax statement on my
lake property listed on page 67 of the tax roll. I purchased this property from
Owen G. McDonald in October of 1968. I bought 200 feet of lakeshore property, cabin,
and all personal property, and Dr. McDonald retained the adjacent 200 feet. When
Dr. McDonald owned the property, the assessed valuation (1964 reevaluation) was
$7,000 for the cabin, $1,800 for 100 feet of improved land, and $2,700 for 300 feet

of unimproved land, a total of $11,500. My portion of the property was $7,000 for
the cabin, $1,800 for improved land, and $900 for unimproved land, a total of $9,700.
This year I received my 1969 tax bill for an assessed valuation of $15,69-0 although
no changes have been made in the property since 1964. I did not receive a notice of
the increase as required in Wisconsin Statutes, Section 70.365. The change in assess-
ment is, therefore, illegal. My taxes should be based on the valuation in 1968 and
should be $453.96 instead of $734.20 listed on my tax bill. A revised statement of
calculation based on the 1968 valuation is attached. My 1969 taxes should be $280.24
less than on my statement.
I shall pay half the tax listed on my present statement ($367.10)and await your
action on my petition. The matter could be handled either by revising the second -
half balance owed to-$86.86 or by refunding $280.24.
I am appealing this statement of valuation and taxes not only because the pro-
cedure followed was illegal, but because the assessment is grossly incorrect. I
have discussed the matter with William Carter, Town of Iron River Assessor. He based
his valuation of our cabin on the sale price as he was advised by the Rice Lake Office
of the Bureau of Property Taxation. With a percentage adjustment he, in effect,
subtracted the land value from the sale price and arrived at a completely unrealistic
figure for the value of the cabin. He -was not advised that the cabin and grounds
contained well over $5,000 worth of personal property nor was any consideration given
to the fact that the convenience of obtaining a cabin completely outfitted entered
into consideration when we bought the property. My time is worth money and not having
to.shop for a single item increased the value somewhat. This is not, however, real
property value, but personal property value. Mr. Carter has assurred me that he
will back up my contention that the assessment was illegal and will reassess the
property fairly in 1970.

ATTENTION: EDWARD A. PAJALA
Gentlemen:
Lake Superior District Power Company plans to construct a new transmission line
from Ashland to Washburn, Wisconsin. This line as proposed, will cross over certain
parcels owned by Bayfield County - namely, the N'/2 SE/4 in `Sec. 2, T 47 N, R 5 W, and
the NW/ NE/, Sec. 1, T 48 N, R 5 W, Bayfield County, Wisconsin.
Lake Superior District Power Company would wish to obtain permission in the
form of an easement from the Bayfield County Board covering the encroachment of the
proposed transmission line on Bayfield County land. The approximate location of the
transmission line is shown by means of a red line on the two sets of prints enclosed
herewith and titled "Exhibit All and "Exhibit B". Our standard easement form (in
duplicate) is enclosed for your execution.
On the enclosed map titled "Exhibit All our proposed transmission line is shown
on the north line of our existing 115 KV transmission line right of way. As shown
on "Exhibit All an additional fifty (50) feet is needed for our proposed new trans-
mission right of way, which will involve the clearing of 1.9 acres of land. The
100 foot right of way as shown on "Exhibit B", will require 3.1 acres of land clearing.
We have been obtaining easements along the proposed route of this transmission
line on the basis of $20.00 per pole. We estimate that there will be eight (8) poles
located on Bayfield County land totalling a payment of $160.00. In addition to pole
payments, we will pay for stumpage for an area of approximately five (5) acres which
area will 'be cleared for our transmission right of way. Also to be included in the
payment to the County will be the labor costs of your forester in appraising the timb-
er on the five (5)-acres to be cleared.

WHEREAS, the wage scale for extra jailors has been set at $$1.68 per hour by
county board action as recorded on Page 458 Volume 12, and
WHEREAS, said rate of pay was based on the minimum salary of the regular jailors
in effect at that time, and
WHEREAS, the Bayfield County Board did in November 1969 revise the salary of the
regular jailors, therefore
BE IT RESOLVED, that the hourly rate of pay for extra jailors be hereby set at
$1.92 per hour which.is in conformity with the base minimum monthly salary of the
regular jailors, and
BE IT FURTHER RESOLVED, that the regular salaried jailors when requested to work
extra time over and above their regular scheduled work day or week, shall be paid at
their regular rate of pay as in effect at the time of employment, and be it further,
RESOLVED, that the aforesaid increase in pay shall become effective February
1, 1970.

Gentlemen:
Please be advised of the following Resolution passed at the January 20, 1970
meeting of the Bayfield County Taxpayers Alliance:.
WHEREAS, the Division of Corrections of the State of Wisconsin has decreed that
the Bayfield County Jail does not meet statutory requirements in its present condition,
February 10, 1970__
and
WHEREAS, the architect employed by the Bayfield County Board of Supervisors
has designed two separate and distinct plans for remedying this situation, designat-
ed as "Plan 1" and "Plan 211, and
WHEREAS, both plans were submitted to the Taxpayers of Bayfield County at a
Public Hearing, at which time the opinion of said Taxpayers was requested, and
WHEREAS, the overwhelming opinion of the Taxpayers vocally and in subsequent
petition form clearly represented a mandate to the County Board of Supervisors to
adopt "Plan 111, and
WHEREAS, the aforementioned Division of Corrections' representatives have sti-
pulated that "Plan 1" will be acceptable to permit continued operation of the pres-
ent Bayfield County Jail without unnecessary -and unreasonable Tax burdens to the
Taxpayers of said Bayfield County,
NOW THEREFORE BE IT RESOLVED THAT: We, the members of the Bayfield County Tax-
payers Alliance do hereby implore the Bayfield County Board of -Supervisors to take
immediate steps to adopt "Plan 1" in its entirety and *thus insure compliance of the
Bayfield County Jail with existing Division of Corrections standards.
As previously stated, motion for adoption of the above Resolution was properly
made, seconded and unanimously passed. We ask that you present this Resolution on
the agenda of your February loth, 1970 meeting for adoption by the County Board.

The County Board Chairman introduced Mr. Ernest Korpela, Assemblyman for
Ashland, Bayfield and Iron Counties.
Mr. Korpela informed the members that because of the large agenda the Board
had at the meeting he would make only a few brief remarks and would then be avail-
able for questions by the Board regarding legislative matters. Several questions
were raised by the Board members which he answered.

Mr. Walter Anderson appeared before the Board and spoke on Equalized Valuations
in regard to Taxation. Mr. Rudolph Schindler also appeared before the Board and made
a few remarks on this same subject.
A short recess was called at 3:45 P.M. after which the following Resolution
was read:
No. 16
At a meeting of the County Board of the County of Bayfield, Wisconsin, duly
called and held on the 1Oth day of Feb., 1970, a quorum being present, the following
resolution was adopted.
WHEREAS, on or about the 5th day of January, 1959, Walter T. Norlin of Washburn,
Wisconsin, as Principal, and Hartford Accident and Indemnity Company, Hartford,
Connecticut,"as Surety, executed bond in the sum of One Thousand and No/100 $1,000.00)
Dollars, in favor of Hon. L. K. Blanchard, -Judge of the County Court, Bayfield County,
Wisconsin, in connection with the election of said Walter T. Norlin as Public Adminis-
trator, of said Bayfield County, Wisconsin, for a term of one year commencing on the
2nd day of January, 1970 and ending on the 2nd day of January, 1971.
WHEREAS, this County Board desires that said bond be cancelled as of Nov. 11,
s 1969.
NOW THEREFORE BE IT RESOLVED, by the County Board of the County of Bayfield,

Memorial Hospital Construction Fund; Bond Redemption Fund (Sinking Fund) Investments;

WHEREAS, Bayfield County has a large and growing Recreation Industry,- and
WHEREAS, Bayfield County's 253 clean, unspoiled lakes, its 53 streams, its
792,730 acres of forests, its four harbors, its outstanding ski hills, and its 120
miles of Lake Superior shoreline make Bayfield County a natural area for further re-
creation development, and
WHEREAS, the improvement of U. S. Highway No. 2 would make Northern Wisconsin
more accessible to people living in high population centers which would result in the
acceleration of growth of Bayfi.eld.County's recreation industry, and
NOW THEREFORE BE IT RESOLVED, that the United States Department of Transporta-
tion be urged to give high priority to the development of U. S. Highway No. 2 into a
freeway type highway, and
BE IT FURTHER RESOLVED, that the County Clerk send copies of this resolution to
Congressman Alvin E. O'Konski, Senator Gaylord Nelson, Senator William Proxmire and
Mr. John A. Volpe, Secretary of Transportation.

BAYFIELD COUNTY SANITARY ORDINANCE (Revised 2-10-70)
Pursuant to Chapter 59.07 (51) Wisconsin Statutes the Bayfield County Board of
Supervisors does ordain as follows:
Section
1.0 GENERAL PROVISIONS
1.1 The jurisdiction of this ordinance shall apply to all the land in
Bayfield County except within the corporate limits of cities and
villages which have adopted codes or ordinances covering the same
subject matter.
1.2 Sanitary facilities for the purpose of this ordinance shall include:
1.21 The construction, alteration or extension of any private sewage
treatment and disposal system.
1.22 The location and construction of private wells as specified in
Section RD 12 of the Wisconsin Administrative Code, and Section
4.0 of this ordinance.
2.0 PERMIT REQUIREMENTS
2.1 No private sewage system or well shall be constructed, altered or re-
located without a sanitary permit.
2.2 Work on a structure or use requiring a private sewage or water system
shall not begin until a sanitary permit has been issued.
2.3 A sanitary permit shall not be issued for any structure or use open
to the public which requires a private sewage or water system until
the plan for such system has been approved by the state agency
authorized to make such..approval.
2.4 An application for a sanitary permit shall be made by the plumber in
charge of the installation or by the owner or his agent to the Zoning
Administrator. Such permit, when issued, shall be posted in a prominent
place on the premises during construction.

2.5 A permit will not be required for the replacement of parts or for any
maintenance.
3.0 SEWAGE TREATMENT AND DISPOSAL
3.1 Sewage treatment and disposal, and septic tank capacity, shall be
in accordance with Chapter H 62.20 Wisconsin Administrative Code,
except that the minimum size septic tank shall be 750 gallons.
3.2 A private sewage system may be installed only where a public sewer
facility is not available.
3.3 Connection to a public sewer, when it becomes available, must be
made within one year.
3.4 Effluent from septic tanks and any other material removed from
waste disposal units shall be disposed of in a manner not to create
a nuisance or a menace to public health. Unless otherwise authoriz-
ed by•the Zoning Administrator the disposal of such material shall
comply with H 62.20 Wisconsin Administrative Code.
3.5 It shall be unlawful to throw, discard, or discharge any can, bottle,
rubbish or liquid waste into a navigable water.

4.1 Soil absorption systems shall not be installed where the minimum
separation distances cannot be met, or on slop6s exceeding 12%.
5.0 INSPECTION
When work is ready for.inspection, prior to covering, the plumber in
charge, or the owner in case no plumber is employed, shall notify the
Zoning Administrator. If the inspection is not made within a reasonable
time the work may be continued.
6.0 PERMITS
6.1 A schedule of permit fees will be kept on file in the
office of the Zoning Administrator.
6.2 A fee will be refunded when a permit has been denied.
6.3 The Zoning Committee may attach special requirements or conditions
to any permit.
6.4 Permits will be subject to revocation by the Zoning Committee.
7.0 APPEAL PROCEDURE
7.1 Any person aggrieved by a decision of the Zoning Administrator may
request, and shall be granted, a public hearing on the matter before
the Zoning Committee within 30 days of such request.
7.2 An appeal to the Committee shall be made within 15 days from the
date of the order or decision from which the appeal is made.
8.0 VARIANCES:...:
8.1 The Zoning Committee will hold public hearings as needed and may
grant variances from the terms of this ordinance as will not be
contrary to State law or the public interest.
8.2 Such variances that are granted shall not have the effect of allow-
ing prohibited uses or permitting a lower degree of protection, and
shall not be considered a precedent in any way.
9.0 PUBLIC HEARING
The Zoning Committee shall give notice of any public hearing by pub-
lication in the official newspaper of the County not less than ten
days prior to the date set for said hearing, as well as mailed notice
to the parties in interest. The local town board shall also be notified
and the notice posted in three public places in that town.
10.0 VIOLATIONS - PENALTIES
10.1 Any violation of any part of this ordinance which is not corrected
on the order -of the Zoning Administrator shall be referred to the
Zoning Committee, who will determine any further act:i.on,except that
no litigation shall be commenced without County Board approval.

10.2 Any person, firm or corporation found guilty of violating any of the provi-
sions of this ordinance shall be fined not less than $10.00 nor more than
$100.00, together with the full cost of such prosecution, and each days
failure to comply shall constitute a separate violation.
10.3 In the event of failure to pay the fine and costs the defendant may be im-
- prisoned in the County, jail for not more than thirty days or until such
time as said fine and costs are paid.
11.0 ADMINISTRATION
11.1 The administration of this ordinance shall be under the direction of the
County Board of Supervisors.
11.2 The Zoning Committee shall maintain whatever staff is necessary to -carry
out these regulations, and -may assign specific duties of enforcement as
needed, including any assignment to a registered sanitarian, a licensed
master plumber, or a licensed master plumber restricted.
11.3 All appointments and pay rates will be approved by the County Board.
12.0 DISCLAIMER OF LIABILITY
This ordinance shall not be construed as assuming any liability on the part of
Bayfield County, or any officer or employee thereof, for any damages that may
result from reliance on the suitability of lands, practicability or safety of any
structure, use or plan proposed.
13.0 AMENDMENTS
The County Board may make amendments to this ordinance in the manner prescribed
by law.
The Bayfield County Sanitary ordinance dated November 16, 1966 is hereby repealed.
This ordinance shall take effect and be in full force after its passage and
publication.

Milwaukee, Wisconsin, has sustained personal injuries because of thedefective and
dangerous condition of Highway 13 in Bayfield County, Wisconsin, and causes this
statement to be made and filed in compliance with Section 81.15 of the Wisconsin
Statutes; the date of the accident was Wednesday, August 27, 1969 at approximately
1:45 P.M. at the curve known in the community as "Dead Man's Curve," two and one-half
miles northwest of Red Cliff on Highway 13, 2500 feet west of County K; the said
defects being failure to provide highway signs notifying of road construction, failure
to provide proper warning as to the slippery condition of the highway due to fresh
blacktopping, failure to post sufficient highway signs indicating a curve, and
failure to provide highway signs reducing the speed limit due to construction; and
that satisfaction of said claim for personal injuries in the amount of Ten Thousand
($10,000..00) Dollars is,claimed against Bayfield County, Wisconsin.
