MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
The meeting was called to order at 9:30 A.M. by Walter C. Barningham, County
Board Chairman.
The following members answered Roll Call: No. 1
Ray Kyle, Thomas E. Rondeau, Raymond J. Mammoser, Joseph Berweger, Arthur C.
Hanson, Ernest Heglund, George Moniza, Marvin Olson, Sanfred Anderson, Elmer L.
Suomala, Wallace Johnson, Kenneth C. Howell, Bertyl Nelson, William Celinsky, Arthur
Xeierotto, Edwin M. Erickson, Walter Wasmuth, Alvin E. Bratley, Peter.Hanson, Bennie
R. Rude, Walter C. Barningham
Total 21 members present
Moved by Moniza and seconded by Nelson to dispense with the reading of the
minutes of the November 12th and 13th, 1970 meeting. Motion carried.
An announcement was made by Chairman Barningham that the County Board would
tour the new hospital at 11:00 A.M. and that the Zoning Hearing would be at:2:00 P.M.
The following resolution was read: No. 2
WHEREAS, the Northwest Wisconsin C.A.A. has made a request for office space
for five or six employees in the Bayfield County Administration Building; and
WHEREAS, a study of the request should be made by a committee of the County
Board; now therefore be it
RESOLVED, that the Executive Committee is hereby directed to make such a study;
and be it further
RESOLVED, that the said Executive`Committee is hereby authorized to negotiate
with the Northwest Wisconsin C.A.A. regarding the matter and to execute an agreement
with the said Northwest Wisconsin C.A.A. for office space providing said Committee
is of the opinion that it would be in the best interest of Bayfield County.

Mrs. Alice Tribovich appeared before the Board at this time in behalf of the
Northwest Wisconsin C.A.A.. Several questions were asked by board members regarding
the future of the program, purposes, and funding, which were answered by Mrs. Tribo-
vich.

The following Petition was read: No. 3
FOR AMENDMENT OF BAYFIELD COUNTY ZONING ORDINANCE
In order to fully comply with the State Department of Natural Resources Order
No. 3A-70-3, the undersigned hereby petition the County Board to amend the shoreland
provisions of the zoning ordinance as follows:
Section I Section 1.2 is amended to read:
"Within three hundred (3.00) feet of the normal high water elevation
of navigable reaches of rivers and streams or to the landward side oft
floodplains, whichever distance is greater."
Section II Section 1.3 is amended to read:
"Normal high water elevation, where not otherwise established, shall
be determined by the Zoning Administrator, subject to appeal under
I, Section 7.0."
Section III Section 1.7 is created to read:
"Minimum size for any lot for residential purposes -shall be 150 feet
at the shoreline, or other frontage, 150 feet average width, and
30,000 square feet in area."

Section IV Section 2.1 is created to read:
"A boathouse shall not exceed ten (10) feet in height nor extend be-
.yorid the ordinary high water line, and shall not be used for human
habitation."
Section V Section 4.0 is amended to read:
"FILLING-DREDGING-GRADING-LA.GOONING.
A.conditional use permit shall be required for more than 1000 square
feet of filling in any wetland, within or adjoining a shoreland area.
Dredging, grading or lagooning may be permitted only in accord with
State law and where no damage to any natural resource will result."
Section VI Section 9.12 is amended to read:
"Questions regarding exact district boundaries shall be determined by
the Zoning Administrator, subject to appeal under Section 7.0."

COMPREHENSIVE AMENDMENT - BAYYFIELD COUNTY ZONING ORDINANCE
The undersigned hereby petition the Bayfield County Board of Supervisors to
amend the Bayfield County zoning ordinance so that as amended it will -provide as
follows:
1. To establish a permit system to more effectively regulate the uses of land
in the various zoning districts.
2. To establish highway set -backs.
3. To permit the development of sub -standard lots of record.
4. To control the location and plan requirements of mobile home parks and
trailer camps.
5.
To
allow closer County control of planned unit developments.
6.
To
regulate roadside advertising.
7.
To
establish a fee schedule as approved by
the County Board.
8.
To
set up an effective appeal procedure and
provide for the establishment
of
a Board of Adjustment as required by the
State Statutes.
9.
To
provide for additional zoning districts
in order to meet the needs of
the several Towns.
10. To consolidate all past amendments and revisions into a single comprehen-
sive ordinance for administrative and enforcement purposes.

Dear Sir:
In accordance with the provisions of Section 46.17(3) of the Wisconsin Stat-
utes, the Bayfield County Jail was inspected on December 15, 1970.
The jail register were found to be complete and up to date as required. The
juvenile records were proper, up to date, and detention orders were.on file.
The entire facility was as clean and orderly as can be expected under the
present situation. It is hoped that all recommended repairs can be completed as
soon as possible.
Please convey my appreciation to Sheriff Embertson and his staff for the time
and courtesies extended to me during this visit.

The following resolution was read: No. 9
WHEREAS, Eleanore Pine holds the position of Part-time Clerk -Stenographer II
in the office of the Bayfield County Forestry Department, and
WHEREAS, she has held said position since January 1, 1969, completing 2,000
hours in Jule, 1970, entitling her to the Bayfield County Retirement Plan. She
also.has the required number of hours per month to be included under the Wisconsin
Health -Insurance Plan, and
WHEREAS, it is felt that having the above benefits as other Bayfield County
employees and working on a regular three day -a -week basis,
BE IT RESOLVED, that Eleanore Pine be put in Step B of the Bayfield County
Wage Schedule Classification, and to be retroactive as of January 1, 1971.

The following Resolution was read: No. 10
WHEREAS, counties must share in the payment of salary and other contributions
paid to county court reporters; and
WHEREAS, Chapter 449, Laws of 1969 provides that such reimbursement shall be
made monthly; and
WHEREAS, previously such reimbursement was made by the counties in the form
of a State Special Charge certified to the county clerk; and
WHEREAS, said amount so certified'by the Secretary of State has been placed in
the County Budget for 1971, but no provisions were made for payment of said salary
on a monthly basis; and
WHEREAS, the Department of Administration has now certified for payment the
portion of the salaries and other contributions to be paid on behalf of the county
court reporter for the period July through November 1970; and
WHEREAS, the balance of such payments will be certified as they become due in
1971; now therefore be it

RESOLVED, that $8,500 be transferred from the contingency fund into the County
Court account for payment of said portions of salary and other contributions made
on behalf of the county court reporter; and be it further -1.
RESOLVED, that the county clerk is hereby authorized and directed to pay to
the Department of Administration the amount certified for the period July through
November 1970 and that he is authorized and directed to pay the balance of the
certifications as they become due.

MOTION NO. 1 O.A-
Moved by Suomala that a study be made by the Personnel Committee of the salary
and working hours of the court reporter and of the feasibility of sharing the ser-
vices of the Court reporter with another county, and that the information be re-
ported back at the next meeting of the board, seconded by,Johnson.
Motion carried.
The following resolution was read: No. 11
WHEREAS, from time to time it becomes necessary for the County to hire part-
time help in the County Administration Building; and
WHEREAS, the County personnel.policy provides that part-time help be paid for
at the minimum rates established in the personnel policy; and
WHEREAS, it is occasionally possible to rehire experienced retired personnel
who have been previously employed by Bayfield County; and
WHEREAS, it is deemed to be in the best interest of Bayfield County to rehire
such experienced part-time help; now therefore be it
RESOLVED, that the hiring officer be authorized to rehire such personnel at
the rate of pay in existence at the time that such rehired person was retired.

The present "Crusade" in conservation seems to be the damnation of all clear
cutting of timber stands. While this may be a good practice in certain instances,
it certainly does not apply to all species, and in fact is very harmful to the
future of many of our Lake States timber stands.
In our own area, spruce, aspen, and jack pine ar°eprime examples of timber
types which do not lend themselves to selective cutting, and to attempt the same
invites chaos because of the invasion of scrub species.
The attached bulletin on clearcutting gives a factual explanation of the
of
reasons for various types of timber harvest, and will undoubtedly be^interest to you.

The following resolution was read: No. 13
WHEREAS, By resolution No. 25 passed by the Bayfield County Board of Super-
visors on November 15, 1966, it was provided that certain tracts of land in Bayfield
County be set aside by the County for forest management districts and for other
purposes, and
WHEREAS, Said Resolution provided in part as follows: "That the County owned
lands in the Town of Pratt in Township 45 North, Range 6 West, lying northerly of
the Chicago, St. Paul, Minn. and Omaha Railway, as said railway crosses the afore-
said township from the westerly boundary thereof to its junction with the Sweden
Road in Section 14 of said Township and Range, be temporarily withheld from sale
for the purpose of considering the advisability of negotiating a transfer,of said
lands to the Conservation Department of the State of Wisconsin for appropriate re-
creational uses as may be determined by the Bayfield County Board of Supervisors
and the Conservation Committee thereof, such transfer to be made upon conditions
that would insure the said Town of Pratt a financial return from the State on a
use program basis", and
WHEREAS, Certain parcels of the above described lands located in the said Town
of Pratt (Grand View), to -wit: parcels located in the Northwest Quarter of Northwest
(quarter (NW/4 of NWY/) of Section Twenty-two (22), Township Forty-five (45 ) North,
Range Six (6) West, as described in Vol. 147, page 404 and Vol. 96, page 175, Bay-

field County Registry, are so located that the same are not necessary to the intents
and -purposes of the above quoted paragraph of the aforesaid Resolution and that
said parcels, in the interest of Bayfield County, should be offered for sale by the
usual public bid procedures,
NOW THEREFORE BE IT RESOLVED, That the parcels of land above described located
in the said Northwest Quarter of the Northwest Quarter (NW/4 of NW/4) of Section
Twenty-two (22), Township Forty-five (45) North, Range Six (6) West, be excluded
from the provisions of the aforesaid Resolution and that the same be offered for
sale by Bayfield County.

The following Resolution was read: No. 14
WHEREAS, The Bayfield Electric Cooperative, Inc., has made application to
Bayfield County for a right-of-way for the construction of a utility transmission
line across the Northeast Quarter of Southeast Quarter (NEY of SE/4), Section Four
(4), and the Northwest Quarter of Northwest Quarter (NW/4 of NW/), Section Three (3),
all in Township Forty-six (46) North, Range Nine (9) West, and across the Northwest
Quarter of Northwest Quarter (NW/4 of NW/), Section Twenty-five (25), Township Forty-
three (43) North, Range Five (5) West, and
WHEREAS, It is deemed in the interest of Bayfield County to grant said easement
to said Bayfield Electric Cooperative, Inc:.., subject to the conditions and exceptions
heretofore provided for by resolution of this Board of Supervisors, and
WHEREAS, Pursuant to the aforesaid application for right-of-way easements by
said Bayfield Electric Cooperative, Inc., Resolution No. 10 was adopted by the Bay -
field County Board of Supervisors at its meeting held September 10, 1970, which
Resolution by inadvertence included erroneous descriptions and following said Res-
olution, an easement was accordingly issued incorporating said erroneous descript-
ions,
NOW THEREFORE BE IT RESOLVED, That the application for an easement of right-of-
way by said Bayfield Electric Cooperative, Inc. to construct a.utility transmission
line across the three forty acre descriptions herein first above mentioned, be and
the same is hereby granted, subject to the provisions and conditions above set
forth, said easement of right-of-way to contain a description of the exact location
of .said line as the same is to be constructed and located on said descriptions,
said easement being further subject to approval by the Bayfield County Forest Ad-
ministrator and the Bayfield County District Attorney, and
BE IT FURTHER RESOLVED, That the aforementioned Resolution No. 10 relating to
said application for an easement by said Bayfield Electric Cooperative, Inc. passed
by this Board on September 10, 1970, and the easement executed pursuant to the last
said Resolution be and the same are hereby rescinded and declared to be void and of
February 9, 1971
no effect.

The following Resolution was read: No. 15
WHEREAS, inflation has depreciated the life savings of retirees, and
WHEREAS, Social Security benefits at the present time are insufficient to meet
the living costs of the recipients, and
WHEREAS, the House of Representatives Bill H.R. 17750 amended by the United
States Senate and reintroduced as H.R. 1 provides for a rare in Social Security
benefits of 10%, with $$100.00 per month minimum to all recipients'of Social Security,
including a provision permitting Social Security recipients to earn $3,000.00 per
year before losing Social Security benefits, and
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors qo
on record in support of the provisions of Bill 17750 as amended by the Senate and
reintroduced as H.R. 1.
BE IT FURTHER RESOLVED, that the County Clerk send copies of this resolution to
Senator Gaylord Nelson, Senator William Proxmire, and Congressman Alvin E. O'Konski.

Federal Aid Secondary Highway Funds
Federal Aid Highway Act of 1970
Under the Federal Aid Highway Act of 1_970, Federal Aid Secondary Highway Funds
will be available to Wisconsin in the amount of approximately $9.,.242,217. for each
of the fiscal years 1972 and 1973.
The plan for the distribution and administration of the Federal Aid Secondary
Funds becoming available to Wisconsin under the Federal Aid Highway Act of 1970,is
described in the accompanying statement. The provisions of the plan are similar in
all respects to the plan approved for the distribution of funds made available under
the Federal Aid Highway Acts of 1-964, 1966, and 1968. The provisions of the plan
were reviewed by Mr. Robert Mortensen, Executive Secretary of the Wisconsin County
Boards Association, on January 27, 1971. The 1970 Federal Highway Act Secondary Funds
apportioned for your county for the two fiscal years 1972 and 1973 are as follows:

Your attention is directed to the fact that the availability of federal fund
obligation authority has been subject to considerable "stop and go" manipulation in
the past years. At present federal funds are obligated on a quarterly quota basis
through June 30, 1971. Therefore, the exact month in which the Commission may be
able to authorize ,you to proceed with a construction project or the exact month in
which:-.you:..mdy:- be `,reimbursed for right of way acquisition will be subject to such
obligation limitations as applied to the state-wide federal aid financed highway con-
struction program. These funds may, subject to the above stated reservation, within
the time limitation provided in the accompanying statement, be matched by your county
and used on qualifying improvements requested by your county located upon county
trunks or local roads or streets forming apart of the Federal Aid Secondary Highway
System or upon its extensions into urban areas.
In planning the utilization of Federal Aid Secondary Funds, due consideration
should be given to qualifying improvements on the F.A.S. System or extensions thereof
in cities and villages, and to qualifying and desirable extensions of rural,improve-
ments into such municipalities.
It need not be construed that the 2-year apportionment of Federal Aid Secondary
Funds must be spread over a 2-year period. Within certain limits and within the
reservation set forth above, which can be determined only after the total programs
of all counties are known, up to a total of a county's 2-year apportionment may be
used in one year. Now, more than ever before, long range program planning is nec-
essary so that counties may have their engineering completed to the stage which will
permit them to take advantage of federal aid funds as they become available. Requests
for the programming of projects using 1970 Act funds hereby apportioned may be filed
at once.
The Commission's District Engineer and the District Engineer of Secondary Roads
will discuss with your county highway committee your potential Federal Aid Secondary
program, and your county, through your county highway committee is requested to work
with them in developing a proposed program of improvements on the Federal Aid Secon-
dary System to utilize the funds apportioned to your county. The program requests
by your county highway committee, submitted through the district office will be sub-
ject to review and approval by the Commission.
Please bring this matter to the attention of your county board at its next
session.

UNDER THE FEDERAL AID HIGHWAY ACT OF 1970

Federal -aid secondary highway funds authorized by the Federal -Aid. Highway
Act of 1970 and to be available for Wisconsin are tentatively estimated to be as
follows:

The method of apportionment among the counties of the $$12,400,000 for the two
years is: 60% on the basis of total highway mileage as of January 1, 1970, exclus-
ive of the Federal -aid Primary System and exclusive of other mileage in "urban areas"
established pursuant to the Federal -aid highway acts (places of over 5,.000 population);
and 40% on the basis of the total number of motor vehicles registered•in the fiscal
year ending June 50, 1970.
The FAS funds thus apportioned to a county may, within -the time limitation
hereinafter provided, be matched by the county and used on qualifying improvements
requested by the county on county trunks or local roads and streets on the FAS sys-
tem or its extensi.ons in urban areas, in accordance with the requirements of the
Federal -aid highway acts and amendments thereof and regulations pursuant thereto and
of the established requirements and procedures of the -State Highway Commission.
On January 1, 1971, and January 1,, 1972, each; $$6,200,000 of the total amount
of the-FAS.fund.,s apportioned to the Commission will be -apportioned to the counties
for use on the county FAS system for fiscal years 1972 and 1973. The availability
of these funds will be subject to prevailing Federal regulations.
At the close of the first fiscal year following each allotment the Commission
will review each.individual county's balance of its allotment "and, in cooperation
with the county, determine the extent the county has formulated plans to use this
allotment on the County F.A.S. System. If the county has no such plan or an approv-
ed program and indicates it has no interest in providing a plan or program, then
50% of the balance outstanding to the credit of the county will revert to the Com-
mission for state-wide use.
At the end of either calendar year 1971 or calendar year 1972, any county
which has adopted an approved improvement program which will require additional FAS
funds, over and above its proportionate share hereinbefore allotted, may apply to

the Commission for such additional FAS funds as will be required and/or as may be
available to complete the federal aid financing of the approved program.
The reallocation of additional funds to any county will be contingent upon the
availability of unencumbered Federal Aid Secondary funds. In the event there is a
reduction in the availability of 1970 Federal Highway Act funds in the manner des-
cribed in the accompanying cover letter then the provisions of these paragraphs as
they relate to additional funds to the counties will become null and void and any
unencumbered balances of 1970 Federal Aid Secondary funds will be expended at the
discretion.of the Commission, in a manner deemed best for the improvement of the
State's Secondary System considered as a whole system.
The period of availability for the use of a county's regular allotment as here-
in provided will be through the calendar years 1971 and 1972. To those counties
which request and receive additional FAS funds from the Commission on December 31,
1972 the Commission will extend the period of availability for the use of these
funds to June 30, 1973.
Any FAS funds not "used" by a county within the time limitations herein set
forth will revert to the Commission for statewide use.
FAS funds will be deemed to have been "used�.on a project which has been advanc-
ed to the contract state" when bids have been received and the county matching funds
have been deposited with the state; or in case the work is to be performed by day
labor, when an acceptable day labor contract has been signed by the county and de-
livered to the state; or for a project involving only preliminary engineering and/or
the acquisition of rights of way, when all acts required of the county prior to
placing the project under agreement with the Federal Highway kdministration, U.S.
Department of Transportation have been performed. When more than one contract is
involved in a single FAS project, the determination shall be based on the last con-
tract.

WHEREAS, Bayfield County has taken a tax deed on certain property described as
Lot 8, Block 27, Original,Townsite of Washburn; and
WHEREAS., said property was owned by one Ed Holt of the City of Washburn at the
time that the Tax deed was taken; and
WHEREAS, Mrs. Clara Johnson, the only remaining heir of Ed Holt, has requested
permission to redeem said Lot 8, Block 27, Original Townsite of Washburn; now
therefore be it
RESOLVED, that said Mrs. Clara Johnson be allowed to redeem said lot upon pay-
ment of all delinquent taxes and estimated taxes had the property remained on the
tax roll as well as other charges as normally made in similar redemptions.

WHEREAS, Thousands of acres of private owned forest lands are entered under
the Wisconsin Private Forest Crop Law, and,
WHEREAS, Many acres of these lands are higher value lake, other water frontage
lands and other lands, and,
WHEREAS, These lands are.not paying their fair share of the property tax load
because the 10 cents per acre payment in lieu of taxes is based on the 1930 depress-
ion values rather than present day values, now therefore,
BE IT RESOLVED, That the Iron County Board of Supervisors do hereby urge immed-
iate -legislative action'to correct this property tax inequity, 'and,
BE'IT FURTHER RESOLVED, That the per acre payment under private forest crop law
be raised to the minimum of 50 cents per acre, and,
BE IT FURTHER RESOLVED, That high value water frontage lands cannot be entered
or held under the law, and,
BE IT FURTHER RESOLVED, that copies of this resolution'be sent to the Wisconsin -
County Forest Association, our local State Legislators and adjoining County Boards.

The following Resolution was read: No. 27
WHEREAS, certain soils in Bayfield County have severe or very severe limitations
for successful operation of soil absorption sewerage disposal systems because of
slow permeability, shallow impermeable bed rock or high ground water, and
WHEREAS, approximately 55% of the soils in the State of Wisconsin are problem
soils with similar problems with reference to sewerage disposal, and
WHEREAS, at the present, time, the only permissible means of sewerage disposal
is holding tanks that must be pumped periodically and hauled to an approved sewerage
disposal facility, and
WHEREAS, this problem seriously curtails development in areas where -this problem
exists, and
WHEREAS', there is the need of a low cost sewerage disposal system for individ-
ual homes that will meet state regulatory agency requirements, and
WHEREAS, assembly Bill 123 provides for. the appropriation of funds for research
by the University of Wisconsin which would hopefully result'in the designing of an
approved low cost sewerage disposal system, and
NOW -THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors. go.

Dear Sir:
Enclosed find a copy of a resolution passed by the LaCrosse county board 10-15-70.
It is designed to.keep traffic law enforcement at the local level and under local
control by assuming primary but not exclusive jurisdiction on all rural highways ex-
cept the interstate system. The Wisconsin County Police, Deputy Sheriffs and Radio
Operators Association does not believe increasing the size and authority of state
government is the best way to approach the problem. For this -reason we are attempt-
ing to get each county board in Wisconsin to adopt the provisions of -the attached
resolution before January 1, 1971.
In 1969 legislation wa-s proposed which if enacted would have given the State
Patrol primary jurisdiction on all federal and state highways, leaving only county
and township roads for local enforcement agencies. I'm sure you can envision the
loss of local control -and increased costs had this measure passed.
The State Patrol was formed and has since been enlarged for the stated purpose
of assisting county patrols. However, in recent years there have been repeated
attempts to take over completely, eliminating county patrol.
I request that this letter be presented to your county board for their discuss-
ion and action at their next session.
Please advise me of any action they may take.

WHEREAS, Rural traffic law enforcement has long been the subject of discussion
between legislators, police agencies and governmental agencies; and in the interest
of greater highway safety, efficiency and economy in rural traffic law enforcement,
and to avoid conflicts in duplication of patrol and supervision,.and to comply with
the National Highway Safety Act of 1966 regarding concurrent jurisdictional bound-
aries and problems it isnecessary that a system be developed to implement the high-
way standards and
THEREFORE IT IS RESOLVED:

enforcement jurisdiction on all federal, state, county and township highways in
county, excepting all interstate highways within
county and any part of the federal, state or county trunk highway system which is

and every Senator or Assemblyman representing any district in
