The following members answered roll call: No. 1 Present - Thomas Gordon, Ed Erickson, Walter Barningham CQrolyn Sneed, Clayton Beckman, William. Carter, Charles Diamon, Fred Janz, James Stephenson, William Rave, Josephine McGowan, Larry Seidel, George Koval, Karl Ludzack, Edwin Renoos, Herbert Spears; Walter LaJoie Absent - Russell McGillivray, Harold Wickman Present - 17 Absent - 2 TOTAL 19 No. 2 A prayer was -led by Larry Seidel,=Board Members, and the board recited the pledge of allegiance. No. 3 Moved by Separs and seconded by LaJoie to dispense with the reading of the minutes of the previous meeting and to approve of the minutes as written. Motion carried. Nn h George Phillips, DNR Game Warden, next addressed the board informing them of a request their department has received to change the name of Mud Lake in the Town of Drummond to Sugarbush Lake or the Chippewa name for Sugarbush Lake. He stated that this request originated from the people who live on the lake. He further stated that he]s going to put this request in resolution form and present it to the county board at their next meeting. Phillips also talked 'about the Bibon Swamp Project and showed the board a map outlining which lands the state now owns in the swamp and which lands the county owns. No.5 Election of the Veterans Service Officer next took place. The clerk read the statute pertaining to the election of the Veterans Service Officer. Moved by Diamon and seconded by Carter to nominate Bob LePage as Bayfield County Veterans Service Officer. Motion carried. The following relocation order was read: No.6 RELOCATION ORDER STATE OF WISCONSIN, DEPARTMENT OF TRANSPORTATION Division of HIghways and Transportation Facilities PROJECT: 1560-1-21 BRF 0011(016) NAME OF ROAD: White River Bridge & Approaches HIGHWAY: H.S.H.63 COUNTY: Bayfield RIGHT OF WAY PLAT DATE: October 11, 1982 PLAT SHEET NUMBERS 4.0 DESCRIPTION OF TERMINI OR PROJECT: Beginning at a point approximately 173.03 feet south and 2722.68 feet west of the nor one -quarter corner of Section 31, Township 46 North, Range 5 West; thence northerly to a point approximately 1329.99 feet north and 2707.38 feet west of the south cne-quarter corner of Section 30, Township 46 North, Range 5 West. To properly establish, lay out, widen, enlarge, extend, construct, reconstruct, improve, or maintain a Tiortion of the highway designated above, it is necessary to relocate or change and acquire certain lands or interest in lands as shown on the right of way plat for the above project. R. r 1� The following resolution was read: No. 7 WHEREAS, The Bayfield County Forestry Department is engaged in nurr_berous timber sale contracts with private and corporate individuals and; WHEREAS, The funds derived from such contracts represent an equity gained by public investments and such funds are used to reduce the tax levy, and.; WHEREAS, Despite every effort by the Forestry Department, some contracts become delinquent, namely: Larry Johanik, dba Larry's Legging, Contract Number 1477A-81 $85.44 NOW, THEREFORE, BE IT RESOLVED, That the Bayfield County Board of Supervisors meeting this 1st day of February, 1983, do direct and authorize the Bayfield County District Attorney's Office to pursue the necessary legal. means to satisfy the above mentioned contract. The following resolution was read: No. 8 WHEREAS, The Bayfield County Home Health Agency experiencing an ever increasing number of Home Nursing patients, and WHEREAS, The questions has arisen as to the: immediate availability of nusring services for patients in certain areas of the, county, and and WHEREAS, The level of care and the availability of nursing staff varies so from patient to patient, WHEREAS, THis option of contracting would provide a much more efficient system of health care in homes with a cost savings to the taxpayer, now therefore be it RESOLVED, That the county nurse is hereby authorized and directed to contract with nursing personnel as needed to meet the ever -charging staffing and patient requirements in Bayfield County. He felt -this should be done at least once a year. Clerk Strom stated that all that need be done for the nuT6c to visit the school is to contact her and she will respond. The following claim and correspondence were read: No. 9-` NOTICE OF CIRCUMSTANCES OF CLAIM Vr. & Mrs. Vernie Neimesto of Washburn, Wisconsin, their attorneys, Spears and Carlson, by Jack A. Carlson, pursuant to S.893.80(1)(A), Wisconsin Statutes, hereby provide that notice of the circumstances of a potential claim as follows: 1. On' Saturday, August 21, 1982, at approximately 6:45 p.m., at the Bayfield County Fair Grounds at Iron River, Wisconsin, Mrs. Vernie Neimesto sustained personal injuries when a. bleacher upon which she was sitting at the steer ring suddenly collapsed, causing Mrs. Neimesto to fall suddenly to the ground. 2. As a result of said fall, Mrs. Neimesto sustained personal injuries, the exact nature and extent of which are presently unknown to your claimants. 3. That your claimants have already incurred medical expenses as a result of said accident, and anticipate incurring a.dditional_Lmedical expenses. 4. That said accident was caused by the negligence of Bayfield County in impYOpaert installing, maintaining and testing the bleachers in question and in failing to notify the: public of the potential danger. If the county board has not already acted on this claim, I recommend that they disallow it at their next meeting, and that notice of the disallowance be sent to the claimants in accordance with Section 893.80(1)(b) Stat.s. The county board of supervisors of the county of Bayfield does ordain as follows: (1) Title -- This ordinance shall be known as the Bayfield County Access to Public Records Ordinance. (2) Definitions (a) "Authority" means any of the following having custody of a record: an office, elected official, agency, board, commission, committee, council, or department of Bayfield County. (b) "Record" means any material on which written, drawn, printed, spoken, visual or electromagnetic information is recorded or preserved, regardless of physical form or characteristics, which has been created or is being kept by an authority. "Record" includes, but is not limited to, handwritten, typed or printed pages, ma.ps,'charts, photographs,- films, recordings, tapes (Inc:luding computor tapes, and computer printouts. "Record" does not include drafts, notes preliminary computations and like materials prepared for the origi- nators personal use or prepared by the originator in the name of a person for wham the originator is working; materials which are purely the personal property of the custodian and have no relation to his or her office; materials to which access is limited by copyright, patent, or bequest; and published materials in the pos session of an authority other than a. public library which are available for sale, or which are available for inspection at a public library. (3) Legal Custodians (a) An elected official. is the legal custodian of his or her records and the records of his or her office, but the official may designate an employee of his or her staff to act as the legal custodian. (b) Unless otherwise prohibited by law, the county clerk or the clerk's designee shall act as legal custodian for th@ county board and for any committees, commissions, boards or authorities created by ordinance or reseut.ion of the county board. i(.c) For every authority not specified in subs. (a) or (b), the authority's chief administrative officer is the legal custodian for the authority, but the officer may designate an employee of his or her staff to act as the legal custodian.. (d) Each legal custodian shall name a person to act as legal custodian• in his or her absence or the: absence of his or her designate. This subsection does not apply to members of the county board. (e) The: disignations of a legal custodian does not affect the powers and duties of an authority under this subchapter. February 1, 1983 (4) Procedural Information Pursuant to Sec. 19.34, Wis. Stats., and the guidelines therein listed, each authority shall adopt, prominently display, and make available for inspection and copying at its offices, for the guidance: of the public, a notice containing a description of its organization and the established times and places at which the legal custodian from whom and the methods whereby, the public rr.,ay obtain information and access to records in its custody, make requests for records, or obtain copies of reocrds, and the costs thereof. (5) Access to records; fees (a) The rights of any person who requests inspection or copies of a record are governed by the pro- visions and guidelines of Sec. 19.350 ), Wis. Stats. (b) Each authority shall prove -any person who is authorized to inspect or copy a record which appears in written form pursuant to Sec. 19.35(1)(b), Wis. Stats. 'or any person who is authorized to and requests permission to photograph a record the form of which does not permit copying pursuant to Sec. 19.35(1)(f), Wis. Stats., with facilities comparable to those used by its employees to inspect, copy, and abstract the record during established office. hours. An authority is not required by this subsection to purchase or lease:photocopying, duplicating, photographic or other equipment or to provide a separate room for the inspection, copying or abstracting cf records. (c) 1. Each authority shall impose a fee established by the: Executive Committee, upon the requester of a copy cf a record which may not exceed the actual, necessary and direct cost of reproduction and trans- cription cf the record, unless a fee is otherwise specifically established or authorized to be established by the law. 2. Each authority shall impose a fee upon the requester of a copy of a record for the actual, nec- essary arid direct cost of photographing and photographic processing if the authority provides a photograph of a record, the form of which does not permit copying. 3. Except as otherwise provked by law or as authorized to be prescribed by law, an authority shall impose a fee upon a requester for located a record, not exceeding the actual, necessary and direct cost of locat.on, if the cost is $50 or more. 4. Each authority shall impose a fee upon a'requested for the: actual, necessary and direct cost of mailing or shipping of any copy or photograph of a record which is mailed or shipped to the requester. 5. An authority may provide copies of a record without charge: or at a reduced charge where the authorit` (determines that waiver or reduction cf the fee is in the public interest. 6. Each authority shall require prepayment by a requester of any fee or fees imposed under this (subsection if the total amount exceed $5.00. (d) Each authority in acting upon a request for any record shall respond within the times and according to the procedures set out in Sec. 19.34(4), Wis. Stats. ( 6 ) Separation of Infor�mat.ion If a record contains information that may be made public and information that may not be made public, (the authority having custody of the record shall provide the information that may be made public and delete (the information that may not be Trade public from the record before release. Each authority shall consult 1with the. county District Attorney before releasing any information under this section. (7) This ordinance takes effect upon passage: and publication. February 1, 1983 No.11 Don Jerabek, Area Director of Emergency Government next appeared before the board to introduce himself to the board and to speak about the: Emergency Government Program. Mr. Jerabek gave some background on himself, commended Sue Gatts, Bayfield County Emergency Govern - went Director and answered a few questions from the board members. 'rohaiitl The following resolution was read: No. 12 WHEREAS, The Legislature of the State of Wisconsin enacted legislation providing for allocation to the: respective counties in that state on an acreage basis for the county conservation aid projects on the condition that the counties matCh-, the state allocation, and WHEREAS, Bayfield County desires to particiapte in the county conservation aid project through the purchase of S.J. Darwin's Lot 42 on Long Lake, Iron River, and WHEREAS, This site will provide the public with an access to Long Lake, Iron River, and WHEREAS, Once the lake has a public access, the Department of Natural Resources can managethe waters to provide the fishermen with a better fishery. THEREFORE, BE IT:RESOLVED, That the Bayfield County Board of Supervisors has appropriated a matching allocation with the Town of Iron River at 25% each to par•ticiapte with the State's 50% of the cost for the Long Lake Boat Landing Access. Motion. carried. lb,. �Orni& a •rraer, cis 10' dorm& The following resolution was read: No. 17 WHEREAS, The custodian for the jail is employed for 20 hours/week, and WHEREAS, The Sheriff deems it necessary for the custodian to be employed for 24 hours/week, and WHEREP,S, The Sheriff contends that he can find the: funding necessary without any additional outlay to pay for the additional hours, and WHEREAS, The Sheriff's Committee recommends that the custodian for the jail be employed for 24 hours/weel now, therefore, be it RESOLVED, That the Bayfield County Board of Supervisors in session this 1st day of February, 1983, approve the hours of the jail custodian be increased fr.cm 20 hours/week to 24 hours/week. The following resolution was read: No. 18 WHEREAS, The courthouse personnel are represented by the AFSCME Union and WHEREAS, The: labor contract for this union has been settled for 1983, and WHEREAS, The AFSCME Union was granted an increase of 31,% to begin January 1, 1983, and a 2 3/4% increase to begin June 1, 1983, resulting in a 64% increase over 1982 in salary beginning on June 1, 1983, and WHEREAS, The elected officials:and department heads have not received an increase in salary, and WHEREAS, The department heads and elected officials are requesting a 64% increase beginning with the March 15, 1983, payroll, and WHEREAS, The Personnel Committee has received the proposal of the elected officials and department heads, and WHEREAS, This would amountto the same dollar increase as that granted the AFSCME Union, and WHEREAS, It is the opinion of the Personnel Committee that this is a fair and reasonable request, and recommend to the county board for its passage, now, therefore be it RESOLVED, That the Department heads, chief deputy, and elected officials be granted a 64% increase beginning with the March 15, 1983, payroll. Strom Bayfield County Clerk Washburn, WI 54891 Dear Mr. Strom:: I wish, on behalf of outgoing Secretary Owne Alres, to acknowledge receipt of a copy of the Bayfield County Board Resolution #8. We recognize the resolution as expressing the County Boards opposition to the Trans- portation Aids formula recommended by the Governor's Special Committee on Transportation Aids on the basis that the formula could result in significant reductions in aid to the County. Obviously, any change in the formula will result in a redistribution of aids, with some gainers and some losers. The Committee worked hard to find an equitable formula that would minimize significant gains or losses to any unit of government. Other alternatives have subsequently been discussed, and a decision is still pending as to how the matter of the Transportation Aids formula will be addressed in the budget the Governor will present to the legislature next month. I recently contacted Mr. George Lightbourn of the state Department of Transportation, who informed me that the governor plans to include 5% across-the-board increases in transportation aids in his budget.... It is not yeat clear, however, how this will affect municipalities, like Bayfield County, that are now affected by the "hold harmless" provisions of the present transportation aids formula. The governor will not submit his budget to the Legislature until February 8. At any rate, the governor does not plan to implement any of the Special Committee's recommendations into the 1983-85 budget. Thank you for keeping me informed of the actions of the Bayfield County Board. I trust you will continue to do so in the future.
