MEETING OF THE BAYFIELD COUNTY BOARD
OF SUPERVISORS
The meeting was called to order by Walter C. Barningham, County Board Chairman
at 9:30 A- M.
The following members answered Roll Call: No. 1
Ray:Kyle, Thomas E. Rondeau, Raymond J. liammoser, Joseph Berweger, Arthur
Hanson, Ernest Heglund, George Moniza, Marvin Olson, Sanfred Anderson, Elmer Suomala,
Wallace Johnson, Kenneth C. Howell, Bertyl Nelson, William Celinsky, Arthur Meierotto,
Edwin Erickson, Walter Wasmuth, Alvin Bratley, Peter Hanson, Bennie Rude, Walter C.
Barningham - Total 21 members present, none absent.
NO. 2
The Chairman announced that the first order of business was the election of
the Highway Committee. There was some question about the Statute requirements as
to the election of said committee, which was checked on by the County Clerk. It
was reported that the Highway Committee is to be elected for a one year term.
Moved by Moniza that the board recess for five minutes to caucus, seconded by
Erickson. Motion carried.
The Chair announced that nominations were in order for Highway Committee mem-
ber, District #1.
Mr. Wasmuth was nominated by Nelson. The -Chair called three times for additional
nominations, there were none.
Moved by Nelson and seconded by Erickson that nominations be closed. Motion
carried.
Moved by Erickson and seconded by Heglund that the County Clerk cast a unanimous
ballot for Walter Wasmuth for Highway Committee member, District #1. Motion carried.
The Clerk cast the unanimous ballot for Mr. Wasmuth as directed and the Chair
declared Mr. Wasmuth elected.
The Chair announced that nominations were in order for District #2.
Mr. Rude announced that as a result of the caucus two members were nominated
for District #2: Kenneth Howell and Peter Hanson. The Chair called three times for
additional nominations, there were none.
Moved by Rude and seconded by Bratley that nominations be closed. Motion carried.
Tom Rondeau and Art Meierotto were appointed as ballot clerks by the Chairman.
The Clerk read the following results:

Total - 21 The Chair declared Mr. Howell elected -as Hyw. Comm. member
for District #2. Mr. Howell thanked the members of the board for their support.

The Chair announced that nominations were in order for Highway Committee mem-
ber, District #3.
Wallace Johnson nominated Joseph Berweger. The Chair called three times for
additional nominations; there were none.
Moved by Howell and seconded by Nelson that nominations be closed. Motion
carried.
Moved by Howell that the Clerk cast a unanimous ballot for Berweger, seconded
by Johnson. Motion carried.
The Clerk cast the unanimous/as directed for Joseph Berweger as Highway Commit-
tee member from District 7#3 and the Chair declared Mr. Berweger elected.
The Chair announced that nominations were in order for Highway Committee member
for District #4.
Moved by Rondeau that Ray Mammoser be nominated, seconded by Kyle. The Chair
called three times for additional nominations; there were none.
Moved by Kyle and seconded by Nelson that nominations be closed. Motion carried.
Moved by Johnson that the Clerk cast a unanimous ballot for Ray Mammoser for
Highway Committee member for District #4, seconded by Olson. Motion carried.
The Clerk cast the unanimous ballot as directed and the Chair declared Mr.
Mammoser elected.
Mr. Mammoser thanked the members of the Board for their support.
The Chair announced that nominations were in order for Highway Committee member
for District #5.
Moved by Olson that Bertyl Nelson be nominated.
Moved by Celinsky that nominations be closed.and that the Clerk be instructed
to cast a unanimous ballot for Bertyl Nelson, -seconded by Rude. Motion carried.
The Clerk cast the unanimous ballot as directed for Bertyl Nelson as Highway
Committee member .for District #5 and the Chair declared Mr. Nelson elected.
The following resolution -was read: No. 3
WHEREAS, Bill 207 is to go before the 1971 Senate, and
WHEREAS, said Bill 207 pertains to diverse changes in the determination and
a
administration of Forest Cropland taxes and severance taxes including: restating
legislative policy toward Forest Croplands, requiring public hearings on petitions
for entry of parcels only upon request or department initiative, raising the 'acre-
`� age share11 from 100 to 150, increasing the States contributions to Towns from 100
k;, to 200 per.acre, permitting Towns to use income from Forest Cropland taxes for any
�? Q legal purpose and changing interest determinations presently required,
v
THEREFORE, BE IT RESOLVED that the County Board of Supervisors duly assembled
this 4th day of May 1971, vote to be in favor of said Bill 207, and

BE IT FURTHER RESOLVED, that a copy of this resolution be forthwith transmitted
by the Bayfield County Clerk to the Honorable Arthur Cirilli, State Senator, and
the Honorable Ernest Korpela, Assemblyman, with the request that they support said
Bill 207.

WHEREAS, a resolution was presented to the Bayfield County Board on February 9,
1971providing for reclassifying Eleonore Pine, an employee in the Bayfield County
Forestry Department office, and
WHEREAS, ) said resolution was referred to the Personnel Committee of the Bay -
field County Board for study, and

WHEREAS, the said Personnel Committee has considered the request, be it there-
RESOLVED, that Eleonore Pine be reclassified and placed into Step B of the
Clerk Stenographer II classification, and that her wages be adjusted accordingly,
and be it further
RESOLVED, that the reclassification of Eleonore Pine be made effective
May 1, 1971.

WHEREAS, Bayfield County owns a lot in Buffalo Subdivision upon which is
located a dilapidated residence, said property being formerly known as the Kenneth
Basina property, and
WHEREAS, The condition of the building thereon is such that it constitutes
danger to the public and more especially to children playing in the area,
NOW THEREFORE BE IT RESOLVED, That the Executive Committee be and it is hereby
authorized and directed to cause the aforesaid building to be removed or torn down.

Ordinance passed on September 10, 1970 and recorded on pages 293 and 294, Vol. 13

WHEREAS, Bayfield County is an actively participating member of the North-
western -Wisconsin Regional Planning and Development Commission being represented
on the Commission by Mr. Wm. Celinsky and Mr. George Malinoski;'
WHEREAS, The Northwestern Wisconsin Regional Planning and Development Commiss-
ion has adopted as a matter of policy a strategy, stated with particularity in its
annual report for 1968, and which concerns its dedication to local and regional
cooperation and planning in order to maximize the benefit derived from available

financial and human resources in the development of the Northwest Region; and
WHEREAS, Bayfield County takes the position that progress can best be ach-
i-eved through coordinated effort as heretofore said;

NOW, THEREFORE, It is hereby resolved/the Bayfield County Board of Supervisors
that the policy of the Northwestern Wisconsin Regional Planning and Development
Commission is in conformity with the policy of Bayfield County and as such is
hereby acknowledged;
It is further resolved by the Bayfield County Board of Supervisors to oppose,
as a matter of policy, the creation or operation of units or districts not coordin-
ated regionally through the Northwestern Wisconsin Regional Planning and Develop-
ment Commission.

On Wednesday, Feb. 10, 1971, a meeting was called by the Southern Bayfield
County School Board in which the Town and Village Chairmen were asked to be present,
mainly to discuss the financial problems in the school district. The delinquent
taxes which are due to the district I am told amounts to approximately $67,000.
There::was..a�discussion:-by the chairmen and a couple of the County Board mem-
bers suggesting that the County Board take action to pay these delinquent taxes to
the school districts which would ease their problem somewhat. Then the question
was raised by the County Clerk, where would the County get the monies from to pay
these taxes other than putting it onto the tax roll.
In my opinion, and I am sure that there are many other-l;people who share in
same, this problem could be very easily resolved without any further taxation to
any land owners of the entire Bayfield County, and here is the -solution.
In reviewing the Plat Book, I find that Bayfield County is in the land business
in a big way, having title to approximately 175,325 acres. Now let's assume that
we base this acreage at $20. per acre which I am quite certain is a fair market
value,.amounts to $3,506,500.00, that's right, better than three and one half
million dollars.
If the County Board will take action to put just a small part of these lands
up for sale, let's say 10,000 acres which would net the County approximately
$200,000.00, they could then very easily pick up the delinquent tax,tab-, and also
retain a fund for this same purpose in future years.
Here is a breakdown of the various acreages in the Townships, Russell - 10,334
Barnes - 17,032; Cable— 7,284; Bell - 14,862; Orienta-Port Wing - 22,254; Tripp -
7,301; Washburn-Bayfield and Bayview - 38,123; Clover - 5,050; Iron River - 6,998;
Hughes - 34,579; Lincoln - 1,095; Delta - 440; Mason - 200; Kelly - 327; Namakagon -
76; Grand View - 7,351; Pilsen and Keystone - 826; Oulu - 240; the Islands - 670.

that it may do some good in easing our school problem.

The Clerk reported on recent sales of County lands by sealed bid. Several
comments were made by members of the Board in regard to County lands being offered
for sale.

The Clerk advised the Board that Tom Rondeau's term as a member of the North
Central Guidance Clinic Board of directors expires this year and that George Moniza's
term had expired a year ago.

Guidance Clinic Board, to succeed Tom Rondeau: No. 11
Moved by Mammoser that Tom Rondeau be nominated as member of the board.
Moved by Howell and seconded by Nelson that nominations be closed and that the
Clerk cast a unanimous ballot for Tom Rondeau as member of the North Central Guid-
ance Clinic Board of Directors for a three year term.
The Clerk cast the unanimous ballot as directed and Tom Rondeau was declared
elected.
Mr. Moniza thanked the Board and also gave a brief resume' of the services
offered by the North Central Guidance Clinic.
The following resolution was read: No. 12
WHEREAS, the employees of the Bayfield County Highway Department are repres-
ented by the International Brotherhood -of Teamster, General Drivers, Warehousemen,
Helpers and Inside Employees, Local Union No. 346, and
WHEREAS, Representatives of"said Union and the Bayfield County Highway Committee
of the Bayfield County Board of Supervisors have been negotiating a labor contract
between said Union and Bayfield County for the years January 1, 1971 through Dec. 31,
1972, and
WHEREAS, the aforesaid Union and the Bayfield County Highway Committee have
reached a tentative agreement on said contract, subject to the approval of the
Bayfield County Board of Supervisors, and
IN
WHEREAS, a copy of said proposed contract is on file with the Bayfield County
C
Clerk and is incorporated herein by reference, and
WHEREAS, said labor contract is deemed to be reasonable and in the interest of
Bayfield County to accept in form and content as recommended by said Bayfield
County Highway Committee.
NOW THEREFORE BE IT RESOLVED, that the aforesaid contract hereinabove referred,
a copy of which is on file with the Bayfield County Clerk, be and the same is hereby
approved and the Bayfield County Highway Department and the officers thereof are
hereby authorized to execute said agreement on behalf of said Bayfield County.

WHEREAS, Bayfield County is largely dependent on its natural resources for its
economic welfare and
WHEREAS, several severe winters and the use of the party permit system have
severely reduced the deer population, be it.therefore
RESOLVED, by the Bayfield County Board of Supervisors that the'Wisconsin De-
partment of Natural Resources is requested. to not issue deer party permits for the
deer season of 1971.

WHEREAS., Bayfield County now has a duly existing advisory committee organized
for -the purpose of coordinating a program for Bayfield County with the Northwestern
Wisconsin Regional Planning Commission under the Federal Omnibus Crime Bill, which
committee was created by this Board of Supervisors at its July, 1969 meeting, and
WHEREAS, It is deemed advisable to discontinue the present committee and to
transfer said duties and responsibilities to a new committee consisting of the
members of the Sheriff's Commission of the Bayfield County Board of Supervisors,
NOW THEREFORE BE IT RESOLVED, That the committee now existing for the purpose
of coordinating a program between Bayfield County and the Northwestern Wisconsin
R,egi_onal Planning Commission under the Federal Omnibus Crime Bill be and the same
is hereby dissolved and a new committee is hereby created to coordinate a program
between Bayfield County and the Northwestern Wisconsin Regional Planning Commission
and -ex -the Federal Omnibus Crime Bill as administered by the Wisconsin'Council on
Criminal Justice, the membership of said committee to consist of the members of the
,present Sheriff's Commission of the Bayfield County Board of Supervisors, and
BE IT FURTHER RESOLVED, That the membership of said newly created committee
shall change and correspond in membership as the membership of said Sheriff's Com-
mission may change from time to time.

G from the Fifty Thousand Dollars ($50,000.00) fund now held in escrow by Bayfield
� Count y under d the hospital bonding agreement and that said officers transfer said
sum of $6500.00 to the Bayfield County Memorial Hospital for the purchase of equip-
ment to be used inthe intensive care unit of said hospital, and
BE IT -FURTHER RESOLVED, That the sum of $6500.00 shall be replaced in said fund
by said Bayfield County Memorial Hospital within a reasonable time as may be deter-
mined by the Executive Committee of this Board and upon determination of said date,
said Bayfield County Memorial Hospital shall have at least Ninety (90) days written
notice thereof.

Several opinions were expressed regarding the equipment purchase. Mr. Moniza
expressed his opinion that the board was right in granting the request. The Clerk
referred, to the bond resolution which was adopted at the July 31,' 1969 meeting.

The staff director of the Senate Subcommittee on Employemnt, Manpower and Poverty,
Mr. Bill Bechtel, advised me today that they have scheduled me to be the lead-off
witness at a special hearing on Rural Manpower and Poverty Programs, beginning at
10 a.m. on April 29 in Washington,DC. This hearing is being held to receive testi-
mony on S-1290 known as the Nelson=Javits Bill to provide for the. continuation of
programs authorized under the Economic Opportunity Act of 1964 and for other purposes.
Unless we are able to extend-OEO, the,Manpower Programs such as the Neighbor-
hood Youth Corps, Job Corps, Mainstream, Green Thumb and Green bight programs will
expire along with other OEO programs on June 30, 1971.
We are making,.,.,. -the assumption that we have been asked to be the lead-off witness
because Wisconsin Farmers Union has had several years of experience in sponsoring
and operating a Neighborhood Youth Corps program over a broad geographic area of
Wis%consin.
In view of this request, I am asking that you provide me with certain specific,
detailed backgroun&_1 information. I am interested in knowing the value attached by
participating agencies to the Neighborhood Youth Corps program that we operate in
the various communities. Do school boards, school administrators, municipal offi-
cers feel, that the program has been beneficial to the community in addition to pro-
viding work experience and financial aid to enrollees? If the program terminated,
is there a way for the local communities to step in and provide the kind of help
that the Neighborhood Youth Corps pioneered? Any other information that -would be
helpful before the Senate Subcommittee in substantiating a need would be appreciated.

To All Participating Agencies
Subject: Senate Subcommittee Hearings
All office of Economic Opportunity Programs including N.Y.C. will expire on
June 30, 1971 unless Congress enacts legislation to continue them.
Attached please find photo copy of letter this office received from Mr. Gilbert
C. Rohde, president of the Wisconsin Farmers Union, the sponsor of your Neighborhood
Youth Corps Program.
Public acceptance and support of these programs is very important before Con-
gress will decide to continue the expenditure of Federal Funds for this purpose.
It is very important that you.respond immediately to Mr. Rohde's request, as
per attached letter, for information about the N.Y.C. program in your community.
A few issues that you can comment on are:
1. Should N.Y.C. be discontinued, continued, or expended.
2. Public opinion of N.Y.C. in your area.
3. Effectiveness of N.Y.(C.. in your area (Enrollee success stories, etc.).
4. Your opinion of Farmers Union's general over-all administration of
the program; such as kind of,program service, amount of red tape, etc.
Please forward these letters of information to this office or Mr. Rohde's office
as soon as possible in order that Mr. R.'ohde can include them in his testimony at the
hearing.

Gentlemen:
It is my understanding,that the County has taken tax title to a certain parcel
of land in the township of Iron River, the description being:..
A, parcel of land in the NE/ SEy of Section 7, Township 47 North, Range 8 West,
Commencing at a point where Mill Street in the Town'of Iron River, Wis. intersects
with Oneida Street, being the north side of Mill Street and the west side of Oneida
Street; thence running in a westerly direction along the north line of Mill Street
in the village of Iron River a distance of 132 1/3 feet; thence northerly 168 feet;
thence easterly 132 1/2 feet; thence southerly along the west.line of Oneida Street
167 feet to the place of beginning.
This property has been in my family for over fifty years but due to recent
deaths causing involved heirship and disinterest of the parties involved in payment
of taxes, they have lapsed.
We own the parcel of land bordering this and request to be permitted to pay all
taxes, interest and charges accrued in this parcel and receive title.

KNOW ALL MEN BY THESE PRESENT, that the undersigned, for a good and valuable
consideration, the receipt of which is hereby acknowledged, hereinafter referred to
as the grantor(s), (have)(has) and (do)(does) hereby grant and convey unto Bayfield
Electric Cooperative 'and to its successors and assigns, duly authorized to transact
business in the state of Michigan and Wisconsin, hereinafter referred to as the
-grantee, the perpetual right and easement to construct, maintain, inspect, remove
from, rebuild, replace, and operate across the premises hereinafter described, a line
or lines of wires for the transmission and/or distribution of electric energy and
for the private telephone service of the grantee, including all supports, poles and/or
structures, wires, guys, anchors, fixtures, appliances and other equipment which the
grantee shall deem necessary, over, across, and upon said premises and to carry elec-
tric energy thereon.
There is also granted to the grantee the perpetual right from time to time and
by such means as the grantee may determine to cut, trim, destroy and/or remove from
the portion of said lands lying within 20 feet of the center line of said line or
-lines any brush, trees, logs, stumps, branches, weeds or grass lying, standing or
beingthereon, and to cut, trim, destroy and/or remove from adjacent lands of the
undersigned any trees or branches which by reason'of their proximity may endanger or
interfere with the said line or lines or the above described use and operation thereof
and -to enter upon and/or cross over said premises from time to time by man and mach-
ines, insofar as the grantee shall deem necessary in the exercise and enjoyment of

There is also granted to the grantee the right to continue on at a later date
with -the line to serve others that request service. Grantee shall notify the grantor
of the proposed route prior to building of additional line.

5. -The easement grantee shall take all necessary precautions to prevent the
obliteration of landmarks relating to corner and monuments including all corners,
bearing trees, bench marks and other Government and private•survey references.
6. That such easement grantee shall, in the clearing of'rights-of-way and
construction thereon, comply with all of the laws of the State and County concern-
ing the cutting of forest products and disposition of slash and shall be more spec-
ifically prohibited from windrowing slash in, along or upon said rights -of -way and

The first order of business to be considered was Forestry: No. 23
Mr. Mammoser, Chairman of the Forestry Committee, advised the board that the
Forestry Committee would be happy to arrange a tour of the area involved in the
application withdrawal of certain lands from County Forest.
Mr. Jerry Carlson, Mount Ashwabay Ski Hill and Mr. Robert Holmgren representing
Port Industries were present.
Mr. William Hepner, County Forestry Administrator, stated that we are facing
a problem of withdrawing 1,280 acres of County Forestry land. He stated that con-
sideration should be given to the following facts:
1. The land,.if withdrawn, must be put to a higher use
2. The board must determine if the requested use of the land is feasible
3. The board should determine the best interest of the county
Mr. Carlson, Ashwabay, spoke in regard to development plans presently contem-
plated for the Ashwabay Ski Hill.
Mr. Hepner further stated that at present there are two requests - one from
Ashwabay for withdrawal of 160 acres and another from Port Industries, Inc. for
withdrawal of 1,.280 acres. Mr.,Hepner 'stated.that the County would have to reimburse
the State in the amount of $2,388.00 if the land is to be withdrawn. He also ad-
vised the board that the Department of Natural Resources would appraise the land
and establish a minimum price.

Mr. Hepner further stated that a study should be made to determine what use
should be made for all lands owned by the county,.
Mr. Merton Heuer, Bayfield, was present and commented on land development and
sales in the county.
Mr., Hepner commented on the present County Forestry program, management and
utilization.
Mr® Robert Becker, Department of Natural Resources, was present and commented
on the prodedure of withdrawal of County Forest lands.
Mr. Harold Schultz, Cable, commented on the public ownership of property and
its effect on local taxes.
Mr. Mammoser again commented on the request for withdrawal. He raised the
following questions:
1. Should. the Board continue to investigate?
2. Should the Board, -meet and tour the area - possibly May llth?

May llth at 9:30 A.M. at the Court House. The agenda for the meeting will include

board on Port Industries :proposed Development request. Mr. Mammoser-replied that
a decision would be reached after the tour.

1. To Establish a permit system to more effectively regulate the uses of land
in the various zoning districts.
2. To establish highway set -backs.
3. To permit the development of sub -standard lots.
4. To control the location and plan requirements of mobile home parks and
trailer camps.
5. To allow closer County control of planned unit developments.

A large number of property owners are absent during the winter and early spring
months. The Town Board of the Town of Barnes feels a delay in.the passage of the
proposed Bayfield County Zoning Ordinance will give many of these property owners
an opportunity to study the ordinance.

COMPREHENSIVE AMENDMENT BAYFIELD COUNTY ZONING ORDINANCE
Pursuant to the authority and purposes of Sections 59.97, .59.971 and 87.30
Wisconsin Statutes, the Bayfield County Board of Supervisors does ordain as follows:
Section
1.0 'G•ENERA.L
1.1 Jurisdiction The jurisdiction of this ordinance includes all the land
in the unincorporated areas of Bayfield County.
1.2 Compliance Every building or other structure hereafter erected or relocat-
ed shall be in compliance with the provisions of this ordinance, and the applicable
provisions of the Bayfield County sanitary and subdivision regulations.
1.3 These regulations shall be effective on public lands only to the extent
permitted by law.
1.4 Regulations within the shoreland areas, as hereinafter defined, shall not
require the approval, or.be subject to the disapproval of any town board.
1.5 Elevations pertaining to high water marks, and groundwater levels, where
not previously established, will be determined by the Zoning Administrator, subject
to appeal under Section 12.0.
1.6 Shorelands The shorelands of navigable waters are the unincorporated
areas of Bayfield County which are as measured from the normal high water elevation;'
within one thousand (1,000) feet from lakes, ponds and flowages, and three hundred
(300) feet from rivers and streams, or to the landward side of floodplains if that
distance is greater.
1.61 Floodplains Any area subject to flooding by an adjacent stream.
1.62 Lakes, Ponds, and Flowages Any body of water larger than five acres.
1.63 Navigable water Likes, ponds and flowages, as herein defined, and
reaches of rivers and streams capable of floating a skiff or canoe of the
shallowest draft for an annually recurring and continuous period of 30
days or more, exclusive of flood period, and/or if they are indicated as
"continuous" on the U.S. Geological survey maps of Bayfield County.
2.0 CGENERAL .:LAND USE :RE.QU1REMENTS
2.1 A land use permit shall be required for any new residence, any building
erected,::relocated or structurally altered, or where. any use of the land may be sub-
stantially changed.
2.11 No such permit shall be issued where the land is not adequately
drained, has adverse soil conditions, steep slopes, shallow bedrock, or is
subject to flooding if such conditions are hazardous to the planned use
and cannot be removed. The Zoning Committee shall,in writing, recite the
facts upon which it bases its conclusions of unsuitability.
2.12 This section shall not apply to sheds, temporary shelters, farm
buildings other than residences, and similar structures, provided that set-
back requirements are met.

2.2 A conditional use permit shall be required for more than one principal
building on a lot.
2.3 A boathouse shall not exceed 10 feet in height nor extend beyond the ordin-
ary high water line, and shall not be used for human habitation.
2.4 Minimum lot sizes shall be according to the Bayfield County subdivision
ordinance, unless specifically st5.ted otherwise in these regulations.
3.0 SETBACK'S
3.1 Shoreline All permanent structures, except legally erected piers, wharfs,
marinas, boathouses, shall n6rmally be set back a minimum of 75 feet from the normal
high water line of any navigable water. A reduced setback shall be allowed where
the existing buildings within 500 feet are at less than the required setback. In
such cases, the setback shall be the average of the nearest main buildings on each
side of the proposed site, or it there is no building on one side, the average of
the setback for the one building and the required setback, but in no case shall it
be less than 40 feet. Any other setback may be permitted under Section 12.0
3.11 Special Shoreline Setback.,..A setback of not less than 40 feet, as
measured from the edge of the bank, may be permitted on the high
shorelines of Lake Superior.

3.21 A reduced setback, as determined under Section 3.1, may be permitted,
but in no case shall it be less than one-half of the required set-
back from the right-of-way line.
3.3 In cases of adverse soil or topographical conditions the Zoning Committee
may require greater setbacks.
3.4 Special setbacks and side yards, in harmony with existing buildings and
lot sizes, will be -permitted within unincorporated villages.
4.0 REMOVAL of SHORE COVER
4.1 Cutting of trees and natural shrubbery for residential purposes within a
strip paralleling the shoreline of any navigable water and extending in-
land 35 feet from the normal high water mark shall be limited as follows:
4.11 Within any 100-foot length of this strip no more than 30% shall be
clear cut.
(a) A conditional use permit will be required for any.clear cutting
on slopes greater than 20%.
4.12 In the remaining 70% of the strip, cutting shall be limited so as
to preserve the natural character of a woodland cover and to control
run-off .
4.2 For purposes other than residential clear cutting shall be prohibited
within a strip paralleling the shoreline and extending inland 100 feet
from the normal high water mark, except where such cutting is an accept-
able practice in fish and wildlife management.

4.3 From the inland edge of the strips set by this section to the outer limit
of the shoreland area, the commercial harvesting of trees will be allowed
under accepted forest management practices.

5.2 A conditional land use permit shall be required for more than 1,000 square

6.1 A conditional use permit will be required for the improvement of any sub-
standard lot.
6.2 Two or more adjoining substandard lots with the same ownership will be
considered as an individual lot for the purposes of this ordinance.
7.0 MOBILE HOMES - HOUSE TRAILERS - CAMPS
7.1 Any mobile home or mobile home type residence located outside of a State -
approved mobile home park shall be considered as a primary housing unit.
7.2 A.conditional use permit shall be -required for,the location of a mobile
home park, trailer camp, recreational camp or camp grounds.

8.0 PLANNED DEVELOPMENTS - CONDOMINIUMS - RESORTS
. It is recognized that carefully planned large-scale developments may de-
serve certain exceptions from the otherwise fixed requirements of the
zoning district (such as setbacks and minimum lot sizes) where the resulting
development would better serve the objectives of the ordinance than would
a;:'development of the same land without the use of the exceptions.
8.1 Applications for land use permits under this section shall be reviewed by
the Zoning Committee under the following procedures
(1) The applicant shall meet with the Committee to discuss the general
plans. (2) Thereafter the applicant may submit a formal application which
must include preliminary plans showing the location of all boundaries,
buildings, sewage disposal and water supply facilities, together with in-
formation showing how all the applicable provisions of this ordinance will
be complied with., the exceptions requested, and the reasons why the appli-
cant considers the exceptions to be consistent with the spirit of the ord-
inance. The Committee may request the applicant to submit such other maps

Studies, plans or pertinent information as shall be necessary to its con-
sideration of the application. (3) Final plans shall be checked by the
Committee prior to issuance of the permit.
8.2 The Committee may disapprove such plans or approve them with or without
conditions. All approvals shall be in writing. Any changes in plans shall
be approved by the Committee in writing.
8-.3 The Committee shall consider the following standards in making its decision
on the application:
8.31 The provisions of Sections 20.2 and 20.3.
8.32 A public hearing on any application for a land use permit in any
shoreland area.
8.33 Any development under this section shall have a minimum area of
30,000 square feet times the number of permitted dwelling units,
which shall be no more than four (4) per each 150 feet of lake front-
age; and the minimum lake frontage shall be 600 feet.
8.34 The requested exceptions, such as minimum lot size, must be essential
to the development which better carries out the objectives of the
ordinance than would normal development without the exception. The
objectives, for the purpose of this section, shall be und.erstood to
include; the controlling, abatement or avoidance of erosion and
pollution, the protection of natural vegetation along the shoreline,
the prevention of overcrowding of any natural resource, such as a
lake, and the compatibility of the proposed development with nearby
existing and likely development.
8.35 The tree cutting provisions of Section 4.0 shall apply except that
the maximum clear cut opening shall not exceed 100 feet for any devel-
opment.
8.36 Developments under this section shall not be permitted to use the
shoreland area of any stream or river, or the shoreland area of any
lake smaller than 100 acres.
9.0 SIGNS Purpose and Policy In order to promote the better use of scenic
resources and to protect the related aspects of the general welfare; it
is the policy of the County and the purpose of this section to limit out-
door advertising to information relative to the daily guidance, accomod-
ation and service needed by the traveling public, and to encourage the

orderly and convenient arrangement of signs.'
9.1 No outdoor advertising sign visible to the traveling public may be erected
or maintained except as provided in this section.

9.21 The number of off -premise signs permitted for.any one applicant shall
be limited to one sign on each highway approach to that applicant's
place.
9.22 The maximum distance for an off -premise sign shall normally not exceed
15 miles.
9.23 Class B signs shall have a minimum separation distance of 300 feet.
9:3 Subject matter displayed by signs will conform to the purpose stated under
Section 9.0
9.31 Any question regarding a sign's subject matter shall be determined by
the Zoning Committee.
9.4 Exempt Signs The following signs are exempt from the requirements of this
section:
a. Signs on the rolling stock of common carriers.
b. Official traffic control signs.
C. Memorial or historical signs and markers.
d. Signs of a governmental unit or department.
e. Political, auction, carnival, etc., provided they are removed within
10 days from the date of the event.
9.5 A permit will be required to erect or alter any Class B sign.
9.6 Signs of the type permitted under Section 9.2 which were erected prior to
the effective date of this ordinance, shall be governed by Section 10.0
and shall be made to conform to Section 9.82 and 9.87.
9.7 Any sign not covered by Section 9.2 may be maintained until January 1, 19759
unless it would be subject to prior removal for cause under Section 9.8.
These signs will be subject to Sections 9.82 and 9.87.
9.8 General Requirements
9.81 Flashing, intermittent or moving lights, or moving parts shall not
be used with any sign.
9.82 Signs shall not be placed or made to interfere with official traffic
signs or driver visibility.
9.83 A sign.shall be placed on its own support. Exception: on -premise
signs fastened to a building.
9.84 Signs shall not be closer than 3 feet to a property or right-of-way
line, and shall not extend more than 15 feet above the ground level,
or, if fastened to a building, not higher than the highest part of
the roof.
9.85 Signs will be placed on standard posting or in sign malls where pro-
vided or required.
9:86 With the exception of on-premeise for sale, lease or rent signs, no
advertising sign shall be designed and erected so as to be seen or
read from any water area.
9.87 •All signs shall be maintained in a good state of appearance and repair.
9.9 The Zoning Committee may revoke any permit or order any sign removed for
non-compliance with the provisions of this section.
9.91 A time limit of not less than 30 days shall be given in the order for
the removal of any sign.

10.0 NON -CONFORMING USES Non -conforming uses or structures predating this
ordinance may be continued, subject to the following:
10.1 The use or structure shall not be expanded or enlarged and damaged struct-
ures shall not be restored, except in conformity with regulations.
10.2 Any non -conforming use discontinued for one year cannot be resumed.
10.3 Structural repairs and alterations shall not, as long as the non -conform-
ity continues, exceed 50% of its fair market value.
10.4 Solid waste disposal sites in the shoreland area, such as garbage and
refuse dumps, junk and salvage yards, shall be discontinued in use one
year from the effective date of this ordinance, unless continuance is
authorized by the State Division of Environmental Protection.
10.5 Any existing method of waste disposal which had been found to be a public
nuisance shall not be permitted to continue as a non -conforming use.
11.0 PERMITS.
11.1 Any application for a permit shall be made.to the Zoning Administrator.
11.2 A schedule of permit fees as approved by the County Board will be
kept on file in the office of the Zoning Administrator.
11.3 The Zoning Committee may issue temporary permits and may attach
special conditions or requirements to any permit.
11.4 A fee will be refunded when a permit has been denied.
11.5 The condition or conditions attached to any approval or the reasons
for disapproval shall be described in writing and made a part of the
file record of the permit application.
12.0 APPPEAI PROCEDURE
12.1 Any person aggrieved by a decision of the Zoning Administrator and/or
the Zoning Committee may request, and shall be granted, a hearing
before the Board of Adjustment.
12.11 The appeal notice shall be filed with the Board of Adjustment with-
in 30 days from the date of the order or decision from which the
appeal was made.
13.0 BOARD OF ADJUSTMENT
13.1 The Chairman of the County Board is hereby authorized to appoint a Board
of Adjustment consisting of five members and one alternate, who shall be
approved by the County Board. Term of appointments, and all other matters
under this Section, shall be according to the provisions of Section 59.99.
Wisconsin Statutes.
13.11 The members of the Board shall live within Bayfield County and
outside the limits of any incorporated city or village, but no
two from the same Town.
13.2 The actual and necessary expenses of the members in the performance of
their duties shall be paid as in cases of other claims against the County.
13.3 The Board of Adjustment shall hold public hearing as needed, may order the
issuance of permits and authorize variances from the terms of this ord-
inance as will not be contrary to State law or the public interest.
13.31 Public Hearings The Board of Adjustment shall give public notice
of any hearing by publication of a Class 2 notice in the official

newspaper of the County not less than ten days prior.to the date of
the hearing, as well as mailed notice to the parties in interest.
The local town board shall also be notified and the notice posted in
three public places in the town.
13,.32`-'A copy of the notice of any public hearing on matters within the
shoreland area shall be sent to the Division of Environmental Pro-
tection, Department of Natural Resources.
14.0 VARIANCES Such variances that are granted from the terms of this ordinance
shall not have the effect of allowing prohibited uses or permitting a lower
degree of protection, and shall not be considered a precedent in any way.
15.0 VIOLATIONS - PENALTIES
15;.1 Any violation of any -provision of this ordinance which is not corrected
on the order of the Zoning Administrator, shall be referred to the Zoning
Committee, who will determine any further action, except that no litigation
shall be commenced without.County Board approval.
15.2 Any person, firm or.corporation found guilty of violating any part of this
ordinance shall forfeit a sum of not less than �10.00 nor more than 4100.00,
together with the full costs of such prosecution, and each day's failure
to comply shall constitute a separate violation.
15.3 Any imposed penalty shall be in addition to the required compliance.
16.O.ADMINISTRATION The administration of this ordinance shall be under the
direction of the Bayfield County Board of Supervisors.
16.1 The Zoning Committee shall maintain whatever staff is necessary to carry
out these regulations, and will assign specific duties of enforcement as
needed. All appointments and pay rates shall be approved by the County
l
Board.
17.0 AMENDMENTS The County Board may make amendments to this ordinance in the
manner prescribed by law.
17.1 Any petition for amendment submitted by other than a governmental body
shall be accompanied by a fee of $25.00.
18.0 A copy of all appeals, requests for variances and conditional uses, pro-

posed amendments and notices of public bearings in matters within the
shoreland areas shall be sent to the Division of Environmental Protection,
Department of Natural Resources.
This amendatory ordinance supersedes the zoning ordinance dated November 14,
1934, and all revisions and amendments thereto, and shall constitute the
entire Bayfield County Z-oning Ordinance.

20.0 ZONING DISTRICTS The purpose of this section is to divide the unincorp-
orated areas.of Bayfield County into districts within which the uses of
land will be mutually compatible.

20.11 The location and boundaries of these districts are "shown on the
official zoning maps of Bayfield County as filed in the office of
the Zoning Administrator.
20.12 Questions regarding exact boundary locations shall be determined by
the Zoning Administrator, subject to appeal under Section 12.0.
20.2 Conditional Uses Some uses may be necessary or desirable in a particular
district, but certain restrictions may need to be imposed to make them
compatible with the basic uses in that district or an adjoining district.
Such uses will be permitted when approved by the Zoning Committee.
20.3 Basis of Approval The Committee will consider the effect of any use in
relation to the character and quality of the immediate area; the topography;
the erosion and pollution potential; transportation needs; demand for re-
lated services, and other considerations relating to the general welfare.
The Committee may hold public meetings and/or hearings as needed to effect
its determinations.
20.4 Conditional uses common to all districts will be communication and power
lines and related structures, and public transportation facilities.
20.5 Accessory uses will be permitted in all districts.
20.'6 Unspecified Uses The Zoning Administrator may issue a land use permit for
an unspecified use which in his judgment is clearly impliedly included with-
in the uses permitted in the district. Doubtful cases shall be referred to
the Zoning Committee.
R-1 RESIDENTIAL-1 DISTRIC.T

Single family residences
Horticulture, gardening
Sign - Class C, D, E
Conditional uses:
Multi -family (2 or more) residences, motels
Schools, churches, town halls and other public buildings
Playgrounds, parks
Home occupations not occupying more than 25% of the floor space or

and associated commercial enterprises.
A. AGRICULTURAL DISTRICT
`k;This district is intended to provide areas for general agriculture
and to prevent the encroachment of scattered commercial and indust-
rial enterprises, and small lot residential development
Permitted uses:
One and two-family farm residences, all agricultural land uses, build-
ings and activities, roadside stands, farm -oriented recreational uses.
(a) Buildings used for housing livestock, barnyards and feed lots
shall be at least 300 feet from a commercial district or any
residence on a non -farm lot, and shall be at least 100 feet
from the normal 4igh water mark of any navigable water (subject
to diversion dikes where needed to control run-off).
Signs - All classes
Conditional uses:
N.6n-farm, single family residences - minimum lot size, five acres
with 330 feet minimum.frontage and a minimum side yard of 75 feet.

Open space uses associated with agriculture,forestpy and wildlife.
Conditional uses:
.Structures not requiring soil absorption -sewage disposal systems

21.0 Invalidation by a court of any part of this ordinance shall not invalidate
the rest of the ordinance.
22.0 Force and Effect Following passage and publication by the County Board
of Supervisors this comprehensive amendment shall be in full force and
effect as provided in Section 59.97 Wisconsin Statutes.
23.0 DEFINITIONS
1. Accessory use A use incidental to the principal use of a building.
2. Floodplain See Section 1.61.
3. Lake, Pond, Flowage See Section 1,*62.
4. Lagoon An artificial enlargement, of a waterway.
5. Lot A parcel of land five (5) acres or less in area.
6. Mobile Home Any structure which is intended for year-round residence
and which is designed to be capable of transportation by a motor
vehicle upon public highways.
7. Navigable water See Section 1.63.
8. Normal High Water Line The line where natural vegetation changes from
predominantly acquatic to predominantly terrestrial.
9. Shoreland See Section 1.6.
10. Shoreline Measurement This shall be the shortest horizontal distance
from the point where one side lot line intersects the shoreline to the
corresponding point on the opposite side lot line.
11. Structure Anything constructed or erected.
12. Wetland Any area where the groundwater is at or near the surface
most of the year.
13. Width The width at any point on a lot shall be the shortest horizontal
distance between the lot's side lines at that point.

April 12, 1971, that the following communication be forwarded to the Chairman of
the Bayfield County Board:
The Town Board of the Town of Barnes in a regular meeting April 12, 1971 votes
"NO" to the adoption and passage of the proposed Comprehensive Amendment of the Bay -
field County Zoning Ordinance dated April 12, 1971.
A large.number of property owners are absent during the winter and early spring
months. The Town Board of the Town of Barnes feels a delay in passage of this ord-
inance will give many of these property owners and voters an opportunity to study
this ordinance.
We have no major fault with the ordinance as a whole and do appreciate the
fine work of the committee and particularly Mr. Lattimer.
Possibly a joint meeting with the other towns in Bayfield County would allow
the voters and property owners a chance to voice their opinions. This could be
done in a few joint meetings and should not work an undue hardship on the Zoning
Committee.

meetings and conventions as he deems necessary and the out of pocket expenses and
regular mileage be paid by Bayfield County.

WHEREAS, the Town of Clover desires to purchase the aforesaid description, now
therefore be it
RESOLVED, that said Town of Clover, Bayfield County, Wisconsin, be permitted to
purchase the Northwest Quarter of the Southeast Quarter (NW/ SE/) of Section Twenty-
one (21) Township Fifty. (50) North, Range Seven (7) West, as provided for in County
Board Resolution recorded on page 287, Vol. 12, County Board Journal.

property.f.or the purpose of relocating said Town of Keystone dump described as the
Northwest Quarter of the Northeast Quarter (NW/ of NEY4) and the Northeast Quarter
of the Northwest Quarter (NE/ of NW/a), Section Twenty-four (24), Township Forty-seven
(47) North, Range Seven (7) West, Town of Keystone, Bayfield County, Wisconsin,
_ the consideration therefore to be the appraised value as established by Bayfield
County, and
WHERE.LS, The County recognizes the need of maintaining dumps in acceptable areas,

WHEREAS, Bayfield County has deeded to the Town of Bell Lot Two (2) of '-Siskiwit
River Valley Fruit Land Company for a gravel pit, and
WHEREAS, the Town now feels that they need additional land for sand and gravel
for public use,
NOW THEREFORE BE IT RESOLVED by the Supervisors of Bayfield County meeting
this 4th day of May, 1971, that the County of Bayfield, through its proper officers,
convey to the Town of Bell Lot One and the East Half of Lots Fifteen and Sixteen of
Siskiwit River Valley Fruit Land Company being a part of the Southeast Quarter of
Section 2, Township 50 North, Range 6 West.

departure of two of our most able and dedicated public servants during the year
1970, Ed Jelinek and.Silas Buck, former County Board members,
NOW THEREFORE BE IT RESOLVED, That the members of the Bayfield County Board
duly convened this 4th day of May, 1971, stand in a moment of silence -in respect to
the passing of Ed.Jelinek and Silas Buck, former County Board members; that this
resolution be -made a part of the permanent records of Bayfield County -and that a
copy thereof be sent to the families of said deceased.
