Barningham, County Board Chairman. The following members answered roll call:, No. 1 Edwin Erickson, Arthur Meierotto, Ila Bromberg, Eric Johnson, Clifford Hoagland, Beanie Rude, Herbert Spears, Wallace Johnson, Ernest Heglund, Arthur Hanson, Carl Anderson, ,Joseph.Berweger, Stephen Barry, Edwin Renoos, Walter,Ba.rningham. Absent: Peter Hanson, Larry Seidel,"William Carter present 15 absent 3 Total 18 A prayer was led by Pastor Ronald Hanson, Messiah Lutheran Church, followed by the pledge of allegiance. Moved by Meierotto, seconded by Erickson to dispense with the reading of the minutes of the previous meeting. Motion carried. The following communication was read: No. 2 TOWN OF DELTA June 27,1975 Bayfield County Board Washburn, WI 54891 Gentlemen: The Town Board of Delta has passed a resolution that they are against the Dept. of Natural Resources acquiring any more acreage, in the township of Delta. Respectfully submitted, Elizabeth Visocky, Delta Clerk Moved by Spears, seconded by Bromberg to receive and place on file. Wayne Gibson and William Weiher of the DNR in Brule were present and each made a few brief comments relative to the letter and answered several questions raised by the Board. Motion carried. No. 3 Chairman Barningham and Cliff Hoagland, Chairman of the Civil Defense Committee, presented Gary Gylund, Civil Defense Director, a certificate for attending a Civil Defense Seminar. August 5, 1975 445 The following communication was read: No. 4 TRAPP & ROTH Attorneys at Law Brookfield, Wis. 53005 July 10; 1975 County Board Bayfield County Cable, Wisconsin Gentlemen: Please be advised that this office has been retained by and _does represent Donald and Dorothy Pekel, who own real estate in your tax district. A copy of his deed is attached to more specifically identify this married couple's joint property interest. The Pekels specifically protest the present 1974 tax assessment of their unimproved, inaccessible lot in the amount of approximately $96.00. They wish to present what they feel is substantial evidence indicating the assessment discriminatorily levied at a rate substantially in excess of rates applied to like parcels of unimproved real estate in other tax districts contiguous to your own, as well as other properties, apparently held by local residents, within your district. Though the Pekels are reasonably prepared to present their claim to you, it appears that there is no method of doing so, other than to attend the yearly meeting in Cable of the County Board, and personally present their grievances. Such an archaic mechanism for seeking property tax relief quite obviously favors the local full-time residents of your County over the persons, such as our clients, who have purchased the land as an investment and live hundreds of miles away. Clearly, there must be a. means by which our affidavits and proofs can be submitted to you for review without the need of mooting the issue by incurring transportation -costs in ' excess of the disputed amount. If no such alternate method. is available, then there is good reason to suspect that the annual assessment meeting is no more than an arbitrary and capricious pretext to tax at exorbitant and discriminatory rates the -many "absentee" owners who own real property located in your County. If this be true, then your assessment actively, by its method of redress, is in violation of Article 8, Section 1 of the Constitution of the State of Wisconsin, and, to an even greater degree, the due process clause of the Fourteenth Amendment of the United States Constitution. There is no compelling state interest of any sort which can justify providing a virtual monopoly to resident property owners over the access to government machinery which could provide tax relief; this to the virtual exclusion of all but the most frivolously wealthy investment owner living any appreciable distance from Cable. You may consider this letter as a demand for the creation and placement in operation of a bureaucratic system which can effectively handle, by mail preferably, the'claims of non- resident property owners for assessment tax relief. Hanson that the County Board go on record in supporting the officials of the.Town of Delta in their efforts to stop the DNR from acquiring more lands in the Town of Delta. A roll call vote was taken on the adoption of the foregoing motion with the following results: No. 5a Ayes - Erickson, E. Johnson, W . Johnson, A. Motion #5B 4: Moved by Spears,seconded by Renoos that the County Board refer the matter to the Forestry G� Committee for further study and that the committee prepare an appropriate resolution to be presented to the County Board at a future meeting. Motion carried. 5, 1975 The following communication was read: No. 6 TOWN OF BARNES Solon Springs, WI June 25, 1975 Jacob Heinlein Bayfield Co. Zoning Administrator Washburn, WI 54891 Dear Sir: The Town Board of the Town of Barnes requests and recommends the following two changes in zoning: 1) That part of Lot 5, Section 15, T. 44N., R. 9W, lying south of the Eau Claire River and north of the road (driveway) to Hargrave cabin on the west side of Highway 27 from Commercial to Residential Recreational; and to decrease the depth of the belt of commercial property from 400 ft to 300 ft in the above Government Lot 5. August 5,, 1975 The following Report of the Bayfield County Zoning Committee was read: No. 8 TO: The County Board of Supervisors of Bayfield County on the hearing on the petitions to amend the Bayfield County Zoning Ordinance. The following resolution was read: No. 10 WHEREAS, Bayfield County is the owner of certain tax title lands on Sand Island located in said Bayfield County, and WHEREAS, Sales of said tax title lands are presently held in abeyance by previous action of this Board, and WHEREAS, It is deemed in the interest of Bayfield County to release said tax title lands for sale under the direction of the Executive Committee and through the usual procedures for such land sales now existing, NOW THEREFORE BE IT RESOLVED, That tax title lands located on Sand Island belonging to Bayfield County may -be offered for sale as -determined by the Executive Committee under the established procedure for tax title land sales, notwithstanding any previous directive of this Board. The following resolution was read: No. 12 WHEREAS, it is of vital importance that the law enforcement officers have radar equipment to assist them in traffic control, and WHEREAS, the radar equipment which the Bayfield County Sheriff Department uses at the present time is obsolete and not in operating condition, and WHEREAS, it would be difficult and costly to repair the equipment, and WHEREAS, the cost of new modern radar equipment suitable for the Bayfield County Sheriff Department would be approximately $2,000.00, now therefore be it RESOLVED, that the Sheriff Commission of Bayfield County be authorized to purchase new radar equipment at an approximate cost of $2,000.00. Mni-i nn l 7a Moved by Rude, seconded by Berweger that $2,000.00 be transferred from the Contingency Fund to the Sheriff's Outlay account to finance the purchase of new radar equipment. Motion carried. The following resolution was read: No. 13 WHEREAS, The Bayfield County Board of Supervisors during the year 1967, passed a resolution in reference to authorizing a lease arrangement to be entered into between Bayfield County and the Iron River Lions Club, permitting certain Bayfield County property described as the SW-1-4 of the SEµ of Section 1, Township 47 North, Range 9 West, to be used under said lease arrangement for Boy Scout activities, and WHEREAS, Said arrangements were not fully concluded by the proposed lessee, and WHEREAS, Said lease arrangement should be fully reconsidered by this Board of Supervisors in the event an interest is shown by said Club in the future to follow through on said agreement, and WHEREAS, Said reconsideration would be more appropriate upon condition that the said previous resolution passed in 1967 is rescinded, and F6�61 750 August 5; 1975 WHEREAS, It is deemed in the interest of Bayfield County to rescind said resolution and fully reconsider said lease arrangementl,,as required, NOW THEREFORE BE IT RESOLVED, That the aforesaid resolution passed by this Board of Supervisors during the year-1967, relating to the SW4 of SEµ of Section 1, Township 47 North, Range 9 West, Bayfield County, Wisconsin, recorded in Volume 12 of Records, page 436-7 be and the same is hereby rescinded. Communications regarding easements to the Great -Lakes Gas Transmission Company were presented to the Board: No. 14 Moved by A. Hanson, seconded by E. Johnson to receive and place on file. The following resolution was read: No. 15 WHEREAS, Great Lakes Gas Transmission Company has made application to the Bayfield County Board of Supervisors for an easement to maintain a gas pipe line over and across the Northeast Quarter of Southwest Quarter (NE4 of SW-), Section Thirty-four (34) , Township Forty-eight (48) West North, Range Eight (8), Bayfield County, Wisconsin, and WHEREAS, The consideration for the granting of said easement in the amount of One Hundred Dollars ($100.00) has been Edvanced to said Bayfield County, and WHEREAS, The provisions contained in said proposed right-of-way easement agreement adequately protect Bayfield County, said easement containing all of the provisions required by established policy of Bayfield County and contained in a form known as Easement Schedule A, NOW THEREFORE BE IT RESOLVED, That the proposed right-of-way easement agreement by the said applicant and Bayfield County be and the same is hereby approved in the form and with the conditions as set forth in a photostatic copy of said easement agreement attached hereto andmade a part of this Resolution, and BE IT FURTHER RESOLVED, That the Bayfield County Clerk is hereby authorized and directed to execute said easement on behalf of Bayfield County and to deliver the same to said Great Lakes Gas Transmission Company. The following resolution was read: No. 16 WHEREAS, Resolution No. 62, adopted by the Bayfield County Board on November 12, 1970, made provisions for payment of 50% of unused accumulated sick leave to county employees upon terminat of employment and also provided that 50/ of the unused accumulated sick leave shall be paid to the estate of an employee upon death of the employee, and 51 August 5, 1975 WHEREAS, item 9, page 15 of the Personnel Policy adopted by the County Board on July 30, 1974 also makes provisions for payment of 50% of unused accumulated 'sick leave to be paid to employees due to lay-off, resignation or any other voluntary termination, but makes no reference to termination due to death of the employee, and WHEREAS, it is the belief of the Personnel Committee that this item was inadvertantly omitted from the policy adopted on July 30, 1974, now therefore be it RESOLVED, that item 9, page 15 of the said Personnel Policy be amended to read "Upon termination of the employment of any employee due to death, lay-off, resignation or any other voluntary termination, 50% of the unused accumulated sick leave will be paid to the employee or estate of the employee. Payment will be based on the regular rate of earnings of,the employee at the time of termination. If the employee is dismissed for cause such as intoxication, insubordination, etc., it shall be the duty of the Personnel Committee to determine if unused sick leave benefits will be paid." To properly establish, lay out, widen, enlarge, extend, construct, reconstruct,, improve, or maintain a portion of the highway designated above. It is necessary to relocate or change and acquire certain lands or interests in lands as shown on the right of way plat for the above project. To effect this change, pursuant to authority granted under Sections 83.07 or 83.08, Wisconsin Statutes, the Bayfield County Highway Committee hereby orders that: 1. The said highway is hereby laid out and established to the lines and widths as shown on the plat. 2. August 5, 1975 No. 18 Mr. Bob Visocky, representing the Ashland Chamber of Commerce, was present and requested a contribution from Bayfield County to help finance the prin-Chg of a booklet on a scenic tour of the Chequamegon Bay area. Copy for the booklet is being prepared by Northland College, Ashland. Moved by Anderson, seconded by E. Johnson to deny the request for any funds. Motion carried. Moved by E. I i The following resolution was read: No. 2 WHEREAS, Bayfield County is required by law to provide a jail facility meeting State standards for detention of prisoners, juveniles, the mentally ill and other non -criminal i citizens, and WHEREAS, The present jail facility does not meet required standards and is in a dilapidated condition, due primarily to the age of the building, and WHEREAS, Following reports from the State Department of Social Services that provision must be made by the County to correct such deficiencies or, in the alternative, to contract i j with other counties for the detention of such prisoners, juveniles, mentally ill, and other - I I non -criminal persons, and . i WHEREAS, The County Board and the Committees thereof have had under consideration the replacement of said jail structure during the past five years, and WHEREAS, After extensive deliberations and exploration of the short and long term benefits 1 to County government, it has been determined that the construction of anew jail would be the I I. most advisable course to follow, and WHEREAS, The Sheriff's Committee of this Board of Supervisors has engaged the services of an architectural f-irm which has prepared plans for such construction and bids for such con- struction have been received and reviewed by the Executive and Sheriff's Committees of this Board, and WHEREAS, The low bids for the construction of said jail with a canopy between the jail and the present Courthouse and an elevator are as follows: General construction, $333,996.00; Canopy, $9,500.00; Elevator, $14,886.00; Electrical, $64,694.00; Elevator wiring, $150.00; l Conbined mechanical, $79,000.00; and that the total of such low bids is $502,226.00, {(� NOW THEREFORE BE IT RESOLVED, That the County Board accept the low bids as set forth above and proceed with the construction of said jail facility,in accordance with the plans.and I specifications submitted by the architect. { C. Johnson to adopt the foregoing resolution. 1 I 1 i August 19, 1975 The chairman declared the County Board meeting recessed and stated that a public hearing would be held to allow interested county residents present to voice their opinion on the matter of construction of a new jail. About 75 to 100 people were present.With the exception of one person, all those who voiced E their opinion were opposed to the construction of a new jail and many who spoke suggested that the County Board should order a public referendum to be held on the matter. All those present were allowed to speak and following the hearing a motion was made by W. Johnson and seconded by Carter to reconvene as a County Board. Motion carried. Edward A. Pajala, County Clerk, read the following petition which was filed in his office on Monday, August 18, 1975. August 18, 1975 Mr. Walter Barningham Chairman of the Board Bayfield County Board of Supervisors Courthouse, Washburn, WI 54891 Dear Mr. Barningham: Attached, please find "Petition Papers", of one hundred and forty signatures of people in District Number Three, which reads as follows: "I, the undersigned, a qualified elector of District No. 3, (three), consisting of the town of Clover, Orienta, Oulu, and Port Wing, of Bayfield County, State of Wisconsin, am in protest of )� the building of'a new jail in the aforesaid county, inasmuch, as the tax burden is presently great enough, and that we the taxpayers, pray for relief from such additional tax burden. This issue will come before the Bayfield County Board, on August 19, 1975 , at 0930'A.M." I am sure that you are aware that Clifford Hoagland, and Eric Johnson represent this district, and .it is our wish that this information be read before the County Board assembly, inasmuch, as all District Three constitutents are not for this additional expenditure. :Thank you for your attention in the above matter. Following the public hearing several members of the Board spoke on the matter. A motion was made by Rude to table the above resolution. The motion was lost due to lack of a. second. Mr. Neilson asked for an appropriation of $1000 from Bayfield County which will be returned when the Housing Authority grant is approved. MOTION 5 Moved by Rude, seconded by Spears that $1000 be taken from the Contingency Fund and loaned to the Bayfield County Housing Authority, said money to be reimbursed when the Housing Authority receives its grant. The followi:�g resolution was read: No. 6 WHEREAS, The newly appointed District Attorney has requested that he be permitted to devote part-time to private pratice as time may be available upon first fulfilling and meeting the duties and responsibilities of said office, and WHEREAS, The District Attorney will set a schedule of regular office hours at the Court- house from 8:00 AM - 11:30 AM and will be available at other times as needed and maintain secretarial services at the Courthouse, and WHEREAS, The said proposed changes in the operation of said office as requested by said District Attorney are acceptable to the Board of Supervisors of this County, NOW THEREFORE BE IT RESOLVED, That the District Attorney be permitted to devote part-time to private practice as may be available after meeting and fulfilling the responsibilities of said office and that the total annual budget for said office be reduced to the amount set forth in the proposed revised budget on file with the County Clerk, effective retroactively to the 12th day of August, 1975. The following resolution was read: No. 7 WHEREAS, This County Board deferred the sale of 6560 acres of County land in the wildlife area of the White River in September.; 1972, in accordance with the Wisconsin Department of Natural Resources " Bibon Marsh - White River Project Proposal's, and WHEREAS, This County inadvertently advertised, received and accepted bids for four, 40 acre parcels of land within said proposed project area, and WHEREAS, Said four: parcels of land are more particularly described as follows, to -wit: NEµ NEµ, Sec. 23-46-7 SWµ NE4, Sec. 23-46-7 NEµ NW4, Sec. 23-46-7 NEµ SEµ, Sec. 23-46-7 WHEREAS, The above described parcels do not front on said White River and do not otherwise appear critical to said proposed project. The following resolution was read: No. 8 WHEREAS, the Bayfield County Board did on June 25, 1975 authorize the Executive Committee of the county board to purchase new equipment to update the accounting system of the county, and WHEREAS, the Executive Committee has made a further study regarding the necessary equip- ment, and WHEREAS, a designated committee has visited several county offices to view the actual operation of such equipment, and 4 Ems:' 5 �a August 19, 1975 9 WHEREAS,.it is the intent and desire of the committee to purchase equipment with which all tax assessment, tax computation and tax billing can be done, and WHEREAS, it now appears that in order to purchase all of the necessary equipment it would be necessary to expend an approximate amount of $4,000. in addition to the amount allocated and approved at the June 25, 1975 meeting, now therefore be it RESOLVED, that the Executive Committee be authorized to expend an additional amount not to.exceed $4,000. for the purchase of the aforesaid accounting equipment, said amount of $4,000 to be over and above the amount pre- viously authorized at the meeting of June 25, 1975. The county clerk explained to the Board that it was originally planned that if the new equipment was purchased and tax computation done on the machine, part of the work would be contracted out to some firm having a line printer. Since that time it has been decided that it would be more advantageous for the County to purchase a line printer to gether with the computer which would require'Zk additional funding. John Maitland, County Auditor, and Norma Chape., Bookkeeper, were both present and spoke to the Board in regard to their choice of equipment. Mr. Maitland also explained to the Board some of the proposed operating procedures.
