MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
June 6, 1978
The meeting was called to order at 9:30 AM by Walter C. Barningham, co. bd. chairman.
The following members answered roll call: No. 1
present - Edwin Erickson, Walter Barningham, Joel Bromberg, Dale Maki, Larry Seidel, James

A prayer and pledge of allegiance was led by Larry Seidel, board member.
Moved by Spears, seconded by Seidel to dispense with the reading of the minutes of the
previous meeting. Motion carried.
No. 2
The first item taken up by the board was the Northwest Wisconsin Transportation Communi-
cation Charter. William Bussey, District Attorney, came before the board and went through the
charter, section by section. He stated that he wanted the board to have full understanding
of the charter. Mr. Bussey stressed the fact repeatedly that the charter should be written in
such a way that there is no question of the intent. He pointed out many areas where the
language did not clearly spell out the intent. Mr. Bussey stated that it would be better if
the charter were written up so that all items would be clearly stated so that in the future
there would not be any problem as to the intent. Mr. Bussey was especially concerned about
areas relevant to financing of the railroad; both prior to the development and also the oper-
ational period. He was also concerned about the problems that might be involved if one or
more counties withdrew or if the railroad were to be completely terminated after the counties
have taken over. He stated that nowhere in the charter could he find clear language spelling
out how the assets would be distributed and even more important how the liabilities would be
distributed.

Moved by Diamon, seconded by Strom that the commission work with the District Attorneys
of the three counties in drawing up a charter to present to the county board at a later date.
The board then discussed the matter of additional county board members serving on the
committee. Some members of the board were of the opinion that an additional county board
member from each county should serve on the commission. Some thought the commission should
handle it without additional assistance and some were of the opinion that one member of the
commission who is presently a county board member and one other member of each county board not

presently on the commission at all should study the matter. A question was put to the D.A.
as to whether he thought that the three District Attorneys could re -write the charter and bring
it back for consideration by the county boards. Mr. Bussey stated that he didn't believe that
could be accomplished by the three District Attorneys alone as the District Attorneys could only
put into writing what the committee members thought should go into the charter but they were not
in a position to make a determination of the actual conditions of the charter.
Seidel and Ludzack both suggested that there should be an advisory vote taken by the county
board as to whether the county board wishes to continue attempting to salvage the railroad and
if the county board would indicate approval, then a further study could be made.
It was pointed out that there was a motion before the house and unless that motion was with-
drawn, it must be acted on before another motion is introduced.
Diamon and Strom withdrew their motion.

Moved by Seidel, seconded by Stephenson that a roll call vote be taken on whether the county
board wishes to continue their support of the railroad transportation commission.

WHEREAS, The term of one member of the Bayfield County Board of Adjustment will expire on
June 1, 1978, and
WHEREAS, It is recommended to the Bayfield County Board of Supervisors that Robert LePage
of Iron River, Wisconsin, be appointed to said Board of Adjustment to fill said vacancy,
NOW THEREFORE BE IT RESOLVED, That Robert LePage is hereby appointed to the Bayfield County
Board of Adjustment for a period of three years, commencing July 1, 1978.

That Section 3.02 (B) be amended to read as follows: structural setbacks from privately
constructed streets or roads (except individual driveways) shall be forty (40) feet from the
centerline of the street or road.
That Section 7.01 (B) be amended to,read as follows: the lot is of record in the Register
of Deeds office prior to April 20, 1971-.
That Section 23.0 be amended to designate Class A signs as conditional uses in Residential-1,
Residential-2, Residential-3, Residential-4, and Agricultural-2 zoning districts; to designate
Class B signs as conditional uses in Residential-1, Residential-2-, Residential-3, Residential-4,
Agricultural-2 and Forestry-2 zoning districts; to designate Class C signs as permitted uses in
Agricultural-2 zoning districts; and to designate Class D signs as conditional uses in Forestry-
2 zoning districts.

The following resolution was read: No. 8
WHEREAS, Section 45.10 of the Wisconsin Statutes provides that "every county board shall
annually levy, in addition to all other taxes, a tax to provide aid to needy veterans, their
spouses or surviving spouses and minor or dependent children of such veterans", and
WHEREAS, the Veterans Service Officer, did request an appropriation of $500.00 for the 1978
budget, and
WHEREAS, said request was out by $250.00, and
WHEREAS, said funds are now depleted, and
WHEREAS, it will be necessary to provide additional aid to needy veterans, now therefore be it
RESOLVED, that the Bayfield County Board in session this 6th day of June, 1978, transfer
$250.00 from the Contingency Fund into the Veteran's Relief Fund.

WHEREAS, it 'is recognized that the management of lands in Bayfield County's forest
resources by private landowners, industry, county, state and federal governments has been
positive and progressive and a major economic benefit to its citizens; and
WHEREAS, modern forest management programs provide recreational opportunities, wild-
life habitat, scenic beauty and watershed protection as well as society's wood and paper
product needs; and
WHEREAS,
our private, county,
state and federal forests are a renewable resource which
must continue
to be managed to assure
their perpetuation and use by future generations; and

WHEREAS,
these forests provide
jobs and related employment opportunities; and
WHEREAS,
society's demands for
wood and wood .products will nearly double by the year
2000 thereby necessitating our forest resources to be managed more efficiently than ever before;
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors stands firmly
opposed to any attempts to set aside any private or government -owned forest land for single -
purpose and/or limited use wilderness areas within Bayfield County; and
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors is on record sup-
porting multiple -use management of private, county., state and federal forest lands to assure
continued motorized recreational opportunities for the vast majority of our citizenry as well
as a future supply of wood resources.

The following resolution was read: No. 11
WHEREAS, County Board resolution #40 enacted November 16, 1977, granted retroactive salary
adjustments to the Social Services Department and the Unified Services Board, and
WHEREAS, the salary increase granted to Wilma Lamken was $26.50 instead of the recommended
$50.00 increase in salary, and
WHEREAS, the Bayfield County board did, at their meeting held April 19th, refer the matter to
the Personnel Committee of the county board, and
WHEREAS, the Personnel Committee has now studied the matter and is of the opinion that Miss
Lamkin should have been granted the $50.00 increase instead of the $26.50, now therefore be it
RESOLVED, that the salary of Wilma Lamken be increased by an amount of $23.50 retroactive
to July lst, 1977.

The following resolution was read: No. 12
WHEREAS, Ellsworth Hudson, janitor at the Bayfield County Highway Department attained the
age of 65 during the second calendar quarter of 1978, and
WHEREAS, Section 41.11 (1) of the Wisconsin Statutes provides that employment may be con-
tinued by the employer, and
WHEREAS, Ellsworth Hudson likes and appreciates his job, is competent to do':the work and
wishes to continue working,
NOW THEREFORE, BE IT RESOLVED that the aforesaid Ellsworth Hudson be continued in his
present employment to the end of the calendar quarter June 30, 1979.

The following resolution was read: No. 13
WHEREAS, Bayfield County has in the past, provided housing with all utilities included,
at no cost, for the county sheriff, and
WHEREAS, it now appears to be in the best interest of the county to discontinue the sheriff's
housing and instead adjust the salary of the sheriff to compensate the sheriff for not being furnis ed
housing, .and

WHEREAS, the Sheriff's Commission has recommended that the housing be discontinued and
the salary adjusted, and
WHEREAS, Section 59.15, Wisconsin Statutes provides in part that the salary of county
elective officials shall be established by the county board prior to the earliest date for
.filing nomination papers, and
WHEREAS, June lst is the earliest date for filing nomination papers, and
WHEREAS, the Executive Committee of the county board has been delegated powers of the
county board in emergency situations, as found in paragraph L. page 3 of the Reorganization
plan adopted April 17, 1973, and
WHEREAS, the county Executive Committee did meet on May 30, 1978 and did, by a motion
duly made and seconded, pass a'-motion_discontinuing the sheriff's housing and increasing the
salary of the sheriff by $100.00 per month, effective on the beginning of the next term of
office of the sheriff, being the first Monday in January, 1979, now therefore be it
RESOLVED, that the Bayfield County Board, in session this 6th day of June, 1978, approve
the action of the Executive Committee in discontinuing the housing for the sheriff and in-
creasing the salary of the sheriff.

No. 17
Clerk Pajala began a discussion on the new Bayfield County Rest Home. He informed the
board that the executive committee met and took the necessary action in advertising for bonds.
He stated that on June 2nd the Certificate of Need was received for a 100 bed rest home. The
architect was instructed to proceed. The bond bids will be opened by -the board on the 21st of

The meeting was called to order at 7 PM by chairman Wallace Johnson with all members present.
Also present were John Blahnik, Bayfield County Memorial Hospital Administrator and Dan O'Neill,
financial consultant representing the T. G. Evensen firm.
Mr. O'Neill was given the floor and informed the committee that his firm is suggesting that
June 21st be the date set for the sale of the nursing home construction bonds. He also informed
the committee that their legal advisors are of the opinion that it will be necessary for the county
board to meet to open the bids for the bonds and award the bid. Following a lengthy discussion,
member Barningham introduced the following resolution and moved its adoption subject to approval of
the D.A. The motion was seconded by Seidel. Roll call vote was asked for with the following

The committee then continued to discuss the need for a special county board meeting to act
on opening of the bids and sale of the bonds. A motion was made by Stephenson aril seconded by
Meierotto that the clerk prepare a petition to be signed by members of the county board requesting
that a special meeting of the Bayfield County Board be held on June 21, 1978 at 7:30 PM. Motion
carried. This completed the business relative to matters relating to construction of the Bayfield
County Rest Home.

BE IT RESOLVED by the Executive Committee of the County Board of Supervisors of Bayfield
County, State of Wisconsin, as follows:
Section 1. Authorization
The Board of Supervisors, by resolution adopted October 25, 1977, has found, determined
and declared to be necessary and expedient.and has ordered that Bayfield County shall issue
its general obligation bonds in the principal amount of $1,825,000 to finance the acquisition,
construction and equipment of a County home for the care of the indigent and the aged, in
accordance with and.within the meaning of Wisconsin Statutes, Section 45.05. Such principal
amount -of bonds,.together with outstanding unpaid bonds issued for those purposes set forth
in Wisconsin Statutes, Section 67.04(1)(a), if any, does not exceed in amount 4/ of the last
equalized value of taxable property in Bayfield County for state taxes made by the Wisconsin
Department of Revenue under Wisconsin Statutes, Section 70.57.
Section 2. Sale; Publication of Notice.
The Board of Supervisors shall meet at the time and place set forth in the form of notice
of sale herein prescribed for the purpose of receiving and considering sealed bids (for the
purchase of the Bonds. The Clerk is authorized and directed to cause a public notice of the
time, place and purpose of the meeting to be published in The Washburn -Times, the official
newspaper of the County, for two consecutive weeks, the second publication to be made not
less than ten days prior to the date of the meeting, the notice being in substantially the

distributed to prospective bidders for the Bonds:

The Executive Committee of the Board of Supervisors of Bayfield County,, Wisconsin, acting
pursuant to authority delegated by the Board, has called for bids for the purchase of the above
Bonds. The County Board of Supervisors will meet at the Bayf ie.ld County Courthouse.in the City
of Washburn, Wisconsin, on Wednesday, June 21, 1978, at 7:30 o'clock P.M., C.D.T., to receive
and open sealed bids for the purchase of the Bonds. The Bonds are offered for sale upon the
following terms:
PURPOSE AND SECURITY
The purpose of the Bonds is to provide funds to acquire, construct and equip a County home
for the indigent and the aged. The Bonds will be general obligations of the County for which
its full faith, credit and taxing powers are pledged.

REDEMPTION FEATURE
All Bonds maturing on or after October 1, 1993 shall be subject to redemption and prepayment
at the option of the County in inverse order of serial numbers on October 1, 1992 and any interest
payment date thereafter, at a price of the principal amount thereof and accrued interest.
INTEREST
Interest on the Bonds will be payable on April 1, 1979, and semi-annually thereafter on
each April 1 and October 1. All Bonds maturing on the same date must bear interest from date
of issue until paid at a single, uniform rate. Each rate must be in an integral multiple of
5/100 of 1/, and not more than 8 rates may be specified for the issue. The difference between
the highest and lowest rates specified may not exceed 1-1/2/. No supplemental or "B" coupons
will be permitted.
PAYING AGENT
I .
Principal and interest will be made payable at a suitable bank recommended by the purchaser
and approved by the Board, and the County will pay customary charges for this service provided
that such recommendation is received within 48 hours after the sale and the Board will select
the paying agent if the recommendation is not approved.

CUSIP NUMBERS
The County will assume no obligation for the assignment or printing of CUSIP numbers on
the Bonds or for the correctness of any numbers printed thereon, but will permit such numbers
to be assigned and printed at the expense of the purchaser, if the purchaser waives any ex-
tension of the time of delivery caused thereby.
DELIVERY
Within 40 days after sale, the County will furnish and cbliver at the office of the pur-
chaser or, at his option, will deposit with a bank in the United States selected by him and
approved by the County as its agent to permit examination by and to deliver to the purchaser,
the printed and executed Bonds, the opinion thereon of bond counsel, and a certificate stating
that no litigation in any manner questioning their validity is then threatened or pending.
The charge of the delivery agent must be paid by the purchaser, but all other costs will be
paid by the County. The purchase price must be paid upon delivery of the Bonds, or within
five days after deposit with the delivery agent, in funds available for expenditure by the
County on the day of payment.
LEGAL OPINION
A legal opinion on the Bonds has been or will be requested from Dorsey, Windhorst,
Hannaford, Whitney & Halladay, of Minneapolis, Minnesota. The legal opinion will be printed
on the Bonds at the request of the purchaser.
TYPE OF BID - AMOUNT
Sealed bids must be mailed or delivered to the undersigned and must be received prior
to 7:30 P.M., C.D.T., on June 21, 1978. Each bid must be unconditional and must be accom-
panied by a cashierTs or certified check or bank draft in the amount of $36,500, payable to
the County Treasurer, to be retained by the County as liquidated damages if the bid is
accepted and the bidder fails to comply therewith. The bid authorizing the lowest net interest
cost (total interest from date of Bonds to stated maturities, less any cash premium) will
be deemed the most favorable. No oral bid and no bid of less than $1,825,000 for principah
plus accured interest on all of the Bonds will be considered, and the County reserves the
right to reject any and all bids and to waive any informality in any bid.

An informal discussion was held regarding the Bibon Marsh lands. The board was informed
of the fact that several meetings have been held by the DNR and the executive committee of the
county board andtat this time it appears that the committee is not in favor of selling county
owned lands to the DNR.- It was pointed out that when the DNR comes up with a definite proposal
on the lands that they wish to acquire and the use of said lands, public hearings will be held so
that the board will be aware of the proposal prior to any action being taken.
