MEETING OF THE BAYFIELD COUNTY BOARD.OF SUPERVISORS
DECEMBER 21, 1977
The meeting was called to order at 7:10 P.M. by Walter C. Barningham, County Board Chairman.
The following members answered roll call: No. 1

Moved by Polich, seconded by E. Johnson to dispense with the reading of the minutes of
the previous meeting. Motion carried.

take action on the following items:
1) To consider and take action on Bayf ield County's position regarding the abandonment
of the Hayward, Ashland, Washburn and Bayf field Railroad and the disposition of the
right -of -quay.
2) To decide on the use of Anti -Recession Funds.
3) To act on the appointment of a Farmland Preservation Act Committee.
4) All other matters which may come before the said board of Supervisors.

Chairman Barningham asked Wallace Johnson to inform the board the reason for the meeting.
Johnson stated that a meeting of the Northwest Regional Planning Commission had recently been
held and the railroad matter was again discussed and that he, together with Karl Ludzack and
Ed Erickson, attendtpthe meeting and they had felt that it would be necessary for the county
board to meet to further discuss the possibility of a short line and/or disposition of the
right-of-way. He then suggested that Ludzack be. given the floor to explain the matter to
the board.
Ludzack then addressed the board and explained that the time for appealing the abandonment
of the railroad had now expired, but there still was time to discuss the formation of a short
line railroad or the disposition of the right-of-way if the railroad is abandoned. Ludzack
stated that the abandonment would not become official until it is printed in the federal register
which he expected to be done in about 3 weeks. He said that the county or anybody -who wished
to do so would then have another 15 days to become involved in either making plans for setting
up a short line railroad 'or making application for acquiring of the right of way. He also
stated that the DOT appeared to be interested in the right of way, that they would not have
the funds to proceed with the purchase. He stated that it would be necessary for the county
to work together with the DOT if the DOT desired to purchase the right-of-way.
Assemblyman Kedrowski was present and he was called on to express his thoughts on the matter.
Kedrowski stated that there were 3 separate railways that were being abandoned in the state and
the state legislature was in favor of the DOt acquiring the right-of-way, however, the legis-
lature had failed to provide funds for the purchase. Kedrowski stated that a new mini -budget
would be -presented in 1978 as there appeared to be surplus state funds, but he also pointed
out that there was going to be many applications for the surplus funds and all.of the requests
would not be granted. Kedrowski did appear to be in favor of the DOT acquiring the right-of-
way and stated that he would work {o appropriate funds for the purchase.
As there was nothing before the house the question was raised as to what the next step
would be. Ludzack stated that he hoped that the board would take some action by either motion
or resolution to support the DOT purchase of the short line railroad

Moved by Erickson that Bayfield County support the DOT to acquire the right-of-way with
the idea of developing a short line railroad.
Motion lost due to lack of a second.
MOTION NO. 5
Moved by Bromberg, seconded by Renoos to recess for 5 minutes so that a formal motion can
be presented to the board. Motion carried.
Clerk Paja.la suggested that Ludzack and Phil Scherer draft a resolution and the secretary
could then type the resolution so that there would be something in writing before the board.
This was agreed to and Ludzack and Scherer left the room to prepare the resolution.
The following claim was read: No. 6
HOLLY KAY LEWANDOWSKI, LEON LEWANDOWSKI,
ALICE LEWANDOWSKI, MOLLY PQDLESNY AND
BECKY HOGAN
against
BAYFIELD COUNTY, WISCONSIN
a -
The above named persons herewith make claim against Bayfield County, Wisconsin, pursuant
to the provisions of Wisconsin Statutes, with reference to the injuries suffered by Holly Kay
Lewandowski on November 22, 1974. An accident took place on U.S. Highway #2 in the Town of Eileen,
near the Ashland - Bayfield County border in Bayfield County. The claimant, Holly Kay Lewandowski
was a passenger in a vehicle driven by Mark Pycha. The vehicle was travelling east on U.S. Highway
#2, the highway at that point was a four lane highway with two lanes going in each direction. A
grader owned by Bayf ield County, Wisconsin, and operated by an employee of Bayfield County, to -wit:
Thomas A. Kovachevich, was proceeding in the same direction as said vehicle; without giving notice,
as the Pycha vehicle was passing, turned into the lane of traffic in which the Pycha vehicle was
travelling resulting in a collision -between the Pyycha vehicle and the Bayfield County grader; that
as a result of said collision caused by the negligent operation of the Bayfield County grader; the
claimant Holly Kay Lewandowski received severe injuries, including the following: fractures to both
femurs, shattering of the cartilage of her knees, numerous cuts and abrasions about her body, and
especially on her legs, injuries to her neck, the claimant was rendered unconscious as a result
of the collision.
That the said Thomas A. Kovachevich, an employee of Bayfield County, Wisconsin,' was negligent
in the following respects: a. That the said defendant Thomas Kovachevich failed to yield the
right of way to the motor vehicle operated by the defendant Mark K. Pycha; b. That the said
Kovachevich failed to maintain a proper lookout; c. That the said Kovachevich failed to give not is
by signal as required by law of his turn in order to make such turn with reasonable safety; d.
That the said Kovachevich failed to properly manage and control said grader. That the negligence
of the said Thomas A. Kovachevich is imputed to Bayfield County by virtue of .his employment by
said count and the ownership of the grader by.Bayfield County, which allowed its employee,
Thomas A. Kovachevich to use it in his employment.
The claimant Holly Kay Lewandowski was hospitalized for a. period from November 22, 1974 to
June 19, 1975. She was a minor at the time of the accident and resides at 722 9th Avenue West,
Ashland, Wisconsin, at the present time. She is now an adult. She received out -patient service
at said hospital for her disabilities from July 16, 1975, through November 10, 1976. That she re-
mains under medical care and has serious permanent disabilities involving her legs, particularly
her knees, serious scarring; that said disabilities prevent her from carrying out her normal
activities, that it has required her to change her vocational pursuits; and has resulted in serious
pairl, suffering, and will result in future medical expense and resulted in present and future wage
losses. That all of said injuries to the claimant Holly Kay Lewandowski are in the reasonable
sum of $350,000.00.
Claim of Leon Lewandowski
That the claimant repeats the same factual matters as set forth in the claim of Holly Kay
Lewandowski as if fully set forth herein; that he has suffered medical expenses in connection
with the injuries received by his daughter, Holly Kay Lewandowski with reference to the accident
in which Bayfield County s grader was involved, which grader was operated by said Thomas A.
Kovachevich-in the amount_of $1424.00, and that he makes demand upon Bayfield County for said
amount. That he is an adult resident of the City of Ashland, residing at 722, 9th Avenue West,
Ashland, Ashland County, Wisconsin.
Claim of Alice Lewandowski
That Alice Lewandowski is the mother of Holly Kay Lewandowski; that she is a registered
nurse; that she performed medical nursing services for Holly Kay Lewandowski as a result of the
accident set forth in the claim of Holly Kay Lewandowski above; that the reasonable value of said

services is in the amount of $6,000.00 that she repeats all of the factual information and
incorporates same in the same manner as if fully set forth herein; that she is an adult resident
of the City of Ashland, Ashland County, Wisconsin, residing at 722 9th Avenue West.
Claim of Becky Hogan
That Becky Hogan is the sister of Holly Kay Lewandowski; that she is a registered nurse;
that she performed medical nursing services for Holly Kay Lewandowski as a result of the accident
set forth in the claim of Holly Kay Lewandowski above; that the reasonable value of said services
is in the amount of $6,000.00; that she incorporates all of the factual information set forth
above in the same manner as if set forth fully herein; that she is an adult residing in the Town
of Barksdale, Bayf field County, Wisconsin, whose address is C.herryville Road, Ashland, Wisconsin.
Claim of Molly Podlesny
That Molly Podlesny is the sister of Holly Kay Lewandowski; that she performed tutoring

services for Holly Kay Lewandowski who was a high school student and who was unable to attend
regular .high school classes as a result of the accident set forth in the claim of Holly Kay
Lewandowskiabove;- that the reasonable value of said services is in the amount of $3,000.00;
that she incorporates all the factual information set forth above in the manner as if set forth
fully herein; that she is an adult residing at 506 Maple, Sault Sainte Marie, Michigan.
All these claims are made by the authorities of these claimants, the undersigned Richard
F. Wartman, their attorney, being specifically authorized to make this claim in their behalf.

My resignation as Bayfield-County Sheriff will become effective January 1, 1978, at which time I
would also feel obligated to resign from the position of Bayfield County Highway Safety Coordinat
I'm certain you are aware that the position of Highway Safety Coordinator is created by appoint-
ment by the County Board Chairman.
I believe it would be very appropriate and beneficial to Bayfield County to have Richard W.
Fredericks appointed to fill the vacancy created by my resignation. Mr. Fredericks has served as
the law enforcement representative on the Highway Safety Review Committee for the past seven
years and has access to all information necessary to carry on this endeavor.
I have sincerely enjoyed working with you personally on the numerous highway safety grants we
have received.

Walter Barningham appointed Richard W. Fredericks to the position of Highway Safety
Coordinator being vacated by Sheriff Rudy Frechette.
Moved by Carter, seconded by Rude to approve the appointment. Motion carried.
The following resolution was read: No. 11
WHEREAS, Section 979.14, Wisconsin Statutes, provides that the county board may set the
compensation of the County Coroner, and
WHEREAS, the present per diem fee set by the county board in September, 1975 is $25.00, and
WHEREAS, the Executive Committee is of the opinion that the Coroner and the Deputy Coroner
are entitled to an increase in the per diem, now therefore be it
RESOLVED, that the per diem rate for the Coroner and the Deputy Coroner shall be set at
$30.00, and be it further
RESOLVED, that said Coroner and Deputy Coroner shall be allowed the same traveling expense
as is allowed to other county employees.

WHEREAS, the Chicago and North Western has been granted authority to abandon sections of
line extending between Hayward and Ashland Junction and between Washburn and Bayfield, and
WHEREAS, Bayfield County is studying the feasibility of developing a short line railroad
operation on the subject line, and
WHEREAS', Bayfield County feels that if a short line operation cannot immediately be imple-
mented, the line still has long term potential for transportation use,
NOW THEREFORE BE IT RESOLVED, that Bayfield County would like to request that the Wisconsin
Department of Transportation exercise its right-of-first-refusal.and purchase the subject right-
of-way, including structures and trackage, and
BE ITFURTHER RESOLVED, that Bayfield County submit copies of its recently completed short
line feasibility study to the Wisconsin Department of.Transportation and designate two county
board members to work with said agency and the North West Regional Planning Commission on the
best course of action for the line.

RE: JUVENILE SPECIALIST POSITION
Dear Mr. Barningham:
Approximately two -and -one-half years a.go, the Bayfield County Law Enforcement Commission requested
that I pursue the possibility of obtaining funds to provide a juvenile officer to the Bayfield
County Sheriff's Department and the Bayfield County Court. A grant application was written to the
Wisconsin Council on Criminal Justice entitled "Rural Juvenile Police Relations Specialist". This
grant was approved by the WCCJ, and Mrs. Joyce Meyer began employment on February 16, 1976. There
is no doubt that this program has contributed significantly to the tremendous decrease in the
amount of juvenile cases requiring Court action. The contacts with community groups, educational
programs, and crime prevention aspects of this position have also 'resulted, directly from this
juvenile program.
I'm certain that you are. aware that I was quite skeptical during the initial probationary period of
this position; however, I feel I must strongly support the continuation of this program on behalf
of all Bayfield County residents, and in particular, our youth.

Gentlemen:

I wish to express my concern in regard to your decision not to continue the position of
Juvenile Specialist presently being -held by Mrs. Joyce Meyers.
It is my opinion that the Juvenile Specialist is a critical.and essential part of the Bayfield
County Criminal Justice System. The position has been very effective in redirecting misguided
youths, working with various agencies to provide constructive outlets of activity for the juvenile
population of the county, determining the best course of action in the correction of youthful
offenders, and easing the work load of already overworked and understaffed law enforcement and
other,agencies within the county. Termination of this position will result in immediate and long
range negative effects in regard to juvenile crime prevention and correction. The County Board
December 21, 1977
has the responsibility to do everything it in capable of to assist law enforcement in providing
to the citizens of Bayfield County the most efficient law enforcement possible. Termination
of the Juvenile Specialist is NOT a step in the right direction. To quote an old adage "An
ounce of prevention is worth a pound of cure" is very appropriate in this situation. The juve-
nile offender must be redirected, guided, and properly supervised now, or there is.a good chance
that he will never be a productive citizen, but will cause larger problems in the future for
all concerned.
I feel I am speaking for and on behalf of all law enforcement agencies in Bayfield County
when I most desperately urge you to reconsider your decision and retain the Juvenile Specialist
in Bayfield County.

She has been helping me set up a class entitled: "You and the Law" for my 8th grade class. She
has been of much help in the introduction of new resources, ideas, and people.
It is essential that we do not lose someone who is able to communicate with the youth of today.
It is essential that we do not lose someone with the knowledge of young people and the law. It
is essential that we do not lose Joyce Meyer.
I hope.you will consider all of the things I have mentioned about Mrs. Meyer and keep her and
her program here in Bayfield County.

In re: Juvenile Specialist
Dear Sheriff:
I understand there is a possibility that funding will not be available to continue this
office. This is one of the programs that has contributed substantially to problem solving and
disposition of cases concerning juveniles.
In addition to the assistance the court receives it should be borne in mind that the county
has saved substantial sums of money in the avoidance of jury and court trials in these mattes.
There is a further service to the general public in that this office makes follow-up calls to
the juvenile involved, the family of the juvenile and the victims of juvenile offenses.

Chief Deputy Fredericks, who will assume the duties of Bayf field County Sheriff beginning
January 3rd, spoke in support of retaining the position of the Juvenile Police Relations
Specialist. Fredericks stated that juvenile crime has been substantially reduced since Mrs.
Meyer was appointed juvenile specialist. He stated that prior to the appointment of Mrs.
Meyer a juvenile worker had been employed by the Dept. of Social Services, but that person never
became as involved in the matter of juvenile delinquency as has Mrs. Meyer. He stated that the
advantage that there has been is the fact that Mrs. Meyer has worked much in the field of pre-
vention of crime rather than in punishment after the crime has been committed.. Fredericks also
called to the attention of the board the fact that the. cost for the county to keep Mrs.. Meyer
may not be as great as it might appear to be as in all instances when a minor is charged with
a crime,;the minor must be represented by an attorney and in many instances this turns out to
be a court appointed attorney who is paid.by the .county.
Wallace Johnson stated that the Dept. of Social Services is at present recruiting for a
special juvenile worker to be employed by the dept. and the salary of that person is almost
100% reimbursable by the state, therefore, the county can save money by eliminating the position
of the juvenile police relations specialist and go the route to hire an additional person for
the Dept. of Social Services. Many board members expressed their unhappiness over the policy
of positions being created by federal funding and then after a few years it becoming necessary
for the county to pick up the employee at county expense.. It was pointed out that Mrs. Meyer's
position under the federal funded program will not terminate until February and that the county
board will be meeting on the first Tuesday in February, 'therefore, the matter could be further
studied and final action be taken at the February meeting.

Moved by Erickson, seconded by Bromberg to refer the matter of the feasibility of refunding
the juvenile police relations specialist program to the Executive Committee and a.report be made
back at the February board meeting. Motion carried.

WHEREAS, there presently exists two vacancies on the Natural Resources Board, and
WHEREAS, the Honorable Martin J. Schreiber, acting Governor of the State of Wisconsin, will
soon :be.filling these two vacancies, and
WHEREAS, the actions of the Natural Resources Board have direct impact on Northern Wisconsin
and a representative from the area is very desirable.
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors highly recommends
and requests the Governor's consideration in the appointment of Mr. Adrian J. DeVriend to one of
the vacancies that exists on the Natural Resources Board.

WHEREAS, it has been the policy of Bayfield County to sell county owned tax deed lands by
sealed bid, and
WHEREAS, the Executive Committee of the county is now of the opinion that it may be in the
best interest of the county to sell county owned tax deed lands by open bidding rather than by seal
bids, now therefore be it
RESOLVED, that the Executive Committee of the county board be authorized to sell county owned
tax deed lands by either calling for sealed bids or by the.open bidding method, whichever method th
committee deems to be most advantageous to the county_, and be it further
RESOLVED, that the Executive Committee be authorized to engage the services of a professional
auctioneer to sell such county owned tax deed lands.

WHEREAS, the county board did on. September 23, 1977 adopt a resolution providing for the
transfer of $7,577.64 of Anti -Recession funds into the Assessment Account to cover the cost of
absorbing a CEP employee, and
WHEREAS, further examination of the account has revealed that the salary of that additional
employee had already been placed in -the 1977 Assessment budget; and
WHEREAS, it now appears that the county retirement fund account will have a deficit of
$12,000.00, and

WHEREAS, Anti -Recession funds can be used for any purpose to retain basic services, now
therefore be it
RESOLVED, that the amount of $7,577.64 originally allocated to the Assessment Account
be transferred to the county retirement account..

In order to promote the safety, convenience and enjoyment of public travel, to preserve the
natural beauty of Wisconsin, to aid the free flow of interstate commerce, to protect investment
in highways, and to conform to the express intent of Congress to control the erection Md main-
tenance of outdoor advertising signs, displays, and devices adjacent to the National System
of Interstate and Defense and Federal Aid Primary Highways, it is deemed necessary in the public
interest to control the erection and maintenance of billboards and other outdoor advertising
devices adjacent to or .visible from the above described portion of said system of highways.

Therefore, pursuant to authority granted urrler Sections 84.09 and 84.30, Wisconsin Statutes, as
amended by Chapter 197, Laws of 1971, the Division of Highways hereby orders that:
1. The required signs or interests as shown on the plat shall be acquired by the Division of
Highways, in the name of the State of Wisconsin.*

Clerk Pajala.next addressed the board in regard to the Farmland Preservation Act. He told
the board that applications for the contracts are now available in the clerk's office and that it
will be necessary for the county board to become involved in approving the applications. He also
stated that it has been suggested that the county might wish to appoint a special committee to
review the applications prior to them being submitted to the county board for final approval.
