To consider and take action on bids covering renovations to the heating system in the Bayfield County Administration Building and Jail. 2. To consider and take action on an Ordinance providing for establishment of a Bayfield County Law Enforcement Commission and other related matters. 3. To consider and take action on an Ordinance regulating large --:.,assemblies of persons in the County. 4. To consider all other matters which may come before the said Board of Super- visors. Rondeau Ernest Heglund Wallace Johnson - -- - - - - -September-10, 1970 - - Mr. Walter Anderson, Mason,was present and was allowed the floor. He spoke regarding the forthcoming meeting on Equalization. Mr. Anderson suggested that a breakdown of real estate classifications be made available to the County Board mem- bers prior to adoption of the equalized valuations of the county. Discussion followed and several questions were raised by members of the Board. Mr. Anderson requested that the County Board refrain from adopting the Equalization Report until the November meeting in order that there may be time for the members to study the report. The next order of business was the receiving of bids for the modification of the heating system. The Chairman then turned the meeting over to the Clerk who read the following.Notice for Bids: No. 3 MODIFYING EXISTING HEATING SYSTEM Bayfield County Court House' Washburn, Wisconsin Notice is hereby given that on September 3, 1970 at 7:00 P.M. CDST, bids will be received by the Board of Supervisors, Bayfield County Wisconsin for Modifying Existing Heating System for the Bayfield County Courthouse, all in accordance with the plans and specifications prepared by Bean, Gilmore and Hill; Inc., 5 North 4th Avenue West, Duluth, Minnesota 55802. Bids will be acted upon officially at the regular meeting of the Bayfield County Board at their September meeting. Said sealed proposals will be received, opened, and read publicly. Each proposal must be enclosed in a sealed envelope, appropriately marked to indicate the work bid upon, and must be addressed to E. Pajala, Clerk, Bayfield County, Washburn, Wisconsin. All bids shall be made on forms similar to those attached to and made a part of the proposed contract documents. The plans and specifications may be examined and obtained at the office of the Engineer. and at the Builders Exchange at Duluth, Minnesota. A11 bids must be accompanied by a certified check or bidders bond in the amount of five percent (5%) of the bid, including alternate bids, payable to-Bayfield County, Wisconsin, as provided in the specifications; said check and the amount thereof or the amount of bidder's bond to be forfeited as liquidated damages if the bidder furnishing the same neglects or refuses to promptly carry out said bid or enter into contract or bond if the same be required by the Bayfield County. Several questions were raised by members of the Board regarding the con- version of the heating plant. a MOTION NO. 4 . Moved by Berweger that the low bid of Shorty's Plumbing & Heating be accepted, the motion was seconded by Suomala. A Roll Call vote was taken: No. 4a Ayes - Kyle, Rondeau, Mammoser, Berweger, A. Hanson, Heglund, Moniza,.Olson, Anderson, Suomala, Johnson, Howell, Nelson, Celinsky, Meierotto, Erickson, Wasmuth, Bratley, P. Hanson, Rude, Barningham Nayes - none Ayes - 21 Nayes - 0 Total - 21 Motion carried. MOTION NO. 5 Motion by Rondeau and seconded by Kyle that the Engineer be directed to notify the contractor of the Board's intentions and to prepare contracts for the execution of the work. Motion carried. The Engineer, being present, was instructed to proceed with the preparation of the contracts. September 10, 1970 The following Ordinance was read: No. 6 ESTABLISHMENT OF SPEED ZONES ON COUNTY TRUNK HIGHWAYS, BAYFIELD COUNTY, STATE OF WISCONSIN THE BOARD OF SUPERVISORS OF BAYFIELD COUNTY, WISCONSIN, ORDAINS AS FOLLOWS:: Section 1. A traffic and engineering investigation having been made on the following described highways, the maximum permissible speed at which vehicles may be operated on said highways, which speed is herewith extablished as reasonable and safe pursuant to Section 349.11, Wisconsin Statutes, shall be set forth herein, subject to approval by the State Highway Commission, and upon the erection of stand - and signs giving notice thereof: 1. County Trunk Highway "M", Village of Cable, Bayfield County. (a) Twenty-five miles per hour for all vehicles from its intersection with.USH 63 easterly for a distance of 0.30 of a mile. (b) Thirty-five miles per hour for all vehicles from a point 0.30 of a mile east of its intersection with USH 63 easterly for a distance of 0.20 of a mile. 2. County Trunk Highway "E", Village of Mason, Bayfield County. (a) Thirty miles per hour for all vehicles from a point 0.05 of a mile west of the C &, NW railroad easterly for a distance of 0.40 of a mile. 3. County Trunk Highway "A", Town of Iron River, Bayfield County. (a) Thirty miles per hour for all vehicles from its intersection with USH 2 southerly for a distance of 0.20 of a mile. (b) Thirty miles per hour for all vehicles from its intersection with USH 2 northerly for a distance of 0.18 of a mile. 4. County Trunk Highway "H", Town of Iron River, Bayfield County (a) Thirty miles per hour for all vehicles from its intersection with USH 2 southerly to the Spider Lake Road. 5. County Trunk Highway "A", Town of Port Wing, Bayfield County. No speed zone is recommended from its intersection with STH 13 south. Advance "Stop Ahead" sign (3611) should be erected } 1300 feet in ad- vance of the stop signs. 6. County Trunk Highway "F", Village of Benoit, Bayfield County. (a) Thirty miles per hour for all vehicles from a point 0.30 of a mile east of C. & NW. Railroad westerly to a point 0.12 of a mile west of said railroad. It is recommended that reverse turn signs with (101",MPH) advisory speed be erected for the turns in the Village of Benoit. 7. County Trunk Highway "G", Moquah, Bayfield' County (a) Thirty miles per hour for all vehicles from a point 0.20 of a mile east of the Burlington - Northern Railroad tracks to a point 0.20 of a mile west of said Railroad. 21Z September-1-0-1 1970 8. County Trunk Highway "C", City of Washburn, Bayfield County. (a) Twenty-five miles per hour for all vehicles from its intersection with STH 13 northwesterly for a distance of 0.25 of a mile. 9• County Trunk Highway "C", Town of Bell, "Cornucopia", Bayfield County. (a) Thirty --five miles per hour for all vehicles from its intersection with State Trunk Highway 13 southeasterly for a distance of 0.50 of a mile. 10. County Trunk Highway "I", City of Bayfield, Bayfield County. ('a) Twenty-five miles per hour for all vehicles from its intersection with STH 13 northwesterly for a distance of 0.50 of a mile. Section 2. Any person violating any provision of this ordinance may be fined not less than $10.00 nor more than $200.00, plus costs, or imprisoned not more than or until such forfeiture 30 days upon failure to pay such fine or forfeiture/and costs are paid, but not to exceed 30 days. Moved by Mammoser and seconded by Nelson that the Clerk be authorized to obtadn the approval of the State Highway Commission on the foregoing Ordinance. Motion carried. September 10, 1970 The following Resolution was read: No. 7 WHEREAS, certain lands located along the laid out route of County Trunk Highway "AT in the Town of Port Wing, Bayfield County, Wisconsin, within the limits of Project S 0270 (2), Iron River - Port Wing Road, are owned by Bayfield County and, WHEREAS, it is necessary that certain portions of such county -owned lands be, established as highway right of way, NOW THEREFORE BE IT RESOLVED, that the County Board of Supervisors of Bayfield County, Wisconsin, in regular session assembled, this 1Oth day of September 1970, do hereby dedicate the following described lands for highway purposes: All that part of a strip or parcel of land in the SE1/4 NE1/4, Sec. 20, T. 49N. , R. 8 W., SW/4 SW/+, NW/4 NWY4, Sec. 21 T. 49 N., R. 8 W., a reference line to r which is described as follows:. r) Beginning at a point 8.5' east of the northeast corner of Sec. 20, T. 49 N., 'a .` R. 8 W., thence S. 11 27' W. 631.9', thence S. 01 26' W., 1604.2', thence S. 0° 25' W. 1092.8', thence S. 1° 13' W. 1906.01. Width of parcel, all as measured perpendicular to radially from and southerly Ni along the reference line from the place of beginning, is as follows: On the Easterly Side: 50' for the first 13:08.81, no distance for the next `wN 2617.41, 60' for the remaining 1308.7'. BE IT FURTHER RESOLVED that the Bayfield County Clerk is hereby authorized and directed to sign and issue a Quit Claim Deed to Bayfield County for the herein, described lands. "A" Parcel No. 14 Moved by Wasmuth and seconded by Nelson that the foregoing Resolution be adopted and that the land be conveyed to the Highway Department. Motion carried. September 10, 1970 Robert Norlin appeared before the Board in behalf of the Cable Natural History Museum. Mr. Norlin introduced Mr. Jackson Burke, Vice President of the Museum, who outlined the purpose of a request to acquire a small parcel of land in the Village of Cable. The following Resolution was read: No. 8 WHEREAS, when County Trunk Highway "M" was relocated in the Village of Cable, the County Highway Department acquired a small parcel of land in the village, and WHEREAS, the entire parcel was not needed for the highway relocation, and WHEREAS, the Bayfield County Highway Department has declared the land not used to be excess right of way, and WHEREAS, the Cable Natural History Museum Inc. owns the adjoining property, and WHEREAS, the said museum would like to acquire this small parcel for museum purposes. THEREFORE, the County Highway Committee recommends that the land described below be released to Bayfield County Land Sales Committee to be sold or otherwise transferred to the Cable Natural History Museum Inc. Description: A parcel of land in the Northeast Quarter of the Southwest Quarter (NE'/4 SW/), Section Eighteen (18) Township Forty-three (43) North, Range Seven (7) West, more particularly described as follows: Commencing at the center of said Section 18; thence west on the east -west quarter line a distance of 38.6 feet; thence South 43' 59' West a distance of 73.3 feet to the point of beginning; thence North 811 34' West a distance of 55.8 feet; thence South 14' 4' West a distance of 88.35 feet; thence north- easterly in a straight line to the point of beginning. MOTION NO. 8a Moved by Rude and seconded by Bratley that the Sales Committee be authorized to sell the parcel for the consideration of One Dollar to the Cable Natural History Museum, Inc. Motion carried. September 10, 1970 The following Resolution was read: No. 9 l' RESOLUTION REQUESTING LEGISLATION TO MAKE A LARGER PORTION OF THE WISCONSIN STATE SALES TAX AVAILABLE FOR AND TO BE ALLOCATED TO THE. COST OF THE OPERATION OF OUR PUBLIC SCHOOL SYSTEM WHEREAS., It is common knowledge to the members of your undersigned Committee, the members of this County Board, and to the people of the State of Wisconsin gen- erally that the real property taxes as presently determined and assessed are re- r pressive, discourage improvements, and place an undue hardship on those with fixed incomes, and WHEREAS, It generally appears that the real property tax burden to a large extent is the result of increased costs of financing public education, and WHEREAS,_.It is the belief of your undersigned Committee that the Wisconsin ;4 �`. State Sales Tax is a more appropriate source of financing a larger portion of the 'costs of public education, , 4j w �4 NOW THEREFORE BE IT RESOLVED, By the County Board of Supervisors of Bayfield County, Wisconsin, that the Wisconsin County Board Association consider the adoption and presentation of a resolution to the Wisconsin State Legislature requesting legislation to make a larger portion of the Wisconsin State Sales Tax available for and to be allocated to the cost of the operation of our public school system, and BE IT FURTHER RESOLVED, That copies of this Resolution be submitted to our respective legislators. The following resolution was read: No. 10 WHEREAS, The Bayfield Electric Cooperative, Inc., has made application to Bayfield C-ounty for a right-of-way.for the construction of a utility transmission line across the Southwest Quarter of the -Southwest Quarter (SW/4 of SW/4) , Section Three (3), Township Forty-six (46) North, Range Nine (9) West and across the Northwest Q`Uarter of the Northwest Quarter (NUY4 of NW/4), Section Twenty-five (25), Township Forty-three (43) North, Range Five (5) West, and September 10 ,_ _1070 WHEREAS, It is deemed in the interest oaf Bayfield Gounty.to grant said easement to said Bayfield Electric Cooperative, Inc., subject to the conditions and except- ions hereto provided for by resolution of this Board of Supervisors, NOW THEREFORE BE IT RESOLVED, That the application for an easement of right- of-way to construct a utility transmission line across the above described property be and the same is hereby granted subject to the provisions and conditions above set forth, and subject to approval by the Bayfield County Forest Administrator and the Bayfield County District Attorney. The following resolution was read: No. 11 WHEREAS, Funds may be•available from time to time during and following emer- gencies under the Federal Disaster Act (public Law 875, 81st Congress; 42 U.S.C. 1855-18559), and WHEREAS, It is necessary that the Bayfield County Board appoint an official representative to act on behalf of Bayfield County to process applications for said financial assistance when the same may become available, NOW THEREFORE BE IT RESOLVED, That the County Clerk be and he is hereby auth- orized and directed to act on behalf of Bayfield County in the application and processing of applications for Federal financial assistance under the aforesaid Federal Disaster Act, when the same may become necessary or deemed desirable in the interest of Bayfield County. September 10, 1970 The following resolution was: read:: No. 12 WHEREAS, The Bayfield County Forest Administrator has resigned his position which is being filled temporarily by William Hepner, Assistant Bayfield County Forest Administrator, and WHEREAS, The Bayfield County Forestry Committee has authority by virtue of previous County Board action to employ a Bayfield County Forest Administrator, NOW THEREFORE BE IT RESOLVED, That the Forestry Committee of this Board be and it is hereby authorized to take such action as may be necessary to fill the vacancy of Bayfield County Forest Administrator, with the present compensation as fixed by the Board for said position to continue and to be in effect in accordance with current schedules. The following resolution was read: No. 13 WHEREAS, Bayfield County is the record owner of the following described premises, to -wit: A parcel of land in the Northeast Quarter of the Southwest Quarter (NE/4 SWy4), Section 18, Township 43 North, Range 7 West, more particularly described as follows: Commencing at the center of said Section 18; thence West on the East-West quarter line a distance of 38.6 feet; thence South 43' 59' West a distance of 73.3 feet to the point of beginning; thence North 81' 34' West a distance of 55.8 feet; thence South 141 4' West a distance of 88.35 feet; thence Northeasterly in a straight line to the point of beginning; and WHEREAS, the Highway Committee for Bayfield County has declared said parcel to be excess right-of-way and has recommended disposal thereof;. September.10, 1970 BE IT RESOLVED that the County Clerk be, and he is hereby authorized to execute and deliver unto the Village of Cable, upon receipt within 60 days of a request for such conveyance by the said Village, a good and sufficient deed of conveyance describing the -above property; (Signed) Thomas E. The following resolution was read: No. 14 WHEREAS, Bayfield County has a high population of coyotes and fox; and WHEREAS, it is of the opinion of the Conservation Committee that the high coyote and fox population is detrimantal to the game bird and game animal pop- ulation of the county, and WHEREAS, the State of Wisconsin through the Department of Natural Resources has made provisions for matching funds to be used for a bounty payment of certain predator animals, and WHEREAS, it'is deemed to be to the best interest of Bayfield County that such a bounty program be instituted, now therefore be it, RESOLVED, that the County Clerk and the County Board Chairman be hereby authorized and directed to make application to the Department of Natural Resources for a County Conservation Aid Program, and be it further, RESOLVED, that said program will provide for a bounty of $10:00 on mature coyotes, $5.00 on coyote pups, $2.50 on mature fox and $1.00 on fox kits, and be it further, RESOLVED, that the total project shall not exceed $4000.00. Hanson, Rude, Barningham Nayes - Olson, Howell, Erickson Ayes - 18 Nayes - 3 Total - 2211 Motion carried. September 10, 1970 The following Ordinance was read: No. 15 1. INTENT A. It is the purpose of the Bayfield County Board of Supervisors to regulate the assemblage of large numbers of people, in excess of those normally needing the health, sanitary, fire, police, transportation and utility services regularly pro- vided in Bayfield County, in order that the health, safety and welfare of all persons in Bayfield County, residents and visitors alike, may be protected. B. It is the intent of this Bayfield County.Bo�L.rd of Supervisors that all sections and provisions of this Ordinance have an independent existence, and, should any section or provision be declared invalid or unconstitutional by a court of com- petent jurisdiction, it is the intent of this Bayfield County Board of Supervisors that any section or provision so declared shall be severable from and shall not affect the validity of the remainder of the Ordinance. II. LICENSE REQUIRED A. No person shall permit, maintain, promote, conduct, advertise, act as entrepreneur, undertake, organize, manage, or sell or give tickets to an actual or reasonably anticipated assembly of 1,000 or more people which continues or can reasonably be expected to continue for 8 or more consecutive hours, whether on pub- lic or private property, unless a license to hold the assembly has first been issued by the Bayfield County Board of Supervisors, application for which must be made at least 30 days in advance of the assembly. A license to hold an assembly issued to one person shall permit any person to engage in any lawful activity in connection with the holding of the licensed assembly. B. As used in this legislation: 1. person means any individual natural human being, partnership, corpor- ation, firm, company, association,. society or group; 2. assembly means a company of persons gathered together at any location at any single time for any purpose. C. A separate license shall be required for each day and each location in which 1,000 or more people assemble or can resonably be anticipated to assemble; the fee for each license shall be $100.00. D. A license shall permit the assembly of only the maximum number of people stated in the license. The licensee shall not sell tickets to nor permit to assemble at the licensed location more than the maximum permissible number of people. E. The license shall not permit the sound of the assembly to carry unreasonably beyond the enclosed boundaries of the location of the assembly. F. This legislation shall not apply to any regularly established, permanent place of worship, stadium, athletic field, arena,. auditorium, coliseum, or other similar permanently established place of assembly for assemblies which do not exceed by more than 250 people the maximum seating capacity of the structure where the assembly is held. G. This legislation shall not apply to government sponsored fairs held on regularly established fairgrounds nor to assemblies required to be licensed by other laws and regulations of Bayfield County. 287 September 10, 1970 H. There is also excepted from this legislation such activities or assemblies as may be officially sponsored by municipalities within Bayfield County nor shall this legislation apply to activities or assemblies officially sponsored by any officially recognized civic organization which has been active in the promotion of civic activities at least six months.prior to the filing of the application for assemblies required by this ordinance with the further provision that said civic organizations sponsoring such activities or assemblies must be affiliated with ai parent organization of both the State of Wisconsin and the United States. III. CONDITIONS FOR ISSUING LICENSE Before he may be issued a license the applicant shall first; A. Determine the maximum number of people which will be assembled or admitted to the location of the assembly, provided that the maximum number shall not exceed the maximum number which can reasonably assemble at the location of the assembly in consideration of the nature of the assembly and provided that, where the assem- bly is to continue overnight, the maximum number shall not be more than is allowed to sleep within the boundaries of the location of the assembly by the zoning or health ordinances of the municipality; B. Provide proof that he will furnish at his own expense before the assembly commences: 1. A fence completely enclosing the OF location,,of sufficient off" the maximum ermissible number from gaining ac ss height and strength to prevent people in excess to the assem iy grounds, which shall have at least four gates, at least one at or near four opposite points of the compass; 2. Pottable water, meeting all federal and state requirements for purity, sufficient to provide drinking water for the maximum number of people to be assem- bled at the rate of at least one gallon per person per day and water for bathing at the rate of at least 10 gallons per person per day; 3. Separate enclosed toilets for males and females, meeting all state and local specifications ,.conveniently located throughout the grounds, sufficient to provide facilities for the maximum number of people to be assembled at the rate of at least one toilet for every 200 females and at least one toilet for every 300 males together with an efficient, sanitary means of disposing of waste matter deposited, which is in compliance with all state and local laws and regulations; a lavatory with running water under pressure and a continuous supply of soap and paper towels shall be provided with each toilet; 4. A sanitary method of disposing of solid waste, in -compliance with state and local laws and regulations, sufficient to dispose of the solid waste production of the maximum number of people to be assembled at the rate of at least 2.5 lbs. of solid waste per person per day, together with a plan for holding and a plan for collecting all such waste at least once each day of the assembly and sufficient trash cans with tight fitting lids and personnel to perform the task; 5. Physicians and nurses licensed to practice in Wisconsin suffieient to provide the average medical care enjoyed by residents of Wisconsin for the maximum number of people to be assembled at the rate of at least one physician for every 1,000 people and at least one nurse for every 1,500 people, together with an enclos- ed covered structure where treatment may be rendered, containing separately enclosed September 10, 1970 treatment rooms for each physician, and at least one emergency ambulance available for use at all times; 6. If the assembly is to continue during hours of darkness, illumination sufficient to light the entire area of the assembly at the rate of at least five foot candles, but not to shine unreasonably beyond the boundaries of the enclosed location of the assembly; 7. A free parking area inside of the assembly grounds sufficient to pro- vide parking space for the maximum number of people to be assembled at the rate of at least one parking space for every four persons; 8. Telephones connected to outside lines sufficient to provide service for the maximum number of people to be assembled at the rate of at least one separ- ate line and receiver for each 250 persons; 9. If the assembly is to continue overnight, camping facilities in com- pliance with all state and local requirements as set forth in the Wisconsin Admin- istrative Code and ordinances of this municipality, sufficient to provide camping accommodations for the maximum number of people to be assembled; 10. Security guards, either regularly employed, duly sworn, off duty Wis- consin peace officers or private guards, licensed in Wisconsin, sufficient to pro- vide adequate security for the maximum number of people to be assembled at the rate of at least one security guard for every 250 people; 11. Fire protection, including alarms, extinguishing deVvices and fire lanes and escapes, sufficient to meet all state and local standards for the location of the assembly as set forth in the Wisconsin Administrative Code and ordinances of this municipality, and sufficient emergency personnel to efficiently operate the required equipment; 12. A11 reasonably necessary precautions to insure that the sound of the assembly will not carry unreasonably beyond the enclosed boundaries of the location of the assembly; 13. A bond, filed with the Clerk of Bayfield County, either in cash or underwritten by a surety company licensed to do business in Wisconsin at the rate of $1.00 per person for the maximum number of people permitted to assemble, which shall indemnify and hold harmless this municipality or any of its agents, officers, servants and employees from any liability or causes of action which might arise by reason of granting this license, and from any cost incurred in cleaning up any waste material produced or left by the assembly. IV. APPLICATION A. Application for a license to hold an actual or anticipated assembly of 1,000 or more persons shall be made in writing to the governing body of this municipality at least 30 days in advance of such assembly. B. The application shall contain a statement made upon oath or affirmation that the statements contained.therein are true and correct to the best knowledge of the applicant and shall be signed and sworn to or affirmed by the. individual making application in the case of an individual, natural, human being, by all officers in the case of a corporation, by all partners in the case of a partnership or by all officers of an unincorporated association, society or group or, if there be no officers, by all members of such association, society or group. __ __ --- . The name, age, residence and mailing address of all persons required to sign the application by IV B and, in the case of a corporation, a certified copy of the articles of incorporation together with the name, age, residence and mailing address of each person holding 10% or more of the stock of said corporation; 2. The address and legal description of all property upon which the assembly is to be held together with the name, residence and mailing address of the record owner(s) of all such property;. 3. Proof of ownership of all property upon which the assembly is to be held or a statement made upon oath or affirmation by the record owner(s) of all such property that the applicant has permission to use such property for an assembly of 1,000 or more persons; to last; 4. The nature or purpose of the assembly; 5. The total number of days and/or hours during which the assembly is 6. The maximum number of persons which the applicant shall permit to assemble at any time, not to exceed the maximum number which can reasonably assemble at the location of the assembly, in consideration of the nature of the assembly, or the maximum number of persons allowed to sleep within the boundaries of the location of the assembly by the zoning ordinances of the municipality if the assem- bly is to continue overnight; 7. The maximum number of tickets to be sold, if any; 8. The plans of the applicant to limit the maximum number of people per- mitted to assemble; 9. The plans for fencing the location of the assembly and the gates contained in such fence; 10. The plans for supplying potable water including the source, amount available and location of outlets; 11. The plans for providing toilet and lavatory facilities including the source, number and location, type, and the means of disposing of waste deposited; material; 12. The plans for holding, collection, and disposing of solid waste 13. The plans to provide for medical facilities including the location and construction of a medical structure, the names and addresses and hours of avail- ability of physicians and nurses and provisions for emergency ambulance service; 14. The plans, if any, to illuminate the location of the assembly including the source and amount of power and the location of lamps; 15. The plans for parking vehicles including size and location of lots, points of highway access and interior roads including routes between highway access and parking lots; 16. The plans for telephone service including the source, number and location of telephones; 17. The,plans for camping facilities, if any, including facilities avail- able and their location; September 10, 1970 18. The plans for security including the number of guards, -their deploy- ment, and their names, addresses, credentials and hours of availability; 19. The plans for fire protection including the number, type and location of all protective devices including alarms and extinguishers, and the number of emergency fire personnel available to operate the equipment; 20. The plans for sound control and sound amplification, if any, including number, location and power of amplifiers and speakers,* 21. The plans for food concessions and concessioners who will be allowed to operate on the grounds including the names and addresses of all concessioners and their license or permit numbers. D. The application shall include the bond required in III, B 13, and the license fee. V. ISSUANCE The application for a license shall be processed within 20 days of receipt and shall be issued if all conditions are complied with. VI. REVOCATION The license may be revoked by the governing body of this municipality at any time if any of the conditions necessary for the issuing of or contained in the license are not complied with, or if any condition previously met ceases to be complied with. VII. ENFORCEMENT A. The provisions of this legislation may be enforced by injunction in any court of competent jurisdiction. B. The holding of an assembly in violation of any provision or condition con- tained in this legislation shall be deemed a public nuisance and may be abated as such. C. Any person who violates II A or who violates any condition upon which he is granted a license may be fined not less -than $1,000.00 nor more than $10,000.00. Each day of violation shall be considered a separate offense. In the event of failure to pay such fine or forfeiture, such person shall be confined in the Bayfield County Jail not to exceed 6 months or until such time as such fine is paid, but not to exceed said 6 month period. It has recently been brought to our attention that our fence includes nine acres of Bayfield County Forestry Crop Land. See attached sheet for description and map. Since we feel this property was purchased by the Bratley's in good faith from Congressman Peavey's estate in the 1930's and has since been maintained by us; that the property is legally ours by adverse possession. This, of course, could only be decided in court. It should also be noted here that Congressman,Peavey owned this property and maintained the fence for quite some time before we purchased this property. And at the time Bayfield County acquired this property, no mention was made or has ever been made'to us that we were on County Land. However, we would _ _ ___ September _10, 1970 rather the County consider (1) a trade or (2) the selling of nine acres. We realize it is not standard policy to trade or sell Forest Crop Land, however, there are ex- ceptions to every rule and we feel this is one of those exceptions. We suggest trading our fifteen acres which are near the questionable acres for the County's fifteen acres. (See page 2.) However, we are certainly open to any suggestions and recommendations by the County as it is our sincere hope that this can be handled in a manner satisfactory to both the County and the Bratley's. The following Ordinance was read: No. 23 THE BAYFIELD ODUNTY BOARD OF SUPERVISORS ORDAINS AND)ENACTS AS FOLLOWS: Section 1 - LAW ENFORCEMENT COMMISSION (a) There is hereby established a Bayfield"C"ounty Law Enforcement Commission for the Sheriff's Department with duties, functions, and authorities, as I herein set forth, said Commission to consist of the members of the Sher- iff's Committee. (b) Members shall be entitled to receive compensation from the County for services actually rendered in conducting the authorized business of said Commission, which compensation shall be at the per diem rate of the County Committees, plus mileage at the prevailing County rate when such services are rendered. (c) At the option of the Commission, the County Clerk shall act as secretary of the Commission and keep the records thereof. All meetings of the Com- mission shall be at the call of the Chairman. Three (3) members shall constitute a gxa.orum. The Commission shall have the power to make suc,- rules and regulations as may be required for the ordinary condvn.t of its business, and may have said rules and regulations printed .':r b(:aklet form and the cost of said booklets and printing shall be paid b;- the County. September 10, 1970 Section 2 - DUTIES OF THE COMMISSION It shall be the duty of the Commission: V (a) To receive applications and conduct examinations of applicants for pos- itions in the Sheriff's Department of Bayfield County with that frequency necessary to maintain an eligible list sufficient to meet the needs of the Department. All written examinations to be conducted by the Wisconsin Employment Service. <` (b) To prepare the budget for the Sheriff's Department. Employ extra help as radio operators on a temporary basis to replace regular operators during their vacation time or sick leave. Recommend to the County Board the purchase of equipment and automobiles needed by the Sheriff's Depart- ment and handle purchases of other equipment where Board approval is not necessary. Establish policies for protection of persons and property in Bayfield County/and handle all matters pertaining to hiring, training, i' examining, promoting, disciplining, or dismissing law enforcement per- sonnel of the County and establishing requirements and duties of said personnel, subject, however, to grievance hearing procedures established by the Bayfield County Board of Supervisors and subject to the Wisconsin Statutes.affecting said procedures. (c) At such time as the Law Enforcement Commission is required to process a grievance against an officer of the Sheriff's Department, at the option of either the Commission or the officer against whom the grievance is presented, the Commission shall add to its panel three additional members who shall be disinterested private citizens, one of whom shall be selected by the Commission,'one by the officer against whom the grievance is pre- sented and the third member by the two persons so selected. Section 3 - ORGANIZATION OF COMMISSION (a) The members of the Sheriff's Committee of the Bayfield County Board of Supervisors, acting in such capacity -at the time of passage of this ordinance, shall constitute the membership of the Law Enforcement Com- mission. In addition to the duties of said Commission hereinabove set forth, said Commission shall also have and be charged with all of the duties, responsibilities and authority of the present Sheriff's Committee and shall hold membership in said Commission for the same term and under the same conditions as such membership is presently held in said Sheriff's Committee. (b) The Sheriff's Committee of the Bayfield County Board of Supervisors is hereby abolished. Section 4 - COMPENSATION (a) The salary of the Chief Deputy shall be the same as that now received by the Under -sheriff. The salaries and hourly wage of all other Bayfield County Sheriff's Department personnel shall remain the same as is now being paid to presently employed persons in said positions. All changes in hourly wages and salaries shall be recommended by the Personnel Com- mittee, subject to final approval by the Board of Supervisors. September 10, 1970 (b) When vacancies occur, they shall be filled by selection by the Commission from a list of three (3) persons receiving the highest grade in a competi- tive examination administered by the Wisconsin State Employment office. (c) Vacancies in part-time Deputy Sheriff positions shall be filled pursuant to rules and regulations promulgated by the Commission. (d) Rank of assigned personnel shall be established by the Commission, except that in all cases the Sheriff and Chief Deputy shall be the first and second ranking officer respectively. (e) Grievance procedures extablished by the Board of Supervisors and the Law Enforcement Commission shall be subject to the provisions of Section 59.21 (8) (a) of the Wisconsin Statutes. September 10, 1970 The following Ordinance was read: No. 25 THE BAYFIELD COUNTY BOARD OF SUPERVISORS ORDAINS AND ENACTS AS FOLLOWS: Section 1 - SHERIFF'S DEPARTMENT. Commencing October lst, 1970, all Bayfield County law enforcement personnel and units shall be combined under the Bayfield County Law Enforcement Commission and shall be a part of the Bayfield County Sheriff's Department. Section lA - All special and part-time deputies shall be charged with duties hereunder as set forth under Section 59.23, as may be assigned by the Sheriff or the Chief Deputy with the approval of the Sheriff. Section 2 - CHIEF DEPUTY. Commencing October lst, 1970, there is hereby created the position of Chief Deputy within the Bayfield County Sheriff's Department, the position of Under - sheriff having been abolished as of said date. Section 3 - APPOINTMENT OF CHIEF DEPUTY AND FULL-TIME EMPLOYEES The Chief Deputy and all present full-time employees of the Bayfield County Sheriff's Department, shall be appointed by the Law Enforcement Commission and approved by the County Board, except that the Undersheriff in office at the time of the passage of this resolution shall be and is hereby appointed Chief Deputy and all other full-time employees of the Bayfield County Sheriff's office and Traffic Department shall be retained in positions and salaries in effect at the time of passage, except that the present traffic officers shall hereafter be classified as full-time deputies. Section 4 - TENURE. The Chief Deputy and all full-time employees as designated in Section 3 shall hold office in the same manner as any other deputy and shall not be subject to demotion, suspension or dismissal, except for good cause, and after due notice and hearing before the Law Enforcement Commission, whose determination is sub- ject to review upon appeal to the Circuit Court of Bayfield County. Section 5 - QUALIFICATIONS OF CHIEF DEPUTY. The following qualifications shall apply: (1) Male citizen of the U.S.A.`and State of Wisconsin. (2) Age 21 to 55 years. (3) Resident of Bayfield County not less than One (1) year. (4) High school graduate or equivalent education. (5) In good health., Not less than 5'8" in height. Weight in proportion to height. Must pass physical examination. (6) Experience preferred but not essential. (7) Shall not have been convicted in any court of a criminal offense defined by Statute as a felony® (8) Written examinations will be conducted by the Wisconsin Employment Serv- ice for applicants and they.,must receive a grade of at least 70 to be considered for the position and that the Commission must select the appointee from the 3 applicants receiving the highest grade. September 10, 1970 Section 6 - SALARY OF CHIEF DEPUTY. The starting salary of the Chief Deputy shall be established by the Personnel Committee with approval of the County Board. Section 7 - DUTIES OF CHIEF DEPUTY. The Chief Deputy shall outrank all other personnel of the Bayfield County Sheriff's Department except the Sheriff. In addition to being the highest ranking officer of the Department, it is the intent that he shall be the head administrative officer under the Sheriff. He shall also perform related work required as follows: (1) Act for the Sheriff in his absence. (2) Be the head administrative and personnel officer within the Department. (3) Direct investigations, internal operations and civil process divisions. (4) Assign and review work of officers and employees within the Department. (5) Advise personnel on policies and procedures. (6) Prepare and make recommendations to the Law Enforcement Commission and County Board. (7) Keep records and make reports as directed by the County Board or Law En- forcement Commission. (8) It shall be his duty to make complaint for disciplinary purposes to the Sheriff and to the Law Enforcement Commission against any Deputy he believes has acted so as to show him to be incompetent or to merit suspension, de- motion, or dismissal. (9) It is the intent in connection with the specifying of duties to provide, within the limitations of the existing law and constitution, a continuity in law enforcement as it relates to the Sheriff's Department and to provide an incoming Sheriff a working organization and to relieve the Sheriff of details in connection with the responsibilities of that office. It is the further intent that the position of Chief Deputy is to be compared to that of an executive Vice -President, responsible for the operation of a bus- iness organization. It is understood that all general policy and direction will be extablished by the Sheriff, but that the Chief Deputy, with the authority herein, will furnish the necessary leadership and administration on a continuing basis so as to eliminate morale problems and provide a more efficient operation of the Department. The Chief Deputy shall out- rank all other deputies, sergeants, lieutenants or captains. In addition to being the highest ranking officer of the Department and performing the duties of Deputy Sheriff it is the intent of this ordinance that he shall be the head administrative officer under the Sheriff. Section 8 - The office of Cbunty'Traffic Officer is hereby abolished and such traffic officers as are presently employed by Bayfield County shall be classified as full-time deputies and governed by the regulations estab- lished by the Board for such officers. Mr. Robert Norlin appeared before the Board at this time regarding anc`:easement requested by the Town of Iron River for construction of a sanitary sewer. The following resolution was read: No. 28 WHEREAS, the Iron River Lion's Club will sponsor a Snow -mobile Derby during the month of January, and WHEREAS, the Iron River Lion's Club has asked for permission to use the Bay - field County Fairgraounds for this event, and now therefore be it, RESOLVED, that the Iron River Lion's Club be given permission to use the fairgrounds for the Snowmobile Derby if they will provide for adequate liability insurance, and will agree to clean up the grounds after the event has been held, and be it further RESOLVED, that the insurance coverage furnished for this event be studied and approved by the Bayfield County District Attorney before permission is granted for the use of the fairgrounds. Ledin, District Attorney, appeared before the Board and spoke in relation to the County's liability in regard to public events held at the Fair- grounds. He also stated that his recommendation was that the County consider a non-profit organization to operate the. Bayfield County Fair. Operation of the Bay - field County Fair by a non-profit organization would relieve the County of liability• in the event of accidents. The following resolution .was read: No. 29 WHEREAS, Bayfield County is eligible to participate in fund /sharing projects under the Omnibus Crime Control and Safe Street Acts of 1968 through the Wisconsin Council on Criminal Justice, and WHEREAS, Funds under said Act are available to Bayfield County for certain types of equipment and for the partial funding of certain enforcement programs and activities, and WHEREAS, The Sheriff's Department of said County has requested that an appli- cation be processed for the following items of equipment and funding for certain programs of law enforcement, to -wit: (a) Video tape equipment having an estimated maximum cost of $1500.00. (b) A program for law enforcement on the Red Cliff Indian Reservation located in Bayfield County, Wisconsin, and WHEREAS, It is deemed in the interest of Bayfield County to process an appli- cation for cost sharing in the purchase of the aforesaid equipment and for financial assistance in carrying out a program of law enforcement on the aforesaid Red Cliff Indian Reservation, NOW THEREFORE BE IT RESOLVED, That the Sheriff's Committee and the Committee designated to act for Bayfield County under the above said crime control Act be and said Committees are hereby authorized to make application for cost sharing in the purchase of the aforesaid video tape equipment and to purchase�aaid equipment for said Sheriff's Department upon -the granting of cost sharing funds by the afore- said Wisconsin Council on Criminal Justice and other agencies cooperating in said program, and BE IT FURTHER RESOLVED, That the aforesaid Committees explore the possibility of obtaining funds under said Act to implement a program of law enforcement on the aforesaid Indian Reservation and to report back thereon at the November, 1970 meeting of this Board of Supervisors. September 10, 1970 The following resolution was read: No. 30 WHEREAS, Bayfield County is the record owner of the Northeast Quarter of the Northwest Quarter (NE1/4 NW/4), of Section Seven (7), Township Forty-seven (47) North, Range Eight (8), West, and WHEREAS, the Town of Iron River, and the Iron River Sanitary District #1 are presently engaged in the construction of sanitary sewers to service properties in said section, and WHEREAS, it is deemed in the interest of Bayfield County to grant an easement to said Town and District, subject to the conditions and exceptions of this Board of Supervisors, now therefore be it, RESOLVED, that an easement for the construction, reconstruction and mainten- ance of a sanitary sewer system be granted to said Town and District over the west thirty-three (33) feet of the above described forty, lying north of the Town Road, subject to the provisions and conditions previously provided for by resolution of this Board of Supervisors. The following communication was read: No. 32 Cable - Namakagon - Drummond UNION' AIRPORT Cable, Wisconsin 54821 August 31, 1970 Bayfield County Board of Supervisors Mr. Ed Pajala, Clerk Washburn, Wisconsin 54891 Gentlemen: The Airport Commissioners,of Union Airport at Cable, Wisconsin, hereby request the sum of $5,000.00 be placed in the budget of Bayfield County for the 1970-71 year to help us meet'the needs of this airport and to purchase land for expansion planned for 1971-72. The plans now under consideration, calls for the E-W turf runway to be length- ened to 4800' and paved -to accommodate the jet age coming in air travel. The en- closed letter from the Division of Aeronautics advises us to purchase 29.8 acres soy September 10, 1970 of land owned by Tom Rondeau, Sr. which lies directly at the west end of the runway and would be used for this proposed extension. We have an option to purchase this property on or before January 31, 1971 for the price of $3000.00. This is the only land purchase necessary to extend this runway, for we have exchanged approximately 25 acres of airport property for 33 acres of land from Mr. Tony Wise, which also lies in the path of this new proposed extension. The four owning municipalities each contribute $500.00 each year towards the upkeep of this airport which is located right in the midst of vast building expansion now progressing in this end of your County. I need not remind, you this is.the area Bayfield County will now have to rely on for the additional tax dollars with the anticipated closing of the Du Pont Plant and the loss of their contribution in revenue. Also .enclosed is the treasurer's report of our expenditures for the past fiscal year. It is evident that our request for $5,000.00 aid is realistic and urgent. The Bayfield,County Highway Department has promised to seal coat the' N-S. paved runway yet this summer so we shall have this added expense besides.those shown on the treasurer's report. Dear Mr. Brevak: This letter will acknowledge your communication of June 15, 1970, in reference to the claim of Mrs. Ray Kyle for damages done to her automobile by virtue of an alleged defect on Highway 2 occurring on May 21, 1970. I have forwarded this claim to the County Clerk requesting that he notify our insurance company and also that he present the claim to the next meeting of the Executive Committee to determine what disposition should be made. The acceptance of this claim for processing does not indicate acceptance of the claim or acknowledge that the claim is made in proper form. In fact, there may be some question about the form and manner in which the claim is presented and the claimant may desire to check the law or consult an attorney as to the exact requirements of making such a claim against a municipality.
