The following members answered roll call: No. 1 Walter Barningham, County Board Present: Ed Erickson, Art Meierotto, Walter Barningham, Joel Bromberg, Dale Maki, Russell McGillivray, Larry Seidel, James Strom, William Rave, Glenn Spears, Wallace Johnson, James Stephenson, Charles Diamon, Art Hanson, Carl Anderson, Wayne Sellung, Karl Ludzack Ed Renoos. Absent: None Present - 18 Absent - 0 Total 18 No. 2 A prayer and pledge of allegiance were led by Larry Seidel, Board member. No. 3 Moved by Erickson and seconded by Diamon to dispense with the reading of the minutes of the previous meeting. Motion carried. No. 4 Clerk Pajala read the following report of the Bayf field County Zoning Committee: REPORT OF THE BAYFIELD COUNTY ZONING COMMITTEE TO: The County Board of Supervisors of Bayffield County on the hearing on the petitions to amend the Bayf ield County Zoning Ordinance. The Zoning Committee of the Bayfield County Board of Supervisors, having held a public hearing pursuant to Section 59.97 (5), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petitions described as follows be approved: The North-West One -Quarter (NWµ) of the North-East One -Quarter (NE-4), Section Twenty-three (23), Township Forty-nine (49) North, Range Nine (9) West, be changed from Forestry-1 Use to Agricultural-1 Use. The following amendatory ordinance by the Zoning Committee was read: No. 5 AMENDATORY ORDINANCE The Bayfield County Board of Supervisors ordains as follows: That the Bayfield County Zoning Ordinance, adopted June 1, 1976, be and the same, is hereby amended so that as amended, The North-west One -Quarter (NW-4) of the North-East One Quarter (NEµ), Section Twenty-three (23), Township Forty-nine (4q) North, Range Nine (9) West, is changed from Forestry-1 Use to Agricultural - 1 Use. Clerk Pajala then addressed the board concerning a fencing problem this may cause if passed. Pajala suggested that the adjoining property owner be notified and asked to attend the afternoon session in order to voice his opinion. The motion to adopt the ordinance was seconded by Bromberg: The question was asked on the motion to adopt the zoning ordinance. Motion carried. (Affidavits of publication and other notices and correspondence on file) The following resolution was read: No. 6 WHEREAS, Bayfield County did on April 17, 1979, authorize the purchase of a snowmobile trail groomer and WHEREAS; The county board authorized and directed the Conservation Committee of the county board to prepare a lease agreement leasing said snowmobile -trail groomer to the Bayfield County Snowmobile Alliance and WHEREAS, The Conservation Committee has met jointly with representatives of the Bayfield County Snowmobile Alliance to negotiate such a lease a copy of said lease being attached to and made a -,part of this resolution;, now therefore be it RESOLVED, That the county clerk be authorized and directed to execute for Bayfield County the said lease. Signed: Larry Seidel, Karl Ludzack, Art Hanson, Dale Maki, and Charles.Diamon LEASE AGREEMENT entered into this day of 1979, by and between Bayfield County, Wisconsin (hereinafter referred to as Lessor) and the Bayfield County Snowmobile Alliance, 4",05�p A_i�r' September 25, 1979 (hereinafter referred to as Lessee). WHEREAS, the Lessor is the owner of a snowgroomer more particularly described as The Tucker Sno-Cat, Model 1342, Serial Number E520080, and Trailmaster Drag. WHEREAS, Lessee desires to lease from the Lessor the above described snowgroomer to maintain snowmobile trails in Bayfield County. NOW THEREFORE, in consideration of the mutual covenants contained herein, the Lessor and Lessee agree as follows: 1. Term and Rent. The Lessor hereby leases to the Lessee the above described snowgroomer for a period of One (1) year commencing on the 1st day of October, 1979, and terminating on the 30th day of September, 1980, for an annual rental of one dollar ($1.00). 2. Use. Lessee agrees that the snowgroomer shall be used by the Lessee exclusively for the public use in grooming and maintaining snowmobile trails in Bayfield County. The snowgroomer shall not be used by the Lessee for any other use other than in the manner and for the use contemplated by the Lessor. Lessee further agrees that it shall not operate the snowgroomer on any lake, river, stream or other waterway. 3. Care, Maintenance & Storage. The Lessee shall at its own cost and expense be responsible for the proper care and maintenance of the snowgroomer and for all repairs necessary to iaintain the snowgroomer in its original condition, normal wear and tear excepted. The Lessee further agrees that it shall, at its own cost and expense,.be responsible for the storage of the snow - groomer. The Lessor or any of its representatives shall have the right to inspect the snow - groomer at any time. The Lessee further agrees that it shall, on request from the Lessor, furnish the Lessor with such supplemental information as may be reasonably necessary to determine whether or not the Lessee is complying with the terms and conditions of this Lease. 4. Insurance. The Lessee agrees to secure at its own expense public, liability insurance covering the respective liabilities of the,Lessor and Lessee, and naming the Lessor as an additional insured. Said insurance shall provide at a minimum the following coverage. One hundred thousand dollars ($100,000.00) for bodily injury to any one individual; three hundred thousand dollars ($300,000.00) for bodily injuries in any one occurrence; and fifty thousand dollars ($50,000.00) for property damage in any one occurence. The Lessee shall furnish the Lessor with a copy of said policy for.its approval. During the term of this lease the Lessee shall also procure and maintain at its own expense insurance covering any and all loss and/or damage to the snowgroomer in an amount equal to the value of the snowgroomer and naming the Lessor as the insured. The Lessee shall furnish the Lessor with a copy of said policy for its approval. The Lessee further agrees that it shall supply the Lessor with copies of all receipts showing payment of all premiums on the insurance policies referred to above. 5. Hold Harmless Clause. The Lessee hereby agrees that the Lessor shall not be liable for, and that the Lessee shall hold the Lessor harmless from, any and all injuries, damage, loss or claims that may arise from the use of the snowgroomer by Lessee, including claims and liens for storage of the snowgroomer and claims and liens for labor or materials utilized in maintaining of the snowgroomer. 6. Liability for Loss or Damage. Lessee shall be liable for any loss of or damage to the snowgroomer which occur during the term of this Lease. Repairable damage to the snowgroomer shall be repaired by the Lessee at' -its own expense. Any insurance proceeds received by the Lessor with respect to such damages shall be applied toward the cost of repair. 7. Lessor's Right to Use Snowgroomer. The Lessor reserves the right to use the snowgroomer with approval of the Bayfield County Recreation Director. 5,45 September 25, 1979 S. Assignemnt of Lease. This Lease shall not be assignable nor shall the Lessee sublet the snowgroomer without the prior written consent of the Lessor. 9. Default. If the Lessee breaks any of the convenants and agreements herein con- tained, orWillfully or negligently causes injury to the snowgroomer, the Lessor may at its option terminate this Lease and take possession of the snowgroomer. 10. Surrender. Upon expiration of this Lease or termination of this Lease by Lessor, the Lessee hereby agrees to surrender and deliver the snowgroomer to the Lessor and it shall be delivered to the'bessor in its original condition, normal wear and tear excepted. Spears commented that the Conservation Committee and the District Attorney should be commended for the fine job done on the lease. The question was asked on the motion to adopt the resolution. Motion carried. Lou Stolle, Bayfield County Nutrition Director, then addressed the board. Stolle gave a general report on.the nutrition program and gave recommendations on the program as such. Stolle also told the committee that a cost ,breakdown of the program would be presented at the next county board meeting. Stolle then gold the board that he would answer any questions that they might have concerning his program. Ed Renoos asked Stolle whether or not. the vans used in the program could be replaced since they are in.such bad condition. Stolle answered by saying the transportation funds they received covered only about $10,000 for the next year. He explained,though, that they could expend the money for new vans over a period of years so that.they do not have to spend the whole $10,000 at onee. McGillivray then asked if the Vocational School catered the meals for the elderly. Stolle answered that they have just recently engaged the services of the Ashland Vocational School and that they have been doing a good job at a reasonable price. Stephenson then questioned if the people on the program could go to one of the area schools for meals since the schools are also state funded and have all the facilities. Stolle replied that the kitchens in the schools are not large enough to.handle the additional overflow and also the types of meals they served were somewhat impractical for the elderly. The following resolution was read: No. 9 WHEREAS, The Bayfield County Highway Department employees and the Bayfield County Sheriff's Deputies have been represented in labor negotiations by General Drivers, Local Union No. 346 and 547 WHEREAS, The Bayfield County Sheriff's Department Dispatchers have now elected to be represented by General Drivers, Local Union 34.6 and WHEREAS, It has been the policy of Bayfield County to have the county Highway Committee negotiate a contract with the union for highway employees and the -Personnel Committee which is also the Sheriff's Committee negotiate the contract for the Sheriff's Deputies and WHEREAS, It would appear to be in the best interest of Bayfield County to have only one labor negotiating committee and WHEREAS, It would appear to be in the best interest of Bayfield County to have a committee that is not directly involved with any department, negotiate the labor contracts, now therefore be it RESOLVED, That the Executive Committee of the county board be authorized and directed to be the official negotiating committee for all labor contracts involving Bayfield County employees, and be it further RESOLVED, That this resolution shall become effective upon passage. EXECUTIVE COMMITTEE: Wallace Johnson, James Stephenson, Art Meierotto, Larry Seidel, Ed Renoos, Ed Erickson, Walter Barningham Moved by Spears and seconded by McGillivray to adopt the resolution. Spears commented that the Executive Committee is already overburdened with problems although he did think that one committee should negotiate the labor contracts. Renoos agreed with Spears saying that he thought the Personnel Committee might be better suited to take over the negotiations. Bromberg then voiced his opinion stating that once reorganization of the committees starts the forming of this new committee would be fine,, but for this year they should stick with the same committees for negotiations. Spears' then..commented that there might be some statutory problems involved if Bayfield County changes negotiating committees. William Bussey, District Attorney, was then called on by the board. Bussey stated that it is Bayfield County's prerogative to choose their negotiator and he foresaw no problem with it at this time. McGillivray withdrew his second to the motion to adopt the resolution at this time. The motion died for lack of a second. Moved by Stephenson and seconded -by Erickson that the county board chairman shall appoint a negotiation committee which shall be confirmed by the county board. Motion carried. 8 r j. 420 The following resolution was read: No. 10 WHEREAS, Bayfield County did on May 29, 1979, adopt Resolution No. 12 providing for the distribution of payments received in lieu of taxes as provided for by public law 94-565 and WHEREAS, Said resolLA ion provides that 7S% of said monies be distributed to towns having U.S. Forest Lands and WHEREAS, Said resolution further provides that said monies are paid as aid to the townships under Section 83.03(1) of the Wisconsin Statutes for aid in construction, improving or repairing of highways or bridges, now therefore be it RESOLVED, That upon receipt of the aforesaid monies by the county the county clerk be and is hereby authorized and directed to pay 75% of said monies to the townships upon request. EXECUTIVE COMMITTEE: Wallace Johnson, Art Meierotto, James Stephenson, Larry Seidel, Ed Renoos, Ed Erickson, and Walter Barningham Moved by Erickson and seconded by Renoos to adopt the resolution. Motion carried. The following resolution was read: No. 11 1 WHEREAS, The president of the United States has ordered the immediate imposition of the Stand -By -Emergency Building Temperature Restriction Plan and WHEREAS, Said Temperature Restriction Plan applies to all buildings such as the county courthouse, the county Sheriff's Department, the county Highway Department and various highway shops and the administration portion of the County Rest Home and WHEREAS, Said temperature restriction provides minimum cooling temperatures of 780 Fahrenheit and maximum heating -temperatures of 650 Fahrenheit and WHEREAS, It is necessary for the county to execute and post an Emergency Building Temperature Restrictions Certificate of Building Compliance in each affected building and WHEREAS, Said certificates must be signed by either the building owner or operator, now therefore be it RESOLVED, That an Emergency Building Temperature Restrictions Certificate of Building Compliance be signed by the Chairman of the County Board for each affected building and that said chairman post or cause to be posted such certificates in each Bayfield County owned building affected by the Emergency Building Temperature Restrictions. EXECUTIVE COMMITTEE: 'Wallace Johnson,\James Stephenson, Art Meierotto, Larry Seidel, Ed Renoos, Ed Erickson, and Walter Barningham Moved by Renoos and seconded by Seidel to adopt the resolution. Clerk Pajala then addressed the board further explaining the regulations of the Building Temperature Restriction plan. The Question was asked on the motion to adopt the resolution. Motion carried. ,Two, 0 C September 25, 1979 No. 12 Renoos suggested that the county appoint an energy manager to take over the responsibility of checking to see that the Build-ng Temperature Restrictions and regulations are carried out in county buildings throughout the county. Strom suggested that the Zoning Administrator take on the responsibility as he would be more familiar with the changing building codes. Diamon thought that the Emergency Government Director should take over the responsibility. Bromberg made the suggestion that this appointment should be channeled through one of the committees. Moved by Renoos and seconded by Bromberg that the Personnel Committee appoint an energy manager. Motion carried. The following resolution was read: No. 13 WHEREAS, Prisoners are no longer incarcerated in the Bayfield County Jail and WHEREAS, Bayfield County Prisoners are presently being incarcerated in the Ashland County Jail and on occasion some other area county jail and WHEREAS, Bayfield County has been paying Ashland County at the rate of $10 per day for each prisoner incarcerated in the Ashland County Jail and WHEREAS, The Sheriff of Ashland County increased that rate to $20 per day effective June 1, 1979, and WHEREAS, The Bayfield County Sheriff's Committee has met jointly with the Ashland County Sheriff's Committee together with the Sheriff of Ashland County and the District Attornies to negotiate a prisoner board agreement and WHEREAS, Said joint committee has jointly approved a prisoner board agreement, a copy of said agreement being attached to and made a part of this resolution, now therefore be it RESOLVED, That the Bayfield County Sheriff and the Chairman of the Bayfield County Sheriff's Committee be authorized and directed to execute for Bayfield County the said agreement. Signed: James Stephenson, James Strom, Karl Lu.dzack, Wayne Sellung, Carl Anderson, Walter Barningham A (_R VVM77NT The Sheriff and Jail Committee of Ashland County, Wisconsin, and the Sheriff's Committee of Bayfield County, Wisconsin, do hereby enter into this Agreement pursuant to the authority of said committees to- enter into such Agreement as permitted by each respective County Board of Supervisors. 1. With respect to the housing of Bayfield County Huber Law prisoners in the Ashland County Jail, it is the policy of the Ashland County Sheriff that the following requirements be met prior to accepting such prisoners: A. That pursuant to Wisconsin Statutes 56.08, all Bayfield County Huber Law prisoners must work in Ashland County while in the custody of the Ashland County Sheriff and during his or her incarceration. 5 0 September 25, 19-79 B. That a prisoner who is attending an educational facility in Ashland County and who has been granted the Huber Law privilege from the Bayfield County Judge will be allowed to attend said educational . facility. 2. With respect to the housing of all Bayfield County prisoners in•the�Ashland County Jail, it is the policy of the Ashland County Sheriff that if there is not a matron on duty at the time of the incarceration of the Bayfield County prisoner and such incarceration requires the services of a matron, that Bayfield County will provide a matron and'bear the full cost of the employment of said matron. 3. It will be the responsibility of the Bayfield County Sheriff's Department to collect Huber Law fees from Bayfield County Huber Law Prisoners. 4. With respect to the proper fees to be charged Bayfield County by Ashland County for the boarding of all Bayfield County prisoners in the Ashland County Jail, the -agreed upon -rate is Twenty Dollars ($20.00) per day. S. If an injured or ill prisoner is brought to the Ashland County Jail by the Bayfield County Sheriff's Department, the Bayfield County Sheriff's Department shall.secure necessary medical services for that prisoner. It shall be the decision of the Ashland County Jailer as to whether a prisoner needs immediate medical attention prior to being incarcerated. 6. Bayfield County shall provide liability insurance coverage to compensate Ashland County for liability it may incur in the event a Bayfield County prisoner sustains injury while a prisoner in Ashland County. 7. The terms of this agreement will expire at the end of two years from the date hereof. Moved by Diamon and seconded by Maki to table the discussion until after lunch. Motion carried. The following equalized valuations were presented to the board: No. 14 REPORT OF THE COMMITTEE ON uQUALIZATION Washburn, WI August 29, 1979 TO THE HONORABLE BOARD OF SUPERVISORS OF BAYFIELD COUNTY: We, the undersigned Committee on Equalization of Bayfield County, after a careful examination of all evidence and data placed before us by the Supervisor of Assessments of said county and all other data at our disposal, do hereby agree that the following valuations set out after each taxation district are the correct valuations of the real and personal property of said county for the year 1979 and recommend that the county assessment of district values be made on said basis. Flo The following resolution was read: No. 15 WHEREAS, the Bayfield County board did on April 17, 1973, adopt a Reorganization Plan of the County Board of Supervisors and Committees which is recorded in Vol. 14; pages 86 - 93, County Board Journal, and WHEREAS, in said plan, included with the duties of the Executive Committee, item F provides "To supervise matters referring to delinquent and illegal taxes and securing tax titles for the County, and to have charge of -the appraisal and sale of county owned lands.", and WHEREAS, The Executive Committee is of the opinion that the appraisal of county owned lands should be delegated to the County Clerk and the County Treasurer, now therefore be it RESOLVED, that the County Clerk and the County Treasurer are authorized and directed to appraise all county owned lands before they are offered for sale pursuant to Sec. 75.69, Wis. Statutes. Stephenson suggested that to maintain continuity in the committee the County Forester should be added to the County Treasurer and the County Clerk to appraise land before county land sales. Moved by Stephenson, and seconded by Diamon to amend the resolution be addling the County Forester along with the County Clerk and County Treasurer -to appraise land values. Motion carried. The question was asked on the motion to adopt the resolution as amended. Motion carried. Moved by Bromberg and seconded by Rave to adjourn for lunch. Motion carried. September 25 Clerk Pajala next read the following letter: No. 19 Bayfield County Forestry Department Courthouse Washburn, WI 54891 August 22, 1979 Mr. David-Kedrowski Washburn, WI 54891 Dear Dave: At the meeting of the Bayfiel County Forestry Committee on the evening of August 21, 1979, Assembl Bill 515 was discussed in length. It is hoped that the criticism offered will be accepted as constructive rather than offensive. Everyone was in agreement with the need for wetland pro- tection but differed somewhat in the method of carrying out the job. Here are six items of major concern. The definition of a wetland is vague as presently determined in the Statutes. This could be interpreted as half of all the land in Bayfield County. The restrictive order resulting from a petition from five people could be very difficult to administer and now -days you can very readily find five people that would sign any kind of petition. The Department of Natural Resources has the ability to map all wetlands and should develop the basic guidelines but the adoption and enforcement of these guidelines should be vested in the County government. It is also hoped the allowable practice of 'Tconductings•ustained-yield forestry operations" will be reconsidered in light of the total lack of the definition of forestry operations. The proposed bill should cover all lands,'this includes unincorporated and incorporated municipal- ites. Again I would like to offer my thanks and appreciation for your attendance at our meeting. The following resolution was 'read: No. 20 WHEREAS, the Department of Social Services has experienced an increase in service caseloads, to the extent that if the trend continues, expenditures will exceed budgeted funds by an approx- imate amount of $20,000.00, and WHEREAS, it is the intention of the Department to apply for an additional available fund, now THEREFORE BE IT RESOLVED, by the Bayfield County Board of Supervisors in session this 25th day of September to transfer $20,000.00 from the contingency fund to the Social Services account. Ed Dashner, Social Services Director, then addressed the board explaining his request for additional funds. Dashner stated that the reason for the need for more money is the fact that his department has received additional requests for money for foster home care and care for the elderly. September 25, 1979 Carl Anderson then questioned if the Social Services Department would be working with an uncontrollable budget since they eannot foresee the ni;mber of people who will be requesting aid. Johnson answered by stating that it would not be an uncontrollable budget since they can control things such as staffing. The board then again discussed the matter of trading county owned lands for lands owned by the Hazel Hills Corporation in the Bibon Marsh area. It was pointed out that if the county has no intention of trading lands the forestry department should not be required to cruise the lands as originally requested by the county board. A motion was made by Ludzack and seconded by Stephenson that the county board give the Forestry Committee the authority to meet with the Hazel Hills Corporation to decide what lands they want to t,vade!and report back to the County Board. Motion carried. No. 23 Chairman Barningham then reported to the board that Jim Stephenson has asked to be relieved of his duties in the CEP Program. Barningham informed the committee that he would like to appoint Glenn Spears to replace Stephenson.
