Barningham, Chairman of the Bayfield County Board. The following members answered roll call: No. 1 Ray Kyle, Thomas Rondeau, Ray Mammoser, Joseph Berweger,.Arthur Hanson, Ernest Heglund, George Moniza, Marvin Olson, Clifford Hoagland, Elmer Suomala, Wallace Johnson, George Peacy,;Eric Johnson, Harold Benton, Alvin Bratley, Peter Hanson, Bennie Rude, Walter Barningham, William Celinsky, Arthur Meierotto, Edwin Erickson Present 21 Absent 0 Total 21 The following petition for a special meeting was read: No. la May 16, 1972 TO: Edward A. Pajala ,Bayfield County Clerk Washburn,'Wisconsin 54891 Dear Mr. Pajala: You are hereby petitioned to call a Special Meeting of the Bayfield County Board of Supervisors at 9:30 o'clock A.M., on Tuesday, June 61_1972, at the Court House, Washburn, Wisconsin; for the following purposes: 1. To consider and take action on a revised Reapportionment Plan for the County Supervisory Districts. 2. To consider and take action on certain zoning amendments to the Bayfield County Zoning Ordinance. 3.- To act on the approval of an amendment to "Schedule All, used in County land easements, etc. 4. To consider and take any necessary action on the rejection by the DNR of a request of the -County to withdraw from under County Forest Lands classi- fication certain lands in the Town,of Clover, Bayfield County. 5. To consider'the confirmation of a policy adopted by the Conservation Committee of the County Board to charge a boat launching fee at certain lakes in Bayfield County. 6. To consider all other matters which may come before the said Board of Supervisors. Moved by Moni-za, seconded by Mammoser to dispense with reading of the minutes of the previous meeting. Motion carried. U94 June 6-, 19 72_ _ Wallace Johnson, Chairman of the Reapportionment Committee, was given the floor and he informed the Board about the various reapportionment plans that have been considered by the Committee. He stated that the Committee had come to the conclusion that the 18 member - 10 district supervisory plan appeared to be the plan that might be most accept- able to both the County Board and the Court. He stated that the one problem with the 18 member proposed plan was that the City of Bayfield and the Town of Russell were in the same district and that they were not contiguous. He further stated, however, that the District Attorney had discussed that problem with Judge Lewis J. Charles and it was the District Attorney's opinion that if the plan was acceptable in regard to the one-man one vote principal, it would not necessarily be rejected because of the City of Bayfield, Town of Russell problem. The District Attorney was also present and he stated that he was of the opinion that it was not necessary to give notice of a special public hearing in regard to the matter as such a hearing has already been held and the present meeting had been given -pub licity in the press and it had been stated in the press that the public was invited to attend. He did, however, suggest that it might be wise to set a specific time for later in the day at which time the public would be allowed to be heard on the matter. Moved by Rondeau, seconded by Moniza that the County Board adjourn at 1:30 PM and conduct a public hearing at which time the public would be allowed to be heard in re- gard to the various reapportionment plans. Motion carried. The District Attorney suggest that the resolution be read so that the Board members would all be familiar with it and that they could all discuss it during the noon hour if they wished to do so. The clerk then read the proposed resolution in its entirety as suggested by the District Attorney. No further action was taken. 6 � eThe following communication was read: No. 2 41 r June 6, 1972 TO: THE COUNTY BOARD OF BAYFIELD COUNTY In 1969 I was the owner of an undivided one-half interest in some land in Section 26, Township 44 North, Range 6 West (Town of Grand View). This land was entered on the tax assessment roll for 1969 as follows: Tax roll page Description Sec. T. R. 54 Part of Govt. Lot 5, W. of Co. D. 26 44 6 56 Govt. Lot 12' less Hwy'. 26 44 6 56 Lot 13, W. of Co. D. 26 --= 44 6 56 Parcel in Govt. Lot 11 as described in Vol. 204 P. 521 26 44 .6 An objection was filed to the assessment for the year 1969 and after the Board of Review overruled the objection, an appeal was taken to the Circuit Court. Honorable Richard Bardwell, Circuitt;Judgeof Dane County heard the case and entered judgment declaring the tax void. The Judge ordered the property reassessed on the 1970 roll for the year 1969 along with the regular assessment for the year 1970, but this was not done. June 6, 1972 As a result the judgment stands declaring the-1969 tax invalid, .but -it has not been reassessed. I suggest that to clear the record, the County Board should declare the tax illegal and cancel the tax certificates so that the assessor can put the property on the current roll as omitted from the 1969 roll, complying with the spirit, if not the letter of Judge Bardwell's decision. A copy of that judgment is attached hereto and made a part hereof by reference. Sincerely yours, Robert W,. The following petition was read: No. 4 June 6, 1972 To Bayfield County Board of Supervisors The Town Board of the Town of Grand View requests the purchase or trade of 40 acres of land in Sec. 18, 44 N R. 5 W., which is in County ownership. (S.W. N.E.) We are in dire need of a dump in the southern part of our Town and the only way we can get a desirable piece of property is to trade with the Federal Forestry. Warren J. June _6,_ 1972_ The following resolution was read:, No. 5 WHEREAS, Bayfield County has an established policy in reference to the granting of rights--of-way across County land for .utility lines and other purposes upon proper application being made therefor, and WHEREAS, Among other provisions and conditions for the granting of said rights - of -way, the established charge for the granting of said easements has been determined to be $30.00 per acre of all land included in said easement in addition to compensation for timber stumpage and other special damages, and WHEREAS, -It is deemed desirable to establish, in addition to the foregoing pro- visions, a minimum charge for the granting of such easements, in the amount of $100.00, and WHEREAS, There may be applications for such easements, where, in the interest of Bayfield County, said minimum charge should be waived, NOW THEREFORE BE IT RESOLVED, That in addition to all other provisions and conditions now in effect in reference to the issuance of rights -of -way and easements over and across County owned lands-, there is hereby established a minimum fee for the granting of such easements, in the amount of $100.00 and that such minimum fee may be waived only upon approval by the County Board upon -proper application being made to the said Board for said purposes. Gylund, Squadron Commander of the Chequamegon Bay Squadron from the Civil Air Patrol,appeared before the Board to discuss civil air patrol coverage for Bayfield and .Ashland Counties. Mr. Gylund informed the Board that -the Civil Air Memorial Patrol was being reactivated in the area and that theywef;e based at the Kennedy°'Air- port in Ashland and that the Squadron was available for search and rescue missions at any time in the area. He stated that he was not requesting any appropriation from Bayfield County andthat the services of the members of the Squadron were all voluntary. He suggested to the Board that the air patrol be called in any emergency day or night and they would respond with all f acilities'available. The following resolution w.as read: No. 7 WHEREAS, the Conservation Committee of the Bayfield County -Board has determined that there is a severe congestion.of boats at the boat ramp at the Twin Bear Park in the Town of Iron River, and WHEREAS, The said Conservation Committee has hired a caretaker for said Twin Bear Park to issue camping permits,.and WHEREAS, the Committee has determined that it.is to the best interest of the County to make a nominal charge for launching boats at the Park, be it therefore RESOLVED, that the Bayfield County Board in session this 6th day.of June, 1972 approve the one dollar ($1.00) boat launching fee as set by the Committee, and be it further RESOLVED, that said Conservation Committee of the County Board be authorized to change the amount of the fee or.abolish said fee at their. discretion, and be it further RESOLVED, that said Committee at their discretion be allowed to charge similar boat launching fees at other county parks. I TO: THE COUNTY BOARD OF SUPERVISORS OF BAYFIELD COUNTY: The Zoning Committee of the Bayfield County Board of Supervisors having petitioned said Board -to amend the Zoning Ordinance, and having held a public hearing thereon, pursuant to Section 59.97 (3) Wisconsin Statutes, notice thereof having been given as provided by law anti being informed of the facts pertinent to the changes proposed, -hereby recommends that said amendment to the Bayfield County Zoning Ordinance, be approved. The following communication to Walter Barningham was read: No. 10 Walter C. Barningham -- Chr., Bayfield County Board, Washburn, Wisconsin Dear Mr. Barningham: It has been my privilege to be a Trustee of the Bayfield County Rest Home since it started. I have been happy to serve, but for personal reasons, I believe it best that my replacement be made at this time. Therefore, I herewith submit my resignation as a Trustee of the Bayfield County Rest Home, effective May 20th, 1972. I deeply appreciate and thank the Bayfield County Board Members,and the Rest Home personnel, for the trust they placed in me. It is my honest and sincere wish that the Rest Home may successfully continue in its strive of maintaining its intended objective. The chairman announced that the next order of business would be to elect a Trustee to fill the unexpired. :'.term of Vic Wallin as a member of the Bayfield County Board of Trustees. Moved by Kyle, seconded by Rude that the nominations be made to fill the vacancy of a Rest Home Trustee. Motion carried. Mammoser nominated Leo'Lay, Cable, The Chairman called three times for additional nominations. No additional nominations were made. Moved by Kyle, seconded by Rude that the nominations be closed. Motion carried. Moved by Rude, seconded by Olson that the clerk cast the unanimous ballot for Leo Lay as a member of the Board of Trustees of the Bayfield County Rest Home. Motion_ carried. The clerk cast the unanimous ballot as directed and Leo. -Lay was declared elected. Moved by Erickson, seconded by Mammoser to adjourn for lunch and reconvene at 1:00 PM. Motion carried. Pajala April 28, 1972 County Clerk Court House Washburn, Wis. 54891 Dear Mr. Pajala: In reply to your.letter of April 26th, we are sorry to report that we do not have the proof maps for Bayfield County. Our space is very limited here, and of ter -we have completed and ship a county, we'keep all proofs etc. for 60 days. If we have not heard from the sponsor by the end of these 60 days, we throw away all proofs etc. and keep just our originals. June 6, 1972 The only thing I could suggest now, is that you send us a description or note of any error, and when a new plat book is made, we will double check this with the county records. The following letter addressed to Walter Barningham from the Division of Corrections was read: No. 13 15 May 1972 Mr. Walter C. Barningham, Chairman Bayfield County Board of Supervisors Bayfield, Wisconsin 54814 Dear Sir: In accordance with the provisions of Section 46.17 (3) of the Wisconsin Statutes, the Bayfield County jail was inspected on May 9, 1972. The jail registers were complete, correct and up to date. The necessary detention forms for detained juveniles were on file as required. The kitchen was clean and orderly. The menu for the day was adequate and ample. The facility appears to be in a state of disarray and does not present a good appear- ance on the first floor. The protective mesh for windows in the security section will prevent damages that occur to windows as long as prisoners are permitted the,.use Of the guard_corridors. The moving of the table in the former dining area, to the upstairs dormitory and the removal of the old wooden cupboard previously used for Fl keeping prisoners._,,dishes, would help appearance a great deal. Mrs. Jacobson mentioned that she was short on the proper coffee cups for prisoners. I have previously recom- mended that some stainless steel kitchen dishes was available at the Central Ware- house of the Wisconsin State Prison, Waupun, since the remodeling took place. I contacted the Central Warehouse (phone 414-324-2691)' and learned that they are presently out of stainless steel cups, but do have some stainless steel compartment trays left. They may have some cups again in the near future. The trays are obtain- able at 25'cents.per tray. A call.could be placed direct.to'the warehouse for details. It is hoped that the jail remodeling process can be completed very soon. Please convey my appreciation to Sheriff Embertson's staff for the time and courtesies extended to me during this visit. Several communications were read from the Bayfield County Memorial Hospital; No. 14 Moved by Wallace Johnson; seconded by Bratley to receive the communications and place them on file., Motion carried® The following communication from the Division of Highways was read: No. 15 April 7, 1972 To County Treasurers Prepayment "of 1972 Supplemental Highway Aid for County Trunk Highways, Section 20.395 (yb) (yd) Wisconsin Statutes The enclosed State Treasurer's check in the amount indicated in the righthand column below represents the'prepayrient of the 1972 supplemental highway aid for County Trunk Highways in your county pursuant to Section 20.3951 Wisconsin Statutes. It is computed as 50 per cent of the supplemental aid paid to your county in September, 1971. The exact amount of the 1972 supplemental aid paid to your County Trunk Highways pursuant to Section 20.395 will be determined after the close of the current fiscal year on June 30, 1972. The balance of your 1972 supplemental highway aid after deducting the amount of this payment, will be remitted during the month of July. The funds represented by this payment are supplemental to and are to be used for the same purposes as the County Trunk Ailotment under Section 83.10 (1), which will be paid in July. June 6, 1972 The following resolution was read: No. 16 Authorizing Bayfield County to recognize and endorse the Northwest Areawide Comprehensive Health Planning Organization as the areawide comprehensive health planning agency for Bay - field County. Whereas, there now has been created an areawide comprehensive health planning agency identified currently as the Northwest Areawide Comprehensive Health Planning Organization for the purpose of fulfilling the health needs of a multi -county area in= cluding Bayfield County. Whereas, such areawide comprehehsive health planning agency will collect data, conduct research and evaluate facts and information concerning the health problems, needs, facilities, and services of the area, including the formation of a master plan for improving health facilities and services and satisfying unmet needs; and to foster coordination and cooperation among organizations, agencies, groups and indiv- iduals, private and public, who are operative in health fields and to provide the means for continuing exchange of information among them; and Whereas, the work of the areawide comprehensive health planning agency will relate very closely to the many health programs and services in which the County government is engaged; Now, therefore, be it resolved, that Bayfield County recognizes and endorses The Northwest Areawide Comprehensive Health Planning Organization as the organization which should properly undertake to develop an areawide comprehensive health planning program in this area. Moved by Moniza, seconded by Mammoser to adjourn as a County Board and convene as a Committee of the Whole to conduct a Public Hearing in relation to the reapport- ionment of the Bayfield County Supervisory Districts. Motion carried. The Hearing was called to order by Wallace Johnson, Chairman of the Reapportion- Iment Committee. Mr. Johnson asked for any comments from the floor. Mr. Walter Anderson spoke and gave his opinion. Mr. Anderson appeared to be of the opinion that of the several plans that had been proposed, the 12 member plan as proposed by the Court should probably be the one approved by the County Board. 4 4D Moved by Mammoser, seconded by Berweger to adjourn the Hearing and reconvene as,a County Board. Motion carried The following resolution was read: No.' 17 WHEREAS, Counties in the State of Wisconsin were required, pursuant to the provisions of Section 59.03 (2)'(c) of the Wisconsin Statutes., to apportion County supervisory districts following the receipt of the population certification of the 1970 Federal decennial census, and WHEREAS, The Bayfield County Board of Supervisors, pursuant to the foregoing Statutory directive, adopted a plan of reapportionment at a special session of said Board held on December 15, 1971, whereby 21'supervisory districts were created within the County, and WHEREAS, Thereafter, litigation was commenced in the Circuit Court for Bayfield County, Wisconsin, petitioning said Court to set aside said reapportionment plan as being unconstitutional under the established guide lines of the "one man - one vote" principal, and WHEREAS, The said Circuit Court for Bayfield County, Wisconsin has declared ' the present plan of the reapportionment for Bayfield County to be illegal following a hearing on said petition; and WHEREAS, Said Court has directed the Bayfield County Board of Supervisors to apportion Bayfield County as to the Supervisory districts therein within the guide lines as established by law, and WHEREAS, The Bayfield County Board of Supervisors, pursuant.to the aforesaid Statutory authority, the directives of the Bayfield County Circuit Court, following public hearings on the 15th clay of December; 1971 and the 6th day of June, 1972, has formulated a plan for the reapportionment of said County as to Supervisory districts which is deemed to be within the aforesaid guide lines as to the "one man - one vote" principal, said reapportionment plan being attached hereto and made a part of this Resolution as Schedule "A", with the same effect as though fully set forth herein, and 111HEREAS, A special election will be necessary to elect County Supervisors at the regular April spring election in the year 1973, NOW THEREFORE BE IT.RESOLVED, That the Bayfield County Board of Supervisors, pursuant to the foregoing Statutory authority and directive of the Circuit Court for Bayfield County, Wisconsin,hereby adopts the reapportionment plan set forth in said Schedule "A" attached hereto, to become effective, subject to the approval of said Bayfield County Circuit Court and, upon such approval, to be implemented by a new election of County Supervisors, pursuant to said plan, to take place at the time of the regular spring election during the month of April, 1973, the Supervisors therein elected to take office on the 3rd Tuesday in April, 1973, and BE IT FURTHER RESOLVED, That the County Clerk for Bayfield County shall, upon the aforesaid plan of reapportionment being fully approved, initiate and take all necessary procedures to cause an election to take place for said County Supervisors at the regular spring election of -.April, 1973, as aforesaid. WHEREAS, The Bayfield Electric Cooperative, Inc. of Iron River, Wisconsin, 11 has made application to Bayfield County for a right-of-way to be used for the construction of a utility line running across a part of the Northeast Quarter -of the Southeast Quarter (NE4 of the SE4), Section Twenty-nine (29), Township Forty-nine (49);North, Range Five (5) West, from the town road westerly to the Bayfield County Sheriff's Department radio tower for the purpose of serving said facility with electricity, and WHEREAS, It is deemed'in the.interest,of Bayfield County to grant said easement without cost to said applicant, subject to the provisions of the schedule of restrictions now in effect as relates to the granting of such easements referred to as Schedule "A"' NOW THEREFORE`BE IT RESOLVED, That the Bayfield County Clerk is hereby authorized and directed to execute and deliver an easement running to said Bayfield Electric Cooperative, Inc. for said purposes running across said described property belonging to Bayfield County. The following resolution was read: No. 19 --- - ---- - --- -- -- - --- ---- --- -------- June l� sA WHEREAS, Bayfield County by resolution duly adopted by the Board of Supervisors on the loth day of November, 1970, pursuant to the provisions of Section 28.11 of the Wisconsin Statutes, petitioned the Department of Natural Resources for the withdrawal � of a cettain parcel of land from the Forest Crop Law, entered under Chapter 77 of the Wisconsin Statutes, said p arcel of land being described as a part of the Northeast Quarter of the Northeast Quarter (NE% of NE!), Section Ten (10), Township Forty-nine (49) North, Range Seven.-,(7) West, consisting of approximately Nine (9) acres and 3 located within the enclosed portion of a fence known as the Bratley Fur Farm Fence, and WHEREAS, Said petition was denied -by said Department following required Statutory procedures, and WHEREAS, The owner of adjoining lands who initially requested the action of the County Board to petition for the withdrawal of said parcel of land is interested in pursuing all remedies afforded by Statute to effect the withdrawal of said land, NOW THEREFORE BE IT RESOLVED, By the Bayfie.ld County.Board of Supervisors assembled this 6th day of June, 1972, that an appeal is hereby entered from the decision of said Department of Natural Resources, said appeal being made to a review committee as. pro- vided for in Section 28.11 (lla) of the Wisconsin Statutes, w ' BE IT FURTHER RESOLVED, That the County Clerk be and he is hereby authorized and directed to forward to the Department of Natural Resources a certified copy of this Resolution and to notify all interested persons of the action of this Board in requesting the aforesaid review.
