The meeting was called to order at 9:30 a.M, by Chairman Walter Barningham

Moved by Rave and seconded by Soderstrom to dispense with the reading of the minutes
of the previous meeting and to approve of the minutes as written. Motion carried.

To: The -County Board of Supervisors of Bayfield County on the hearing of the petitions to amend
the Bayfield County Zoning Ordinance.
The Zoning Committee of the Bayfield County Board of Supervisors, having held a public
hearing pursuant to Section 59.97(5), Wisconsin Statutes, notice thereof having been given as
provided by law and being duly informed of the facts pertinent to the proposed changes, hereby
recommends that the petitions described as follows be denied:
Government Lot One (1) , Section Twenty (20) , Township Fifty (50) North, Range Four (4)
West, Town of Bayfield, be changed from Forestry-1 Use to Residential- Recreational Use.
The Zoning Committee of the Bayfield County Board of Supervisors, having held a public

David Lee, Zoning Administrator, went through each description for the board explaining
how and why these descriptions were changed.

NOTICE OF CLAIM AND CLAIM
TO: County Clerk, Bayfield County, Wisconsin:
YOU ARE HERBY NOTIFIED that, on the 16th day of March, 1981, at about the hour of 11.40
a.m., that the undersigned, National Iron Company, a division of Pettibone Corporation, 50th
Avenue West and Ramsey St., Duluth, MN 55807, Pettibone Corporation, 4700 West Division St.,
Chicago, Illinois 60651 and Pettibone International Sales Corporation, 799 Brickell Plaza,
Fo&ITih Floor, Miami, Florida 33131, suffered great damage to personal property, costs and conse-
quential damages by reason of the insufficiency and want of repair and maintenance of a public
highway in said County, namely, U.S. Highway 2, in the Township of Keystone, County of Bayfield,
about four and a half miles west of its junction of U.S. Highway 2 and State Highway 63 all
approximately 15 miles west of Ashland, Wisconsin. The insufficiency and want of repair and
highway defects caused a severe frost heave and cracking and buckling of the highway surface
causing the front steering axle on a Pettibone Model 100 TKLS Truck Krane.: to break, rendering
the crane out of control and causing the crane to leave the highway and plunge down a steep
embankment resulting in damage to property in the sum of $174,426.19, cleanup and wrecking costs
of $5,688.54 and consequential damages in the amount of $18,960.00 for total damages of $199,074.7;
as itemized on the statement attached hereto.
That said highway defects were caused by the negligent acts and omissions committed
while carrying out duties as officers of employees of Bayfield County by Lawrence C. Young,
Bayfield County Highway Commissioner and all other officers and employees of the Bayfield County
Highway Department.
That pursuant to the provisions of Sec. 893.80 Wisconsin Statutes, the undersigned
hereby notifies Bayfield County and Bayfield County Highway Commissioner Lawrence C. Young that
it claims damages against Bayfield County and Larence C. Young jointly and severally in the amount
of $199,074.73.

The cost figures above are estimates, NOT firm prices..
Due to the type of equipment and the extent of damage all work done on this crane would be on a
time and material basis,since it is not possible to accurately determine the full damage until
the unit is fully disassembled and inspected.

A.dog damage claim from George Sveda was next presented to the Board. The claim
was in the amount of $100.
Moved by Carter and seconded by Erickson to approve the claim. Motion carried.

The following resolution was read: No. 7
WHEREAS, The Bayfield County Board of Supervisors adopted the Bayfield County
Outdoor Recreation Plan on February 3, 1981; and
WHEREAS, The demand for recreational boat access has increased on Lake Superior, and
WHEREAS, The Thompson West End Park, located in the City of Washburn, Wisconsin,
boat launching access is in need of dredging to deepen the access to a minimum of five (5) feet;
thus resulting in improvement of the present average depth of three and one-half (32) feet to
accomodate the larger recreational boats now in use.
NOW THEREFORE, BE IT RESOLVED, That the Bayfield County Outdoor Recreation Plan be
amended to include this recommended improvement.

The following resolution was read: No. 8
WHEREAS, Bayfield County has been billed for the care of Veterans' graves in the
Woodland Cemetery in Washburn each year pursuant to S.S. 45.185, and
WHEREAS, The City of Washburn does have perpetual care of cemetery lots, and
WHEREAS, The Executive Committee deems it in the best interest of Bayfield County to
provide perpetual care of veterans' graves, now therefore be it
RESOLVED, That Bayfield County purchase perpetual care of veterans' graves in the
Woodland Cemetery in Washburn, Wisconsin, beginning January 1, 1982, at a cost of $2,160.00'.

Soderstrom,stated that he would like further study into the matter to make sure the
county is paying ajust amount for the care of the graves. '
Clerk Strom informed the. board that the county, by statute is required to make payment
for care of the veterans' graves; therefore, they hay.e two choices - 1) continue paying $15
per year per grave,or 2) pay a one time charge of $45 per grave.
Soderstrom still""'opposed the motion stating further study should be made into the matter.
The question was asked on the motion to adopt Resdliition No. 8.

Moved by Renoos and seconded by Soderstrom to refer the matter of care of veterans' graves
back to the Executive Committee for further cost analysis. Motion carried.

Moved by Soderstrom and seconded.by Erickson to set the date of the Eqalization
Meeting for August 26, 1981, at 6:00 p.m. and to meet as a full county -:,board.
Soderstrom stated that he wished the full board to meet so that they can give some input
into the state valuations.
The question was asked on the motion to meet as a full County Board on Aug. 26, beginning
at 6_:00 p.m.

Margaret Stuber next appeared before the board. Mrs. Stuber introduced 'to the board
Tom Anderson, Extension Agent,and Carolyn Krueger, Home Economist, who each in turn gave a
brief synopsis of their duties.
Next Mrs. Stuber introduced Palmer McCoy, University of Wisconsin Extension Services
from the Hayward area office, and Joe Eisele, from the Rhinelander area office.
Mr. McCoy and Mr. Eisele then gave a demonstration on the newest equipment being used
in the Extension field, such as video --tape machines and computer terminals.

WHEREAS, The salaries of the Bayfield County Deputies was approved by County Board
action, and
WHEREAS, The salaries -.'.of said deputies were computed in error and, therefore, are not
correct as shown in the minutes, and
WHEREAS, There iS now.:agreement between the Union and the Personnel Committee, now
therefore be it
RESOLVED, That the Personnel Committee recommends to the County Board that the contract
language be changed as follows:
Appendix A Meal Allowance -- The employer shall pay each employee a $50.00 per month
meal allowance by separate check. The $50.00 per month shall be deducted from the employees'
monthly compensation rate set forth above.
This paragraph should be changed to read:

WHEREAS, The Chief Deputy's salary has not been fixed for the year 1981, and
WHEREAS, The Chief Deputy's salary does not appear in the Union contract, and
WHEREAS, The Personnel_;Committee does recommend to the County Board, that the salary
of the Chief Deputy be $50.00 per month higher than a deputy sergeant, including the deputy
sergeant's meal allowance, now therefore be it
RESOLVED, That the salary of the Chief Deputy be fixed at a figure of $1,515.90 per
month, retroactive to January 1, 1981.

The following resolution was read: No.' 15
WHEREAS, The Sheriff's Committee did authorize the purchase of four new sgaud cars,
WHEREAS, The bids were received and let, and
WHEREAS, The amount of money in the budget for these cars was not sufficient to make
payment, and
WHEREAS, The cars are now in operation, now therefore be it
RESOLVED, That the necessary amount of money ($11,919.00) plus interest be taken from
the contingency fund and placed in the Sheriff's Outlay budget, and be it further
RESOLVED, That the budget for the Sheriff for 1982 for purchase of cars be reduced by
an equal amount.

Ludzack stated that he was opposed to the fact of reducing the Sheriff's 1982 budget.
Diamon also objected to the reduction of the Sheriff's budget in 1982 comparing this
situation to the many times the Social Services budget was overrun, but never reduced the following
year.
Johnson stated that you cannot compare the Social Services budget with the Sheriff's
budget because the Sheriff's budget is a controlled cost but the Social Services budget is not.

WHEREAS, The County Treasurer's budget is not sufficient to cover costs, and
WHEREAS, The County Treasurer has submitted his request for an additional amount of
$12,000.00, and
WHEREAS, The Executive Committee after reading the treasurer's request deemed it a
necessary and logical request, now therefore be it
RESOLVED, That the Bayfield County Board authorize the transfer of $12,000 for the
contingency 'fund to the County Treasurer's budget.

The following resolution was read: No. 17
WHEREAS, Bayfield County has in its employ a communications consultant, John DuBois, and
WHEREAS, Mr. DuBois, at the request of the Executive Committee has prepared a study
of a county owned or leased telephone system to be used in the jail and the courthouse, and
WHEREAS, Mr. DuBois has determined that a county owned telephone system would be less
costly than a lease from Wisconsin Telephone Company, and
WHEREAS, Mr. DuBois has recommended to the Executive Committee that Bayfield County
should purchase their own telephone system, and
WHEREAS, The Executive Committee recommends that the Bayfield County Board purchase
telephone equipment for use in the jail and courthouse, now therefore be it
RESOLVED, That the Bayfield County Board authorize the Executive Committee to proceed witl..
the purchase and installation of a county owned telephone in --,the jail and the courthouse.

Moved by Renoos and seconded by Carter that the word "purchase" in the first line of
the fifth paragraph and the words "proceed with" in the first line of the sixth paragraph be

Moved by Soderstrom and seconded by Sneed to add an additional paragraph to the
resolution that would read:
"BE IT FURTHER RESOLVED, That the Executive Committee be authorized to,:'.hire Mr.
John DuBois to prepare specs. and advertise for bids for a telephone system for the jail and
courthouse." Motion carried.

Moved by Soderstrom and seconded by Renoos to adopt the resolution as amended. Motion
Soderstrom questioned if this system will be compatible to the."91171 system.
Renoos answered yes.
Mattson suggested that perhaps the word "quotation" instead of 7bid" should be used
in the resolution, saying that Bell Telephone will not bid on such a project,,, -but -they will
give a quotation.
This concluded the discussion on the telephone system.
The following ordinance was read: No. 18
ESTABLISHMENT OF SPEED ZONE ON COUNTY TRUNK HIGHWAY N, BAYFIELD COUNTY,
STATE OF WISCONSIN
THE BOARD OF SUPERVISORS OF BAYFIELD COUNTY,'WISCONSIN, ORDAINS AS FOLLOWS: .
Section 1. A traffic investigation study has been made on the following described
highway, the maximum permissible speed at which vehicles may be operated on said highway, which
speed is herewith established as reasonable and safe pursuant to Section 349.11(3)(c), Wisconsin
Statutes, shall be set forth herein, subject to approval of the Bayfield County Board of Super-
visors, and upon erection of standard signs giving notice of such speed.
(1) County Trunk Highway N, Township of Barnes, Bayfield County, Wisconsin
(a) Forty=five (45) miles per hour for all vehicles from a point 2.50 miles west of
the junction with County Trunk Highway A westerly to a point 1.75 miles east -of the junction
with State Trunk Highway 27. (More specifically between the Birch Lake Road and the Lake Road.)
Section 2.
Any person violating any provision of this ordinance may be fined not
less than $40.00 nor more than $300.00 plus costs, or imprisoned not more than 30 days upon
failure to pay such fine or forfeiture or until such forfeiture and cost are paid, but not
to exceed 30 days.
The foregoing ordinance is being introduced by the following., -members of the Bayfield
County Board of Supervisors.

The following resolution was read: No. 19
WHEREAS, Nekoosa Papers, Inc., has lands located in the proposed Bibon Swamp Natural
WHEREAS, Nekoosa Papers are desirous of trading these lands for other lands within
Bayfield County and owned by Bayfield County, and
WHEREAS, The Land Sales Committee does not wish to see any trade or purchase of lands
in the Bibon Swamp Natural Area, and
WHEREAS, The Land Sales Committee recommends that the request of Nekoosa Papers, Inc.,
be denied, now therefore be it

WHEREAS, Wisconsin State Statute, Chapter 166 (4)(a) states, "The governing body of
each county, town and municipality shall adopt an effective program of emergency government con-
sistent with the state plan of emergency government and, except at the county level in counties
having a county executive, shall appoint a head of emergency government services. . . . . ."; and
WHEREAS, Wisconsin State Statute, Chapter 166 (8) (d) states, T' . . . volunteer emergency
government workers are employees of the emergency government unit with whom duly registered in
writing for purposes of worker's compensation benefits. . . . . Any employment which is part
of an emergency government program including but not restricted beeause of enumeration, test runs
and other activities which have a training objective as well as emergency government activities
during an emergency proclaimed in accordance with this Chapter and which grows out of, and is
incidental to, such emergency activity is covered employment. . .TT; and
WHEREAS, Wisconsin State Statute, Chapter 166(8)(e) states, "Emergency government
employees,as defined in par. (d) shall be indemnified by their sponsor against any tort liability
to third persons incurred in the performance of emergency government activities while acting in
good faith and in a reasonable manner. .T'; and
WHEREAS, The ability to execute emergency plans is built by a repetitive cycle of planning,
exercising, and so on, thus requiring the necessity of planned disaster training exercises,utilizing
volunteers; and
WHEREAS, Counties are always faced with the possibility of an actual emergency occurring
in which volunteers are utilized to assist in rescue, clean-up, etc; and
WHEREAS, Volunteer workers are in integral part of Bayfield County's emergency government
operations; and
WHEREAS, The current insurance coverage carried by the County excludes liability imposed
upon the County by Chapter 166, Wisconsin State Statute or any law supplementary or amendatory
thereof.
NOW, THEREFORE BE IT RESOLVED, By the Bayfield County Board of Supervisors that an
endorsement to Bayfield County's current insurance coverage be added to include all emergency
activities.

Pursuant to Wisconsin State Statute 86.30, payment for local transportation aids has been disc
tributed to the treasurer in the amount_of $105,497.77.
This figure reflects a 1.683% annual reduction for fiscal year 1981, rather than the 7% reduction
previously announced.
However, those local units not receiving hold -harmless payments will receive slightly less than
otherwise as a result of a court order requiring us to withhold a total of $466,885 pending
settlement of litigation over payments withheld from units of government ;failing to.meet
cost reporting deadlines.

Gentlemen:
At your request I have reviewed the petition for division of the Town of Russell and other
documents pertaining to it which have been filed with the County Clerk. For the reasons

which follow I think that the petition is inadequate to empower the County Board to divide the
town.
Section 60.05(1) of the Wisconsin Statutes requires that a petition to divide the town be signed
by 'T50 or more freeholders, residents of.../ the / town, and at least one-third of the electors
thereof." A T4freeholder" is 'Tone having title to realty." Black's Law Dictionary, Revised 4th
Edition. An "elector" is every U.S, citizen age 18 or older who has resided in the election
district in question for at least 10 days. See Section 6.02(1) of the Wisconsin Statutes.
From the documents on file there is no way of determining whether at least 50 of the petitioners
for division are freeholders, nor is there any indication that the 102 petitioners for division
constitute at least one-third of the electors of the town. In fact, from the petition in the
file opposing the division, containing 225 signatures, and the list in the file of persons 18
years and older living on or adjacent to the reservation, containing 342 names, it appears that
the 102 petitioners for division do not constitute at least one-third of the electors.
Because the petition does not appear to meet the criteria of Section 60.05 of the Statutes, I
believe that it is inadequate to empower the County Board to divide the town.

As you know, it is_my responsibility to certify supplemental monies to counties for performing
certain law enforcement services. Under Sec. 20.455(2)(d), Stats.,
I may make these certifications to counties which provide additional law enforcement services
by reason of federal legislation removing governmental control over Indians.
Because of the current shortfall in state revenues and in accordance with the.Department of
Administration's order of a 4.4/ across-the-board reduction in expenditures, I am regretfully
constrained to reduce county 20.455(2)(d) allotments by $110.00. Accordingly, Bayfield County's
allotment is $2,390.00.

Dear Jim:
This is regarding Sheriff Fredericks' request for an opinion on whether surplus funds for
the construction of the new county jail, raised by bond issue, can be used to pay for
the installation of a new communications system to be installed in the building.
I have reviewed the information provided by you and Sheriff Fredericks regarding the terms
of the bond issue and the proposed communications system and have also reviewed the
applicable statutes, case law and definitions of the terms involved. Both the County
Board resolution authorizing the bond issue and the bonds themselves indicate that the bonds
were issued for the purpose of financing"... the cost of construction of a county jail and
related law enforcement facilities." I believe that the proposed communications system,
as described by Sheriff Fredericks, comes within the language of "related law enforcement
facilities" and that therefore; the surplus funds may be used to pay for the system.
Would you please inform the Executive Committee of my opinion.
