The following members answered roll call: No. 1 present - Edwin Erickson, Arthur Meierotto, Walter Barningham, Ila Bromberg, Dale Maki, Russell McGillivray, Larry Seidel, H. Glenn Spears, Wallace Johnson, James Stephenson, Charles Diamon, Arthur Hanson, Carl Anderson, Wayne Sellung, Karl Ludzack, Edwin Renoos absent - James Strom, William Rave present - 16 absent - 2 total 18 A prayer and pledge of allegiance was led by Larry Seidel, board member. Moved by Bromberg, seconded by Erickson to dispense with the reading of the`miriutes of the previous meeting. Motion carried. The following resolution was read: No. 2 WHEREAS, Joseph Berweger, a veteran member of the Bayfield County Board, departed from our midst on the 22nd day of September, 1978, and WHEREAS, the public service rendered by the deceased member was exemplary and worthy of special consideration and commendation by the board, and WHEREAS, it is appropriate that such recognition become a part of the permanent records and ' history of Bayfield County, Q, q NOW THEREFORE BE IT RESOLVED, that the members of the Board of Supervisors of Bayfield County, in session this 28th day of September 1978, pause, in remembrance of Joseph Berweger, in Y recognition of his public service, his contributions to good government and above all in remem- brance of Joe as a friend of all, and BE IT FURTHER RESOLVED, that this resolution be entered in the official journal of Bayfield County and that a copy of it be delivered to the family of Joseph Berweger by the chairman of the board. The following appointment was read: No. 3 September 28, 1978 Edward A. Pajala, Clerk Bayfield County Washburn, WI 54891 Q 1 � 0 Dear Ed: Due to the death of Joseph Berweger, veteran county board member representing District No. 9, I have appointed Carl Anderson, Mason, to fill the vacancy on the board. I trust you will present this appointment to the county board for confirmation. Very truly yours, Walter C. Barningham, Chairman Bayfield County Board of Supervisors Moved by Bromberg, seconded by Diamon to approve the foregoing appointment. Motion carried. September 28, 1978 No. 4 , Pastor Barry Boyer accompanied by Glenn Perry appeared before the board to introduce to the board the new alcohol and drug center. Mr. Boyer, reading from a prepared text, stated that the name of the non-profit corporation is the Bayfield County Alcohol and Drug Center, Inc. :and that it covers the geographical area of Bayfield County. He stated that the objectives of the board were as follows: A. Increase public understanding of alcohol and drug abuse, their nature and treatment. B. Make this knowledge effectual in solving the problems of alcohol and drug abuse. C. Promote the tenet that the alcohol and drug abuse can be helped. D. Assist in the recovery of alcoholics, alcohol abusers and other chemically dependent persons. Mr. Boyer stated that eventually they would expect someone from the Bayfield County Board to serve on the Board of Directors. The Board of Directors shall not exceed 11 members and should not drop below 5 at any time. Mr. Boyer further stated that he hoped that it would not be necessary for,the county board to appoint one of their members to the Board of Directors, but that some board member would be interested and concerned.enough to volunteer to serve on the board. He indicated that an appointed member may not show the interest that a volunteer member might. Glenn Perry also spoke briefly to the board about the operation of the new organization. No. 5 Chairman Barningham informed the board that due to the death of Joseph Berweger there now was a vacancy on the highway committee. Barningham suggested that the board follow the normal procedure of members from the district involved caucusing and nominating someone to fill the vacancy. Clerk Pajala advised the board that the Statute does provide that in the case of a vacancy on the highway committee the chairman of the board shall appoint someone to fill the vacancy until the county board meets. He stated that as Berweger had just recently passed away, the board chairman didn't feel that it was necessary to appoint a, member for only a few days. The board members from highway district no. 3 caucused and following the caucus Stephenson reported that they agreed to nominate Carl Anderson as a member of the highway committee to represent District No. 3. nominations. Barningham called three times for additional "' There were no further nominations. Moved by Johnson, seconded by Meierotto that the nominations be closed and that the clerk cast the unanimous ballot for Carl Anderson. The clerk cast the unanimous ballot as directed and Carl Anderson was declared elected a member -of the h.�ghway committee representing District No. 3. The following Report of the Bayfield County Zoning Committee was read: No. 6 TO: The County Board of Supervisors of Bayfield County on the hearing on the petitions to amend the Bayfield County Zoning Ordinance. The Zoning Committee of the Bayfield County Board of Supervisors, having held a public hearing pursuant to Section 59.97(5), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petitions described as.follows be approved: S ember 28, 1978 The North -half (N2) of the North -half (N2) of the North-East One -Quarter (NE4) of the South - East One -Quarter (SE4) , Section Fourteen (14) , Township Fifty -One (51) North, Range Four (4) West, be changed from Agricultural-1 Use to Industrial Use. The following resolution was; read: No. 8 WHEREAS, There presently is in effect in Bayfield County a Comprehensive Zoning Ordinance, WHEREAS, Bayfield Recreational Development, Inc. a corporation engaged in the business of operating a restaurant facility in the Town of Bayfield, Bayfield County, Wisconsin, and WHEREAS, Said Bayfield Recreational Development, Inc., made an application to the Bayfield County Zoning Committee through its duly appointed administrator requesting that a permit be granted allowing the location of two cabanas on said Bayfield Recreational Development, Inc. pro perty, and WHEREAS, Said application to allow the location of these two facilities was after due deliberation by said Committee, denied, and WHEREAS, Said Bayfield Recreational Development, Inc., did without a permit and contrary to the direction of the Zoning Committee, procede'to locate the before mentioned cabanas on the said property, and WHEREAS, The Zoning Committee has 'recommended that an action be commenced against said Bayfield Recreational Development, Inc., for the violation of the provisions of said ordinance and for such further relief as may be appropriate including injunctive relief for the removal of said cabanas, and, WHEREAS, Said Ordinance requires Bayfield County Board action before such litigation is instituted, NOW THEREFORE BE IT RESOLVED, That the Zoning Committee recommends that the Bayfield County Board of Supervisors authorize the Bayfield County District Attorney to pursue whatever action including litigation is'required to serve compliance with the Bayfield County Zoning Ordinance. The following resolution was read: No. 9 WHEREAS, There is presently in effect in Bayfield County a Comprehensive Zoning Ordinance, WHEREAS, Cleo Beaver, a property owner, has built and maintains a dwelling loe.ated in Government Lot 2, Section 15, Township 43 North, Range 6 West, Town of Namaka.gon, and WHEREAS, said dwelling was constructed contrary to the terms under which a land use permit was issued to said Cleo Beaver, by the Bayfield County Zoning Committee, and, WHEREAS, said Cleo Beaver; refuses to initiate action to rectify the -location of said dwelling, and, WHEREAS, the Bayfield County Zoning Committee recommends that an action be commenced against said Cleo Beaver, for the violation of the provisions of said ordinance and for such relief as may be appropriate as to secure compliance with said ordinance, and, WHEREAS, said ordinance requires County Board action before such relief is sought, NOW THEREFORE BE IT RESOLVED, that the Zoning Committee recommends that the Bayfield County Board of Supervisors authorize the Bayfield County District Attorney to commence such action as may be required to cause compliance with the terms of said Zoning Ordinance. Motion carri 671) '1'� September 28, 1978 The following resolution was read: No. 10 WHEREAS, There is presently in effect in Bayfield County Comprehensive Zoning and Subdivision Control Ordinances., and, WHEREAS, the Port Superior complex, corporations engaged in the business of operating a marina condominium facility in the Town of Bayfield, Bayfield County, Wisconsin, and WHEREAS, individuals representing said corporations and private interests of the Port Superior complex have engaged in land transactions resulting in the creation of lots in violation of the Bayfield County Subdivision Ordinance, and, WHEREAS, said individuals have failed to take action to secure compliance with the Subdivision Control Ordinance, and WHEREAS, said land transactions.have resulted in the violation of provisions of Section 10.0 of the Bayfield County Zoning Ordinance by reducing frontage and acreage requirements under which initial land use permits were issued, and WHEREAS, said individuals have failed to initiate action to secure compliance with said Zoning Ordinance, and., WHEREAS, the Bayfield County Zoning Committee has recommended that actions be commenced a.gains said individuals for the violation of the provisions of said ordinances and for such further relief as may be appropriate, and, WHEREAS, said ordinances require Bayfield County Board action before such actions are instituted, NOW THEREFORE BE IT RESOLVED, that the Zoning Committee recommends that the Bayfield County Board of Supervisors authorize the Bayfield County District Attorney to commence such action against said individuals, or any officers or agents thereof, as may be appropriate for such alleged -illegal acts and to seek compliance with the terms of said Zoning_ and Subdivision Control Ordinances. The following resolution was read: No. 11 WHEREAS, the mileage allowance for county employees using their private automobiles on county business is 15� per mile, and WHEREAS, said allowance has been in effect since February 1, 1975, and WHEREAS, the cost of operating an automobile has increased considerably since 1975, now therefore be it RESOLVED, thatthe mileage allowance for all county employees using their private automobile on county business be set at 17� per mile effective January 1, 1979. September 28, 1978 No. 12 Spears suggested that the county board consider a county owned fleet operation for county employees rather than paying mileage to employees using their own vehicles. He directed a question to the clerk asking how many automobiles were used by county employees. The clerk stated that there was probably about 15 to 20 employees who use their own vehicles to a large extent. Mn-Finn I? Moved by Spears, seconded by Bromberg that the matter be referred to the Executive Committee for study and report back to the county board at.the February meeting. Motion carried. The following resolution w.as read: No. 13 WHEREAS, the Personnel Committee of the Bayfield County Board has approved the "Guidelines for the Bayfield County Non -Supervisory Employees Committee", and WHEREAS, the Personnel Committee and the Non -Supervisory Employees.Committee have met to negotiate salaries and fringe benefits for all regular courthouse and sheriff's department employees, except elected officials, department heads, rest home employees and those employees covered by a separate union labor contract, and WHEREAS, the above committees have come to an agreement on salaries and fringe benefits, now therefore be it RESOLVED, that the salary schedule of the courthouse and sheriff's department employees be increased by $25.00 per month and be it further RESOLVED, that the cost of living salary adjustment in effect prior to July 1, 1977, be reinstated, said adjustment to be as follows: 1. An increase or decrease in salaries and wages will be made at the end of each calendar quarter equal to one cent per hour for each three tenths of 1 point increase or decrease in the Revised Consumer's Price Index for Urban Wage Earners and Clerical Workers. 2. No decrease shall be made in salaries or wages until the decrease in the cost of living index would cause at least a three cent per hour decrease in wages, at which time the full amount of the decrease will apply. 3. If the quarterly point increase or decrease results in a fractional cent in- crease or decrease, such increase or decrease shall be adjusted to the nearest cent. AND BE IT FURTHER RESOLVED, that this resolution does not apply to the.salari.es and wages of elected officials, department heads, rest home employees and those courthouse and sheriff's department employees covered by a separate union labor contract, and be it further RESOLVED, that all provisions of this resolution shall become effective January 1, 1979. Stephenson recommended approval of the resolution by the board. Wallace Johnson commented that copy of resolutions such as the one before the house should be made available to members of the county board prior to the day of the county board meeting. He said that resolutions of that nature have a large fiscal impact on the county and it becomes quite difficult for the county board members to vote on such matters without having an opportunity to study the question. The following resolutinn was read: No. 16 0 WHEREAS, Bayfield County court house and.sheriff's department employees now receive annual wlongevity pay, and 1 WHEREAS, said payments are computed at $1.00 per month of employment to a1l.employees who have been employed at least 36 months on December lst, and WHEREAS, said formula does not provide any higher rate of longevity payment for employees with {� o long time service, and WHEREAS, the Personnel Committee is of the opinion that additional incentive should be pro- �I vided to long time employees, now therefore be it �IRESOLVED, that paragraph 4 on page 11 of the Bayfield County.Comprehensive Schedule adopted in 1974 be amended to read as follows: Longevity pay will be paid each year to eligible employees in a separate check on the pay day closest to the,lst of December. Subsequent annual I longevity payments shall be paid according to the I following formula. $1.00 per month after 3 years of employment $1.50 per month after 5 years of employment $2.00 per month after 10 years of employment $2.50 per month after 15.years of employment $3.00 per month after 20 years of employment All other provisions of the longevity pay program provided for on page 11 of the Bayfield County Compensation Schedule shall remain in effect, and be it further RESOLVED, that this amendment shall only apply to court house and sheriff's department employees, not including elected officials, department heads, rest home employees or those sheriff' department employees covered under a separate union labor contract, and be it further RESOLVED, that this resolution shall become effective on January 1, 1979. 401 28,. 1978 PERSONNEL COMMITTEE James Stephenson Larry Seidel Wayne Sellung Karl Ludzack Moved by Stephenson, seconded by Sellung to adopt the foregoing resolution. The following resolution was read: No. 17 WHEREAS, the cost of living pay adjustment has been discontinued for the county sheriff and the chief deputy; and WHEREAS, the sheriff's department deputies are still covered by the cost of living adjust- ment provision, and WHEREAS, this has caused an inequity in the wages of the sheriff and the chief deputy as compared to the wages of the sheriff's department sergeant, now therefore be it RESOLVED, that adjustments be made to the salaries of the sheriff and chief deputy to correspond with adjustments made in the salaries of the sergeant, and be it further RESOLVED, that the first such adjustment be made effective for the period beginning October 1, 1978, said adjustment being an amount to increase the salary of the chief deputy to be $75.00 per month above the salary of the sheriff's department sergeant and to increase the salary of the sheriff to be $200.00 per month above the salary of the sheriff's department sergeant, and be it further RESOLVED, that the additional adjustments be made in the salaries of the chief deputy and sheriff according to the above formula each time that the salary of the sergeant is adjusted, and be it further RESOLVED, that the salary of the sheriff as adjusted does not include the $100.00 per month allowance in lieu of free housing and utilities granted to the sheriff on June 6, 1978, said $100.00 to be added to the adjusted salary of the sheriff. The following resolution was read: No. 18 WHEREAS, counties are authorized to distribute to towns within the county all -or a portion of the income received from timber harvests on county owned lands not entered under the County Forest Law, and WHEREAS, it is deemed equitable to share these receipts, in lieu of taxes, with the towns losing revenue from these lands, now therefore be it September 28, 1978 RESOLVED, that fifty percent (50%) of the income received from timber harvests on county owned lands not entered under the County Forest.Laws shall be distributed to the town in which it is harvested, and be it further RESOLVED, that the provisions of this resolution shall be effective for all timber harvested on or after January 1, 1979. :,Edwin Renoos James Stephenson Joel!, Bromberg Russell McGillivray Moved by Renoos, seconded by Diamon to adopt the foregoing resolution. Discussion followed. Moved by Stephenson, seconded by Bromberg that the resolution be sent back to the Executive Committee for further study. Motion carried. The following resolution was read: No. 19 WHEREAS, Bayfield County owns land in the county not entered in Forest Crop or Special Use categories, and WHEREAS, Bayfield County has by resolution removed some of these lands from sale, and WHEREAS, this action reduces the revenue of the townships in which these lands are located, WHEREAS, it is felt in the best interests of Bayfield County to keep these lands in county ownership, now therefore be it RESOLVED, that Bayfield County shall pay over to the treasurer of each township involved 20� w per acre, in lieu of taxes, for every acre held from sale by the county not in Forest Crop or Special Land Use. Payments shall be made annually beginning in January 1980 for each such acre Id on November lst of the preceeding year, and be it further RESOLVED, that the provisions of this resolution shall not cover those county lands designated as 1166 feet on each side of the river" Edwin Renoos James Stephenson Joel Bromberg Russell McGillivray Dale Maki Moved by McGillivray, seconded by Stephenson to adopt -the foregoing resolution. Absent - 3 Total 18 Motion carried. The County Commission on aging board members have requested that I, Ray Kyle, as chairman of the Commission ask for a County board member be appointed to our commission also by mandate of the stat requires that a member be under thirty years of age. It was requested that we ask for Mr. Joel Bromberg as that would fill both requirements. _, At your service, Ray Kyle Moved by Spears, seconded by Stephenson to receive the foregoing communication and place it on file. Motion carried. No. 21 Barningham then appointed Joel-Brorriberg to serve on the Commission on Aging to represent the Bayfield County Board. Moved by Renoos, seconded by Spears to approve the foregoing appointment. Motion carried. Moved by McGillivray, seconded by Erickson to adjourn for lunch. Motion carried. He read through the ratio report explaining some of the figures along the way. He stated that real estate sales and new improvements are used to come up with the new equalized values. The following communication was read: No. 30 August 7, 1978 Mr. Dale Maki, Supervisor Bayfield County Board Iron River, WI 54847 J Dear Dale: I have received a copy of the motion passed on August lst by the County Board directing the Highway Department to look into the unsafe conditions at the -junction of USH 2 and CTH A (Darw.tn's corner) . The Wisconsin Department of Transportation, the Sheriff's Department and the Highway Depart- ment are all well aware of the dangers -of this intersection and have accident review maps available to substantiate those dangers.. From the observations made by the above mentioned departments we find the problems to be obstructed vision to the east, because of cars and trucks parked between the front of Darwin's and USH 2 and pavement marking of the designated parking areas on USH 2 t.h�pough the Town of Iron River. The Town is responsible for marking the parking areas. I have talked to the Town officials regarding this problem and have written letters requesting them to mark the parking areas. Because USH 2 widens out as it enters Iron River many people think it is a four lane and therefore use it as such. If the Town were to paint in the parking areas the appearance of a four lane would be eliminated at once. The County Highway Department in cooperation with the Wisconsin Department of Transportation have been involved in a relocation study of CTH A from its present location to one mile east on USH 2, at the wayside. CTH A would be relocated beginning at the corner of Hooper's road straight south to USH 2. The County Highway Department recognizes the need for the relocation particularly from a safety standpoint and cost of construction and maintenance. We have several public informational meetings that were held at Iron River regarding the relocation proposal and have recently completed an origin and destination study. The results of these meetings and studies will be available shortly. We have painted the white edgeline on all CTH's in the past and will continue to do so in the future if funds permit. The CTH's are scheduled for painting this year. We are still awaiting our paint order. CTH A as it enters the intersection of. USH 2 is only 24 ft. wide and that is where the white edgeline will go. We have no jurisdiction of the property other than the traveled portion of the roadway in that particular area. Thank you for your interest in highways and more specifically, highway safety. Funds for this juvenile crime - prevention program are provided for only a two year period. After December 31, 1978 these funds will.no longer be forthcoming. Without a major financial supporter_, our greatly. needed youth services will be in jeopardy. It is of great concern to the Iron River Youth Committee and the communities involved, to see that the Iron River Youth Organization beable to continue its youth.programming. The expense involved is more than our towns can afford, and our only available source of funding to keep our program alive is through Bayfield County. As you can see from the schedules and information enclosed, a variety of activities are provided for youth from third through twelfth grades on a daily and monthly basis. Currently we have a Youth Center which provides a. place for the youth to come and see friends., read magazines, play games and use the kitchen facility. As we -he Youth Committee look over our past $18,000 budget we realize the cuts and changes that must be made. For that reason we are proposing a new budget totaling $9200. As your Board looks over its proposed budget for next year in Bayfield County, we hope that youth are being considered. We are requesting of your Board some greatly needed financial help . Of the total $9200 mentioned above, $5200 would be the salary for the 20-hour work week of the youth director. Because the majority of the youth in our economically deprived area would find it difficult to afford the total payment for activities, we have requested that the remaining amount of $4000, be spent for the cost of activities, some transportation and general supplies. This amount coincides with the annual costs we have experienced for activities over the past two year, The Youth Center will not be used because of the expense required to keep it running. In its place we plan to utilize the Town Hall of Iron River one or two days a week after school and in the evenings. Continued use of the Iron River Elementary School's gymnasium will also be.part of our program. We hope it is -your desire to see continued services brought to Bayfield County youth. If so, your support of a group deserving of the benefits it so desperately needs, will be greatly appreciated. Thank you for your time and consideration of this matter. As we represent the people in the Town of Hughes, we feel our youth deserve the chance to develop and expand their horizons which without the youth center many would not have the opportunity, transportation, or guidelines to do so. We are hoping that the Bayfield County Board will approve the L.E.A.A. federal grant money for the benefit of our youth.
