MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
September 23, 1977
The meeting was called to order at 9:30 A.M. by Walter C. Barningham, County Board
Chairman.
The following members answered roll call; No. 1
Edwin Erickson, Arthur Meierotto, William Zamback, Bennie Rude, Larry Seidel, William Rave,
Herbert Spears, Wallace Johnson, Ernest Heglund, William Carter, Arthur Hanson, Joseph
Berweger, Charles Polich, Karl Ludzack, Edwin Renoos, Walter Barningham

A prayer and pledge of allegiance was led by Larry Seidel, board member.
Moved by Meierotto, seconded by Erickson to dispense with the reading of the minutes of
the previous meeting. Motion carried.
No. 2
Lyle Cowley, delegate from the Bayfield County Game Congress, appeared before the
board. Mr. Cowley reminded the board that the county has been appropriating the sum of
$100 to cover the cost of the expenses of the members of the county conservation game congress.
He stated, however, if all members attended as they did in 1977, the $100 appropriated is
0
insufficient to cover the expenses and he asked the county board to consider increasing that
amount to $150 in 1978.
Bromberg arrived at 9:50 AM.
Eric Johnson arrived at 9:55 AM.
Questions were asked by board members which were answered by Mr. Cowley.
The clerk read the following letter from Bill Bromberg: No. 3
September 19, 1977
To the Members of the County Board:
I am an elected member of the Wisconsnn Conservation Congress, an alternate delegate,
representing sportsmen's interest in Bayfield County. I feel it is necessary to express my
objection to the use of public tax dollars to subsidize the Congress in any way. Although
I do intend to remain a member as long as I am re-elected and would, no doubt benefit by the
subsidization.

$100.00 isn't a great amount, but the issue is not money but the ethics of supporting
the organization. First, I would question the policy of using taxpayers money in this manner
and second, you may be setting a precedent for other special interest groups.
I have been informed that Bayfield is the only County that does subsidize Congress members.
It is my feeling that a delegate should pay his own way or be subsidized by one or more of the
sportsmen's groups he represents.
Finally, if the Bayfield County delegates had met to discuss this policy and voted on it,
I would abide by the decision of the majority, However, since this procedure was not followed,
I would like to take this opportunity to express my opinion.

financing the game congress for the year 1978. Motion carried.
No. 4
Bill Lake, from the Dept. of Revenue, presented to the board the county values for 1977.
Mr. Lake provided information to the board regarding the number of sales in each taxing district
in the last year and also the total for the last 2 years. He went on to explain the formula
the state uses in arriving at the equalization values. He stated that the state uses only normal
sales which appear to be between a willing buyer and seller and not any sales that are made
under any pressure and the state also does not use any county or other municipal land sales.
Mr. Lake said that they use the sales figures and compare them with the assessment on the same
parcels and from that they arrive at the level of assessment by the local assessor. The state
then takes the previous years equalized valuation and by using the formula adjusts that to what
they believe the valuation should have been in the previous year and adjusts the valuation
accordingly. Mr. Lake advised the board that it was not necessary for the county to adopt the
resolution establishing the equalized valuations at the.September meeting and he was only pre-
senting these to the county at this time and the county could actually formally adopt the reso-
lution in November, if they so desire.

meeting. Motion lost.

Dear Ed:
I have received a letter from Melvin C. Pederson, Project Director for the Emergency Medical
Services Program. Mr. Pederson advises that the Emergency Medical Services Program has received
a federal grant for the ensuing year which will satisfy their financial needs without any soli-
citing from county governments in 1977. Mr. Pederson further informs me that NACHPO is being
re -organized and the new _name for the organization will be "The North West Wisconsin Emergency
Medical Services Council, Inc.". Each county involved with the new corporation shall through
its county board appoint a member to serve on the Board of Directors of the organization.
I am today appointing Charles Polich as a member to the organization. This appointment will
require confirmation of the county board. Please bring this matter to the attention of the board
on Friday, September 23rd.

Mr. Nelson, representing David M. Griffiths & Assoc., in regard to financial consulting
appeared before the board. Mr. Nelson stated that this consulting firm assists the counties in
availing themselves to all federal monies that might be available.
Moved by W. Johnson, seconded by Rave that Bayfield County engage Griffiths & Assoc. in a
contract for recovering federal dollars.

The following resolution was read: No. 10
WHEREAS, the Bayfield County Highway Dept. has located a substantial amount of gravel
in the. Wz of the SEµ, Section 35, T. 45 N. R. 6 W., Town of Grand View, and
WHEREAS, the source of gravel would be a benefit to the Highway Dept. and the surrounding
townships, and
WHEREAS, the Highway Dept. has requested of the Forestry Committee that the jurisdiction
of the parcel mentioned above be turned over to the Highway Dept. for the purpose of producing
crushed gravel, and
WHEREAS, the Highway Dept. has secured the Town Board approval on August 29, 1977 and a
conditional land use permit for a gravel pit from the Bayfield County Zoning Committee, and
WHEREAS, the Bayfield County Highway Committee has by committee action on Sept. 14, 1977
requested the Executive Committee to appraise the parcel of land mentioned above,
NOW THEREFORE BE IT RESOLVED, that the Bayf ield County Board of Supervisors hereby
awards jurisdiction of the above mentioned parcel of land to the Highway Dept. for the ap-
praised value set by the Executive Committee.

In order to promote the safety, convenience and enjoyment of public travel, to preserve the natura.
beauty of Wisconsin, to aid the free flow of interstate commerce, to protect the public invest-
ment in highways, and to conform to the express intent of Congress to control the erection and
maintenance of outdoor advertising signs, displays and devices adjacent to the National System of
Interstate and Defense and Federal -Aid Primary Highways, it is deemed necessary in the public in-
terest to control the erection and maintenance of billboards and other outdoor advertising devices
adjacent to or visible from the above described portion of said system of highways.
Therefore, pursuant to authority granted under Sections 84.09 and 84.30, Wisconsin Statutes, as
amended by Chapter 197, Laws of 1971, the Highway Commission hereby orders that:
1. The required signs or interests as shown on the plat shall be acquired by the Division of
Highways, in the name of the State of Wisconsin.*
2. This order supersedes and amends any previous order issued by the Commission.

To: County of Bayfield, a municipality of the State of Wisconsin, as provided by Section
345.05(a), Wisconsin Statutes, and to the Clerk of said County:
Claim is hereby made, pursuant to Sections 59.76, 59.77 and 345.05, Wisconsin Statutes,
by the undersigned, Kim Louis Magnuson, Herbert Magnuson and Lillian Magnuson, whose address
of their usual place of abode is 805 Ninth Avenue West, Ashland, Wisconsin 54806, as follows:
CLAIM OF K124 LOUISE MAGNUSON
The claimant, Kim Louise Magnuson, claims damages for personal injuries sLu tained by her
on the 22nd day of November, 1974, when, as the claimant Kim Louise Magnuson was riding as a
guest passenger in a 1965 model Chevrolet 4-door sedan, operated by.Mark K. Pycha, said
Chevrolet collided with a Caterpillar Road Grader owned by Bayfield County, being operated at
the time of the -collision by Thomas A. Kovachevich, an:employee of Bayfield County, in the
scope of his employment, on U. S. Highway #2 in the Town of Eileen in Bayfield County, Wiscon-
sin. The collision and the personal injuries sustained by Kim Louise Magnuson were caused by
the negligence of Mark K. Pycha and Thomas A. Kovachevich. The negligence of Thomas A. -
Kovachevich is imputed to Bayfield County by reason of its being committeL by Thomas A. Kovache-
vich in the scope of his employment by BayfieldCounty. Kim Louise -Magnuson sustained multi-
ple personal injuries, including extensive and severe facial lacerations and multiple fractures
of bones -and teeth. Kim Louise Magnuson suffered, by reason of the collision involving the
Bayfield County. Caterpillar Road Grader on November 22, 1974, due to the aforesaid personal
injuries, severe pain and anguish and she has been obliged to undergo professional medical
and surgical care and will be.obliged to undergo further professional medical and surgical
care in the future. Bayfield County, Wisconsin, its officers and employees, had actual notice
of the collision and the injuries and damages suffered by Kim Louise Magnuson immediately after
the happening of the collision.
As the sole, direct and proximate result of the collision, solely, directly and proximately
caused by the negligence of Mark K. Pycha and the negligence of Thomas A. Kovachevich in his
operation of the Caterpillar Road Grader for Bayfield County in the course of its business,
Kim Louise Magnuson has suffered damages and she therefore makes claim of, upon and against
Bayfield County:
For past and future pain,suffering and anguish, for temporary total disability,
for permanent partial disability, including facial scarring..for impairment of
ability to conduct the ordinary non -vocational affairs, .pursuits and recreations
of life, in the sum of $125,0.00.00
For expenses of procuring and providing medical and surgical care, hospitalization
and the like, since attaining the -age of eighteen, and likely to be incurred hence-
forth $ 10,000.00
no part of which has been paid.
CLAIM OF HERBERT MAGNUSON
The claimant, Herbert Magnuson, father of Kim Louise Magnuson, restates, with the,same
effect as though fully set forth herein, each of the matters set forth in the foregoing claim
of Kim Louise Magnuson.
As the sole,_direct and proximate result of the personal injuries sustained by Kim
Louise Magnuson, the -daughter of claimant Herbert Magnuson, which personal injuries were the
sole, direct and proximate result of the aforesaid collision resulting from the combined
negligence of Mark K. Pycha and Thomas A. Kovachevich, the negligence of the latter being
imputed to Bayfield County, the claimant Herbert Magnuson has been obliged to pay and incur

reasonable expenses in procuring and providing medical and surgical attendance and hospitalization
for his said daughter, by reason of which the claimant Herbert Magnuson makes claim of, upon and
against Bayfield County:
For expenses in providing and procuring medical and surgical care, hospitalization
and the like_ $ 10,000.00
For impairment of the companionship and services of Kim Louise_
Magnuson $ 7,500.00
CLAIM OF LILLIAN MAGNUSON
The claimant, Lillian Magnuson, mother of Kim Louise Magnuson, restates, with the same effect
as though fully set forth herein, each of the matters set forth in the foregoing claims of Herbert
Magnuson and Kim Louise Magnuson.
As the.sole, direct and proximate result of the aforesaid collision and the personal injuries
suffered by Kim Louise Magnuson, daughter of claimant Lilliam Magnuson, claimant Lillian Magnuson
has sustained and will sustain in the future loss of aid, society and companionship of her daught
by reason of which the claimant Lillian,Magnuson makes claim of, upon and against Bayfield County:
Past and future loss of.aid, society and companionship of Kim Louise Magnuson $ 7,500.00
WHEREFORE, the claimant Kim Louise Magnuson demands of Bayfield County the sum of $135,000.00
and the claimant Herbert Magnuson demands of Bayfield County the sum of $17,500.00 and the c

Attorney Richard Wartman appeared on behalf of his clients Mr. and Mrs. Merton Heuer and
spoke in favor of also changing Government Lot 2, Section 22 Township 50 North Range 4 West,
described in Volume 233 Page 481 and Volume 228.Page 367 less parcels described in Volume 275
Page 221 from Residential -Recreational to Commercial Use.
The zoning committee had considered the matter and recommended that that request be denied.
Mr. Renoos explained the reason for denial saying that the committee was .not necessarily opposed
to changing that particular description but they felt it should not be done piecemeal but rather
that the Town of Bayfield, City of Bayfield and Zoning Committee get. together: and make some plans
for rezoning the whole area lying between the City of Bayfield and the Sanatorium. Mr.'Renoos
urged the board to support the action of the zoning committee.
Question was asked for on the adoption of the Amendatory Ordinance. Motion carried.

WHEREAS, the 1976 Ashland-Bayfield County Bi-Centennial Committee has completed its work and
is no longer in existence and during its existence had income totaling $20,483.79, had expenditures
amounting to $20,355.43 leaving a cash on hand balance of $180.16 and still has a balance remaining
�` n due to the Daily Press of Ashland, Wisconsin of $4,051.00; and

WHEREAS, certain B-Centennial Committee materials remain on hand which materials are as
follows: 500 pictorial booklets which had a sale price of $2.00 each; 300 chronical newspapers
which had a sale price of $1.00 each and 1,000 gift books which had a sale price of $1.00 each;
and
WHEREAS, the Daily Press has agreed to compromise this debt in the hope of resolving this
matter along the following lines:
The $4,051.00 balance due to the Daily Press would first be reduced to $3,500.00 by the
Daily Press reducing the bill by $551.00; that the Daily Press would purchase the 300 remaining
chronical newspapers from Ashland-Bayfield County to reduce the "-3,500.00 balance by $300.00
to a balance of $3,200.00; that the Daily Press will without charge advertise for the sale of
the remaining 500 pictorial booklets in an attempt to help Ashland and Bayfield Counties to sell
the balance of these booklets with the proceeds from the sale of such booklets to be divided
equally between Ashland and Bayfield Counties; that this $3,200.00 balance could be reduced to
of $180.16; that this
$35019.84 by applying the cash -on -hand balance of the Bi-Centennial Commi.tt.Qe._be paid by Ashland
balance of $3,019.84 remaining due
County paying $1,509.92 to the Daily Press and by Bayfield County paying $1,509.92 to the Daily
Press; and
WHEREAS, in order for this financial arrangement to be feasible both, Ashland and Bayfield
Counties would have to consent, and
WHEREAS, Ashland County has approved the payment of $1,509.92 to the Daily Press provided
Bayfield County also approves payment.of a like amount, now therefore be it
RESOLVED, that the Bayfield County Board of Supervisors go on record approving the above
stated arrangement and approve the payment of the sum of $1,509.92 to the Daily Press, said
amount to.be taken from the county contingency fund.

The next matter to be brought to the- attention of the county board was the sale of a small
parcel of land in the Town of Tripp to the U.S. Fish and Wildlife Service. The matter has been
discussed at several prior county.board meetings and had always been held over for further study.
Present to discuss the matter were.Ervin Harnois, chairman of the Town of Tripp, G. Wm. Frankie,
resident of the Town of Tripp and former town chairman, Steve Schram .from the DNR and Ted
Kavajecz, former resident of Tripp now residing in Barksdale. Mr. Harnois stated that he nor

the Town of Tripp was not necessarily opposed to the fish hatchery being built in the Town of
Tripp or the sale of land by Bayfield County, but that they were merely asking for time to gather,
more information on what impact, the hatchery would have on the Town of Tripp. Mr. Frankie and Mr.
Kavajecz spoke in favor of the county selling the parcel to the Fish and Wildlife Service and
Steve Schram stated that the DNR has not had the opportunity yet to thoroughly study the matter and
therefore they were not taking any position at this time.
The county clerk advised the board that Vincent Schurr, appraiser for the U.S. Fish and
Wildlife Service had advised him several weeks ago that they are re -appraising the property as the
original appraisal was made in 1976 and it appears that property values have increased in many in-
stances since the last appraisal. The clerk advised the board that Mr. Schurr had told him that
they were not pressing for purchase of the property until the new appraisal is completed. Members
the board indicated that they thought that the county should take action at this time and authorize
sale of the property subject:to the new appraisal.
Moved by Polich, seconded by Spears that the Executive Committee be authorized to sell the p
described as 66 feet on each side of the stream in the Ell SWµ NEµ, Section 10-48-8.

Don MacRae, sales and public relations director of the Wisconsin Indianhead Country, next
appeared before the board. Mr. MacRae requested $500 toward support of the Wisconsin Indianhead

has considered the matter and they have entered a line in their budget, but,have not to date enter
any dollar figure covering the item.

Wallace Johnson informed the board on the progress made to date on the construction of a
new county rest home. He stated that 5 financial firms had been interviewed in regard to the

Larry Seidel reported on the progress of the Sanatorium in regard to Bayfield County
purchasing said facility. The committee has had one meeting and it appears that there are
many problems involved if the county were to purchase the facility. He stated that the com-
mittee has conferred with legal counsel on the matter and it appears that the agreement re-
garding the sewage disposal plant is quite vague as, to the responsibility of the counties
following sale of the property. Mr. Seidel stated that the committee will attempt to get a
legal opinion on the agreement and following that, they will meet again and hope to make some
recommendation to the county board.

The following resolution was read: No. 26
WHEREAS, on June 17, 1977, a Petition for Election involving Municipal Employees was
filed by the Wisconsin Council of County and Municipal Employment Relations Commissinn, and
WHEREAS, an election date has been agreed upon by all parties, such date being September
28, 1977, with voting times of 2:00 p.m. to 3:00 p.m. in the afternoon in the County Board Room
in the County Courthouse, Washburn, Wisconsin, and
WHEREAS, the purpose of the election will be for all employees of the Courthouse, including
dispatchers in the sheriff's department, all professionals, clericals and case aides of the
social services, but excluding supervisory employees, confidential employees and elected officers,
including but limited to, social services employees: comp. services supervisor, administrative
assistant and the confidential secretary to the County Clerk and the District Attorney to vote
on whether they want the above union as their sole and exclusive representative. In addition,
the professional employees will have a self-determination election amongst themselves to determine
whether or not they wish to be included in the bargaining unit, and
WHEREAS, it is the desire of the Bayfield County Board to act in the best interests of its
employees at all times, and
WHEREAS, in a resolution dated August, 1977, the Bayfield County Board pledged itself to
respond fully and openly regarding this matter so that all of its employees may have the
benefit of the information that they need to decide this matter after careful consideration, based
upon a full understanding of all the facts concerning representation by a labor union, and
WHEREAS, the County Board, in a series of letters, has discussed some:of the more important
aspects of union representation, including the uncertainties of collective bargaining, uncer-
tainties as to time, as well as result, the loss of individual freedom and the risk of an illegal
strike, as well as the payment of dues and assessments, and
WHEREAS, for the above reasons,discussed more fully in the letters provided to all employees,
the Bayfield County Board believes that representation by a, union is not in the best interests
of its employees. Now, therefore, be it
RESOLVED, that the Bayfield County Board does believe that effective communications,
based upon true understandings between employer and employee is the solution to most any problem
that can face an employee and his employer, and it is the desire of each and every member of the
Bayfield.County Board to promote these policies, to develop understanding and to create a system
of effective communications, both through its grievance procedure, as well as with the County
Board directly through its committees and its members, as well as County Department Heads, nd
be.it further.
RESOLVED, that while there may be problems now, as well as in the past, it is the belief of
the Bayfield County Board that outside representation by a union such as AFSCME is not the
solution to these problems, but the solution lies in the willingness of everyone to communicate
effectively with a true desire to solve problems, and be it further
RESOLVED, that the Bayfield County Board asks all of its employees who are eligible to vote
in the election on September 285 1977 to set aside their differences, rededicate themselves to
the policies mentioned above, and vote no to union representation by AFSCME, and be it further
RESOLVED, that the Bayfield County Board thanks all of its employees for their time and
understanding through the last several months.

WHEREAS, the Town of Clover being a municipality in Bayfield County and;
WHEREAS, there is a demand for land acquisition for off -road parking facilities and
turn -around for fishermen to have access to the Cranberry River and Lake'Superior, and;
WHEREAS, these facilities are consistent with the goals of providing public recreation facili-
ties as identified in the Bayfield County Outdoor Recreation Plan;
NOW, THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors adopt this amend-
ment as part of the Bayfield County Outdoor Recreation Plan.
