BAYFIELD COUNTY BOARD OF SUPERVISORS
The meeting was called to order by Walter C. Barningham, Chairman of the
Bayfield County Board at 9:30 Mi.

The following members answered roll call: No. 1

Moved by Rondeau, seconded by Erickson to dispense with reading of the minutes
of the previous meeting. Motion carried.
Richard Olson and John Blahnik, representing the Bayfield County Memorial
Hospital, appeared before the Board. Mr. Olson gave a complete report to the County
Board relative to the operation of the hospital. He stated that the hospital was
operating satisfactorily and no problems had been encountered in regard to the
hospital making their annual lease payments. Mr. Olson then proceeded to explain to
the Board the need for additional clinic and office space in the hospital. He
stated that a thorough study had been made in regard to adding either additional
patient room and clinic space or clinic space only. After the study it wad decided
by the hospital board that.the most pressing need at the present time was for clinic
space only and the board had, therefore, engaged the services of Thomas Shefchik &
Associates, Architects, to prepare preliminary plans for the addition. Mr. Olson
then went on to explain that the hospital board was of the opinion that adding the
clinic space at an estimated cost of $60,000 to $80,000 could be financed by the
hospital without in any way jeopardizing the hospital's ability to make the annual
lease payments. The Board was informed that it would only be necessary for Bayfield
County to approve the addition and no financial contribution would be required by
the County Board.
Mr. Blahnik and Mr. Olson then answered questions that were raised by the Board
in regard to operation of the hospital. They advised the Board that two new doctors
had been added to the staff and that the clinic was now well staffed with doctors.
Joseph W. Parker, Field Representative, Wisconsin Dept. of Justice, appeared

before the Board. Mr. Parker advised the Board that if the Board,would adopt an
appropriate resolution, all new law enforcement officers would be eligible for 6

six week training session. The salary of the officers as well as all expenses incurred
during the training session would be reimbursed to Bayfield County through state funding.
He further stated that even those officers who had been employed for a year or two
would be eligible for the training.
The following resolution was read: No. 2
WHEREAS, There is presently assigned to Bayfield County only one State Traffic
Officer, and
!WHEREAS, The number of traffic deaths in Bayfield County over the past five years
and the number of traffic arrests made in said County correspond to statistics in
comparable counties having two or more traffic officers assigned thereto, and
WHEREAS, Traffic problems in Bayfield County continue to increase year by year
to accelerated development of recreational areas in all .parts of the County, and
WHEREAS, It would be desirable and in the interest of safety and the protection
of person and property on the highways of this County to increase the number of
State Traffic Officers assigned to Bayfield County and to extend the authority of
said officers to other enforcement duties as encompassed in a proposed Bill now
pending in the State Assembly, to -wit: Assembly Bill 309;
NOW THEREFORE BE IT RESOLVED, That a request be made through the County Clerk
to the State Department of Transportation for the assignment of at least one additional #
State Traffic Officer to Bayfield County, and
BE IT FURTHER RESOLVED, That the Bayfield County Board hereby goes on record in
supportof the aforesaid Assembly Bill 309 in its present form and directs the County
Y
Clerk to forward a copy of this Resolution to -local representatives in the State
Senate and Assembly.

the new proposal and the above resolution.

RIGHT-OF-WAY GRANT
In consideration of the sum of One Dollar and Other Valuable Consideration$,
determined by the Forest Administrator, the undersigned, for 'itself, its successors
and assigns, grants and conveys unto the Chequamegon Telephone Co-operative,
Cable, Wisconsin, Iron River Exchange, its successors and assigns, a right-of-way
easement to place, replace, maintain or remove an underground cable telephone
line, including associated appliances such as conduits, marker posts and pressure
alarm apparatus, on and through certain lands owned by the grantor in the Town
of Hughes, Bayfield County, Wisconsin, described as: NZ NE4, Eh NW4, SW NW, all in
Section 22, Township 47 North of Range 9 West. No cable shall be laid or apparatus
installed, however, outside of the above described right-of-way.
This grant likewise included the right of ingress and egress on the lands of
the undersigned for the purpose of exercising the rights herein granted; -the right
to install a gate or to make temporary opening in any fence on said lands at the
point where such fence crosses the route of said telephone line which may, in
judgment of the grantee, interfere with the exercise of the rights herein granted.
Said rights of ingress and egress, however, shall be governed by the conditions
contained in Schedule "A" attached hereto and made a part of this grant.
The rights herein granted may be assigned by the grantee in whole or in part.
The grantor, for itself:, its successors and assigns, convenant not to erect
any structure on said lands that would interfere with the installation, replace-
ment, maintenance or removal hereunder of said telephone line or lines and
associated appliances.
The grantee, for itself, its successors and assigns, covenants that it will
pay the -reasonable value of any crops destroyed and other physical damage done
to the property of the grantor, its successors and assigns, arising at any time
out of the exercise by itZ of the rights herein granted. The grantee shall also
pay to the grantor the initial compensation required by Bayfield County for the
uses granted herein and provided by this easement in accordance with the schedule
established by the Board of Supervisors of said County, together with such
compensation as may be required by the provisions of the aforesaid Schedule "A".
Said cable to be located on the cleared and existing corridor of the Bayfield
County Electric Cooperative Inc. pole line. (said corridor is approximately 60
feet in width). Said cables shall be located within a 10' strip from center
line of existing power line on one side or the other but not both.
This right-of-way grant is subject to all of the provisions and conditions
contained in Schedule "A" attached hereto, as aforesaid, and made a part of
this conveyance.

SCHEDULE "A"
1. A map and legal description tied to established or monumented surveyed corners
shall be furnished with each application for an easement. Such map shall indicate the
width and use of said easement. where underground cable is used, the exact location
of the cable must be indicated. Following the laying of such cable, its location must
be marked above ground at reasonable intervals.
2. The rights of the grantee of such easement shall apply only to the particular
parcel of land granted in the easement and such grantee shall have no right of any
nature whatsoever to enter upon adjoining County Forest or other County lands outside
of the right-of-way for any purpose whatsoever, except the grantee shall have the
right to cut and/or trim trees overhanging the right-of-way upon written permission
of the County Forest Administrator.
3. The easement grantee shall refrain from spraying rights -of -way for the
destruction of trees, shrubs and other plants, without thereafter cutting and properly
disposing of the dead trees and shrubs on said rights -of -way resulting from said
spraying,.for the purpose of avoiding fire hazards, detracting from scenic beauty
and preventing unsightly conditions from developing.
4. The grantee shall pay for all reproduction and timber standing on said right-
of-way at the time the easement is granted at the regular going rates for stumpage
charged by Bayfield County, said stumpage to be estimated by the Bayfield County
Forestry Department. All timber on such rights -of -way shall be cut in accordance with
the practices established by the Bayfield County Forestry Department.
5. The easement grantee shall take all necessary precautions to prevent the
obliteration of landmarks relating to corner.and monuments including all corners,
bearing trees, bench marks and other Government and private survey references.
6. The easement grantee shall, in the clearing of rights -of -way and contruction'
thereon, comply with all of the laws of the State and County concerning the cutting of
forest products and disposition of slash and shall be more specifically prohibited
from windrowing slash in, along or upon said rights -of -way and adjoining lands.
7. All overhead lines shall be constructed and maintained so as to have a minimum
clearance of fourteen (14) feet.
8. There shall be no change in the contour of the land as a result of construction,
and all stumps, debris and cut vegetation shall be removed or properly disposed of,
and shall not be bulldozed to the edge of the right-of-way or upon adjacent land.
9. Upon the substantial failure of the easement grantee to comply with all the
conditions of the easement, including the conditions contained herein, said easement
may be cancelled upon ninety (90) days notice to said easement grantee and upon final
action therein by the Bayfield County Board of Supervisors.
10. The easement grantee shall have the right of ingress and egress over other
County lands adjoining said described right-of-way only where such ingress and egress
is required for the exercise of the rights granted by this easement to the said grantee.
Such rights of ingress and egress shall be exercised only upon the written approval of
the Bayfield County Forest Administrator and over designated routes as established by
said Administrator. All special damages which may result.from the opening up and use
of such ingress and egress routes shall be compensated for by said grantee.

The County Clerk brought to the attention of the Board that the Chequamegon
Telephone Company has made an application for an easement to bury an underground
cable on Lots 13 to-17, inclusive, Block 13, Hessey's Addition"Town of Iron River,
said lots now being currently advertised for sale by the Sales Committee.
The following motion was made: No. 7
Moved by Suomala, seconded by Rude to sell the above described lots in
Iron River and let the Wisconsin Telephone Company get in touch with the new owner.
Motion carried.
The following resolution was read: No. 8
WHEREAS, Senate Bill 2 has been introduced in the State Senate, and
WHEREAS, Senate,Bill 2 adopted in its present form would freeze property
taxes at a level not to exceed the 1972 levels, and
WHEREAS, the proposed bill would prohibit the increase of taxes above the 1972
level by the state, county, city, village or town, whether for use of the political
subdivision or on behalf of another governmental entity, and
WHEREAS, many of the local taxes are certified to the.municipality by either
the state, county or school districts, and therefore the local municipality has no
control over the tax, and
WHEREAS, the apportionment of taxes to the counties as well as political sub-
divisions of a county fluctuates from year to year according to the equalized values
and is not controlled by the local municipality, and
WHEREAS, the bill further provides that increases over the 1972 levels can only
be made after holding a public hearing and approval of the people at a duly held
referendum, and
WHEREAS, the present laws now already provide for a public hearing and the holding
of a referendum would only add to the tax load, now therefore be it
RESOLVED, that the Bayfield County Board in session this 13th day of February
go on, record opposing Senate Bill 2, and be it further
RESOLVED, that copies of this resolution be mailed to Governor Patrick J. Lucey,
Senator Daniel Theno, Representative to the Assembly David Kedrowski and all county
clerks in the State of Wisconsin.

The following resolution was read: No. 9
WHEREAS, The several committees of the Bayfield County Board of Supervisors are
required, in the conduct of the business of said Bayfield County, to hold and conduct
committee meetings in excess of the.number permitted by Statute, and
WHEREAS, by action of the County Board, the number of meetings of said committees
beyond the Statutory limit may be extended, now therefore be it
RESOLVED, That the several committees of the said Bayfield County Board of Super-
visors, be and they are hereby authorized to hold such meetings during the year 1973 as
may be necessary to the proper conduct of the business of said Bayfield County.

Recently the State Geographic Names Council received two applications to name a
feature located in Bayfield County. One application is for Twenty Mile Creek and
the other application is for Twentymile Creek, spelled as one word. It was the
Council's recommendation that due to a discrepancy in the descriptions submitted and
the.two different spellings this item should be sent to the county for clafification
at a local level.
Would you please investigate and report your findings as to;the proper description
and spelling of the name or name of this feature. A copy of both of the applications
which we received is attached for your use.
Also the U.S. Board on Geographic Names on their Docket.No. 161 listed Mud Creek
for a feature in Bayfield County as described on the attached copy of the docket.
At their October, 1972, meeting it was the decision of the State Geographic Names
Council to deny Mud Creek in order to avoid duplication. There are presently three
Mud Lakes located in Bayfield County listed in the "Wisconsin Lakes" publication.
Please submit any comments or suggestions you may have on these matters. Thank you

SUBJECT: Audit of Bayfield County State Aid.Forestry Fund
January 1, 1969 to December 31, 1971
On June 28 and 29, 1972, an audit was made of the Bayfield County State Aid Forestry
Fund. The period covered was January 1, 1969 to December 31, 1971.
With the assistance of the County Forester, vouchers were examined for proper
authorization and classification. Vouchers and receipts were traced to the County
Forest Administrator's journal which was reconciled to the records of the County
Clerk. All receipts properly accruing to the State Aid Forestry Fund appeared to
have been correctly credited.
During 1969 the county had only one account set up for all county forest disbursements.
Both the state allotment and the county appropriation were credited to this account
and all disbursements charged against it. In 1970 and 1971 separate accounts were
set up. All disbursements were charged against the State Fund until it was exhausted
and then the county fund was used. Treating the accounts this way results in.there
being no carryover balance left in the State Fund. Any unexpended balance in the
county appropriation reverts to the county general fund. This method of accounting
was adopted at the recommendation of John H. Maitland, CPA, of Washburn, Wisconsin,
who audits the regular county .books. A letter dated November 13, 1969, from M. E.
Reinke, who at that time was Director of the Bureau of Forest Management, indicates
this method is acceptable to.the Department of Natural Resources.
Original charges to the State Fund in 1970 and 1971 were in excess of the amount
available and the account was balanced out by a journal entry transferring a sufficient
amount of- .disbursements to the County Fund. This was -done on a total amount basis
without any detail breakdown. In view of these -facts and because there was no separati
of 1969 disbursements it has been necessary to show all disbursements together. The
attached analysis shows all county disbursements as one unit rather than two, and
accounts for all receipts in total rather than separately.
All the State allotment is considered to have been expended. Any unexpended balance
is considered to be a portion of the county appropriation and therefore is returned to
the County General Fund.
For 1969 all vouchers were examined but for 1970 and 1971 only the vouchers which had
been charged against the State Fund were examined. All appeared to be legitimate ex-
penditures and properly authorized.
Bayfield County has an active program of forestry work and spends from county funds
more than twice the amount of the State allotment. The State allotment has remained
steady at just over $16,500.00, but total disbursements have increased from $48,223.57
in 1969 to $51,311.47 in 1970 and $56,312.20 in 1971.

Administrative expense is considerably above the normal 10 percent. It was 30
percent in 1969 and 1970 and 25 percent in 1971..It is possible that a careful
study of the administrators time would show that more of his time could be charged
to supervision of some of the outside activities.
Equipment costs were consistent in 1969 and 1970 at $3,301.28 and $3,384.24
tespectively. In 1971 they rose to $4,723.41, due largely to heavy tractor
repair expense.
Planting expenses rose consistently from $6,328.56 in 1969, to $7,567.13 in 1970,
and $10,177.97 in 1971.
Timber stand improvement expenses were heavy in 1969 at $2,163.57, but none in
1970 and -.a nominal amount in 1971.
Timber sale expense showed a steady increase from $19,979.56 in 1969 to $23,546.24
in 1970 and $25,466.57 in 1971. Consistently more salary time was charged to
cruising and less to supervision.
Forestry building operational expenses were steady and consistent through the
three-year period.
Insurance costs remained fairly steady during the three-year period. A land with-
drawal charge of $290.02 in 1969 boosted miscellaneous expense for that year to
$1,077.26.
Unexpended balances f rom the county appropriation which were returned to the
County General Fund were $838.87 for 1969, $4,827.97 for 1970 and $1,886.51 for 1971.
In addition to the above disbursements the county has an outlay account for capital
expenditures relating to the County Forests. Expenditures from this account were
as follows:

In summary it can be stated that the records were well kept and that Bayfield

WHEREAS the County Highway Department has had three Federal Aid Projects
in which the overrun has been more than the County Road and Bridge Fund appro-
priation financed, and
WHEREAS costs of construction have increased in right-of-way a.cquisiti.on'..due
to the Federal Relocation Assistance Act and environmental
requirements, increasing overhead accordingly, and are beyond local control, and
WHEREAS there are pending proposals to freeze the segregated highway fund
at the 1972 level, and
WHEREAS increased costs for the next Federal.Aid to Secondary Roads projects
are more than anticipated, and
WHEREAS the -revenue sharing funds cannot be used where other Federal monies
apply,
NOW, THEREFORE, BE IT RESOLVED that $60,000 of the Revenue Sharing Funds
payable to Bayfield County be appropriated to the Bayfield County Highway Department
for the purpose of financing construction of two buildings, namely a storage garage
at Mason and a salt -shed at Iron River.

WHEREAS, the NWCAP administers $1,600,000 in total funds favorably contributing
to the economy of the area, and
WHEREAS, the NWCAP's presence has a positive impact on the Human Resource and
economic status of the area,
THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors hereby
request that Congress see that the funds for Community Action be 'released through the
life of the Economic Opportunity Act as approved by Congress.

accumulated sick leave time should be paid to the employee upon retirement or
to the heirs of such employee upon death of such employee at the regular rate
of pay in effect at the time of retirement or death, and
WHEREAS, it is deemed advisable to amend the resolution, therefore be it
RESOLVED, that the above referred to resolution be amended to provide that
the 50/ of the unused accumulated sick leave time shall be paid to the employee
upon termination of employment whether such termination is because of resignation,
lay-off or voluntary termination by the employee, and be it further
RESOLVED, that if an employee is dismissed for cause, such as intoxication,
insubordination, etc., it shall be the duty of the Personnel Committee of the
County Board to determine whether the unused sick leave shall be paid to the
employee, and be it further

WHEREAS, It has been recommended to the Bayfield County Board of Supervisors
by the Board of Directors of the Bayfield County Memorial Hospital, Inc., that a
one-story addition to said hospital be added for use as clinical space at a cost
not to exceed $80,000.00,'and
WHEREAS, No part of the cost of said construction is to be borne by Bayfield
County, and
WHEREAS, The aforesaid required funds for said construction have been arranged
for through contributions and other available assets of said hospital not required
for operational expenses or debt retirement, and
WHEREAS, Any indebtedness which must be incurred in the construction of said
addition will be minimal and will not adversely affect the financial stability of
said institution, including debt retirement, and
WHEREAS, It is deemed advisable that the County proceed with such construction,
NOW THEREFORE BE IT RESOLVED, That the Board of Supervisors of Bayfield County
hereby authorizes the Executive Committee of said Board to do such acts as may be
necessary in the planning and construction.of said wing to the Bayfield County

WHEREAS, Every municipality is charged with the responsibility of furnishing
jGeneral Relief, except where counties have chosen to furnish General Relief, and
bruary 13. 1973
WHEREAS, Forty-three counties have chosen to administer General Relief, and
WHEREAS, General Relief must be financed entirely through local property
taxes, and
WHEREAS, Local property taxes were never intended to finance a General Relief
program similar to the present program, and
WHEREAS, The nature of the General Relief program has changed from the time
it was established, and
WHEREAS, The mobility of people has made the furnishing of relief a common
responsibility to be shared, instead of a responsibility falling exclusively upon
the community meeting that need, and
WHEREAS, The administration of the General Relief program as a separate program
is more expensive than other assistance programs, and
WHEREAS, We have found that the General Relief program can more effectively
be administered through the County Agency administering the other public assistance
programs, and
WHEREAS, The erratic administration of General Relief in the state has thrown
an undue burden upon those communities meeting the emergency needs of people,
therefore
BE IT RESOLVED That the Bayfield County Board of Supervisors in session this
13th day of February, 1973 supports legisl4tion that would provide state matching
funds for General Relief and for the administration of General Relief to counties
that administer the program through the County Department of Social Services, and
BE IT FURTHER RESOLVED, That because of the temporary and emergency nature
of General Relief, flexibility in meeting needs and the use of voucher and vendor
payments be permitted.

WHEREAS, The Department of Health and Social Services, Division of Family
Services, is proposing state administration of county social services, and
WHEREAS, Such plan provides for Multi -Service Centers throughout the state; and
WHEREAS, Bayfield County now has modern and adequate social services offices, and
WHEREAS, Adjacent to these quarters is space available to accommodate expansion
to provide an additional 1890 square feet of space, therefore

BE IT RESOLVED By the Bayfield County Board of Supervisors in session this 13th
day of February 1973 to offer office space for lease to the Division of Family Services
to accommodate the Multi -Service Center for this area of the state, and
BE IT FURTHER RESOLVED that if Washburn is selected as the site for the Multi -
Service Center the uncompleted lower level of the Bayfield County :Administration
Building be considered for completion after appropriate lease is negotiated.

Gentlemen
I am a property owner on the Upper Eau Claire Lake, who, among many, after full
consideration, am opposed to the development of a campground on this beautiful
lake, for such obvious reasons that it should insult one's intelligence and common
sense to enumerate.
The prime reason I am writing, however, is not only to strongly voice my objection
to the granting of permission of such an onerous venture, but to question the
obvious unresponsiveness of the elected officials of the Bayfield County Board in
view of the pervasive opposition of the land owners and electorate to this project.
It appears all too clear that some of the elected officials in a position to do some-
thing for the people who pay the largest share of the County budget through taxes,
are to a very large part, ignoring the will of the majority simply because the
proponents of this project have claimed they have met the existing regulations,
however minimal.
You can be assured that not only the undersigned will scrutinize the activities
of those elected officials who ignore those many persons and families -who now and
in the future will be irreparably damaged if such a mercenary endeavor. is permitted.

Walter Barningham, Chairman, brought to the attention -of the Board the
necessity for certain changes required in the County Board functions, especially
relative to committees, due to the re -districting of the Bayfield County Supervisory
Districts. He pointed out that under the new districting plan there will only be
18 supervisors instead of 21. Due to the decrease in the number of supervisors,
certain changes will have to be made regarding the composition of the County Board
committees.
Moved by Moniza, seconded by Mammoser to refer this matter to the Personnel
Committee and report back to the County Board. Motion carried.
Moved by Suomala, seconded by Celinsky that the Executive Committee make a
study of safeguarding the records in the Register of Deeds office. Motion carried.

Embertson for his service to Bayfield County and a copy of this motion be sent to
him and that the County Clerk write an appropriate letter to Mr. Embertson informing
