HomeMy WebLinkAboutCounty Board of Supervisors - Minutes - 4/21/1970REORGANIZATION MEETING OF BAYFIELD COUNTY BOARD OF SUPERVISORS The meeting was called to order at 9:30 a.m. by Walter C. Barningham, County Board Chairman. The following members answered roll call: No. 1 Ray Kyle, Thomas E. Rondeau, Raymond J. Mammoser, Joseph Berweger, Arthur C. Hanson, Ernest Heglund, George Moniza, Marvin 0. Olson, Sanfred Anderson, Elmer L. Suomala, Wallace Johnson, Kenneth C. Howell, Bertyl Nelson, William Celinsky, Arthur Meierotto, Edwin Erickson, Walter Wasmuth, Alvin E. Bratley, Peter Hanson, Bennie R. Rude, Walter C. Barningham, Total 21 present. Moved by Moniza and seconded by Erickson to dispense with the reading of the November and February meeting minutes and that the minutes be approved as printed. Motion carried. The following new members of the board were introduced: Joseph Berweger, District #4; Elmer Suomala, District #10; Marvin Olson, District #8; Arthur Hanson, District #5; Wallace Johnson, District #11. The Chair announced that nominations were in order for the offic�e-of County Board Chairman. Mr. Moniza nominated Walter Barningham. The Chair called three times for additional nominations. Moved by Rude and seconded by Rondeau that nominations be closed. Motion carried. Moved by Rondeau and seconded by Meierotto that the Clerk cast a unanimous ballot for Walter Barningham as Chairman. The Clerk cast a unanimous ballot as instructed and Mr. Barningham was declared elected as Chairman of the Bayfield County Board for a two year term. Mr. Barningham thanked the members of the Board for their support. Nominations for Vice Chairman were then called for. Mr. Erickson nominated Ben Rude for Vice Chairman. Wallace Johnson nomin- ated Tom Rondeau for Vice Chairman. The Chair called for additional nominations for Vice Chairman. Moved by Erickson and seconded by Art Hanson that nominations be closed. Motion carried. 6-4) r 8 44 Y -- April 21,1970 - - The Chair appointed Moniza and Meierotto as tellers. The results of the ballot vote were as follows: Rude . 11 Rondeau 9 Howell 1 The Chair declared Ben Rude elected as Vice Chairman. Mr. Barningham asked the Board to decide whether the Board Chairman should continue naming the various committee chairmen or should each committee pick their own chairman. Moved by Johnson and seconded by Bratley that the committees elect their own chairmen. Discussion followed as to who would call the first committee meeting. The District Attorney advised the Board that they could make their own rule regard- ing the matter. Mr. Rude moved to amend the motion that temporary chairmen be appointed by the Board Chairman. The motion was seconded by Olson. The motion to amend carried. Moved by Moniza and seconded by Berweger that the amended motion be adopted. Motion carried. The Chair announced that the next order of business was the election of the Highway Committee. Moved by Berweger that there be three members on the Highway Committee. There was no second to the motion. Moved by Moniza and seconded by Bratley to recess and that the Board members of each district caucus to nominate a candidate from their respective district. Motion carried. The Chairman called for nominations for District No. 1 Mr. Wasmuth was nominated by Meierotto. There were no further nominations. Moved by Rude and seconded by Erickson that nominations be closed. Moved by Howell and seconded by Mammoser that the Clerk cast a unanimous ballot for Mr. Wasmuth as Highway Committee member, District No. 1. Motion carried. The Clerk cast the unanimous ballot as directed and the Chair declared Mr. Wasmuth elected. April 21, 1970 The Chair announced that nominations were open for District No. 2 Mr. Rude announced that as a result of the caucus he wished to nominate two candidates, Mr. Howell and Mr. Peter Hanson for District No. 2. Moved by Rude and seconded by Kyle that nominations be closed. Moniza and Meierotto were appointed as tellers. The results of the ballot vote were as follows: Howell 11 Hanson 10 The Chair declared Mr. Howell elected as Highway Committee member for District No. 2. The Chair announced that nominations were open for Highway Committee member, District No. 3. Mr. Ernest Heglund was nominated by Moniza. Mr. Joseph Berweger was nominated by Bratley. Moved by Moniza and seconded by Howell that nominations be closed. Motion carried. The results of the ballot vote were as follows: Berweger 13 Heglund 8 - The Chair declared Mr. Berweger elected as Highway Comm- ittee member for District No. 3. The Chair announced that nominations were open for Highway Committeemember, District No..4. Mr. Mammoser was nominated by Rondeau. There were no further nominations. Moved by Rude and seconded by Kyle that nominations be closed. Motion carried. Moved by Kyle that the'Clerk cast a unanimous ballot for Mr. Mammoser as High- way Committee member, District No. 4, seconded by Nelson. Motion carried. The Clerk cast the unanimous ballot as directed, and the Chair declared Mr. Mammoser elected. The Chair announced that nominations were open for Highway Committee member, District No. 5. Sanfred Anderson nominated Bertyl Nelson. There were no further nominations. Moved by Rude and seconded by Celinsky that nominations be closed. Motion carried. Moved by Rondeau and seconded by Celinsky that the Clerk cast a unanimous ballot for Bertyl Nelson as Highway Committee member, District No. 5. The Clerk cast the unanimous ballot as directed and the Chair declared Bertyl Nelson elected. - ---- -- - - April- 21_, 1970---- - - Mr. Wasmuth reported on a letter- from Harley Farrar, Cable,regarding County Trunk "D". H. ' April 21, 1970 The following communication was read: No. 4 STATE OF WISCONSIN/Department of Transportation April 3, 1970 Mr. EdwaidA. Pajala Bayfield County Clerk Courthouse Washburn, Wisconsin Dear Sir: Estimated 1971 Allotment for State Trunk Highway System You are hereby notified that the estimated allotment in the fiscal year ending June 30, 1971, under the provisions of Section 20.395(2vf) and 84.03(3), for expend- iture on the State Trunk Highway System in your county is $121,000. By joint action of your county and the Highway Commission, such allotment in the sum of $1,000. has previously been authorized to be advanced for the improvement of portions of U.S. Highway 2 between Iron River and Ino. The proposed allocation of the extimated 1971 allotment, which is submitted for the consideration of your County Board, is as follows: The sum of $120,000. to be held in reserve for future allocation. The following communication was read: No. 5 STATE OF WISCONSIN / Department of Transportation March 18, 1970 Mr. Edward A. Pajala Bayfield County Clerk Courthouse Washburn, Wisconsin 54891 Dear Mr. Pajala: County Trunk Highway System Changes P-2035 Bayfield County The Highway Commission met on March 3, 1970, and considered the petition of Bayfield County for changes in the County Trunk Highway System. The following action was taken: The petition requested the addition of a road in the Towns of Iron River and Delta to begin near the center of the south one-half of Section 34, Township 47 North, Range 8 West, thence running southeasterly through Section 34, Township 47 North, Range 8 West, and Section 3,2, and 1, Township 46 North, Range 8 West, and Section 7 and 8, Township 46 North, Range 7 West to a point in the south one-half 253 April 21, 1970 of the southwest one -quarter of Section 8, Township 46 North, Range 7 West. THE ADDITION WAS APPROVED. The petition also requested the removal of a road in the Towns of Iron River and Delta to begin near the center of the south one-half of Section 34, Township 47 North, Range 8 West, thence running southeasterly over present County Trunk "H" through Section 34, Township 47 North, Range 8 West, and Sections 3, 11 and 12, Township 46 North, Range 8 West and Sections 18, 7, and 8, Township 46.North, Range 7 West, to a point in the south one-half of the southwest one -quarter of Section 8, Township 46 North, Range 7 West. This portion of old County Trunk Highway "H" is to become a part of the town road systems of the Towns of Iron River and Delta. THE REMOVAL WAS APPROVED. The following Petition was- read: No. 6 COUNTY BRIDGE AID Section 81.38 To the Honorable County Board of Supervisors Bayfield County, Wisconsin. Gentlemen:, - This petition of the Town of Pilsen, Bayfield County, Wisconsin, respectfully represents and shows to your honorable body that: (1) The Pine Creek Bridge on the Watick Road (Plat Road #9-2) on the quarter line between NE NW and NW NE of Section Fifteen (15) Township Forty-seven(47) N., Range Six (6) West on a public highway maintainable by the Town of Pilsen, requires immediate emergency replacement in accordance with the provisions of Section 81.38 of the Statutes. (2) The Town of Pilsen has provided for such portion of the cost of construction as is required by Statute. (3) The total cost of replacement is $ WHEREFORE, Petitioner prays and,makes this petition to your honorable body for County Aid for one-half of the cost to said Town of Pilsen in the amount of 5 , all in accordance with the provisions of Section 81.38 of the Wisconsin Statutes. The following communication was read: No. 7 April 219 1970 To The Honorable County Board of Supervisors:: I hereby submit my resignation as Bayfield Cbunty Forest Administrator -as of this date. Due to health reasons I feel this being a just cause at this time. I wish to be re -instated as Forester -Cruiser for the Bayfield County Forestry Department. Serving as Forester -Cruiser and with by approximately seventeen years of ser- vice with the Forestry Department, I feel that I am capable and knowledgable to benefit and aid the department whenever necessary. At this time I wish to thank one and all.for the help and support that you have given me during the past year and one-half that I have served as Forest Ad- ministrator. It was greatly appreciated. Motion carried. and The following resolution was read: No. 8 WHEREAS, Raymond 0. Anderson is the present Bayfield County Forest Administrator, WHEREAS, Said Raymond 0. Anderson has expressed a desire to be relieved of the duties of said office, and WHEREAS, William Hepner is the Assistant Bayfield County Forester, and WHEREAS, It is in the interest of Bayfield C.bunty and the orderly operation of said office to forthwith appoint an acting Bayfield County Forester, and WHEREAS, Said William Hepner has agreed to accept said position until such time as a permanent placement can be made by action of the Forestry Committee and the Bayfield County Board of Supervisors, NOW THEREFORE BE IT RESOLVED, That on the request of said Raymond 0. Anderson, he is hereby relieved of his duties as Bayfield County Forest Administrator and is appointed, at his request, Bayfield County Forest Cruiser. - 2, 5 i April 21, 1970 BE IT FURTHER RESOLVED, That William Hepner be and he is hereby appointed acting Bayfield County Forest Administrator and he is hereby relieved of his duties as Assistant Bayfield County Forest Administrator, and BE IT FURTHER RESOLVED, That the present salary schedule for said position of Forest Administrator shall continue the same as though said position was being occupied on a permanent basis and the salary schedule for said Forest Cruiser sha-ll be in the amount of $550.00 per month, and BE IT FURTHER RESOLVED; That these appointments shall be effective as of the lst day of May, 1970, and that. the Forestry Committee be and it is hereby directed to take such action -as may be necessary to permanently fill said positions of Bayfield County Forest'Administrator and County Forest Cruiser. The following resolution was read: No. 9 WHEREAS, The Committees of the Bayfield County Board of Supervisors may be required to hold committee meetings during the year 1970 in excess of the number authorized by Statute, NOW THEREFORE BE IT RESOLVED, That all committees of said Bayfield County Board of Supervisors be and they are hereby authorized to meet at such number of times during the year 1970 as may be required by the demands of County business notwithstanding the limitation of such number of meetings as provided by Statute. Motion carried. ----------- - ---- - ---- ---- -- -- ---- ------ -- April---21�-19.70 --- --- -- - - ---- - ---- - -- --- -- ----- --- � The following resolution was read:.- No. 10 , WHEREAS, Sec. 32.08 provides for creation of the Office of Cbmmissioner of G°ondemnation and the appointment of Condemnation Commissioners, and further provides that the compensation of said Cbmmissioners shall be set by the County Board, THEREFORE BE IT RESOLVED, that the compensation for Condemnation Commissioners is hereby set at" 3.00 per hour, and BE IT FURTHER RESOLVED, that,said Commissioners be compensated at the rate of seven (7) cents per mile for each mile traveled to and from their home to the place where the Condemnation Commission conducts its hearings. The following resolution was read: No. 11 WHEREAS, Sec. 144.03 Laws of'1969 makes provisions for the issuance of permits to install septic tanks; BE IT THEREFORE RESOLVED, that the County Clerk and the County Zoning Admin- istrator be hereby designated as the only persons authorized to issue said permits to install septic tanks, and BE IT FURTHER RESOLVED, that all permit fee refunds due from the state shall be paid to the County Treasurer to become part of the county general funds. April -21, 1970 - - - - - -- -- -- -- - The following resolution was read: No. 12 WHEREAS, the Wisconsin County Boards Association has inaugurated a professional employer relations service, and WHEREAS, through said service, counties can obtain help with labor negotiations, employer relations and personnel management, and WHEREAS, said service is named the Wisconsin Institute of Municipal and County Employers, Inc., BE IT THEREFORE RESOLVED, that Bayfield C-bunty subscribe to the professional employers relations service offered by the Wisconsin Institute of Municipal and County Employers, Inc., and BE IT,FURTHER RESOLVED, that,the County Clerk is hereby authorized and directed - to pay to the Wisconsin Institute of Municipal and County Employers, Inc., the regular membership fee based on the total number of employees, and BE IT FURTHER RESOLVED, that said fee shall be charged to the accounts of the Bayfield County Board, Highway Administration and Rest Home based on the total number of employees employed in the County Administration.Building and Jail, High- way Department and the Rest Home on Feb. 1, 1970, and, BE IT FURTHER RESOLVED, that the County Clerk is also authorized and directed to pay any additional fees for consultive services as agreed to between the various departments and the Wisconsin Institute of Municipal and County Employers, Inc. The following resolution was read: No. 13 WHEREAS, a request has been made to Bayfield County through the Executive Committee to arrange for moving the Selective Service Office now located on the second floor of the Bayfield County Administration Building to the first floor of said building, and WHEREAS, there is suitable empty space on the first floor to accomodate said Selective Service Office, and WHEREAS, the Executive Committee has proposed a rental fee of $60.00 per month for rental of the available space, - - - - -- April--21---197Q - - - BE IT THEREFORE -RESOLVED, that the Executive Committee be and is hereby authorized to enter into a lease agreement with the Selective Service Administration or the General Service Administration for rental of said available space at the proposed rental fee of $60.00 per month or such other fee as mutually agreed upon by the said Executive Committee and other proper authorities, and BE IT FURTHER RESOLVED, that the Executive Committee at their option can ar- range for any necessary repairs or renovations to said office and may also decide on nature and amount of custodial, utility and other service to be allowed in said lease. The following resolution was read: No. 14 WHEREAS, Bayfield County contains within its borders a tax exempt Indian Reservation, namely, the Red Cliff Reservation, and WHEREAS., The County has incurred extra expense in law enforcement, arising by reason of Federal legislation removing Governmental controls over Indians and said Bayfield County appears to be eligible for assistance as provided under the pro- visions of Section 20.180 (11) of the Wisconsin Statutes, NOW THEREFORE BE IT RESOLVED, By the County Board of Supervisors of Bayfield County, in annual session assembled, this 21st day of April, 1970, that application be made to the State of Wisconsin, for assistance under the provisions of Section 20.180 (11) of the Wisconsin Statutes, for law enforcement for the fiscal year ending June 30th, 1970, and BE IT FURTHER RESOLVED, That a copy of this Resolution be certified by the County Clerk to the Attorney General of Wisconsin, with a request for certification of such application, as is required under the provisions of Section 20.180 (11) of the Wisconsin Statutes. The following correspondence was read: No. 16 March 18, 1970 Bayfield County Board of Supervisors Washburn, Wisconsin 54891 Attn: Mr. Ed Pajala, County Clerk Gentlemen: - As authorized by the membership of the Bayfield County Taxpayers Alliance at their January 20, 1970 meeting, the Directors of said Alliance passed the following Resolution on the same date: WHEREAS, the Division of Corrections of the State of Wisconsin has decreed that the Bayfield County Jail does not meet statutory requirements in its present condition, and WHEREAS, the architect employed by the Bayfield County Board of Supervisors has designed two separate and distinct plans for remedying this situation, designat- ed as "Plan 1" and"Plan 211, and WHEREAS, both plans were submitted to the Taxpayers of Bayfield County at a Public Hearing, at which time the opinion of said Taxpayers was requested, and WHEREAS, the overwhelming opinion of the Taxpayers vocally and in subsequent petition -form clearly represented a mandate to the County Board of Supervisors to adopt "Plan 1", and WHEREAS, the aforementioned Division of Corrections' -representatives have stipulated that "Plan 1" will be acceptable to permit continued operation of the present Bayfield County Jail without unnecessary and unreasonable Tax burdens to the Taxpayers of said Bayfield County, NOW THEREFORE BE IT RESOLVED THAT: We, the members of the Bayfield County Taxpayers Alliance do hereby implore the Bayfield County Board of Supervisors to take immediate steps to adopt "Plan 1" in its entirety and thus insure compliance of the Bayfield County Jail with existing Division of Corrections standards. As previously stated, motion for adoption of the above Resolution was properly made, seconded and unanimously passed. The following resolution was read: No. 17 WHEREAS, On or about the 7th day of August, 1929, Bayfield County conveyed to the Board of School Directors of the Town of Iron River, certain lots located in the First Addition to Iron River,. described as follows: -- Lots 1 through 8 Block 24 Lots 13 and 14 Block 22 AND WHEREAS, Said property was conveyed to said grantee for school purposes with a reservation included in said deed to the effect that at such time as such property was no longer used for school purposes, said lands would revert to Bayfield County, and WHEREAS, The present school district having control of said property is de- sirous of conveying the above described lots to a private corporation, to -wit: Acme Northern Industries, Inc. of.Iron River, Wisconsin, and WHEREAS, Prior to said conveyance it is necessary that the aforesaid reserva- tion to Bayfield County be released, NOW THEREFORE BE IT RESOLVED, That the aforesaid reservation of reversion to Bayfield County be and the same is hereby released on said described lands and the County Clerk is authorized to issue a quit claim deed conveying said premises to the School Board now having jurisdiction of said school property upon request of said Board. The following Ordinance was read: No. 19 The Bayfield County Board of Supervisors ordains as follows: - (a) There is, hereby created a County Highway Safety Commission to serve without compensation, consisting of: - County Board Chairman County Judge Highway Committee Chairman Superintendent of Schools County Sheriff �Wy Executive Committee Chairman Highway Commissioner_ County Board Members representing political Subdivisions. ' The Chairman of the Commission shall be elected annually by Commission members. (b) MEETINGS. } 1. The commission shall develop a meeting schedule that includes a minimum of four (4) meetings per year. 2. The Commission shall appoint a secretary to keep a record of attendance, minutes and all official proceedings. (c) RESPONSIBILITIES AND DUTIES". 1. To secure voluntary coordination and reenforcement of highway safety activities conducted by the political subdivisions of the county in the functional areas of: April 21, 1970 Driver education Codes and laws Traffic courts Alcohol in relation to highway safety Identification and surveilance of accident locations Traffic records Emergency medical services Highway design, construction and maintenance Traffic control devices Pedestrian safety Police traffic services Debris hazard control and cleanup School bus safety 2. Review and develop a written statement of highway safety needs in the aforementioned functional areas and develop immediate priorities and long-range goals for highway safety improvements. 3. To advise the County Board and its various committees on highway safety matters. 4. It shall maintain liaison with highway safety programs carried on by other municipalities and related State functions conducted in the County. 5. It shall act as an advisory body to the County highway safety co- ordinator for the purpose of developing local actions necessary to implementing projects under the Federal Highway Safety Act of 1966. 6. It shall cooperate with -non -official organizations....and":.groups.:in developing' and conducting public information programs directed to highway safety improvements. 7. Develop procedures for periodic review of local highway safety im- provement programs. The County Board at this time recessed to inspect the repairs currently being done to the Bayfield County Jail. It was pointed out to the Board members that the door leading from the main office to the cell block had been reversed, openings have been cut into the cells to allow passing of food trays to prisoners. The two cells on the first floor have been repaired to allow their use. Heavy steel mesh has been welded to the outside of all of the windows to prevent passage of any contraband to prisoners. There still remains to be installed separate toilet facilities in two of the downstairs cells. All of the repairs done to date and.the remaining repairs left to do have been done with the approv- al of.Alvin T. Nygaard, State Detention Supervisor. Approval.was expressed by many of the Board members of the repairs that have been made to.the jail. - - - - - - April--21-, -1-97 Mr. Dale Brevak, Highway Commissioner, was present and introduced Mr. Tom Kinsey, District Highway Engineer and Mr. Martin Olson, former District Highway Engineer. It is understood that the increased hospitalization benefits now allowed in all departments shall continue in effect in all departments as well as any other fringe benefit approved either verbally or as recorded in the minutes of the personnel committee or the county board, and BE IT FURTHER RESOLVED, that the personnel committee of the county board is hereby directed to make a study of all fringe benefits now being allowed by the various county departments and that it be the policy of the county to equalize as much as practicable all fringe benefits but it is not the intent of the county board that all employees must receive equal benefits. They served a total of 1842 prisoner days. The breakdown is as follows:: 174 - - - - - Adult Males 1 -.- - -.- Adult Female 15 - - - - - Juvenile Males 0 - - - Juvenile Females 8-----Mental Ill 198 Total BAYFIELD COUNTY SHERIFF DEPARTMENT The Bayfield County Sheriff Department and Traffic Department investigated 270 automobile accidents involving personal injury or property damage over $100. 10 persons were fatally injured in automobile accidents in Bayfield County during the year 1969. A total of 150 Traffic Citations were issued during 1969 by the Sheriff De- partment and Traffic Department. 60 breakins were investigated by the Sheriff Department during the year. A total of $7789.63 in receipts was written at the Bayfield County Sheriff Department for 1969. Originally I owned a cabin and 400 feet of lake frontage which was assessed as follows: Valuation (a) 7000.00 cabin (b) 1800.00 100 ft. of improved land (c) 2700.00 300 ft. of unimproved land In 1968 I sold a, b, and 100 ft. of part c, thus retaining 200 ft. of un- improved land. Many years ago; a railroad hotel occupied my present land. The hotel burned to the ground, and left my land practically devoid of vegetation. The low bid is $4,088.00 for blowing it within 1000 feet of shore. Mr. H. Jewel,. U. S. Forest Ranger, Hayward, has designated with us the best site as shown on the attached drawing. We would appreciate your review and approval of this new disposal area in order that we may award the work at the earliest date. We believe the swimming beach will be an improvement to the area.
