February 7, 1984
The meeting was called to order at 9:30 a.m. by Chairman Edwin Renoos.

A prayer was led by Larry Seidel and the board recited the pledge of allegiance.

Moved by Rave and seconded by LaJoie to dispense with the reading of the minutes of the previous
meeting and to approve of the minutes as written. Motion carried.
No. 4
Margaret Stuber, 4-H Agent and newly appointed fair secretary, next spoke to the boar�d. Mrs. Stuber
gave the board a 5 year statistical summary of the fair. She went through the summary with the board.
Mrs. Stuber stated she would appreciate any input the board members wish to give her on the fair.
The concluded Mrs. Stuber's presentation.
Ed Pajala, representing B.A.R.T., brought the following resolution before the board: No. 5
WHEREAS, Section 59.967(5)(b) relating to county transit systems and Section 66.943(5)(b) relating
to city transit systems both provide that "no transit commissioner shall hold any other public 6ffice",
and
WHEREAS, Said provision does create a hardship in many instances in the appointment of transit
commissioners, and
WHEREAS, It would appear to be in the best interest of the public to allow elected public officials
Ito serve on transit commissions and
WHEREAS, The Bayfield County Board does favor allowing elected public officials to serve on transit
1commissions, and
WHEREAS, Assembly Bill 525, which provides for the repeal of said subsections (5) and (b) of
ISections 59.967 and 66.943 has passed the Assembly and will be referred to the Senate Transportation
lCommittee, now, therefore, be it -
RESOLVED, That the Bayfield County Board in session this 7th day of February, 1984, does go on

The following resolution was read: No. 6
WHEREAS, The Bayfield County Board of Supervisors subscribes to the goals of independence,..dignity...
self determination ... and least restrictive, and
WHEREAS, The Bayfield County Board of Supervisors holds true the belief that elderly, physically dis-
abled, developmentally disabled, chronically mentally ill and chemically dependent citizens of Bayfield
County have a right to live as fully as possible within their home communities, and
WHEREAS, The Community Options Program represents an effective mechanism to pool the collective
knowledge and resources within Bayfield County to accomplish the above mentioned goals and to strengthen
the social fabric of our communities at the same time, therefore,
BE IT RESOLVED, By the Bayfield County Board of Supervisors in session this 7th day of February, 1984,
to direct the Bayfiold County Unified Services Board to act as the lead agency in establishing a
Community Options Program Planning Committee, whose membership is delineated in S.S.46.47(7) with final
membership approval subject to the confirmation of the Bayfield County Board of Supervisors and that the
planning committee shall begin planning for the implementation of the Community Options Program in
Bayfield County by 1984.

Eric Fredenberg, Unified Services, discussed the community options plan with the board. Fredenberg
stated that this type of service would allow people to be maintained in their homes rather than being
placed in a nursing home or institution. Fredenberg informed the board that all state monies are u5ed for
this program. He further stated that Bayfield County will receive approximately $23,000 in 1984 for this
program.
This money received from the state will be used for 3 things: 1) assessment 2)case management 3)
services. Fredenberg stated that with this amount of funding they will be able to provide services to 3
people per month.
Koval questioned if this program would take the place ---,of another program.
Fredenberg stated no, this program was not taking the place of another program. This program was ,7,-
designed to be a service in addition to the programs already offered by the Social Services Department.
The question was asked on the motion to adopt.

Joe Williams, from C.E. Beck, spoke to the board regarding the oil and gas leases. Williams informed
the board that it was possible to lease the mineral rights on the bounty forest land. He stated he would
be negotiating a lease on these lands with the district attorney along with a lease for approximately
11,000 acres of privately owned land that the county has retained the mineral rights to.
William Bussey, District Attorney, next addressed the board, stating that a lease for the county
forest land and private..lands should be negotiated and brought back to the board for approval.
It was asked that'_if_,the-'Llcoun�� . leased the mineral rights on the privately owned lands, would the
holding the lease be able to go!-on.-Iprivate land without the permission of the land owner.
Williams answered yes, according to the statutes.
Stephenson questioned if,a provision can be written into the lease so that the company would have to
the permission of the land owner before going onto private property.
Williams state that this could be done.
Moved by Stephenson and seconded by McGillivray to direct the District Attorney and the Executive
Committee to negotiate a gas and oil lease agreement for the county forest lands and private lands and to
the negotiated lease back tbethe county board for approval. Motion carried.

WHEREAS, Said legislation is not beneficial to Bayfield County's interests, and has been developed

ORDINANCE TO REPEAL AN ORDINANCE PROVIDING FOR A CIVIL DEFENSE ORGANIZATION AND FOR PROTECTION AND
OF PUBLIC SAFETY, HEALTH AND WELFARE IN THE COUNTY OF BAYFIELD DURING A STATE OF EMERGENCY AND TO
TE AN ORDINANCE GOVERNING EMERGENCY GOVERNMENT IN THE COUNTY OF BAYFIELD, ENTITEED "EMERGENCY GOVERN -
FOR BAYFIELD COUNTY".
County Board of Supervisors of Bayfield County do ordain as follows:
1. The Ordinance entitled "An Ordinance Providing for a Civil Defense Orga-nization and for Protec-
and Promotion of Public Safety, Health, and Welfare in the County of Bayfield During Civil Defense
es" is repealed effective March 1, 1984.

on 1. POLICY AND PURPOSE
(1) To ensure that the County of Bayfield will be prepared to cope with emergencies resulting from
action and with emergencies resulting from natural or manmade disasters, an Emergency Government
ization is created to carry out the purposes set out in Wisconsin Statutes.
(2) Definitions. As used in this ordinance:

(a) The term "emergency goverment" includes civil defensean.d means all those activities and measures
designed or undertaken: 1. To minimize the effects upon the civilian population caused or what would be
caused by enemy action 2. To deal with the immediate emergency conditions which could be created by
such enemy action, and 3. To effectuate emergency repairs to, or the emergency restoration of, vital
public utilities and facilities destrd
.�edor damaged by such enemy action.
(b) The term "enemy action" means any hostile action taken by a foreign power which threatens the
security of the State of Wisconsin.
(c) The term "natural ormanmade disaster"iincludes all other extraordinary misfortunes affecting
the county,naturc�il or manmade, not included in the term "enemy action7.
Section 2. COUNTY EMERGENCY GOVERNMENT COMMITTEE
(1) How Constituted. A committee of the County Boardas created under its rules shall be designated as
the County Emergency Government Committee.
(2) Duties of County Emergency Government Committee. The County Emergency Government Committee shall be
an advisory and planning group and shall advise the County.Emergency Government Cooi�.dinator and the County
Board Supervisors on all matters pertaining to Emergency Government. It shall meet upon call of the
chairman.
Section 3. EMERGENCY GOVERNMENT COORDINATOR
(1) Joint Coordin ator. There is. hereby created the Office of County -Municipal Emergency Government
Coordinator. The County Emergency Government Coordinator shall also hold the office of Emergency Government
Coordinator of such municiplaities of Bayfield.County as may hereafter enact an,ordinance parallel to
this ordinance. In addition to his/her duties as County Emergency Government Coordinator, he/she shall have
the additional duties and responsibilities of a Municipal Emergency Government.Coordinator as provided for
in Wisconsin Statutes.
(2) Term, Appointment and Statutory Provision.
(a) Term.-- The term of the Bayfield County Emergency Government Coordinator shall be at the pleasure
of the County Board.
(b) Appointment. The Emergency Government Coordinator shall be appointed in accordance with the�
standard employment procedures as used by the County Board.
(c) Statutory Provision. The provisions of Emergency Government in Wisconsin Statutes, relating to
Personnel, shall apply to the selection of the Coordinator and.his/her staff..
(3) Status. The County Coordinator of Emergency Government shall be considered to be an employee of
the countynot under Civil Service and shall be entitled to all the rights, privileges and benefits that the
county employees have. He/ She shall report to the County Emergency Government Committee.
(4) Municipal Deputy Emergency Government Coordinator.
(a) Each municipality passing a joint action ordinance with the county may appoint a deputy Emergency
Government Coordinator.
(b) The Municipal Deputy Emergency Government Coordinator will operate under the administrative
direction of the county Emergency Government Coordinator.
(c) Remuneration, if any, for the deputy municipal Emergmency Government Coordinator will be determined
and paid for by the government body of that municipality.
Section 4. SHARING OF COSTS,
(1) Office and Staff. The Bayfield County Board shall provide offices,,office furniture, stenographic
help and such office supplies as may be necessary to carry out the functions -of the County Emergency
Govenment Coordinator and the cost thereof shall be defrayed by the County of Bayfield.
k2) Major Equipment and Servi�es. Cost of equipment and servieessshall be borne 100 per cent by the
municipal government requiring such procurement with Federal matching funds procured by the County/Municipal
Coordinator when applicable. Federal Matching Fund reimbursements shall be returned to the treasurer of
municipality procuring the equipment or services.

Section 4. JOINT ACTION MEETINGS.
Whenever it is deemed necessary by either the County Emergency Govern-
ment Committee oi� the Emergency Government Committee of a Municipality participating in joint action,
there shall be a joint meeting of the committees to decide such matters as may arise.
Section 6. DUTIES OF THE EMERGENCY GOVERNMENT COORDINATOR.
(1) County -Wide Duties. The Coordinator, in his/her capacity as county coordinatbr,,rsubject to the
control and direction of the County Emergency Government Committee and under the general supervision of the
County Board shall:
(a) Develop and promugate Emergency Government plans for the county, including planning for joint
action municpalities, consistent with the state plan of Emergency Government;
(b) Coordinate and assist in the development of no.n-joint action municipal emergency government plans
within the county, and integrate such plans with the county plan.
(c) Coordinate the County and joint action municipality emergency government programs;
(d) Coordinate county -wide civil defense training programs and exercises;
W Advise the state,administrator of all emergency government planning for the county and render such
reports as may be required by the state administrator;
(f) In case of a state of emergency proclaimed by the governor, coordinate the county-.and.1joint
action municipalities emergency government activities and coordinate the non -joint action municipal
emergency government activities within the county, subject to the coordinating authority of the state
administrator; and
(g) Perform such other duties relating to emergency government, as may be required by the municipal
governing body.
Section 7. UTILIZATION OF EXISTING SERVICES AND FACILITIES
(1) Policy.. In preparing and executing the emergency government program, the services, equipment,
supplies and facilities of the existing departments and agencies of the county shall be utilized to the
maximum extent practicable; and the officer and personnel of all such departments and agencies are directed
to cooperate with and extend such services and facilities as are required of them.
(2) Responsibility. In order to assure that in the event of an emergency all the facilities of the
existing county government are expanded to the fullest to meet such emergency, all department heads will
fulfill emergency andnon-emergency duties as assigned under the County Emergency Operations Plan. The
Emergency Government Coordinator will assist them in organizing and planning for the expansion of their
departments prior to and during an emergency and for recruiting necessary Emergency Government Volunteers
to supplement regular department employees.
Nothing in this section shall be construed so as to limit the Emergency Government Coordinator from
immediately commencing organizational planning programs as required by the Emergency Operations Plan
adopted by the Bayfield County Board of Supervisors.
(3) Joint Action. Municipalities entering into joint action with Bayfield County will provide for �-.
utilization of existing services of municipal government by enactment of an ordinance parallel to this .-
section of the county ordinance.
Section 8. OTHER EMERGENCIES
(1) Joint Action Municipalities. In the event of the governor determining that an emergency exists
growing out of natural or manmade disasters, the County Emergency Government Coordinator will activate
and coordinator the Emergency Government Services at the appropriate level of government affected by the
emergency.
(2) Non -Joint Action Municipalities. In the event of a natural or manmade disaster, the County
Coordinator will coordinate the munic)Palities affected and render such assistance as is required and
available from county resources.
(3) Penalties. It shall be unlawful for any person willfully to obstruct, hinder, or delay any
member of the emergency government organization in the enforcement or any act forbidden by any order,
rule, regulation or plan issued pursuant to the authority contained in this ordinance. For a violation
of any of the provisions of this ordinance he shall forfeit not less than $100.00 nor more than $500.00
and in default of payment thereof, shall be imporiso.ned in the county j ail for a period not exceeding
90 days.
(4) Repeal of Prior Resolutions. Any resolution herein before adopted by the County Board consistent
with the provisons of this ordinance are hereby repealed.
(5) Effective Date. This ordinance shall take effect and be in force upon passage and publication.
This ordinance shall take effect and be in force on March 1, 1984.

The following resolution was read: No. 12
WHEREAS, The Personnel Committee was involved in contract negotiations with the unions, and
WHEREAS, The AFSCME Union had as one of their proposals a "payroll savings deduction" and
WHEREAS., A resolution was adopted on November 21, 1983, and
WHEREAS, The committee has since been asked to provide for payroll deductions for insurance other
than what the county provides, and
WHEREAS, It is the opinion of the Personnel Committee that they do not wish to have any further
payroll deductions of any kind, now, therefore, be it
RESOLVED, That the Personnel Committee of the Bayfield County Board recommend to the County Board
of Supervisors assembled this 7th day of February, that they go on record as being opposed to any more pay-
roll deductions of any kind, other than what is required by law.

The following resolution was -read: No. 13
WHEREAS, The labor contract between Bayfield County and the Bayfield County Highway Department Union
General Drivers Local No. 346 expired on December 31, 1983, and
WHEREAS, The Personnel Committee of the Bayfield County Board has been nogotiating with the
Bayfield County Highway Department Union, General Drivers Local No. 346, for a new labor contract, and
WHEREAS, The two parties have come to an agreement on anew contract, now, therefore, be it
RESOLVED, That the contract which expired on December 31, 1983, be renewed with the changes and
additions as outlined in the settlement agreement attached to and made a part of this resolution and be
it further
RESOLVED, That the proper county officials are authorized and directed to execute the new revised

LETTER OF AGREEMENT
The following shall constitute a negotiated offer of settlement between the parties as follows:
1. One year contract, January 1, 1984, through December 31, 1984.
2.. The terms and conditions of this settlement except wages, shall be effective as of January 1, 1984,
Wages shall be effective as of March 15, 1984.
3. Wages: Effective March 15, 1984, each wage classification shall be increased by 400 per hour.
4. Sick Leave; Increase the number of sick leave to 90 days.
5. Holidays: Increase the holidays by 12 day and apply this 12 day to New Year's Eve Day to create
a full day holiday for New Year's Eve Day.
6. Workers Compensation : The county will pay the first 3 days of compensation without any reimbUrse-
ment from the employee.
7. Clothes Dryer: The county shall within 30 days following approval of this settlement agreement by
the County Board, purchase a clothes dryer which shall be installed for use by the'-.1burner-welder, machinists
and machanics as set forth in Section 1, Article 33.
The county within 10 days following the county board approval shall mail the 1984 contract to the union.
The union within 30 days thereafter shall sign the contract and return it to the county. If this procedure
is followed, the employees shall have any wage and benefits available on the pay period following receipt
of the contract.

The following resolution was read: No. 14
WHEREAS, The labor contract between Bayfield County and the Bayfield County Dispatcher -Jailers Local
Union AFSCME, AFL-CIO expired on December 31, 1983, and
WHEREAS, The Personnel Committee of the Bayfield County Board has been negotiating with the Bayfield
County Dispatcher -Jailers Local Union AFSCME AFL-CIO for anew labor contract and
WHEREAS, The two parties have come to an agrement on a new contract, now therefore, be it
RESOLVED, That the 'contract which expired on December 31, 1983, be renewed with the changes and additions
as outlined in the settlement agreement attached to and made a part of this resolution and be it further

LETTER OF AGREEMENT
The following shall constitute the agreement for the year 1984 between the Union and the county:
1. One year agreement, January 1, 1984, through December 31, 1984.,
2. Wages: Effective March 15, 1984, increase each step of the salary schedule by 5%.
.3. Mileage: Increase the mileage allowance to 240 per mile.
4. Holidays: Adjust the holiday schedule by adding an additional 1 day holiday to Good Friday whereby

Good Friday shall become a full. day holiday.

5. Sick Leave: Increase the sick leave accumulation to 90 days.

nurses department for their employees who are subject to the hours of the courthouse.
The vote of the majority of each voting unit shall determine the hours for that voting unit.
If the hours are to be changed, the change shall be effective as of March 1, 1984.

The clerk read the following excerpt from the December 27, 1979 county board minutes:
"WHEREAS, The Personnel Policy for Bayfield County employees dated July, 1974, provides on Page 6
under Item 18 - MEALS - as.follows: "County Board members.or other county employees or officers, except
officers and employees of the Sheriff's Department, shall not receiveany, meal allowance except when on
duty away from the County.seat. Expenditures over $2.00 shall be accompanied by a receipt'll and
WHEREAS, The Executive Committee and the,Personnel Committee are of the opinion that Bayfield County
should not reimburse any employee for meals while on regular duty for the county during normal working
hours, now therefore be it
RESOLVED, -By the Bayfield County Board in session this 13th day of November, 1979, that said Item
18 - MEALS - of the Personnel Policy be amended to read as follows:
County Board members or other county employees or officers shall not receive any meal allowance while
on duty during normal working hours in either Ashland or Bayfield County exeept that said county board
members,employees, or officers shall be entitled to receive reimbursement for'meal expenses incurred anywhere
while an county business attending or traveling to or from any convention, seminar, or other regular or
special meeting, and be it further
RESOLVED, That "meeting" as referred to in this resolution shall not include county board meetings
or county board committee meetings except if such meetings3are held away from the county seat and are
duringor extend into the noon or evening lunch hour, and be it further
RESOLVED, That all reimbursable meal expenditure claims of over $3.50 shall be accompanied by a receipt.

Dear Board Members:
From 1978 to 1983, 1 have owned property, legal description, NW SE, Sec. 17-49-8, in Bayfield County,
Wisconsin. I was informed that taxes1frOm 1977 were due on,this property and that these must be paid
before the public auction date. First, I must tell you that I was unaware to this point in time that
any taxes were outstanding on the property, and secondly, that on December 4, 1983, 1 sent the county
treasurer a check for $100.00, which was funded by my bank on the 12 of December, 1983. 1 believe the
amount due in taxes for 1977 was $65.26. 1 have received no change from the overpayment and furthermore,
I have been informed that Bayfield County has my property; however, I received no written notice
to this affect.
5. 1984
At this time, I respectfully request that the county reinstate my claim (title) to this property since all
taxes have been paid to date of alleged possession.

The clerk informed the'board that Ms. Pate had been notified that the taxes were delinquent
and the county would be taking a tax deed by both the county treasurer and the district attorney.
However, the clerk also stated that there was an error in the treasurer's office,for the
taxes of 1979. The taxes due were listed bn the wrong line; therefore, the county treasurer recommended
to allow the redemption of property.

Binding arbitration and the rally to be held in Madison opposing it were next discussed.
Stephenson stated opposition to binding arbitration would give more power to the county
during negotiations.
McGillivray added that it may give the county more power in negotiations; however, it also
leaves the door open for employee strikes.
By a show of hands the board voted on whether they opposed the issue of binding arbitration
or whether they were for it. Three members favored binding arbitration, thirteen members opposed it,
one member abstain.ed from voting and two members were absent.

The clerk brought up the following request from Darrell Fuhrman. Bayfield County issued
a quit claim deed to Darrell Fuhrman some years ago. Fuhrman then issued a warranty deed to J. Darwin.
Darwin in turn issued another deed to a Mr. Anderson and it seems there was a conveyance on these lots
which was recorded in the Register of Deeds.Office, but by some oversight was not listed in the tract
index. Therefore, this di&';not show up on the deed issued to Darwin. The problems with the deed were
straightened out by Robert Norlin who is charging Fuhrman $85 for his services.
Fuhrman is requesting the county to -pay the $85 as he feels it was the county's error.
