MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
APRIL 15, 1975
The meeting was called to order at 9:45 A.M. by Walter C. Barningham, County Board
Chairman.

Gentlemen:
In reference to the Resolution for a storage building which is being presented by the
Highway Committee, I offer the following reasons for its adoption.
There is a definite need for a storage building at the Highway Garage in Washburn. Many
pieces of expensive equipment are standing outside with only canvas or polyethelene covers
for protection. These covers have, at times, been torn off by high winds and as a conse-
quence our machinery has been damaged by the elements.
Vandalism takes a toll on county machinery stored outside. Lights, windows and windshields
are broken. Fuel tanks and other filler pipes are sometimes filled with sand.
A recent example supporting the need for covered storage occurred during the blizzard of
- March 25 of this year, when we were forced to put the four wheel drive Oshkosh into service.
This very large vehicle, because of our present limited storage, has to stand outside. To
get the Oshkosh into the garage, prepare it for service, plus the time lost to other machines
cost $403.67.
This is only one example. There are many more minor incidents, not only in Washburn, but
at outlying garages as well, which, added together are a high annual cost. It is usually

j the largest, and, therefore, the most expensive equipment, which has to be left outdoors.
The need, at this time, is for a building approximately 55' x 110' x 14'. This size would
enable us to get most of the high priced equipment under cover, protected from the elements
and vandalism. We also hope it would avoid the possibility of accidents should anyone be
hurt while playing on or attempting to vandalize the equipment.

The projected cost of this size and type of building for storage would be approximately
$10,000.00, to be paid for from the Highway Machinery Fund.

BE IT RESOLVED by the Bayfield County Board of Supervisors, assembled in session this 15th
day of April, 1975, that the County Highway Committee be authorized and directed to take all
necessary steps, or actions, in connection with preparing plans and constructing a storage
building near the County Highway Garage in Washburn.
BE IT FURTHER RESOLVED, that all costs in connection therewith be paid from the building
account of the County Highway Machinery Fund.

The clerk called to the attention of the Board and interested citizens assembled there the
fact that the Board Room has now been remodeled with the jury box and judges bench removed and
new tables and chairs have been installed and new carpeting laid on the floor. He also pointed
out to the assembly that discussions have been had in the past in regard to installation of a
sound system in the r9om and he inquired whether the Board and others present were able to hear
the conversation or whether it appeared to be necessary to install a sound system. Members of the

Board indicated that they were not having trouble in hearing the chairman or the clerk or other
members speak, but several of the visitors seated to the rear portion of the room stated that
they were having difficulty in hearing the proceedings. No further action was taken and
no recommendations were made.

Lake Superior District Power Company ) Project No. 2444
ORDER REQUIRING CONTINUED MAINTENANCE
OF RESERVOIR LEVEL AND OPERATION OF
TAINTER GATES TO PASS FLOOD FLOWS
(Issued March 21, 1975)
Motion carried.
Lake Superior District Power Company is the Licensee for White River Project No. 2444
1/ located on the White River in the vicinity of the City of Ashland, Ashland County, Wis-
consin. On August 19, 1974, Licensee drained the project reservoir for the purpose of
inspecting the project works and carrying out minor repairs. As the reservoir was lowered,
the wood stave penstock leading from the project dam to the powerhouse collapsed, thus
rendering the project temporarily unusable for power production purposes,_ The reservoir
was not subsequently refilled.
As a consequence of the complete drawndown of the White River Project reservoir, deposits
of silt and sediment which had accumulated behind the dam were exposed to the erosive effects
of run-off and of the White River, resulting in turn in the transport of silt and sediment
to the river and river bed below the project.
Cognizant of the potentially damaging effects of such transport of silt and sediment
downstream, we issued an order on November ®, 1974, directing Licensee to "(i)mmediately close
the floodc�_gates of the dam at Project No. 2444 and maintain the project reservoir at a level
sufficient to minimize erosion," and to "(s)how cause, if any there be, on or before December
9,

1974, why the reservoir should not continue to be maintained at a reasonable level until
proper authorization to abandon the project is obtained from the Commission in accordance
with the terms of the license."
In compliance with the above -mentioned order, Licensee lowered the two tainter gates at
gat_
the project dam on November 9, 1974. The right,was lowered completely, with the bottom of
the gate resting on the sill. The left gate, which is a split gate, was set,with the 19-foot
lower leaf on the sill and the 7-foot upper leaf raised, leaving an opening of approximately
4.5 feet between the leaves. The penstock intake was sealed off. Under this mode of operation

the reservoir has since been maintained at a level about three feet below normal pool, with stream
flows passing over the lower leaf of the left gate.
On November 26, 1974, Licensee filed, in accordance with Part 6 of the Commission's
I
Regulations under the Federal Power Act, 2/ an application for surrender.of its license for I
Pooject No. 2444. In this application Licensee alleges that it is not economically feasible
to rehabilitate the project for power production purposes. The economic feasibility of such
rehabilitation is currently under study by the Commission staff.
The Commission received several letters of comment from interested persons and organizations
in response to the order of November 8, 1974. Included in all of these letters were recommendations
that the reservoir level be maintained until studies could be carried out on the probable impact
of downstream transportation of silt and sediment that could result from permanent draining of
the reservoir. Entities submitting letters of comment included the United States Department of
the Interior, Bureau of Indian Affairs; the Bad River Tribal
S
2/ 18 C.F.R. S6.1 et seg.
Council, 3/ through its attorneys; the Northern Environmental Council; the Environmental Policy
Center; the Sigurd Olson Institute of Environmental Studies of Northland College; and C. Mike
Polich, apprivate citizen.
On December 9, 1974, Licensee filed its answer to our order to show cause. In this answer,
Licensee alleges that, historically, the tainter gates at the project were not operated during
the winter months. Normal river flows were passed through the penstock to the project turbines
for.the production of power. The only water -flowing past the gates was due to leakage. This
leakage would result in a build-up of ice around the gates which would require several weeks of
work to remove in order to free the gates in time to accommodate the spring run-off. Once freed,
the gates could be raised as necessary to pass excess spring flows.
Under the present mode of operations, Licensee is concerned that the water passing over the
lower leaf of the left tainter gate will cause considerable spray and splashing, which will result
in turn in ice accumulations of unprecedented magnitude. Licensee alleges that this ice build-up
could create conditions which could not be overcome in time to accommodate the normal spring run-
off. If the gates could not be opened in time, avers Licensee, over -topping of the dam proper may
occur, with consequent structural damage to the dam itself.
Licensee also alleges in its answer that the mist and spray from the falling water may cause
hazardous road conditions on State Trunk Highway 112, which crosses the White River over the project
dam pursuant to an agreement between Licensee and the Wisconsin State Highway Commission.
In order to investigate the allegations in Licensee's answer to our order to show cause,
members of the Commission

Tribal Council has alleged that the draining of the reservoir in August, 1974, detrimentally
affected its interests in trapping, fishing, and the harvest of wild rice and wild canberries,
and is concerned lest future abandonment of the project and permanent draining of the reservoir
lead to further adverse impacts.

staff conducted an inspection of Project No, 2444.on.January 16 and.17, 1975. The staff
found that, while there was indeed a considerable quantity of ice which had.accumulated
around the left gate�as.a result .of the water passing over the lower leaf, the right gate
remained relatively unaffected, with only minimal ice build-up due to apparent leakage.
The staff also noted the presence at the dam of an oil-fited steam plant and steam piping,
which has been used, and is available, for de-icing the gates in the spring. At the time
of the inspection, there was -no evidence of hazardous road conditions on State Trunk -Highway
112 due to freezing mist and spray from the project.
Spring break-up floods on the White River generally occur;a.around and during the month
of April, and average about 30 days in duration. Based on United States Geological Survey
data, the magnitude of the spring floods averaged 1,520 efs during the 1966-72 period. The
maximum spring flood of record occurred on April 24, 1960, with a peak flow of 4,630 cfs.
With the tainter gates of Project No. 2444 at their present setting, average spring
flood flows could be passed between the upper and lower portions of the left gate. With
the left gate at its present setting, and -with the right gate freed of ice and in operating
condition, much greater flows could be passed. In view of the minimal ice accumulations on
and around the right tainter gate, and the presence at the site of functioning steam
equipment for the de-icing of said gate, Licensee has the apparent ability, with due diligence,
to pass spring flood flows which may occur without substantially altering"the level of the
project reservoir.
j We therefore conclude that Licensee has failed to show cause why the reservoir of Project
No. 2444 should not continue to be maintained at"a reasonable level, sufficient to minimize
erosion and the transport of silt and sediment downstream, until the_Commission has reached a
determination on Licensee's application for surrender of license.
The Commission finds:
(1) Lake Superior District Power Company has failed to show cause why the reservoir of
White River Project No. 2444 should not continue to be maintained at a reasonable level,
sufficient to minimize erosion, as required.: by our order of November 8, 1974.
(2) Pending further order of the Commission, Lake Superior District Power Company should
maintain the reservoir of Project No. 2444 at a level sufficient to minimize erosion.
(3) Lake Superior District Power Company should operate the tainter gates, as necessary,
to pass spring flood flows at Project No. 2444 without substantially altering the level of
the project reservoir.
The Commission Orders:
(A) Pending further order of the Commission, Lake Superior District Power Company shall
maintain the reservoir of Project No. 2444 at a level sufficient to minimize erosion..
(B) Lake Superior District Power Company shall operate the tainter gates, as necessary,
to pass spring flood flows at Project No. 2444 without substantially altering the level of
the project reservoir.

WHEREAS, There is presently' assigned to Bayfield County only two State Traffic Officers, and
WHEREAS, The number of traffic deaths in Bayfield County over the past five years and the
number of traffic arrests made in said County correspond to statistics in comparable counties
having three or more traffic officers assigned thereto, and
WHEREAS, Traffic problems in Bayfield County continue to increase year by year due to accelera
development of recreational areas in all parts of the County, and
WHEREAS, It would be desirable and in the interest of safety and the protection of person
and property on the highways of this County to increase the number of State Traffic Officers
assigned to Bayfield County,
NOW THEREFORE BE IT RESOLVED, That a request be made through the -County Clerk to -the State
Department of Transportation for the assignment of at least one additional State Traffic Officer to
Bayfield County, effective not later than July lst, 1975.

WHEREAS, there is aggrowing need to increase the mobility of rural residents in Bayfield
and Ashland Counties who do not have reasonable access to alternate forms of transportation, and
WHEREAS, the Federal Aid Highway Act of 1973 has provided funds to carry out Demonstration
Projects for public mass transit on highways in rural areas, and
WHEREAS, the Northwest Community Action Agency is making application for Demonstration
Project funding in cooperation with the two Counties, Tribal Units and Communities, and
WHEREAS, the local municipalities, employers, service facilities and the general public
have expressed strong written and verbal support for the proposed Transit System, and
WHEREAS, the Executive Committee of the Bayfield County Board has reviewed the preliminary
Demonstration Project application and supports the intent of the proposal, and
WHEREAS, on Thursday, April 3, 1975, the Executive Committee passed a motion recommending
that $5000 be allocated to the Demonstration Project,
NOW THEREFORE BE IT RESOLVED that the Bayfield County Board of Supervisors approves
the commitment of $5000 to the Demonstration Project if the application is approved by the
Federal Highway Administration, -
BE IT FURTHER RESOLVED that Bayf ield County will consider -further support for the
Transit System after the expiration c' the Demonstration Period if its continuance is found
to be feasible and in the overall public interest.

The following resolution was read: No. 11
WHEREAS, the Bayfield City Dock is an important part of the transportation system between
Bayfield and Madeline Island as well as for the docking of recreation and other types of
ships and boats, and
WHEREAS, the dock has deteriorated to the point where it should be replaced in the near
future, and
WHEREAS, the total cost.of building a new dock is estimated at approximately $295,000 and
WHEREAS, if the building of a new dock is approved for funding by the Department of
Transportation, 70/ of its cost excluding engineering fees would be funded by the above
mentioned department, and

WHEREAS, the Upper Great Lakes Commission may or may not be able to finance approximately
10/ of the cost, and
WHEREAS, theCity of Bayfield will not be able to finance all the remaining costs of building
this facility, and
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board supply $5000.00 to help defray
part of the cost of building the new city dock.

WHEREAS, The Bayfield County Board of Supervisors on April 19, 1967, passed a Resolution
providing that all tax title lands owned by Bayfield County on Sa.i?d Island be withheld from sale
until further action of the Board, said action having been taken in contemplation of the develop-

ment of a Federal Park project, and
WHEREAS, It is deemed in the interest of Bayfield County to rescind said Resolution and I f
release said lands for sale through established procedures for�the sale of tax title lands,
NOW THEREFORE BE IT RESOLVED, That the aforesaid Resolution be -and the same is hereby
rescinded, and
BE IT FURTHER RESOLVED, That the Land Sales Committee is hereby authorized to offer said tax

Mr. Pat Miller, National Park Service; spoke to the Board in regard to county lands in the
Federal Park Service.
Mr.. Miller stated that if the county were to sell the lands within the exterior boundaries
of the park area to private individuals, it would delay by several years the acquisition of
the lands by the Federal Government, as most of the private lands have already been appraised
and negotiations to purchase have begun. The clerk raised the question of what the park service
was proposing that the county do with the lands if they objected to the lands being sold by the

County to private individuals. Mr. Miller stated that under the present law he believed
that the Park Service could not purchase lands from the County and, consequently, the only
way the Park Service could acquire the lands directly from the County would be through
donation by the County. Comments made by various members of the Board appeared to be in
opposition of the County donating the lands now owned by the County -to the Apostle Islands
Park Service.

STATEMENT OF THE NWRP&DC
concerning
HEALTH SERVICE AREAS
President.Ford recently signed P.L. 93-641, the "National Health Planning and Resources
Development Act of 1974". Under this new law, "health service areas" shall have a population
of not less than 500,000 nor more than 3,000,000. The law also states that in "highly
unusual circumstances" the population could be less than 200,000.
The combined population of the Northwest Area Comprehensive Health Planning Orgaii.tation
(NACHPO) is less than 125,000 and the Northwestern Wisconsin Regional Planning and Development
Commission (NWRP&DC) feels strongly that there are "highly unusual circumstances," which
makes it imperative that this organization remain in tact. Substantial local effort has gone
into organizing NACHPO. It would be highly inefficient to dissolve the existing organization
and reorganize a completely new service area council. Over 900 health care consumers,
providers and local governmental officials have been actively involved in healthcare systems
delivery in NACHPO's present area. The operation is running smoothly and if it must be
increased to 500,000 people or even 200,000 the size of the area, would virtually eliminate
local participation or at least make it extremely fragmented. -
The NWRP&DC, therefore, goes on record in support of maintaining the present NACHP0
district and organizational structure as the PL 93-641 health service area and health system
agency, and urges Governor Lucey and the Secretary of HEW, U.S. Senators Nelson and Proxmire,,
and U.S. Congressmen from Wisconsin to recommend and approve this request.

WHEREAS, salary increases were granted to county non -represented employees at the
February llth meeting, and
WHEREAS, the amount of the anticipated increase that would be granted was:not known
at the time of adoption of the budget for 1975, and
WHEREAS, a sum sufficient to allow adjustment of the various budgets due to salary
increases has been placed in the Contingency fund, now therefore be it
RESOLVED, that the County Clerk be authorized to adjust each of the department budgets
affected by the salary increases granted on February 11, 1975 by transferring from the said
Contingency fund an amount equal to the total cost of the salary increase to -said department
budgets.

Bayfield County Board of Supervisors did, during the County Board proceedings on February 11,
1975, turndown a. proposal to replace the existing jail facility.
I am certain you are aware that this agency has, over the past nine years, been concerned in
regard to the inadequate facility and non-compliance with Statutory and Code requirements.
Therefore, acting in accordance with Section 46.17 of the Wisconsin Statutes, the following
restrictions relating to the confinement of persons in the Bayfield County Jail shall be
complied with immediately:

WHEREAS, Bayfield County'is required by law to provide a jail facility meeting State
standards for detention of prisoners, juveniles, the mentally ill and other non -criminal
citizens, and
WHEREAS, The present jail facility does not meet required standards and is in a. dilapidated
condition, _due primarily to the age of the building, and
WHEREAS, Following reports from the State Department of Social Services that provision must
be made by the County to correct such deficiencies or, in the alternative, to contract with
other counties for the detention of such prisoners, juveniles, mentally ill, and other non-
criminal persons, and
WHEREAS, The County Board and'the'Committees thereof have had under consideration the
replacement of said jail structure during the past five years, and
WHEREAS, After extensive deliberations and exploration of the short and long term benefits
to County government, it has been determined that the construction of a new jail would be the
most advisable course to follow, and
WHEREAS, as a result of such determination, the Sheriff's Committee of this Board of
Supervisors has engaged an architectural firm to prepare preliminary plans for such construction,
together with estimates of the cost thereof, said cost estimate being in the approximate amount
of $450,000,00,,
NOW THEREFORE BE IT RESOLVED, That the Executive Committee of this Board of Supervisors,
together with the Sheriff's Committee and the appropriate County officers of Bayfield County
be and they are hereby authorized to proceed with said jail construction project and to do and
complete all necessary procedures to the point of, and including, advertising for bids for
said construction, and
BE IT FURTHER RESOLVED, That upon rece}t of bids pursuant to said advertisement, the

Dear Sir:
As you are probably aware, the Wisconsin State Senate just recently passed Senate Bill
61. This bill, which I have authored, would allow the County Boarcb of Wisconsin the
opportunity by a two-thirds vote to veto any DNR land purchase of forty acres or more.
I am sure you realize the.impo.rtance of this legislation in light of the fact that the
state is continually buying up lands in our counties without local self-determination. This
problem precipitates a loss of tax base and results in the displacement of people, homes and
farms in Wisconsin. I certainly am not against all DNR land purchases, but I do feel that
the Department of Natural Resources should have to justify to the County Boards where purchas

are being made, the validity of these purchases in the first place.
My purpose in contacting you today is to encourage you to express your views to the appro-
priate individuals considering this legislation. Senate Bill 61 is presently in the Assembly
Committee on Natural Resources. The Chairman of the Committee is Representative Lewis Mittness.
Other members of the committee include. Laurence Day, Harland Everson, EdwardJackamonis, Mary
Lou Munts, Thomas Murray, Francis Lallensack, Marcel Dandeneau, Donald Hasenohrl, Gordon
Bradley, Lloyd Kincaid, Cloyd Porter and Alan Lasee.
I am sure that letters or resolutions from you and your.County Board members would be
encouraging in securing final legislative passage of this important.proposal. Certainly your
cooperation and assistance on this matter would be greatly appreciated.
