MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
June 7, 1977
The meeting was called to order at 9:45 AM by Walter C. Barningham, County Board Chairman.
The following members answered roll call: No. 1

Moved by Seidel, seconded by Rave to dispense with the reading of the minutes of the
previous meeting. Motion carried.
A prayer and pledge of allegiance was led by Larry Seidel, Board member.
Ken Todd, Ashland County Board Chairman and Tom Higgens,.Douglas County Board Chairman,
were present as visitors.
NO. 2
Leo Lay, Trustee of the Bayfield County Rest Home, appeared before the board in regard
to the future of the rest home. He informed the board that the person who was interested
in purchasing the rest home had informed him that because it would create conflicts in his
present employment, he could not proceed with purchase of the Bayfield County Rest Home.
Dick Olson, Sr. next spoke to the board in regard to the proposal of the Washburn
Hospital Board to construct a rest home attached to the present Bayfield County Memorial
Hospital. He stated that each board member should have received a packet in the mail with
information on procedures to be followed if the county was to finance the construction of a
home together with a payment schedule. He again told the board that the hospital board be-
lieved that a 120 bed rest home could be operated with very little or no actual cost to the
county after the first one or two years of operation.
The clerk advised the board that the appraisal which the county board had directed the
county clerk to have made has been made by Robert E. Anderson & Associates, Eau Claire and
copies of the report have been distributed to members of the Executive Committee. The ap-
praiser has appraised the rest home at $240,000 which includes all permanently installed
equipment in the kitchen, laundry and dining room. It does not include movable personal
property.

A lengthy discussion followed with many board members indicating their support of Bayfield
County bonding the county to build a 120 bed wing on to the Bayfield County Memorial Hospital
to be used as a nursing home. The nursing home would be leased and operated by the Washburn
Hospital Association under an agreement similar to the lease agreement for the hospital.
MOTION NO. 3
Moved by Bromberg, seconded by Hanson that the Enecutive Committee be allowed to advertise
for sale the present rest home facility as a nursing home and report back any findings at the
August meeting.

The Highway Commission deems it necessary to make certain revisions on a previously approved
right of way plat and to acquire certain lands and interests in lands according to such
revisions, for the proper improvement or maintenance of the above -designated project and
highway. The revised relocation order of the Commission and the map showing the highway as
laid out and established and the lands and interests to be acquired are transmitted herewith.
The enclosed relocation order provides that the necessary acquisitions of lands and interests
not previously acquired shall be made by the Division of Highways, pursuant to the provisions
of Section 84.09 (1) or (2) , Wisconsin Statutes.

Dear Mr. Pajala:
This letter is in reply"to your May 2 letter about logging operations in the NW-4 Section 29, T46N-
RSW, Town of Kelly.
The Department of Natural Resources did take action immediately in this case, which is outlined
as follows:
1. George Phillips, Conservation Warden, received the complaint and inspected the site on March
11, 1977. There was no slash in the waters of the river and, therefore, was no violation of
any law. George Phillips did note the slash on the floodpla.in and wrote a letter to John
Walters of Consolidated asking them to remove the slash from the floodplain because of the
potential flooding and possible damage to the bridge.
2. Mr. Walters responded with a letter on March 15, that the slash had been pushed back.
3. George Phillips inspected the site again on March 17, and found the slash had been pushed back.
Other than the request by George Phillips, the Department of Natural Resources had no jurisdiction
in this matter.
The Department of Natural Resources policy on elm cutting is to harvest and salvage good quality
elm that will in all likelihood, eventually succumb to the Dutch Elm Disease. Since the majority
of the elm in Bayfield County is located along the water courses, the major impact of the disease
will be seen in areas like along the White River. I believe Mr. Heinlein was proper in allowing
Consolidated to proceed with the elm removal. The regeneration of this area to other species
mixed in with young elm is better resource management than at a future date having a large amount
of dead elm bordering the White River.

Diane Brander, Director, ABC Developmental Center, was allowed the floor by Chairman
Barningham and she spoke on the future of her program. Mrs. Brander stated that it now
appeared that the funding of the Unified Services Board would be depleted by August lst and
after that date services would have to be curtailed unless additional appropriations were
made. Mrs. Brander again reminded the Board that she had in her previous appearances before
the Board advised them that this wa.s a possibility if Bayfield County withdrew from the four
county unified services group. She also reminded the group that she had been assured by
members of the Bayfield County Board that there would not be any reduction or curtailment of
services if the county decided to operate on a single county unified services system. Mrs.
Brander now expressed her concern that curtailment or reduction in services was inevitable
unless definite arrangements were made for additional funding.
Ed Dashner, Administrator of the Unified Services Board, next was allowed the floor and
he agreed with Mrs. Brander that funding did appear to be inadequate to continue the level
of services for the balance of the year as is being provided at the present time. Mr. Dashner,
however, appeared to be of the opinion that there may be areas where there should be some re-
duction in services. He indicated that in many instances it may be possible for either the
client or the family to provide the necessary funds for services rather than charge it to
the county.
Questions were asked and comments made by many of the Board members with.the questions
answered by either Mrs. Brander, Ed Dashner or members of the Bayfield County Unified Services
Board.
MOTION NO. 10
Moved by Rude, seconded by Seidel that the Unified Services Board of Bayfield County
continue to give the same services that were given before the county formed a single county
system and if additional funds are needed that they be taken from the -contingency fund for
the balance of the year.
Moved by Polich, seconded by E. Johnson to adjourn for lunch. Motion carried.

Upon re -convening the Board continued discussion about the problems with the Unified
Services Board and the Developmental Center. It was pointed out by Board members that other
services might also have to be curtailed or reduced as funding would run out in other areas as
well as the Developmental Center. It was pointed out that as there is no actual crisis at this
time it would be unwise for the county to authorize unlimited spending by the Unified Services
Board to fund any particular program and that if the time comes when funds are depleted the
Board should at that time face the issue and take whatever action might be appropriate.
Rude then withdrew his motion and Seidel withdrew his second, but he stated that he was
withdrawing on the condition that the Board will give further study to the problem and take
action when necessary.
Moved by Polich, seconded by Rude that the Bayfield County Board go on record that there
will be an on -going Developmental Disabilities Program as it exists now for the duration of 1977.
Polich withdrew his motion and Rude withdrew his second.
The Board then discussed the possibility of having a special meeting some time prior to the
August Board Meeting to devote more time to the problem. The clerk advised the Board that they
could, if they so desired, adjourn the meeting to any given date. By adjourning to a specific
date, it would not be necessary for the Board to call a special meeting by petition. No further
action was taken.
The following resolution wa.s read: No. 12
WHEREAS, Charles Diamon,_Chief Deputy for Bayfield County has resigned effective April 29,.
1977 and
WHEREAS, Lieutenant Richard Fredericks has been employed by Bayf ield.County since January
1, 1955 and has seniority over any of the other officers in the Sheriff's Department, and
WHEREAS, Richard Fredericks has been a dedidated and faithful employee, and
WHEREAS, the Sheriff's Commission of the Bayfield County Board recognizing the ability and
faithful service of Richard Fredericks has .Tpointed Richard Fredericks as Chief Deputy for Bay -
field County, subject to approval of the County Board,
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board in session this 7th day of
June, 1977 confirms the appointment of Richard Fredericks as Chief Deputy for Bayfield County.

WHEREAS, Norma Chape is the head bookkeeper for Bayfield County, working in the County
Clerk's office, and
WHEREAS, the position requires considerable skill and knowledge in bookkeeping, and
WHEREAS, it is vitally important that a skilled person hold said position due to the
necessary accuracy of the work involved, and
a,
WHEREAS, Norma. Chape has proven to be an efficient and qualified bookkeeper, and
WHEREAS, the salary of the county bookkeeper should be at least equal to the salaries

of other county employees holding like positions, now therefore be it
RESOLVED, that the salary of Norma Chape be increased by an amount of $70.00 per month
which will bring her salary up to the level of salaries paid for other similar positions, and
be it further
RESOLVED, that'the effective date of this resolution shall be April 1, 1977.

The following resolution was read: No. 14
WHEREAS, by action of the Bayfield County Board, the Personnel Committee of the county
board was directed on August 3, 1976, by Motion 26, to make a study and re-evaluation of all
non -represented county positions, and
WHEREAS, on September 28, 1976, further reference was made in Resolution 27 to the
pending study and re-evaluation, and
WHEREAS, said study and re-evaluation has been made by the committee, and
WHEREAS, there have existed certain inequities in the salary schedule of the non -
represented county employees, and
WHEREAS, the Bayfield County Board has made several salary adjustments which have caused
additional inequities in the overall salary schedule, and
WHEREAS, the resolution providing for quarterly cost -of -living increases to employees
does not appear to be the solution to salary inequities, now therefore be it
RESOLVED, that the salary schedule attached to and made a part of this resolution shall
be the salary schedule for county non -represented employees, effective on July 1, 1977,
and be it further
RESOLVED, that no changes shall be made in the salaries or hourly wages of Rest Home
employees or employees of the Department of Social Services except such increases as may be
due following six months or`eighteen months of employment, or cost -of -living increases due
Rest Home employees, and be it further

RESOLVED, that the resolution providing for cost -of -living salary adjustments adopted
on September 30,,1975 be rescinded in its entirety except that the cost -of -living provision
shall remain in effect for all Bayfield County Rest Home employees and the Bayfield County
Sheriff's Dept. employees who are covered under a separate labor agreement.

Mr. Schurr of the Department of Interior was present a.t the board meeting in regard to a
county owned 2 acre parcel of land in the Iron River Fish Hatchery Project which the Department
of Interior wishes to purchase. The request was originally made to the county board at the
April meeting and at the request of Ervin Harnois, Chairman of the Town of Tripp, the matter was
tabled with the understanding that further consideration would be given to it at the June meeting.
Mr. Schurr explained to the county board the need for all of the land that the Department of
Interior is attempting to purchase.- He explained that there. will be a 5 million dollar hatchery
built and it was necessary to acquire the lands adjacent to the hatchery which had streams running
into the hatchery area so that they could be assured of no pollution. He also stated that the area
would not be closed to the public and no administration charge would be made.
Wallace Johnson informed the board that he had again been approached by Mr. Harnois and that
Mr. Harnois had advised him that they still are not satisfied with the information they have re-
ceived from the Department of Interior. regarding the acquisition of lands in the hatchery area.
and also the questions they have raised in payments in lieu of taxes to the Town.

The Zoning Committee of the Bayfield County Board of Supervisors, having held a public
hearing pursuant to Section 59.97(5), Wisconsin Statutes, notice thereof having been given.
as provided by law and being duly informed of the facts pertinent to the proposed changes,
hereby recommends that the petitions described as follows be approved:
The South 310 feet, West 850 feet of the'South-West One -Quarter (SW-4) of the South-West

WHEREAS, The terms of two members of the Board of Adjustment will expire on July 1, 1977, and

WHEREAS, It is recommended to the Board that Dennis Rasmussen of Cable, Wisconsin, and Floyd
Iddings of Bayfield, Wisconsin, be appointed to said Board to fill two of said vacancies and that
Mrs. Anselle Hokanson be appointed to fill the vacancy of said alternate member,

of playground and tennis facilities at the DePont Park, West End Park and
Memorial Park, and;
WHEREAS, playground equipment and tennis facilities are consistent with the goals of
providing public recreation facilities;
NOW, THEREFORE BE IT RESOLVED, that the Bayfield County.Boa.rd.of Supervisors adopt this

ADOPTED BY THE BAYFIELD COUNTY BOARD ON JUNE 25, 1975
WHEREAS, the Town of Barnes being.a municipality in Bayfield County and;
WHEREAS, the demand for outdoor recreation at the Barnes community recreation area
h has warranted the development of two tennis courts, softball diamond, play-
ground equipment, basketball court, skating rink with lights, picnic shelter,
parking area., water supply (well) , and -picnic tables and;
WHEREAS, these facilities are consistent with the goals of providing public recreation
facilities as identified in the Bayfield County Recreation Plan;
NOW, THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors adopt this
amendment as part of the Bayfield County Outdoor Recreation Plan.

WHEREAS, the Lincoln School located in the City of Bayfield is a school within
Bayfield County, and;
WHEREAS, the demand for tennis and playgrounds has warranted the development of
tennis facilities and playgrounds at the Lincoln School, and;

�. WHEREAS, tennis facilities and playground equipment is consistent with the goals of
providing public recreation facilities as identified in the Bayfield County
Recreation Plan;
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors adopt this
amendment as part of the Bayfield County Outdoor Recreation Plan.

RESOLUTION
of the
BAYFIELD COUNTY BOARD OF SUPERVISORS
for
LEGAL COUNSEL
in
CHICAGO & NORTH WESTERN ABANDONMENT PROCESS
WHEREAS: The Chicago and North Western Transportation Company has petitioned for authority to
abandon and dismantle the rail line extending from Hayward to Bayfield and Ashland to
Ashland Junction, and
WHEREAS; The Interstate Commerce Commission will hold a public hearing on this request beginning
on June 13, 1977, and
WHEREAS: Bayfield County is interested in retaining rail service on the subject line, and
WHEREAS Bayfield County has been cooperating with the Northwest Regional Planning Commission,
as well as with Ashland, Washburn and Sawyer Counties to retain such service, and
WHEREAS: Legal Counsel will be necessary if the Regional Planning Commission and the four
counties wish to effectively present their concerns at the public hearing and to prepare
a post hearing brief, and
WHEREAS: The Northwest Reginnal Planning Commission has agreed to contribute $2,500 toward such
counsel, and
WHEREAS: An estimated $5,500 in legal fees is needed to present effective testimony, to cross
examine the C & NW, to prepare a post hearing brief, and to obtain general counsel.
NOW, THEREFORE, BE IT RESOLVED, that the Bayfield County Board of Supervisors would like to
contribute $750.00 toward the above mentioned legal counsel.

Mr. Henry Hohorst's appearance at the hearing and that a letter be mailed to Phil Scherer advising
him of the action of the County Board. Motion carried.
Karl Ludzack also explained to the Board that the Northwest Regional Planning Commission
will draft a resolution, said resolution to provide for creation of a 4 county transit authority.
He stated that if the county wishes to support such action, the Regional Planning Commission will
draft the resolution and it will be brought back to the county board for action.

The following resolution was read: No. 29
WHEREAS, the Department of Interior has for several years been studying the possibility
of a Wildlife Area in the vicinity of the Bibon Marsh, and
WHEREAS, the Department of Natural Resources has prepared a report entitled Bibon
Marsh - White River Project Proposal, and
WHEREAS, the DNR has requested that Bayfield County withhold the sale of approximately
6,560. acres of county owned lands within the proposed Bibon Marsh Wildlife Area, and
WHEREAS, the Bayfield County Board did on September 26, 1972 adopt Resolution No. 10,
said resolution being recorded in Volume 13 County Board Journal, which did provide for
withholding the sale of county owned lands within the aforesaid Bibon Marsh Area, and
WHEREAS, the Executive Committee of the County Board is now of the opinion that it is
not in the best interest of Bayfield County to continue withholding said lands from sale,
NOW THEREFORE BE IT RESOLVED, that the action taken by Bayfield County on September
26, 1972 withholding said lands from sale be rescinded.

WHEREAS, Peter Pease has been employed in the Bayfield County Sheriff's Department.as
a deputy sheriff since November 16, 1971, and
WHEREAS, Diane Fizell has been employed in the Bayfield County Sheriff's Department
since January 21, 1975, and
WHEREAS, Grover Shanks has also been employed in the Bayfield County Sheriff's Depart-
ment since May 1, 1976, and
WHEREAS, all of the aforesaid employees have been employed under various government
funded programs during most of their time of employment, most recently under the Concentrated
Employment Program, and
WHEREAS, under the guidelines of the program employment can only continue for a limited
period of time after which the employer must absorb the positions, and
WHEREAS, the county can upon absorbing the aforesaid positions fill the slots with
some other position, and

WHEREAS, the Personnel Committee of the Bayfield County Board has approved placing Grover
Shanks on the county payroll as of May 1, 1977 and Peter Pease and Diane Fizell on the county
payroll as of June 1, 1977
NOW THEREFORE BE IT RESOLVED, that the action of the Personnel Committee in placing the
aforesaid employees on the county payroll be approved.

The Chequamegon Theatre Association is requesting storage space for some of its props and
paper goods. The Chequamegon Theatre Association is a non-profit, tax-exempt organization
(tax-exempt number is ES 15683).
We are requesting a storage space of approximately 5-10 ft by 20 ft although more is agree-
able to store non-flammable goods.
We would be willing to use only regular hours to get at the storage and would need to be
accessible to it about four times during a year.

Dear Mr. Pajala:
I have for many years, 10+, made at least a couple trips per year to Bayfield County area -
primarily Delta Lake. Believe me I have been quite a booster of this lake and area having
brought other fisherman into the area from both Michigan, Indiana and from cities as far away
as Dayton, Ohio - many of whom are yearly visitors to Delta Lake.

What concerns me and has for several years is the fact the outlet structure has deterioraf[ion
to the point that the level of Delta Lake has dropped several feet in the last few years
and continues to drop. Fishing has slipped too.
While I am not a member of the Corp of Engineers, it appears no more than several loads of
rock dumped at the damn at the.Hay Lake outlet would remedy the situation and not require
a major expense.
Are there any plans underway to raise the level of Delta Lake back to what it used to be?
I'm not saying at this time that I "ain't" coming back if something isn't done, as my threat
alone wouldn't make much difference - but all the gang I've drug into the area is starting
to think about it. as am I!
Actually many of my Michigan friends "fishin' buddies) think I'm out of my head for driving
Past some 5000+ lakes here to go up to Bayfield County, Wisconsin. Well, we like your
hospitality as well as the fishing and want to keep it that way!
Please advise what is or can be done....

After hearing and reading of the Bayfield County Board's discussion on the Tourism Train Study,
I feel that some clarification should be made as to the Bayfield County Board's preogatives in
administration of this project.
First, the intention of the Upper Great Lakes Regional Commission was to get County involvement
in the project rather than to do the study themselves or to contract it with the Northwest Regional
Planning Commission. Our feeling was that each county should be involved as we knew there was con-
cern about the abandonment issue. Our assumption was that if the County.was receptive to under-
taking the study - which they were - they would establish the administrative apparatus to oversee
the project. Our further assumption was that the County Board -appointed Recreation Director had
been given the responsibility to proceed with the study.
The steering committee's powers are strictly advisory and authority for approval or disapproval
Of the study, the contracted firm for the study, and other requirements rests ultimately with the
Bayfield County Board or with the officers or committees given such authority by the Bayfield Count,
within the guidelines established.by the grant offer. That was the reason the recommended contrac-
came to the County Board.
If the Bayfield County Board or its committees empowered to do so desire to appoint two people to
the steering committee, that is their option. Our understanding was Gary Gylund's office, and
ultimately the Bayfield County Board, had the power to approve or disapprove any and all aspects
of the study within the grant offer guidelines. The Bayfield County Board has the right to appoint
its own steering committee or can administer the project as it desires within the guidelines of
the grant and the 05,000 funding available.
The steering committee came into being because the tourism train concept involves several counties
and it was deemed desirable to get their involvement and understanding of the issues involved. The
committee make-up rests with your Recreation Director and/or the County Board or its committee.
However, we would hope that an advisory board be retained in order to continue dialogue between
counties and agencies who might eventually determine the fate of the line.
To further clarify this off ice's position on actual development of a. tourism train or a short line
operation for the proposed abandonment, we are neither supportive of or opposed to actual develop-
ment at this time. Hopefully, this study will address whether the tourism train and/or short line
operation is actually feasible without cost to the property taxpayers, or if costly - how much?
In the final analysis, it will be up to the counties or other local units of government to decide
the fate of a tourism train or short line.operation. The Upper Great Lakes Regional Commission,
in its endeavors to serve the area, is only interested through this study in providing local
elected officials with information so they can make decisions if they should be eventually con-
fronted with the problem of losing the line between Hayward and Bayfield. That problem, if the
Board and citizens of the area view it as that, is a reality with hearings set on that abandonment
in mid -June. For the Upper Great Lakes Regional Commission to assist in funding any local develop-
ment requires local support for creating such a project. We will not make that decision. Bayfield
County, possibly, or some other governmental unit will decide the fate of the Hayward-Bayfield line.
As per our telephone conversation of this morning, I appreciate your providing the contents of
this letter to the County Board of Supervisors.
