The meeting was called to order at 9:40 AM by Walter C. Barningham, County Board Chairman.
The following members answered roll call: No. 1

Dear Sir:
The purpose of this letter is to notify you that I, Otto Korpela, am resigning as Bayfield County
Board Supervisor for District 4, effective September 17, 1976. The reason for my resignation is
that I am concerned my candidacy for Registerof Deeds of Bayfield County could conflict with
important decisions coming up before the County Board, especially regarding those issues under
study by the Personnel Committee of which I have been a member.
Although I have been on the County Board only since this past spring, I consider my membership
a rewarding and educational experience. I thank all the Supervisors of the County Board, County
Clerk Edward Pajala and his staff, and the other County employees and officials for their courtesy
and assistance during my time of service. In conclusion I wish to thank you for your helpful
leadership and guidance.

Mrs. Newell Stephenson presented a painting done by Mr. Stephenson to the Bayfield
County Board. The painting will be hung in the County Extension Office.

.Eugene Gohl and David Deneen from the Department of Revenue, Eau Claire, appeared before
the Board and presented the new 1976 equalization figures. Mr. Gohl took time to explain to
the members and others present how the equalization figures are established. He passed out the
equalization figures to those present and explained the difference between last year and this
year.
Many questions were asked.by'board members'and were answered by Mr. Gohl.

Moved by Polich and seconded by Spears that Bayfield County reject the figures as submitted
by the Department of Revenue.
Renoos asked for a,roll call vote.

Moved by Bromberg, seconded by Rave that the Executive Committee draw up a resolution
to force our legislature to work on a land use taxation law. Motion carried.
The following resolution was read: No. 10
Accepting Excessive Backwater For A Portion of The Onion River Flood Plain In Ba.yf ield County
WHEREAS, existing STH 13 crosses the flood plain of the Onion River in Bayfield County,
Wisconsin restricting the natural flow of flood waters in the Onion River drainage basin causing
a backwater of two and zero -tenths feet above the Wisconsin Flood Plain Management Standards out-
lined in Wisconsin Administrative Code NR.116, and
WHEREAS, the Wisconsin Department of Transportation proposes to replace the existing twenty-
seven foot long bridge carrying STH 13 over the Onion River with a new fifty foot long bridge
which -will accommodate the flood waters of the Onion River without raising the Backwater higher
than that experienced in past years and,
WHEREAS, conformance to the Wisconsin Flood Plain Management Standards would require the
construction of at least one hundred and fifty foot long bridge estimated to cost approximately
one hundred and eighty thousand dollars and such conformance would constitute an undue expense
and hardship on area and regional transportation and could delay or inhibit the proposed improve-
ment of STH 13.

NOW THEREFORE BE IT RESOLVED that the.Ba.yfield county board of supervisors does hereby
agree to establish and accept backwater elevation for the Onion River flood plain west of
STH 13 for one hundred year frequency flood of six hundred and nine and zero -tenths feet
above sea level elevation as established by the 1929 datum of the National Geodetic Survey
which backwater elevation is understood to be two and zero -tenths feet above the Wisconsin
Flood Plain Management Standards outlined in Wisconsin Administrative Code NR 116 and which
backwater elevation will result in flooding conditions no more severe than those produced
by the existing Bridge and Gradeline.

WHEREAS, The Bayfield County Zoning office requires the use of dictation equipment and
has been informed that the necessary equipment can be purchased from Wisconsin Typewriter
Company for $464.66, and
WHEREAS, The Bayf ibld County Zoning Committee has recognized the need for dictation
equipment and has approved a request to purchase said EUuipment from the Wisconsin Typewriter
Company at its meeting of September 13, 1976,
NOW THEREFORE BE IT RESOLVED, That the Bayfield County Board of Supervisors approve the
purchase of dictation equipment from the Wisconsin Typewriter Company for the Zoning office
in the amount of $464.66.

The following resolution was read: No. 12
WHEREAS, Larry Erickson built and maintains a cabin located in the SWµ of the SWµ,
Section 21, Township 47 North, Range 6 West, Town of Keystone, which cabin was built, without a
land use permit and has been and currently is in violation of tte Bayfield County Zoning Ordinance,
and
WHEREAS, The Town of Keystone in which said cabin is located refuses to give its approval
for the existence of said cabin to the Bayfield County Zoning Administrator in that the continued
existence of said cabin could cause complications in the operation of the Town of Keystone
sanitary land fill, and that said approval by the Town of Keystone is required for the issuance
of a land use permit, .and
WHEREAS, The owner of said cabin refuses to remove it from said premises, and
WHEREAS, It is the opinion of the Bayfield County Zoning Administrator and the recommendat
of the Bayfield County Zoning Committee that litigation may be required to effect compliance
with the Bayfield County Zoning Ordinance,
NOW THEREFORE BE IT RESOLVED, That the Bayfield County Board of Supervisors authorizes
the Bayfield County Zoning Administrator to pursue such action, including litigation if necessary,
as is required to secure compliance with the Bayfield County Zoning Ordinance in the matter of
the Larry Erickson cabin.

The clerk read Resolution No. 15 and a related motion fromthe August 3, 1976 meeting.
A brief discussion followed.
Moved by Renoos, seconded by Meierotto to adjourn the public hearing and reconvene as
a County Board. Motion carried.

Mr. Patrick Miller, Superintendent of the National Park Service appeared before the
Board with a slide presentation of the national lakeshore. Mr. Miller stated that it now
appeared that the influx of tourism would not be as great as originally anticipated due to
the fact that the areas in the Bad River Reservation in Odahah and the Red Cliff Reservation
north of Bayfield have been excluded from the park. Mr. Miller answered a number of questions
that were raised by the Board.

Richard Ledin appeared before the Board in regard to. a land trade with Bayfield County
for a wood yard.
Moved by Bromberg, seconded by Seidel to adjourn as a county board and reconvene as a
Committee of the Whole for the purpose of conducting a public hearing. Motion carried.

Letters from the Town of Bell and Delta and Wausau Paper Mills Company all in support of
i
the proposal to trade county owned lands with Ledin Forest Industries to enable the Ledin
Forest Industries to continue operation of their pulp yard were read into the record.
(letters on file in the county clerk's office.)
The following petition opposing the trade signed by 72 Iron River area residents and one
other!person was next read:
The, undersigned, hereby petition the County Board of ;BayfeldoCounty to deny Ledin Forest
Industries from purchasing or leasing or trading approximately 60 (sixty) acres, which is now
considered part of the Bayfield County Fair Grounds, located in the town of Iron River, Wisconsin.
Reason number l: It would create a tremendous fire hazard to Iron River and the
surrounding area.
Reason number 2: Destruction of a beautiful piece of wooded land, to be bulldozed
off and destroyed forever. (Imagine people coming from all over
-the state to enjoy our County Fair, perhaps riding on the ferris
wheel, and looking at what was once a very scenic view, only to
see a pulp yard.
Reason number 3: Noise pollution. Twenty four hours a day of machinery running,
pulp trucks loading and unloading, who knows what!
Reason number 4: Some people think nothing of destroying a beautiful piece of
land for a few lousy dollars and leaving a mess for generation
after generation to see.
We are quite sure there are other tracts of land that could be used by the Ledin Forest
Industries that would not impose such an environmental hazard.
Also read to the.Board was a letter from Andrew and Mary Antonson which was in opposition
to the trade; (letter on file in the county clerk's office.)
The following petition in support of the trade was also read to the Board:
Whereas, Ledin Forest Industries, operators of the Ledin Pulp Yard in Iron River, Bayfield
County, Wisconsin are being forced to re -locate their pulp yard, and must find a new site on
which to set up a new operation soon, and
WHEREAS,,the Ledin Pulp Yard conducts a business operation with a yearly volume (including
area wood product purchases and wages) in Bayfield County of approximately $2,000,000.00, and also
a yearly personal property tax is paid on wood products assessed at approximately $1,000,000.00,
and in addition also a sizeable tax is paid yearly on the Yard equipment; therefore
It is desirous and advantageous;to.,(keep this valuable business operating in our area, and
As the Ledin Pulp Yard desires to remain in the Town of Iron River with its operation --
which has the following location requirements --(I) access to a good main highway, (2) access to
a railroad, (3)- a near -by water supply, (4) approximately 60 to 80 acres of flat, sandy land for
wood storage and erecting of shop buildings, etc., and
Whereas; Bayfield has a suitable tract of land in the Town of Iron River which meets all of
the above requirements (located south of the Bayfield County Fairgrounds as shown on map below),
and is unused now, and even after granting the desired amount of land for the proposed pulp yard,
would leave many acres for any future possible expansion of the Fairgrounds, and

Whereas, Ledin proposes to trade 80 acres of private land located in the boundaries
of Bayfield County Forest land for 62 acres, and this would benefit the County by completing
"blocks" in the County Forest,
WE, THE SIGNERS ON THE ATTACHED SHEETS, respectfully ask the Bayfield County Board members
to consider our concern and to act favorably on the proposed land trade which would keep this
extremely valuable industry in our county.
(The legal description of lands offered in trade is: SEµ of SWµ Sec. 14, T. 48 N. R.
8 W. The first 40 has small timber on it. The second 40 has a crop"of popple on it
and the East Fork of the Iron flows through it..)
The petition had 882 signatures.

county board. Motion carried.

special committee to work with Ledin on the land problem. Motion carried..

Mr. Polich suggested that as Wallace Johnson has-been a member of the multi -county
51.42 board and none of the proposed candidates had previous experience on the board, that
Wallace Johnson should be appointed as a member of the board.
Moved by Polish, seconded by Bromberg that Wallace Johnson's name be added to the
list. Motion carried.
Charles Polish then withdrew his name in favor of Wallace Johnson taking his place.
The following resolution was read: No. 21
WHEREAS, The Bayfield County Board of Supervisors received a Resolution at its.meeting
of August 3, 1976, requesting that the hereinafter described streets and alleys in the.
Okerstrom and Heydlauff's Addition to Port. Wing, Wisconsin be vacated and discontinued for

the purposes of a planned construction of a high school for the South Shore School District, and

WHEREAS, In accordance with said Resolution of August 3, 1976 a hearing was held after
proper public notice on September 28, 1976 on said vacation and discontinuance of said streets
and alleys and, as a result of said public hearing by the Ba.yf field County Board of Supervisors,
the Board finds that the public interest requires the vacation and discontinuance of said here-
inafter described streets and alleys for the planned construction of said high school and
WHEREAS, The Bayfield County Board of Supervisors finds that all procedural and substantive
requirements of Section 66.296 for allowing the vacation and discontinuance of 'streets and alleys
have beet met,
NOW THEREFORE BE IT RESOLVED, That the Bayfield County Board of Supervisors hereby vacates
and discontinues the following described streets and alleys in the Okerstrom and Heydlauff's
Addition to Port Wing, Wisconsin, to -wit:
3rd Street, from the west boundary of blocks 6 and 11, to the east boundary of blocks 8 and 9;

I have been retained by a group of citizens, owners of property abutting Green Street of the Plat
of Birch Grove in the.,Town of Barksdale.
My clients wish the County Board to vacate Green Street in accordance with Section 236.445 of the
Wisconsin Statutes. I have enclosed a petition signed by all the property owners who have frontage
on the street.
Therefore I would request that the County Board act in accordance with Section 66.296 (1). Please
advise if a hearing is necessary.

The following resolution was read: No. 25
WHEREAS, salaries of the employees of the Bayfield County Department of Social Services
are reimbursed..by.the .Wisconsin Department of Health and Social Services, Division of Family
Services, based on an established minimum and maximum monthly salary level in compliance with
the State Merit Rule, and
WHEREAS, cost of living salary increments increase the minimum salary level of each
classification, and
WHEREAS, the Merit Rule requires a salary increase upon completion of probationary employment
at a minimum of per cent of the current salary, therefore
BE IT RESOLVED by the Bayfield County Board of Supervisors in session this 28th day of
September, 1976 that the minimum salary level of employees of the Department of Social Services
be re-established according to the cost of living increment granted.

The following resolution was read: No. 26
WHEREAS, the Bayfield County Board has authorized the purchase of a new mini -computer for
the county clerk's office, and
WHEREAS, said mini -computer has been purchased and is in operation, and
WHEREAS, The Executive Committee of the County Board has determined that the municipal
assessment rolls and tax rolls should be printed on the computer and the calculation of taxes
should also be done on the computer, and
WHEREAS, there are approximately 35,000 land descriptions in the caunty which must all be
converted from addressograph plates to tape, and
WHEREAS, it has been estimated that the work involved'in making -such -a conversion will be
full-time work for one employee for five to seven months, and
WHEREAS, it will be necessary to hire additional help to do the abovekrnentioned*conversion
of tax records,
NOW THEREFORE BE IT RESOLVED, that the Personnel Committee of the County Board be authorized
and directed to take immediate action to hire an employee to do the tax description conversion, and
BE IT FURTHER_ RESOLVED, that the Personnel Committee take into consideration the need for an
assistant county bookkeeper who would be able to fullfill the duties of the regular full-time
bookkeeper, with the possibility of hiring a person qualified to take over.both positions.

The following resolution was read: No. 27
WHEREAS, certain discrepancies in salaries and classifications of certain courthouse
employees were brought to the -attention of the County Board at�their meeting, on August 3rd, and
WHEREAS, the County Board was of the opinion that certain discrepancies do exist, and
WHEREAS, the County Board did direct the Personnel Committee -of the County Board to make
a study of salaries and classifications of county employees, and
WHEREAS, said Personnel Committee has made such a study and is of the opinion that
certain discrepancies do exist which should be corrected immediately, said discrepancies being
as follows:
1. The salary of NorAaaChape, head bookkeeper of the county; is below the level
of certain other county department bookkeeper positions.
2. Mary Ann Sarver, an employee in the county clerk's office, is classified.
presently as a stenographer and has been classified as such ever since the
reclassification of employees in 1974, although she has been doing and is
doing the work of a secretary.
3. Beatrice Kelly and Delores Jackson, employees in the county Extension Office,
are classified presently as stenographers and have been classified as such
ever since the reclassification of employees in 1974, although they have been
and are dping the work of a secretary.
NOW THEREFORE BE IT RESOLVED, that (1) the'salary range of the county bookkeeper,
which position is presently filled by Norma Chape, shall be increased in the amount of
$30 per month, said $30 increase to apply to all three steps of that position; (2)
Mary Ann Sarver shall be reclassified as a secretary with the appropriate increase of $30
per month; (3) Beatrice Kelly and Delores Jackson shall be reclassified as secretaries
with the appropriate increase of $30 per month, and
BE IT FURTHER RESOLVED, that the above mentioned changes shall become effective on
October 1, 1976, and
BE IT FURTHER RESOLVED, that the above mentioned changes are not to be construed as
an over-all salary adjustment of county employees which is still under consideration by
the Personnel Committee.

Mr. Lawrence Wachsmuth, City of Bayfield Mayor, appeared before the Board in regard to
a resolution adopted by the County Board at their August 3rd meeting in regard to repair of
city dock funds from Bayfield County. Mr. Wachsmuth explained to the board how much and where
the money was spent.
Moved by Rave, seconded by Heglund that the balance of the $5000 grant be paid to the
City of Bayfield. Motion carried.
The following resolution was read: No. 30
WHEREAS, the Ashland Breakwater Fog Signal has, in the past few years been in operation
24 hours per day, 365 days a year, and
WHEREAS, the constant noise pollution has caused anguish to the residents of the Chequamegon
Bay shoreline ,
THEREFORE, BE IT RESOLVED,,that the Bayfield County Board of Supervisors requests that, if
the fog signal be kept in operation, it be controlled to operate only when weather conditions
create a necessity for its use.

In order to promote a departmental work force which accurately reflects our areas
diverse available labor force, Bayfield County will implement an annual Affirmative Action
Plan providing for policy direction, specific goals and time -tables, and periodic monitoring
of progress. Our Affirmative Action Plan will be carried out in accordance with Federal
Mandates -which direct employers to correct under -utilization of women, minorities, and the
handicapped, and to assure their equal rights in all.segments of our county work force.
In order to eliminate .and .avoid _discrimination against any employee er applicant for
employment, the official policy of this agency will be to recruit, hire, and promote for all
Job Classifications in ways that .avoid intentional or non -intentional discrimination for
reasons of sex, race,.physical or mental disability, religion, class or economic status,
color, national origin or ancestry,age, marital status, sexual orientation, physical
characteristics, political beliefs, and other factors. unrelated to job performance. In
addition, steps will be taken to insure that only valid requirements for advancement are

Overall responsibility for this policy is assigned to the Personnel Committee. In
addition tthe Chairman of the Personnel Committee is appointed manager of Affirmative Action and
Development, to bear specific vesponsiblity for the functional maintenance of this program.
While it is the duty of the County Board to establish its Affirmative Action Program, each
employee has an active role to play in ensuring its success. This role involves making a
personal committment to Equal Employment Opportunity and following through on that committment
within the context of daily work life. Employees who have any suggestions, problems, complaints,
or information associated with our Affirmative Action Program, are urged to communicate them to
the Personnel Committee.

The primary recruiting area for salaried and hourly positions are the cities of Washburn

Ba.yf field County, a municipal corporation, with its County seat at Washburn, Wisconsin,
hereby grants to the Bayfield Electric. Cooperative, Inc., of Iron River, Wisconsin, a right-
of-way for the purpose of constructing an underground cable across that portion of the Sz of
the NEµNE4, of Section 20, Township 43, North of Range 7 West, located in the center of an
abandoned Town Road, being County owned land. Said right-of-way to be 15 feet in width,
and upon laying of the underground cable the Bayfield Electric Cooperative Inc., of Iron River,
Wisconsin, will make detailed survey designating location of said underground cable.
This easement is subject to the provisions and conditions contained in Schedule "A"
attached hereto and made a part of this easement.
TO HAVE AND TO HOLD said right-of-way unto sa.id Bayfield Electric Cooperative, Inc.,
its successors and assigns until such time as said underground cable is abandoned or discon-
tinued, in which event all of said rights shall revert to the grantor herein.

SCHEDULE "A"
1. A map and legal description tied to establish or monumented surveyed corners shall be
furnished with each application for an easement. Such map shall indicate the width and use of
said easement. Where underground cable is used, the exact location -of' the cable must'be indi-
cated.- Following the laying of such cable, its location 'must -'be marked' '*a.bove ground at reasonable
intervals.
2. The rights of the grantee of such easement shall apply only to the particular parcel of
land granted in the easement and such grantee shall have no right of any nature whatsoever to
enter upon adjoining County Forest or other County lands outside of the right-of-way for any
purpose whatsoever, except the grantee shall have the right to cut'and/or trim trees overhanging;
the right-of-way upon written permission of the County Forest Administrator.
3. Tie easement grantee shall refrain from spraying rights -of -way for the destruction
of trees, shrubs and other plants, without thereafter cutting and properly disposing of the dead
trees and shrubs on said rights -of -way resulting from said spraying, for the purpose of avoiding
fire hazards, detracting from scenic beauty and preventing unsightly conditions from developing.
4. The grantee shall pay for all reproduction and timber standing on said right-of-way at the
time the easement is granted at the regular=going rates for stumpage charged by Bayf ield County,
said stumpage to be estimated by the Bayfield County Forestry Department. All timber on such
rights -of -way shall be cut in accordance with the practices established by the Ba.yfield County
Forestry Department.
S. The easement grantee shall take all necessary precautions to prevent the obliteration of
landmarks relating to corner and monuments including all corners, bearing trees, bench marks and
other Government and private survey references.
6. The easement grantee shall, in the clearing of rights-of=way and construction thereon,
comply with all- of the laws of the State and County concerning the cutting of forest products
and dispositioncf slash and shall be more specifically prohibited from windrowing slash in, along
or upon said rights -of -way and adjoining lands. -
7. All overhead lines shall be constructed and maintained so as to have a minimum clearance
of fourteen (1.4) feet.
8. There shall be no change in the contour of the land as a'result of construction, and all
stumps, debris and cut vegetation shall be removed or properly disposed of, and shall not be
bulldozed to the edge of the right-of-way or upon adjacent land.
9. Upon the substantial failure of the easement grantee to comply with all the conditions
of the easement, including the conditions contained herein, said easement may be cancelled upon
ninety (90) days notice to said easement grantee and upon final action therein by the Ba.yfield
County Board of Supervisors.
10. The easement grantee shall have the right of ingress and egress over other County lands
adjoining said described right -.of -way only where such ingress and egress is required for the
exercise of the rights granted by this easement to the said grantee. Such,rights of ingress and
egress shall be exercised only upon the written approval of the Ba.yfield County Forest Administrator
and over designated routes as established by said Administrator. All special damages which may
result from the opening up and use =of such ingress and egress routes shall be compensated for by
said grantee.

The clerk advised the Board that the County Treasurer has received correspondence from
the Office of the State Treasurer relative to investing surplus county funds in a state
municipal investment fund. He further advised the Board that the Executive Committee has
discussed this matter at one of their regular meetings and they were of the opinion that the
matter should be referred to the County Board. The clerk also stated that the -County Treasurer
is not recommending the change but had only brought this to the attention of the committee in
the event that the committee or the board decides that the change should be made. The clerk
also reminded the board that the County Board has annually designated all Bayfield County
banks as depositories for county funds and it would therefore require County Board action
to make the change. No action was taken on the matter..

WHEREAS, Bayfield County is eligible to receive $89,530.00 for fiscal year 1977 and
approximately $54,800.00 for fiscal year 1978 to be used for ro`ad-projects that are not on
the Federal Aid Secondary.Highway'System, and ---

by Federal Aid 70%, and,

To the Bayfield County Board of Supervisors:
There is little doubt.that the question of tourism and recreation development is the most
important issue facing. Bayfield County.
,The,decisions,and planning done by the County now, will.have a far reaching influence
on the,economy, life styles and environment of Bayfield County residents.
With the fast increasing pace of recreational development, there is a.gr.owing concern
as to the affect these changes will have on Bayfield County.
Surveys to determine the desires of residents have been attempted, but the results have
been inconclusive and questioned.
A comprehensive evaluation of resident opinion could prove to be a valuable guide for
planning the direction of growth in the County.
Special interest groups have been active and influential in the planning that has been
completed at this time, however, the ultimate responsibility and legal authority for such
planning is a right of the voter of Bayfield County.
For this reason, I would like to suggest that the County Board consider adding an

advisory referendum to the November Ballot.
Three basic questions are apparent and could be included; 1) yes— no_ Bayfield County
will use -County Revenues to actively promote recreational business growth and increased tourism.
2) yes. —no. Bayfield County will use County revenues to actively promote industrial and
non -recreational business growth.
3) yes_ no... Bayfield County zoning-authoritywill be used to encourage recreation based,
business development.
If this referendum (and any additional questions that the Board suggested) were added
to the November ballot, it could provide a:va.luable indication of voter preference at a
minimal cost.
Considering the interest in, and the importance of the issue, it seems likely that it
would -eventually come to a referendum. A-special,referendum would be.more expensive and delay
the collection of vitally needed voter input for the future planning of Bayfield County.

Will you please present this request to the Bayfield County Board at their next County
Board Meeting?
To the Bayfield County Board:
At a Town Board Meeting, held September 9th, 1976, the Town Board of the Town of Clover,
voted to replace the culvert and repair the approach over Bark Creek between NW SE and the
SW SE, in Section 23-township 50, Range 7 W., and petition the Bayfield County Board for
aid as provided under law 81:38.
The following action was taken:
Resolved; that the culvert over Bark Creek between NW SE and the SW SE forties in -section 23,
Township 50, Range-7 West, has become dangerous to cross and snow -plow. An emergency now
exists as the school bus must now travel over this route. The existing culvert is in bad
shape and too narrow, making it necessary to replace this culvert and repair this approach
without delay.
The estimated cost of the 24Tx96" culvert and two bands, is $2,600. The labor estimate
is $2,500., making a total estimated cost of five thousand one hundred dollars ($5,100).
Therefore, the Towri_Board of the Town of Clover, petition the Bayfield County Board that
an appropriation for aid be made, for the emergency repair of the approach and the replace-
ment of the culvert over Bark Creek, as provided under law 81:38.
