HomeMy WebLinkAboutCounty Board of Supervisors - Minutes - 5/27/1980May 27, 1980 MEETING OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS Mav 27. 1980 The meeting was called to order at 9:37 a.m. by County Board Chairman Walter Barningham The following members answered roll call: No. 1 Present - Erickson, Barningham, Bromberg, Maki, McGillivray, Seidel, Strom, Rave, Soderstrom, Johnson, Carter,Diamon, Anderson, Wickman, Ludzack, Renoos Absent - Meierotto, Sechen Present - 16 Absent - 2 TOTAL 18 No. 2 A prayer and pledge of allegiance were led by Larry Seidel, board member. No. 3 Moved by Erickson and seconded by Johnson to dispense with the reading of the minutes of the previous meeting. Motion carried. The following resolution was read: No. 4 WHEREAS, The Bayfield County Board of Supervisors concurs with the Wisconsin Department of Transportation in the opinion that rail service will become more essential to Wisconsin R Communities as the energy shortage intensifies., and VVcl l WHEREAS, Chicago Northwestern Railroad has proposed to abandon lines between Washburn and 1 3 2 Rhinelander, and v WHEREAS, The quality of rail service in Bayfield County is deteriorating to the point of jeopardising the future economic welfare of Bayfield County as the people are dependent on efficient transportation for shipping and receiving products in Bayfield County, 0 oo NOW THEREFORE BE IT RESOLVED, That the Bayfield County Board of Supervisors, in session on Tuesday, May 27, 1980, establish a Bayfield County Transportation Commission, and BE IT FURTHER RESOLVED, This commission be composed of the members of the Bayfield County Land Sales and Development Committee, and BE IT FURTHER RESOLVED, That this commission be authorized to investigate methods of saving Bayfield County railroads, enter into cooperative agreements with other arms of government and to negotiate with investors who might preserve railroad service in Bayfield County. Submitted by: Joel Bromberg Moved by Bromberg and seconded by Renoos to adopt the resolution. Bromberg then informed the board that he had drafted this resolution from a sample copy resolution which was going'before other county boards. The'clerk then read a letter from Vilas County for informational purposes. Soderstrom then questioned as to who would have to do all the necessary work involved with this matter. Bromberg then stated that the work would probably be done through the clerk's office. Ludzack added that a great amount of the work could be done by the Northwest Regional Planning Commission. 27. 1980 Johnson stated that the Commission would, if requested by the County, get involved with the matter. He further stated that the county should look to the Commission as a resource. The question was asked on the motion to adopt Resolution No. 4. Motion carried. In fact, this will be the first time in 53 years. We in the Northland come in contact with the DNR daily, and I believe it is unreasonable for the .powers to be in the State not to give us representation. Art Meierotto arrived at this time. l- No.7 Don Wilson and Don Chatfield, Department of Transportation addressed the board about the possibility of providing federal funds for the resurrection of the transit system between Red Cliff, Washburn, Ashland, and Odanah. Wilson informed the board that an application could be made for a federal grant which would cover 80% of the initial cost of purchase of equipment and other costs related to beginning the operation and the grant would also cover 50% of any deficit in the operation of the system. Seidel then questioned if the federal monies that would be received for this project would be a one time grant or a continua:l..grant. 24 27, 1980 Wilson answered that federal funds provided through these acts recognize continuing needs and he would expect Congress to extend this program just like other programs of this nature. Erickson asked if the buses used '.would be new buses or if.,. they would be older buses. Wilson answered that he had hoped to see that newer equipment would be used in the transit system. He envisioned that they would have two buses operating and one in reserve. Erickson also questioned if it would be a donation service. Wilson answered that there would be a reasonable fixed fare for use of the transit system. Ludzack questioned if this program could be expanded so that it could cover more of the county. Wilson stated that at present that would be too large scale a project but it is definitely a thought for the future. Wilson then informed the board that the Red Cliff Tribal Council is supportive of the program and is willing to make application for funding. Anderson questioned if it would be possible to use commercial buses that are already in existence. Wilson answered that it would be ppssible to -lease the buses rather than to purchase. Diamon suggested that the Board Chairman appoint a committee of three members from the townships involved to work with the Department of Transportation on this matter. Moved by Bromberg and seconded by McGillivray that the County Board Chairman appoint a committee of three members from the townships, involved to work with the Department of Transpor.= tation on the system. Moved by Anderson and seconded by Rave to approve the presentation made by the Department of Transportation and approve of 'the study. Motion carried. No. 7C, Moved by Renoos and seconded by Ludzack to appoint the County Land Sales Committee to work with the Board of Transportation on this matter. Motion carried. Ma The following resolution was read: No._8 WHEREAS, There is presently in effect in Bayfield County a comprehensive Zoning and Sanitary Ordinance, and, WHEREAS, C.J. Kontny, a property owner, residing on a parcel of land located in the North-East One -Quarter (NEµ) of the North-East One -Quarter (NE-,[), of Section Twenty -Six (26) , Q Township Forty -Seven (47) North, Range Six (6) West, Town of Keystone, allegedly did locate on his property a mobile home, did construct an addition to his existing dwelling, and did substantially alter an existing private domestic sewage treatment disposal system without first obtaining a land use and sanitary permit, and, WHEREAS, Said alleged activities are contrary to the terms of Sections 2.01 and 2.05 of the Bayfield County Zoning Ordinance and Sections 2.1 and 3.1 of the Bayfield County Sanitary Ordinance, and, WHEREAS, Said'C.J. Kontny has failed to initiate action to rectify this matter, and, WHEREAS, The Bayfield County Zoning Committee has recommended that an action be commenced against said C.J. Kontny for the violation of the,provisions of said ordinances and for such relief as may be appropriate and, WHEREAS, Said ordinances require Bayfield County Board approval before such action is instituted, NOW THEREFORE BE IT RESOLVED, That the Zoning Committee recommends that the Bayfield County Board of Supervisors authorize the Bayfield County District Attorney to commence such action as may be appropriate for such alleged illegal acts, and to cause compliance with the terms of said Zoning and Sanitary Ordinances,and BE IT FURTHER RESOLVED, That any penalties involved shall conform with the violation provisions of Section 15.0 of the Ba.yfield County Zoning Ordinance and Section 10.0 of the Bayfield County Sanitary Ordinance. Dave Lee then updated the board as to the events that happened since the County Board had directed the Zoning Committee to meet with Kontny and how to -date Kontny still has not made an attempt to correct the problems. George Koval, Chairman Town of Keystone,then addressed the board informing them of the meeting the town board also had with Kontny. The question was asked on the motion to adopt Resolution No. 8. Motion carried. No. 9 Jane Schumacker, ombudsman from the Governor's office, then addressed the board. She stated that her main purpose of coming before the board was to introduce herself to them and to let them know what services are available through her program. She explained the legal services that are provided to the elderly and disabled,& how she is involved with nursing home concerns and consumer protection. She explained that her services are available to anyone 60 years of age or older or anyone who has a handicap. She also added that there is no income criteria for her to follow. She also gave the board the following toll free number to call in f Hayward: 1-800-242-1060. The following resolution was read:' No. 10 WHEREAS, The per diem for County Board Committees other than regular committees has usually been set at the same rate as the per diem paid to County Board members attending committee meetings and WHEREAS, No provisions have been made for establishing the per diem for the members of the 51.42 board, now therefore be it RESOLVED, That the per.diem and mileage paid to members of the 51.42 board be established to be the same rate as paid to County Board members attending regular committee meetings and be it further RESOLVED, That in the event that the per diem or mileage paid to County Board members is adjusted, the mileage rate and the per diem for 51.42 board members will be adjusted accordingly. The following letter and resolution were read: No. 11 and lla Arlene Weiss 12421 Dairy Ashford Houston, TX 77099 May 23, 1980 Mr. Edward Pajala Bayfield County Clerk Washburn, WI 54891 Dear Mr. Pajala: Thank you for bringing to my attention the tax deed notice on my property (Lot 118 of the Woodcrest Addition to Wilde River).- I was not aware of this situation prior to your recent letter and would have expected notification at my Texas address as taxes have been paid the past —wo years from this address. Concerning the omissions on my part --let me reiterate our phone conversation: Tax of 1973: I had been told, verbally, at the time of purchase that I bore no responsibility for the first years' tax. Never having purchased any property prior to that point I did not check the contract for�conf irmation until your letter. Thus, I acknowledge my omission. Tax of 1975: Examination of old checkbooks and checks revealed that check number 785, dated March 31, 1976, for $144.89 was issued to Bayfield County. That check, however, is missing and apparently was never cashed. Tax of 1976: I have no record for payment of this tax. Constant business traveling, the move to Texas, and the resulting confusion would partially account for my negligence. Subsequent to getting settled here, I did notify Joann Lang about my non -receipt of my 1978 statement. Shortly thereafter I received the statement and paid accordingly. Furthermore, the 1979 taxes were paid February 9, 1980, which is subsequent to the county taking deed. To satisfy this situation, I have enclosed full payment and request County Board redemption. Again, Thank you for bringing this matter to my attention. Very truly yours, Arlene Weiss Si May 27, 1980 No. 11a WHEREAS, Bayfield County is the owner of Lot 118, Woodcrest Addition to Wilde River, Town of Cable, and WHEREAS, Bayfield County acquired the aforesaid parcel of land by a tax deed taken on December 281 1979 for the delinquent tax of 1973, Sale of 1974, and WHEREAS, A letter addressed to Arlene Weiss, former owner of the property, was mailed by certified mail to Arlene Weiss at 1317 Braumell, Evanston, IL 60202, on September 20, 1979, which letter was returned unclaimed due to the fact that the aforesaid Arlene Weiss had moved to Houston, Texas, and WHEREAS,Arlene Weiss did pay the 1974, the 1977, and the 1978 tax prior to the time that the county took a deed on the 1973 tax, and WHEREAS, Arlene Weiss did pay the 1979 tax to Joann Lang, Treasurer, Town of Cable, on the aforesaid parcel of land unaware of the fact that the county had taken a tax deed on the land, and WHEREAS, The County Clerk has now notified Arlene Weiss of the fact that the county has taken a deed on her property and said Arlene Weiss has indicated that she would desire to redeem her property and has, in fact, mailed a check to the County Clerk in the amount of $622.25, which covers the delinquent tax of 1973, 1975 and 1976, plus interest and other charges, now therefore be it RESOLVED, That Arlene Weiss be allowed to redeem Lot 118, Woodcrest Addition to Wilde River, and that the County Clerk be authorized and directed to issue to Arlene Weiss a quit claim deed on the aforesaid Lot 118, Wilde River Addition, Town of Cable. No. 13 Lou Stolle, Director, Unit on Aging,then addressed'the board informing the new members of what the county agin Unit is and gave the whole board an up -date of the U.nit's activities. He informed the board that the Unit came into effect last May and during that year they have established an information referral telephone, a transportation program funded through the state, an escort program, supportive home care program and they are developing a home maintenance and repair program. This concluded Stoll.e's presentation. No. 14 Moved by Johnson and seconded by Erickson that Karl Ludzack be appointed to the CEP Board to replace H. Glenn Spears. Motion carried. No. 15 Moved by Strom and seconded by Wickman that Hazel Maki be appointed to the Bayfield County Housing Authority Board. Motion carried. Moved by Erickson and seconded by Seidel to adjourn for lunch. Motion carried. The meeting was called to -order at 1:05 p.m. by Chairman Walter Barningham. The following members answered roll call; No. 16 Present - Erickson, Meierotto, Barningham, Maki., McGillivray, Strom, Rave, Soderstrom, Johnson, Carter, Diamon, Anderson, Wickman, Ludzack, Renoos Absent - Bromberg, Seidel, Sechen Present - 15 Absent - 3 TOTAL 18 No. 17 Bob Becker, Assistant District Director Department of Natural Resources, and Jerry Rickhoff, Area Supervisor Department of Natural Resources, next gave a presentation on the Bibon Swamp area. They informed the board that shortly Environmental Impact Statements would be sent to them, he added that there are two parts to this study - the draft stage and the information received at the public hearing which is t❑ be held on July 2. Joel Bromberg arrived at this time. Becker also stated that he would like to request a meeting for the first-half of July with the Executive Committee when the Environmental Impact Statement is out. This concluded the presentation from the D.N.R. 27. 1980 0, The following resolution was read: No® 18 WHEREAS, An appointment has been made to the Board of the Department of Natural Resources to replace Steve Pavich, a resident of Bayfield County, and WHEREAS, The new appointee is from the southern portion of the State of Wisconsin, and WHEREAS, The recent appointment leaves the entire northern one third portion of the State of Wisconsin without representation on the Board of the Department of Natural Resources, ant WHEREAS, This lack of representation of the northern one third of the State of Wisconsin on the Board of Natural Resources has not been experienced in the last 53 years, and WHEREAS_, .It is very important to not only the northern portion of the State,'but to the entire State that representation on the Board of the Department of Natural Resources be apportioned through all areas of the State, now therefore be it RESOLVED, That the Bayfield County Board go on record in opposition to the lack of representation on the said Board, and be it further, RESOLVED, That an effort be_made to apportion the State into seven (7) separate districts, with each district being represented by one member so as to provide representation on the Board from all areas of -the State. LAND SALES AND. DEVELOPMENT COMMITTEE: McGillivray, Soderstrom Renoos, Erickson, Meierotto, Barningham Moved by Erickson and seconded by Soderstrom to adopt the resolution. Motion carried. Larry Seidel arrived at this time. No. 19 Sue Gatts, Emergency Government Director, next addressed the board on the TT9111t System saying that Bayfield County had submitted a grant application for " 911" and the application had been denied. Gatts then proceeded to read to the board a letter she had received from the State denying the application. The letter stated that the reason for denial was because a resolution in favor of "91111 was not passed and submitted by the board to the State before the filing date of January 31. Anderson then questioned Gatts about what is the county's responsibility in the "91111 system. Gatts answered that the county's responsibility would be implementing the system and the cost for the county would be the mileage rates from the telephone company to the communication center. The telephone company would absorb the cost of the main equipment. The following letter was read: No,. 20 May 22, 1980 TO: BAYFIELD COUNTY BOARD MEMBERS BAYFIELD COUNTY BOARD COURTHOUSE WASHBURN, WISCONSIN -54891 FROM: R. W. FREDERICKS, BAYFIELD COUNTY SHERIFF RE: BAYFIELD COUNTY JAIL My sincere regrests for not being able to attend your May 27 County Board meeting. I would like to be there to personally convey the following information. Previous committments require my presence elsewhere. During your May 27th meeting you will receive a report on a recent joint meeting between the 27, 1980 Ashland and Bayfield Coynt Sheriff's Coguitt es Iam taking this.opportunity to submit my own repor an personne o inion as dirktion the County should -proceed -in this very important Jail issue. For the past year I have investigated the pros and cons of consolidated Jail use. I have finally come to the conclusion that this would not be the best direction to proceed. My reasons for reaching this conclusion are as follows. 1. Economically, a consolidated,effort may or may not be feasible. There is a possibility that over a long period of time this County could save a few dollars. I have serious doubts that a consolidated effort could continue to be maintained over thislength of time.. 2. Regardless of how a consolidated effort was administered, Bayfield County would not have full control. Without this ability to control..a security institution of our own, we will not be adequately able to meet all of the' ne.ed's of 'Bayfield County prisoners. 3. The problem of transportation of prisoners will still be in existence. It requires a considerable amount of time and energy to transport these prisoners. It also creates problems with Court schedules and Court appearances. The inconvenience to attorneys, probation and parole people, alcohol and drug counselors as well as members of the prisoners', families have to be considered. 4. A consolidated effort will have to include the dispatching services. The Bayfield County Sheriff's Department dispatches not only all of the police agencies in the County, we also dispatch for nine ambulances and two fire departments -with the -expected addition of several more fire departments in the near future. Dispatching also covers the monitoring of alarm systems (burglary and fire) as well as -radio systems for the Federal Forestry and Bayfield County Highway Dept. Should the two counties combine these services, it will be necessary to hire additional staff people to act as Jailers. No longer will the dual role of jailer -dispatcher be practical. Bayfield County, operating its own institution, will be able to continue using these people in a dual role, and'also continue to provide adequate attention to both positions. The technical aspects of consolidated ,dispatching will be extremely expensive and difficult to overcome. Telephone and radio systems will both require major alterations. These alterations could result in some of the services provided by this office being terminated. Here again, we would be losing -some local control- These four points are of primary concern to an effective operating procidure for a Bayfield County Jail. There are also many other items which are too lengthy to be considered at this time. With all due consideration, and after careful study and evaluation, I have determined that the possible savings are not justified by the benefits to be lost, as well as the incon- venience of the enter operation. Therefore I am urgipg you at this time to give your support to the building of a new jail attached to the rear of the rest home building, and remodeling the existing structure for utilization asp-Bayfield County Law Enforcement Center. The following resolution was read: No. 21 WHEREAS, The County Board did at their April 15 meeting direct the Bayfield County Sheriff and the Sheriff's Committee to meet together with the Ashland County Sheriff and the Ashland County Sheriff's Committee to further discuss the possibility of joint jail use and WHEREAS, Said joint committees did meet on May 3 and did discuss the matter at length and WHEREAS, By unanimous vote passed a motion recommending that both Ashland and Bayfield County continue the study of joint jail use.-aow therefore be it RESOLVED, That the Bayfield County Sheriff's Committee together with the Sheriff further study the matter of joint Ashland--Bayfield County jail use. SHERIFF'S COMMITTEE: Ludzack, Anderson, Barningham, Maki, Wickman Moved by Anderson and seconded by Maki to adopt. 27, 1980 Dale Maki, Chairman of the Sheriff's Committee, then reported on the previous meeting of the.Ashland--Bayfield County.Sheriff�' Committees. Strom then questioned if it was legal to spend Bayfield County tax dollars.to remodel another county's jail.. He also wondered if it was legal to commit either county , to a long term agreement. Renoos stated that he was in favor of 'Bayfield.Cgu-nty building their own jail and he felt that the county should not go on with the joint jail study._ Chief deputy Neff then informed the board of the reasons why Sheriff Fredericks changed his mind on continuing, the joint jail study. One of the reasons-was.the legal problems that would be encounter-ed with the consolidation and also Fredericks felt. that the expenses, espec.lally for the dispatching service, would cost Bayfield County more than Ashland County for the suvitch. The question was asked on the motion to adopt Resolution No. 21. Gentlemen: We have been informed by the Wisgonsin Funeral Directors Association, that: "Chapter 206 increasing the non -asset welfare funeral allowance from $300.00 to $600.00 becomes law tomorrow, May-8th - your county welfare director (and likely County Board) must first approve any increase." We are at this time, then,'respectfully asking the Board for serious consideration in this regard. With today's inflated prices,..the current allowance of $300.00,does not even cover ordinary grave opening and closing fees (in Bayfield it is $170.00), vault charges and transportation fees (approximately $240.00, and much higher, if a burial takes place on a weekend or holiday). Burial receptacles and all professional fees, therefore, become gratis items..
