BOARD OF SUPERVISORS

The meeting was called to order at 9:47 a.m. by Chairman Walter Barningham

Moved by Erickson and seconded by Soderstrom to dispense with the reading of the
minutes of the previous meeting and to approve of the minutes as written. Motion carried.
The following report was read: No. 4
TO: The County Board of Supervisors of Bayfield County on the hearing on the petitions to amend
the Bayfield County Zoning Ordinance. -
The Zoning Committee of the'Bayfield County Board of Supervisors, having held a public
hearing pursuant to Section 59.97(5), Wisconsin Statutes, notice thereof having been given as
provided by law and being duly informed of the facts pertinent to the proposed changes,hereby
recommends that the petitions described'as-follows be'approved:
The South two hundred twenty (220) feet of the Southeast one -quarter (SEµ), of the
Southwest one -quarter (SWµ); Section Thirty-three (33), Township Forty-five (45),North, Range
Nine (9) West, Town of Barnes; more specifically described in Volume 294, Page 441 of the
Register of Deeds Office; be changed -from Forestry-1 Use to Residential-3 Use.
The following three parcels of land, all of which are located in Section Five (5),

The following resolution was read: No. 6
WHEREAS, One member of the Bayfield County Board of Adjustment, whose term was to
expire July 1, 1981, has resigned, and,
WHEREAS, It is recommended to the Bayfield County Board of Supervisors, that Gordon
Strub, Iron River, Wisconsin, be appointed to said Board of Adjustment to fill said vacancy, and
WHEREAS, It is also recommended that Gordon Strub be appointed to serve on said Board
of Adjustment for a three year term commencing July 1, 1981, now therefore be it
RESOLVED, That Gordon Strub is hereby appointed to the Bayfield County Board of
Adjustment.

Steve Schraufnagel, Ashland County Board Member, appeared before the board to discuss
the John F. Kennedy Memorial Airport.
Schraufnagel first passed out to the board information on the airport including a budget
request and a map.
Schraufnagel also presented the board with a statement written by him on the need for the
participation of Bayfield County in the J.F.K. Airport ownership, operation, and budgetary
support. -Schraufnagel read through the statement which gave a brief history of the airport and
stated the benefits it can give to this area.
Mr. Schraufnagel requested that two County Board members be appointed to analyze the
services of the Ashland Airport to Bayfield County, view its operations, and report back to the
full County Board so that possibly a resolution could be drawn up allowing Bayfield County to
work with Ashland County and the City of Ashland on the airport program.

Moved by Rave and seconded by Ludzack to have.the County Board Chairman appoint two
County Board members to analyze the services of the airport and the benefits to Bayfield County
and report back t-a:the County Board. Motion carried.
Walter Barningham, County Board Chairman, bppointed Jim Mattson and Karl Ludzack to
serve in this capacity.

WHEREAS, the Unified Services Board Members are appointed to a specific three year term
of the Board, and
WHEREAS, Pauline Ludwig, Alice Maassen and James Mattson were appointed to fill unexpired
terms of previous Board Members which term expired April 30, 1981, and
WHEREAS, these Board Members are not fully experienced to the policies of the Board, and
WHEREAS, program planning and development for 1982 may undergo revisions due to proposed
changes in legislation and funding, therefore
BE IT RESOLVED, by the Bayfield County Board of Supervisors in session this date of
May 21, 1981, that the above mentioned Board Members be hereby appointed for a three year term
to the Bayfield County Unified Services Board.

To effect this change, pursuant to authority granted under Sections'84.02(3) and 84.09,
Wisconsin Statutes, the Department of Transportation hereby orders that:
1. The said highway is hereby laid out and established to the lines and widths as shown
on the plat.
2. The required lands or interests in lands as shown on the plat shall be acquired by
the Division of Highways and Transportation Facilities, in the name of the State of Wisconsin,
pursuant to the provisions of Section 84.09(1) or (2), Wisconsin Statutes. (All required lands or
interests in lands have previously been acquired).
3. This order supersedes and amends any previous order issued by the former state
highway commission.

Recent comments in the Washburn Times have prompted me to write you regarding the naming of
area financial institutions as a depository of county funds.
The Northern State Bank does have a branch office in Bayffield County as you are well aware. We
have not, however, been asked for a quotation on interest rates for investment of county funds
since September of 1980. We feel we can be very competitive and would appreciate an opportunity
to quote on your investments from time to time.
I note our Mason branch office has a 1979 depository resolution, so I am enclosing a new document
for completion by proper county officers.

RESOLVED, That Northern State Bank, qualified as a public depository under Ch.34,
Wisconsin Statutes, is hereby designated as a depository in which the funds of this Municipality
may from time to time be deposited; that the following described account(s) be opened and maintain
in the name of this Municipality with the Bank subject to the rules and regulations of the Bank
from time to time in effect; that the person(s) and the number thereof designated by title opposite

FURTHER RESOLVED, That the Bank be and is hereby authorized to comply with any process,
summons, order, injunction, execution, distraint, levy, lien, or notice of any kind (herinafter
called "Process") received by or served upon the Bank, by which, in the Bank's opinion, another
person or entity claims an interest in any of these accounts and Bank may, at its option and
without liability, thereupon refuse to honor orders or to pay or withdraw sums from these accounts
and may hold the balance therein until Process is disposed of to Bank's satisfaction.
FURTHER RESOLVED, That any one or more of the persons holding the offices of this Munici-
pality designated above is/are hereby authorized (1) to receive for and on behalf of this Municipal-

receipts therefore, and the Bank is hereby authorized to make delivery of such property.in

FURTHER RESOLVED, That this Municipality assumes full responsibility and holds harmless
the Bank for any and all payments made or any other actions taken by the Bank in reliance upon
the signatures, of any person or persons holding the offices of this Municipality designated
above and if such signatures resemble the signatures as provided to the Bank or for refusing to
honor any signatures not provided to the Bank or for honoring any requests for the transfer of
funds or money between accounts, and that this Municipality agrees to indemnify and hold harmless
the Bank against any and all claims, demands, losses, costs, damages or expenses suffered or incu
by the Bank resulting from or arising out of'any such payment or other action.

FURTHER RESOLVED, That the undersigned officer of this Municipality be and hereby is
authorized and directed to certify to the Bank the foregoing resolutions, that the provisions
thereof are in conformity with law and to provide the names and specimen signature(s) on
signature cares, if requested of the person(s) authorized therein, and that the foregoing
resolution, and signature cards and the authority thereby conferred shall remain in full force
and effect until this Municipality notifies the Cashier of Bank to the contrary in writing; and
the Bank may conclusively presume that such resolutions and signature cards are in effect and
that the persons identified therein from time to time as officers of the Municipality have been
duly elected or appointed to and continue to hold such offices.

The following resolution was read: No. 11
WHEREAS, The proof sheets for the new plat books have arrived, and
WHEREAS, These proof sheets have been distributed to the respective towns, and
WHEREAS, The Executive Committee has recommended that only County Board members receive
plat books without charge, and
WHEREAS, The cost per book is $10.18 not including tax, now therefore be it
RESOLVED, That the Bayf field County Board in session this 26th day of May, 1981,
authorize and direct the County Clerk to ..,issue a new plat book free of charge to the following
officials: County Board Supervisors, and be it further
RESOLVED, That in the event of termination of any of the above mentioned county board
of supervisors, it shall be the duty of said supervisor to return the plat book to the County
Clerk.

Clerk Strom informed the board that the books will cost $10.30 after the free ones are
given away, therefore, the $10.00 figure will not be sufficient.

Gentlemen:
Constance Capitano and the First Bank of Apostle Islands have both contacted {', me in regards to
property taxes due for the year of 1975 on Lot 16, Block 10, in the original townsite of Washburn.
The bank has a mortgage on the property, and Mrs. Capitano owns it, having purchased it from
Ronald Guske in 1978.
At the time Mrs. Capitano purchased the property, the records of the Bayfield County Treasurer's
Officer erroneously showed taxes due on the property only for the years 1976 and 1977. These
taxes were paid out of the proceeds of the sale. Subsequently, it was discovered that the 1975
taxes, amounting to $439.09, were also due on the property. These taxes should have been paid by
Guske but he no longer owns the property and apparently has not financial resources to speak of.
The taxes have been delinquent for 5 years, and consequently the property would normally be
foreclosed upon in our tax foreclosure proceeding next fall.
Because the county's records were in error and Mrs. Capitano relied upon them to her detriment,
I think it is likely that the county would be required to compensate her for her resulting loss if
the matter was contested in court. I therefore recommend that the county avoid a legal contest
by paying the 1975 taxes itself.

Regarding the above captioned matter, this is to inform you that the above described employees
who are members of Teamsters Local 3LE6 have ratified the county proposals that were agreed to in
WERC mediation with Robert McCormick on April 22, 1981, in regard to the dispatchers agreement
this was subject to the modifications you made in person at -the Sheriff's Office with the members
on this date May 22, 1981. With this mailgram, it is my understanding that the County Board
would approve the contracts mentioned above and pay the new rate and retroactivity from January 1,
1981, at their May 26 County Board Meeting.

Add the following holidays:

2. Article XXXI - Clothing
The present clothing policy is to be continued except that the employer shall provide the
annual sum of up to $50.00 for employees service shoes. The shoe shall be plain toed with uniform
color. The style and color is to be determined by the Sheriff with the employees having the option
of selecting a shoo or boot which is high-topped, low -topped or a Wellington boot.
3. Article XXVI - Sick Leave
Increase the number of sick leave accumulated days to 72.
4. Appendix A - Meal Allowance
Add the following language:
"The employer shall pay each employee a $50.00 per month meal allowance by separate
check. The $50.00 per month shall be deducted from the employees' monthly compensation rate
set forth above."
S. Wage Increase:
Apply a 10% increase to the 18-month schedule and reduce the salary schedule by the
percentage differences between each lesser step.

new labor contract and

TO: Bayfield County Board of Supervisors
FROM: Bayfield County Forestry Committee
SUBJECT: Withdrawal Request of County Forest -Land by Mr. Eugene 0. Voelk
Gentlemen:
As per Motion No. 25 of the April Meeting of the County Board of Supervisors, the Forestry
Committee considered the request of Mr. Voelk for the withdrawal from County Forest of 40 acres
NEµNEµ, Section 10, Township 47 North, Range 8 West. Home construction and small scale fruit
acriculture was the proposed use.
After considerable discussion, the motion was made and seconded to deny the proposal. The basis
of the denial was that the forty acres in question is very desirable land to use for a future
trade for private land within the County Forest boundaries.
Considerable discussion was also devoted to the matter of withdrawal requests. It is evident
that these withdrawal requests can take up a lot of time of the County Board Committee members
and the Forestry Department. After due consideration; -land 'appraisal, correspondence with
numerous individuals and untold meetings, Bayfield County can have a considerable amount of
money invested in the withdrawal.

If the withdrawal is allowed, the investment can be recovered. If the withdrawal is not allowed,
or the person making the request fails to purchase, the county is left holding the bag.
An obvious solution to this problem would be requiring a posting of "earnest money" with any
withdrawl request to cover the cost of administration. The Forestry Committee would appreciate
the opinion of the Board of Supervisors on this matter.

The following letter was read: No. 17
TO: Bayfield County Personnel Committee
FROM: Department Heads and Supervisory Personnel
SUBJECT: Salary Negotiations
Gentlemen:
Considerable time has elapsed since salary negotiations with the department heads and supervisory
personnel were suspended. The idea was to negotiate with the various unions and use the agreement
reached as a base line for the non -represented personnel.
It now appears as though agreement with one union is at hand. Likewise, the Highway Department
appears to be going -into arbitration which will postpone any final decision until the August
meeting of the County Board.
Our group has been polled and we are willing to settle for no less than the Sheriff's Department
union has agreed to. It is our understanding that this amounts to approximately 10%.
The statement made by the Personnel Committee in November of 1980 that "what is fair for one is
fair for all" is also endorsed by our group. We sincerely hope that 'this feeling is still
prevalent among the members of the Personnel Committee.
Any action by the Personnel Committee to consummate a settlement will be greatly appreciated by
our group.

Carl Anderson stated that he did not think this matter could be settled without meeting
directly with the employees' representatives.
Moved by Renoos and seconded by Erickson to refer the matter to the Personnel committee
and if the courthouse employees and department heads come to an agreement with the committee, the
County Board could meet in special session to ratify the agreement. Motion carried.

Six reapportionment plans were presented to the committee. Discussions were then held
on the six plans.
Some board members stated they did not/like the idea of splitting the townships as
proposed in Plans 1, 2, and 3.
It also seemed to be the concensus of the board members that a 15 person board a,sy
proposed in -Plan 6 may not be large enough.
Sneed expressed her preference of Plan 4; several members agreed with Sneed.
Moved by Diamon and seconded by Rave to adjourn as a committee of the whole and
reconvene as a County Board. Motion carried.

municipalities for approval.
