Barningham, co.board chairman. The following members answered roll call: No. 1 Edwin Erickson, Zxthur Meierotto, Ila Bromberg, Eric Johnson, William Zamback, Bennie Rude, Larry Seidel, William Rave, Herbert Spears, Wallace Johnson, Ernest Heglund, William Carter, Arthur Hanson, Joseph Berweger, Charles Polich, Karl Ludzack, Edwin Renoos, Walter Barningham Total present 18 A prayer and pledge of allegiance was'led by Larry Seidel, board member. Moved by Seidel, seconded by E. Johnson to dispense with the reading of the minutes of the previous meeting. Motion carried. The 1977 Annual Report of the Bayfield County Highway Committee was presented: No. 2 Moved by Polich and seconded'by Hanson that the report be received and placed on file. Motion =ried. (Report on file in the county clerk's office.) Motion No. 3 Moved by Bromberg, seconded by Hanson that a letter go to each department head re- questing that their annual report should reach the county board members at least 5 days prior to the county board meeting. Motion carried. The following Report of the Highway Commissioner was presented: No. 4 Moved by Spears, seconded by Berweger to receive the foregoing report and place it on file. Motion carried. The following communication was read: No. 5 COUNTY HIGHWAY COMMISSIONER Washburn, Wisconsin 54891 November 1, 1977 County Board Members: - I am writing this letter in response to a letter received from Mr. Pajala, County Clerk, regarding the F.A.S. Construction Project on CTH"A". 218 vember 15. 19 Concern was expressed over the alleged hardships and excessive maintenance costs to the Towns of Oulu -and Orienta on the town road system because of the Construction Project on CTH"A". I can assure you that we too are concerned over the progress of the project and are fully aware that traffic has increased on the town road system in spite of the properly marked detour which is marked as follows: CTH "B" from its intersection with CTH"A" west to the county line, Douglas County Trunk "H" and State Trunk 13. The County is responsible for the maintenance of the detour route during construction. The detour route was selected to avoid any excessive use of the town roads. If the Towns have suffered any hardships or excessive maintenance because of our Construction Project it is beyond the control of the County as are any of the other roads in the County that are affected by other Construction Projects in the County. The town roads are public highways for which the Towns receive gas tax aid and therefore are subject to the use of the traveling public. If the town roads were marked as a detour route then it would be the County's responsibility to properly maintain these roads. The Highway -Committee has in the past had to ask the County Board to appropriate funds for various Construction Projects and presently has asked for appro- priations to the Road and Bridge Fund just to keep abreast of rising costs. The County Trunk Highway allotment no longer is sufficient to properly maintain the County Highways at a high level. We cannot justify the use of County Trunk Highway Funds to maintain the town road system when we have not used their roads for our detour. We have in the past had agreements with various townships for the use of their roads for detours on other projects which the County was,responsibl for the maintenance and repair of, but only when they are used as detours. Mr. Pajala's letter stated that many Board Members were wondering why the project was taking so long because it was not a project of major proportion. In my estimation, any time you are spending nearly a half million dollars, constructing two bridges, and reconstructing nearly two miles of road, it is definitely a Major Project..... The reason for the length of time the project is taking can be readily understood by merely taking a look at the adverse weather conditions we have experienced since about mid -June. Rain has definitely been a detriment to any type of road building, building construction, farming, etc. The Construction Project was first let to bid in early Spring of 1976. The bids came in rather high at $507,999.63 and the Highway Committee rejected the bids as being excessive. The Committee, at the recommendation of the State, sat down and looked over the quantities and special provisions of the contract and agreed to rebid the project and allow the project to be completed in two segments during two construction seasons. As a result of the rebidding the County realized a savings of $72,499.85. The low bid on the rebidding was awarded to Duffek Sand and.Gravel for $435,499.78 when the bids were reviewed in June of 1976. The contract time was for 220 calendar days. Work began on July 26, 1976, and the contract was suspended for the season on November 22, 1976. One hundred twenty calendar days were used in 1976, 85 of which were working days (days not including weekends and holidays). The contractor resumed work on May 31, 1977, with 100 calendar days left to go on.the contract time. As of October 31, 1977, there were 153 calendar days used up. Of these days, 45 were rain days or days on which the grade was too wet to work. I would have to assume at this time that the con- tractor will apply to the State and Federal Highway people for a contract extension because of the adverse weather conditions and I am quite sure that an extension will be granted. We, in the Highway Department, have been very concerned over the progress of the project on CTH "A". We have done everything in our power to speed up construction and to have the job com- pleted so as not to inconvenience the public, residents and municipalities surrounding the pro- ject. The State of Wisconsin District Highway Office as well as the County Highway Office has received numerous calls in regard to this -project and we have done our utmost to respond to the needs of these callers, but we have no control over the weather,_ Should there be any questions involving the above project or any other highway matters, please feel free to contact me at any time. Vernon Frostman, chairman of the Town of Oulu, spoke on the matter and read from a prepared statement the cost of maintenance on the Town of Oulu portion of the road that has been used during the re -construction of Highway "A". Mr. Frostmanrs statement showed that the cost of maintenance during 1976-77 had more than doubled over the cost of maintenance.on that portion of the road in 1975. It was pointed out that the highway department had designated Highway "B" and STH 13 as the detour route during the construction period, but due to the difference in mileage over the posted detour and the town roads about 75% of the normal traffic was using the town road ovember 15. 1977 rather than using the posted detour. Mr. Young pointed out that the highway commissioner had no control over traffic on town roads and that as the town road was not the posted detour, the county highway department was not liable for damages to the road. Motion No. 6 Moved by Polich that the matter be referred to the highway committee to work out some reimbursement to the towns for additional maintenance costs on the town roads involved. Motion lost due to lack of a second. The following petition was read: No. 7 COUNTY BRIDGE AID Section 81.38 To the Honorable County Board of Supervisors Bayfield County, Wisconsin Gentlemen: This petition of the Town of Oulu, Bayfield County, Wisconsin, respectfully represents and shows to your honorable 6,o4y that: The bridge on the Airport Road crossing the Iron River in the NWµ of the SWµ, Section 12, Township 48 N. Range 9 W. on a public highway maintainable by the Town of Oulu required immediate emergency replacement in accordance with the provisions of Section 81.38 of the Statutes. The Town of Oulu provided for such portion of the cost of construction as required by Statute.. The total cost of replacement is $1835.86. Wherefore, Petitioner prays and makes this petition to your honorable body for County Aid for one-half of the cost to said Town of Oulu in the amount of $917.93, all in accordance with Section 81.38 of the Wisconsin Statutes. The following petition was read: No. 8 COUNTY BRIDGE AID Section 81.38 To the Honorable County Board of Supervisors Bayfield County, Wisconsin November 15, 1977 This petition of the Town of Grand View, Bayfield County, Wisconsin respectfully represents and shows to your honorable body that: The bridge on the Trapper's Lake Road, known as the Trapper's Lake Outlet Bridge, in the NEµ of the SEµ Section 27, Township 44N, Range 6 W on a public Highway maintainable by the Town of Grand View required immediate emergency replacement in accordance with the provisions of Section 81.38 of the Statutes. The Town of Grand View has provided for such portion of the cost of construction as required by Statute. The total cost of replacement is $2864.65. The following petition was read: No. 9 OOUNTY BRIDGE AID Section 81.38 To the Honorable County Board of Supervisors Bayfield County, Wisconsin This petition of the Town of Delta, Bayfield County, Wisconsin, respectfully represents and shows to your honorable body that: The bridge on the Pi.Xe River Road crossing the White River in the NEµ of the NEµ, Section 21, T. 46 N., R,.. 7 W., on a public highway ma.intainab+e by the Town of Delta requires additional County Bridge Aid as follows: The total cost to the Town of Delta was $28,290.22. One half the cost would be $14,145.11. Bridge Aid approved by the County Board in November 1976 was $11,015.00, therefore additional Bridge Aid would be $3,130..11. The Town of Delta provided for cost of construction as required by Statute. Wherefore,: Petitioner prays and makes this petition to your honorable body for County Bridge Aid for $3,130.11, all in accordance with Section 81.38 of the Wisconsin Statutes. Motion carried. ,21 November 15, 1977 The following resolution was read: No. 10 COUNTY AID CONSTRUCTION AND MAINTENANCE DURING THE CALENDAR_' YEAR 1978 The County Board of.Supervisors of Bayfield County, Wisconsin, regularly assembled, does hereby ordain that such funds as may be made available to the county for highway work in the year 1978 shall be expended as hereinafter set forth: WHEREAS, the State Department of Transportation made the first payment of transportation aids to Bayfield County in the amount of $94,249.41 on October 3, 1977, as prescribed by the 1977-79 State Budget Law and, WHEREAS this is the first of four approximately equal payments, the next three payments to be made January 2, April 3 and June 26, 1978, a total amount of approximately $376,997.64, BE IT RESOLVED that the County Highway Committee is authorized and directed to expend the said sum to the extent required to match and supplement Federal Aid for construction, right- of-way and other costs on any Federal projects located on the county highway system of said county, which are not recovered from Federal funds, and to expend any balance for construction, repairing or maintaining such county trunk highway system and the bridges thereon, and for other authorized purposes as required including maintenance of buildings, snow and ice removal and control and to re-imburse the general fund for any expenditures that may be made therefrom. WHEREAS appropriations are made in the Bayfield County budget for 1978 in addition to the amounts to be received from the state, BE IT RESOLVED that this Board does hereby direct that any balance remaining in any appro- priation for a specific highway improvement after the same shall have been completed may be used by the County Highway Committee to make up any deficit that may occur in any other improve- ment, which is part of the same item in the county budget, and any balances remaining at the end of the'year in any highway fund shall remain and be available for the same purpose in the following year. BE IT FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to make payments for the purposes for which such funds are to be used, as hereinbefore authorized, from any funds in the county treasury that are not required for the purposes for which appro- priated -and to re-imburse such funds in the county treasury from highway revenues. WHEREAS the County Highway Committee and the County Highway Commissioner are charged with the duty and responsibility of carrying out the construction and maintenance of highways for which provision is made, and other related supervisory and administrative duties, BE IT RESOLVED that the County Highway Commissioner shall have the authority to employ, discharge, suspend or reinstate such personnel as he deems necessary for such purposes, pro- vided, however, that the County Highway Committee may by action recorded in its minutes determine the number of persons to be hired and may also at any time by action so recorded order the County Highway Commissioner to employ discharge suspend or reinstate any such person. The - term "pe,rsonnel" or "person" shall include all patrolmen, laborers, foremen, clerks, stenographerE or other employees necessary to carry on such activities. November 15, 1977 The following resolution was read: No. ll Be it resolved by the Bayfield County Board of Supervisors assembled in annual session this 15 day of November'1977, that the -County Board Chairman, County Highway Committee and County Highway Commissioner are hereby authorized to attend State Road Schools, conventions and/or other road meetings, and that their per diem and expense be paid from the County Highway Administration Fund. The following resolution was read: No. 12 PURCHASE OF HIGHWAY EQUIPMENT WHEREAS for the construction and maintenance of highways, including the removal and control of snow and ice, it becomes necessary from time to time to purchase equipment, the nature of and necessity for which cannot be accurately anticipated, THEREFORE, BE IT RESOLVED that the County Highway Committee is hereby authorized, pursuant to Section 83.015(2). of the Statutes, to purchase without further authority, and to the extent that revolving funds accumulated for such purpose or appropriations made for such purpose are available, such highway equipment as they deem necessary to properly carry on the work, and.to trade or sell such old equipment as may be considered to be for the best interests of the county. OF TRANSPORTATION August 15, 1977 TO THE TREASURER OF: SUBJECT: Supplemental Highway Aid County Trunk Highways Sections 20.395 (1) (qb) 1 and 20.395 (1) (qb) 2 Wisconsin Statutes June 30, 1977 The enclosed State Treasurer's check represents the balance of your 1977 highway aids pursuant to Sections 2.0.395 (1) (qb) 1 and (1) (qb) 2 after deducting the amount previously paid to you on April 15, 1977, in accordance with Section 20.395(1)(gb) 2e, Wisconsin Statutes. This allotment i supplemental to and is to be used for the same purpose as the county trunk highway allotment under Section 83.10(l). 2J 2 3 November 15., 1977 The total amount available for the counties is apportioned among them on the basis of the last allotment for county trunk highways under Section 83.10(1). OF TRANSPORTATION November 3, 1977 To All County Board Chairpersons, County Clerks, County Highway Commissioners, and Mayors of First, Second and Third -Class Cities, etc. Ba.yfield County Clerk Courthouse Washburn, WI 54891 Safer Off System Roads Through this letter, the Department of transportation is allocating an additional $54,528 of Safer Off -System Roads'federal highway aids to Bayfield.County from the 1977-78.apportionment of $4,299,846 for all Wisconsin off -system roads. The 1976-77 allocations were distributed through Robert T..Huber's letter of -July 2, 1976, and October 18, 1976. These funds may be obligated for improvement on any off -system public roads within the county; including county trunk highways, town roads, and the roads and streets of cities and villages. Each county is to determine improvement priorities on all off -system roads within county boundaries and select priority projects within the limits of the funds available. Towns, cities and villages should seek funding from the counties for their particular project needs. Congress has appropriated only $90 million of the $200 million authorized for the nationwide Safer Off -System Roads Program. They may yet appropriate the remaining $110 million. If not, the funds will be obligated on a first -come, first -served basis. Therefore, states, including Wisconsin, could receive less than the amount apportioned. 'Until -and if Congress appropriates the remaining $110 million, it is urgent that all counties act promptly to obligate their allocation for approved safety improvement projects. If not Wisconsin counties could lose a significant part of the $4.3 million now apportioned.. These allocations are not guaranteed and do depend upon the availability of federal funds at the time projects are ready for fund obligation. To make further improvements on Wisconsin roads and to expedite the overall program, an addi- tional $250,000 is made available statewide. Beyond their basic.allocations, counties may and are encouraged to apply for additional improvement funds up to $50,000. This will apply to any P. S. & E's submitted on or after October 18, 1977, to the Facilities Development Section of the Division of Highways from the Highway District Office.. November 15, 1977 In prior programs, counties have made extensive use of available funds to upgrade highway signs to standard levels and to replace unsafe bridges. These high priority needs may be expeditiously developed for federal approval. Safety funds may be used for engineering design of bridge re- placement as well as construction. Enclosed for your further information are copies of relevant Federal,Highway Administration circulars. Also, as you may well know, Safer Off -System Roads funds require a 30% match from the project sponsor. It is strongly suggested that you contact your District Engineer for further information and assistance in developing your Safer Off -System Roads Program. It is a high Department of Trans- portation priority to help counties develop projects and obtain their full fair -share of federal safety funds. Motion 226 November 15, 1977 The following communication was read: No. 17 NORTHWEST REGIONAL PLANNING COMMISSION Date: November 7, 1977 To: Bayfield.Co. Bd. Members From: Philip Scherer, Transportation Planner Northwest Regional Planning Commission Subject: Apostle Islands Notional Lakeshore Area Transportation Study Dear County Board Member: As a result of establishment of the Apostle Islands National Lakeshore, local concern and interest in the area's ability to meet future transportation needs has become a critical and justifiable con cern of both Ashland and Bayfield Counties. Responding to local requests, the Northwest Regional Planning Commission was able to initiate a study and planning program that addresses these concerns The Study meets a number of basic objectives, including: 1. The identification of existing and projected travel demands and transportation needs throughout the two -county area; 2. Identification of alternatives available to solve these needs; 3. Preparation of an improvement program for carrying out.the most effective transportation - related improvements. . . I 4. Increase the understanding of area transportation problems and opportunities among the local agencies, representatives and residents. Administration of this two -county transportation study has been carried out by the Northwest Regional Planning Commission. Ongoing study management and review activities have been carried out by the transportation study advisory committee, formed under,the auspices of the Apostle Islands Advisory Committee. During preparation of the study, six meetings were held with the Advisory Committee to discuss findings and progress: Similarly, four additional meetings were conducted for review and comment by local residents. Sessions were held in both Ashland and Washburn with local comments and direction playing an important role in the development of this report. The study's advisory committee has endorsed the project report and has asked that it be presented to you for review. For this reason, it has been placed on the agenda for the November 15 County Board. meeting. , I . . To make our discussion more meaningful, I have enclosed a copy of the study report and flier. If you have the time, please page through these prior to the Board meeting. In that the budget for this project was somewhat limited, we printed a significant number of the fliers but fewer larger reports. For this reason, and because Ashland County has not yet reviewed the report, we would like to ask thatyouu bring the report to the meeting. He requested endorsement from Bayfield-County if they agree on the Study. Motion No. 18 Moved by Bromberg, seconded by Spears that Bayfield County adopt the transportation study. Motion carried. At ll'AM a motion was made by Erickson and seconded by Spears to adjourn and first travel to Bayfield and view the old Bayfield County Courthouse. The Historical Society has proposed that the building be renovated by the City of Bayfield and leased to the GSA to be used for an Apostle Islands National Park office building. The Historical Society has indicated that they will request a donation from Bayfield County to be used toward renovating the building. November 15, 1977 Walt Pomeroy who has been designated as.the.coordinator for the fund raising program for the.renovation project together with Don Stanius, architect, spoge:to the board at the Bayfield Courthouse site and led the board on a tour of the bulfling. At 12 noon the board went to the Bayfield Inn for noon lunch. Pajala County Clerk Bayfield County Court House Washburn, Wisconsin Dear Mr. Pajala: This is in response to the request of the Bayfield County Board of Supervisors for an opinion concerning the possibility of allocating monies received under Public Law 94-565, Payment in Lieu of Taxes, to certain towns and school districts in the County which contain national forest lands. The County's authority to spend money is strictly limited by the State Statutes. The County does not have authority to spend or allocate funds unless that authority is specifically enumerated in the Statutes. My review and research of'the Statuteshas uncovered no authority to make a. general allocation of funds. to towns or school districts. While the County may provide assistance to the towns for items specifically enumerated in the Statutes, such as a rural numbering system, Section 59.07 (65) or water shed protection areas, Section 59.07 (60) or Senior Citizen's programs, Section 59.07 (93), the County may not provide general aid to the towns. With respect to school districts, there appears to be no provision which would permit the County to make either a general grant of funds or a grant of funds for specific purposes. If the Board wishes to make a general grant of funds to either thp-towns or school dis- tricts or both which contain national forest lands, it seems the most appropriate means would be to secure a legislative amendment to Section 59.07 permitting the same. The following communication was read: No. 22 WISCONSIN COUNTY BOARDS ASSOCIATION August 16, 1977 - TO: County Board Chairmen and Clerks of Counties with Federal Lands FROM: Robert Mortensen, Wisconsin County Boards Association RE: Announcement of Federal Payments in Lieu of Taxes on Federal Lands During the last session of Congress, WCBA lobbied and promoted federal legislation authorizing federal payments to local governments to'partially compensate for the burden caused by property tax exemptions on federally -owned natural resource lands. The types of lands included are national forests, national parks, wilderness areas, Bureau of Land Management lands and water resource lands such as Army Corps of Engineers and Bureau of Reclamation projects. The issue during our last visit to Washington was appropriations' legislation. We needed dollars to back up the legislation passed two years ago. At the present time, the appropriations' legislation contains about $100 million to be distributed through a formula which simplified would pay local governments 75� per acre less current timber, mineral or grazing payments. There is also a per capita limitation on the payments based on a complicated sliding scale which restricts payments based on population from a maximum of $50 per capita for lesser populated counties, sliding down to a limit of $20 per capita for more largely populated counties. Payments will go directly to local governments and can be used for any local purpose. They are not restricted for use on roads or schools. More than 1,000 counties in,49 states would benefit from the legislation. Included in this total are 16 counties in Wisconsin, mainly in northern and western areas of the state. Recently, a Wisconsin and Michigan issue,emerged. Should the payments in Wisconsin go to towns or counties? Though the administrative procedures may change, we are now advised that the Wisconsin payments will be made to county government in September, 1977. Motion carried. Clerk Pajala read a memo taken over the phone from Senator Gaylord Nelson's representative regarding revenue sharing fund allocation by the county. Senator Nelson confirmed what had already been told to the board by the clerk that the local tax effort is a factor that is used in determining the amount of revenue sharing funds for each municipality and that when revenue sharing funds are used to offset the tax levy it does have a direct bearing on future revenue sharing receipts. It was also pointed out by the clerk that the county is limited in the amount of tax levy by the state levy limit law and unless the revenue sharing funds were used to offset some of the tax levy, the county tax levy would exceed the levy limit. Mrs. Benton first appeared before the board in regard to the Historical Society project of renovation of the old Bayfield Courthouse. R Paul Tychsen, coordinator of the DART Program, next was allowed the floor and he spoke on behalf of the DART Program and requested county appropriation of $5,000 toward the program. NWI 15. 1977 Mrs. Hammerschmidt, member of the DART board, also spoke in favor of the DART Program. Sandra Brown spoke in favor of the DART Program and also a county -wide program for the youth. Janet Maciosek, Barb Allison, Sharon I aedike and Gene Miller from the area served by the DART Program also spoke: in favor of the program.. Diane Brander of the ABC Developmental Center appeared before the board and spoke on the developmentally disabled program in the county. Dave Armant, counselor at South Shore High School, appeared and commented on the services provided by the 51.42 board stating that the schools were not.now receiving the services that they had received when Bayfield County was part of the 4 county Unified Services Board. The purpose is to allow the public to present written and oral comments and suggestions on the possible use of Revenue Sharing funds in the amount of $165,127..00. The Bayfield Chapter of the Bayfield County Historical Society wishes to request some of these funds. The chapter is presently negotiating with the General Service Administration (GSA) to lease space for housing the headquarters of the Apostle Island National Lakeshore. The initial lease for this will be'for ten years with repeat options for five year periods thereafter. The space which we are offering is -'in the Old Bayfield County Courthouse on Washington Avenue, Bayfield. This letter and enclosed materials will give some details about our proposal...You may know that the history of the building is unusual and that it was one of the first Bayfield buildings to be placed on the National Register of Historic Places.. This.review will help you to better understand the unique bonds felt by many Bayfielders and Bayfield County residents, past and present, for this structure. As a site for Lakeshore headquarters, this building is peculiarly suitable. It was de- signed as a "model structure" for use of brownstone when quarrying of the material was near its height. The park now retells this boonwstone story with a quarry on display at Stockton Island. With commercial cutting of the stone long past, no other local facility could assume such appropriateness. -Our architect intends restoring the native wood interior trims to their 1884,elegance. The combined regional lumber and stone made this an impressive building.by news reports of that.day. It continues to be impressive today. Reconstruction of the clock tower, which dominated the early landscape, will still today afford an unhampered view of lake, surrounding islands and shoreline. Access now planned to have this integral part of the original building become an observatory for visitors would be a doubly interesting feature. 23 2 I- s November IS1977 Landscaping about the building now exists in the style of that day - maples outlining boundar near streets and walks. After renovation little would need doing for beautification beyond what volunteer citizens could handle. Only space beyond the city limits could compete with'the Dpportunity on this city block of property for uncrowded and convenient parking. A considerable bonus found in the 60 x 72 foot building is a third floor auditorium area not needed for park requirements. Such space has been to t in Bayfield for the past twenty years. With the planned elevator access this would be a prime place for senior and other community functions, theatre, musicales, etc. A historical museum could also be housed, a good adjunct for the park displays. Two former tennis courts on the grounds are presently lost under storage rather than for community recreation for both -youths and adults. Bayfield would gain both pride and dollars in having this'National Register site activiated again. Restoring it to current usage has been a continuing goal of our society. The following resolution was read: No. 31 WHEREAS, the Bayfield County Board of Supervisors has accepted the responsibility to carry out the terms and the objectives of the federal grant offer by .the United States Environmental Protection Agency for funds to demonstrate methods of sediment and erosion control in the red clay area of Northern Wisconsin and Minnesota which includes Ashland,-Bayfield, Douglas and Iron Counties in Wisconsin and Carlton County in Minnesota, and WHEREAS, a grant of 3.6 million dollars was approved by N.S.E.P.A. and the Bayfield County share of this Grant will be approximately $225,252.00 to be used to demonstrate methods of sedimentation and erosion control in the Pine Creek Watershed in the Town of Pilsen, and WHEREAS, the planning phase of the project has been completed and much of the soil survey work, land mangement practices, land treatment practices, and channel protection measures have been completed or are in the process of completion as identified by the U.S. Soil Conservation Service and approved by the Bayfield County Soil and Water Conservation District Supervisors for implementation, and WHEREAS, the 25% non-federal share of project funding must be assured by the State, County, Local and Private Contributions of in -kind services and funds, and WHEREAS, at their April 1975 meeting, the Bayfield County Board of Supervisors by Resolution pledged their continued support of the Red Clay Project with the carryover Phase I appropriation and if needed a budgeted amount of not more than $10,000 per year for.1977 and 1978, and WHEREAS, while the County share of,the Phase I cost in the amount of $1127.00 was paid, no other funds have been submitted by Bayfield County for this program, and WHEREAS, there is some doubt as to how much cost sharing funds are needed.to complete this project in 1978 because, State Agencies, Bayfield County Employees and Supervisors, the Town of Pilsen and local landowners are also making in -kind contributions to this program, and NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors appropriate $1200 for the county share of the cost of the Red Clay Project for the 1978 fiscal year, and BE IT FURTHER RE SOLVED, that the County Clerk be authorized to issue payment of sufficient funds to meet Bayfield County's share of the 1978 cost of this project as approved by the Bayfield County Soil and Water Conservation District Supervisors. Clerk Pajala explained to the board that Mr. Jackson had inquired of him about the possible value of the school 40 which is located northwest of the Washburn cemetery. He advised the board that the county had sold the 40 to the Washburn School District in 1959 and thatat the time of the sale another motion was passed by the county board providing that any lands sold to the school district for school.forest purposes should be used as a school forest and if they ceased to be used as a school forest they should revert back to the county. He stated that the Washburn School District now wishes to purchase two blocks of land in the City of Washburn immediately west of the present athletic field and the school district would now wish to dispose of the school forest land to raise funds for the purchase of the two blocks in the City of Washburn. Pajala stated that he had adv..,ised Mr. Jackson that the 40 acre parcel would probably now sell for about $6,000. Bob Olson together with Rosemary Bodin, members of the Washburn School Board, were present and Mr. Olson spoke to the -board requesting the county to lift the restriction on the land allowing the school district to sell the land. The following communications were read: November 14, 1977 Bayfield County.Board of Supervisors Bayfield County Courthouse Washburn, WI 54891 Gentlemen: When the Personnel Committee first re -adjusted the wages of some of the employees, they had some of the clerks and secretaries wages adjusted effective July 1, 1977 and the rest effective Janaary 1, 1978. The latter were those that received one adjustment on July 1, 1977 but were re -adjusted c the new schedule. On the night of the meeting of the Personnel Committee with the employees on November 8, 1977, June Eskola.went before the committee and commented on this and asked that we be re -adjusted back to July 1, 1977. We -were told this was an oversight and it would be corrected. Janet Shefchik said that this affected the clerks, too, and the Committee said that they understood this. Now they have sent around a new adjustment proposal and the secretaries were adjusted back to July 1, 1977, but the clerks were.not. We are hoping you will correct this error. We would also like to know why some of the secretaries are worth more than others. We feel that all of the secretaries have the same responsibilities, unique to her own office. We feel that if some secretaries are worth more, then their title should be changed in order to avoid the look of discrimination. We hope you gentlemen will take another look at the schedule before it'is passed'in its present form. We are speaking for all the Secretaries and Clerks, not just the undersigned. Seventy-five percent (75%) of the County employees have b-een recommended or have received a salary increase from or retroactive to July 1, 1977. However, another twenty-five percent (25%) of the employees, or 25 employees, because of a previous salary problem, have been recommended to receive an increased, revised salary beginning on Jarivary.l, 1978 rather than July 1, 1977, a full six months behind their peers of --equal status. Why are some worth only fifty percent (50%) of their salary increase back to July 1, 1977 and some worth one hundred percent (100%) of their salary increase back to July 1, 1977? We feel the salary schedule maladjustments for these 25 employees began on July 1, 1977 and all salary -schedule readjustments should go back to this date. We are hoping the County Board members will make a fair evaluation of this dilemma. Thank you for giving this problem your attention. He noted that there are secretaries in the courthouse who will be receiving a higher rate of pay than the secretaries in the.Extension Office and he was wondering what the reason was. He stated that if there is a reason why some are worth more than others, he would like to know so that he can go back and tell the reason.to the secretaries in his office. Mr. Dashner also appeared before the group and spoke on the past history of the wage adjustments,. He again advised the board that he has worked out a salary schedule placing the employees in groups with similar responsibilities and similar salaries. It appeared that most dissention was coming from members who objected to the several levels of pay for secretaries. It was pointed out that under the proposed schedule, secre- taries would actually be receiving salaries of $770 - 790 and 800 per month. Polich said that the board could adopt this schedule now and then changes could be made later and adopted at the February meeting, effective 1/l/78. A discussion was held on dropping the salaries of all the secretaries back to $770. The clerk pointed out that as the salary of the secretary `who'is now receiving $800/month in not covered by the resolution before the house,"i't should be made clear whether or not any reductions in the proposed schedule would apply to that secretary as well as those who are included in the proposed salary schedule. fA Motion No. 42 Moved by Bromberg, seconded by Rave that the salary schedule be referred back to the Personnel Committee to attempt to iron out the differences in the salaries of the employees. Director, appeared before the board and stated that Jerry Miller from the Governmmnt Surplus Property Department was present and he wished to show the board some slides and discuss with them the possibility of another surplus property distribution center in northern Wisconsin. Mr. Miller then made a 20 minute slide presentation and advised the board that there a presently 5 distribution centers in Wisconsin which is more than any state in the union and plans are underway to set up a sixth distribution center somewhere in northern Wisconsin. The guide- lines provide that the center should be not more than 55 miles from a major population center such as Superior. If the center were to be locatecL in Bayfield County it should be somewhere in the vicinity of Iron River, Ino or Benoit to fall within the 55 mile limit. Gylund stated that it would be advantageous to the county if one member of the county board could be designated as the representative of the county board to work with Mr. Miller and himself in attempting to estab- lish the distribution center in Bayfield County. November 16., 1977 Motion No. 44 Moved by Polich, seconded by Seidel- that,Bill Carter be designated as the Bayfield County representative to work with the C. D. office in establishing a distribution facility for fed- eral eX cess property in Bayfield County. Motion carried. No. 45 Mary Torstveit, representing school drug and alcohol programs, next appeared before the board. She stated that she has put together an alcohol and drug abuse program for all the schools in the county. She explained that the schools need such a program as the schools were left with no program since the county formed a single county Unified Services Board. The following resolution was read: No. 46 WHEREAS, the Department of Industry, Labor & Human Relations and The Wisconsin Department of Corrections did in 1976 call to the attention of Bayfield County certain deficiencies in the Bayfield County Jail, and WHEREAS, the Department of Industry, Labor & Human Relations and the Wisconsin Department I of Corrections has informed Bayfield County that prisoners cannot be incarcerated in the jail unless the deficiencies are corrected, and WHEREAS, Bayfield County did in 1976 consider the construction of a new jail which was not approved by the county board and the Bayfield County Sheriff's Department has been forced to incarcerate all prisoners in other county jails because of the directives of the Department of Industry, Labor & Human Relations and The Wisconsin Department of Corrections, and WHEREAS, representatives of the Department of Industry, Labor & Human Relations and of The Wisconsin Department of Correctinns have now re -inspected the Bayfield County jail and have indicated that the jail could be again used for the incarceration of prisoners if certain improvements are made, and WHEREAS, the Bayfield County Sheriff's Commission is of the opinion that the necessary corrections can be made for a reasonable expenditure 4 monies, and WHEREAS, Bayfield County does have an amount of $125,705.83 in a segregated Building Fund which has been designated for the repair or construction of county buildings, and WHEREAS, the Sheriff's Commission is!of the .opinion that an indepth study should be made of the feasibility of making the necessary repairs to the Bayfield County jail to permit the incarceration of prisoners in the jail, now therefore be it RESOLVED, that the Bayfield County Sheriff's Commission, together with the Bayfield County Executive Committee, be hereby authorized and directed to make a study of the feasibility of making certain repairs to the Bayfield County jail to allow.for the incarceration of prisoners with the approval of the Department of Industry, Labor & Human Relations and The Wisconsin Department of Corrections, and be it further RESOLVED that if the said committees find that it would be 'in the best interest of Bayfield County to make such repairs, said committees are authorized and directed to proceed with said repairs and to expend an amount not to exceed $25,000.00 to cover the cost of such repairs. Neilson said that it would be necessary for the county to obligate itself to the sum of 2/ of the expected construction cost which is expected to be not more than $300,000.00. The county contribution would, therefore, be not more than $6,000. No further action was taken,._ 0 The following resolution was read: No. 52 BAYFIELD HISTORICAL SOCIETY WHEREAS, upon the dissolving of the old -County of LaPointe, the City of Bayfield was the first location for the Bayfield County seat from 1866 to.1892 and the old Courthouse still standing in Bayfield, which is constructed of native Lake Superior sandstone, served as the Bayfield County Courthouse from 1883 to 1892, and 2 %. November 16. 19 WHEREAS, The Bayfield Historical Society, a chapter of the Bayfield County Historical Society, whose official address is Courthouse,.Washburn, WI., seeks to purchase the Old Bayfield County Courthouse building and Block 61 on which said building is located in the City of Bayfield, and to renovate the building, all of which is dependent upon the successful,leasing of two floors of said building through the U.S..General Services Administration for use as.headquarters for Apostle Islands National Lakeshore for a minimum of ten years with renewable options every five years thereafter, and WHEREAS, the top floor of the building will be renovated into a large auditorium and meeting room for the use by Chequamegon Bay and Bayfield Peninsula region residents for meetings, con- certs, plays and the like, and WHEREAS, said lease is only acceptable to the Bayfield Historical Society if it is at a price ,I I adequate to maintain the total building and grounds, and WHEREAS, in December, 1976, the Bayfield City Council adopted a resolution to accept title to the Old Courthouse building and property, if necessary, upon completion of renovation for occupancy by the Apostle Islands National Lakeshore, and WHEREAS, the architectural firm of Staniui5 and Associates of Duluth estimates the total cost for renovation and restoration of the Old Courthouse at Bayfield will be approximately $600,000, and WHEREAS, The Economic Development Administration has indicated its interest in committing from $400,000 to $500,000 for this project if an acceptable lease offer comes from the G.S.A., and WHEREAS, the Wisconsin Historical Preservation Review Council granted $50,000 several weeks ago for a•Grant-1n-Aid for up to half of the total purchase cost of the building, this being the first such grant north of Wausau, and WHEREAS, this Grant -In -Aid money must be matched by money secured through local efforts, which includes revenue sharing money available to local units of government, and WHEREAS, the Bayfi'eld Chapter of the Bayfield County Historical Society has initiated a fund raising campaign of $100,000 in public and private contributions for use in the purchase of the building and property and for the construction of the auditorium and public meeting room, and WHEREAS, the renovation costs will be potentially available to local contractors on an open bid basis, and that this money could therefore have a positive economic impact on the Bayfield County region, NOW THEREFORE BE IT RESOLVED that the Supervisors of Bayfield County do allocate $10,000 from Revenue Sharing Funds or other monies to be paid after the successful negotiation of a lease for the Apostle Islands National Lakeshore Headquarters, indicating: First, tangible showing of our support for this Project, and Second, standing with the State of Wisconsin Historic Preservation Review Council in providing some funds for the purchase of the Old County Courthouse at Bayfield. Ed Erickson arrived at 10 A.M. NO. 55 Phil Scherer, Northwest Regional Planning Commission appeared before the board in regard to the abandonment of the Hayward-Ashland-Bayfield railroad. Mr. Scherer stated that the initial decision was made on November 10, 1977 and that there was a 20 day appeal period, but another 20 day extension for the appeal has been granted. He pointed out that if an appeal were to be made, the deadline, taking into consideration the extension, would now be December 20, 1977. Mr. Scherer pointed out to the board that he was of the opinion that there would be no purpose in filing an appeal unless the county was in a position to provide new or additional evidence that had not been provided to the ICC.at the previous hearing. He stated that his department or the attorney involved had no new evidence to offer at this time and he stated that it would, appear to be a waste of money to appeal without additional evidence. Mr. Scherer then went on to discuss the possibility of appealing with a recommendation for establishing a short line rail- road. He thought that there might be some possibility of establishing a short line railroad that could be operated either by the county or by some private operator. He estimated that the cost of the appeal and study for establishing a short line railroad might cost about $10,000 to $15,000 and.he stated that there would be available through his organization from $4000 to $6000 to assist in the financing. Either Bayfield County or several counties would have to finance the balance. Its very necessaryand long over -due. After 20 years in the resort business, at Herbster (cabins and motel), one learns a few things about our so "highly -touted recreational industry". Especially as it concerns our specific area. Some of these conditions affecting Bayfield County I would like to briefly mention: By far, the largest bulk of your tourist traffic takes #2, (unfortunately the merchants in both Ashland and Superior short-sightedly point out to the visitor that #2 is his fastest and most direct route.) This is undeniably true, but if he had been directed to take #13 for its scenic beauty.and varied points of interest, the picture often changes very dramatically. Your casual visitor or sight -seer often stays awhile, and he returns for succeeding years. He even buys a cabin, and some take up residence here and settle permanently. This is something we've all seen, not only those in the business of supplying lodging and accommodations.. Unfortunately such a healthy and desirable economic state of affairs happens much too infrequently. Here is where a structured tourist information center would be invaluable. The whole point is that the welcome tourist and his dollar who returns year after year and stays inside the "horn" and,.Lake Superior's south shore has to be directed and shown what we have here the first time. We do need such a tourist information center. We need it like we need salt. Even if only 5 or 10/ of the traffic is diverted from #2 to #13 the benefits would still be incalculable. Both positions require the typing of either medical orders or court room briefs which are approved by a professional supervisor. Also, the Legal Secretary does no bookkeeping while the Medical Secretary spends -almost 50% of her time on Medicare, Medical Assistance billings, plus other bookkeeping tasks. It may interest the Board members to note that many county nursing departments employ a full time .bookkeeper, such as the Ashland County Nursing Agency, to meet the -increasing bookkeeping requirem demanded in health departments. The Ashland County Nursing Agency also has a full time secretary plus two part-time secretaries. Finally,I am saying that Ruth Pristash qualifie;� as more than a medical secretary, that her bookkeeping services should also be taken into account. November 29,,1977 The following communication was, read ,No'..84 JOB SERVICE WISCONSIN November 14, 1977 County of Bayfield & County Clerk Washburn, WI 54891 Dear Government Employer: Assembly Bill 938, recently enacted into law, amended the provisions of the Wisconsin Unemployment Compensation Act, Chapter 108, Wisconsin Statutes on government unit compliance. You should be aware of these changes. Currently, counties, cities, villages and towns whose population in the 1970 census was fewer than 5,000 were excluded from required coverage. All government units will be liable employers under the Wisconsin U.C. Law effective January 1, 1978. Enclosed is a Memorandum outlining the pertinent statutory sections on government unit compliance. This material should be reviewed. You are currently a covered employer financing your U.C. benefit costs by the "Reimbursement Financing" method. If you wish to remain on this method of financing no action is necessary on your part. However, government units may now elect "Contribution Financing." This is the only method availabl to the private profit -oriented employer. If you choose to finance benefit costs this way, you must file a written notice to that effect before January 1, 1978, to have your election effective Jan- uary 1, 1978. Under this tax method you are required to pay contributions quarterly at a rate of 2.7% on the first $6,000.00 paideach employe within a calendar year. This special assessment applies only if the employer has a payroll in excess of $20,000.00 in any one of those years and the benefit payments made from their account exceeds the tax payments submitted. This special assessment applies only during the years an employer has the basic 2.7% rate. Therefore, you could be required to pay contributions at a rate as high as 5.0% of the first $6,000.00 paid any employe in a calendar year or as much as $300.00 tax per employe. November 29, 1977 The following communication was read: No. 100 IRONWOOD CHAMBER OF COMMERCE Ironwood, Mich. 49938 July 1977 Dear Members: After 41 years of submitting applications, conducting survyes and receiving rejections of the "Little Girl's Point" Harbor and Breakwater project, the U.S. Army Corps of Engineers has given tentative approval to the project. The Corps now believes this project is vitally needed, is sound economically and is bene- ficial to boat enthusiasts and fishermen, as well as to stabilizing the economy of the area. A very favorable cost -benefit ratio factor has now been applied by the Corps to the undertaking. Tile St. Paul office of the Corps of Armu Engineers is now operating with a $70,000 appropriation for the survey and has an additional $80,000 appropriation approved by Congress for its con- tinuation. Vice President Mondale, U.S. Senators Hubert Humphrey, William Proxmire, Gaylord Nelson, Robert Griffin, and the late Senator Phil Hart have all given favorable attention and support to the project. Additional support has also been -received from Congressman Phil Ruppe, Mich- igan Governor William Milliken, Seantor Joseph Mack and Representative Russell Hellman. However, we believe that your support, as well as the support of other similar organizations throughout the region is extremely important and will have immeasurable effect in activating Congressional interest to the point where sustained support will emerge with all necessary fin- ancing assured. A brief description of the project includes the harbor and breakwater, along with the development of an adjoining 160 acre county park. This park will provide for primitive camping, hiling trails, picnic areas, fresh water, camper and motor home sites, sanitary facilities, marina clubhouse, tennis courts , boat launching ramps, and parking area. This park will enhance and complement the project favorably. The U.S. Corps of Engineers, in conducting their present survey, must know both the amount and type of usage this facility should be designed for. As your organization is located within the possible radius of facility usage established, we are requesting your cooperation in pro- viding this information. If you would please bring this letter and the enclosed survey form to the attention of your membership at your next meeting, the sportsmen and boat owners among you could fill out the survey and help provide the information needed. As we plan both power and sail boat mooring, it is necessary to separate these categories and still obtain the maximum number of replies. The olbwing Proposed 1977 County Budget was'presented: No. 101 BAYFIELD COUNTY PROPOSED BUDGET FOR THE YEAR 1978 TO THE HONORABLE MEMBERS OF THE COUNTY BOARD OF SUPERVISORS The Executive Committee of the'Bayfield County Board -of Supervisors submits this proposed county budget for the year 1978 together with a report of operations. November 29, 1977 VALUATION The Wisconsin Department of Revenue has recommended a total county valuation for all real and personal property of $250,283,550.00. The recommended value was approved by the county board on September 23, 1977 and all 1977 county and state taxes will be apportioned accordingly. The equalized valuation of the county shows.an increase over the 1976 valuation of $33,761,150.00 or 15.6%. In 1976 the increase was 15.5%. COUNTY TAX LEVY Section 70.62 of the Laws of 1975 created new levy limits on the county. The 1976 county tax levy was $401,510.00 and with the allowable adjustments the 1977 levy be more than $470,435,00. The levy as proposed by the Executive Committee is $452,631.02. The committee has included in the 1977 budget in the revenue section an amount of $165,127.00 Federal Revenue Sharing monies and is also recommending that $270,000.00 of surplus cash be applied to keep the tax levy as low as possible. FEDERAL REVENUE SHARING AND ANTI -RECESSION FUNDS Bayfield County has always.only allocated Revenue Sharing Funds after the monies have been received. Again this year the amount of $165,127.00 is actually monies that the county treasurer now has in a separate Revenue Sharing Trust Fund. It is estimated that Federal Revenue Sharing receipts for the next fiscal year will be about $116,000.00. The county has also received to date $44,786.00 in Anti -Recession Funds. Allocation of those monies was made by separate county board action at the September -meeting. SHARED TAXES There will be a substantial reduction in ,the amount of State Shared Taxes received by the county in 1978 as compared to the 1977 receipts. The estimated Shared Tax receipts for 1977, made in October 1976 were $134,753.00. The estimated receipts for 1978 are $119,148.00, for a decrease of $155605.00. The current tax levy limit has been adjusted to reflect the decrease of $15,605.00. It is now estimated that total Shared Tax receipts for 1977 will be about $174,651.00. LEVY LIMITS The local tax effort (county levy) is an important factor used by the Federal and State agencies in calculating the amount of Revenue Sharing funds and State Shared Taxes. Because the county board has been very conservative in the early 70Ts, we are now suffering from decreased revenues from those two sources. Unfortunately, there is a time lag of several years in the calculation of the aids and, consequently, any increase in the tax levy this year would not have an immediate effect on revenues. One important factor that should not, however, be overlooked, is if the levy limits continue in force, next years base levy will be the amount that is levied this year, not -he amount that could be levied, which will be adjusted again by several factors such as population growth and further reductions in Revenue Sharing and State Shared Taxes, if any. All unnecessary items should, of course, be'deleted from the budget each year, but necessary items should be retained as it might be difficult to stay within the limit in future years if the budget in any year is not realistic, requiring compounded expenditures in future years. �09 November 295 1977 PAYMENTS IN LIEU -OF -TAXES Bayfield County has received $131,642.00 as payment In -Lieu -Of -Taxes on certain federally owned lands. Due to the fact that Public Law 94-565 provides that the payment is not made on lands that were not on the tax roll at the time when they were acquired, Bayfield County did not receive payment of 62,062 acres of federal owned lands. No decision has been made to date for the use of the In -Lieu -Of -Taxes monies: The county also has received $13,552.00 of In - Lieu -Of -Taxes payments covering lands acquired for the Apostle Islands Park and the Wild River Area lands. `Those monies will be distributed to local governments and school districts in which the lands are located. HEALTH AND SOCIAL SERVICES The sale of the Pureair Sanatorium did not materialize and the facility is still owned by the three counties and is vacant. The Tri-County Executive Committees by joint action directed the Board of Trustees to be in charge of the facility and they have hired a full-time attendant to be in charge of maintenance and security. Problems have been encountered in collection of the sewage plant user fees. We hope those problems will soon be resolved. The Rest Home has operated at a 98% occupancy through the month of September at a per capita cost of $25.97. Per capita revenue other than county tax is $22.59 for I.C.F. patients and $23.52 for S N.F. patients. In September there were five private pay patients in the institution. Private pay patients are charged the actual year-to-date cost. not -skin The 1976 Audit Report by John Maitland, C.P.A. has been completed on schedule. Copies of the report are available for inspection at the office of the county clerk or from members of the Executive Committee. The assistance of Mr. Maitland to all departments of the county continues to be very helpful.. The quality of his audit report and state report was recently noted as being "top 'quality".by the representative of the David Griffiths Association, a firm recently retained by the county to recover certain county.costs in administering Federal Programs. The. committee recommends the acceptance of Mr. Maitland's proposal to audit the 1977 county records. The. Executive Committee recommends approval of the following budget, with adjustments, only after careful study to determine actual need.
