Barningham, County Board Chairman. The following members answered roll call: No. 1 Ray C. Kyle, Thomas E. Rondeau, Raymond J. Mammoser, Joseph Berweger, Arthur C. Hanson, Ernest Heglund, George Moniza, Marvin Olson, Sanfred Anderson, Elmer Suomala, Wallace Johnson, Kenneth C. Howell, Bertyl Nelson, William Celinsky, Arthur Meierotto, Edwin M. Erickson, Walter Wasmuth, Alvin E. Bratley, Peter Hanson, Bennie R. Rude, Walter C. Barningham - total 21 members present. MOTION NO. 2 Moved by Moniza and seconded by Johnson to dispense with the reading of the minutes of the September 29, 1970 meeting. Motion carried. The Chairman asked the members of the board whether they preferred to meet on Wednesday, it being Veteran's Day. A show of hands indicated that the group was in favor of meeting on Wednesday. The following communication was read: No. 3 Mr. Ed Pajala, Clerk Honorable County'Board of Supervisors Bayfield County Washburn, Wis. Sirs: Iron River, Wis. October 17, 1970 After 12 years at your service as trustee of our rest home I have decided to retire. Wish to thank your honorable body for the faith and trust you have placed in me. Also to thank the trustees, management and employees for their co-operation in operating a home second to none in the state. November 10, 1970 The following communication was read: No. 4 November 5, 1970 Bayfield County Board of Supervisors Washburn, Wis. Gentlemen: I herewith tender my resignation as a Trustee of the Bayfield County Rest Home, effective January 1, 1971. This decision was not an easy one to make nor a new thought, having seriously considered doing so a year ago. Am thankfull and deeply appreciate having had the opportunity to serve in this capacity. Mr. Rondeau then commented on the proposed ordinance. The following Amendatory Ordinance was read: No. 7 ` The County Board of Supervisors of Bayfield County, Wisconsin, does ordain as follows: That the Zoning Ordinance of Bayfield County be and is hereby amended so that as amended it will contain the following provisions: 1.0 GENERAL These regulations shall apply to the shorelands of navigable waters as defined in 144.26 (2) (d) Wisconsin Statutes in the unincorporated areas of Bayfield County which are: 1.1 Within one thousand (1,000) feet from the normal high water elevation of those lakes, ponds and flowages listed in the Wisconsin Conservation Division publi- cation "Wisconsin Lakes 218-64". 1.2 Within three hundred feet of the normal high water elevation or to the landward side of a floodplain of navigable reaches of rivers and streams. Reaches of rivers and streams shall be considered navigable if they are indicated as "continuous" -on the U.S. Geological Quadrangle Survey maps of Bayfield County. 1.3 Normal high water elevations, where not otherwise established, shall be deter- mined by the Zoning Administrator, subject to appeal under Section 6.0. 1.4 The more restrictive provisions of any town ordinance relating to shorelands will continue to apply. 1.5 All land uses shall comply with the Bayfield County sanitary and subdivision ordinances. 1.6 These regulations shall not require approval of, or be subject to, disapproval by any town or town board. November 10, 1970 2.0 SETBACKS from the WATER All permanent structures, except legally erected piers, wharfs and boathouses, shall be set back a minimum of 75 feet from the high water line of any navigable water. A reduced setback shall be allowed where the existing buildings within 500 feet of the proposed site are at less than the required setback. In such cases, the setback shall be the average of the nearest main building on each side of the proposed site, or if there is no building on one side, the average of the setback for the one building and the required setback, but in no case shall it be less than 40 feet. 3.0 REMOVAL of SHORE COVER 3.1 Cutting of trees and natural shrubbery within a strip parallelling the shoreline and extending inland 35 feet from the normal high water mark of the shoreline, shall be limited as follows: 3.11 Within any 100 foot length of this strip no more than 30% shall be clear cut. (a) A conditional use permit will be required for any clear cutting on on slopes greater than 20'0. 3.12 In the remaining 70% of the strip, cutting shall be limited so as to preserve the natural beauty of a woodland cover and to control run-off. 3.13 From the inland edge of the 35-foot strip to the outer limits of the shorelind area the commercial harvesting of trees will be allowed under accepted forest management practices. 4.0 FILLING -DREDGING - GRADING A conditional use permit shall be required for more than 1,000 square feet of filling or grading in' any wetland or within 300 feet of a navigable water. (See Chapter 30 Wisconsin Statutes for State permit requirements.) 5.0 SIGNS No sign shall be designed and erected so as to be seen and read from any water area. 6.0 LAND USE PERMITS A land use permit shall be required for any new residence, any building erected, relocated or structurally altered, or where any use of the land may be substantially changed. 6.1 A schedule of permit fees as approved by the County Board will be kept on file in the office of the Zoning Administrator. 7.0 APPEAL PROCEDURE Any person aggrieved by a decision of the Zoning Administrator may have the matter reviewed by the Zoning Committee. Thereafter, such person may request, and shall be granted, a hearing before the Board of Adjustment. 7.1 An appeal to the Board of Adjustment may be taken by any person within 30 days from the date of the order or decision from which the appeal is made. 8.0 BOARD of ADJUSTMENT There shall be a Board of Adjustment, consisting of five members appointed according to the provisions of Section 59.99 Wisconsin Stat- utes, which section shall govern the duties of said Board. 9.0 ZONING DISTRICTS The shorelands of Bayfield County are divided into the following districts: (1) Conservancy District, (2) Recreational -Residential District, and (3) General Purpose District. 16"` 9 4 November 10, 1970 The following U.S. Geological Survey Quadrangle maps are designated the Shore - land Zoning Map of Bayfield County: Map No. Title Map No. Title 1 Squaw Bay 13 Washburn 2 Sand Island .13A Long Island 3 York Island 14 Ino 4 Port Wing 15 Moquah 5 Bark Bay 16 Ashland 6 Cornucopia 17 Ellison Lake 7 Mt. Valhalla 23 Namakagon 24 Clam Lake 9.11 The location of the districts are shown on the above named maps. 9.12 Questions regarding exact district boundary locations shall be decided by the Zoning Administrator - subject to appeal under Section 6.0. 10.0 CONDITIONAL USES Some uses may be necessary or desirable in a particular district, but certain restrictive conditions ma,:rie.od.;'to be imposed to make them compatible with the basic uses in that district or an adjoining district. Such conditional uses will be permitted when approved by the Zoning Committee. 10.1 BASIS of APPROVAL The Committee will consider the effect of any use in re- lation to the character and quality of the immediate area, the topography, erosion and pollution potential, transportation needs, demand for related services and other considerations relating to the general welfare. 10.2 Conditional uses common to all districts will be communication and power lines, public transportation facilities, and related structures. 10.3 The uses named in the various districts are without limitation because of enumeration. (1) Conservancy District This district includes all shorelands designated as swamps and marshes on the official Shoreland Zoning Map of Bayfield County. Permitted Uses: Harvesting wild crops, forestry, wildlife preserves, parks and sim- ilar open space uses. Conditional Uses: General farming provided farm animals shall be housed at least 200 feet from any non -farm residence or navigable water. Dams, ponds, flowages. Piers, docks, boathouses. November 10., 1970 (2) Residential -Recreational District This district includes all the shore - lands designated in red on the official Shoreland Zoning Map. Permitted Uses: Seasonal and year round residences Accessory uses Horticulture, gardening Any permitted use in the Conservancy District Conditional Uses: Resorts, dinner clubs, taverns, marina's Mobile home parks (3) General Purpose District This district includes all the shorelands which are not in the Conservancy and Residential -Recreational District. A wide range of uses will be permitted provided they comply with the provisions of this ordinance. Dated: 11-10-70 Thomas E. November 105 1970 _- Dale Brevak was nominated for Highway Commissioner by Mammoser. The Chairman called three times for additional nominations. There were none. Moved by Rude and seconded by Erickson that nominations be closed. Motion carried. MOTION NO. 9 Moved by Moniza and seconded by Nelson that the Clerk be instructed to cast a unanimous ballot for Dale Brevak as Highway Commissioner for a term of two years. Motion carried. The Clerk cast the unanimous ballot for Dale Brevak as directed and the Chair declared Dale Brevak elected as Highway Commissioner. The following resolution was read: No® 10 WHEREAS, Bayfield County is the record owner of the Northeast Quarter of the Northwest Quarter (NE/4 NW/4), of Section Seven (7), Township Forty-seven (47) North, Range Eight (8) West, and WHEREAS, the Town of Iron River, and the Iron River Sanitary District #1 are presently engaged in the construction of sanitary sewers to service properties in said section, and WHEREAS, it' is deemed in the interest of Bayfield County to grant an easement to said Town and District, subject to the conditions and exceptions -of this Board of Supervisors, now therefore BE IT RESOLVED, that an easement for the construction, reconstruction and maintenance of a sanitary sewer system be granted to said Town and District over the North Fifty (50) feet of the above described forty, subject to the provisions and conditions previously provided for by Resolution of this Board of, Supervisors® Signed: Marvin 0. The following resolution was read: No® 11 REPORT OF THE COMMITTEE ON EQUALIZATION TO THE HONORABLE BOARD OF SUPERVISORS OF BAYFIELD COUNTY: Gentlemen: We, the undersigned Committee on Equalization of Bayfield County, after a careful examination of all evidence and data placed before us by the Supervisor of Assessments of said County, and all other data at our disposal, do hereby agree that November 10.1 1970 'the following valuations set out after each taxation district are the full and correct valuations,of the real and personal property of said county for the year 1970 and recommend that the county assessment of district values be made on said basis. Board to study and file a report with the County Board on referred withdrawal res- olutions, and 1 WHEREAS, It is in the best interests of Bayfield County that the referred withdrawal resolution be given thorough and complete study by the Forestry Committee, and n1 N 1• ,= 1 K. November 10, 1970 The following resolution was read: No. 13 WHEREAS, The Ashland County Teacher's College is now scheduled to discontinue operations in the near future, and WHEREAS, The Ashland County Board of Supervisors has passed a resolution urging the continuance of said Ashland County Teacher's College, and WHEREAS, The continuance of said College would be of benefit to Bayfield County residents, NOW THEREFORE BE IT RESOLVED, That the Bayfield County Board of Supervisors goes on record as favoring the continuance of said Ashland County Teacher's College and that a copy of this resolution be forwarded to our State Legislators. The following resolution was read: No. 14 WHEREAS, the various committees of the County Board meet at certain times to discuss matters relating to the functions of the County government, and to make decisions on matters of public interest, and WHEREAS, it is to the interest of citizens to be informed on the proceedings of their government, and;to attend these public meetings when matters of interest are discussed, be it therefore RESOLVED, that the Chairman of the various towns and the presidents and mayors of the Villages and Cities be informed of the time and place of all committee meet- ings at least 4 days.prior to such meeting, and that the existing addressing and mailing facilities of the county be utilized for this purpose. A Question was raised as to the State Statutes in regard to the minimum salaries allowable to employees of the Department of Social Services. Moved by Hanson and seconded by Howell that the foregoing be taken up after the noon hour, during which time the District Attorney will check on the State Statutes. The following resolution was read: No. 16 RESOLVED, by the County Board of Supervisors of Bayfield.County, Wisconsin, that with respect to earnings paid on and after Januaryl, 1971, to participating em- ployes of Bayfield County, Wisconsin, the County of Bayfield shall pay to the Wis- consin Retirement Fund, in lieu of an equal amount of the retirement contributions required to be deducted from each payment of earnings to participating employes ' pursuant to S. 41.07 (2) (c) of the Wisconsin Statutes, an amount equal to 4.5/ of the gross earnings. The provisions of this resolution do not however apply to or include the follow- ing employees of Bayfield County: (1) The employees of the Bayfield County Department of Social Services. Novemb er 1.0 , 1970 (2) The employees of the Bayfield County Highway Department. (This exception, however, does not include the Bayfield County Highway Commissioner). BE IT FURTHER RESOLVED, that all such payments of contributions mad-.e by the County of Bayfield shall be reported to the Wisconsin Retirement Fund in the same manner as though deducted from the earnings of participating employes, and all such payments of contributions made by the County of Bayfield shall be available for all' Retirement Fund benefit purposes to the same extent as normal contributions which were deducted from the earnings of participating employes, it being understood that such payments made by the County of Bayfield shall not be considered munic- ipality contributions. November 101 1970 The following resolution was read: No. 23 WHEREAS, the County of Bayfield constructed and has operated since 1961 a nursing home in the City of Washburn which provides space for.thirty-two residents only, and WHEREAS, the Cbunty of Bayfield is one of only three counties in northern Wisconsin which owns and operates a nursing home of the type located in the City of Washburn, and WHEREAS, the cost per patient -day to be incurred by the County of Bayfield in such nursing home operation in 1970 is projected to exceed $17.00 and is substant- ially greater than costs per patient -day of other nursing.home facilities in the State of Wisconsin, and WHEREAS, charges made to private patients who seek to utilize said nursing home facility are so great as to be prohibitive and the capacity of the facility is so small that most private patients who require the services of the type provided by said nursing home are forced to go to private facilities in the area, and WHEREAS, it is highly probable that operation of the facility could be done on a more efficient and economical basis and in the better interests of a large majority of the citizens of the County of Bayfield if such operation were by persons or firms engaged in private business who are experienced in and familiar with hosp- ital and nursing home practices, methods and management. November 10, 1970 The following communication was read: No. 25 October 13, 1970 Town Board of Cable Cable, Wisconsin 54821 Gentlemen: In reply to your notice of October 3 relative to proposed acquisition of pri- vate property on the Namekagon River'by the Federal Governmant under the National Wild Rivers Bill, I wholeheartedly back the project. I believe this is the last opportunity of preserving the lamekagon in its natural state. Already too much of the river frontage has been subdivided, and through lack of proper zoning has re- sulted in a conglomeration of buildings which only serve to degrade the beauty of the Namekagon. As far as taxes are concerned, yes, there will be an additional burden for those property owners to assume that are not affected by the acquisition program. However, the Federal Government is well aware of the increasing problems imposed on local government by the amount of untaxed Government land within the boundaries of towns, counties, and state. The recently prepared report by the Public Land Law Review Commission submitted to the President June 20, 1970, covers this problem of taxes in chapter 14, "Tax Immunity." Enclosed is a copy of Chapter 14 for your review. I have no doubt that within a few years the Federal Government will enact legislation to adequately make payments to local governments in lieu of taxes. I have had offers to sell my property in past years to private parties. I have turned these down in hope that eventually the Namekagon would be classified as a Wild River. Now that it has, through the efforts of Senator nelson, the people of Bayfield County can point with pride to the fact that partially within the con- fines of the County are two recreational resources of National significance - the Namekagon River and the Apostle Islands. We hope the County Board of -Supervisors and the State Natural Resource Commission will review and accept the recommendation made by the Forestry Committee to withdraw the property from County Forest land. We certainly feel this can be handled in a man- ner both satisfactory and beneficial to the County, State, and to the Bratley's without legal recourse on our part. If the County Board concurs with the Forestry Committee and recommends with- drawal, please attach this letter and history to the application which will be sent to the State Natural Resource Commission. Peavey purchased the farm and had the area fenced in by 1929, for a beaver and fox fur farm. In 1938, Edwin and,Esther Bratley purchased the farm from the -Peavey estate with the understanding that the purchase included all the enfenced area. The Bratley's have an affidavit in their possession stating this fact. The fence has remained in the same position for forty-one years, nine years under Peavey ownership, and thirty-two years under Bratley ownership. F November 10,1970 PART II'. Im REASONS WHY WE FEEL THE PROPERTY SHOULD BE'RETAINED BT THE BRA I Y' S : Unusual circumstances of this case: 1. 2. 3. Property purchased in good faith with the understanding all the enfenced area.was included. As stated before, we have an affida- vit in our possession stating this fact. We have maintained this property, pond, and fence for thirty-two years. In this time, we have replaced fence posts, repaired the fence, raised the fence from six to nine feet (to meet deer farm specifications),, and brushed twenty-four foot wide areas along the fence line. To remove such a fence and replace it in a new area would be very expensive and -difficult because the fence is buried 1 - 116 feet below the ground and has several metal posts in con - Crete. The nine acres.'in question have not been used by the public or the county for forty-one years. 4. Never during the forty-one years has this enfenced area been quest- ioned, even when acquired by the county (forty acres below the fence) or when the land was placed in County Forest Land. Utilization of the property: We hope to acquire a fish hatchery and deer farm licence with the ult- imate goal being a game farm which would benefit the people of the state as a whole, as well as the County. A game farm would draw people and money to the area. As it stands now, this area in my opinion, is in somewhat of a depressed state with the closing of DuPont, and any- thing which may create a few jobs or draw some people and money to the area should be considered carefully. The questionable nine acres are essential to us because they are the winter range for our deer herd as it provides both cover and protection. It is the only extensive acreage of alder swamp inside the fence. The pond (which is only partly on County land) is essential to us because it is the only place in this waterwhed where trout thrive. Further upstream ponds have been in exist- ance for years, but they will not support a fishery. Our explanation is this: 1. Springs exist in bottom of present pond only, 2. Water turnover is greater and faster since the pond is at the junction of two watersheds, one from the North and one from the Southeast. Upstream to the Southeast watershed, the water flows very slowly and it fast becomes warm and stagnant. Also, it should be noted -here, that several biological-_ values will be apparent if the Bratley's maintain the pond and property on the questionable acreage. These are:; a. Pond supports and maintains brook trout. b. Birds such as the mallard, black duck, blue -wing teal, and Hooded Merganser, breed here as well as many other species. Unusual life using the pond edge such as the LeConte°s spar- rows may also breed here. 3391 November iO ,.1970 C. Land and,pond supports and.maintains mammals.such.as otter, mink, muskrat, beaver and racoon. d. fond provides stopover point for waterfowl, shorebirds, and other bird life. This includes all dabling ducks, ring-necked ducks, Sora, common swipe, and many other migratory species. To our knowledge, there is not another such area within many miles. 3. Other advantages of the Bratley's retaining ownership are: a. We will stock deer and game to the outside area if overpopu- lation results, thus benefiting sportsmen. b. Property will be on the tax rolls Now, if the County retains ownership, I do not feel the land will be utilized as well because: 1. Neither the Bratley's nor the County could maintain the present pond because: a® If we were forced to move our fence, we would have to relocate on a line which would bisect the pond. And since the dam (structure) is on our property, we would have to drop the pond to approximately one third the present size. This would elim- inate all the sedges in the North and Southeast sections of the flowage area which is now used by waterfowl and shorebirds. A small fishery might possibly be maintained, but not a very good one as the present deep areas would become shallow areas and the population and size of the fish would then digress back to being like the mainstream, a few small fish up to the legal size limit of five to seven inches. If the pond were completely drained, the following would be lost: (1) Breeding area for fish, waterfowl, and shorebirds. (2) Stopover area for waterfowl and shorebirds. (3) Breeding utilization area for mammals. (4) The fish population would be nonexistant and no fish would be able to run the stream for spawning® b. Since there is no place to dam the pond on the County property and since it would only pull water from the North watershed, no pond could be maintained by the County, thus removing cover and breeding grounds for waterfowl, shoreline birds, and mammals. 2. The addition of the nine acres which is identical to the adjacent area .outside the fence would not significantly improve hunting, fishing, or pasturing for hunters,- fishermen, or nearby wildlife respectively and therefore, would not increase recreational usage. 3® The nine acres is unsuitable for tree planting because it is primar- ily alder swamp. In conclusion, we feel we can put this land to much better use and benefit both the County and the State® We hope the County and the State, by considering all the facts, will come to'the same conclusion and therefore, will recommend withdrawal. Upon going thru my receipts I have found receipts thru the year 1960. I have been unable to look further, but can send you a photostat of the receipts I have if you so desire. I have never received any statements of taxes due nor any notification that the property was to be sold because of lack of tax payment. Perhaps I have been remiss in -not inquiring about this sooner but I have a full time job, a very severe heart attackin1968, and eight children. We find that Bayfield County first took a tax deed on the property on June 27, 1958, that deed was taken on the delinquent tax of 1952, sale of 1953. We then find that Bayfield County quit claimed the same description to John M. Cotter and wife Dorothy in September 1960. November 10, 1970 On December 31, 1968 a tax deed ,notice covering the 1963 sale which was for the tax of 1962 was mailed to John M. Cotter, Granville, Ohio. It appears that the notice was forwarded to 103 Mt. Vernon Rd., Newark, Ohio and from there it'was returned to our office with the notation "addressee unknown". The sale was also advertised on Jan. 2, 9 and 16, 1969. According to the notice in your letter you found the tax receipts for the years 1961 and 1963, apparently you had overlooked paying the 1962 tax which was the tax that the last deed was taken on. Bayfield County has a policy whereby we allow the original owner to redeem property on which we have taken a tax deed providing the request is made within five years. We suggest that you make application to the Bayfield County Board.through our office offering to repurchase the description. The consideration for purchase would be the amount of delinquent tax that had accrued against the property to- gether with other expenses plus an estimated amount for the tax that would have been levied against the property for the years it: was not on the tax roll. Mr. William Granlund,.representing the Addressograph Company, appeared before the Board at this time. Mr. Granlund stated that it appears that the Addressograph machine in the County Clerk's office is in need of replacement. The machine is about 23 years old and the service report indicates that the machine does show con- siderable wear. The cost of a new machine would be in excess of $13,000, but the payments could be spread over period of 3 years without interest. The following resolution was read: No. 35 WHEREAS, on February 10, 1939, Herman Ehlers and wife of Cornucopia, Wisconsin, deeded to the Town of Bell the following described property: Lot Two (2) of Siskiwit River Valley Fruit Land Co., sometimes described as Lot Two (2) of the platted portion of the Southeast Quarter, Section Two ,2), Township Fifty (50) North, Range Six (6) West That the deed covering the conveyance was recorded on February 17, 1939 in Volume 132 of Deeds on page 207; 0 That through inadvertence, the tax for the year in which the sale was made, to -wit: 1939, was not paid and the County of Bayfield took a tax deed on the prop- erty recorded in 10 of Tax Deeds on page 92; That there is a gravel pit on said property and the Town of Bell is desirous of obtaining title to the property. NOW THEREFORE, BE IT RESOLVED by the Supervisors of Bayfield County meeting this 12th day of November, 1970, that the County of Bayfield, through its proper officers, convey to the Town of Bell the above -described real estate. The following resolution was.read: No. 36 COUNTY AID CONSTRUCTION & MAINTENANCE DURING THE CALENDAR YEAR 1971 Notice: Section IX on page 4 of this resolution authorizes the County Highway Commiss- ioner, subject to supervision and control by the County Highway Committee, to employ, discharge, suspend, or reinstate county highway personnel. This change in form was . made in 1945 in view of Attorney General's opinions dated March 6-and-March 24, 1945. If this form conflicts with any existing general rules or civil service plan, or if the County Board wishes to limit the authority which would be conferred by this provision, the attached form should be appropriately altered in consultation with the District Attorney. attention is directed to the fact that any action taken by the County Highway Committee in exercising its powers must, to be effective, be recorded in the minutes of the County Highway Committee's meeting. SECTION I. The County Board of Supervisors of Bayfield County, Wisconsin, regularly assembled, does hereby ordain that such,funds as may be made available to the county for highway work in the year 1971 under the provisions of Section 20.395 and Chapter 83 of the Statutes, and the additional sums herein appropriated, shall be expended as hereinafter set forth: SECTION II. COUNTY TRUNK HIGHWAY ALLOTMENT. WHEREAS, the Division of Highways has notified the County Clerk that a sum of maney estimated to be Three hundred fifteen thousand nine hundred Dollars ($315,900.00) will become available at the end C November 12,. 1970 of the fiscal year under the provisions of Sections 83.10 and 20.395C2)(yb) and (2) (yd) of the Statutes, for the county trunk highway system in the county, but the actual amount will not be known until the close of the fiscal year ending next June 30. BE IT RESOLVED that the County Highway Committee is authorized and directed to expend the said sum to the extent required to match and supplement Federal aid for construction, right of way,, and other costs on any Federal projects located on the county trunk highway system of said county, which are not recovered from Federal funds, and to expend any balance for constructing, repairing, and maintaining such county trunk highway system and the bridges thereon, including snow and ice removal and control, as directed in Section 83.10(1) of the Statutes, and to reimburse the: general fund for any expenditures that may be made therefrom pursuant to Section 83.01(6) of the Statutes. The distribution to such purposes is estimated, but not specifically directed, to be as follows: For construction, maintenance, snow removal, ice prevention and removal on the County Trunk Highway System SECTION IV. WHEREAS it appears that certain additional highway improvements in the county are necessary and warranted. BE -,IT RESOLVED that the County Board does hereby appropriate the following sums,for the purpose hereinafter set forth: The sum of Forty-eight thousand Dollars ($48,000.00) for the improvement by Construction on County Trunk Highway "A" beginning at fort Wing and extending to Iron River as far as the said sum will construct. The sum of fifty thousand Dollars ($50,000.00) for the improvement by Bridge Construction on County Trunk Highway "F" beginning at and ex- tending as far as the said sum will construct. For administration, including salaries, per diem, officer and travel expense of the County Highway Committee, the County Highway Commissioner, his clerks and assist- ants not paid from construction or maintenance funds, the sum of Thirty-five thous- and Dollars ($35,000.00). Total authorized in this Section $133,000.00 SECTION V. WHEREAS appropriations are made herein, in addition to the amounts to be received from the state and available for work in the county under Section 20.395 of the Statutes, BE IT RESOLVED that the County Board does hereby levy a tax .on all of the prop- erty in the county to meet such appropriations as follows: For County Aid under Section 83.14, as provided by Section III hereof, the sum of NONE dollars ($ For the various purposes as set forth in Section IV hereof the sum of One hund- red thirty three thousand Dollars ($133,000.00). WARNING: It is directed that provision for this levy shall be made in the county budget, but that this levy shall not be duplicated. SECTION VII. WHEREAS the various highway activities for which provision is made in this resolution are continuous from year to year, and the exact cost of any work cannot be known at the time of making the appropriation therefor, November 12, 1970 BE IT RESOLVED that this Board does hereby direct that any.balance remaining in any appropriation for a specific highway improvement after the same shall have been completed may -be used by the County Highway Committee to make up any deficit that may occur in any other improvement, which is part of the same item in the County Budget, for which provision is herein made, and any balances remaining at the end of the year in any highway fund shall remain and be available for the same purpose in the ensuing year® SECTION VIII. WHEREAS the exact amount of the funds that will become available from the state for highway purposes in the county under Section 20.395 of the Stat- utes will not be known until on or after next June 30. BE IT RESOLVED that the County Treasurer is hereby authorized and directed to make payments for the purposes for which such funds are to be used, as hereinbefore authorized, from any funds in the county treasury that are not required for the purposes for which appropriated prior to next August 1,'and to reimburse such funds in the county treasury from the sums received under Section 20.395 of the Statutes. SECTION IX. WHEREAS the County Highway Committee and the County Highway Comm- issioner are charged with the duty and responsibility of carrying out the construct- ion and maintenance of highways for which provision is made, and other related supervisory and administrative duties, BE IT RESOLVED that the County Highway Commissioner shall have authority to employ, discharge, suspend, or reinstate such personnel as he deems necessary for such purposes, provided however that the County Highway Committee may by action recorded in its minutes determine the number of persons to be hired and may also at any time by. -action so recorded order the County Highway Commissioner to employ, discharge, suspend, or reinstate any such person. I would like your permission to accept these and store them with our 25-litter hospital equipment in the basement of the new addition of the Courthouse. These cots could be used in any emergency that may arise within the county. I would appreciate your okay on receiving this valu- able equipment. The following Resolution was read: No. 49 WHEREAS, Section 350.12 (4) of the Wisconsin Statutes provides that funds may be made available to Counties for the purpose of the development of snomobile trails within the County, and WHEREAS, Said aids are administered through the Department of Natural Resources of the State of Wisconsin, and WHEREAS, It is required that application for such aids be made to said Depart- ment under a comprehensive County program for the construction and operation of said snomobile trails under the direction of a duly authorized County Board Comm- ittee, and WHEREAS, Said financial aids will be granted on a reimbursement basis only, NOW THEREFORE BE IT RESOLVED, That Bayfield County shall participate in said snomobile trails program under the provisions of said Statute and under the regula- tions as established by said Department of Natural Resources, and BE IT FURTHER RESOLVED, That the Conservation Committee of the Bayfield County Board of Supervisors be and it is hereby designated as the Committee to be in charge of said program and to act as a liaison between Bayfield County and said Department of Natural Resources in carrying out said program,and BE IT FURTHER RESOLVED, that said Conservation Committee be and it is hereby authorized and directed to formulate a comprehensive snomobile trails program for Bayfield County, including provisions for the construction, maintenance, operation and policing of said trails under and in compliance with the guidelines as set forth by the aforesaid Department of Natural Resources, and ' Po November_ 12 9- -1970 -- - BE IT FURTHER RESOLVED, That said Conservation Committee shall have and is hereby delegated the authority to make application to said State Department of Natural Resources for said financial aids through the Bayfield County Clerk, and BE IT FURTHER RESOLVED, That there is hereby appropriated the sum of $25,000.00 for the construction, operation and maintenance of said snomobile trails for the year 1971 and that said Committee shall make application for such -of said funds expended therefor as may be reimburseable under the provisions of the aforesaid program, and BE IT FURTHER RESOLVED, That the aforesaid Committee, in.formulating and adopt- ing the aforesaid comprehensive snomobile trails program for Bayfield County shall work in close cooperation with the official snomobile organizations in Bayfield County to the end that said organizations may have an opportunity to present sug- gestions and proposals to said Committee in the development of said snomobile trails program. A statement prepared by Nick Pristash, County Treasurer showed that the total amount of tax plus interest calculated to November 1970 amounted to $3.66. Mr. Moniza further stated that the recommendation of the Executive Committee was to sell the parcel to the Town of Bell, the consideration to be the amount of tax plus interest. NO. 66 The Chair declared that nominations were in order for Trustee, Bayfield County Rest Home, for the unexpired term of 1 year to replace Lud Tranmal who has resigned. MOTION NO. 74 Moved by Moniza and seconded by Rude to adopt the following Budget, as revised: PROPOSED BUDGET FOR THE YEAR 1971 TO THE HONORABLE COUNTY BOARD OF SUPERVISORS Gentlemen: We, the undersigned,members'of the Executive Committee, hereby submit our budget report and recommendations for 1971. VALUATION The Supervisor of Assessments recommends a true value of $80,231,100.00 which as of the date of this report has not been accepted by the County Board. Any change in the figure could and would affect the budget. The legal levy limit exclusive of debt items for County general purposes is 196. The proposed levy is $72,874.29 below the legal limit but is an increase of $101,275.49 over last years budget. The contingency fund is $30,000.00 which is $20,000.00 more than last year. The reason is explained elsewhere in this report. The Levy increase over last year is made up of, in addition to the increase in the contingency fund of $20,000.00; a $10,000.00 increase in the State Special Charges and about $72,000.00 increase in the Medical Assistance Program. HEALTH AND SOCIAL SERVICES This year the Budget reflects the full cost of the Medical Assistance Program. Because of this the Social Services budget has a substantial increase in the bud- get figures. But actually there is a $72,000.00 increase in the Medical Assistance Program as we have indicated earlier. The committee felt that the budget should November 12, 1970 represent the true cost of this program in our county as a matter of information to the County Board and all taxpayers as well. The Rest Home is being operated at full capacity and as efficiently as possible. Meetings with the Board of Trustees have indicated that little or no savings can be effected if the facility was leased or operated on some other arrangement other than a county operation and still providing the same level of service. The North Central Guidance Clinic Budget is about the same as last year. All five counties are participating -again this year. HIGHWAYS & BRIDGES The Highway Budget continues to need the support of county -funds. Aside from the bridge aids of $5,257.00, there is $35,000.00 proposed for Highway,Administrat- ion, $48,000.00 for road construction on County Highway "A", and $50.,000.00 for Bridge Construction on County Highway "F". FINANCE You will note the Bond indebtedness for the hospital is offset on the revenue side by the same amount. The. committee was informed that all obligations and agree- ments with the Hospital Ass'n. have been met to date without any cost to the county. Our cash surplus is declining as we have indicated in our last years report. The primary reason is that because of more accurate information the Health & Social Service's budget is more realistic, and therefore is not overbudgeted which has resulted in large cash surpluses in the past. This year's cash surplus applied to the tax levy is $45,000.00 as compared to $80,000.00 last year. Next year we ant- icipate little or no cash surplus. We are not recommending any additions to the building fund. The contingency fund is proposed at $30,000.00 to provide for any increases in salaries or fringe benefits. It is the understanding of this committee that such requests will -[be made. AUDIT - The 1969 audit report has been completed at budget time which assisted the Committee in preparing the budget. A copy of the audit report is available at the County Clerk's office or from any member of the Executive Committee for your in- spection. All department budgets are about the same as last year with the exception of a few minor increases other than those we have referred to elsewhere in this report. We recommend the acceptance of the Auditor's proposal to audit the 1970 records. The Committee wishes to thank the County Clerk's office and the Auditor for their assistance.
