The following members answered roll call: No. 1 Present - Thomas Gordon, Edwin Erickson, Walter-Barningham, Carolyn Sneed, Clayton Beckman, Charles Diamon, Fred Janz, James Stephenson, William Rave, Josephine McGowan, Larry Seidel, Harold Wickman, George Koval, Karl Ludzack, Edwin Renoos, Herbert Spears, Walter LaJoie Absent - Russell --McGillivray, James Nelson Present - 17 Absent - 2 TOTAL 19 No:. - -2 A prayer and pledge of allegiance were led by Larry Seidel, board member. No. 3 Moved by Rave and seconded by LaJoie to dispense with the reading of the minutes of the previous meeting nd to approve of the minutes as written. Motion carried. The following resolution was read: No. 4 WHEREAS, Bayfield County is eligible to receive Federal and State Aid Bridge Replacement Funds to re- place County and Town Bridges, and WHEREAS, The cost of these projects is shared by local units of government at 20010 and by Federal and State Aid at 80%, and WHEREAS, Federal and State Aid Bridge Replacement Funds are administered by the Wisconsin Department of Transportation, and WHEREAS, The Wisconsin Department of Transportation policies require the County to select the projects and approve the priorities, and WHEREAS, The priorities are established based on critical need and sufficiency ratings, and WHEREAS, As the result of recent bria9einspections in Bayfield County new sufficiency ratings have been assigned to all bridges, and WHEREAS, As a result of those sufficiency ratings a new Bridge Replacement Priority List has been completed, and WHEREAS, The Highway Committee of Bayfield County hereby submits a revised list to the Bayfield County Board of Supervisors and recommend their approval. Motion carried. 31, 1983 o Nnrn� i The following letter was read: No. 5 County Highway Commissioner Bayfield County, Wisconsin Lawrence C. Young, Commissioner Washburn, WI 54891 P.O. Box 428 May 17, 1983 County Board of Supervisors Courthouse The Highway Committee has received proposals for roofing the Bayfield Garage and the Iron River Garage. In the past, we have roofed CAble, Grand View and Port Wing with a.Truss Roof system to eliminate the heavy snow and water loads that were on these buildings as a result of the previous roofs which were flat. The Truss Roofs have solved all our leaking problems. The main shop and office at Washburn was roofed with "Trocal". A vinyl roofing material that is bonded to the old roof. All leaking has stopped at the main shop and office location as well. Trocal has proven to be a very reliable roof system. In addition to its sealing qualities it has the ability to shed accumulated snow loads in the winter, because of its slippery surface when wet. The Highway Committee has reviewed the roofing proposals for both Bayfield and Iron River and wish to call to the Board's attention the proposed cost of each of these roofs prior to making any decision as to the awarding of contracts. While nothing was budgeted for roof work at Bayfield, it is felt that the cost of that roof can be handled with Highway Department funds. The cost of which is proposed to be $8,098.67. The proposed cost of the Iron River garage is $25,486.00 of which only $15,000.00 had been budgeted. Because of the proposed cost, the Highway Committee wishes to call this matter to your attention, and hope that it can be discussed at the Board Meeting with a recommendation from the Board as to the procedure that should be taken for additional funding. A short discussion on the courthouse roof next took place. No. 6 Moved by Spears and seconded by Wickman that the Highway Committee be authorized to reroof the Iron River Garage and that the $10,486 for this project shall come from the contingency fund. Renoos questioned why the same kind of roof that is now on the garage could not be put on again as this roof has held up well over' --the years. Renoos stated that it was his understanding that this was the type of roof that was budgeted for. Young next gave the board the figures on the bids for the Bayfield Garage roof and the proposals for the Iron River Garage. The revised relocation order of the Department and the map showing the highway as laid out and established and the lands and interests to be acquired are transmitted herewith. The Zoning Committee of the Bayfield County Board of Supervisors, having held a Public Hearing pursuant to Section 59.97(5), Wisconsin Statutes, notice thereof having been duly informed of the facts pertinent to the proposed changes, hereby recommends that the petition described as follows be approved. The following resolution was read: No. 12 WHEREAS, Bayfield County contains within its borders a tax exempt Indian Reservation, namely, the IRed Cliff Reservation, and WHEREAS, The County has incurred extra expense in law enforcement, arising by reason of Federal legislation removing governmental controls over Indians and said Bayfield County appears to be eligible for assistance as provided under the provisions of Section 20.455(2)(d) of the Wisconsin Statutes, NOW, THEREFORE, BE IT RESOLVED, By the County Board of Supervisors of Bayfield County, duly assembled this 31st day of May, 1983, that application be made to the State of Wisconsin, for assistance under the provisions of Section 20.455(2)(d) of the Wisconsin Statutes, for law enforcement for the fiscal year ending June 30, 1983, and BE IT FURTHER RESOLVED, That this resolution shall continue in force from year to year and that the proper officers of Bayfield County shall make claim annually for such financial assistance in policing said Reservation and for expenses directly connected therewith, and May 31, 1982 BE IT FURTHER RESOLVED, That a copy of this Resolution be certified by the County Clerk to the Attorney General of Wisconsin, with a request for certification of such application, as is required under the sions of Section 20.455(2)(d) of the. BAYFIELD COUNTY ) I Darrell Vaillancourt being first duly sworn on oath depose and say that I am the legal owner of certain domestic animals located in the Town of Lincoln and County as aforesaid. That on the 19th of March, 1983, my cow that was due to freshen within 6 weeks (young cow -third calf) met with death resulting from and directly caused by a dog or dogs owned by Unknown. That upon or before the discovery of the death of said animals I observed the following: Dog trails ham strung and forced through a brush pile outside pasture, couldn't get out. Shot two dogs. That by reason of these facts I claim that the death of said animals is due to the work of some dog or dogs. And I therefore assess tie fair and reasonable market value of said .animals herein described as follows: $1,000.00 for coca and calf; $1,000.00 for lost milk production but would be well satisfied with any amount you would consider fair. ve you paid the current tax on all dogs owned by you?` Yes er: Darrell A. That we have diligently investigated said laim and now find the facts to be as follows: That said animal was driven by dogs out of fenced year onto brush pile, then they hamstrung cow and caused her death. Pictures enclosed. That by reason of the facts as aforesaid, we further find that.said damages was caused by some dog or ogs. And we further find that the assessed value of said animals at last assessment was $1,000.00; that heir fair and reasonable market value is $1,000.00. May 31, 1983 The following dog claim was read: No. 14 OWNER'S CLAIM FOR DAMAGES TO ANIMALS STATE OF WISCONSIN ) ss. BAYFIELD COUNTY ) I, Clarence D. Pratt, Sr., S+ar Route, Box 97, Bayfield, WI 54814, being first'duly sworn on oath depose and say that I am the legal owner of certain domestic animals located in the Town of Bayfield, of Bayfield County, Bayfield, Wisconsin. That on the 30th day of March, 1983, one calf, met with death resulting from and directly caused by a dog or dogs. That upon or before the discovery of the death of said animal,I observed the following: When I got home from work, all my cattle were at my neighbors, when I got my cattle all back home, I found one of my calves had been killed by a dog. The next day when I got home from work, the same dog was after my cattle again, so I shot the dog. That by reason of these facts, I claim that the death of said animal is due to the work of some dog or dogs. And I therefore assess the fair and reasonable market value of said animals herein described as follows: One whiteface calf, about one week old - $175.00 Have you paid the current dog tax on all dogs owned by you? The following resolution was read: No. 15 WHEREAS, In the compilation of the 1983 Bayfield County budget, it was stated that the total for the onservation Department of $41,160.51, and WHEREAS, Shortly after the adoption of the Bayfield County budget, it was found that an addition error the Conservation budget was made, and WHEREAS, This error shows a decrease of $4,000.00 in the Conservation budget, and WHEREAS, The Conservation, Recreation, and Parks Committee at their December 8, 1982, meeting referred this back to the Bayfield County Board for the adjustment of this $4,000.00 error, now, therefore, be it RESOLVED, That an adjustment of $4,000.00 to the Conservation Budget be made, and be it further RESOLVED, That the $4,000.00 be taken from the contingency fund and transferred to the Conservation budget. May 31, 1983 Ed Renoos next gave an update on the computor consortium. : n The following resolution was read: No. 16 WHEREAS, The Executive Committee has been studying the possibility of the purchase of a computer to replace the bookkeeping machine, and the addressograph, and WHEREAS, The Nof,thwest Regional Planning Commission has set into action the possibility of a 10 County Computer Consortium, and WHEREAS, A meeting of all 10 counties served by the NWPRC was held in Spooner on May 26, 1983, to determine if the 10 counties had any interest in forming a computer consortium, and WHEREAS, There was considerable interest amoT\9. the 10 counties toward forming said consortium and, WHEREAS, The first step to be followed was to have a "needs assessment" study done in all 10 counties, now, therefore, be it RESOLVED, That the Bayfield County Board of Supervisors assembled this 31st day of May, 1983, authorize the appropriation of $5,000 to be used for said "needs assessment", to be taken from the contingency fund. The following resolution was read: No. 17 WHEREAS, Section 75.69(1) provides that inc:.counties of population of less than 500,000 no tax delinquen real estate acquired by a municipality as defined by 75.35 shall be sold unless the sale and appraised value of such real estate has first been advertised, and WHEREAS, Said Section 75.69(1) further provides that the county is authorized to sell for an amount equal to or above the appraised value without readvertisement any land previously advertised for sale and WHEREAS, It has been the policy of the Executive Committee of the County Board that all lands be ad- vertised a:minimum of two times before they are sold without further advertising, and WHEREAS, It has also been the policy of the Executive Committee of the County Board to authorize the county clerk and the county treasurer to sell at their discretion at any time within 30 days of the opening of bids of the second advertising any lands that have been advertised a minimum of two timers, now, there- fore, be it RESOLVED, That the Bayfield County Board does go on record this 31st day of May, 1983, approving the policy of the Executive Committee whereby all tax title lands shall be advertised a minimum of two times at the same appraised price before they shall be sold without further advertising and that the county clerk and the county treasurer can sell during the period of 30 days after opening of the bids such lands for the appraised price, and be it further RESOLVED, That after the said 30 day time period has elapsed the Development and Land Sales Committee is authorized to sell at their discretion any such lands that have been advertised a�minimum of two times at the appraised price and be it further ru . Vorre r�/l,nrisop RESOLVED, That if the Development and County Land Sales Committee of the County Board deems it to be in the best interest of the county in certain exceptional cases to sell tax title lands without further advertising after they have been advertised once, they shall be authorized to do so. HOW: Carol Laudenbach from Wisconsin Job Service was next to address the board regarding the Job Training Partnership Act. Laudenbach described the act and its benefits. The following resolution was read: ldo. 19 WHEREAS, It is the function of the Land Sales Committee to advertise and put up for sale any and all tax title lands in county ownership, and WHEREAS, There are many parcels of land which are land locked and not on any town or county road, and WHEREAS, It is felt that the value of these land locked parcels would be increased if there were some method to assure a potential bidder that he could gain access across county owned tax title land to the land locked parcel and WHEREAS, It is the opinion of the Land Sales Committee that they be granted the authority to allow an easement across county owned tax title land for the purpose of access to a land locked parcel, now, therefore, be it hereby RESOLVED, That the County Board of Supervisors assembled this 31st day of May 1983, do hereby authorize the Land Sales Committee to grant easements across county owned tax title land to the person who bids on parcel in a land sale. The following resolution was read: No. 20 WHEREAS, The labor contract between Bayfield County and' the General Drivers Union Local No. 346 represent ing the Bayfield County Sheriff's Deputies expired on December 31, 1982, and WHEREAS, The deputy sheriffs have elected to become a part of the Bayfield County Deputy Sheriff's Local Union No. 1731-B AFSCME, AFL-CIO, and WHEREAS, The Personnel Committee of the Bayfield County Board has been negotiating with the Bayfield County Deputy Sheriff's Local Union No. 1731-B, AFSCME, AFL-CIO for a new labor contract, and WHEREAS, The two parties have come to an agreement on a new contract, now, therefore be it RESOLVED, That the contract which expired on December 31, 1982, be renewed, using language from both e AFSCME Bayfield County Employees Local Union No. 40 contract and the language from the General Drivers ion Local No. 346; with the changes and additions as outlined in the settlement agreement attached to d made a part of this resolution, and be it further RESOLVED, That the proper county officials be authorized and directed to execute the new revised contract ending ratification by Bayfield County Deputy Sheriffs Local Union No. 1731-B AFSCME, AFL-CIO. IGNED: Erickson, Stephenson, Wickman, Gordon, Rave, Reneos 9 Bayfield County Deputy Sheriffs Local Union #1731-B, AFSCME, AFL-CIO Tentative Agreement The following is a tentative agreement: 1. Wages - Increase the 18 month step of 1982 agreement by 321% effective 1/1/83 and on June 1, 1983, another 2 3/4% of the 18 month step of the 1982 contract. The other two steps to be adjusted so as to keep the percent difference between the steps at the same percentage. 2. Mileage - Increase from 220 per mile to 230 per mile effective 4-29-83. 3. Clothing Allowance - Increase the clothing allowance by $10.00 per year from $225 per year to $235 per year. 4. Sick Leave - Increase the sick leave accumulation from 72 days to 82 days. 5. Meal Allowance - Increaseethe meal allowance by $5.00 per month. 6. Dues Check -Off - Replace the "Dues Check -Off" clause with a "Fair Share Agreement". Jacobson shall submit a statement as to his wishes to belong to the union. 7. Provide that members of the bargaining committee shall not lose nor gain2 additional compensation for serving on the bargaining committee. 8. Provide that the period of probation may be extended by mutual agreement of both parties. 9. Agree to modification of the present contract language using proposed AFSCME contract language, mutually agreed to by both parties. The following resolution was read: No. 21 WHEREAS, The labor contract between Bayfield County and the General Drivers Union Local No. 346 z ..r ,epresenting the Bayfield County Dispatcher -Jailers expired on December 31, 1983, and WHEREAS, The Dispatcher -Jailers have elected to become a part of the Bayfield County Dispatcher -Jailers ,ocal Union AFSCME, AFL-CIO, and WHEREAS, The Personnel Committee of the Bayfield County Board has been negotiating with the Bayfield :ounty Dispatcher -Jailers Local Union AFSCME, AFL -CEO for a new labor contract and WHEREAS, The two parties have come to an agreement on a new contract, now, therefore, be it RESOLVED, That the contract which expired on December 31, 1982, be renewed; using language from both tYe FSCME Bayfield County Employees Local Union No. 40 contract, and the language from the General Drivers ocal Union No. 346; with the changes and additions as outlined in the settlement agreement attached to and ade a part of this resolution and be it further RESOLVED, That the proper county officials be authorized and directed to execute the new revised ontract pending ratification by Bayfield County Dispatcher -Jailers Local Union AFSCME, AFL-CIO. Wages - Increase the 18 month step of the 1982 agreement by 32% effective 1/1/83, and on June 1, 1983, another 2 3/4% of the 18 month step of the 1982 contract. The other two steps to be adjusted so as to keep the percent difference between the steps the same. 2. Mileage - Increase from 220 per mile to 230 per mile effective 4-29-83. 3. Sick Leave - Increase the sick leave accumulation from 72 days to 82 days. 4. Clothing Allowance - Increase by $10 per year 5. Dues Check Off - Replace the "Dues Check -Off" clause with a "Fair Share'Agreement". 6. Provide that members of the bargaining committee shall not lose nor gain additional compensation for serving on the bargaining committee. 7. Provide that the period of probation may be extended by mutual agreement of both parties. 8. Agree to modification of the present contract language using proposed AFSCME contract language, mutually agreed to by both parties. Moved by Gordon and seconded by Janz to adopt. Cour.thous e Washburn, WI54891 May 10, 1983 Lawrence C. Young Bayfield County Highway Commissioner P.O. Box 428 Washburn, WI 54891 Dear Larry: This is in reply to your letter of April 12, 1983, inquiring about the legal effect of Section 83.015 of the Wisconsin Statutes with respect to the hiring, discharge, suspension, or reinstatement of the Highway Department employees. 1. 198 The question, insofar as it pertains to hiring employees, was considered in a 1932 Attorney General's opinion, a copy of which is attached. The opinion concludes that the power to hire highway department em=; ployees rests with the County Board, which may delegate such power to the highway commissioner or Highway Committee if it chooses. The clear implication is that it can delegate such power to another committee such as the Personnel Committee. Having reviewed the opinione.and the applicable statutes, I believe that the opinion is correct. Section 83.01(4) Stats. provides that: "The County Board shall provide (the highway commissioner) with suitable offices and such assistants as are necessary for the proper performance of his duties." Section 59.025(3)(a) Stats. provides that the County Board may: "Create any county office, department, committee, board, commission position or employment it deems necessary to administer -functions authorized by the legislature." Subsection 4::of this same section states: "The County Board may determine the method of selection of any county offices except for the offices of supervisors, county clerk, county treasurer, clerk of courts, county executive and county assessor and those officers elected under Section 4 of Article VI of the Constitution. The method may be by election or by appointment and, if by appointment, the County Board shall determine the appointing authority..." While Section 83.015 Stats. specifies 11Urnerous duties of the Highway Committee pertaining to the constructi and maintenance of highways, the hiring, discharge, suspension or reinstatement of highway department em; .c­ ployees is not one of them. Though the Statutes do not contain express provisions with respect to the discharge, suspension or reinstate- ment of employees, I believe that in the absence of any express provisions to the contrary, it is logical to conclude that these powers reside in the authority which has the power to hire, namely, the County Board. Again, such powers could be delegated to the highway commissioner or Highway Committee or another Committee such as the Personnel Committee. In summary, I do not believe that the law gives the Highway Committee a statutory right to hire, discharge suspend, or reinstate highway department employees. The County Board could delegate such authority to the Highway Committee if it chose to do so, or it could leave such authority with the Personnel Committee. Any change in present policy would have to take into account the collective bargaining agreement pertaining to highway department employees presently in effect. Under that agreement any suspension or discharge of a highway department employee may be appealed via the grievance procedure set forth in the agreement, which involves a review of the action by the Personnel Committee, and, if that does not resolve the matter, arbitra tion. Any change in present policy would have to be consistent with the agreement, or else the agreement would have to be amended. Article 3 of the agreement suggested that the initial decision to suspend or discharge a highway department employee rests with the Highway Committee and that it is the Highway Committeeg decision which may then be appealed to the Personnel Committee via the grievance procdure and, if necessary, subjected to arbitration. As a matter of policy, I think'_it would be sensible for the County Board to affirm this suggestion, by giving the Highway Committee and/or the highway commissioner the express authority to at least make the initial decision to suspend or discharge an employee. In my judgement it would facilitate appropriate matters of highway department employees. However, in matters. of policy, the County Board, not the district attorney, has the final say. Because I will not be available for the next meeting of the County Board, I am sending a copy of this letter to Jim Strom so that he will be able to inform the County Board of my opinion. Stephenson stated he would like to see the testing on the roof done and to replace the present roof with a hip type roof. He stated this shculd be done immediately as damage is being done to the building with the present roof, and that the pending lawsuit might take years to settle. Janz stated that we should put on the same type of roof that was one before the present roof was installed. Renoos suggested that the same type of roof that was put on the Highway Garage should be put on,as the Highway roof is holding up well. Renoos also suggested that the county put bids out on the roof with two different specs; one with r trusses and one without.
