The following Communication was read: No. 5 Chequamegon National Forest Park Falls, Wisconsin 54552 Reply to: 5420.Purchases Subject: F.S. Purchase, Wisconsin, Chequamegon, Boelkow, Frederic E., Sr. - Tract #3632 To: Bayfield County Board of Supervisors Courthouse Washburn, Wisconsin 54891 August 25, 1970 The Forest Service is in the process of purchasing Lots 3 and 4 of Section 11, T. 44 N., R. 6 W., Town of Grand View, containing 73.86 acres. The property consists of woodland with frontage on the south shore of East Davis Lake. The North Country Trail passes along the north side of East Davis Lake, and a Forest Service parking area and rest stop is located adjacent to County Highway "D" less than one -quarter mile northwest of the subject property. The acquisition will provide enviromental control of the land near the trail and along the south' -shore of East Davis Lake as well as eliminating one and one - quarter miles of interior Forest boundary. If you desire to comment on the proposed purchase, we would like to hear from you. Richard C. S. Forest Service. Moved by Erickson and seconded by P. Hanson to table the foregoing communication until the afternoon session. Motion carried. The following communication was read: No. 6 State of Wisconsin Department of Transportation June 19, 1970 Division of Highways County Treasurer: Bayfield County Dear Sir: Allotment for County Trunk Highways June 30, 1970 Sections 20.395-(4) (x) and 83.10 (1), Wisconsin Statutes The enclosed check is in payment of your county's allotment for county trunk highways available June 30, 1970, pursuant to Sections 20.395 (4) (x) and 83.10(1), Wisconsin Statutes. September_29, 1.970 The following Gbmmunication was read: No. 7 State of Wisconsin Department of Transportation April 15, 1970 Bayfield County To: County Treasurers Prepayment of 1970 Supplemental Highway Aid for County Trunk Highways, Section 20.395(4)(xg)(xm), Wisconsin Statutes The enclosed State Treasurer's check in the amount indicated in the right-hand column below represents the prepayment of the 1970 supplemental highway aid for County Trunk Highways in your county pursuant to Section 20.395(4)(xg)(xm), Wisconsin Statutes. It is computed as 50 per cent of the supplemental aid paid to your county in September, 1969. The exact :amount of the 1970 supplemental aid paid to your County Trunk Highways pursuant to Section 20.395(4)(xg)(xm) will be determined after the close of the current fiscal year on June 30, 1970. The balance of your 1970 supplemental highway aid, after deducting the amount of this payment, will be re mitted during the month of July. The funds represented by this payment are supplemental to and are to be used for the same purposes as the County Trunk Allotment under Section 83.10(1), which will be paid in July. September 29, 1970 The following Resolution was read: No. 8 WHEREAS, The Bayfield County Board at a meeting held September 10, 1970, adopted a resolution_ allowing the Iron River Lion's Club to use the Bayfield County t Fairgrounds for a Snowmobile Derby in January, 1971, and WHEREAS, no provisions were made in the Resolution to instruct any County De- partment to have charge of the use of the grounds for the event, now therefore be it, RESOLVED, That it shall be the duty of the Bayfield Y Count Fair Committee to Y na see to it that all the provisions of the aforesaid resolution be complied with.. Motion carried. Mention was made of the fact that the various departments should have their proposed budgets in by October 15th. Mr. Roland E. Wildes, Supervisor of Assessments, and Mr. Leon Gesicki, from the Rice Lake Office, Bureau of Property Taxation were present. Mr. Wildes re- ported on the recommended real estate valuations for the respective towns, villages, and cities in the county for the year 1970. An overall increase of 11.86% was noted. Several questions regarding the valuation figures were raised by members of the Board which were answered by Mr. Wildes. Mr. Walter Anderson, Mason, was present and raised some questions regarding valuations of wooded lands. Mr. Harold Schulte, Cable, was allowed the floor and questioned Mr. Wildes regarding the Wild River lands being taken over by the government along the Nama- kagon River. M'a September.29, 1970 MOTION NO. 9 Moved by Mammoser and seconded by A. Hanson that action on adopting the recommended valuations be deferred until the November meeting of the County Board. Motion carried. Moved by Berweger and seconded by Erickson that the Board adjourn for the noon lunch. Motion carried. The meeting was called to order at 2:00 P.M. by Walter C. Barningham, Chairman. MOTION NO. lla Moved by Celinsky and seconded by Nelson that the County Board go on record opposing the sale of Lots 3 and 4, Section 11, T —44 N., R. 6 W., Town of Grand View, to the U. S. Forest Service. Motion carried. MOTION NO. 12 Moved by Suomala that Tom Rondeau, Chairman of the Zoning-Ag. Committee be authorized to attend the meeting in regard to the Wild Rivers Bill at Hayward on October 5, 1970; the motion was seconded by Nelson. Motion carried. September 29, 1970 v c� N N C� 0 MOTION NO. 13 Moved by Suomala and seconded by Celinsky that the County Board prepare a resolution to submit to our legislative representatives urging them to take legis- lative action to relieve the local governments of the loss of tax revenue caused by the acquisition of tax producing property by the Federal and State governments. Motion carried. The County Clerk brought the Board up to date on the work being done regarding the modification of the heating system. The following relocation order was read: No. 14 THE COUNTY HIGHWAY COMMITTEE FINDS AND DETERMINES THAT: The proper establishing, laying out, widening, enlarging, extending, construct- ing, reconstructing, improving, or maintaining a portion of the highway now desig- nated as County Trunk Highway "D", from a point 870 feet east and 980 feet north of the southwest corner of Section 2, Township 43 N., Range 6 W., thence in a northerly direction to a point 1610 feet north and 235 feet west of the south one -quarter corner of Section 2, Township 43 N., Range 6 W. and on roads or lands in and about and along and leading to same, requires certain relocation or change and the ac- quisition of lands or interests in lands as shown on the map or copy thereof marked: "PLAT OF RIGHT OF WAY REQUIRED, PROJECT E0770(9)", for the Namekagon Lake - Trapper Lake Road, C. T. H. "D", Bayfield County, dated July 1, 1970, the same being sheets No. 4.0, 4.1 inclusive of the plans for said project, and Pursuant to its authority under Section 83.08, Wisconsin Statutes, THE COUNTY HIGHfJAY COMMITTEE HEREBY ORDERS THAT: (1) The said highway is hereby laid out and established to the lines and widths as shown on the said plat. (2) The required lands or interests in lands as shown on the plat shall be acquired by the County Highway Committee, pursuant to the provisions of Section 83.08 and 32.05(1), Wisconsin Statutes, (3) This order supercedes and amends the previous order issued by the County Highway Committee on July 9, 1969. September 29, 1970 The following Communication was read: No. 15 State of Wisconsin Department of Health and Social Services August 6, 1970 TO ALL COUNTY CLERKS Complaints have been registered with this office that in some instances county ordinances have been promulgated and adopted relative to the installation of private sewage disposal systems which appear to be in conflict with State Stat- ute 145. Therefore, this office is taking this opportunity to notify all county boards that there are existing problems and to apprise them of State Statutes govern- ing the activities of persons involved in the preparation and installation of private sewage disposal systems. It is sincerely suggested that, after the county board members have had the opportunity to review and discuss this information, they inform the persons in each of their counties who have been delegated the authority to supervise and enforce regulations pertaining to the installation of private sewage disposal systems of the following statutory requirements and procedures to be followed in the future operation of their offices. The installation and alteration of any private sewage treatment or disposal system is defined as plumbing under Section 145.01 (1) (b) and therefore requires licensed plumbers to make such installations or alterations as stipulated in Section 145.06 (1) (a), (2), (3) and 145.14. Reference is also directed to Section 144.03, enclosed. Complaints have been registered with this office by persons licensed under Chapter 145 that they are being prohibited from making and supervising percolation tests and soil borings as required under Section H 62.20 as well as the Statutes. The above complaint has been discussed with our legal counsel in the State Department of Justice, Office of the Attorney General, and we have been informed under Section 145.04 (2) that a municipal or local ordinance cannot supersede statu- tory authority nor under this particular section of the Statutes can it prohibit a licensed plumber from conducting percolation and soil boring tests with regard to the installation of private sewage disposal systems or for consideration, evaluation and acquisition of permits required for this type of work. Investigation and consultation with some county personnel indicate that these prohibitions have been invoked because the licensee has failed to conduct proper tests. The above indicates that the licensee is failing to comply with his obligation under Chapter 145 and therefore provides the local authority with the privilege of reporting to this department under Statute 145.04 (3) such violations, requesting formal action by the department for suspension or revocation of the individual's license as provided for under Section 145.10 of the Statutes. Enclosed for your assistance and reference is a copy of the current Statute, Chapter 145. Should you desire additional copies for distribution to your board members, please feel free to make your request known to this office. September 29, 1970 A delegation from the Pike's Bay Marina entered the meeting at this time. The following resolution was read: No. 16 WHEREAS, Pike's Bay Marina has applied to the State of Wisconsin Department of Natural Resources for a permit to construct a breakwater adjacent to their property in the Town of'Bayfield, Bayfield County, Wisconsin; and WHEREAS, they have proposed two plans for the construction of said breakwater; now therefore, be it RESOLVED by the County Board of Bayfield County, meeting in session this �9tn day of September, 1970, that the County Board go on record as approving Alternate Plan #2 but continuing their objection to Plan #1. Holmgren, Vice President of Port Industries, Inc., was allowed the floor and presented a proposal for developing an area for year round use in the vicinity of the present Mt. Ashwabay site by Port Industries. The project would include a motel, condominiums, and golf course facilities with development covering a four or five year period. f The Chair declared a recess of ten minutes. MOTION NO. 17 Moved by Olson and seconded by Art Hanson to withhold action on the Ordinance regarding large assemblies until the November meeting and that copies be made for the Board members. September 29, 1970 i Al The following Resolution was read: No. 18 BE IT RESOLVED by the County Board of Supervisors of Bayfield County, Wisconsin, meeting in session this 29th day of September, 1970, That the application of Port Industries, Inc:-., dated April 11, 1970 and amended September 28, 1970 be accepted and that the lands in Sections 29, 30, 31 and 32, Township 50 North, Range 4 West be withdrawn from the County Forest pursuant to Section 28.11 (11) (a) of the Wisconsin Statutes. That the land to be withdrawn is more fully described in the exhibit filed with the County Forestry Committee by Port Industries, Inc:., on the 24th day of September, 1970. (Signed:) W. C.
