MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
The meeting was called to order by Walter C. Barningham, County Board Chairman,
at 9:30 AM.
The following members answered Roll Call: No. 1
Ray Kyle, Thomas Rondeau, Raymond.Mammoser, Joseph Berweger, Arther Hanson, Ernest

Moved by Moniza,seconded by Erickson to dispense with reading of the minutes
of -the"annual meeting. Motion carried.
The following resolution was read: No. 2
WHEREAS, The State of Wisconsin has revised the law governing public libraries in
the State and has provided for the payment of State aids to public library systems as
certified by the Wisconsin Division for Library Services, and
WHEREAS, The Multicounty Library Service Program is desirous of obtaining
certification as a system under the new sections of the law (43.11-13-15-17 and 19),
,and
WHEREAS, Section 43.11 calls for each County Board of Supervisors to appoint a
County Library Planning Committee for the purpose of studying system development and
services, and Section 43.19 requires the establishment of a System Board appointed by
the County Boards acting jointly,
NOW THEREFORE BE IT RESOLVED, That the Bayfield County Board of Supervisors will
appoint such a Library Planning Committee and such members to the Library System Board
on or before June 1, 1972, and
BE IT FURTHER RESOLVED, That a copy of the resolution be filed with the Division
for Library Services prior to March 1, 1972.

Mr. William Sloggy of the Multicounty Library System appeared before the Board to
iscuss the foregoing resolution. He stated that pursuant to the resolution, the County
oard chairman will appoint a 7 member County Library Planning Committee composed of one
ounty Board member and 6 other county residents. The County Library Planning Committee
ill then select 2 members who can be selected from either the membership of the Planning
ommittee or some.other interested persons to represent Bayfield County on the Multi-
ounty Library System Board. There will be 8 counties included in the System Board and
System Board will therefore be composed of 16 members.

Board and discussed various matters relating to the need of a Housing Authority in
Bayfield County.

The following resolution was read: No. 4
WHEREAS, The Bayfield County Board of Supervisors has heretofore authorized a
housing authority for said Bayfield County under the provisions of Section 66.40 of
-the Wisconsin Statutes, and
WHEREAS, Certain expenses of the committee members and the officers of said
housing authority must be borne by Bayfield County, including mileage and office
expenses, and
WHEREAS, Funds for said expenses were not included in the 1972 budget, and
WHEREAS, The sum of Nine Hundred Dollars ($900.00) is deemed to be an adequate
amount to cover said expenses of said housing authority committee members and officers
for a period of one year,
NOW THEREFORE BE IT RESOLVED, That there be transferred from the contingency
fund to the general fund the sum of Nine Hundred Dollars ($900.00) for the purposes
hereinabove set forth and that said funds be disbursed to said committee members
and officers upon vouchers for said expenses properly presented and approved by
the Executive Committee.

the members of the -Housing Authority do not receive per diem for attending the meetings
and they should be entitled to out of pocket expenses and mileage for attending the
meetings.

TO THE COUNTY BOARD OF BAYFIELD COUNTY
The Bayfield County Zoning Committee of said Bayfield County having considered
certain petitions to amend the Bayfield County Zoning Ordinance and having held a
public hearing thereon on the 4th day of February, 1972, purcuant to Section 59.97
(5)(e)(3) of the Wisconsin Statutes, notice thereof having been given as provided
by said Statute and said Committee having been duly informed of the facts pertinent
to the changes proposed and having considered all of the evidence and testimony pro-
duced at said hearing, said Committee recommends as follows:
That the proposed amendments as set forth ina copy of the notice of public
hearing, attached hereto as Schedule "A" and made a part of this report, be and
the same are hereby approved as requested in said petitions.

An Amendatory Ordinance to the Bayfield County Zoning Ordinance was read: No. 7
Moved by Celinsky, seconded by Suomala to adopt the Amendatory Ordinance.
(The above mentioned Ordinance was withdrawn and referred to the District
Attorney's office'f or a correction in the land descriptions involved. See corrected
Ordinance #14.)
Jeff DeGayner and Jack budenhoefer, representing the DeGayner & Co., Inc.,
appeared before the Board and spoke on the proposed development by the DeGayner Company
in the Cable area.
The following resolution was read: No. 8
WHEREAS, Bayfield County is the owner of certain described real property located
in and near the unincorporated:Village of Red Cliff in the Town of Russell, Bayfield
County, Wisconsin,set forth on Schedule -"All and made a part of this Resolution, and
WHEREAS, The Tribal Council of the Red Cliff Indian Reservation has made application
to Bayfield County for a transfer of said property from the County to said Tribal Council
and
c$ WHEREAS, The purpose of said transfer is to permit said Tribal Council to construct
;a and develop in and upon said parcels of property certain sanitary and water facilities
vy, under a Federal program of assistance for the benefit of the residents of said Indian
community, and
WHEREAS, It is deemed in the interest of Bayfield County and the said Indian
community to effect such transfer for the purposes hereinabove set forth, and
WHEREAS, It is deemed advisable that said transfer be made initially to the said
Town of Russell and by said Town transferred to said Tribal Council, and
WHEREAS, The intended use of said parcels of land by the said Town of Russell and
said Tribal Council is deemed to be a use in the interest of -the public as required by
previous Resolution of this Board,
NOW THEREFORE BE IT RESOLVED, That the aforesaid parcels of land belonging to
Bayfield County as described in Schedule "A" attached hereto be conveyed to the Town
of Russell for the appraised value thereof, said appraisal and transfer to be made under f
normal procedures heretofore established for transfer of County lands to municipalities
within the County, and
BE IT FURTHER RESOLVED, That the Clerk of said Bayfield County is hereby authorized
to execute and deliver a quit claim deed to said property to the said Town of Russell
for the consideration established by said appraisal.

WHEREAS, Applications are made to Bayf'iield County from time to time for
utility; highway and other types of easements over County owned lands, and
WHEREAS, Bayfield County now has an established policy as to the granting of
said easements, and
WHEREAS, It is deemed desirable to make certain changes in the conditions and
provisions presently existing for the granting of said easements, as set forth in a
proposed Schedule "A", to be attached to all of said easements hereinafter granted
by Bayfield County, said proposed Schedule"A" being attached to and made a part -of
this Resolution, and
WHEREAS, Said changes in said Schedule "A" have been recommended by the Bayfield
County Forestry Committee, and.,
WHEREAS, It is in the interest of Bayf'leld County to make an initial charge
for the granting of easements on an acreage basis in addition to stumpage values and
other special damages heretofore provided for,
NOW THEREFORE BE IT RESOLVED, That the proposed Schedule "A" attached to this
Resolution,is hereby adopted, the conditions and provisions therein to be made a part
of all easements hereinafter granted for the aforesaid purposes, and
B9 IT FURTHER RESOLVED, That all conflicting provisions and conditions as pre-
viously established be and the same are hereby rescinded, and
BE IT FURTHER RESOLVED, That all of said easements continue to be approved in
writing by the Bayfield County Forest Administrator and the District Attorney as to

and other special damages, that an initial charge shall be paid by the easement grantee,

SCHEDULE °A"
1. A map and legal description tied to established or monumented surveyed corners
all be furnished with each application for an easement. Such map shall indicate the
idth and use of said easement. Where -underground cable is used, the exact location
f the cable must be indicated. Following the laying of such cable, its location must
e marked above ground at -reasonable intervals.
2. The rights of the grantee of such easement shall apply only to the particular
arcel of land granted in the easement and such grantee shall have no right of any
ature whatsoever to enter upon adjoining County Forest or other County.lands outside
f the right-of-way and for any purpose whatsoever, except the grantee shall have the
ight to cut and/or trim trees overhanging the right-of-way upon written permission
f the County Forest Administrator.
3. The easement grantee shall refrain from spraying rights -of -way for the des. -
ruction of trees, shrubs and other plants, without thereafter cutting and properly
isposing of the dead trees and shrubs on said rights -of -way resulting from said spraying,
or the purpose of avoiding fire hazards, detracting from scenic beauty and preventing
ightly conditions from developing.
4. The grantee shall pay for all reproduction and timber standing on said right-
of-way at the time the easement is granted at the regular going rates for stumpage
charged by Bayfield County, said stumpage to be estimated by the Bayfield County Forestry
Department. All timber on such rights -of -way shall be cut in accordance with the
practices established by the Bayfield County Forestry Department.
5. The easement grantee shall take all necessary precautions to prevent the
bliteration of landmarks relating to corner and monuments including all corners, bearing
rees, bench marks and other Government and private survey references.
6. The easement grantee shall, in the clearing of rights -of -way and construction
thereon, comply with all of the laws of the State and County concerning the cutting of
orest products and disposition of slash and shall be more specifically prohibited from
indrowing slash.in, along or upon said rights -of -way and adjoining lands.
7. All overhead lines shall be constructed and maintained so as to have a minimum
clearance of fourteen (14) feet.

8. There shall be no change in the con -tour of the land as a result of construction,
and all stumps, debris and cut vegetation shall be removed or properly disposed of, and
shall.not be bulldozed to the edge of the right-of-way or upon adjacent land.
9. Upon the substantial failure of the easement grantee to comply with all the
conditions of the easement, including the conditions contained herein, said easement
may be cancelled upon ninety (90) days notice to said easement grantee and upon final
action therein by the Bayfield County Board of Supervisors.
10. The easement grantee shall have the right of ingress and egress over other
County lands adjoining said described right-of-way, only where such ingress and egress
is required for the exercise of the rights granted by this easement to the said grantee.
Such rights of ingress and egress shall be exercised only upon the written approval of
the Bayfield County Forest Administrator and over designated routes as established by
said Administrator. All special damages which may result from'the opening up and use
of such ingress and egress routes shall be compensated for by said grantee.

In consideration of the sum of one thousand one hundred and four & 90/100
Dollars ($1,104.90), the undersigned, for itself, its successors and assigns, grants
and conveys unto the Wisconsin Telephone Company, its successors and assigns, a
right-of-way and easement to place, replace, maintain or remove an underground cable
telephone line, including associated appliances such as conduits, marker posts -and
pressure alarm apparatus, on and through certain lands owned by the grantor in the
Towns of Bayfield.and Bell, Bayfield County, Wisconsin, described as: S2--SW% Section
18, NE4-NW4 Section 19, T50N-R4W, S%-SE4, SE4-SW4 Section 13, N2-NW4 Section24, N1-2-NE4,
Nz-NW4....Section 23, N2-NE4, NZ-NW4 Section 22, NE4-NE4 Section 21, S1-2-SE4, SE4-SW4
Section 16, SE4-SW4, F.%-E% of SW',,-SW4 Section 17, all in T50N-R5W and all in the Town
of Bayfield. NW'-SW4, S1-2-SW4 Section 12, all in T50N-R6W, and all in the Town of Bell,
and all in Bayfield County.
This grant includes the right, on and through the lands hereinbefore described,
to place, replace, maintain or remove additional underground cable telephone lines,
together with associated appliances, subseque6t to the placing of the telephone line
to be initially installed hereunder, it being understood, however, that such additional
lines shall be located roughly parallel to, and not more than about 10 feet distant
from, the first line installed hereunder. No cable shall be laid or apparatus installed,
however, outside of the above described right-of-way.

This grant likewise includes the right of ingress,and egress on the lands of the
ersigned for the purpose of exercising the rights herein granted; the right to install
a gate or to make a temporary opening in any fence on said lands at the point where such
fence crosses the route of said telephone line which may; in the judgment of the grantee,
interfere with the exercise of the rights herein granted. Said rights of ingress and
egress, however, shall be governed by the conditions contained in Schedule "A" attached
eto and made a part of this grant.
The rights herein granted may be assigned by the grantee in whole or in part.
The grantor, for itself, its successors and assigns, covenant not to erect any
structure on said lands that would interfere with the installation, replacement, main-
tenance or removal hereunder of said telephone line or lines and associated appliances.
The grantee, for itself, its successors and assigns, covenants that it will pay
the reasonable value of any crops destroyed and other physical damage done to the pro-
perty of the grantor, its successors and assigns, arising at any time out of the exercise
by it of the rights herein granted: The grantee shall also pay to the grantor the initia
compensation required by Bayfield County for the uses granted herein and provided by this
easement in accordance with the schedule established by the Board of Supervisors of said
County, together with such compensation as may be required by the provisions of the
aforesaid Schedule "A".
Said cable to be located on the cleared and existing corridor of the Bayfield
Electric Cooperative Inc. pole line. (said corridor is approximately 60 feet in width).
This right-of-way grant is subject to all of the provisions and conditions contained
in Schedule "A" attached hereto, as aforesaid, and made a part of this conveyance.

in the Town of Bayfield, Bayfield County, Wisconsin, described as follows: A parcel
of land measuring 35 feet by 85 feet in the Northeast quarter of the Northwest quarter

To cut down and keep cut down all trees and.brush located on said parcel of land.
To have the right of travel over said parcel of land and to do all such other
things thereon that may be necessary or usual in the exercise of the rights herein
granted.
The grantor, its successors and assigns, are not to maintain a fence on or along
the south side 'of said highway, for the distance in which said parcel of land abuts
said highway, and any existing fence in such location is to be removed by the grantor
at its expense. Should the grantor, its successors and assigns, erect a fence along
the remaining boundaries of said parcel of land separating said parcel from adjoining
lands, the expense of constructing and maintaining said fence shall not constitute a
further charge upon the grantee, its successors and assigns. The fact that the grantor,
its successors and assigns, have the right hereunder to erect such fence shall not,
however, preclude the grantee (its successors or assigns) from erecting and maintaining
a fence of its own at its own expense along any or all of the boundaries of said parcel
of land.
No damages shall be due, the grantor, its' -successors and assigns, for the value of
any cropsdestroyed or any other physical damage done to the property of the grantor,

Robert Spears, Trustee of the Pureair Sanatorium, appeared before the Board to
discuss matters relating to the Pureair Sanatorium.
Mr. Spears 'again discussed the possibility of dual use for the Sanatorium. He
stated that Dr. Mercer had inquired of the possibility of using the facility for
it
psychiatric patients and vIllas being considered by the Board of Trustees. He further
stated that using the facility for a mental health institution on the state level
still was a problem because of the fact that state aids were being paid to counties
about 18 months after the expenditures were made and the counties would have to finance
the institutions out of County funds for the 18 month period.

Rudy Frechette,.Chief Deputy, appeared before the Board to demonstrate the Video
Tape Recorder obtained through Federal Funding for the Sheriff's Department.

Too often good public servants are, at�best, ignored or otherwise mistreated
by the public they serve. I'.would like to change that; if just for a moment or two.
I am in the unique position of having been in almost every court house in Wis-
consin, not to mention those of eight other states. In short this gives me the position.
to judge and to compare. May I say that coming to the Bayfield County Administration
Building is a pleasure for me.
First of all I would like to express my gratitude to the County Treasurer, Mr.
Pristash, for allowing me to use his office for my work base. Both he and his deputy,
Mrs. Celinsky, were most gracious. This goes for the Register of Deeds and his staff
as well; as I was in and out of this office many times - and was always greeted with
a pleasant smile. I would like to thank Mr. Pajala for allowing me to use the mat-
erial as much as I did and also his staff of girls who were always pleasant and helpful.
Above all I would like to express my admiration and profound appreciation to the
Deputy County Clerk, Mrs. Shirley Haugen. She has done a marvelous job with the
addressograph system and by her adding more diagrams has made a much better plat book.

WHEREAS, it has been the policy of the County to sell the plat books at cost, and

the price of the new plat book should be adjusted to absorb the cost of those plat
books issued at no cost to certain municipal and county officers, now therefore be it
RESOLVED, that the price of the new plat book be set at $8.00 per copy plus.25e,
toward payment of State Sales Tax, be it further
RESOLVED, that the County. Clerk be authorized to sell the remaining stock of
the previous edition of the plat books at -a cost of $3.50 plus State Sales Tax and
that he be authorized to sell any copies of the plat books prior to the 1969 edition

the Emergency Employment Act of 1971 for Bayfield County. He reported that at,. --the
present time there are 32 people employed under the Program.

Mr. George Moniza spoke concerning the salary of the,Zoning Administrator.
He stated that the Zoning Committee had included in the 1972 Budget of the Zoning
Department an item of $7500 for the salary of the Zoning Administrator. The Zoning
Administrator's salary at that time was $6900 per year. Through an oversite a
resolution providing for the salary increase was not presented to the County Board
at the November meeting and consequently, the Zoning Administrator's salary has
remained at $6900 per year. Mr. Moniza stated that the Personnel(�C,ommittee had met
during the noon hour and was recommending that the salary of Mr. Heinlein, Bayfield
County Zoning Administrator, be increased to $625 per month effective February 1,
1972, which equals -the amount provided for�in the Budget.
Moved by Moniza, seconded by Rondeau to set the Zoning Administrator's salary
at $625 per month effective February 1, 1972. Motion carried.

Walter Wasmuth was allowed the floor and he spoke on matters concerning the
Highway Department. Mr. Wasmuth stated- that during the last 3 months, 2 positions
e.
have been eliminated in the Highway Department, one due to the retirement of the Patrol
Superintendent and the other job _due to the death of the Highway Shop Foreman. The
duties of the shop foreman have now been combined with the duties of the present
Parts man in the Highway Shop and the position of -the -:timekeeper has been eliminated
and the former timekeeper has been promoted to the position of the Patrol Superintendent
and the Patrol Superintendent and the Highway Commissioner now have taken over the
duties of the timekeeper. Mr. Mammoser highly commended the present Highway Com-
missioner and informed the Board that he was by far the lowest paid Highway
Commissioner in the 8th District. He further stated that his salary was in excess of
$100 per month less that the average salary of Eighway Commissioners in the 8th District
1. 1 Mr. Wasmuth recommended that the Board consider an increase in salary for the Highway ,
Commissioner and Patrol Superintendent and he suggested that the Commissioner's
salary be increased by approximately-$100 per month and the, Patrol Super.intend-entIs
salary be increased -fit $60 - $70 per month.
Moved by Howell, seconded by Berweger that the Highway Committee apply to the
Pay Board for authorization of an increase in salary of $100 per month for the
Highway Commissioner and $60 per month for,the Patrol Superintendent, effective upon
final approval of the Personnel Committee. Motion carried.

Bennie Rude again spoke on matters pertaining to the County Housing Authority.
He stated that the Board should consider allowing space in the County Administration
Building for the County Housing Authority to hold their regular meetings. Mr. Moniza
suggested that the Authority should first meet and decide where they wish to have their
meetings and if they do choose to have their meetings in the County Administration
Building, they should then make the request accordingly.
Mr. Rude suggested that Walter Wasmuth, Sanfred'Anderson and Bertyl Nelson,
present County Board Supervisors who are not candidates for re-election to the Board,
be given a rising vote of thanks for their services to Bayfield County.
