Barningham, County Board Chairman. The following members answered roll call: No. 1 Present - Edwin Erickson, Arthur Meierotto, Ila Bromberg, Eric Johnson, Clifford Hoagland, Bennie Rude, Peter Hanson, Larry Seidel, Herbert Spears, Wallace Johnson, Ernest Heglund, William Carter, Joseph Berweger, Stephen Barry, Walter Barningham Absent - Arthur Hanson, Carl Anderson, Edwin Renoos Total present - 15 Larry Seidel, board member, started out the meeting with a prayer and pledge of allegiance. Moved,by Erickson, seconded by Meierotto to dispense with reading of the minutes of the previous meeting. Motion carried. The following communication was.read: No. 2 n STATE OF WISCONSIN/DEPT. OF TRANSPORTATION 12-16-74 Mr. Edward A. Pajala Bayfield County Clerk County Courthouse Washburn, WI 54891 Dear Mr. Pajala: County Trunk Highway System Changes P-2.212 Bayfield County On December 12, 1974, the Highway Commission considered the petition of Bayfield County for changes in the County Trunk Highway System. The petition requested: 1. The removal of a road in the Tn. of Washburn beginning at a point approximately 1575 feet north of the center of Section 27, Township 49 North, Range 5 West, thence easterly to a point on the east line of said Section 27, thence south along the east line of said Section 27 to a point approximately 300 feet.north of the southeast corner of said Section 27, thence southeasterly approximately 400 feet to the south line of Section 26,,Township 49 North, Range 5 West, thence _east to a point approximately 750 feet east of the southwest corner of said Section 26. 2. The addition of a road in the Town of Washburn beginning at a point approximately 1575 feet north of the center of Section 27, Township 49 North; Range 5 West, thence,southeasterly along a 4000' curve to the right approximately 950 feet, 6thence southeasterly approximately 3100 feet, thence easterly along a 4001 curve to the left approxi- mately 1645 feet to a point approximately 750 feet east of the south- west corner of Section 26, Township 49 North, Range 5 West. Motion carried. 380 February ll, 1975 The following resolution was read: No. 3 WHEREAS, certain lands located in Bayfield County, Wisconsin, and more particularly those lands within the limits of Project 8161-1-21, Washburn-Bayfield Road, STH 13; Bayfield County, are owned by Bayfield County, and; WHEREAS, certain portions of such county -owned land are required for highway right of way; NOW THEREFORE BE IT RESOLVED: That the Bayfield County Board of Supervisors, in regular session assembled, this llth day of February, 1975, do hereby reserve the following lands for highway purposes: Tract 1 - All that part of a 0.3 acre parcel of land located in Gov't Lot 2, Sec. 4, T. 49 N. R. 4 W., further identified as Parcel No. 56 on Sheet 4.11 of the right of way plats for above described project. Tract 2 - All that part of Lot 5, Block 135, original townsite of Bayfield; further identified as Parcel No. 119 on Sheet 4.15 of the right of way plats for above described project. (Said parcel contains 1600 square feet, more or less, exclusive of land previously acquired for highway purposes.) BE IT FURTHER RESOLVED, that the Bayfield County Clerk is hereby authorized and directed to sign and issue Quit Claim Deeds to the State of Wisconsin (Dept. of Transportation, Division of Highways) for the herein described lands. The following resolution was read: No. 4 WHEREAS, the Highway Committee of Bayfield County and the labor negotiator of Bayfield County have carried on extensive negotiations with General Drivers Local No. 345 of the International Brotherhood of Teamsters, and have arrived at'a settlement of a contract for the year 1975, NOW THEREFORE BE IT RESOLVED that the appropriate officers of the County of Bayfield enter into a contract with the Highway Union for the year 1975 which will provide for the following changes: 1. An overall wage increase of 40� per hour effective January 1, 1975, and an additional 10� per hour increase effective on July 1, 1975. 2. That the County pay all of the premium for hospitalization insurance for single employees and 90/ of the premium for married employees. 3. That the contract be amended to provide that negotiations may commence for a new contract . 90 days prior to the expiration of the contract year, rather than 60 days. 4. In all other respects; the contract be the same as the present contract for the years 1973 and 1974. S. The contract for the year 1975 will be for a period of one year. The following communication was read: No. 5 UNITED STATE OF AMERICA FEDERAL POWER COMMISSION Before Commissioners: John N. Nassikas, Chairman; Rush Moody, Jr., William L. Springer, and Don S. Smith. Lake Superior District Power Company) Project No. 2444 ORDER REQUIRING MAINTENANCE OF RESERVOIR LEVEL AND ORDER TO SHOW CAUSE (Issued November 8, 1974) It appearing that: (a) On May.3, 1966 a license for Project No. 2444 was issued to Lake Superior District Power Company; (�) The Commission found the White River,'upon which Project No. 2444 is located, to,, be navigable, and a tributary to the Bad River; (c) Licensee has without -authorization from the Commission raised the flood gates of the project and drained the reservoir for Project No. 2444; (d) This unauthorized action by Licensee has exposed a silted and sedimented portion of the reservoir area subjecting it to erosion and consequent siltation of the stream and stream bed below the project; (e) The Licensee has not responded to the recommendation of the Chicago Regional Engineer that a pool elevation be maintained to cover or inundate the silt deposits above the dam in -order to minimize erosion effects; (f) The Licensee is in violation of Article 9 of its license in that it has not obtained proper authorization from the Commisson=to abandon the project; (g) The Licensee is in violation of Seeti.on 10(c) of the Federal Power Act requiring it to maintain project works. The Commission, on its own Motion, orders that the Lake Superior District Power Company shall: (1) Immediately close the flood gates of the dam at Project No. 2444 and maintain the project reservoir at a level sufficient to minimize erosion; and (2) Show cause, if any there be, on or before December 9, 1974, why the reservoir should not continue to be maintained at a reasonable level until proper authorization to abandon the project is obtained from the Commission in accordance with the terms of the license. Washburn, WI 54891 Dear Mr. Pajala: Under Chapter 59.87L (l) of Wisconsin Statutes, many county board appropriate money for Bee Disease Control (Apiary Inspection) each year to encourage,and protect the -beekeeping industry in their respective counties. The Wisconsin Department of Agriculture `is charged with bee disease control work. It is necessary that we know the amount of such appropriation so as to plan our work in your county for 1975. An occupational tax of 25 cents per colony of honey bees is collected, 75 per cent of which is to be returned to the State Treasurer in the same manner as state taxes,on personal property are paid. It is also important that we 'know the amount of occupational bee tax collected. A self-addressed postal card is enclosed for your convenience in replying. The following resolution was read: No. 10 WHEREAS, personnel of the University of Wisconsin - Extension Arts Center have proposed that each county arrange for a local artist to paint an historical painting to be exhibited at Madison during the opening of the Bicentennial Celebration, and WHEREAS, it is proposed that after the Madison exhibition the paintings would be returned to their respective counties for permanent exhibition, and WHEREAS, it t estimated that the painting would cost approximately $650, one-half of said amount to be funded through grants for that purpose, and February 11, 1975 WHEREAS, the Executive Committee of the Bayfield County Board is of the opinion that Bayfield County should participate in this program, and WHEREAS, the committee further believes that such a painting would be desirable to exhibit in the County Board Room after it is returned to Bayfield County, NOW THEREFORE BE IT RESOLVED, that the Executive Committee of the Bayfield County Board be authorized and directed to select a resident of Bayfield County to do a painting for the above mentioned purpose, and BE IT FURTHER RESOLVED, that a sum sufficient be transferred from the Contingency Fund to the Courthouse Outlay account to finance said project. WHEREAS, the secretary in the Office of the Civil Defense Director was employed on a one- half time basis in 1974, and WHEREAS, the workload in that office is heavy enough to require additional secretarial time, and WHEREAS, 50/ of the salary of the secretary in the Civil Defense Office is reimbursed by the State, and �} WHEREAS, additional funds have been included in -the 1975 budget of the Civil Defense Director to cover the County share of said salary, NOW THEREFORE BE IT RESOLVED, that the secretary in the Civil Defense Office be employed v on an 80% basis, and v i BE IT FURTHER RESOLVED, that the Civil Defense Director be authorized to determine the number of hours per day and/or the number of days per week that said secretary shall be employed, and BE IT FURTHER RESOLVED, that this resolution shall be effective January 1, 1975. WHEREAS, Emma Pearson has been employed in the Bayfield County Extension Office as a part-time employee for several years, and WHEREAS, the 1975 budget as adopted by the County Board in November 1974 provided for funds to employ Emma Pearson on a full-time basis, and WHEREAS, the workload in the Extension Office requires another full-time employee, NOW THEREFORE BE IT RESOLVED, that Emma Pearson be hired on a full-time basis in the Extension Office with the classification of Extension Clerk at the maximum rate of pay for that position subject to any over-all increases granted by the County Board, effective January 1, 1975. WHEREAS, the present rate of reimbursement for Bayfield County employees for use of their personal automobiles on county business is 12� per mile, and WHEREAS, the cost of operation of an automobile has increased substantially since the 12� per mile rate was adopted, and � , , �-P, R-- F) February 11, 1975 WHEREAS, there are indications that the cost of gasoline will continue to rise, further increasing the cost of operation of an automobile, NOW THEREFORE BE IT RESOLVED, that the reimbursement rate for the use of an employees I personal automobile.on county business by Bayfield County employees shall be set at 15� per mile, effective February 1, 1975, and BE IT FURTHER RESOLVED, that a reimbursement factor based on the average pump price of regular gasoline will be applied to an employee's total mileage for the month as an add -on to the regular mileage reimbursement rate. Determination of this add -on factor will be made on a quarterly basis by the county clerk by averaging the regular grade pump prices of, at least 6 major brand suppliers in the county chosen at random. This add -on factor shall be posted in the County Clerk's office. The following resolution was read: No. 14 WHEREAS, an error was made in the preparation of the 1975 Budget for the County Agricultural Agent, and WHEREAS, said error was in the salaries of the stenographers employed in the said Agricultural Agent's office, and WHEREAS, said budget of the Agricultural Agent should reflect the true and correct salaries as paid to the said stenographers employed in the office of the Agricultural Agent, now ! therefore be it RESOLVED, that the County Clerk is hereby authorized and directed to adjust said budget as it pertains to the said stenographers in said office in an amount equal to the error that was made in said budget, and be it further j RESOLVED, that said budget shall be further adjusted to reflect any increases in salaries approved by the county board, and be it further RESOLVED, that a sum sufficient to make said adjustment shall be transferred from the Contingency Fund to the County Agricultural Agent budget. The following communication was read: No. 15 Iron River, WI Jan. 29,.1975 Bayfield County Board Courthouse Washburn, WI Gentlemen: Iron River has recently organized themselves for a concentrated drive against inefficiency in various governmental units, and the constantly raising the real estate burden, which is rapidly approaching confiscation. The second meeting of C R Y, CITIZENS REVOLT YEAR, was held January 28 at the Rebekah Hall, in Iron River. This -meeting was called for the purpose'of discussing two important subjects: 1. The possible building of a new jail, at Washburn, by the County Board of Bayfield County, and 2. The increased cost in the administration of the County Welfare Program. Mr. William Carter, member "of the County Board of Bayfield, was present and described the problems as they stand at this time. He covered both topics from an informational point of view. Mr. Charles Polich, of the Bayfield County Taxpayer's Alliance, presented the group with the hostorical background of the jail problem. I . Both men also spoke of the various alternatives, which will face the Bayfield County Board, when they next convene on February 11. A full and spirited discussion followed, the presentations and the following statements, of belief, were carried unanimously: February 11, 1975 1. That, if the County Board, at their next or following meetings vote in favor of a new jail, they will, by their own motion, call for a county wide referendum, and, 2. Johnson to receive and place on file. Motion carried. The following communication was read: No. 16 BAYFIELD COUNTY TAXPAYERS ALLIANCE Route #1, Washburn, Wisc. 54891 2-11-75 To: Bayfield Co. Bd. of Supervisors From: Bayfield County Taxpayers Alliance The Bayfield County Taxpayers Alliance wish to register a formal protest and objection in the matter of building a new county jail. The Alliance has already registered objections at two prior county committee meetings. Said objections are a matter of record. We wish to reiterate again that the obvious economic plight of the Federal and State Governments and the pleas by the President of the United States and by the Governor of Wisconsin that economy and austerity must be practiced by all civil units; that to construct a new jail would indeed be contrary to the harsh cold facts of our present economic condition - and that all indications point to even a further deterioration of the economy. We earnestly request that the board take the appropriate legal steps to institute the nechanics necessary in putting the issue to a referendum so that the voters may decide by a truly Democratic process. 0 Sincerely yours, Bayfield Co. The following resolution was read: No. 17 WHEREAS, Bayfield County is required by law to provide a jail facility meeting State standards for detention of prisoners, juveniles, the mentally ill and other non -criminal citizens, and WHEREAS, The present jail facility does not meet required standards and is in a dilapidated condition, due primarily to the age of the building, and WHEREAS, Following reports from -the State Department,of. Social Services.that provis"don must be made by the County to correct such deficiencies or, in the alternative, to contract with other counties for the detention of such prisoners, juveniles, mentally ill, and other non -criminal persons, and February 11,: 1975 WHEREAS, The County Board and the Committees thereof have had under consideration the i replacement of.said jail structure during the past five years, and WHEREAS, After extensivQ-deliberations and exploration of the short and long term benefits f to County government, it has been determined that the construction of a new jail would be the f most advisable course to follow, and WHEREAS, As a result of such determination, the Sheriff's Committee of this Board of Supervisors has engaged an architectural firm to prepare preliminary plans for such construction, together with estimates of the cost thereof, and WHEREAS, At a meeting of said Committee held at the Court House on February 5, 1975, it was unanimously agreed by the voting members of said Committee that a recommendation be made to the Board of Supervisors of Bayfield County that the County proceed with the construction of a new jail facility, at a cost of approximately $450,000.00, as estimated by the architectural firm preparing said plans, NOW -THEREFORE BE IT RESOLVED, That the Sheriff's Committee of this Board of Supervisors, together with the Executive Committee and the appropriate County officers of Bayfield County be and they are hereby authorized to proceed with said jail construction project and to do and complete all necessary procedures to the point of advertising forbids for said construction,and BE IT FURTHER RESOLVED, That upon receipt of bids pursuant to said advertisement, the Sheriff's Committee shall meet, consider said bids and make recommendations to the Bayfield County Board of Supervisors for further action by said Board as may be appropriate. Johnson, seconded by Rude that the County Board adjourn and open the meeting to the public for discussion of the matter. Motion carried. About 25 interested taxpayers were present at the meeting and comments were made by the - following persons. Harry Randall Charles Anderson Harold Schultz George Funk E'.• W. Peake Merton Heuer Charles Polich Frank-Keena All of the comments which were made by the above mentioned taxpayers were in opposition to constructing a new jail at the present.time.. The opinions expressed by many who spoke was that the present economy was:such that no.large expenditures should be made by the county unless absolutely necessary. It was suggested by some of the speakers that the county should consider minimal alterations to the present facility and possibly the detention of prisoners in some other jail. MOTION NO. 18b f Moved by Rude, seconded by Erickson that the Board go back .into County Board session. Motion carried. Resolution No. 17 was again read to the Board and to interested persons present. 390 February 11, 1975 Moved.by A. Hanson, seconded. by Bromberg to table the foregoing resolution. After further discussion Bromberg withdrew her second to the motion to table. For lack of a second to the motion the chair declared the motion to table lost. Sheriff Frechette was present and answered several questions by the Board members relative to the present jail. Moved by Hoagland, seconded by E. Johnson to adjourn for lunch. Motion carried. Cliff Hoagland spoke on the need,for a new jail facility. County Clerk, Edward A. Pajala, at the request of Cliff Hoagland,presented the Board with information relative to the present financial condition of the county and the proposed methods of financing the construction of a new,faci.lity. He stated that the county presently had avail- able,approximately $225,000.00 which could be used for the construction project. The balance of the estimated $450,000.00 to $500,000.00 would have to be raised by either the sale of additional forest products or land or possibly short term borrowing. She spoke in regard to the Bicentennial J Celebration and stated that she had been requested by various persons and officials to participate in planning for the Bicentennial Celebration. She was of the opinion that it would be more feasible for Ashland and Bayfield Counties and other area governmental agencies to work together on the project, The purpose of the project would be to commemorate the Bicentennial of the American Revolution by collecting the heritage of the Chequamegon Region. This could be done in either book form or a film. Miss Tone stated that a contribution of $5000 from each of the two counties would very likely be sufficient to finance the project. She proposed that a joint committee from Ashland and.Bayfield Counties be appointed to be in charge of the project with expenditures to be made by the authorization of said committee. Moved by W. Johnson, seconded by Anderson to transfer from the Contingency Fund, $5000 into a non -lapsing fund over a 2 year period for support of the -Bicentennial Project to be used -at the discretion of the Executive Committee.
