The meeting was called to order at 9:40 AM by Walter C. Barningham, County Board Chairman.

Moved by Erickson, seconded by Spears to dispense with the reading of the minutes of the
previous meeting. Motion carried.

REPORT OF THE BAYFIELD COUNTY ZONING COMMITTEE
To: The County Board of Supervisors of Bayfield County on the hearing on the petitions to
amend the Bayfield County Zoning Ordinance.
The Zoning Committee of the Bayfield County Board of Supervisors, having held a public
hearing pursuant to Section 59.97 (5), Wisconsin Statutes, notice thereof having been given as
prwvided by law and being duly informed of the facts pertinent to the proposed changes, hereby
recommends that the petitions described as follows be approved:
.'The South -East One -Quarter (SEµ), of the North-East One -Quarter (NE-4) of the South -East

The following resolution and communication were read: No. 5
WHEREAS, it is recognized that the management of lands in Bayfield County's forest
resources by private landowners, industry, county, state and federal governments has been posi-
tive and progressive and a major economic benefit to its citizens; and
WHEREAS, modern forest management programs provide recreational opportunities, wildlife
habitat, scenic ]-jeauty and watershed protection as well as society's wood and paper product
needs; and
WHEREAS, our private, county, state and federal forests are a renewable resource which must
continue to be managed to assure their perpetuation and use by future generations; and

WHEREAS, these forests provide jobs and related employment opportunities; and
WHEREAS, society's demands for wood and wood products will nearly double by the year 2000
thereby necessitating our forest resources to be managed more efficiently than ever before;
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board of Supervisors stands firmly
opposed to any attempts to set aside any private or government -owned forest land for single -
purpose and/or limited use wilderness areas within Bayfield County; and
BE IT FURTHER RESOLVED, that the Bayfield County Board of Supervisors is on record supporting
multiple -use management of private, county, state and federal forest lands to assure continued
motorized recreational opportunities for the vast majority of our citizenry as well as a future
supply of.wood resources.

At the meeting of the Forestry Committee on July 6, 1978 action was taken on the above mentioned
resolution.
On motion by Arthur Hanson, second by Dale Maki, the Forestry Committee does recommend to the
County Board of Supervisorsthe adoption of said resolution. Carried.

No. 7
Earl Neilson of the Bayfield County Housing Authority appeared before the board in regard
toa request made in June of 1977 to release $6000 of county monies which had been appropriated
to the Housingi;Adthority for housing units in Drummond. Pajala explained what has' happened to
date in regard to the matter. He stated that the request from the Housing Authority had been pre-
sented to the Executive Committee at a June meeting, however, it appeared that the county board

resolution adopted in December '77 provided that the $6000 would be paid to the Housing
Authority at the time of approval of the loan: According to information received at that
time from the FHA, the pre -application for the loan had been made, reviewed and approved,
but in June the formal application still had not apparently been made and the formal approval
consequently, was not made for the loan. Pajala stated that he had on Monday called the
FHA office in Ashland and they assured him that although the formal application had not been
approved, it has been received and is in the process of approval and that there appears to be
no reason why the loan will not be approved. He stated that Mrs. Livingston from the Ashland
FHA office also informed him that the money has already been appropriated for the loan.
Moved by Renoos, seconded by Spears that the $6000 be released at this time. Motion carried.

` The request of the Town of Russell to purchase county owned land which was presented to
V0 the board in May was again brought to the attention of the board. The resolution had been re-
ferred to the Forestry Committee for further study.

County Board.
The request of the Township of Russella.to purchase the NW-1-4 SEµ Section 5 Township 51 North,
Range 4 West for taxes and all other charges for land fill expansion was considered.
Upon motion by Arthur Hanson, second by Dale Maki, it was passed to recommend that the land
in question be sold to the Township at the appraised price.

the Town of Russell Town Board:

WHEREAS, there have been continued violations by bear hunters using dogs in Bayfield
County and,
WHEREAS, the'Bayfield County Board of Supervisors did unanimously pass a resolution in 1976
� in opposition to hunting bear with dogs, and

WHEREAS, the Townships of Bell, Clover, Hughes, Keystone, Orienta, Oulu:,._Iron River, Port
Wing, Tripp, Washburn and Kelly have submitted opposition to the use of dogs for hunting bear, and
WHEREAS, the Northern Wisconsin Rod and Gun Club, Moquah Men's Club, South Shore Taxpayers
Alliance, Benoit Rod and Gun Club, South Shore Sportsmen's Club, Brule River Sportsmen's Club,
Bayfield County Farmer's Union, Bayfield County NFO, and the South Shore Senior Citizens Group
have expressed opposition to the use of dogs for hunting bear and,

WHEREAS, the residents of Bayfield County attending the -Conservation Congress Hearings
on April 24, 1978, did pass a resolution in opposition to hunting bear with dogs, now
THEREFORE, BE IT RESOLVED, that the attached referenda, (exhibit A), appear on the November
election ballots for Bayfield County and that results of said referenda be submitted to the
Wisconsin Legislature and the Department of Natural Resources if indicated to be the wish of the
voters.

Moved by Renoos, seconded by Spears to refer the resolution to the Conservation Committee
and report back at the next meeting of the board.
Bromberg felt that the resolution should be passed and a referendum held in the November
Election.

of holding a public hearing.

Discussion continued on bear hunting with dogs in Wisconsin and William Bromberg from the
Town of Washburn spoke to the board and informed the board that bear hunting with dogs will
be allowed in Wisconsin this year.
Dale Maki, representing the South Shore Sportsmen's Club, also spoke against bear hunting
with dogs.
Floyd Iddings, chairman of the Town of Bell, also spoke against bear hunting with dogs.
Spears thought that more study should be made on the matter and stated that bears are a
serious problem in Bayfield County.
Moved by Ludzack, seconded by Renoos. to go back into county board session. Motion carried.
Question was asked for on the motion to refer this matter to the Conservation Committee.
Motion carried.

This will acknowledge receipt of the suit that has been filed in Bayfield County by the plaintiffs
Holly Kay Lewandowski, Leon Lewandowski, Alice Lewandowski, Molly Podlesny; and Becky Hogan.
We do note thatthe demand of these plaintiffs, in addition to previous lawsuits and other expend-
itures made on this claim are in, excess of your policy limits of $500,000. Lloyd Schwartz previously
advised you that it is your prerogative to hire an attorney at your own expense to look after those
amounts claimed which are in excess of your policy limits with our company. We do request, if you
retain an attorney, you notify us immediately.
Please be advised that the defense of this matter has been assigned to John H. Hendricks, attorney
at law, Superior, Wisconsin. Mr. Hendricks will make the necessary Answer and appearances in your
behalf in regard to this lawsuit.

Pajala briefed the board on the above matter.
The following resolution was read: No. 13
WHEREAS, several claims have been filed against Bayfield County for damages resulting from
an accident involving a county road grader, and
WHEREAS, the demands of the plaintiffs, in addition to previous law suits and expenditures
which have been settled, are in excess of the county liability policy limit of $500,000, and
WHEREAS, the county has been advised by the insurance carrier that the county may hire an
attorney at county expense if the county wishes to do so, and
WHEREAS, the insurance carrier is only informing the county of their rights and not recom-
mending that the county retain their own attorney, and.
WHEREAS, it does appear that.the total final settlements may not exceed the policy limits
of $500,000,
NOW THEREFORE BE IT RESOLVED that the county, at this time, does not hire an attorney at
county expense to represent the county, but rather depend on the insurance company and their
attorneys to represent the county.

The following petition -was read: No. 14
WE, the undersigned,, request that the nutritional program for Senior Citizens not be reduced
to three (3) days. We feel that the social and nutritional benefits.are too great to reduce the
program any further.
The petition was signed by 168 county residents.
Moved by Bromberg, seconded by Maki to receive the foregoing petition and place it on file.
Motion carried.
About 28 senior citizens were in the audience in regard to the Nutrition Program,.

The following resolution was read: No. 15
WHEREAS, the Executive Committee of the Bayfield County Board of Supervisors deleted the
amount of $7,492.00 from the Bayfield County Title VII Nutrition Program budget for the 1978
program year, and
WHEREAS, this amount is necessary to meet the express concerns)oc the Bayfield County Board
of Supervisors desires to expand the Bayfield County*Title VII Nutrition Program for the Elderly,
therefore
BE IT RESOLVED that the Bayfield County Board of Supervisors reinstate the amount of
$7,492.00 into the Bayfield County Title VII Nutrition Program for the Elderly budget for the
1978 program year.

Louis Stolle, Nutrition Program Director, informed the board of the progress made to date
by the Nutrition Program.
Moved by Bromberg, seconded by Renoos to adjourn as a county board for the purpose of
holding a public hearing. Motion carried.
Discussion followed with comments made by board members and the audience. Most favored
expansion but not cutting back.
Moved by Stephenson, seconded by Sellung to go back into county board session. Motion
carried.
Sellung asked Stolle if the Nutrition Program could run for another month and during that
time have the advisory board meet and figure out how much money is needed to expand and balance
out the program for the balance of the year.
Stolle replied that the program could continue for another month with no reduction in
services.

Moved by Renoos, seconded by Sellung that the Executive Committee meet with the Nutrition
Advisory Committee to discuss the future of the program and report back to the county board at
the September meeting. Motion carried.
Moved by Rave, seconded by Berweger to adjourn for lunch. Motion lost.
The following resolution was read: No. 17
WHEREAS, the September meeting of the Bayfield County Board is scheduled for Tuesday,
September 26th, and
WHEREAS, the State Department of Revenue has scheduled the Bayfield County Equalization
Meeting for 2 P.M., Thursday, September 28th, and
WHEREAS, it is in the best interest of Bayfield County to combine the two meetings into one,

Beginning at the intersection of Bayfield Street and Fourth Avenue East, City of Washburn, thence

To properly establish, lay out, widen, enlarge, extend, construct, reconstruct, improve, or maintain
a portion of the highway designated above, it is necessary to relocate or change and acquire certain

To effect this change, pursuant to authority granted under Sections 84.02(3) and 84.09, Wisconsin

of Highways, in the name of the State of Wisconsin, pursuant to the provisions of Section 84.09(1)

The following resolution was read: No. 19
WHEREAS, the Courts in the State of Wisconsin have reorganized as of August lst, 1978,
and the State has requested changes in the judicial system which make it necessary to amend
compensation for Jury duty.
RESOLVED, that all jurors selected for jury duty be paid twenty five and no/100 ($25.00)
dollars per diem and fifteen cents (15�) per mile on days served, and
RESOLVED, that the Jury Commissioners be paid the same rate of pay as jurors, and
RESOLVED, that the bailiff be paid the same rate of pay and mileage as jurors and jury
commissioners.

The following communication was presented: No. 20
TO ALL COUNTY BOARD MEMBERS
Gentlemen:
Enclosed you will find a program schedule regarding "Comprehensive Investigation of Death"
directed to pathologists, coroners, attorneys, field investigators, and to the forensic
scientists, which will take place in Orlando, Florida, October 16-22, 1978.
I cannot stuess enough how important it is for me to be able to attend this program. As we all
know, a considerable amount of suicides, murders, and accidental deaths occur in our area as well
as around the nation. Programs such as the one I have enclosed for you to review are important
when the question of insurance and beneficiaries arise as determination of causes of death can
greatly affect the settlement of estates.
I am requesting at this time the sum of $1,000.00 for registration, transportation, food and
lodging to attend this program. All receipts will be turned in the the County Clerk's office
for verification of these expenditures. I will be in attendance at the August 1 County Board
meeting to answer any further questions that you may have. Thank you for your consideration.

Moved by Stephenson, seconded by Spears that the request be denied.
The clerk advised the board that there was another letter on file addressed to Walter
Barningham from Eugenia H. Parker, M.D., Pathologist at MMC, which was in support of Mr. Anderson's
request. The board indicated that they were not interested in having the letter read.
Question was asked for on the above motion. Motion carried.
The following resolution was read: No. 21
WHEREAS, the recreation/tourism industry is the second-largest industry in the county and
the Bayfield County Board has always recognized the importance of the recreation/tourism industry,
and
WHEREAS, to promote the recreation/tourism industry, it has for many years worked with the
Bayfield County Recreation Association in achieving many promotional goals, and

WHEREAS, to further promote the recreation/tourism industry, it would be in the best interests
of Bayfield County to have their -own tourist information center located at the junction of Highways
13 and 2, known as the "T" , _ and
WHEREAS, the owner .of this property, Mr. David Kuester, is willing to lease this land for 25
.years to Bayfield County for the express purpose of.a tourism information center and
WHEREAS, the Bayfield County Recreation Association would like to utilize this property for a
tourism information center and fund this project totally on their own without Bayfield County tax
dollars,
NOW THEREFORE BE IT RESOLVED, that the Bayfield County Board lease this property from Mr. David
Kuester and allow the Bayfield County Recreation Association to sub -lease and develop a tourist
information center on the site with the following stipulations:
1. That plans for development be approved by the Conservation Committee;
2. That no construction begin until all permit requirements are met;
3. That all financial records be kept in order including receipts, expenditures, and that they
be reviewed by the Conservation Committee at least onee a year;
4. That the total project, including construction, maintenance, and operation, be open for
inspection by the Conservation Committee members;
5. That the Bayfield County Conservation Committee work with the Bayfield County Recreation
Association in helping to determine any and all ongoing federal and state grants that
could help the Recreation Association to receive the most assistance for their dollar, and
BE IT FURTHER RESOLVED, that no county funds be expended for the project unless such funds
have been made a part of the conservation budget except with the express approval of the County
Board or the Executive Committee of the County Board.

Discussion followed. Ludzack briefly explained what plans have been made to date. Some
members voiced their opposition to county involvement stating that the lease should be between
the land owner and the Bayfield County Recreation Association. Question was asked on who would
sign the lease.

Dale Maki brought to the attention of the board a dangerous situation that exists at the
intersection of County Trunk Highway "A" and US "2" near Darwin Ford in Iron River. He sug-
gested that the shoulder lines on Highway A should be marked as cars are now parked on the
highway obstructing the view at the corner. He stated that many accidents have happened at
that intersection because of the obstructed view.
Moved by Maki, seconded by Rave to direct the Highway Department to look into the matter.
