BOARD OF SUPERVISORS
November 21, 1983
The meeting was called to order at 9:30 a.m. by Chairman Edwin Renoos. The following members
answered roll call: No. 1
Present - Thomas Gordon, Edwin Erickson, Walter Barningham, Carolyn Sneed, Russell McGillivray, James Nelson,
Charles Diamon, Fred Janz, James Stephenson, William Rave, Josephine McGowan, Larry Seidel, Harold

Moved by Spears and seconded by Diamon to dispense with the reading of the minutes of the previous
meeting and to approve of the_-aninutes as written. Motion carried.
No. 4
The first order of business was to listen to the winners of the Conservation Speech contest. Dan
Miller from Drummond gave his speech first on fires and Christie Batley, who placed second at the state
competition gave her speech next on the conservation of"water..
Karl Ludzack arrived at this time.
No. 5
Joe Williams and Steve Tasheff , representatives from C. E. Beck and Associates were next to
speak, to the board.
Mr. Williams explained to the board his company's interest in leasing the mineral rights of county
owned land for purposes of doing exploratory drilling for oil.
He explained the leases would be for 10 years at $1.00 per acre per year.
A question was asked as to how deep the company would dig for oil.
Williams stated the wells would be between 5,000 and 10,000 feet deep:
Another question was raised that if by leasing the mineral rights on these lands would the county
till be able to sell the lands or the timber on the lands.
Williams answered saying that the county would have a free hand to do with the land as they wished.
Stephenson stated that we should not discourage this type of development but should promote it.
He also stated that the county could use the funds that would be generated from this type of
enture.

Moved by'Stephenson and seconded by Ludzack to sign the mineral leases on the land that the county
as control over except the county forest land, until it can be found out if it is possible to lease mineral
ights on county forest land. If it is found that the mineral rights on county forest land%can be leased
hen the county may sign the leases for these lands also.
Sneed stated she was not too eager to sweep all of the county lands into an agreement like this.
McGowan suggested that the matter be tabled until the board had more time to study the matter.

Moved by McGowan and seconded by Sneed to table the matter until the board has the time to look
over the leases and be better informed on the matter. The board can then make a decision on whether or not
!o sign the leases at the next county board meeting.

This petition of the Town of Clover, Bayfield County, Wisconsin, respectfully represents and shows to your
honorable body that:
The East Fork Cranberry, -River Section 28 Township 50 North Range 7 West on a public highway maintained by
the Town of Clover required replacement in accordance with the provisions of Section 81.38 of the Wisconsin
Statutes.
The Town of Clover provided for such portion of the cost of construction as required by Statute.
The total cost of replacement paid by the Town of Clover was $39,551.81.
Wherefore, petitioner prays and makes this petition to your honorable body for County Aid for one-half of
the cost to said Town of Clover in the amount of $19 J75.91 all in accordance with Section 81.38 of the
Wisconsin Statutes.

by the Town of Eileen required replacement in accordance with the provisions of Section 81.38 of the
Statutes.
The Town of Eileen provided for such portion of the cost of construction as required by Statute.
The total cost of replacement paid by the Town of Eileen was $16,714.80.
Wherefore, Petitioner prays and makes this petition to your honorable body for County Aid for one-half of
the cost to said Town of Eileen in the amount of $8,357.40, all in accordance with Section 81.38 of the
Wisconsin Statutes.

The total cost of replacement paid by the Town of Washburn was $6,692.13.
Wherefore, Petitioner prays and makes this petition to your honorable body for County Aid for one-half of
the lost to said Town of Washburn in the amount of $3,346.07, all in accordance with Section 81.38 of the

THEREFORE BE IT RESOLVED, that the County Highway Committee is hereby authorized, pursuant to
Section 83.015(2) oft:the Statutes to purchase without further authority, and to the extent that revolving
funds accumulated for such purpose or appropriations made for such purposes are available, such as highway
equipment as they deem necessary to properly carry on the work and to trade or sell such old equipment as
be considered to be for the best interests of the county.

The County Board of Supervisors of Bayfield County, Wisconsin, regularly assembled, does hereby
that such funds as may be made available to the County for highway work in the year 1.984 shall be
as hereinafter set forth:
WHEREAS, the State Department of Transportation has notified Bayfield County that the 1984
tion aids to be paid to Bayfield County will be $401,331.04.
BE IT RESOLVED THAT the County Highway Committee is authorized and directed to expend the said sum
to the extent required to match and supplement Federal Aid for Construction, right-of-way and other costs on
Federal projects located on the County highway system of said County, which are not recovered from
Federal Funds, and to expend any balance for construction, repairing and maintaining such county trunk high -
system and the bridges thereon, and for other authorized purposes as required, including maintenance of
,know and ice removal and control and to reimburse the general fund for any expenditures that may be
therf rQm.
WHEREAS, appropriations are made in the Bayfield County Budget for 1984 in addition to the amounts
be received from the State.
BE IT RESOLVED, that this Board does hereby direct that any balance remaining in any appropriation
a specific highway improvement after the same shall have been completed may be used by the County Highway
ttee to make up any deficit that may occur in any other improvement which is part of the same item in
Budget, and any balances remaining at the end of the year in any highway fund shall remain and be
vailable for the same purpose in the following year.
BE IT FURTHER RESOLVED, that the County Treasurer is hereby authorized and directed to make paymen

WHEREAS, the County Highway Committee and the County Highway Commissioner are charged with the duty

BE IT RESOLVED, that the County Highway Commissioner shall have the authority to employ discharge
uspend or reinstate such personnel as he deems necessary for such purposes, provided, however, that the
ounty Highway Committee may by action recorded in'its minutes determine the number of persons to be hired
nd may also at any time by action so recorded order the County Highway Commissioner to employ, discharge
uspend or reinstate any such person. The term "personnel" or "person" shall include all patrolmen , laborers
, clerks, stenographers or other employees necessary to carry on such activities.

Be it resolved, by the Bayfield County Board of Supervisors assembled in annual session this 21st
of November, 1983, that the County Board Chairman, County Highway Committee and County Highway Commission -
are hereby authorized to attend state road schools, conventions and/or other road meetings and that their
diem and expense be paid from the County Highway Administration Fund.

WHEREAS, Bayfield County has in the past been a member of the Wisconsin County Board's Association
and
WHEREAS, It is deemed to be in the best interest of Bayfield County to continue said membership,
now, therefore be it
�p RESOLVED, That Bayfield County continues membership in the Wisconsin County Board's Association
and be it futher
RESOLVED, That the County Clerk be instructed to pay to the Wisconsin County Board's Association the
annual membership fees and magazine dues amounting to $1,742.70.

WHEREAS, The several committees of the Bayfield County Board of Supervisors are required in the
conduct of business of said Bayfield County, to hold and conduct committee meetings in excess of the number
permitted by Statute, and
a WHEREAS, By action of the County Board, the number of meetings of said committees beyond the
Statutory limit may be extended, now therefore be it
RESOLVED, That the several committees of the said Bayfield County Board of Supervisors be and they
re hereby authorized to hold such meetings during the year 1984 as may be necessary to the proper conduct
f the business of said Bayfield County.

The following resolution was read: No. 16
RESOLVED, that all banks in Bayfield County & Northland Savings & Loan qualified as a public
depository under Ch. 34, Wis. Stats., is hereby designated as a depository in which the funds of this
Municipality may from time to time be deposited; that the following described accounts be opened and main-
tained in the name of A�nis Municipality with the Bank subject to the rules and regulations of the Bank from
time to time in effect; that the person(s) and the number thereof designated by title opposite the following
designation of account(s) is hereby authorized for ardon behalf of this Municipality, to sign order checks
as provided in S.66.042(6) Wis. Stats., for payment or withdrawal -of money from said account(s,,�. and to issue

Moved by McGowan and seconded by Janz to adopt.
A discussion regarding Northland Savings and Loan being included in the rotation for the checking
account ensued.
Renoos informed the Board that Northland Savings and Loan has not even requested to be put in the
rotation, so it should not be a concern at the present time.
McGillivray questioned the rotation system stating that he did not think it was in the best interest
of the county to handle it this way. He suggested that the Executive Committee study the matter.
The questions was asked on the motion to adopt. Motion carried.
The following resolution was read: No. 17
WHEREAS, The Executive Committee of the Bayfield County Board of Supervisors has examined a report
of the Bayfield County treasurer setting forth the certain tax certificates now owned by Bayfield County are
illegal and void in that said certificates were issued on the tax on exempt property or property on which
there was a double or incorrect description and for other reasons set for in the Treasurer's report, and
WHEREAS, From said examination it has been determined that said report is correct and that said
certificates described in said report are illegal and void and that the taxes upon which said certificates
are based are not justly reassessable.
NOW, THEREFORE BE IT RESOLVED, That the amounts of said illegal and void tax certificates be charged
back to the respective towns, cities or villages wherein such lands are situated.

WHEREAS, The Executive Committee of the Bayfield County Board of Supervisors has examined a
report of the Bayfield County Treasurer setting forth that certain tax certificates now owned by Bayfield
County are illegal and void in that said certificates were issued on a tax on exempt property on which there
was a double or,incorrect description and for other reasons set forth in said Treasurer's Report, and
WHEREAS, From said examination it has been determined that said report is correct and that said
certificates described in said report are illegal and void and that the taxes upon which said certificates
are based are not justly reassessable.
NOW, THEREFORE, BE IT RESOLVED, That the amount of said -illegal and void tax certificates be
charged back to the respective towns, citites or,�villages wherein such lands are situated.

This is in reply to your letter to me of Sept. 19, 1983, regarding the above matter. I recommend that the
claim for damages be placed on the county board agenda for the -next county board meeting so that the board

WHEREAS, The county did change insurance carriers and is now insured by St. Paul Fire and Marine,

WHEREAS, Section 605.21(2)(c), Wisconsin Statutes, requires in part that "any local governmental-�.-,
unit may terminate its insurance in the property fund by a majority vote, and upon certifying such action to
the manager of the insurance' in force in the fund shall terminate upon expiration of the policy unless the
t specifies an earlier date for termination."
NOW, THEREFORE, BE IT RESOLVED, That the Bayfield County Board of Supervisors in session this 15th
of November, 1983, do authorize the cancellation of said State Property Insurance Fund policy with the

WHEREAS, The AFSCME Union has, as one of their proposals a "payroll savings deduction", and
WHEREAS, It is the opinion of the Personnel Committee that they do not wish to negotiate for a
oll savings deduction for various reasons, and
WHEREAS, The Personnel Committee recommends to the County Board of Supervisors that they go on
ord as opposing a "payroll saving deduction", now therefore be it
RESOLVED, That the Bayfield County Board of Supervisors assembled this 21st day of November
on record as being opposed to a "payroll savings deduction".

WHEREAS, Federal and State Aid Bridge Replacement Funds are administered by the Wisconsin Depart -
of Transportation and
WHEREAS, The Wisconsin Department of Transportation policies require the County to select the

That by reason of these facts I claim that the death of said animals is due to the work of some
dog or dogs. And I therefore assess the fair and reasonable market value of said animals herein described as

we have investigated the claim of John Wroblewski -for damages as aforesaid to ascertain and determine whether
in fact said damages were caused by some dog or dogs. That we have diligently investigated said claim and
now find the facts to be as follows: Peacock hen killed by dog or dogs. Dogs were seen at rabbit cage early
in morning had rabbit on ground, could not identi�y whose dogs they were, couldn't get a shot at them.
That by reason of the facts as aforesaid we further find that said damage was caused by some
dog or dogs.
And we further find that the assessed value of,�said animals at last assessment was not assessed.

Stephenson brought up the matter of the board and committee members having to pay for their own
meals when a board or committee meeting runs over into mealtime. He suggested that ei+her they be
pensated for their meals or receive a higher per diem.
Renoos suggested that a resolution be presented that would allow the committee chairman to decide
if a meeting will run long enough to warrant the county paying for the meal.
Stephenson stated that Clerk Strom should also be included in this.
Mc�owan suggested that a time limit should be set and if a meeting runs over the time limit the

The 1984 budgef was next discussed, Stephenson stated he would like the board to set a percentage
increase of how much the board would like to see the budget at.
Seidel then gave the board an update on the Executive Committee's budgeting process. Seidel dis-
cussed the alternatives listed on a cover letter to the county board. The letter read as follows:

The budget proposed for 1984 by the Executive Committee is not to their liking, and they are certain it is
not to your liking either. It is with these thoughts in mind that the Executive Committee met again on
November 15, 1983, and drafted the following proposed options for the county board to consider. These
options are not listed iri orddr_`6f '.ptiority, but is simply a list which will give the county board an idea
of what Th—e 'committee discussed but took no action on.
Items discussed during the budget meetings were as follows. The 11% savings" you see after each item is the
percent of the $452,106, the amount over the 1983 budget. There is an amount of $21,756.00 which can be
added to the budget as a revenue item under "cash applied". These monies are from the Debt Service Account.
This was not known until Mr. Maitland informed the committee at their November 15th meeting.
Total savings = $21,756 % savings = 4.8% ,
1. Each employee would take one day of unpaid vacation per_,-.,Moftth.
Total savings = $86,000 % savings = 19%
2. The $150,000 which the committee had put into the Highway budget could be removed. The
committee feels that a long range highway improvement plan should be drafted by the Highway
Committee and the Executive Committee.
Total savings = $150,000 % savings = 33%
3. Combining of the Recreation Department and the Emergency Government Departments. A savings of
$20,000.00 in salary and fringes, but a loss of $10,000.00 in state aid for Emergency Govern-
ment.
Total �avings = $10,000.00 'lo savings = 2.2%
Eliminating the Recreation Deparment completely and transferring the Snowmobile Ti�ails and
County Parks to another department such as Emergency Government.

4. Eliminate from the Highway budget the sum of $100,000 which is scheduled to be used for purchase
of trucks. Do not purchase trucks.

5. Mr. Maitland informed the committee on November 15 that there could be a revenue of $309000
additional from interest on investments.
Total savings = $30,000-00 % savings = 6.6%,
6. Lay-off of personnel:
a. Sheriff's Department - $25,000 less,unemployment compensation
Total savings = $25,000 '/o savings = 5.5%
b. Highway Department - $18,000 less unemployment compensation

county is far behind on their repairs because of budget cuts in previous years.

Next discussed was the option of every employee taking one day off each month without pay.
McGillivray then questioned as to what the union was asking for as part of their wage increase.
McGillivray was informed that the union is asking for a 6% increase.
McGillivray stated that the cost of living increase has only been between 3 and 4 per cent and
that to ask for more than the cost of living is being irresponsible. McGillivray further stated that as
long as the county continues to give the unions what they want without the union feeling some kind of pain
in the line of lay-offs, they will continue to take and ask for anything they can get.
Spears was concerned that the county may run into trouble with the union if the county tells
their employees to take a day off without pay.
Stephenson s1tated that this should pose no problem with the union.
Spears further stated that there are slack times in every office and it is during these times that
the employees should take their time off without pay or be layed off for a week or two.
Moved by Ludzack and seconded by Gordon to have each employee take one day off per month
without pay. Motion carried.

BAYFIELD COUNTY PROPOSED BUDGET
FOR THE YEAR 1984
TO THE HONORABLE MEMBERS OF THE BAYFIELD COUNTY BOARD OF SUPERVISORS
The Executive Committee of the Bayfield County Board of Supervisors submits this proposed 'county
budget for the year 1984 together with a report of operation��

The Wisconsin Department of Revenue has recommended a total county valuation for all real and
personal property of $453,534,100.00 and does not include the tax incremental district in the City of
Washburn. The recommended value was approved by the County Board on September 27, 1983, and all 1983
county and state taxes will be apportioned accordingly. The equalized valuation of the county shows an
increase over the 1982 valuation of $3,601,200 or .008%. In 1982 the increase was-5-75%.
COUNTY TAX AND TAX LEVY LIMIT
Section 1188 of the Laws of 1983, Act 27 of August 27, eliminated the tax levy limit which had
been imposed on all counties.
The 1982 county tax levy was $1,180,140.82. The levy as proposed by the Executive Committee is
$1,632,246.44. No amounts have been included in any budget except the Social Services budget for salary
increases for 1984. The Social Services budget for state reporting purposes has a 6% increase for salaries
for 1984. There is an amount of $75,000.00 in the contingency fund which may take care of any other salary
increases and other contingencies.
The committee has included in the 1984 budget, in the revenue section, an amount of $200,000.00
Federal Revenue Sharing Funds. There is an amount of $19,851.8o listed as surplus cash. This cash is the
receipt of a check from the State Property Insurance Fund for replacement of a building collapsed by snow
and will go toward the replacement of this building. There is also an additional $150,000 added to the
Highway Outlay for blacktopping of roads.
The proposed county tax levy this year tg $452,105.62 over the 1982 levy. This year' after comple-
tion of the tentative budget by the Executive Committee, using budget figures as approved by various county
board committees and department heads as well as other estimated expenditures, the grand total expenditures
with no surplus cash to apply would have left a tax levy of $1,588,959.50.
The final budget as adjusted by the Executive Committee shows expenditures of $4,185,491.69 and:
revenues of $2,533,393.45 and gives a tax levy of $1,632,246.44.
REVENUE SHARING FUNDS
The local tax effort (county levy) is an important factor used by the federal and state agencies
in calculating the amount of Revenue Sharing Funds and State Shared Taxes. Because the county board has
been very conservative in the early101s, we have been suffering from decreased revenues from these two
sources. Fortunately, this year the Revenue Sharing has increased from $151,000 last year to $200,000 this
year.
PAYMENTS IN -LIEU OF TAXES_
Bayfield County has received in 1983, $92,554.00 in -lieu of taxes monies on Federal Forest Lands.
This amount is more than the $86,176.00 received in 1982. The payments are based on 750 per acre on Federal
Forest Lands less the amount received as payment for timber harvest on said lands. Pursuant to County
Board action, 750/. of the money is being distributed to the towns in which the Federal Forest Lands are
located.
In December of 1982, the United States Court of Appeals for the Sixth District stated, "that the
secretary (of the interior) exceeded his authority under the act when he included a 'primary provider of
services' standard in his definition of 'units of general government"', which means these monies should have
gone entirely to the smaller unit of goverment (towns).

In 1983 Assembly Bill 137, intending to create Sec. 59-195, "Co. Treasurer; Nat. Forest Lands",
states, "If the county treasurer receives federal payments in -lieu of taxes in respect to National Forest
Lands, the county treasurer within 30 days shall distribute to any town-,. village, or city in the county in
which the national forest is situated all of those payments, including payments made before the effective
date of this section (1983).11 This bill, however, is still sitting in committee. As it now stands, the
county can keep all or part of the payment in -lieu of taxes monies.
BAYFIELD COUNTY JAIL
The new Bayfield County,jail, which was occupied in April of 1982, has been filled to cap . acity
since that time.
NORTHERN LIGHTS MANOR REST HOME
The new Northern Lights Manor Rest Home has now been in use for approximately 321 years. There is
now a total of 72 patients in the rest home. There was at one time during the past year a total of 77
patients in the rest home.

The amount of $421,169.00 in Highway Outlay only represents the amount included in the county tax
levy; other highway expenditures are not reflected in this budget. It does not include $46,319.38 dounty
for bridges as this is a separate item in the county budget.
There is an amount of $150,000.00 additional add�d by the ENecutive Committee for the.purpose
resurfacing more miles of county highway than was asked for by the Highway Committee. In addition,
is an amount of $4,400.00'to cover costs of additional equipment needed to service county owned
vehicles.
AUDIT
The 1982 audit report by Maitland & Company, S.C., has again been completed on schedule. Copies
available for inspection at the office of the county clerk or from members of the county board�;,
The assistance of Mr. Maitland and his staff continues to be a great asset to Bayfield County
his services are available throughout -the year to all the various county departments.
The Executive Committee recommends approval of the following budget for 1984.
